The paper maps out an alternative to a behavioural (economic) approach to business ethics. Special attention is paid to the fundamental philosophical principle that any moral ‘ought’ implies a practical ‘can’, which the paper interprets with regard to the economic viability of moral agency of the firm under the conditions of the market economy, in particular competition. The paper details an economic understanding of business ethics with regard to classical and neo-classical views, on the one hand, and institutional, libertarian thought, (...) on the other hand. Implications are derived regarding unintentional and passive intentional moral agency of the firm. The paper moves on to suggest that moral agency can be economically viable in competitive ‘market’ interactions, which is conventionally disputed by classical/neo-classical and institutional, libertarian economics. The paper here conceptualises active moral agency of the firm as the utilisation of ethical capital in firm--stakeholder interactions. This yields a reinterpretation of instrumental stakeholder theory. (shrink)

The paper reconstructs in economic terms Friedman's theorem that the only social responsibility of firms is to increase their profits while staying within legal and ethical rules. A model of three levels of moral conduct is attributed to the firm: (1) self-interested engagement in the market process itself, which reflects according to classical and neoclassical economics an ethical ideal; (2) the obeying of the "rules of the game," largely legal ones; and (3) the creation of ethical capital, which allows moral (...) conduct to enter the market process beyond the rules of the game. Points (1) and (2) position the Friedman theorem in economic terms while point (3) develops an economic revision of the theorem, which was not seen by Friedman. The article reconstructs, in economic terms, managerial business ethics perceptions in the Japanese consumer market for fast-moving daily consumption products. An economic, three-level model of moral agency was applied that distinguishes unintentional moral agency, passive intentional moral agency and active intentional moral agency. The study took a qualitative approach and utilized as empirical research design an interview procedure. The study found that moral agency of Japanese firms mostly extended up to unintentional and intentional passive moral agency. The article suggests that in a modern context, where value pluralism is a prevailing and possibly, even ethically desirable interaction condition, institutional economics provides a more viable business ethics than behavioural business ethics, such as Kantianism or religious ethics. The article explains how the institutional economic approach to business ethics analyses morality with regard to an interaction process, and favours non-behavioural, situational intervention with incentive structures and with capital exchange. The article argues that this approach may have to be prioritised (...) over behavioural business ethics, which tends to analyse morality at the level of the individual and favours behavioural intervention with the individual’s value, norm and belief system, e.g. through ethical pedagogy, communicative techniques, etc. Quaker ethics is taken as an example of behavioural ethics. The article concludes that through the conceptual grounding of behavioural ethics in the economic approach, theoretical and practical limitations of behavioural ethics, as encountered in a modern context, can be relaxed. Probably only then can behavioural ethics still contribute to raising moral standards in interactions amongst the members (stakeholders) of a single firm, and equally, amongst (the stakeholders of) different firms. The paper critiques the relationship between personalist ethics and institutional economics, and accepts that institutional economics can be difficult to reconcile with humanistic management that builds on personalist ethics. Even so the paper connects impersonalist ethics with institutional economics. On this ground, the paper demonstrates how theory and practice of personalist humanist management can lean on impersonalist ethics, i.e., institutional economics. Three pathways are laid out for such leanings. It is argued that to understand these alignments is important to improve (...) the success of humanistic management, when a market economy context is given. The paper further contends that personalist humanistic management may imply abandoning the market economy when it positions itself in opposition to institutional economic reasoning that underpins the market economy. The Adam Smith problem refers to a claimed inconsistency between the Theory of Moral Sentiments and the Wealth of Nations, regarding the portrayal of human nature in these two books. Previous research predominantly resolved the claimed inconsistency by uncovering virtuous, less selfish character traits in the Wealth of Nations. This article voices caution. I acknowledge – on methodological grounds – fundamental differences regarding the portrayal of human nature in Smith’s behavioral ethics, i.e. the Theory of Moral Sentiments, as compared with (...) Smith’s economic research. The key argument is that Smith’s two books address different research problems and hence do not, need not and cannot adopt the same view of human nature – for methodological reasons, so my argument. Adam Smith scholarship overlooked that Smith himself in considerable degrees understood “economic man” as a heuristic abstraction. I connect to the philosophies of science of Imre Lakatos and Karl Popper. (shrink)

Originally published in 1971 by Winthrop Publishers, Inc., this volume provides a discussion and analysis of the theory of natural law as it appears in contemporary political and social thought. This theory of natural law was used from the fifth century B.C. until the end of the eighteenth century to provide a universal, rational standard to determine the nature and limits of political obligation, the evaluation of competing forms of government, and the relation of law and politics to morals.

