This article maps out a pedagogical juncture of bell hooks's feminist theory of homeplace (hooks 2007) and Indigenous maternal pedagogies as liberatory praxis through a journey with Indigenous women's literatures. I position this work as a response to the call to transform feminist theorizing through Indigenous philosophies as articulated in a recent Hypatia special issue (Bardwell-Jones and McLaren 2020, 2). The article documents hooks's theory of homeplace as a space of resistance and renewal and shares insights into Indigenous experiences of (...) homeplace within historical and contemporary contexts of genocide, and the ongoing racialized and sexualized violence on Turtle Island. I discuss finding homeplace in Indigenous literatures by sharing a genealogy of Indigenous women's literatures as theorizing tools for engaging social change within academic spaces. To bring this work full circle, I offer Indigenous perspectives of homeplace, and the lessons gleaned from Indigenous women's literatures, as intentional work toward imagining Indigenous futurities. Indeed, connecting this work with liberatory pedagogical praxis imagines a site to establish homeplace in academic settings and empower students to engage in the kind of work that fosters and calls for safer homes, schools, and communities. How is human social intelligence engaged in the course of ordinary conversation? Standard models of conversation hold that language production and comprehension are guided by constant, rapid inferences about what other agents have in mind. However, the idea that mindreading is a pervasive feature of conversation is challenged by a large body of evidence suggesting that mental state attribution is slow and taxing, at least when it deals with propositional attitudes such as beliefs. Belief attributions involve contents that are decoupled (...) from our own primary representation of reality; handling these contents has come to be seen as the signature of full-blown human mindreading. However, mindreading in cooperative communication does not necessarily demand decoupling. We argue for a theoretical and empirical turn towards “factive” forms of mentalizing here. In factive mentalizing, we monitor what others do or do not know, without generating decoupled representations. We propose a model of the representational, cognitive, and interactive components of factive mentalizing, a model that aims to explain efficient real-time monitoring of epistemic states in conversation. After laying out this account, we articulate a more limited set of conversational functions for nonfactive forms of mentalizing, including contexts of meta-linguistic repair, deception, and argumentation. We conclude with suggestions for further research into the roles played by factive versus nonfactive forms of mentalizing in conversation. (shrink)

This paper describes a reduction-graph model of legal precedents that accounts for a key characteristic of legal precedents: a precedent's relevance to subsequent cases is determined by the theory under which the precedent is decided. Historical and Theological Reflections, Matthew Levering writes "to make the case" that there is "good reason" to believe in the bodily resurrection of Jesus (1). In this (...) self-described work of "theological apologetics" (211), Levering argues from a threefold foundation for the credibility of Jesus's resurrection: (1) "the New Testament evidence," considered from the perspective of historical investigation; (2) the "sheer strangeness" of the apostolic claim that [End Page 1347] Jesus was "resurrected" and not just resuscitated or exalted into heaven as an immortal soul; (3) and the intrinsic credibility of the "supreme love" revealed through his death and resurrection (2–4). As this threefold foundation makes clear, Levering draws together both "historical and theological reasons for believing that Jesus' Resurrection happened" (4).In chapter 1, Levering contends that, while "faith does not stand or fall upon the results of historical research, those who insist that the truth of Jesus' Resurrection has nothing to do with the domain of historical investigation are mistaken" (30). To this end, he offers a survey of three figures: (1) the Belgian Dominican theologian Edward Schillebeeckx; (2) the American Protestant biblical scholar Dale C. Allison Jr.; and (3) the Anglican bishop and biblical theologian N. T. Wright. Levering exposes the serious flaws of contemporary attempts to reduce the resurrection claims of early Christians to hallucinations or visions of someone who has recently died. In particular, Levering finds compelling Wright's argument that the bodily resurrection of Jesus provides "the best historical explanation" of the early Christian claim that what first-century Jews expected to happen to everyone at the end of time had in fact happened to only one person—Jesus of Nazareth—in the middle of time. From a strictly historical point of view, claims that the disciples were merely moved by grace to a new experience Jesus being "alive" or that they simply experienced hallucinatory visions of Jesus after his death fail to explain the "radical change of eschatology" that took place in the early Church (56).In chapter 2, Levering explores the question of whether "the Church's mediation is truly effective in enabling us to share in the apostolic communion with the risen Jesus" (63). He first offers a sympathetic overview of the Protestant biblical scholar Richard Bauckham's book Jesus and the Eyewitnesses (2003; 2nd ed., 2017), in which he claims that the Gospels rest largely on "eyewitness testimony" (87–88). According to Levering, Bauckham's historical arguments show that "the ongoing presence of eyewitnesses provides a reason for not being skeptical about the major events of Jesus' life as reported by the Gospels, including his Resurrection" (89). On receiver-based teleosemantic theories of representation, the chemical states of the circadian clocks in animal, plant and cyanobacterial cells constitute signals of future states of affairs, often the rising and setting of the sun. This signalling is much more rigid than sophisticated representational systems like human language, but it is not simple on all dimensions. In most organisms the clock regulates many different circadian rhythms. The process of entrainment ensures that the mapping between chemical states of the clock and the (...) daily light-dark cycle is adjusted to deal with seasonal changes. In regulating anticipatory behaviour, the states of the clock look forward both to the time the behaviour is supposed to happen and the later time when the anticipated circumstances are supposed to arise. The case of the circadian clock shows that purely indicative signals can arise in very basic biological systems and brings into sharp relief the trade-offs involved in characterizing representational systems. On receiver-based teleosemantic theories, future-directed signals are not restricted to complex multicellular organisms but are ubiquitous in the biological world. (shrink)

