I argue that Metz's undertaking, in seeking a ‘comprehensive basic norm' to underpin African ethics, is similar to Hans Kelsen's postulation of the Grundnorm in his Pure Theory of Law. But African ethics does not need to be underpinned by an approach such as Kelsen's. In my view, Metz's preference for seeking to develop a Grundnorm rests upon a failure to attend carefully to the distinctness of African ethical thinking from Western ethical thinking. This failure is manifest in a spurious (...) distinction between ‘moral anthropology' / ‘cultural studies' and ‘normative theory'. It is also manifest in Metz's failure to attend carefully to the work of Wiredu and Bujo, both of whom present systematic, critical analyses of African ethical thinking while implicitly rejecting the quest for a Grund norm as being unAfrican. Man unterscheidet in der Organisation verschiedener Tiere folgende Kategorien von Parallelismen: 1) die Homologien, welche auf einen gemeinsamen Ursprung der betreffenden Organe hinweisen, 2) die Analogien, die als eine Folge von ähnlichen Funktionen oder der äusseren Wirkungen sekundär enstehen, 3) die Homomorphien, wodurch ich diejenigen Übereinstimmungen im Körperbau von verschiedenen Tieren bezeichne, welche auf Grund der allgemeinen Gesetze der Morphogenese zustande kommen. Das Studium der Homologien ist historischer Art, dasjenige der Homomorphien und Analogien typologischer Art.Man kann weiter unterscheiden: eine (...) allgemeine Homomorphie, welche sich im Tierreiche überall, wo dazu günstige Bedingungen vorhanden sind, offenbart , und eine spezielle Homomorphie, welche als eine der Möglichkeiten bei einer begrenzten Anzahl von Tierformen hervortritt . John Rawls' conception of a reasonable pluralism proceeds on the epistemological assumption that it is not possible to set up one specific notion of justice attached to certain beliefs about the nature ofthe person, the purpose and the goal of human life. The liberal position insists on the principle of moral justification, according to which no norm is legitimate unless it can be accepted in principle by all affected persons. According to this view, it is recommended, in public debates where (...) the legitimacy of laws and state actions is being disputed, citizens should confine themselves to the use of religious arguments for which independent, secular reasons can be given. This conception has elicited an array of critical responses from authors of a religious persuasion. Critics point above all to the unequal terms of entry to public debates. But it can be shown in termsofamodest foundationalist epistemology that the required translation of religious beliefs in secular reasons is not an unfair and unjustified charge. Personally justified basic beliefs can be tested in intersubjective and public procedures of reasoning without requiring believers to sacrifice their religious or confessional identity. (shrink)

Reinhard Löw, a young German philosopher who has written on the natural sciences and life, offers a critical exposition of Kant’s philosophy of organism that seeks at once to view the philosopher’s thinking in a new light and to contribute to present-day philosophy of organism in particular and nature in general. Löw offers his own historical and theoretical development of the issues and draws upon the insights of present-day thinkers on life, such as Jonas and Uexküll. Rejecting a causal-mechanical Erklären (...) in favor of a Verstehen of nature deriving from "the ends of life," Löw puts forward the concept of a Leib-Apriori within the broader notion of a psychophysical subjectivity as ground of a new teleological thinking. Structured interviews were held with 149 registered nurses in seven countries in America, Asia, Australia and Europe concerning the feeding of severely demented patients who do not accept food. The most common reasons for nurses being willing to change their decision to feed or not to feed were an order from the medical head, a request from the patient's husband and/or the staff meeting. There was a connection between the willingness to feed and the ranking of ethical principles. Nurses who (...) were most prone to feed the patient most often gave a high rank to the ethical principle of sanctity of life, while those who primarily chose not to feed