This article ethnographically considers the experiences of Australian young people who were born deaf and who hear and listen through cochlear implants to explore the intersection between the sensory body, lived experience and technology. The article draws on phenomenology to examine how experiences of deafness are productive in analysing articulations of embodiment and the meanings embedded in a body that is valued as both deaf and hearing. Leaving aside binary conceptions of deaf versus hearing, and understandings of the cochlear implant (...) as a remedy for sensory deficits, we instead make a case for nuanced understandings of the device and embodied experiences through technology. This analysis identifies how a cochlear implanted body navigates connections to the world and to others in turning on and off engagement. We contend that the device has an intrinsic value for recipients through enabling their access to hearing while not removing their experiences of deafness. (shrink)

Professor Robert John Barrett died suddenly, after a long and difficult illness, on January 12th, 2007. At the time of his death, at the age of 57, he was Head of the Discipline of Psychiatry at the Royal Adelaide Hospital, University of Adelaide. His passing was mourned by countless individuals in Australia and internationally. The celebration of his life, held in the University of Adelaide’s Bonython Hall, from which generations of scholars have received their parchments upon graduation, was an emotive (...) ritual of which Rob would have both approved and also enjoyed immensely. The Hall was filled to capacity, with over 1,300 people listening to a collection of his favourite music and tributes delivered by eight of his friends and family members. Dignitaries in full academic regalia, including the Vice-Chancellor, the immediate past and current Deans of Medicine, and the Head of School oversaw proceedings from an elevated position in the Hall, the symbolic meaning of which would have caused Rob to smile wryly. A reflection of his life in pictures, at the conclusion of the ceremony, before the pall-bearers carried his coffin to the hearse, evoked yet more tears and grief at the tragic and untimely loss of this man: an outstanding intellectual, wise mentor, gifted teacher, caring doctor, and true and loyal friend. There is no systematic research on the rites and rituals associated with companion animal death in modern Australian society. Three cremation service providers were interviewed and asked to consider which caretakers have their companion animals cremated. Seven people who had recently had a companion animal cremated were then asked about their views on the process. Five interrelated themes emerged from the two data sets about who uses cremation services for companion animals: “Everyone uses companion animal cremation services”; “People who consider (...) the companion animal as a family member, as a child”; “People who want memorials for their companion animals”; “Grieving people”; and “People who seek compassion and social support.” With scant recognition of the impact of companion animal death and the role of rites and rituals in facilitating the grieving process, further research in the area is needed, including into attachment as a possible mediator. The creation of pharmacotherapies, such as Selective Serotonin Reuptake Inhibitors (SSRIs), for the treatment of depression was hailed as a great breakthrough in mental health care. However, since that time, serious questions have arisen as to their safety and the way they are prescribed without full information being provided to patients about a range of important issues, including the possible aetiologies of depression, and the efficacy and potential side-effects of medication. These issues have been especially important in the care and (...) treatment of young people, as there is evidence that SSRIs may be implicated in increased suicidal behaviour. In this article, we examine the experiences of five individuals who were prescribed an SSRI in their late teens or early twenties, and discuss some of the ethical issues that arise from their accounts. Animal use in medical research is widely accepted on the basis that it may help to save human lives and improve their quality of life. Recently, however, objections have been made specifically to the use of animals in scientific investigation of human obesity. This paper discusses two arguments for the view that this form of animal use, unlike some other forms of animal-based medical research, cannot be defended. The first argument leans heavily on the notion that people themselves are responsible (...) for developing obesity and so-called ‘lifestyle’ diseases; the second involves the claim that animal studies of obesity's causes and therapies distract attention from preventive efforts. Drawing on both empirical data and moral reasoning, we argue that the relevant attributions of responsibility and claims about distraction are not plausible, and that, therefore, there is no reason to single out the use of animals in obesity research as especially problematic. Scholarly learning as engagement with beauty. Three evocative images of aesthetic experience come to light in the essays by Custodero, Hansen, and Neumann. From the musical play of children conducting imaginary orchestras to the vocational aspirations of adults who gaze through telescopes or study paintings at Chicago's Art Institute, aesthetic experience spans