Les premiers travaux réalisés sur les effets du confinement du printemps 2020 sur les enfants ont établi que ceux qui étaient en résidence alternée l’avaient mieux vécu que les autres. L’objectif de cet article est de comprendre pourquoi. À partir de l’enquête Sapris et plus particulièrement du sous-échantillon des enfants âgés de 8-9 ans des cohortes Elfe et Epipage2, nous comparons les conséquences du confinement sur les enfants selon la structure familiale dans laquelle ils vivaient. Continu dans les (...) familles nucléaires, le temps familial est habituellement beaucoup plus fractionné entre les résidences des parents pour les enfants de familles séparées. Le confinement est venu transformer les expériences habituelles du temps familial pour les enfants, aussi bien dans son organisation que dans sa texture. Il a modifié leur cadre de vie ordinaire, en réorganisant leurs occupations au quotidien et en modifiant leurs relations avec leurs parents. En observant particulièrement les différences apparues entre les résidences alternées qui ont continué et celles qui ont été interrompues, nous montrons que si les mouvements réguliers des enfants ont pu constituer une respiration bienvenue pour les différents acteurs concernés, les alternances interrompues ont ouvert des espaces exceptionnels dans lesquels il a été possible de renouer avec des formes passées de continuité familiale. Prendre la décision de déménager en France ou à l’étranger après un divorce ou une séparation, c’est accepter de prendre le risque de voir la résidence de son enfant fixée au domicile de l’autre parent. Les décisions rendues par les juridictions françaises illustrent en effet une idée sous-jacente de sanction à l’encontre du parent qui extrait l’enfant du lieu de résidence habituelle de la famille. Celui qui, en s’éloignant, fait obstacle à la poursuite de la résidence (...) class='Hi'>alternée ou à l’exercice du droit de visite et d’hébergement de l’autre parent prend le risque de perdre le bénéfice des droits qui lui ont été conférés sur la résidence de l’enfant. Par une comparaison des décisions rendues en la matière, l’auteure, avocate spécialiste en droit de la famille et du patrimoine, propose d’établir une matrice de réflexion permettant à un parent divorcé ou séparé d’anticiper les questions inhérentes à un projet de déménagement et d’établir les étapes à suivre pour conserver la résidence de son enfant. Le droit applicable à l’exercice de l’autorité parentale a été remanié par la loi du 4 mars 2002. Il existe désormais un statut légal du couple parental, applicable quelle que soit la situation familiale des parents, conditionné par l’établissement du lien de filiation de l’enfant. Ce droit commun est gouverné par un principe supérieur : les père et mère exercent en commun l’autorité parentale. La consécration progressive d’un principe d’autorité parentale conjointe (1970,1987,1993, 2002) est certes un progrès en ce qu’elle (...) invite les parents à s’accorder et à se consulter dans l’exercice de l’autorité parentale, mais l’indifférenciation des situations familiales sur laquelle repose désormais la notion de « coparentalité » est excessive en ce qu’elle conduit à détacher le principe du modèle d’un couple uni. Une autre orientation pourrait être prise : celle consistant à rapprocher du mariage le concubinage avec vie maritale, ce qui supposerait de prendre en la matière le contre-pied de la loi de 1999. L’apport le plus apparent de la loi du 4 mars 2002 est de prévoir tout un arsenal de dispositions de nature à assurer l’effectivité du principe de coparentalité, en particulier les conventions et la résidence alternée. Les conventions marquent, sous l’angle de la notion d’ordre public, l’avènement du pluralisme familial, nouveauté encadrée par un corps de règles de plus en plus tentaculaire. Quant à la résidence alternée, cette modalité présente le défaut majeur d’être désormais légale, ce qui implique sa vocation à s’appliquer à tous. Il serait souhaitable pour cette raison de rétablir dans la loi le principe de la résidence habituelle de l’enfant chez l’un de ses parents et de réserver la résidence alternée à la pratique judiciaire, à titre très exceptionnel et expérimental, pour des enfants en âge de l’assumer. Les auteurs ont étudié les médiations réalisées dans le cadre d’une association, durant une année, en dirigeant leur recherche sur les attentes des parents séparés, et les motifs et conditions de mise en place de la médiation. La moitié de ces médiations sont imposées par le juge aux Affaires familiales, mais cependant ce n’est pas le fait qu’elle soit ordonnée ou le choix volontaire d’une médiation qui permettent la réussite de ce processus, mais bien l’adhésion des personnes qui viennent. Une (...) partie de ces médiations ont été consacrées à la question de la résidence alternée. L’enjeu central du partage de la vie de l’enfant justifie souvent – pour les juges comme pour les parties – l’utilisation de ce processus dont le résultat ne se compte pas en nombre d’accords conclus mais en possibilité de débloquer les situations. La médiation permet d’ajuster les attentes, et non des motifs « judiciarisés », et de les travailler – de faire en quelque sorte des compromis « sur mesure ». (shrink)

