The article presents the argument that administrative decision-making should be understood as devoted to balancing between conflicting interests of individuals or groups, usually when none of the affected parties has predefined legal rights that are relevant to the substantial content of the administrative decision. Administrative decisions often have a direct effect not only on human and civil rights issues, but also on matters bearing on the quality of life, living conditions, prices of regulated products, and the allocation of government funds. Since the decision as to which interest should prevail in the conflict is a distributive one and has many possible answers, the role of administrative law is primarily to ensure that these decisions are made fairly, with due weight given to the conflicting interests of the various groups and individuals involved. With this as background, the article shows how the doctrines of positive administrative law are designed to meet the challenge of coping with conflicting interests in the administrative decision-making process, using such examples as the prohibitions against decision-makers’ conflicts of interest and the rules regarding interest representation and judicial review. In the second part, the article applies the interest perspective to the administrative decision-making process in order to analyze the highly extensive regulation of land resources in Israel. The analysis concentrates on the Israeli Supreme Court decision in one of the most controversial petitions brought before it: against administrative decisions on the development of formerly agricultural lands. This article focuses on land rights, land law, and land administration within a multilayered colonial setting by examining a major land dispute in British-ruled Palestine. Our research reveals that the Mandate legal system extinguished indigenous rights to much land in the Zor al-Zarqa and Barrat Qisarya regions through its use of "colonial law"--the interpretation of Ottoman law by colonial officials, the use of foreign legal concepts, and the transformation of Ottoman law through supplementary legislation. However, the colonial legal system was also the site of local resistance by some Palestinian Arabs attempting to remain on their land in the face of the pressure of the Mandate authorities and Jewish colonization officials. This article sheds light on the dynamics of the Mandate legal system and colonial law in the realm of land tenure relations. It also suggests that the joint efforts of Mandate and Jewish colonization officials to appropriate land and undertake "development" operations in the area were fueled by neither the interests of colonial rule nor those of Jewish colonization alone, but, rather, by the integrated impact of both forces. There is a growing trend across North America of women being criminalized for their pregnancy outcomes. Rather than being a series of aberrations resulting from institutional failures, we argue that this trend is part of a colonial strategy of administrative violence aimed at women of color and Native women across Turtle Island. We consider a range of medical and legal practices constituting gender-based administrative violence, and we argue that they are the result of non-accidental and systematic production of population-level harms (...) that cannot be disentangled from the goals of ongoing settler occupation and dispossession of Indigenous lands. While white feminist narratives of gender-based administrative violence in Latin America function to distance the places where such violence occurs from the ‘liberal democratic’ settler nation-states of the U.S. and Canada, we hold that administrative forms of reproductive violence against Latin American women are structurally connected to efforts in the U.S. and Canada to criminalize women of color and Indigenous women for their reproductive outcomes. The purpose of these systemically produced harms is to sustain cultures of gender-based violence in support of settler colonial configurations of power. (shrink)

In an increasingly competitive higher education environment, America's public universities are seeking ways to differentiate themselves. This book suggests that a hopeful vision of what a university should be lies in a reexamination of the "land-grant mission," the common system of values originally set forth in the Morrill Land Grant Acts of 1862 and 1890, which established a new system of practically oriented higher learning across the United States. While hard to define, these values are often expressed by (...) the one hundred or so institutions that currently define themselves as "land grants" under the three pillars of research, teaching, and engagement/extension.In order to understand the unique character of a modern land-grant institution, this book focuses especially but not exclusively on the multiple components of a single organization, Oklahoma State University, founded in 1890 and currently enrolling 35,000 students across five campuses. Contributors from across the university focus on what the land-grant mission means to them in their daily endeavors, whether that be crafting the undergraduate academic experience, stimulating research, or engaging with the community through extension activities. The twenty contributions are divided into four parts, exploring in turn the core mission of the modern land-grant university, the university environment, the university's public value, and its accountability. The volume ends with an epilogue by the editor, which summarizes the values underlying the activities of land-grant institutions. In a time of uncertainty in higher education, this volume provides a helpful overview of the many different types of value public universities bring to American society. It also offers a powerful vision of a future founded on land-grant ideas that will be inspiring to university administrators and trustees, other educational policymakers, and faculty and staff, especially those fortunate enough to be part of land-grant institutions. A dizzying trip through the mind(s) of the provocative and influential thinker Nick Land. During the 1990s British philosopher Nick Land's unique work, variously described as “rabid nihilism,” “mad black deleuzianism,” and “cybergothic,” developed perhaps the only rigorous and culturally-engaged escape route out of the malaise of “continental philosophy” —a route that was implacably blocked by the academy. However, Land's work has continued to exert an influence, both through the British “speculative realist” philosophers who studied with him, (...) and through the many cultural producers—writers, artists, musicians, filmmakers—who have been invigorated by his uncompromising and abrasive philosophical vision. Beginning with Land's early radical rereadings of Heidegger, Nietzsche, Kant and Bataille, the volume collects together the papers, talks and articles of the mid-90s—long the subject of rumour and vague legend (including some work which has never previously appeared in print)—in which Land developed his futuristic theory-fiction of cybercapitalism gone amok; and ends with his enigmatic later writings in which Ballardian fictions, poetics, cryptography, anthropology, grammatology and the occult are smeared into unrecognisable hybrids. Land is a constitutional issue in Ethiopia. Article 40 of the FDRE constitution enshrines governing provisions about rural and urban land. Legislation power is given to the federal government (Article 51(5) of the constitution) although this power can be delegated to regions (Article 50(9) of the same constitution). In contrast, administration power is allocated to regions (Article 52 (2(d)) of the constitution). The federal government has enacted the Rural Land Administration and Use Proclamation 456/2005. Both (...) federal and regional land laws have Alternative Dispute Resolution clauses. However, the opportunities and challenges of these clauses from the access to justice perspective are not studied very well. The main objective of this paper is to assess the legal framework and practice of ADR mechanisms in the rural land administration system from the access to justice perspective and come up with a policy option. Doctrinal type of legal research is applied where it involves theory testing which deals with studying existing laws (both federal and regional laws). In addition, both primary and secondary sources have been used. Primary qualitative data was collected through semi-structured interviews. The study found that there are legal constraints. One significant legal constraint is the requirement for mandatory mediation in certain regional states before seeking recourse in a court of law. Mediation is not clearly and uniformly applied per the law and in practice (often the practice and legal framework confuse mediation with arbitration, inappropriately giving decision-making powers to mediators, and turning them into arbiters). Women and Vulnerable Groups are generally more negatively affected by the overreaching of mediators into decision-making, because the mediators are more easily influenced by the party opposing women and Vulnerable Groups, and/or the mediators are culturally biased. This study recommends that mediation should be made optional, where mediators are chosen by the parties and the legal framework is clear that the role of the mediators does not involve imposing decisions. For Oromia and SNNPR, the legal regime of mediation should be clarified to avoid confusion with the arbitration. It is necessary to train community-level mediators in the law and the protection of land rights of Vulnerable Groups against gender discrimination. (shrink)