a range of (...) activities and ages. No matter the setting or moment, aesthetic experience vitalizes our lives with meaning and joy. Why this is so and what difference this makes for education emerge as overarching concerns in this set of papers. Addressing these issues, the authors articulate a number of commonthemes and reach similar conclusions about the nature and value of aesthetic experience.I want to identify and analyze key ideas that run throughout these essays. Doing so deepens our appreciation of the authors' insights and underscores the importance of the project they undertake. I also want to examine three questions that the essays suggest but do not develop. Exploring these questions, I hope to further enrich our understanding of aesthetic experience and its place in education.First and foremost, aesthetic experience for all three authors integrates multiple ways of knowing and enables individuals to perceive connections that they might otherwise overlook. According to Custodero, aesthetic experience harmonizes imagination, physicality, and "thinking-in-action." For Hansen, aesthetic experience connotes heightened perception, a way of being that attends to nuances of gesture that would otherwise remain invisible. The following is a translation of the Fontaine version. I have noted all of the variations from the latter version in the notes. As I emphasize in my commentary, the piece is a notable display of Wahl’s eclectic range of influences. Most importantly, it shows the extent (...) to which his interest in radical empiricism and process metaphysics informs his creative approach to the intersection of poetics and metaphysics. Hansen, writing out of philosophy of education, discusses how being fully present in the teaching moment (...) leads to meaningful experience; and Anna Neumann, who writes out of the field of higher education studies, represents scholars as engaged in intellectual pursuits, often framed aesthetically, and as struggling to hold on to precious time for creation. Aware of the inherent tensions in learning environments from child care centers to graduate schools, we address ways in which our research has revealed people's sustained pursuit of imagined possibilities, oftentimes amidst perceived impediments.Creative work involves imagining possibilities whereby individuals, alone and together, pose personally relevant questions and pursue fluent pathways of inquiry within the shared meanings of cultural context. At its finest, such work is artful, simultaneously responding to and emanating from immediate circumstance and past experience. It is malleable and vulnerable and compelling, fusing familiar images and surprising perceptions into new "equilibria... stable, even though moving" whereby "changes interlock and sustain one another."1 As scholars and teachers committed to learning, we strive to create and discern meaning between established understandings and emerging ideas and images. As we dance between reception and action, between insight and "onsight,"2 fully attentive to the perceived potentials in our work, we move toward synchrony, experiencing the aesthetic. The realizations that arise from experiences such as these — new or newly reconfigured words, sounds, images, movement, and ideas — express new balances of sense and feeling and, sometimes, beauty. Whether in the shared, artfully expressive vocalizations between the newborn infant and mother or in the scientist's finessing patience with elegant mathematical imagery, creative work invites a drawing together of what we know and what we struggle to know. We see the aesthetic as both native and learned; as individually held and formed and felt, and as collectively created and voiced, the product of lives in intersection; as marking bounded moments in time (those instants of compelling "present-ness") and as spreading through years, well beyond bounded present-ness, perhaps as memory. Yet while striving to define the aesthetic in lives, we also strive to understand lives, individually and interactively, as lodgings for the aesthetic, as locations that give shape, form, and voice to beauty and insight, to creativity and learning. As we explore the lives in which the aesthetic finds its home, and within which it forms, we wonder about the extent to which the aesthetic may, in its turn, illuminate the strivings of those lives, including human desires to create, know, learn, understand, sense. This paper explores the relationship between a prominent version of the relational view of memory and recent work on forms of unsuccessful remembering or memory errors. I argue that unsuccessful remembering poses an important challenge for the relational view. Unsuccessful remembering can be divided into two kinds: misremembering and confabulating. I discuss each of these cases in light of a recent relational account, according to which remembering is characterized by an experiential relation to past events, and I argue that experiential (...) relations do not adequately distinguish between remembering and unsuccessful remembering. This is because there are, on the one hand, cases of remembering that do not instantiate the relevant experiential relations, and, on the other hand, cases of confabulation and misremembering that do instantiate the relevant experiential relations. I conclude by suggesting that any successful relationalist attempt to explain remembering needs to come to grips with unsuccessful remembering. (shrink)