This article analyzes why journalism ethics has remained a subfield of journalism law in Japan rather than having become a distinct field of study in its own right. The historical reasons for this situation are traced to the introduction of the concept of social responsibility1 to postwar Japan. Premises of the Hutchins Commission and the American Society of Newspaper Editors are contrasted with a number of Japanese perspectives about the proper role of news media in society and the resolution of (...) journalistic dilemmas. The e-value of a hypothesis H, ev, is a Bayesian epistemic, credibility or truth value defined under the Full Bayesian Significance Testing mathematical apparatus. In this paper, I will examine the notion of an epistemic dilemma, its characterizations in the literature, and the different intuitions prompted by it. I will illustrate that the notion of an epistemic dilemma is expected to capture various phenomena that are not easily unified with one concept: while some aspects of these phenomena are more about the agent in a certain situation, other aspects seem to be more about the situation as such. As a consequence, incompatible intuitions emerge concerning (...) the transparency of epistemic dilemmas as well as regarding the role that doxastic suspension plays in resolving cases of epistemic dilemma. I suggest to distinguish between the mental state of agents who find themselves in an epistemic dilemma and the normative situation that gives rise to a dilemma. I will refer to the agent’s mental state as epistemic conflict and will reserve the term epistemic dilemma for evidential situations in which epistemic principles either recommend incompatible doxastic responses or render all options impermissible. The concept of epistemic conflict not only captures the mental state of agents who find themselves in a genuine epistemic dilemma but also applies to agents who face difficult epistemic choices that they cannot resolve without substantial cognitive (and often pragmatic) effort, for example, via doxastic suspension. Taking his critique of totalitarianizing conceptions of community as a starting point, this text examines Jean-Luc Nancy's work of an ‘ontology of plural singular being’ for its political implications. It argues that while at first this ontology seems to advocate a negative or an anti-politics only, it can also be read as a ‘theory of communicative praxis’ that suggests a certain ethos – in the form of a certain use of symbols (which is expressed only inaptly by the word ‘style’) (...) that would render the ontological plurality of singulars perceptible and practically effective. Finally, some recent texts by Nancy even sidestep the ontology of being-with and face the question of what politics, faced with demands of justice, could be and what a democratic politics could provide. Both of these aspects in Nancy's work, however, still remain to be spelled out more politically. (shrink)

Beyond the Pleasure Principle is Freud's most philosophical and speculative work, exploring profound questions of life and death, pleasure and pain. In it Freud introduces the fundamental concepts of the "repetition compulsion" and the "death drive," according to which a perverse, repetitive, self-destructive impulse opposes and even trumps the creative drive, or Eros. The work is one of Freud's most intensely debated, and raises important questions that have been discussed by philosophers and psychoanalysts since its first publication in 1920. In the 1920s, Carnap and Schlick both made an important use of definitions in their main publications: Schlick, in his Allgemeine Erkenntnislehre (1918, 2nd ed. 1925) and Carnap in Der logische Aufbau der Welt (1928, mostly written by 1925). In this paper, we first provide an analysis of the kinds of definitions that are distinguished in these books and a few other papers, and we then propose a systematic comparison of Schlick’s and Carnap’s diverging conceptions of definitions in the 1920s, (...) relating them, in both cases, to their respective philosophical projects in the Allgemeine Erkenntnislehre and in Der logische Aufbau der Welt. The use of certain performance-enhancing drugs (PED) is banned in sport. I discuss critically standard justifications of the ban based on arguments from two widely used criteria: fairness and harms to health. I argue that these arguments on their own are inadequate, and only make sense within a normative understanding of athletic performance and the value of sport. In the discourse over PED, the distinction between “natural” and “artificial” performance has exerted significant impact. I examine whether the distinction makes sense (...) from a moral point of view. I propose an understanding of “natural” athletic performance by combining biological knowledge of training with an interpretation of the normative structure of sport. I conclude that this understanding can serve as moral justification of the PED ban and enable critical and analytically based line drawing between acceptable and nonacceptable performance-enhancing means in sport. This meta-study applies a socio-semiotic framework combining five basic communicational aspects, form, content, act, time, and space, developed to help answering the questionCan animals refer?It further operates with four levels, sign, utterance, genre, and lifeworld, studying relations between utterance and genre in particular. Semantic key terms found in an excerpted ‘resource collection’ consisting of three anthologies, two academic journals, and a monography, studying content in animal communication, are inspected, and discussed, especially information, functional reference, and reference. Since a temporary inspection (...) concluded that the field seems unable to give convincing joint answers, the scope of the meta-study was extended to include critical investigations of implicit communicational epistemologies applied in the sources. Two major challenges were brought to surface. Firstly, the problem of conflicting interrelatedness in animal utterances (parts versus whole). Positioning analyses revealed that theories and project-designs were mostly dyadic, prioritising form/content, content/function, or function/form, and rarely form/content/function, as a whole. The second concerned the issue of functional openness of animal communication systems. The meta-study found that more recent studies tend to reduce an essentialist search for ‘clear’ categories in favor of more complex designs, where focus is less on references in utterances as such and more on a species’ communicational system. This shift in turn leads to a problematisation of the role of context, kinds of communication (life-genres) and semantic levels in animal utterances, in other words, on animal communication for particular