Pour un pédopsychiatre, le concept de médiation est indissociable de celui d’intérêt de l’enfant, ce terme étant défini comme la protection de la sécurité et du développement affectif et intellectuel de l’enfant. Dans les situations de divorce concernant des enfants petits, il est donc indispensable que les professionnels impliqués aient des connaissances précises concernant les besoins d’un nourrisson, et en particulier qu’ils soient familiers avec la théorie et la clinique de l’attachement. Lorsque le couple se sépare, les liens se distendent mais ne sont pas immédiatement rompus. En effet, la séparation effective se trouve retardée pour diverses raisons : d’abord parce que l’un des époux – voire les deux – peut ne pas vouloir, au regard de convictions personnelles, envisager de rompre le lien conjugal ; ensuite parce que les époux peuvent se trouver confrontés aux lenteurs d’une procédure de divorce ; enfin – et plus généralement – parce que la séparation passe (...) aussi par le retour à l’autonomie financière et patrimoniale, imposant à chacun de décider du partage des biens acquis pendant la vie commune. S’agissant des enfants communs, le législateur de 2002 a limité les effets de la rupture du couple parental en tenant l’enfant éloigné des conflits et des bouleversements engendrés par la désunion de ses parents, consacrant ainsi la notion de coparentalité, et ce dans l’intérêt des enfants. Au-delà, il s’agit également de garantir à l’enfant le maintien des liens qu’il a pu entretenir jusqu’à présent avec chaque composante de son entourage familial (frères et sœurs, grands-parents). Residents are important participants and stakeholders in destination development. Identifying factors that assist in predicting resident pro-environmental behavior (PEB) may contribute to enhanced sustainability. Based on a traditional Chinese culture, this research constructed a model of resident PEB by introducing pro-environmental destination image (PEDI) and Confucianism as the independent and moderating variables, respectively. The structural equation modeling for 402 residents indicated the model had a satisfactory level of predictive power for PEB. The results showed that: (1) PEDI positively affected residents’ (...) environmental identity, pro-environmental attitudes, and PEB; (2) environmental identity and pro-environmental attitudes completely mediated the impact of PEDI on residents’ PEB; and (3) Confucian culture had a positive U-shaped moderating effect in the relationships among these four variables. Overall, these findings advance the understanding of the formation of PEB in Confucian culture and provide theoretical and practical implications for fostering residents’ PEB. (shrink)

Although the moral foundations of voting rights regulations have been the subject of widespread scrutiny, there is one aspect of the debate which has gone largely unquestioned and is currently accepted in every state’s actual voting rights regulations. This is the requirement of prior residence, which stipulates that immigrants are granted the right to vote only once they have lived in the host country for a certain period of time. It is this requirement I call into question in this paper. (...) Taking up the most plausible justifications for this requirement, I aim to put substantial pressure on its moral acceptability by arguing that it is not directly grounded by any of the principles that are currently defended as a means to determine the demos, nor a proxy for some other morally relevant feature, nor a warrantor for abilities held to be significant for the right to vote. This research aims to analyze the professionalization process of Master students in an adult education program, based in the University of Rennes (Brittany). The material uses ten reflexive analysis papers, produced by the students for each end of their year session (Master 1 and Master 2). This reflexive production, which aims to formalize and clarify the articulation of theoretical and praxeological aspects of the Master program, shows the integrative experience acquired during the year. The analysis of these papers allows us (...) to characterize the process of professional development from a model articulating three dimensions : 1) the identity dynamics linked with the process of professionalization, 2) the progressive professional socialization required by this professionalization, 3) the development of a specific posture, as a reflexive practitioner. The methodology employs a content analysis through inter-rater method. The results of this research offer a discussion on theoretical and practical levels, both for a better comprehension of professional development and for the trainers or program managers, to support this process of professionalization. I propose a principle of non-domination as a benchmark for assessing the justifiability of unequal residence statuses for non-nationals in liberal democracies. This has advantages over the principles of equality and rights alike, in accommodating both the inclusive and exclusive logics of liberal democratic