The (dis)continuism debate—the debate over whether remembering is a form of imagining—is a prominent one in contemporary philosophy of memory. In recent work, Langland-Hassan (2021) has argued that this debate is best understood as a dispute over whether remembering is a form of constructive imagining. In this paper, I argue that remembering is not a form of constructive imagining because constructive processes in remembering and imagining are constrained, and hence controlled, in different ways at the level of consciousness. More specifically, (...) I argue that remembering and imagining differ in terms of the interventions we can make on the constructive processes as they unfold. What is "race"? What role, if any, should race play in our moral obligations to others and to ourselves? Ethics along the Color Line addresses the question of whether black Americans should think of each other as members of an extended racial family and base their treatment of each other on this consideration, or eschew racial identity and envision the day when people do not think in terms of race. Anna Stubblefield suggests furthermore that white Americans should consider the (...) same issues. She argues, finally, that for both black and white Americans, thinking of races as families is crucial in helping to combat anti-black oppression. Stubblefield is concerned that the philosophical debate—argued notably between Kwame Anthony Appiah and Lucius Outlaw—over whether or not we should strongly identify in terms of race, and whether or not we should take race into account when we decide how to treat each other, has stalled. Drawing on black feminist scholarship about the moral importance of thinking and acting in terms of community and extended family, the author finds that strong racial identification, if based on appropriate ideals, is morally sound and even necessary to end white supremacy. Despite much philosophical attention on forgiveness itself, the phenomenon of un-forgiving is relatively neglected. Some views of forgiveness commit us to denying that we can ever permissibly un-forgive. Some go so far as to say the concept of un-forgiving is incomprehensible—it is the nature of forgiveness to be permanent. Yet many apparent cases of un-forgiving strike us as both real and justified. In what follows, I will address the latter view, that genuine un-forgiving is impossible or incomprehensible as a phenomenon, (...) advanced by a character I will call the “Un-Forgiving Denier.” I address two views which purport to describe candidate un-forgiving cases in alternative ways and deny that any candidate un-forgiving cases are truly cases of un-forgiving: the “epistemic invalidation” and “new forgiveness opportunity” views. In creating problems for those views, I hope to defend the possibility of genuine un-forgiving. Even if it’s possible to respond to the “Un-Forgiving Denier,” a defender of genuine un-forgiving still faces the “Un-Forgiving Critic,” who insists that un-forgiving, while possible, is morally indefensible. Against this view, I argue that un-forgiving enables an ideal of forgiveness wherein victims hold wrongdoers accountable for their moral development and allows certain opportunities for relational repair. I conclude that there is good reason to think un-forgiving is both possible and permissible. Embracing genuine un-forgiving puts constraints on how we should theorize about forgiveness itself and gives us an additional tool for understanding and navigating our relationships. (shrink)