the patient gave a high rank to the ethical principle of autonomy. All nurses stressed the ethical principle of beneficence. Des interviews structurés ont eu lieu avec 149 infirmiers/ères dans sept pays en Amérique, Asie, Australie et Europe concernant l'alimentation des malades gravement dément qui refusent de manger. La raison la plus générale pour des infirmiers/ères d'être prêt à changer leures décisions de donner à manger ou non sont: un ordre du médecin, la demande du mari de la malade ou de la réunion du personnel. Il y avait un lien entre la volonté de nourir et le rang des principes éthiques. Les infirmiers/ères les plus enclins de nourir la malade le plus souvent donnaient un rang supérieur au principe éthique de la sainteté de vie, pendant que ceux et celles qui choisissaient de ne pas nourrir la malade donnaient un rang supérieur au principe éthique de l'autonomie. Tous insistaient sur l'importance du principe éthique de la bienfaisance. Konstruktive Interviews wurden mit 149 ausgebildeten Krankenschwestern und Pfleger in sieben Ländern in Amerika, Asien, Australien und Europa gehalten über die Ernährung von schwer von Dementia praecox leidenden Patienten, die das Essen verweigern. Die gewöhnlichsten Gründe des Pflegepersonals für die Bereitwilligkeit, ihre Entscheidung, zu ernähren oder nicht, zu ändern, waren Anordnungen vom medizinischen Chef, Anfragen vom Ehemann der Patientin und/oder einer Personalsitzung. Es bestand ein Zusammenhang zwischen der Bereitwilligkeit zur Ernährung und dem Rang der ethischen Prinzipien. Die Pflegenden, die sich am meisten neigten, die Patientin zu ernähren, gaben dem ethischen Prinzip der Heiligkeit des Lebens einen hohen Rang, während die, die meistens vorzogen, die Patientin nicht zu ernähren, gaben dem ethischen Prinzip der Autonomie einen hohen Rang. Alle Pflegenden legten grossen Wert auf das ethische Prinzip der Wohltätigkeit. (shrink)

Im institutionalisierten Bereich interkultureller Beziehungen kommt es permanent zu Bemühungen, über gemeinsame musikalische Projekte Brücken zum Austausch von Lebensrealitäten und Erfahrungen zu erzielen. In vielen Fällen besteht jedoch nicht die Gelegenheit des gegenseitigen Austausches, weil die beteiligten Akteure entweder nebeneinander agieren, ohne aufeinander einzugehen und die Impulse ihres Gegenübers in den eigenen Beiträgen zu reflektieren, oder aber eine der beiden Bestandteile den anderen dominiert, und keine entsprechende Gelegenheit zur gleichberechtigten Artikulation einräumt. Der Grund dafür liegt häufig in der Starrheit (...) der musikalischen Systeme, die bei solchen Gelegenheiten aufeinander treffen und deren Unfähigkeit, auf Impulse außerhalb des jeweiligen Bezugsrahmens einzugehen. Die Improvisation bietet in diesem Zusammenhang einen tatsächlichen Spielplatz für unterschiedliche Zugänge und Entwürfe, der dazu einlädt, sich spielerisch einander anzunähern. Während im idiomatisch eingeschränkten Ausdrucksspektrum auch hier noch einige Barrieren existieren dürften, stellt sich im Kontext der harmonisch und rhythmisch freien Variante eine scheinbar ideale Basis zum gegenseitigen Erfahrungsaustausch dar. Diese wird nicht zuletzt aufgrund einer stark individualisierten Klangästhetik und Ausdruckspalette erzielt, deren Repräsentationsanteil an deutlich zuzuordnenden Elementen einer jeweiligen kulturellen Entität jedoch oft nicht exakt zu bestimmen ist. So widmet sich ein zentraler Aspekt der Arbeit der Frage nach der Zuweisungsebene der in diesem Zusammenhang getätigten Ausdrucksweisen, die sich im Bereich zwischen eindeutig einer bestimmten kulturellen Entität zuzuordnenden Elemente – häufig in Form von traditionellen Instrumenten als kulturelle Artefakte einer spezifischen regionalen Zugehörigkeit – und der rein technischen Herangehensweise an die musikalische Praxis der Kollektiv-Improvisation als Bestandteil einer global präsenten Subkultur der freien Improvisationsszene bewegt. Regelmäßig initiierte Projekte, die sich mit dieser Thematik auseinandersetzen werden im methodischen Teil der Arbeit zur Diskussion gestellt und als Ausgangspunkt für Erkenntnisse zur Optimierung von Projekten mit ähnlich ausgerichteten Zielsetzungen herangezogen. Zu Arnauld und im Discours de métaphysique sagt Leibniz, daß alle Wahrheiten begrifflich (prädikativ) und