citizenship. Non-domination requires the state to grant upon first admission a degree of inclusion in the social privileges of citizenship that is sufficient to guard against the most severe forms of domination in social relationships. However, as (...) resident non-nationals become more permanent and come to be in relationships open to other, if less severe forms of domination, it requires gradually increasing the degree of inclusion, over time, to protect non-nationals against these forms of domination also, and, finally, eventually giving them access to the sites of political decision-making that contribute to shaping the background conditions for independent action in social relationships. Dans le cadre d’une ouverture des frontières à l’échelle internationale, la question de la résidence à prévoir au sens légal est d’une importance cruciale. En effet, le statut juridique est devenu un incontournable dans les discussions sur la liberté de circulation, avec le système migratoire que nous connaissons aujourd’hui, gouverné par un contrôle strict et stratifié selon le type de migrant. Le présent article vise à examiner les manifestations contemporaines de ce contrôle et à formuler des pistes de solution (...) sur le type de droit de résidence à prévoir advenant une ouverture des frontières. Nous explorerons tout d’abord les fondements de la liberté de circulation et des protections juridiques pour les migrants, pour ensuite passer en revue le traitement des résidents non citoyens dans l’expérience canadienne et américaine, dans celle de l’Union européenne et dans le cadre des phénomènes de migrations Sud-Sud afin de faire un compte-rendu pour résoudre la question portée en titre. Public parks play important roles in conserving biodiversity, promoting environmental sustainability, fostering community engagement, and enhancing the overall well-being of residents in urban areas. Nevertheless, finance is needed to maintain and expand the greenspaces in the parks. The current study aims to examine how perceptions of biodiversity loss consequences and park visitation frequency influence the residents’ willingness to contribute financially to tree-planting projects in public parks. Employing the Bayesian Mindsponge Framework analytics on a dataset of 535 Vietnamese urban residents, we (...) discovered that perceived health loss and knowledge erosion as consequences of biodiversity loss and park visitation frequency are directly positively associated with financial donation willingness. Meanwhile, the perceived economic growth loss was found to be indirectly positively associated with donation willingness through park visitation frequency, whereas the perceived loss of nature-based recreation opportunities exhibits the opposite indirect association. Based on these results, communication strategies focusing on the multifaceted benefits of biodiversity preservation and investments in public parks are recommended to improve urban residents’ financial support to park panting initiatives, accessibility to greenspaces, and connections with nature. These are crucial for promoting an eco-surplus culture that enhances biodiversity conservation and human well-being. (shrink)

Dispersal of individuals from their natal communities at sexual maturity is an important determinant of kin association. In this paper we compare postmarital residence patterns among Pumé foragers of Venezuela to investigate the prevalence of sex-biased vs. bilateral residence. This study complements cross-cultural overviews by examining postmarital kin association in relation to individual, longitudinal data on residence within a forager society. Based on cultural norms, the Pumé have been characterized as matrilocal. Analysis of Pumé marriages over a 25-year period finds (...) a predominant pattern of natalocal residence. We emphasize that natalocality, bilocality, and multilocality accomplish similar ends in maximizing bilateral kin affiliations in contrast to sex-biased residential patterns. Bilateral kin association may be especially important in foraging economies where subsistence activities change throughout the year and large kin networks permit greater potential flexibility in residential mobility. This article focuses on practical, ethical and political issues that arise in the context of cetacean conservation. Our point of departure is the controversy surrounding plans to assist J50, an ailing member of the southern resident orca population, during the summer of 2018. A brief history of cetacean captivity provides context for the current backlash against captivity. We then argue that, in many cases, interventions aimed at capture, rehabilitation and release are practically feasible and that such interventions are ethically justifiable. (...) Democratic theory offers robust resources in order to defend the claim that noncitizens are, in many cases, entitled to the right to vote in their place of residence, regardless of their citizenship. On this, Avner de Shalit and I are in broad agreement. But the route we take to justify this right rests on substantially different argumentation: whereas I believe that residence is necessary and sufficient to justify