I raise three objections for Gava’s thesis that the primary task of the Critique of Pure Reason is to develop a doctrine of method for metaphysics, understood as an account of the special kind of unity that a body of cognitions must exhibit to count as a science. First, I argue that this thesis has difficulty accommodating Kant’s concern with explaining the possibility of synthetic a priori judgements. This concern is motivated by a question that is prior to the issue (...) of scientific unity. Second, I argue that the context of the passage in which Kant calls the Critique a treatise on method makes clear that the remark concerns the Copernican Turn. This suggests that the method treated in the book is the procedure required by the Copernican Turn. Third, I dispute Gava’s claim that the idea that confers unity on metaphysics is the cosmopolitan concept of philosophy. (shrink)

The central theoretical assumption of English land law (and land law in related legal systems) that all rights in land are derivative of the Crown’s rights does not provide a full account of the origins of rights in land. ‘Liberal’ theories of the origin of property rights, which see property rights as something that emerged independently of state action, retain considerable explanatory value. The paper begins with a discussion of the principal features of David Hume’s account (...) of the origins of property. The paper then engages with historical scholarship that shows that (1) it is a mistake to see the medieval English hierarchy of administration as implying a hierarchy of property rights ultimately derived from the Crown’s ‘title,’ and (2) the idea that communal medieval agricultural practices were super-imposed upon a pre-existing system of individual property rights is plausible. In 1894, the Institut Colonial International was founded in Brussels, with the aim to engage and promote transnational exchanges between jurists, scholars, politicians, colonial administrators and experts, comparing different colonial experiences. As the Institut Colonial International’s founders had hoped, its publications promoted legal debates, discussions and the prospects of specific legislation, decrees or norms to be adapted and used in entirely different colonial systems. This paper will show that the Institut Colonial International encouraged the exchange of ideas about the various (...) colonial experiences in order to create common and universal principles. International law and domestic law, or national law concerning land register systems and land law were part of the colonial discourse as it endeavoured to create and adopt universal principles of law, trying to establish a platform of common dialogue, with common premises, concerning different colonies, different colonial experiences and ultimately different cultural, social and political contexts. ArgumentData collections are a hallmark of nineteenth-century administrative knowledge making, and they were by no means confined to Europe. All colonial empires transferred and translated these techniques of serialised and quantified information gathering to their dominions overseas. The colonial situation affected the encounters underlying vital statistics, enquête methods and land surveying. In this paper, two of those data collections will be investigated—a survey on land and a survey on indigenous law, both conducted around 1910 on the Micronesian island (...) of Pohnpei, which had fallen under German colonial influence a decade earlier. Strikingly, there are no enumerators or envoys of the state visiting the doorsteps of Pohnpei. To facilitate the data collection on homesteads, the whole population of the island was called upon to measure their respective plots of land themselves, without resorting to certified land surveyors. The preserved cadastral lists and spreadsheets testify to a rather peculiar contact between the colonizing administration and the colonized peoples. I argue that the production of data made encounters necessary, which are best observed though a methodological focus on data practices. I argue, furthermore, that the Pohnpeians were prompted during the surveys to define their homestead in new terms. This did not only entail new two-dimensional plots but also a new regime of private property. The change in the legal concept can be seen as a continuation of colonial violence by other means, given that it happened in the aftermath of the defeated Pohnpei Rebellion. The argument of the paper is, therefore, that data collection can have formative effects on society, and that measurement and quantified information are often, as Witold Kula argued, a scene of conflict. At its core, the installation of these metric regimes signified a change in patterns of justification, resource management and the unwritten constitution of the Pacific island. (shrink)