manche gleichwohl kontingent sind. Ich untersuche das Problem im Hinblick auf mögliche Wesen, die ich als möglich auch betrachte und versuche nachzuweisen, daß die Position keinen Widerspruch enthält, weil Leibniz zwei Arten begrifflichen Enthaltenseins unterscheidet -logisch und kausal: Die erste ist notwendig, die zweite jedoch kontingent und nur hypothetisch notwendig, notwendig also lediglich unter der Voraussetzung des vorgegebenen freien Willens Gottes. Es gibt insofern auch zwei (...) Arten vollständiger Begriffe - logisch und kausal vollständig: Kausal vollständige Begriffe sind logisch unvollständig und enthalten gleichwohl logisch (hypothetisches Enthaltensein) Gründe für die fehlenden Prädikate. Diese Begriffe sind Begriffe von zeitlichen Zuständen, die in einem Individuum durch Gottes wohlbegründete freie Ratschlüsse verbunden sind - solche Zustände lassen sich zwar separieren, jedoch nicht neu zusammenfügen. Diese Interpretation ist vereinbar mit dem inesse-Prinzip, mit Gottes Wissen um zukünftige zufällige Ereignisse sowie Leibniz' Ablehnung des Konzepts weltübergreifender Identität und kann durch die Einbeziehung des Kontingenz-Kriteriums einer unendlichen Analyse sowie einer Theorie der Gegenstücke zur Erklärung des Kontrafaktischen problemlos erweitert werden. Der klassische Liberalismus geht davon, dass die Freiheit des einzelnen Menschen ihre Grenze erst an der Freiheit der anderen finden soll. Eingriffe in die Freiheitsrechte müssen gerechtfertigt werden. Im Zentrum der politischen Theorie des Liberalismus steht daher die Aufgabe, die staatliche Rechtsordnung durch vernünftige Gründe zu legitimieren.

The law is an extremely complex phenomenon. It is very difficult to determine it precisely as the complete comprehension and ultimate definition of the law are beyond human capabilities. Also, the law never coincides with its concept, nor does the concept of the law coincide with its definition. This fact shows that the real human capabilities for the comprehension, determination and definition of the law are very limited and the limits are unreliable. The concept of the law is relative as (...) well, which is why all the definitions of the law are also relative. The concept and the definition of the law are also relative because they are of necessity subjective. It is for this reason that they are never truthful. However, even when they are not truthful, they are always useful. Because of these essential cognitive shortcomings and limitations, the law is determined and defined realistically – in a conventional and operative manner – whenever it is possible to do so. Additional difficulties are created by the fact that the number of conventional concepts and definitions of the law is almost limitless. Fortunately, only a number of them, considered operative, are used in the law. And all this because of a possible usefulness. Should the law be useful, then its realistic concept can be determined by the establishment of its common characteristics. On the basis of having at its disposal the mentioned common characteristics, the concept of the law can be operationally determined in both the expanded sense and the restricted sense. Also, it is possible to tell the difference between the three main layers in the concept of the law: complete , incomplete and unfinished law. Obviously, the realistically determined concept of the law is not one-sided, nor is it monolithic, but complex, detailed and as a whole composed of layers of different degrees of being legal. They are used to finely tune the ordering of the relationships between different importance and the degree of the conflict and, which is also important, to legally regulate even those social areas that would otherwise be exclusively regulated with the state or with the social norms. Otherwise, even the Ten Commandments alone would be insufficient to regulate all human relationships. However, the law did not come into being out of leisure time, but out of dire human need to protect the society from self-destruction. Contrary to the realistic concept of the law, there also exist its idealistic, idealized and ideal concepts. However, the idealistic concept of the law is inoperative, the idealized concept of the law is not correct, while the ideal concept of the law is out of