Meinong's theory of meaning and his epistemological views are discussed in detail. An outline of his conception of truth, which is classified as firmly realistic, is followed by a review of the critical works touching upon Meinong's epistemological ideas. Finally, Meinong's theory of objects is (...) presented as inspiring the development of Meinongian logics, with his Aussersein as the prototype of an all-inclusive semantic domain. This study underscores The Lily and the Bird's response to despair in The Sickness unto Death. By suggesting in The Lily and the Bird that we look to nature's creatures to learn an attunement and responsiveness to our situation as physical creatures subject to finite constraints, Kierkegaard's text comes into dialogue with a form of misalignment portrayed in The Sickness unto Death as a refusal of the given, “the finite,” and “the necessary.” One way of seeking alignment in The Lily (...) and the Bird entails learning to hear and to answer within one's given environment, opening up the possibility of embodied joy. This paper addresses some apparent philosophical tensions between realism and enactivism by means of Charles Peirce’s pragmatism. Enactivism’s Mind-Life Continuity thesis has been taken to commit it to some form of anti-realist ‘world-construction’ which has been considered controversial. Accordingly, a new realist enactivism is proposed by Zahidi (_Phenomenology and the Cognitive Sciences,_ _13_(3), 461–475, 2014 ), drawing on Ian Hacking’s ‘entity realism’, which places subjects in worlds comprised of the things that they can successfully manipulate. We review this attempt, and (...) argue that whilst Zahidi rightly urges enactivists towards ‘internal realism’, he cannot sustain a non-negotiable aspect of realism that is crucial for scientific progress – the claim that multiple subjects inhabit _the same world_. We explore Peirce’s pragmatism as an alternative solution, foregrounding his distinction between existence and reality, and his inquiry-based account of cognition. These theoretical innovations, we argue, fruitfully generalize Zahidi’s _manipulation-based_ enactivist realism to a richer, _inquiry-based_ enactivist realism. We explore how this realism’s pan-species monism about truth encourages and supports the investigation of non-human animal cognition, and conclude by considering some implications of our discussion for long-standing realism debates within pragmatism. Some philosophical theories of the nature of color aim to respect a "common sense" conception of color: aligning with the common sense conception is supposed to speak in favor of a theory and conflicting with it is supposed to speak against a theory. In this paper, we argue that the idea of a "common sense" conception of color that philosophers of color have relied upon is overly simplistic. By drawing on experimental and historical evidence, we show how conceptions of color (...) vary along several dimensions and how even supposedly "core" components of the contemporary "common sense" conception of color are less stable than they have been thought to be. International law holds that states are holistically responsible for their acts. Yet what does the ascription of responsibility to the state imply about the responsibility of its citizens? This article argues that most citizens in a representative democracy bear culpability in association with their state's wrongful acts. Most democratic citizens can be blamed for empowering representatives to act on their behalf, and then failing to adequately oversee and dissent from the specific wrongful decisions their representatives made. This gives culpable citizens (...) duties that go beyond compensation, especially duties to foster a reparative social ethos towards state victims. (shrink)

Emotion suppression has been found to have negative psychological and social consequences in Western cultural contexts. Yet, in some other cultural contexts, emotion suppression is less likely to have negative consequences; relatedly, emotion suppression is also more common in those East-Asian cultural contexts. In a dyadic conflict study, we aim to conceptually replicate cultural differences found in previous research with respect to the prevalence and consequences of emotion suppression,and extend previous research by testing whether cultural differences are larger for some (...) than for other types of negative emotions. We postulate that cultural differences in suppression are less pronounced for socially engaging emotions than socially disengaging emotions, because the former foster the relationship, whereas the latter emphasize individual goals. Belgian and Japanese couples engaged in a 10-min conflict interaction followed by video-mediated recall, during which participants rated their emotions and emotion suppression every 30 s. As predicted, Japanese participants reported more suppression than their Belgian counterparts, but the cultural difference was more pronounced when participants experienced more socially disengaging emotions than when they experienced more socially engaging emotions. These results suggest that the type of emotion should be considered when describing cultural differences in emotion suppression. Finally, and consistent with previous research, emotion suppression was negatively associated with interaction outcomes in Belgian couples, but not in Japanese couples. (shrink)

