The author compares the different interpretations by Castoriadis and Lefort of democratic autonomy. For both, autonomy involves questioning all pregiven meaning. Castoriadis, while rejecting any law of historical progress, regards the history of autonomy as the development of a movement which commenced in a limited political domain in ancient Greece and expanded in other domains in Western Europe from the 11th century on. In theory, it has eliminated pregiven meaning, but has remained stuck in a liberal oligarchy, bogged down (...) by a tide of insignificance. It remains to further the project of autonomy to the point where a truly autonomous society will be able to accept as such the “Abyss” (the “Chaos”) it experiences without hiding behind replicas such as those provided by religion. Lefort, on the other hand, while similarly accepting democracy’s desire for autonomy, believes the source of its principles are enigmatic and it will continue to remain open to the authentic human experience of radical transcendence even without God. He believes that the threat of relativism can be avoided as democracy is more just since it allows its members to be more open to this radical transcendence than other forms of society. (shrink)

It should be no surprise that violence is waiting in the wings.Despite the historical specificity of the present conflict, it is not new. Although focused on the French Revolution, Jason Frank's carefully argued study of the aesthetics of popular assembly resonates with contemporary concerns regarding political spectacles, populist movements, and whether or how democracy might prevail. Frank's objective is not to restore anything but to challenge left and right critiques of "the people" in order to recover a "lost radicalism of democracy" (xii). The general will, beyond representation, is a spontaneous, authentic, and unmediated self-assertion that can be expressed only in part and must be enjoyed as sensate experience. In his Violence and the Sacred, literary critic René Girard presented a bold thesis that revealed his increasing preoccupation with philosophical anthropology. There he claims that all societies are founded in violence that arises from unconscious imitation and subsequent rivalry. Sacred ritual is a means of avoiding, attenuating, or postponing this discord resulting from what he calls "mimetic appropriation." If his contentions in the earlier book seemed striking and original, their correlatives in the present volume are even more radical. Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. And by knowing this, we can start to address questions concerning human emancipation and how the world is to be transformed. (shrink)

In Metaphysics of Goodness, Robert Cummings Neville extends Alfred North Whitehead’s project of cultural studies, which was based on a new metaphysics that Whitehead developed in Adventures of Ideas. Neville’s focus is value or goodness in many modes. The metaphysics treated in this book derive from the Platonic and Confucian traditions, with significant modifications of Whitehead, Peirce, Dewey, Confucius, Xunzi, and Zhou Dunyi. (...) Part one develops a theory of form based on a metaphysics of harmony. Part two elaborates a theory of art based on a metaphysics of beauty. Part three sketches a theory of personhood based on a metaphysics of obligation. Part four discusses civilization in a systematic way based on a metaphysics of flourishing. Al-Jazeera and other satellite television stations have transformed Arab politics over the last decade.

In order to raise the question of a potential compatibility between the awareness of Otherness on the one hand, and a form of universality on the other, some hypotheses should first be formulated and defined. 1) How does moral relativism equate to the rejection of universal discourses? 2) Consequently, how can this rejection be understood as a result of Modernity? 3) How can Modernity be understood as recognition of Otherness? The current paper will attempt to outline some answers to these (...) questions based on a comparative reading between Kelsen and Lefort. Firstly, in order to explicate the main lines of the Kelsenian relativistic axiology it seems crucial to consider his second edition of the Pure Theory of Law, since one can find within it the grounds for a limitation of human cognition. His Farewell Lecture, “What is justice?”, is also relevant to this theme since in it he claims that the human world is a world of relative and conflicting values. The combination of these two ideas leads to the rejection of Universalist discourses – identified with the ones of Natural Law theories – in the name of science. Secondly, three of Lefort’s articles seem to be relevant. The first, “The Image of the Body and Totalitarianism”, enables us to understand his symbolic political philosophy, and more importantly, to introduce his definition of Modernity. “Dissolution of Marks and Democratic Challenge” focuses more on the concept of moral relativism, whilst interpreting it as a consistent reaction to modern indeterminacy. Finally, “Politics and Human Rights” offers a restricted concept of Human Rights, reminiscent of Hannah Arendt’s views, namely that human rights mean the rights to have rights. (shrink)

Abstract:This paper is a preliminary attempt to better understand the concept of legitimacy in stakeholder theory. The normative component of stakeholder theory plays a central role in the concept of legitimacy. Though the elaboration of legitimacy contained herein applies generally to all “normative cores” this paper relies on Phillips’s principle of stakeholder fairness and therefore begins with a brief description of this work. This is followed by a discussion of the importance of legitimacy to stakeholder theory as well as the (...) general ambiguity of the term. A distinction is then drawn between normative and derivative legitimacy. Reference to this distinction helps distinguish between a relationship with the organization based on direct moral obligation and one based on the power to help or harm the organization. It is concluded that stakeholders who retain the ability to affect the organization arelegitimate(derivatively), but that this legitimacy is derived from the moral obligation owed other (normative) stakeholders and that the two sorts of legitimacy are importantly different from one another. An example of the normative/derivative distinction at work in managerial decision making is elaborated upon and managerial and research implications are then suggested. (shrink)