For a Better Worldliness is not only a statement of Abraham Kuyper's and Dietrich Bonhoeffer's theological concept and historical practice of discipleship. It is also--and perhaps more importantly--a call to engage in the fullness of the Christian life here and now. While this book goes to great efforts to establish sound historical and theological insights specifically in regards to Kuyper and Bonhoeffer, there is a strong underlying current that these particular insights deeply matter to the life of discipleship in the (...) world today. History shows us that discipleship is not a singular journey; because of Jesus Christ it is not a description of one set path with one set of guidelines. A disciple can be a prime minister who unabashedly and successfully campaigned on his Calvinistic principles, just as he can be a participant in a coup d'état launched against a tyrant, leading to the disciple's own imprisonment and death. A fundamental entity is an entity that is ‘ontologically independent’; it does not depend on anything else for its existence or essence. It seems to follow that a fundamental entity is ‘modally free’ in some sense. This assumption, that fundamentality entails modal freedom (or ‘FEMF’ as I shall label the thesis), is used in the service of other arguments in metaphysics. But as I will argue, the road from fundamentality to modal freedom is not so straightforward. The defender of FEMF (...) should provide positive reasons for believing it, especially in light of recent views that are incompatible with it. I examine both direct and indirect routes to FEMF. Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. Testimony is an invaluable source of knowledge. We rely on the reports of those around us for everything from the ingredients in our food and medicine to the identity of our family members. Recent years have seen an explosion of interest in the epistemology of testimony. Despite the multitude of views offered, a single thesis is nearly universally accepted: testimonial knowledge is acquired through the process of transmission from speaker to hearer. In this book, Jennifer Lackey shows that this (...) thesis is false and, hence, that the literature on testimony has been shaped at its core by a view that is fundamentally misguided. She then defends a detailed alternative to this conception of testimony: whereas the views currently dominant focus on the epistemic status of what speakers believe, Lackey advances a theory that instead centers on what speakers say. The upshot is that, strictly speaking, we do not learn from one another's beliefs - we learn from one another's words. Once this shift in focus is in place, Lackey goes on to argue that, though positive reasons are necessary for testimonial knowledge, testimony itself is an irreducible epistemic source. This leads to the development of a theory that gives proper credence to testimony's epistemologically dual nature: both the speaker and the hearer must make a positive epistemic contribution to testimonial knowledge. The resulting view not only reveals that testimony has the capacity to generate knowledge, but it also gives appropriate weight to our nature as both socially indebted and individually rational creatures. The approach found in this book will, then, represent a radical departure from the views currently dominating the epistemology of testimony, and thus is intended to reshape our understanding of the deep and ubiquitous reliance we have on the testimony of those around us. Dispositionality is a modal notion of a certain sort. When an object is said to have a disposition, we typically understand this to mean that under certain circumstances, the object would behave in a certain way. For instance, a fragile object is disposed to break when dropped onto a concrete surface. It need not actually break - its being fragile has implications that, so to speak, point beyond the actual world. According to dispositionalism, all modal features of the world may (...) be accounted for in terms of its dispositional features. My aim in this paper is to assess the prospects for dispositionalism by examining the most promising theories. Sections 1 and 2 clarify the assumptions and desiderata of a successful dispositionalist theory of modality. Section 3 introduces the principles governing the dispositionalist theories that apparently meet the desiderata. Sections 4 through 6 show that dispositionalism nonetheless faces three problems: while dispositions help account for modal features of the world that are local, diachronic, or gradable, they cannot account for certain modal features of the world that are global, synchronic, or absolute. I end by discussing the costs of preserving dispositionalism. (shrink)

Many are reluctant to accept primitive modality into their fundamental picture of the world. The worry often traces to this thought: we shouldn't adopt any more primitive - that is, unexplained - notions than we need in order to explain all the features of the world, and primitive modal notions are not needed. I examine one prominent rival to modal primitivism, combinatorialism, and show that in order to account for all the modal features of the world the combinatorialist must adopt (...) two additional primitive notions. My own modal primitivist view takes as primitive the notion of incompatibility between properties or relations. I show how the non-modal notions that the combinatorialist must adopt as primitive may be analyzed using my notion. The upshot is that with respect to the number of primitive notions, my modal primitivist theory comes out ahead. (shrink)

Ethical codes have been hailed as an explicit vehicle for achieving more sustainable and defensible organizational practice. Nonetheless, when legal compliance and corporate governance codes are conflated, codes can be used to define organizational interests ostentatiously by stipulating norms for employee ethics. Such codes have a largely cosmetic and insurance function, acting subtly and strategically to control organizational risk management and protection. In this paper, we conduct a genealogical discourse analysis of a representative code of ethics from an international corporation (...) to understand how management frames expectations of compliance. Our contribution is to articulate the problems inherent in codes of ethics, and we make some recommendations to address these to benefit both an organization and its employees. In this way, we show how a code of ethics can provide a foundation for ethical sustainability, while addressing management intentions and employees’ ethical satisfaction. (shrink)

The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

This article is the first attempt to justify the "next" milestone in the development of legal realism: hyperrealism. The implications of digitalization have become the new fuel for the legal realist's jurisprudence prediction theory, that is, empirical research to predict the judge's or the court's decision. Indeed, that was impossible for American realists in the early twentieth century, and all the attempts failed. Therefore, tools such as Judicial Analytics allow us to prove that personal motives and prejudices affect a dispute's (...) resolution. Based on a systemic, comparative, and interdisciplinary analysis that intermingles legal theory, data analytics and digital technologies, the article substantiates the concept of hyperrealism itself. It evaluates the advantages and disadvantages of its primary tool—judicial analytics. The authors state the necessity of creating regulatory mechanisms of "curbing" to use them to improve justice and minimize the risk of rights violations. They propose using tools of expert evaluation, standardization, and ethical regulation of forensic analysis. (shrink)