species as a whole. Although this study inspects context in general, it is even intended as a prerequisite for a meta-study of contextual time&space in zoo-communication. Moving the scope from linguistics to culture, communication, and semiotics may reveal new similarities between context-perceptions. Paradigmatic historical moves and critical context theories are inspected, asking whether there is a least-common-multiple for perceptions of context. The short answer is that context is relational – a bi-product of attention from a position, creating a focused object, and hence an obscured (...) (back-)ground – the attention’s context. A more comprehensive one is that when the focused phenomenon is culture, semiotics, or communication, context becomes embodied. This recognition triggers new questions: What is the relation between embodied, immanent context and this perception’s external, physical context (its surroundings)? If utterances are regarded as constituted by the triad form-content-act and the dyadic chronotope time&space, what and where is then context? Which challenges will empirical (zoo-)communicational research face if context is split in internal and external versions of context? These questions raise some epistemological and methodological issues. These are discussed based on a framework that regards communication as a micro-macro interplay between utterance and genre. Genres are kinds of communication. More specifically animal genres related to their basic life-functions are called life-genres. A conclusion is that life-genres function as both mental and situational contexts. This complicates empirical research on communication in general, and zoo-communication in particular. The paper concludes that contexts’ relational and embodied nature and the ‘situational’ characteristics of life-genres challenge researchers to validate continuously, shifting between contextualising, decontextualising, and recontextualising. This meta-study of animal semantics is anchored in two claims, seemingly creating a fuzzy mismatch, that animal utterances generally appear to be simple in structure and content variation and that animals’ communicative understanding seems disproportionally more advanced. A set of excerpted, new studies is chosen as basis to discuss whether the semantics of animal uttering and understanding can be fused into one. Studies are prioritised due to their relatively complex designs, giving priority to dynamics between syntax, semantics, pragmatics, and between (...) utterers and receivers in context. A communicational framework based on utterance theory is applied as a lens for inspection of how these aspects relate to the assumed mismatch. Inspection and discussions of the studies bring several features to surface of which five are stressed in the following. Firstly, both syntactic structures and possible semantic content are seen as lean, although richer than earlier believed, and research continues to reveal new complexities in utterances. Secondly, there is a clear willingness to broaden the perception of animals’ semantic capacity to comprehend communication both by arguing theoretically and by generating empirical research in new contexts. Thirdly, the ambition to make sense of these tendencies is still often motivated by an evolutionary search for early building blocks for verbal language, with the pro et cons that such a position can have. Fourthly, the ‘allowed’ scientific frame for studying semantic capacity among animals is extended to new fields and contexts challenging the only-in-the-wild norm. Fifthly, the dilemma of integrating uttering and understanding as aspects of an after all functional communicational system, calls for new epistemological concepts to make sense of the claimed mismatch. This work provoked immediate controversy and has continued to be an important reference for anyone interested in the intersection of philosophy, psychology, religion, and culture. Included in this volume is Oskar Pfister's critical engagement with Freud's views on religion. Pfister, a Swiss pastor and lay analyst, defends mature religion from Freud's "scientism." The introduction claims that there might exist an evolutionary bridge from possible genres in nature to human cultural genres. A sub-hypothesis is that basic life-conditions, partly common for animals and humans, in the long run can generate so-called life-genres. To investigate such hypotheses a framework of interrelated key communicational concepts is outlined in the second, main part. Four levels are suggested. Signs are seen as elements in utterances. Further, sufficiently similar utterances can be perceived as kinds of utterances or genres. (...) Genres are kinds of communication in a species' life-world. Utterance and genre are the framework’s key concepts. Both are seen as products and processes and as constituted by five reciprocal aspects: form, content, act, time, and space, the necessary elements to initiate and interpret communication. A model illustrates this integrative principle. Part three dwells with the idea of life-genres, and part four exemplifies and problematises how a chimpanzee’s ‘begging’ for meat, a fish’s nest-making, and kinds of birdsongs, could be seen as possible life-genres. According to the Differences of Sex Development Regulations of the International Association of Athletics Federations, Caster Semenya and other athletes with heightened testosterone levels are considered non-eligible for middle distance running races in the women’s class. Based on an analysis of fair equality of opportunity in sport, I take a critical look at the Semenya case and at IAAF’s DSD Regulations. I distinguish between what I call stable and dynamic inequalities between athletes. Stable inequalities are those that athletes cannot impact (...) or control in any significant way such as inequalities in biological sex, body size and chronological age. Dynamic inequalities, such as inequalities in strength, speed and endurance, or in technical and tactical skills, can be impacted and to a certain extent controlled by athletes. If stable inequalities exert significant and systematic impact on performance, they provide a rationale for classification. If high testosterone level is an inborn, strong and systemic driver of performance development, inequalities in such levels can provide a rationale for classification. As is emphasised by the Court of Arbitration for Sport, this leads to a dilemma of rights: the right of Semenya to compete in sport according to her legal sex and gender identity, and the right of other athletes within the average female testosterone range to compete under fair conditions. I conclude with providing conditional support of the CAS decision in the Semenya case and of IAAF’s DSD Regulations. (shrink)