What is profoundly under question, especially today, in the aftermath of the pandemic, is on one hand the phenomenon of desire, on the other hand the experience and capability of desiring of the human being. Taking a look at the social situation of the country – recalling first the investigation of the 44th Censis Report 2010, the contents of which in some ways are re-proposed in a naturally volved way in the following one of 2020 –, we are given an (...) image that relaunches our thought owards a need to deepen the ontology of desire and a possible educational pedagogy about it. Our society is depicted as “with no inner desire”: a crisis of desire emerges, in the sense of a crisis about the power of having a vision about the future and capacity of planning with excitement. In this paper, recalling Kant and his transcendental productive imagination as well as the new path of affective neurosciences perspective, going through the Theory of Attachment, I aim at opening a possible way to overcome this impossibility to desire arguing a different hermeneutics in comparison to what the tradition, especially that of J. Lacan, left us about this important and vital faculty of the human being. (shrink)

Zusammenfassung Ausgehend von den Erfahrungswerten sechs Klinischer Ethiker*innen an Universitätsklinika in Deutschland wurde eine strukturierte Auseinandersetzung mit dem Arbeitsfeld der Fortbildungen im Rahmen der Klinischen Ethikarbeit vorgenommen. Die Zusammenarbeit wurde von der Fragestellung geleitet, was bei der Konzeption einer Ethik-Fortbildung innerhalb einer Einrichtung zu berücksichtigen ist. Der methodische Zugang zur Beantwortung der explorativen Fragestellung bestand in einem mehrstufigen, deskriptiven Verfahren, das alternierend in gemeinsamen Arbeitssitzungen und individueller Arbeit zwischen den Sitzungen umgesetzt wurde. Als Resultat zeigt der Aufsatz eine Übersicht über (...) die Bandbreite möglicher Fortbildungsformate auf, die denjenigen Hilfestellung bieten kann, die in ihrer Einrichtung Fortbildungen zu ethischen Themen konzipieren und durchführen wollen. Darüber hinaus bietet er einen Überblick über die bei der Umsetzung jeweils zu berücksichtigenden _direkt strukturierenden_ sowie _indirekt strukturierenden_ Merkmale. Es wird an Beispielen aufgezeigt, welche Formatvarianten sich in Kombination mit welchen direkt strukturierenden Merkmalen in den ausgewählten Universitätsklinika bewährt haben. Der Beitrag liefert eine Diskussionsgrundlage, um die strukturierte Auseinandersetzung mit konzeptionellen Fragen ethischer Fortbildung in der Klinik zu befördern. (shrink)

In this paper, we wish to explore the role that textual representations play in the creation of new mathematical objects. We do so by analyzing texts by Joseph-Louis Lagrange (1736–1813) and Évariste Galois (1811–1832), which are seen as central to the historical development of the mathematical concept of groups. In our analysis, we consider how the material features of representations relate to the changes in conceptualization that we see in the texts.Against this backdrop, we discuss the idea that new mathematical (...) concepts, in general, are increasingly abstract in the sense of being detached from material configurations. Our analysis supports the opposite view. We suggest that changes in the material aspects of textual representations (i.e., the actual graphic inscriptions) play an active and crucial role in conceptual change.We employ an analytical framework adapted from Bruno Latour’s 1999 account of intertwined material and representational practices in the empirical sciences. This approach facilitates a foregrounding of the interconnection between the conceptual development of mathematics, and the construction, (re-)configuration, and manipulation of the materiality of representations. Our analysis suggests that, in mathematical practice, distinctions between the material and structural features of representations are not permanent and absolute. This problematizes the appropriateness of the distinction between concrete inscriptions and abstract relations in understanding the development of mathematical concepts. (shrink)

Wohltätigkeit oder Hilfspflichten gegenüber Armen spielen in der griechisch-römischen Antike nach gängiger Ansicht keine nennenswerte Rolle.