human reach.Das Recht stellt ein immens vielfältiges Phänomen dar. Ihn präzise festzulegen entpuppt sich als unsäglich schwierig, denn eine lückenlose Erkenntnis sowie endgültige Definition des Rechts liegt jenseits des menschlichen Vermögens. Zudem geht weder das Recht mit dessen Begriff konform, noch tut es der Begriff des Rechts mit eigener Bestimmung. Dieser Tatbestand lässt durchblicken, die wahre menschliche Befähigung zum Erkennen, Determinieren sowie Definieren des Rechts sei höchst begrenzt, wobei sich ebendiese Schranken als unzuverlässig erzeigen. Die Notion des Rechts ist ebenso relativ, weswegen hiernach sämtliche Begriffsbestimmungen des Rechts relativ sind. Der Begriff einschließlich der Definition des Rechts ist auch aufgrund der ihnen notwendigerweise innewohnenden Subjektivität relativ. Aus diesem Grund sind sie niemals wahrheitsgetreu. Allerdings, auch wenn sie der Wahrheit nicht entsprechen, sind sie stets von Nützlichkeit. Wegen der angebrachten essenziellen erkenntnismäßigen Unzulänglichkeiten und Limitierungen wird das Recht realistisch bestimmt und definiert – in einer konventionellen bzw. operativen Manier – wann immer dies durchführbar ist. Zusätzliche Erschwernisse werden von der Tatsache geschaffen, dass die Zahl der gebräuchlichen Begriffe und Definitionen des Rechts schier unermesslich ist. Glücklicherweise werden lediglich etliche, als operativ angesehene, im Bereich von Recht eingesetzt. Und all dies der denkbaren Nützlichkeit halber. Sollte das Recht nützlich sein, dann lässt sich dessen realistischer Begriff per Gründung seiner gemeinsamen Wesenszüge festsetzen. Auf der Basis der vorhin angeschnittenen, ihm zu Gebote stehenden angehörigen Merkmale, kann der Begriff des Rechts operational determiniert werden, sowohl im erweiterten als auch im engeren Sinne. Ebenfalls ist der Unterschied erkennbar zwischen drei Hauptschichten in dem Begriff des Rechts: vollständiges Recht , unvollständiges Recht und unvollendetes Recht . Augenscheinlich ist der realistischerweise bestimmte Begriff des Rechts weder einseitig noch monolithisch, stattdessen ist er komplex, detailliert und als Ganzes aus Schichten von ungleichem Rechtlichkeitsgrad zusammengestellt. Man gebraucht sie zur Feinabstimmung der Beziehungsordnung zwischen der unterschiedlichen Wichtigkeit und dem Grad des Konflikts, und, was genauso Gewicht hat, um sogar jene Gesellschaftszonen rechtmäßig zu regeln, die anderenfalls ausschließlich seitens der staatlichen bzw. gesellschaftlichen Normen geregelt würden. Ansonsten würden selbst die Zehn Gebote nicht genügen, um menschliche Verhältnisse in ihrer Gänze zu ordnen. Jedoch ist das Recht nicht als Freizeitaktivität entstanden, sondern im Gegenteil als unentbehrliches menschliches Bedürfnis nach Bewahrung der Menschheit vor Selbstauflösung. Der realistischen Notion des Rechts entgegengesetzt existieren parallel dessen idealistische, idealisierte und ideale Begriffe. Dabei gilt der idealistische Begriff als inoperativ, der idealisierte als inkorrekt, während der ideale Begriff außerhalb der menschlichen Reichweite liegt. (shrink)

In dieser Arbeit werden die Thesen S. J. Becks über den kantischen Begriff von Ding-an-sich geprüft. Es sollen weder die zwei Doktrinen verglichen werden, noch die Punkte, in denen sie übereinstimmen, noch die Punkte, in denen sie sich voneinander entfernen. Basis-Voraussetzung ist mehr die Idee, dass es eine kantische Lehre des Ding-an-sich nicht gibt, sondern, dass es vielfältige divergente Tendenzen gibt in der Art, wie Kant das Problem bearbeitet. Die Auffassung Becks wird als ein Dialog mit denjenigen divergenten Tendenzen dargestellt, (...) die in Kants Gedanken koexistieren, und dadurch eine Reflexion, die an die eigene innere Entwicklung der kritischen Philosophie gebunden ist. Die Originalität von Becks Auffassung liegt in seiner Entscheidung eine eng idealistische Interpretation der transzendentale Philosophie zu privilegieren und - infolgedessen - die theoretischen Nichtigkeit des Begriffs des Ding-an-sich zu behaupten, wenn die systematische Darstellung der kritischen Philosophie nach seinem einzigen, voraussichtlichen Prinzip unternommen wird: das Prinzip der ursprünglichen synthetischen Einheit der Apperzeption. Diese Arbeit wird in drei Teile geteilt. Im ersten Teil wird Becks