Abstract:Should the responsibilities of business managers be understood independently of the social circumstances and “market forces” that surround them, or (in accord with empiricism and the social sciences) are agents and their choices shaped by their circumstances, free only insofar as they act in accordance with antecedently established dispositions, their “character”? Virtue ethics, of which I consider myself a proponent, shares with empiricism this emphasis on character as well as an affinity with the social sciences. But recent criticisms of both (...) empiricist and virtue ethical accounts of character deny even this apparent compromise between agency and environment. Here is an account of character that emphasizes dynamic interaction both in the formation and in the interplay between personal agency and responsibility on the one hand and social pressures and the environment on the other. In “The Sources of Knowledge,” Robert Audi distinguishes what he calls the “four standard basic sources” by which we acquire knowledge or justified belief: perception, memory, consciousness, and reason. With the exception of memory, he distinguishes each of the above as a basic source of knowledge. Audi contrasts basic sources with nonbasic sources, concentrating on testimony. After clarifying the relationship between a source and a ground, or “what it is in virtue of which one knows or justifiedly believes,” Audi (...) evaluates the basic sources’ individual and collective autonomy as well as their vulnerability to defeasibility. The aim of this paper is to compare two authors: Hans Kelsen and Leo Strauss. More specifically, it will compare Kelsen’s “What is Justice?”—his Farewell Lecture given at Berkeley in 1952—and Leo Strauss’s Natural Right and History—one of the main works on political philosophy published in twentieth century America. Both are key texts dealing with the same subject, justice. Although the two texts were written around the same time by authors who shared a similar history, they seem to defend radically (...) opposed points of view. However, despite and beyond their otherwise real differences, the two texts articulate the same important idea: if one wants to think about political issues, one has to address the question of justice. This chapter will attempt to illustrate through a comparison of these two texts the importance of addressing the question of justice, especially in our modern democracies. (shrink)

To investigate the current status of hospital clinical ethics committees (CEC) and how they have evolved in Canada over the past 20 years, this paper presents an overview of the findings from a 2008 survey and compares these findings with two previous Canadian surveys conducted in 1989 and 1984. All Canadian hospitals over 100 beds, of which at least some were acute care, were surveyed to determine the structure of CEC, how they function, the perceived achievements of these committees and (...) opinions about areas with which CEC should be involved. The percentage of hospitals with CEC in our sample was found to be 85% compared with 58% and 18% in 1989 and 1984, respectively. The wide variation in the size of committees and the composition of their membership has continued. Meetings of CEC have become more regularised and formalised over time. CEC continue to be predominately advisory in their nature, and by 2008 there was a shift in the priority of the activities of CEC to meeting ethics education needs and providing counselling and support with less emphasis on advising about policy and procedures. More research is needed on how best to define what the scope of activities of CEC should be in order to meet the needs of hospitals in Canada and elsewhere. More research also is needed on the actual outcomes to patients, families, health professionals and organisations from the work of these committees in order to support the considerable time committee members devote to this endeavour. From the ferment of recent debates about the intellectual virtues, Roberts and Wood develop an approach they call 'regulative epistemology', exploring the connection between knowledge and intellectual virtue. In the course of their argument they analyse particular virtues of intellectual life - such as courage, generosity, and humility - in detail.

Hospitals in many countries have had clinical ethics committees for over 20 years. Despite this, there has been little research to evaluate these committees and growing evidence that they are underutilized. To address this gap, we investigated the question ‘What are the barriers and facilitators nurses and physicians perceive in consulting their hospital ethics committee?’ Thirty-four nurses, 10 nurse managers and 31 physicians working at four Canadian hospitals were interviewed using a semi-structured interview guide as part of a larger investigation. We used content analysis of the interview data related to barriers and facilitators to use of hospital ethics committees to identify nine categories of barriers and nine categories of facilitators. These categories as well as their subcategories are discussed and those specific to nurses or physicians are identified. The need to increase health professionals' use of clinical ethics committees through reducing barriers and maximizing facilitators is discussed. (shrink)

Nurses and physicians may experience ethical conflict when there is a difference between their own values, their professional values or the values of their organization. The distribution of limited health care resources can be a major source of ethical conflict. Relatively few studies have examined nurses' and physicians' ethical conflict with organizations. This study examined the research question ‘What are the organizational ethical conflicts that hospital nurses and physicians experience in their practice?’ We interviewed 34 registered nurses, 10 nurse managers, (...) and 31 physicians as part of a larger study, and asked them to describe their ethical conflicts with organizations. Through content analysis, we identified themes of nurses' and physicians' ethical conflict with organizations and compared the themes for nurses with those for physicians. (shrink)