the right to vote at the municipal and, more controversially, at the national (...) level, de Shalit believes that noncitizens must also intend to reside in a city over the longer term in order to merit the right to vote on city matters. I will argue that this focus on intention is dangerous for the most vulnerable of city dwellers, who are most in need of the right to vote, even if only at the city level. In particular, I argue that the only way that the right to vote can play its protective role is if it is available to migrants on the basis of residence, regardless of their stated intention. Self-regulation, or the ability to effectively manage emotions and behavior, is a critical skill to develop in early childhood. Children living in a context of economic hardship are at an increased risk for developing self-regulation difficulties. However, few studies have comprehensively examined how multiple aspects of the caregiving environment, including fathers’ parenting and coparenting quality, may contribute to child self-regulation. Thus, this study applied a family systems perspective to examine whether coparenting and resident and non-resident fathers’ reports of parenting quantity (...) and quality were associated with observations of children’s self-regulation. Participants were drawn from the Embedded Developmental Study of the Three-City Study, a longitudinal study of children and families facing economic hardship. At Wave 1, when children were 2–4 years old, reports of parenting and coparenting were obtained. At Wave 2, when children were 3–6 years old, children participated in a snack delay and gift wrap task, which assessed their self-regulation. Multi-group path analyses indicated that resident fathers’ harsh parenting at Wave 1 predicted decreased levels of self-regulation at Wave 2. Non-resident fathers’ reported hours of involvement at Wave 1 predicted greater levels of self-regulation at Wave 2. Additionally, supportive coparenting among families with a non-resident father predicted greater self-regulation. Supportive coparenting was not associated with child self-regulation in families with a resident father. The implications for research focused on facilitating positive father–child relationships in diverse family contexts are discussed. (shrink)

Community-Based Tourism (CBT) has been presented as an alternative to sustain tourism development in developing countries. This tourism model offers local residents an opportunity to manage natural and cultural resources in order to promote local economy and generate greater benefits. The objective of the study is to investigate the benefits, challenges of CBT and solution to address identified shortcomings by studying Muen Ngoen Kong community in Chiang Mai, Thailand. In order to achieve these objectives, qualitative methods; field observation and interview (...) were employed and qualitative data were analyzed by thematic analysis. The results of field observation and interview data from local residents were reported, analyzed, and discussed. To practice CBT, the findings indicated that several challenges; conflict over resource ownership and benefit leaking, financial issues, and problems of community participation had been experienced in implementation of CBT. However, abundance of tourism resources and security related concerns were identified as benefits of CBT in the area. In close collaboration with government agency, product development was recommended to create a unique condition for CBT and address shortcoming. It is crucial to involve local residents, empower the local community, conserve and cultivate cultural resources, and finally, maintain the sustainability of overall tourism resources. (shrink)

This study examined knowledge of sea lions for both residents and tourists on San Cristóbal Island in the Galápagos, a famous nature tourism destination. Participants obtained through convenience and snowball sampling answered questionnaires about their knowledge of sea lions. Participants with higher education received higher overall scores, but participants’ education and age influenced answers on only a few questions. Residents and tourists obtained comparable overall scores, exhibiting extensive knowledge of sea lion behavior and life history. Whether participants were residents or (...) tourists influenced answers to several questions, but when only participants with 13 years of education or more were examined, few differences in answers remained between residents or tourists. Participants’ broad knowledge of sea lions may be attributed to the items of knowledge tested, participants’ motivations for travel to the Galápagos, and the fact that sea lions are an engaging and ubiquitous animal. In 1997, when Oregon became the first U.S. jurisdiction authorizing medical aid in dying (MAID), its law included a requirement that patients be legal residents of the state. Other U.S. jurisdictions legalizing MAID followed Oregon in adopting residency requirements. Recent litigation challenges the legality, as well as the justification, for such requirements. Facing such challenges, Oregon and Vermont eliminated their MAID residency requirements. More states could follow this move, for, in certain circumstances, the U.S. Constitution's privileges and immunities clause protects (...) citizens' right to travel to secure medical care. Policy considerations could also motivate states to reexamine whether such requirements are justified in light of existing evidence of how MAID laws have been applied. (shrink)