Abstract:In Scotland, policies supporting the development of wind farms frequently come into conflict with those designed to protect wild land. The siting of turbines is, amongst other things, administered by wild land areas, whilst wild land areas are, in part, characterized by the absence of turbines. In this article, I focus on how the classification of wild land has been constructed in official narratives and I describe the substantial scale of collaborative human labor implicated in this (...) process. I draw on the story of a public local inquiry into a wind farm proposal to make visible some of the contradictions implicit in the term's use and to argue that wildness, as conceived by Scottish Government, is primarily an aesthetic category which relies on absences. I argue that employing wild land as an administrative technology conceals the various kinds of labor that are intrinsic to creating wild land. The work of extending and reinforcing the technologies which govern land use is hidden behind the notion of wild land as a place from which human exertions and technologies are absent. (shrink)

The expression oikoi stratiōtikoi, used in Constantine VII Porphyrogenitus as opposed to oikoi politikoi, designates all those families who were bound to military service. They, in the tenth century, were listed in various enlistment registers that were periodically updated, among which one was kept in Constantinople. There is solid evidence to argue that such an administrative practice originated in the eighth century, coinciding with a significant transformation in the enrolment of soldiers and their maintenance. A conscription procedure was devised in (...) the age of the Isaurians, which, although it is not known whether it was on a voluntary or compulsory basis, entailed the entry in the military records (in Constantinople and the provinces) of every person in charge (oikodespotēs) of the family that had assumed the military burden. This implied in later periods a strong uncertainty in the relationship between service and its performance because registration rested on an ambiguous vocabulary. The ambiguity, in fact, was rooted in the polysemy of the concept of oikos, family unit, home and patrimony at the same time. While such a notion allowed the recruitment in thematic armies to function flexibly through the wide network of the family’s cognate and agnatic structure, precisely because the oikos was also a set of economic interests, it exposed the landed patrimony of military families to splitting and erosion. This ambiguity ended with Constantine VII’s famous law of 949, which regulated the property regime of the stratiōtikoi oikoi, a regime that, as the same provision explicitly states in several points, already existed previously throughout the empire. The law provided a precise economic quantification of the assets needed for each ‘military family’ to perform the service. Historiography has generally interpreted Constantine VII’s measure as an act breaking with the previous tradition, since military service appears in it much more markedly connoted as a patrimonial burden, rather than as a personal one. However, this ‘oppositional’ interpretation does not seem adequate for understanding the concept of oikos stratiōtikos, which from the outset must have implied a profound interrelationship between the personality of the service and its patrimonial basis, since the one did not exist without the other. Kalavun's son as heir Salih Ali in Egypt, published to Zaynaddin Ketboğa a tazkire that dated April-1281 containing the martial law decisions. Tezkire talks about the duties and responsibilities of administrators in the context of state-security-service. These decisions are important state affairs in the flow of daily life such as the judiciary, law, justice, security, transportation, service, trade, (...) class='Hi'>land, fair tax system, control of civil servants and state affairs. In addition, the healthy living conditions of the detainees, It also includes issues such as meeting the needs of the detainees such as churches and baths. Tazkire decisions aiming to ensure the flow of daily life in Egypt during wartime without causing a possible instability are always valid state policies aiming at state order and social welfare. In our article, we will talk about this tezkire, which was narrated as a full text by İbnü'l-Furât (d. 1405) and Kalkaşendî (d. 1418). (shrink)

