'Ética, sustentabilidade e sociedade - desafios da nossa era' reúne estudos de diferentes áreas do conhecimento - Filosofia, Administração, Geografia - que tem em comum o foco nas questões éticas, como a corrupção no meio político e a crise ambiental planetária. Entre a violação à ética na política brasileira e o desafio de sobrevivência do planeta, variados temas são discutidos. Os pesquisadores também se defrontam com outras vertentes comportamentais, como as relacionadas ao ambiente e ao consumo sustentável.

The Operation Lava Jato, initiated in 2014 by the Ministry of Finance and carried out by the Brazilian Government Agency for Law Enforcement and Prosecution of Crimes, brought to light the unethical practices of several national contractors, despite their declared commitment to social responsibility and ethical management—a corporate conduct epitomized in the popular saying: “Do what I say; don’t do what I do”. In this chapter, we analyze such disconnection between discourse and practice vis-a-vis the literature on leadership and business (...) ethics, Brazilian culture and historical analyses of the Brazilian contractors industry. We examine the official discourse of a Brazilian contractor, as observed in documents retrieved from websites and statements to the press, and its practices, as depicted in the media and documented in testimonies already conducted by the federal courts and attached to the original case-files. Specifically, we aim to contribute to the reflection on management and ethics in Brazil by identifying and discussing the factors that seem to have promoted such disconnection, including aspects of national culture and the institutional environment, together with organizational culture and leadership. In his 1920 monograph Relativitätstheorie und Erkenntnis apriori the young Reichenbach distinguished between two meanings of the a priori: ‚apodictically valid, true for all time‘ and ‚constituting the concept of object‘. At the end of the 1990s Michael Friedman drew again the attention of philosophers of science to this forgotten distinction. In the spirit of Reichenbach’s early Kantianism Friedman attempted to construct a relativized or temporally variable a priori, which is nevertheless constitutive of the object of knowledge. Friedman rejects an (...) alternative historicized version of the a priori elaborated by the Marburg school and in particular by Cassirer. According to Friedman, Cassirer defended a regulative, but absolute version of the a priori, the existence of a yet-to-be-found set of final principles that are conditions of all scientific experience. This paper suggests that using the constitutive/regulative distinction as a basis for comparison is misleading. In order to understand the Marburg school’s conception of the a priori one should get back to Hermann Cohen’s interpretation of Kant and in particular to his own distinction between two meanings of the a priori. A more suitable comparison is that between Cohen’s opposition metaphysical-vs.-transcendental a priori and Reichenbach’s distinction apodictic-vs.-constitutive a priori. If the comparison is conducted along these lines—as already suggested in the mid-1920 s by the Dutch neo-Kantian Alfred C. Elsbach—it turns out that Cohen and the Marburg school and not Reichenbach provided a good example of a relativized a priori. (shrink)