Background Migrant live-in care workers are a main pillar of long-term care in many countries, including Germany. Several studies examining their working and living conditions reveal serious problems. However, a key element of live-in arrangements, namely the relationship between the individuals involved, has not yet been systematically investigated from an ethical perspective. Aim Building on previous socioempirical work that explored and set out the meaning of “care networks”, we start from the premise that live-ins are embedded in a network of (...) relationships which are essential for their employment and living situation. Methods The theoretical analysis draws on a network approach that takes care–ethical considerations into account. Using Joan Tronto’s four care–ethical phases, existing dependencies are described and reflected upon using the corresponding four care–ethical dimensions. The central questions are how dependencies in the live-in arrangement can be characterised based on the existing body of empirical studies and with a focus on the elements of power, dependency and trust in the ethical reflection on care. Results Based on this analysis, it becomes apparent that the ambivalence resulting from the simultaneity of different forms of asymmetry and mutual dependence is omnipresent in live-in arrangements and gives rise to seemingly contradictory forms of relationships and emotions. Responsibilities are vague and are constantly renegotiated on the basis of implicit assumptions and problematic role expectations and are also assigned without negotiation. Conclusions In the future, it will not only be necessary to better understand and clarify responsibilities at the micro level of the individual care arrangement from the various positions and roles and with a view to the changing processes of caring for another, but also to address the pressing ethical questions and problems in live-in arrangements at the meso and macro levels—enriched by care–ethical perspectives. Gillian Brock’s Justice for People on the Move is an important contribution to the migration literature. While I agree with many of Brock’s arguments, I focus here on a few key points of difference between us. I press three interrelated concerns about Brock’s view: first, the practical implications of her assessment of the state-system’s current illegitimacy remain too unclear. Second, Brock’s human rights-based theory neglects the importance of citizens’ democratic agency, in a way that may have paternalistic implications. Third, Brock’s (...) view is tolerant of inequalities of wealth and power that may enable relations of exploitation, as we see by examining her advocacy of guestworker schemes. The article draws attention to those places where Brock’s view faces hard questions, and explains why I might have answered some of these questions differently. (shrink)

The question of work–family practices commonly arises in both theory and daily practice as a matter of responsibility in today’s organisations. More information is needed about them for socially responsible human resource management. In this article our interest is in how work–family practices, serve as an important element of SR-HRM, constructed as helpful for employees’ work–family integration, are realised in organisational life. We investigate the discursive ways in which members of two different organisations working at different organisational levels construct the (...) issue in the Finnish context. Three discourses were interpreted: a discourse of compliance with external pressure, a discourse of negotiation and a discourse of individual flexibility. Discursive constructions of work–family practices make visible the complex interconnectedness of individuals and organisations with the environment in which they operate. Many organisational efforts to create positive work–family practices can, in fact, lead to failure to make these practices either available or usable, and they may result in the unjust treatment of organisation members. Creating sustainable work–family practices is a complex challenge for which SR-HRM must work out a solution. (shrink)