In the rabbinic literature from the land of Israel the poor are depicted not as passive recipients of gifts and support, but as independent agents who are responsible for their own behaviour. Communal care for the needy was expected to go beyond their basic needs for food, clothing and shelter; the physical safety of the poor and the value of their time as well as their dignity and self-worth were also included in the scope of charity. In this monograph, (...) Yael Wilfand offers a comprehensive and contextual analysis of major rabbinic texts on poverty and charity composed during the first five centuries of the Common Era in the land of Israel, principally the Mishnah, the Tosefta, the Palestinian Talmud and midrashim. She shows that, for the rabbis, the poor were not necessarily considered outsiders; indeed, some students and rabbis in Palestine may have personally experienced poverty. Wilfand claims that such socio-economic diversity contributed to the thinking of these rabbis, who rarely saw poverty as a result of transgression (in contrast to the Babylonian Talmud). This book presents a number of contrasting viewpoints held by Palestinian rabbis over such questions as: Must communal administrators ensure applicants' eligibility for alms? Should the newly indigent from wealthy families receive exceptional levels of support? Might neighbouring gentiles qualify for economic assistance from Jewish communal sources? By examining Palestinian rabbinic sources within the contexts both of the hegemonic Greco-Roman (later, Christian) milieu and of the biblical heritage, this volume offers an absorbing account of some ancient approaches to timeless social challenges. Life on the road was anything but glamorous for Farm Security Administration photographers traveling through southern Illinois in the mid-1930s. Often their most promising subjects lived at the end of the worst roads, many of which lacked bridges, drainage ditches, or gravel. Outfitted with three government-issue cameras, flashbulbs, tripods, and film-processing chemicals, their job was to help explain America to Americans by seeking out and photographing the one-third of the nation FDR described as ill-housed, ill-clad, and ill-nourished. Featured in (...) this book are more than one hundred photographs from the collection of a quarter of a million taken by FSA photographers between 1935 and 1943. These pictures capture life during the Great Depression as viewed in the coal-mining towns of Herrin, West Frankfort, and Zeigler; the river communities of Shawneetown, Cairo, and Grayville; the farming regions near McLeansboro, Newton, and Harrisburg--more than two dozen southern Illinois county seats, hamlets, and landings. Together they comprise a photographic portrait of the determination, hard work, and capacity to find ways to celebrate life exemplified by the people of southern Illinois during one of the most difficult periods of American history. FSA photographers helped to invent and popularize the documentary style, a type of photography in which pictures and their arrangement carry much of the information in a story. Intended to document the success of a government project, these pictures survived to preserve for later generations the story of the people of southern Illinois and how they endured the difficult times of the Great Depression. Taxation of residential property is difficult to be implemented in many jurisdictions and in this respect Lithuania is not an exception. Many taxpayers do not comprehend why property should be levied by the government. Indeed, any owner of real estate would usually resist to any attempts to increase this tax burden. However, even when the threshold is once overstepped and a new unpopular statutory framework is introduced, the government still faces new dilemmas regarding the administration of this tax. Sometimes (...) weak tax administration but not the tax itself undermines the credibility of the public. Commercial premises as well as land have been continuously levied in the Republic of Lithuania since 1990. Thus, the taxes paid by enterprises and the land tax were not a big issue of public debate in Lithuania. The burden of this tax was not very significant in the light of all taxes paid by enterprises or land owners. The most problematic issue remains the taxation of residential property. (shrink)

The specific issue addressed in this paper is urban encroachment on agricultural lands, and the problems it poses for both analysis and the conservation of the land resource. The purpose of our discussion is two-fold: (1) to identify where and why traditional analytical and regulatory approaches fail to resolve land use conflicts, and (2) to explore ways and means of resolving some of the dilemmas which society faces in making land use decisions. This paper's contribution is in (...) the spirit of Getting Incentives Right for the inter-temporal transfer of wealth, as represented in trade-offs between environmental and resource endowments and human and physical capital. Efforts are placed on identifying what the appropriate price, levy, taxes, and grant ratios ought to be in order to encourage individuals in the marketplace to act in society's interest. We have also explored ways of efficiently transmitting those incentives through the market mechanism, without unduly relying on bureaucratic methods or suasion. Emphasis is placed on mechanisms that have little scope for preferential access and are subject to public scrutiny; emphasis on such self-disciplining approaches should result in less effort expended on (unproductive) lobbying activities and bureaucratic administration. This paper examines the Obama Administration’s approach to democracy promotion in Egypt. After a brief discussion of the motivation for promoting democracy, this essay compares the Obama Administration to its predecessor and analyzes the changes that were spurred by the Arab Awakening. Did the Obama Administration, during and after the 2011 Revolution, fully support democratic change in Egypt not only with rhetoric but also with the financial and programmatic support necessary to help a transitioning country? Did the (...) Obama Administration offer a consistent message on the importance of democratic policies? Or did the administration allow other policy objectives to trump democratic efforts? This paper explores the language, policies, and funding employed by the Obama Administration in Egypt to see what the impact has been. (shrink)

This chapter addresses the problem of ranking available drugs in guideline development to support clinicians in their work. Based on a pragmatic approach to the notion of evidence and a hierarchical view on different kinds of evidence this chapter introduces a decision aid, HiDAD, which draws on the multi criteria decision making literature. This decision aid implements the wide-spread intuition that there are different kinds of evidence with varying degrees of importance by relying on a strict ordinal ordering of kinds (...) of evidence. In order to construct a ranking every pair of drugs is first compared separately on all kinds of evidence. Next, these quantitative comparisons are then aggregated into an overall comparison between drugs based on all the available evidence in a way which avoids that evidence of less importance is trumped by evidence of the higher levels. Finally, these overall comparisons are used to determine the final ranking of drugs which then informs the process of guideline writing. Properties, modifications and applicability of the decision aid HiDAD are discussed and assessed. (shrink)

C. I. Lewis’s conception of the given element in perceptual experience was one of the targets of Sellars’ famous charge that many such conceptions fall victim to the Myth of the Given. Yet exactly what makes a conception of the given mythical has remained unclear. Here I aim to clarify this issue by discussing Eric Watkins’ recent claim that a conception exactly like the one Lewis articulated in Mind and the World Order in fact avoids the Myth. Watkins motivates this (...) claim in part by raising objections for John McDowell’s account of the Myth and argues that a better account can be extracted from Kant. I defend McDowell’s position (and reject Watkins’ Kantian account) by arguing that these objections are based on a failure to appreciate an implication of the claim (which Watkins accepts) that rational thought operates in “the logical space of reasons.” Specifically, I focus on the implication that a thinker must be in a position to understand the rational significance of her perceptual experience. Along the way I explain in what ways Watkins’ conception of the given in experience mirrors the view of Lewis. (shrink)