Recent studies show that psychiatry residents express a relatively greater need for ethics curricula than their colleagues in other specialties. Such studies have been limited in their generalizability because they were conducted at one site. This study of 151 psychiatry residents at seven U.S. psychiatry programs aims to address that limitation. Residents were surveyed on issues pertaining to ethics and professionalism education. Participants were found to support such curricula during training and to value its relevance to the practice of psychiatry. (...) BackgroundThe emphasis on ethics and professionalism in medical education continues to increase. Indeed, in the United States the ACGME will require residency programs to include professionalism training in all curricula by 2007. Most courses focus on cases generated by the course instructors rather than on cases generated by the trainees. To date, however, there has been no assessment of the utility of these two case discussion formats. In order to determine the utility of instructor-generated cases (IGCs) versus resident-generated cases (RGCs) (...) in ethics and professionalism training, the author developed an innovative course that included both case formats. The IGCs were landmark cases and cases from the experience of the course instructors, while the RGCs were selected by the residents themselves. Residents were then surveyed to assess the strengths and weaknesses of each format.ResultsOf twenty-two second and third year residents, fourteen completed surveys (response rate 64%). Residents were nearly evenly split in preferring RGCs (38%), IGCs (31%), or not preferring one to the other (31%). 29% stated that they learn more from the RGCs, 21% stated that they learn more from the IGCs, and 50% stated that they did not find a difference in their learning based on format. In general, residents surveyed prefer a mix of formats. Residents tended to find the RGCs more relevant and interesting, and felt the IGCs were necessary to ensure adequate breadth of cases and concepts.ConclusionBased on our relatively small sample at a single institution, we believe that educators should consider incorporating both instructor-generated and resident-generated cases in their ethics and professionalism curricula, and should evaluate the utility of such a model at their own institution. The level of impairment shown by the 1.3 million residents of nursing homes in the United States varies significantly, and this raises considerable challenges for how to address the sexual and romantic interests and needs of these diverse individuals. Unfortunately, bright-line rules and a onesize- fits-all approach are often taken when addressing these challenges. This article proposes a novel taxonomy for classifying the potential sexual and romantic relationships of cognitively impaired nursing home residents that includes relationships between unmarried residents, relationships (...) between residents and their own spouses, and adulterous relationships. Training residents to become humanistic physicians capable of empathy, compassionate communication, and holistic patient care is among our most important tasks as physician educators. Narrative medicine aims to foster those highly desirable characteristics, and previous studies have shown it to be successful in fostering self-reflection, emotional processing, and preventing burnout. We aimed to evaluate pediatric residents’ perceptions of a novel narrative medicine curriculum. After the initiation of a longitudinal narrative medicine curriculum, focus groups were conducted with residents who participated in (...) at least one narrative medicine session. The curriculum was viewed positively, and residents found the sessions to be helpful in developing empathy, offering a space for reflection, and introducing new perspectives. Challenges noted were perception of relevance, timing of sessions, and interpretation by non-native English-speaking residents. With attention to linguistics and thematic undertones, narrative medicine is a feasible, replicable, and accepted teaching modality for pediatric residents to foster empathy, process emotions, and participate in self-reflection. When we have asked Hadza whether married couples should live with the family of the wife (uxorilocally) or the family of the husband (virilocally), we are often told that young couples should spend the first years of a marriage living with the wife’s family, and then later, after a few children have been born, the couple has more freedom—they can continue to reside with the wife’s kin, or else they could join the husband’s kin, or perhaps live in a camp (...) where there are no close kin. In this paper, we address why shifts in kin coresidence patterns may arise in the later years of a