These geprüft, ob in der Kritik des vorliegenden Begriffs des Ding-an-sich eine Bewilligung Kants an dem Dogmatismus liegt, die durch didaktische und pädagogische Gründe determiniert ist. Im zweiten Teil werden die Übe rprüfungen, die von der systematischen Darstellung der kritischen Philosophie bei den Doktrinen der transzendentalen ästhetik, der transzendentalen Analytik und dem Schematismus gemacht werden müssen, gezeigt, so wie die nachfolgenden änderungen vom Sinn der Affektion, Synthese und Subsumption. Letztlich, im dritten Teil wird dargelegt, dass die Entscheidung Becks für den Idealismus mit einigen Punkten von Kants Denken nicht übereinstimmt und deswegen von ihm abgelehnt werden müsste. One of the central aims of Susanne Mantel’s book "Determined by Reasons" (2018) is to reject the idea that normative and motivating reasons can be identical. In her own words, Mantel denies the “Identity Thesis”, according to which “when an agent acts for a normative reason N, there is a motivating reason M of that agent such that M is identical with N” (Mantel 2018, 93). In this comment, I offer a simple argument for the Identity Thesis: (1) When an (...) agent acts for a normative reason N, there is a reason M for which that agent acts such that M is identical with N. (2) A reason for which someone acts is a motivating reason. (3) Therefore, when an agent acts for a normative reason N, there is a motivating reason M of that agent such that M is identical with N. Premise (1) is trivial, and premise (2) is true by a common definition of the term ‘motivating reason’, according to which a motivating reason is just a reason that is acted upon. I call this the operative notion of a motivating reason. Mantel does not address this operative notion, even though it is widely used in the literature, especially among proponents of the Identity Thesis. I argue that Mantel does not succeed in rejecting the Identity Thesis as long as she does not show that the operative notion of a motivating reason is flawed. (shrink)

This study described the relationships between academic class and student moral sensitivity and reasoning and between curriculum design components for ethics education and student moral sensitivity and reasoning. The data were collected from freshman (n = 506) and senior students (n = 440) in eight baccalaureate nursing programs in South Korea by survey; the survey consisted of the Korean Moral Sensitivity Questionnaire and the Korean Defining Issues Test. The results showed that moral sensitivity scores in patient-oriented care and conflict were (...) higher in senior students than in freshman students. Furthermore, more hours of ethics content were associated with higher principled thinking scores of senior students. Nursing education in South Korea may have an impact on developing student moral sensitivity. Planned ethics content in nursing curricula is necessary to improve moral sensitivity and moral reasoning of students. (shrink)

In recent literature, panpsychism has been defended by appeal to two main arguments: first, an argument from philosophy of mind, according to which panpsychism is the only view which successfully integrates consciousness into the physical world (Strawson 2006; Chalmers 2013); second, an argument from categorical properties, according to which panpsychism offers the only positive account of the categorical or intrinsic nature of physical reality (Seager 2006; Adams 2007; Alter and Nagasawa 2012). Historically, however, panpsychism has also been defended by appeal (...) to a third argument based on considerations about the nature and observability of causation. This argument has not been much discussed in recent times. Here is a concise version from William James: "… the concrete perceptual flux, taken just as it comes, offers in our own activity-situations perfectly comprehensible instances of causal agency … If we took these experiences as the type of what actual causation is, we should have to ascribe to cases of causation outside of our life, to physical cases also, an inwardly experiential nature. In other words, we should have to espouse a so-called “pan-psychic” philosophy" (James 1911: 218). James here suggests that we have direct experience of causation in our own agency. He thereby directly contradicts David