Bu çalışmanın amacı, İmam Hatip Lisesi öğrencilerinin İmam Hatip Lisesi, İmam Hatip Lisesi meslek dersi öğretmeni ve İmam Hatip Lisesi idaresine ilişkin algılarını metaforlar yoluyla tespit etmektir. Araştırma, nitel araştırma desenlerinden fenomenolojik (olgubilim) desende tasarlanmıştır. Amaçlı örnekleme yöntemlerinden ölçüt örnekleme yoluyla belirlenen çalışma grubu, 2018-2019 eğitim öğretim yılında 5 farklı İmam Hatip Lisesinde 9. ve 12. sınıfta öğrenim gören 412 öğrenciden oluşmaktadır. Araştırmanın verileri katılımcıların, “İmam Hatip Lisesi…gibidir; çünkü…”, “İmam Hatip Lisesi Meslek dersi öğretmeni… gibidir; çünkü…”, “İmam Hatip Lisesi idaresi…gibidir; (...) çünkü…” cümlelerini tamamlamaları yoluyla toplanmıştır. Elde edilen verilerin analizinde tümevarımcı içerik analizi yöntemi kullanılmıştır. İçerik analizi sonucu oluşturulan temalar/kategoriler SPSS programında frekans, yüzde ve çapraz tablo olarak analiz edilmiştir. Araştırma sonucuna göre, öğrencilerin “imam hatip lisesi” ile “imam hatip lisesi meslek dersleri öğretmenlerine” ilişkin algılarının olumlu olduğu, fakat İmam Hatip Lisesi idarecilerine ilişkin algılarının ise olumsuz olduğu belirlenmiştir. Bunun yanında erkek öğrencilerin, imam hatip ortaokulundan mezun öğrencilerin ve 9. Sınıf öğrencilerinin metaforik algılarının daha olumlu olduğu görülmüştür. Özet: Bu çalışmanın temel amacı, İmam Hatip Lisesi öğrencilerinin İmam Hatip Lisesi, İmam Hatip Lisesi meslek dersi öğretmeni ve İmam Hatip Lisesi idaresine ilişkin algılarını metaforlar yoluyla tespit etmektir. Türk eğitim sistemi içerisinde yer alan İmam Hatip Liseleri 1924 yılında açılmış, hem mesleğe hem de yükseköğretime öğrenci yetiştiren bir ortaöğretim kurumudur. Öğretim programında yer alan derslerin ortalama %40’ı dini mesleki dersler, %60’ı ise kültür derslerinden oluşmaktadır. Meslek derslerini meslek dersleri öğretmenleri vermektedir. Bu okulların yönetiminde, meslek dersi öğretmenlerinin yanında farklı branşlara ait idareciler de bulunmaktadır. Türkiye’de 2018-2019 eğitim öğretim yılı itibariyle ortaöğretime devam eden öğrencilerin %11’i bu okulları tercih etmektedir. Bu araştırma, nitel araştırma desenlerinden fenomenolojik (olgubilim) desende tasarlanmıştır. Amaçlı örnekleme yöntemlerinden ölçüt örnekleme yoluyla belirlenen çalışma grubu, 2018-2019 eğitim öğretim yılında 5 farklı İmam Hatip Lisesinde 9. ve 12. sınıfta öğrenim gören 412 öğrenciden oluşmaktadır. Araştırmanın verileri nitel araştırmada veri toplama tekniği olarak kullanılan metaforlar yoluyla toplanmıştır. Araştırmanın verileri katılımcıların, “İmam Hatip Lisesi…gibidir; çünkü…”, “İmam Hatip Lisesi Meslek dersi öğretmeni… gibidir; çünkü…”, “İmam Hatip Lisesi idaresi…gibidir; çünkü…” cümlelerini tamamlamaları yoluyla elde edilmiştir. Elde edilen verilerin analizinde tümevarımcı içerik analizi yöntemi kullanılmıştır. İçerik analizi sonucu oluşturulan temalar/kategoriler (olumlu-olumsuz) SPSS programında frekans, yüzde ve çapraz tablo olarak analiz