marriage, after the birth of children. To do so, we model the inclusive fitness costs that wives might experience from leaving their own kin and joining their husband’s kin as a function of the number of children in their nuclear family. Our model suggests that such shifts should become less costly to wives as their families grow. This simple model may help explain some of the dynamics of postmarital residence among the Hadza and offer insight into the dynamics of multilocal residence, the most prevalent form of postmarital residence among foragers. Residents in long-term care facilities and rehab hospitals sometimes ask healthcare professionals to help them do things that HCPs judge to be on balance harmful. A person with respiratory problems may ask for a cigarette, a diabetic for alcohol, a dysphagiac for food or fluids by mouth, a person at risk for falling for her walker, and so on. These requests raise two kinds of problems. The first pits residents against HCPs. Should HCPs ever help residents do what they consider (...) harmful? The second pits HCPs against HCPs. If HCPs disagree among themselves—some thinking that the resident should receive the assistance, others thinking not—what should be done? (shrink)

In three experiments, the relation between different modes of thought and the generation of “creative” and original ideas was investigated. Participants were asked to generate items according to a specific instruction . They either did so immediately after receiving the instruction, or after a few minutes of conscious thought, or after a few minutes of distraction during which “unconscious thought” was hypothesized to take place. Throughout the experiments, the items participants listed under “unconscious thought” conditions were more original. Background Interest in strengthening residents’ autonomy in nursing homes is intensifying and professional caregivers’ experience ethical dilemmas when the principles of beneficence and autonomy conflict. This increased focus requires expanded knowledge of how residents experience decision-making in nursing homes and how being subject to paternalism affects residents’ dignity. Research question/aim This study explored how residents experience paternalism in nursing homes. Research design This study involved a qualitative interpretive design with participant observations and semi-structured interviews. The interpretations were informed by Gadamer’s (...) hermeneutics. Participants and research context Eleven residents were interviewed after a period of participant observation in two nursing homes. Ethical considerations The study was performed in accordance with the Helsinki declaration. The Regional Ethics Committee (REK) permitted the researcher to perform participant observation in the nursing homes. The use of audio recordings of interviews was registered and supervised by Sikt - Norwegian Agency for Shared Services in Education and Research. The resident’s consent was assessed continuously. Three interviews were terminated for ethical reasons. Findings The resident interviews revealed that residents found it obvious for caregivers to possess the decision-making authority in nursing homes. When residents explained their views, three main themes emerged: (1) To be included even though caregivers make the decisions, (2) Surrender to dependency, and (3) Adherence to nursing home norms. Conclusions Residents submit to their caregivers and give caregivers the responsibility and function as leaders. Paternalism was experienced as dignifying in situations where it contributed to residents being able to live according to second order desires and values, and when it implied respect and appraisal of residents’ capabilities. Paternalism was experienced as debasing when residents felt left out, and when residents felt that their capabilities were underestimated. Proper and regular physical activity plays an important role in improving people’s health. With the outbreak of the COVID-19 pandemic, which has posed a serious threat to individual health, residents’ PA has aroused deep concern. Based on the theory of planned behavior, this study examines the impact of residents’ PA intention and behavior in response to the COVID-19 pandemic. Data were collected from a sample of 961 residents in Wuhan in China using a questionnaire survey. The results show that residents’ (...) PA intention and behavior have been affected significantly by residents’ PA attitude, subjective norms, and perceived behavioral control. The COVID-19 pandemic has a significant impact on both residents’ PA intention and behavior. In addition, there were gender and region differences in this impact. The findings are of great significance in promoting residents’ PA intention and PA behavior, which are of positive significance to the development of residents’ physical and mental health in the period of global serious health crisis. Although sufficient attention has been paid to residents' attitudes to tourism in previous studies, few studies have used residents' attitudes to tourists and tourism simultaneously to explain their support for tourism. This study fills this gap by examining the effect of place