This article examines, analyses and compares the cinematic representation of three female protagonists (on three respective films) within their portrayed incestuous relationships. It also attempts to draw significant conclusions about their dynamic as female participating subjects in these affairs in a more inclusive way, one that takes into consideration their racial, gender, social and family characteristics. As incest itself is one of the strongest human taboos, various questions regarding the female portrait and position in such relationships arise: as incest constitutes (...) the strongest social taboo of human civilization, is it similarly portrayed in cinema? Can incest be a female’s act of choice or is it just a male’s one? Are there any differences between male and female depictions of incestuous desire and sexual act? In which ways do potential differences, such as social status, class origin, racial and gender stereotypes, influence the protagonists of incestuous relationships? Mastroianni (bio), Ruth Faden (bio), and Daniel Federman (bio)In recent years, claims have been made by segments of the research community and by women's health advocacy groups that clinical research practices and policies have not benefitted women's health to the same extent as men's health. Central to these claims has been an assertion that women have been inadequately (...) represented as subjects of clinical studies and that as a result neither health conditions unique to women—e.g., menopause—nor women's manifestations of health problems affecting both sexes—e.g., heart disease—have been investigated sufficiently.The scientific community, including federal agencies that sponsor and regulate clinical studies, is increasingly responsive to these claims and is taking steps to raise the level of women's participation in clinical studies. Controversy and concern have surrounded these actions, however. Two of the claims that have been made are: (1) that women are more difficult to study than men because of their cyclical hormonal changes; and (2) that conducting gender-specific subgroup analyses would increase the size of study populations, raise the cost of studies, and thereby reduce the number of studies that could be performed with the limited resources available. In addition, controversy over the inclusion of women of childbearing potential and pregnant women has been particularly salient. Concerns have been expressed about avoiding potential harm to existing or potential fetuses and about the possible legal and financial ramifications of such harm. A further concern involves the perceived difficulties in enrolling women in studies and retaining them for the duration of the studies.Against this backdrop, the Office of Research on Women's Health at the National Institutes of Health (NIH) asked the Institute of Medicine (IOM) in October 1992 to establish the Committee on the Ethical and Legal Issues Relating to the Inclusion of Women in Clinical Studies. The Committee's charge was to: (1) consider the ethical and legal implications of including women, particularly pregnant women and women of childbearing potential, in clinical studies; (2) examine known instances of litigation regarding injuries to research subjects [End Page 55] and describe existing legal liabilities and protections; and (3) provide practical advice on these issues for consideration by NIH, institutional review boards (IRBs), and clinical investigators.The 16 Committee members came from diverse backgrounds: bioethics, law, epidemiology and biostatistics, public health policy, obstetrics and gynecology, clinical research, pharmaceutical development, social and behavioral sciences, and clinical evaluative sciences.1 Chaired by two of the authors of this article, Ruth Faden and Daniel Federman, and coordinated by the third, IOM Study Director Anna Mastroianni, the Committee met five times over a fourteen-month period, convened a one-and-one-half day invitational workshop, and commissioned several background papers. Recent crises in Europe and beyond have renewed a longstanding debate on the status and treatment of refugees. Hannah Arendt famously questioned the limits of universalistic human rights discourse based on the widespread phenomena of statelessness and displacement that emerged during and after World War II. In this paper, we analyze recent patterns of inclusion and exclusion of refugees in Italy through the lens of Arendtian narrative and theorizing. We consider three cases of interaction between families, schools, and other public (...) institutions in light of the shifting normative framework before and during the war in Ukraine. Two major insights emerge from this analysis. From a pedagogical point of view, the most promising educational practices with refugees are those centered on enabling their agency and corresponding experiences of "natality". From an ethical-political perspective, these practices highlight a latent tension between the universalistic scope of human rights enshrined in the human rights declarations and their structural dependence on the particular norms and procedures enacted by nation states. The understanding and teaching of human rights within our political communities is inseparable from the practices that engage with refugees. In this sense, our practices of inclusion and exclusion affect the understanding of national borders as a barrier or threshold with other political communities, but also the interpretation of our own ethical-political principles. Methodenstreit in Economics. This essay offers an account of the Methodenstreit in economics between first Menger and Schmoller and later Max Weber and again Schmoller. It is argued that, for Schmoller, two issues were central; to use economics (widely conceived) as an instrument for economic policy and notably social policy: and to base the science empirically with all the modern methods available. In contrast, the Austrian position had a different view of economics as a science, seeing it more as a (...) system of ideas, which implies a radically different use of empirical evidence. (shrink)

Observational studies have suggested that some nonhuman primates’ cooperative behavior may rely on their capacity to share goals and understand the role of their partners. Experimental studies have tried to find evidence for this under controlled conditions, investigating aspects like the degree of organization in different primate species and the individuals’ capacity to recognize and choose good partners, switch roles with them, and care about their outcomes. Often, the results have been mixed. Partly, this is because of the methodological difficulties (...) inherent to empirical research. In this paper, I offer a critical, methodological review of the experimental studies done in the last years on nonhuman primates’ cooperation, I discuss their findings, and suggest possible solutions to some of the procedural problems. Hopefully, this will contribute to improve the design of future studies and therefore our knowledge about the evolutionary history of cooperation. (shrink)

Representing two generations of counselor education and practice, Megan Anna Neff and Mark McMinn provide practitioners with a fresh look at integration in a postmodern world. Modeling how to engage hard questions, they consider how different theological views, gendered perspectives, and cultures integrate with psychology and counseling.