Hume, who famously denied that we have any experience of causation. James goes on to claim that if this experience is representative of causation in general, it follows that all causation is mental, and that panpsychism is true. This kind of argument for panpsychism can be called the argument from (experience of) causation. This chapter offers, first, a history of this argument and arguments closely related to it, and second, an analysis of the argument – is it valid, are its premises in any way defensible, and how does it relate to the other, more popular arguments for panpsychism from philosophy of mind and categorical properties? This paper is an update of the documents we have concerning the Acts of the Christian martyrs, focused on three main aspects: 1) the kind of acts we know of and their classification from the point of view of their historic value; 2) the versions or editions of the texts that are most accepted by scholars; 3) the relevance of the different parts that make up these documents in order to discern the original text from passages that were rewritten or (...) underwent later variations. In this way, the article offers an exhaustive list of the documents for use in researching Christian martyrs in the Roman period. (shrink)

This is the first comprehensive study of Nietzsche's earliest (and extraordinary) book, The Birth of Tragedy (1872). When he wrote it, Nietzsche was a Greek scholar, a friend and champion of Wagner, and a philosopher in the making. His book has been very influential and widely read, but has always posed great difficulties for readers because of the particular way Nietzsche brings his ancient and modern interests together. The proper appreciation of such a work requires access to ideas that cross (...) the boundaries of conventional specialisms. This is now provided by M. S. Silk and J. P. Stern in their joint study of Nietzsche's book. They examine in detail its content, style and form; its strange genesis and hybrid status; its biographical background and the controversy engendered by its publication; its value as an account of ancient Greek culture and as a theory of tragedy and music; its relation to other theories of tragedy; and its place in the history of German ideas and in Nietzsche's own philosophical career. Traditional Chinese commentators rightly see that understanding Zhuangzi's way with words is the presupposition for understanding Zhuangzi at all. They are not sure, however, if Zhuangzi's words are super-effective or pure nonsense. I consider Zhuangzi's experience with language, and then turn to Heidegger's word of being to see if it may throw light on Zhuangzi's way of saying. I argue that a conversation between Heidegger and Zhuangzi on language is possible, but only by expanding Heidegger's notion of Gestell and through (...) a destruction of the dominant Confucian discourse that obscures Zhuangzi's way of saying. Background. The COVID-19 pandemic necessitated drastic changes to undergraduate medical training at the University of Botswana (UB). To save the academic year when campus was locked down, the Department of Medical Education conducted a needs assessment to determine the readiness for emergency remote teaching (ERT) of the Faculty of Medicine, UB. Objectives. To report on the findings of needs assessment surveys to assess learner and teaching staff preparedness for fair and just ERT, as defined by philosopher John Rawls. Methods. Needs (...) assessment surveys were conducted using Office 365 Forms distributed via WhatsApp, targeting medical students and teaching staff during the 5 undergraduate years. Data were analysed quantitatively and qualitatively. Results. Ninety-two percent (266/289) of students and 73.5% (62/84) of teaching staff responded. Surveys revealed a high penetration of smartphones among students, but poor internet accessibility and affordability in homes. Some teaching staff also reported internet and device insufficiencies. Only WhatsApp was accessible to students and teaching staff. Conclusions. For equitable access to ERT in the future, the surveys revealed infrastructural improvement needs, including wider, stronger, affordable WiFi coverage within Botswana and enhanced digital infrastructures in educational institutions, with increased support for students.