This paper offers an introduction to Hermann Cohen’s Das Princip der Infinitesimal-Methode, and recounts the history of its controversial reception by Cohen’s early sympathizers, who would become the so-called ‘Marburg school’ of Neo-Kantianism, as well as the reactions it provoked outside this group. By dissecting the ambiguous attitudes of the best-known representatives of the school, as well as those of several minor figures, this paper shows that Das Princip der Infinitesimal-Methode is a unicum in the history of philosophy: (...) it represents a strange case of an unsuccessful book’s enduring influence. The “puzzle of Cohen’s Infinitesimalmethode,” as we will call it, can be solved by looking beyond the scholarly results of the book, and instead focusing on the style of philosophy it exemplified. Moreover, the paper shows that Cohen never supported, but instead explicitly opposed, the doctrine of the centrality of the ‘concept of function’, with which Marburg Neo-Kantianism is usually associated. In 1912, Ernst Cassirer contributed to the special issue of the Kant-Studien that honored Hermann Cohen's retirement—his mentor and teacher, and the recognized founding father of the so-called 'Marburg school' of Neo-Kantianism. In the context of an otherwise rather conventional presentation of Cohen's interpretation of Kant, Cassirer made a remark that is initially surprising. It is “anything but accurate,” he wrote, to regard Cohen's philosophy as focused “exclusively on the mathematical theory of nature,” as is usually done. (...) Many philosophers who thought about democracy in the Twentieth century haverejected the notion of absolute truth and even that of truth as such. Hans Kelsendraws a parallel between, on the one hand, philosophical absolutism and autocracy and, on the other, relativism and democracy. For the very same reasons, Hannah Arendt directly infers from her democratic conception of politics that truth is to be rejected. It seems that such views are closely reminiscent of some statements by John Rawls about the notion (...) of truth. I claim that the similarity is only superficial. Joshua Cohen’s interpretation of some passages of Political Liberalism concerning truth will be discussed, in an attempt at showing that Rawls’ view is not the No Concept View, which Cohen ascribes to him. Rawls endorses no particular conception of truth, but he freely uses the notion with its ordinary meaning. The arguments of public reason should start not just from agreed premises, but from true ones, if that is possible. This is quite consistent with the view that the conclusions of those arguments are put forward as being only reasonable – not as being true.Relativism about truth, on the other hand, is definitely inconsistent with Rawls’conception of public reason and, in particular, cannot jibe with his notion of over-lapping consensus. In Mindblindness, Simon Baron-Cohen presents a model of the evolution and development of "mindreading." He argues that we mindread all the time, effortlessly, automatically, and mostly unconsciously. It is the natural way in which we interpret, predict, and participate in social behavior and communication. We ascribe mental states to people: states such as thoughts, desires, knowledge, and intentions. Building on many years of research, Baron-Cohen concludes that children with autism, suffer from "mindblindness" as a result of a selective (...) impairment in mindreading. For these children, the world is essentially devoid of mental things. Baron-Cohen develops a theory that draws on data from comparative psychology, from developmental, and from neuropsychology. He argues that specific neurocognitive mechanisms have evolved that allow us to mindread, to make sense of actions, to interpret gazes as meaningful, and to decode "the language of the eyes." We prove that the category of Nachbin’s compact ordered spaces and order-preserving continuous maps between them is dually equivalent to a variety of algebras, with operations of at most countable arity. Furthermore, we observe that the countable bound on the arity is the best possible: the category of compact ordered spaces is not dually equivalent to any variety of finitary algebras. Indeed, the following stronger results hold: the category of compact ordered spaces is not dually equivalent to any finitely accessible (...) category, any first-order definable class of structures, and any class of finitary algebras closed under products and subalgebras. An explicit equational axiomatisation of the dual of the category of compact ordered spaces is obtained; in fact, we provide a finite one, meaning that our description uses only finitely many function symbols and finitely many equational axioms. We use a new model of metarepresentational development to predict a cognitive deficit which could explain a crucial component of the social impairment in childhood autism. One of the manifestations of a basic metarepresentational capacity is a ‘ theory of mind ’. We have reason to believe that autistic children lack such a ‘ theory ’. If this were so, then they would be unable to impute beliefs to others and to predict their behaviour. This hypothesis was tested using Wimmer (...) and Perner’s puppet play paradigm. Normal children and those with Down’s syndrome were used as controls for a group of autistic children. Even though the mental age of the autistic children was higher than that of the controls, they alone failed to impute beliefs to others. Thus the dysfunction we have postulated and demonstrated is independent of mental retardation and specific to autism. (shrink)

The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of the gig (...) economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker’s status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds. (shrink)

Why do children with autism have such trouble developing normal social understanding of other people's feelings? This new edition updates the field by linking autism research to the newest methods for studying the brain.

According to the extended cognition thesis, an agent’s cognitive system can sometimes include extracerebral components amongst its physical constituents. Here, we show that such a view of cognition has an unjustifiably anthropocentric focus, for it tends to depict cognitive extensions as a human-only affair. In contrast, we will argue that if human cognition extends, then the cognition of many non-human animals extends too, for many non-human animals rely on the same cognition-extending strategies humans rely on. To substantiate this claim, we (...) will proceed as follows. First (Sect. 1), we will introduce the extended cognition thesis, exposing its anthropocentric bias. Then, we will show that humans and many non-human animals rely on the same cognition-extending strategies. To do so, we will discuss a variety of case studies, including “intrabodily” cognitive extensions such as the spinal cord (Sect. 2), the widespread reliance on epistemic actions to solve cognitive tasks (Sect. 3) and cases of animal cognitive offloading (Sect. 4). We’ll then allay some worries our claim might raise (Sect. 5) to then conclude the paper (Sect. 6). (shrink)

This article concerns kime, a somatic code used in the ‘empty hand’ Japanese martial art of karate. Kime is a tactile-kinesthetic entity born out of practice, coming into being in a social setting through the specific organization of the body-self, fusing body and self into one stance and movement. Kime is entirely embodied, yet can only be operated and recognized inter-subjectively. It plays a crucial role in combat and at the same time also indicates a spiritual possibility that depends on (...) eradication of emotion and volition. An analysis of kime shows how cultural understandings can emerge without necessarily using symbolic representations or verbal discourse in their construction. These somatic non-dual understandings can come to form an entire world-of-meaning directly through the moving body. The moving body shapes itself within itself even as it interacts with and contributes to shape its immediate environment. This is a world-of-meaning that includes complex inter-subjectivity founded on the speed and ambiguity of the interface between the innerness and the outerness of the body. (shrink)