edilmiştir. Araştırmada, öğrencilerin, İmam Hatip Lisesine ilişkin 140, meslek dersi öğretmenlerine ilişkin 147, idarecilere ilişkin 161 metafor ürettikleri görülmüştür. Ürettikleri metaforların analiz edilmesi sonucunda, temelde olumlu ve olumsuz olmak üzere iki kategoride toplandığı anlaşılmıştır. Araştırmaya katılan öğrencilerin ortalama üçte ikisi (%63,3) İmam Hatip Lisesine ilişkin olumlu metafor (93) üretirken, üçte biri (%36,7) ise olumsuz (47) metafor üretmiştir. Olumlu olarak üretilen metaforlar içerisinde en sık tekrarlanan metaforların “Evimiz (33/%8,01)”, “Aile ( 24/% 5,83) ve “Kur’an Kursu (14/%3,40)” metaforlarının olduğu; olumsuz olarak en sık tekrarlanan metaforların ise “Cezaevi/hapishane (76/%18,45)”, “Düz lise (12/%18,45)”, “Kötü bir yer (6/%6)” şeklinde olduğu görülmüştür. Bu bulgulara göre öğrencilerin yarıdan fazlasının İmam Hatip Lisesine ilişkin olumlu metaforik algıya sahip oldukları söylenebilir. Araştırmada kız öğrencilerin erkek öğrencilere göre İmam Hatip Lisesini daha fazla olumsuz algıladıkları görülmüştür. Araştırmaya katılan öğrencilerin dörtte üçü (%77,4) meslek dersi öğretmenlerine ilişkin olumlu (98) metafor üretirken, beşte birlik kısmın (%22,6) ise olumsuz (49) metafor ürettikleri belirlenmiştir. Olumlu olarak üretilen metaforlar içerisinde en sık tekrarlanan metaforların “İyi biri (34/%8,25)”, “Abla-abi (32/%7,77)”, “Aile (31/%7,52)”, metaforlarının olduğu; olumsuz olarak en sık tekrarlanan metaforların ise “Kötü biri (10/%2,42)”, “Diğer öğretmen (7/%1,70)”, “Sıkıcı (6/%1,46)” şeklinde olduğu görülmüştür. Bu bulgu öğrencilerin büyük çoğunluğunun meslek dersi öğretmenlerine ilişkin olumlu metaforik algıya sahip olduğunu göstermektedir. Araştırmaya katılan öğrencilerin üçte biri (%35) idarecilere ilişkin olumlu (67) metafor üretirken, üçte ikisinin (%65) ise olumsuz (94) metafor ürettikleri belirlenmiştir. Olumlu olarak üretilen metaforlar içerisinde en sık tekrarlanan metaforun “Aile (22/%5,34)”, “İyi biri (14/%3,40))”, “Disiplinli (7/%1,70)” metaforlarının olduğu; olumsuz olarak en sık tekrarlanan metaforların ise “Gardiyan (32/%7,77)”, “Aşırı disiplinli (30/%7,28)”, “Kötü (30/%7,28)” şeklinde olduğu görülmüştür. Öğrencilerin oluşturduğu diğer metaforların “diktatör, baskıcı, polis, hapishane, hapishane müdürü, sert, baskıcı baba, mahkeme salonu, komutan, dedektif, askerlik” gibi baskı ifade eden metaforlar olması dikkat çekicidir. Bu veriler idarecilerin öğrencilerin yarıdan fazlası tarafından olumsuz olarak algılandığı; idarecilerin öğrencilerin zihninde baskı yapan eğitimci imajı bıraktığı söylenebilir. Araştırmada kız öğrencilerin (%77) erkek öğrencilere (%41,3) göre okul idaresini daha fazla olumsuz algıladıkları görülmüştür. Sonuç olarak, İHL öğrencilerinin okullarına ve meslek dersi öğretmenlerine ilişkin metaforik algılarının olumlu yönde olduğu, fakat okul idarecilerine karşın olumsuz olduğu görülmektedir. Bu bağlamda öğrencilerin idareci algıları üzerine farklı çalışmaların yapılması gerektiği söylenebilir. (shrink)