Courtroom talk in child custody interrogations recurrently features contrasting event descriptions about ‘what happened’, as well as contrasting person descriptions. This case study – from a large set of audio-recorded courtroom examinations – documents how social workers’ contrasting narrative versions about alleged domestic violence are related to divergent problem formulations. Blame-account sequences feature descriptions of a particular event as violent or nonviolent and descriptions of a new partner as ‘non-adult’ or merely as ‘impulsive’ but ‘concerned’. Other contrasting person descriptions feature (...) a target child either as ‘normal’ or as someone who ‘has a diagnosis’. This involves categorizations of the particular child either as a victim or as someone ‘with a diagnosis’, two contrasting accounts that provide divergent explanatory formulations of what the overall problem is. Ultimately, divergent testimonies also reflect how social accounts in court reflect both mitigated/aggravated descriptions of violence and divergent accounts of parents’ and children’s agency and accountability. This study belongs to the ethnomethodological tradition of identifying the everyday practices accounting for the oiled machinery of social organization and applies this approach to understanding direction light usage. We observe a set of episodes videorecorded in North-East Italy in the urban traffic. We first unpack the meaning of direction light usage from a pragmatic perspective and then test our interpretation against the cases in our collection that seem to deviate from it. We argue that direction lights’ usage works as (...) an announcement to some road users and a request to a subset of them; in both cases, direction lights convey contextualized (indexical) coordinates about the vehicle’s prospective trajectory. We then explain the cases in which signaling is omitted and draw some implications for traffic coordination and safety. (shrink)

The aim of this article is to discern the crux of SME sector social responsibility in developing countries. An attempt is made to identify, empirically, the ethical standards subscribed to by small firms in Poland and to compare them with the standards of small firms in the UK. The methodology of empirical analysis of the ethical standards of Polish entrepreneurs running small businesses was modelled on Laura Spence’s research on the priorities, practices and ethics of small firms in the UK. (...) This analysis has revealed certain similarities and significant differences in the way CSR is perceived by Polish and British entrepreneurs. British entrepreneurs manifest a higher degree of awareness with regard to the issue of social responsibility and are more strongly motivated by their external environment to take up social responsibility issues than Polish ones. Recent developments in the field of artificial intelligence (AI) present profound challenges for law. These challenges stem from law’s anthropocentrism, which is often left unspoken. This essay examines both the epistemic and normative dimensions of anthropocentrism within German Law, with a focus on Private Law. It defends the proposition that law’s anthropocentrism does not inherently oppose the idea of granting AI some form of legal capacity. Rather, so the essay argues, it is essentially a question of regulatory prudence to determine (...) the conditions and criteria under which the law should grant a legal status, legal capacity, or partial legal capacity to AI entities. Nonetheless, it is crucial to acknowledge that the core principles of private law as well as questions of liability for fault and negligence are rooted in human agency and cannot be directly applied to AI. It will be argued that the legal discourse on the recognition of AI is to be understood as a fundamentally political discourse. The political dimension of that discourse will be analyzed through the lens of the political theories of Hannah Arendt and Jaques Rancière, among others. (shrink)

Students’ cheating is a serious problem: It undermines the chance to adequately promote, support, and evaluate them. To explain cheating behavior, research seldom focuses on perceived teachers’ characteristics. Thus, we investigate the relationship between students’ cheating behavior and an important teacher characteristic, individual reference norm orientation. We examined cheating on written exams, on homework, and in oral exams among N = 601 students in N = 31 language classes. Results from doubly manifest multi-level analyses showed that, on the classroom level, (...) cheating on written exams and on homework occurred less frequently the more the classroom of students perceived their teachers as having an IRNO. We found no further evidence for other cheating factors or student characteristics. This supports the idea that teacher characteristics are associated with some forms of students’ cheating behavior.