image and host–tourist interactions on residents' attitudes to tourists and tourism, respectively, and their consequent reactions by considering the moderating effect of Chinese traditionality. The proposed model is tested using data from 357 residents living in Huangshan, a fifth-tier (...) city in China. Results demonstrate that attitudes to tourism and host-tourists interaction positively affect their pro-tourism behaviours. Moreover, attitudes to tourism mediate place the image's, host–tourists interaction's and attitudes to tourists' respective relationships with pro-tourism behaviours. Furthermore, the higher the Chinese traditionality of residents, the stronger the influence of their attitudes to tourism on pro-tourism behaviours. However, the relationship of place image and attitudes of residents towards tourists with pro-tourism behaviours are not supported. Findings offer critical implications for planners, practitioners and interested researchers. (shrink)

The traditional view according to which we adults tacitly consent to a state’s lawful actions just by living within its borders—the residence theory—is now widely rejected by political philosophers. According to the critics, this theory fails because consent must be (i) intentional, (ii) informed, and (iii) voluntary, whereas one’s continued residence within a state is typically none of these things. Few people intend to remain within the state in which they find themselves, and few realize that by remaining they are (...) consenting to the state’s lawful actions. In addition, the various obstacles standing in the way of us leaving the state render our remaining involuntary. Thus, the critics conclude, few if any people can be considered to have consented through their residence. I argue that these objections fail and that the residence theory remains a viable option, at least for those who are not committed incompatibilists. (shrink)

Resident-to-resident aggression is quite prevalent in long-term care settings. Within popular and empirical accounts, this form of aggression is most commonly attributed to the actions of an aberrant individual living with dementia characterized as the “violent resident.” It is often a medical diagnosis of dementia that is highlighted as the ultimate cause of aggression. This neglects the fact that acts of aggression are influenced by broader structural conditions. This has ethical implications in that the emphasis on individual aberration informs public (...) policy strategies for prevention with a focus on restricting the freedom of individuals using behavioural modification, drugs, or other restraints with the intent to protect others from harm. A more ethical approach requires attention to the structural conditions of long-term care that both foster aggression and constrain prevention efforts. To this end, we turn to a model of relational citizenship that offers a theory of embodied selfhood and relationality as essential to human dignity, thus entailing human rights protections. The application of an ethic based on this model offers a more holistic prevention strategy for resident-to-resident aggression by drawing attention to the critical need and obligation to promote human flourishing through system level efforts. In July 2011, the ACGME implemented new rules that limit interns to 16 hours of work in a row, but continue to allow 2nd-year and higher resident physicians to work for up to 28 consecutive hours. Whether the ACGME's 2011 work hour limits went too far or did not go far enough has been hotly debated. In this article, we do not seek to re-open the debate about whether these standards get matters exactly right. Instead, we wish to address the (...) issue of effective enforcement. That is, now that new work hour limits have been established, and given that the ACGME has been unable to enforce work hour limits effectively on its own, what is the best way to make sure the new limits are followed in order to reduce harm to residents, patients, and others due to sleep-deprived residents? We focus on three possible national approaches to the problem, one rooted in funding, one rooted in disclosure, and one rooted in tort law. (shrink)

Over the past decade, a series of studies have found that physicians-in-training who work extended shifts are at increased risk of experiencing motor vehicle crashes, needlestick injuries, and medical errors. In response to public concerns and a request from Congress, the Institute of Medicine conducted an inquiry into the issue and concluded in 2009 that resident physicians should not work for more than 16 consecutive hours without sleep. They further recommended that the Centers for Medicare & Medicaid Services and the (...) Joint Commission work with the Accreditation Council for Graduate Medical Education to ensure effective enforcement of new work hour standards.The IOM's concerns with enforcement stem from well-documented non-compliance with the ACGME's 2003 work hour rules, and the ACGME's history of non-enforcement. In a nationwide cohort study, 84% of interns were found to violate the ACGME's 2003 standards in the year following their introduction. (shrink)