You can perceive things, in many respects, as they really are. For example, you can correctly see a coin as circular from most angles. Nonetheless, your perception of the world is perspectival. The coin looks different when slanted than when head-on, and there is some respect in which the slanted coin looks similar to a head-on ellipse. Many hold that perception is perspectival because you perceive certain properties that correspond to the “looks” of things. I argue that this view is (...) misguided. I consider the two standard versions of this view. What I call the PLURALIST APPROACH fails to give a unified account of the perspectival character of perception, while what I call the PERSPECTIVAL PROPERTIES APPROACH violates central commitments of contemporary psychology. I propose instead that perception is perspectival because of the way perceptual states are structured from their parts. (shrink)

The book offers the reader a key to understanding Merleau-Ponty's subtle methodology and highlights the urgency and relevance of his research into the ontological significance of expression for today's work in art and cultural theory. This book is the culmination of the COST Action CA15212 Citizen Science to Promote Creativity, Scientific Literacy, and Innovation throughout Europe. It represents the final stage of a shared journey taken over the last 4 years. During this relatively short period, our citizen science practices and perspectives have rapidly evolved. In this chapter we discuss what we have learnt about the recent past of citizen science and what we expect and hope for the future.

Conceptual engineering is a philosophical method that aims to design and spread conceptual and linguistic devices to cause meaningful changes in the world. So far, however, conceptual engineers have struggled to successfully spread the conceptual and linguistic entities they have designed to their target communities. This paper argues that conceptual engineering is far more likely to succeed if it incorporates empirical data and empirical methods. Because the causal factors influencing successful propagation of linguistic or conceptual devices are as complicated and (...) interwoven as they are, proper empirical research will greatly boost the likelihood that propagation is successful. In arguing for the superiority of empirical conceptual engineering over armchair-based conceptual engineering, this paper proposes a framework for understanding the causal forces at play in propagation. This is a three-part framework between the label of a lexical item, the psychological states associated with the lexical item, and the worldly things associated with the lexical item. By understanding the way causal forces affecting propagation play out at these three levels, conceptual engineers can better conceptualize, study, and harness the different causal forces affecting the success of their conceptual engineering projects. Conceptual engineering is the practice of revising concepts to improve how people talk and think. Its ability to improve talk and thought ultimately hinges on the successful dissemination of desired conceptual changes. Unfortunately, the field has been slow to develop methods to directly test what barriers stand in the way of propagation and what methods will most effectively propagate desired conceptual change. In order to test such questions, this paper introduces the masked time-lagged method. The masked time-lagged method tests people's (...) conceptual understanding at two different points in time without their knowledge of being tested, allowing us to measure conceptual revision in action. Using a masked time-lagged design on a content internalist framework, we attempted to revise PLANET and DINOSAUR in online participants to match experts' concepts. We successfully revised PLANET but not DINOSAUR, demonstrating some of the difficulties conceptual engineers face. Nonetheless, this paper provides conceptual engineers, regardless of framework, with the tools to tackle questions related to implementation empirically and head-on. (shrink)

Mental capacities for perceiving, remembering, thinking, and planning involve the processing of structured mental representations. A compositional semantics of such representations would explain how the content of any given representation is determined by the contents of its constituents and their mode of combination. While many have argued that semantic theories of mental representations would have broad value for understanding the mind, there have been few attempts to develop such theories in a systematic and empirically constrained way. This paper contributes to (...) that end by developing a semantics for a ‘fragment’ of our mental representational system: the visual system’s representations of the bounding contours of objects. At least three distinct kinds of composition are involved in such representations: ‘concatenation’, ‘feature composition’, and ‘contour composition’. I sketch the constraints on and semantics of each of these. This account has three principal payoffs. First, it models a working framework for compositionally ascribing structure and content to perceptual representations, while highlighting core kinds of evidence that bear on such ascriptions. Second, it shows how a compositional semantics of perception can be compatible with holistic, or Gestalt, phenomena, which are often taken to show that the whole percept is ‘other than the sum of its parts’. Finally, the account illuminates the format of a key type of perceptual representation, bringing out the ways in which contour representations exhibit domain-specific form of the sort that is typical of structured icons such as diagrams and maps, in contrast to typical discursive representations of logic and language. An ongoing philosophical discussion concerns how various types of mental states fall within broad representational genera—for example, whether perceptual states are “iconic” or “sentential,” “analog” or “digital,” and so on. Here, I examine the grounds for making much more specific claims about how mental states are structured from constituent parts. For example, the state I am in when I perceive the shape of a mountain ridge may have as constituent parts my representations of the shapes of each peak and saddle (...) of the ridge. More specific structural claims of this sort are a guide to how mental states fall within broader representational kinds. Moreover, these claims have significant implications of their own about semantic, functional, and epistemic features of our mental lives. But what are the conditions on a mental state's having one type of constituent structure rather than another? Drawing on explanatory strategies in vision science, I argue that, other things being equal, the constituent structure of a mental state determines what I call its distributional properties—namely, how mental states of that type can, cannot, or must co‐occur with other mental states in a given system. Distributional properties depend critically on and are informative about the underlying structures of mental states, they abstract in important ways from aspects of how mental states are processed, and they can yield significant insights into the variegation of psychological capacities. Philosophical discussions on causal inference in medicine are stuck in dyadic camps, each defending one kind of evidence or method rather than another as best support for causal hypotheses. Whereas Evidence Based Medicine advocates the use of Randomised Controlled Trials and systematic reviews of RCTs as gold standard, philosophers of science emphasise the importance of mechanisms and their distinctive informational contribution to causal inference and assessment. Some have suggested the adoption of a pluralistic approach to causal inference, and an inductive (...) rather than hypothetico-deductive inferential paradigm. However, these proposals deliver no clear guidelines about how such plurality of evidence sources should jointly justify hypotheses of causal associations. We here develop such guidelines by first giving a philosophical analysis of the underpinnings of Hill’s viewpoints on causality. We then put forward an evidence-amalgamation framework adopting a Bayesian net approach to model causal inference in pharmacology for the assessment of harms. Our framework accommodates a number of intuitions already expressed in the literature concerning the EBM vs. pluralist debate on causal inference, evidence hierarchies, causal holism, relevance, and reliability. Varied evidence confirms more strongly than less varied evidence, ceteris paribus. This epistemological Variety of Evidence Thesis enjoys widespread intuitive support. We put forward a novel explication of one notion of varied evidence and the Variety of Evidence Thesis within Bayesian models of scientific inference by appealing to measures of entropy. Our explication of the Variety of Evidence Thesis holds in many of our models which also pronounce on disconfirmatory and discordant evidence. We argue that our models pronounce rightly. Against (...) a backdrop of failures of the Variety of Evidence Thesis, the intuitive case for the Variety of Evidence Thesis emerges strengthened. Our models do however not support the general case for the thesis since our explication of it fails to hold in certain cases. The parameter space of this failure is explored and an explanation for the failure is offered. (shrink)

This paper highlights the role of Lewis’ Principal Principle and certain auxiliary conditions on admissibility as serving to explicate normal informal standards of what is reasonable. These considerations motivate the presuppositions of the argument that the Principal Principle implies the Principle of Indifference, put forward by Hawthorne et al.. They also suggest a line of response to recent criticisms of that argument, due to Pettigrew and Titelbaum and Hart, 621–632, 2020). The paper also shows that related concerns of Hart and (...) Summary In relation to King Pyrrhus of Epirus, a great number of studies have analysed his different military campaigns, but very few have focused on the political and economic aspects of his reign. Based on a series of references taken from literary accounts, we seek to demonstrate how the internal organisation of the Kingdom of Epirus under Pyrrhus was similar to that of other contemporaneous Hellenistic kingdoms, replete with a Court consisting of a large number of the king’s friends and (...) companions. Using certain archaeological evidence, especially funerary remains, we seek to reflect the existence of this Epirote élite in material terms. The literary tradition bears witness to an interest in agriculture and livestock farming during Pyrrhus’ period, although the accounts handed down to us provide little detail. Once again, archaeology enables us to provide corroborating evidence. In this respect, we focus on the existence of a series of fortified rural residences distributed in irregular manner throughout Epirote territory, which are interpreted as being those of the members of this aristocratic élite, who used these fortified enclosures as centres of exploitation for their lands and as symbols of their power and prestige. As comparative points of reference that enable us to understand these processes, we provide various examples from neighbouring Macedonia, a kingdom with which Epirus maintained close links, especially as of the mid-fourth century B.C., which appears to be the period in which many of these new developments also began to emerge in Epirus, reaching their culmination during the reign of Pyrrhus. In the recent debate between conceptualists and nonconceptualists about perceptual content, Kant’s notion of intuition has been invoked on both sides. Conceptualists claim Kant as a forerunner of their position, arguing that Kantian intuitions have the same kind of content as conceptual thought. On the other hand, nonconceptualists claim Kant as a forerunner of their own position, contending that Kantian intuitions have a distinctly nonconceptual kind of content. In this paper, I argue first, that both sides are wrong about Kant, (...) secondly, that neither side can properly account for the epistemic function of intuition, and thirdly, that Kant’s own notion of intuition contains the resources for a third alternative. The epistemic function of an intuition for Kant is to furnish the sensory representation of an object of cognition. Conceptualism cannot account for this function because it construes perception as a species of thought. As a proper appreciation of Kant’s reasons for insisting upon the heterogeneity of thought and perception puts one in a position to see, any view that does this will fail to do justice to the distinctly sensory nature of intuition. Nonconceptualism, on the other hand, cannot account for the epistemic function of intuition because it views intuition as self-standing, and thus as completely independent from thought. As a consequence, nonconceptualism is not entitled to claim that an intuition is itself a cognitive state. I show that Kant’s actual view avoids both these extremes because it involves a different way of conceiving how perception is informed by conceptual thought. Building on this conception, Kant is able to preserve the distinctly sensory nature of intuition, while also securing proper cognitive standing for it. As a result, Kant’s notion of intuition provides the resources for an alternative account of how thought relates to the senses – one that avoids the shortcomings of the positions staked out in the contemporary debate. Objective Bayesian epistemology invokes three norms: the strengths of our beliefs should be probabilities, they should be calibrated to our evidence of physical probabilities, and they should otherwise equivocate sufficiently between the basic propositions that we can express. The three norms are sometimes explicated by appealing to the maximum entropy principle, which says that a belief function should be a probability function, from all those that are calibrated to evidence, that has maximum entropy. However, the three norms of objective Bayesianism (...) are usually justified in different ways. In this paper we show that the three norms can all be subsumed under a single justification in terms of minimising worst-case expected loss. This, in turn, is equivalent to maximising a generalised notion of entropy. We suggest that requiring language invariance, in addition to minimising worst-case expected loss, motivates maximisation of standard entropy as opposed to maximisation of other instances of generalised entropy. Our argument also provides a qualified justification for updating degrees of belief by Bayesian conditionalisation. However, conditional probabilities play a less central part in the objective Bayesian account than they do under the subjective view of Bayesianism, leading to a reduced role for Bayes’ Theorem. The assumption that philosophers rely on intuitions to justify their philosophical positions has recently come under substantial criticism. In order to protect philosophy from experimental findings that suggest that intuitions are epistemically problematic, a number of metaphilosophers have argued that intuitions play no substantial epistemic role in philosophy. This paper focuses on attempts to deny intuitions’ epistemic role through exegetical analysis of original thought experiments. Using Deutsch’s particularly well-developed exegesis of Gettier’s 10 coin case as an exemplar of this method, (...) I examine the challenges the strategy faces. I argue that intuition denial fails to provide a satisfactory account of how verdicts of thought experiments are justified. Instead, it commits intuition deniers to the conclusion that the arguments of Gettier, Kripke, Thomson, and others are bad arguments. As a result, rather than defusing challenges to the case method raised by experimental philosophers, intuition denial ultimately leads to the same troubling conclusion – that philosophers hold their positions on bad grounds.
