Dealing with the reform of the Transplantation Law, the first issue of the new rubric “Philosophie aktuell” met with strong and lively interest from our readers. Subsequent to this discussion a growing number of reports were published dealing with violations of mandatory rules of conduct in transplantation medicine. Therefore the topic is revisited here from the slightly different vantage point “organ transplantation II: elucidation and confidence”.

Sommario. Prima che di definire un modello della coscienza e comprendere che cosa sia un fenomeno soggettivo, è necessario sviluppare una teoria della prospettiva in prima persona. Questa teoria deve essere concettualmente con- vincente, empiricamente plausibile e, soprattutto, aperta a nuovi sviluppi. Il quadro di riferimento concettuale deve essere coerente con il progresso scienti- fico. Le sue ipotesi fondamentali devono essere adattabili in modo da permette- re a nuovi risultati sperimentali di essere inseriti nel modello teorico. Questo ar- ticolo tenta (...) di definire le linee generali di una teoria in grado di offrire un’analisi rappresentazionale della prospettiva in prima persona. Tre proprietà fenomeniche sono centrali a quest’analisi: “egoicità” (la proprietà fenomenica; il senso di possesso di una sensazione), “selfhood” (l’esperienza cosciente di essere qualcuno) e la prospetticità (una caratteristica strutturale: il fatto che lo spazio fenomenico appaia organizzato attorno a un centro, una prospettiva su- per-modale). Questo articolo analizza queste proprietà da un punto di vista sia rappresentazionale che funzionale. Introdurrò nuovi vincoli concettuali per le rappresentazioni fenomeniche e due entità teoriche necessarie per capire che cosa sia la prospettiva in prima persona: “il modello fenomenico del sé” (PSM: phenomenal self model) e il “modello fenomenico della relazione intenzionale” (PMIR: phenomenal model of intentional relation). Un modello fenomenico del sé è una struttura rappresentazionale plurimodale, il cui contenuto costituisce il contenuto dell’esperienza del sé cosciente. Ha due caratteristiche importanti. Primo, è l’unica struttura rappresentazionale ancorata nel cervello da un colle- gamento funzionale permanente. Secondo, parti consistenti del PSM sono fe- nomenicamente trasparenti: non posso essere identificate come rappresentazioni all’interno del sistema. Sono intrappolate in quello che è stato definito un “in- genuo realismo auto-ingannevole”.. (shrink)

If the latter is the case, what is (...) the nature of this concept? Is it descriptive, heuristic, or even logical? The question is worth asking insofar as it is not only the most orthodox positivists who may be likely to see, in this transfer of concept, nothing more than poetic license. Indeed, the most careful commentators authorized by Merleau-Ponty are in lockstep with the critics of his supposedly “literary” style. “Ambiguous” is thus the term, which more often describes Merleau-Ponty’s notions of encroachment, of reversibility, or even chiasm. First, we shall examine the function and the role of the concept of chiasm in Merleau-Ponty’s philosophy. We shall then establish its scope in order to be able to determine its exact status. After a short summary of the interpretation of Thomas Aquinas’ conception of being given by E. Gilson, according which the actus essendi is existence, the article sets out the criticisms addressed to this conception by P.T. Geach and A. Kenny, showing that they converge with the criticism developed by the author himself in an article of 1979 on Aristotle. In the author’s view, the best reply to this criticism given by the Thomists is the reply of S.L. Brocks, who (...) has shown that the actus essendi is the perfect way of being which belongs only to God. The author shows that this conception is confirmed by some passages of Thomas’ De ente et essentia. (shrink)

Taking its cue from the famous articles in which the Jesuit Marcel Chossat, in the early decades of the last century, was the first to suggest that the doctrine of the real distinction between being and essence should be attributed to Giles of Rome, and not to Thomas Aquinas, the article proposes to consider the Neoplatonic matrix of Giles’ distinction, and to re-examine in more detail the doctrine of participation, which is the real trigger of the controversy between Giles (...) and Henry of Ghent. It suggests that Thomas Aquinas, Henry and Giles all three draw on the Proclean tradition, but each choosing different elements, as attested especially by the different readings of the fourth and ninth proposition of the De causis. Finally, it points out that the purpose of the distinction between being and essence is not at all, in Aquinas, to account for the contingency of creation, but to highlight the superiority of God not only with respect to all that possesses matter, but also to all that possesses only a form, even if intrinsically necessary. The distance between Giles and Aquinas could not be greater in this respect: the Dominican Master is not at all interested in showing the radical contingency of all creatures, including separate substances. On the contrary, insofar as he defends the idea that separate substances, as pure forms, are inseparable from their being, it remains true that one could legitimately speak, with regard to this aspect, of “St Thomas’ Averroism”, as Chossat wanted. Lettura prospettica di un caposaldo del pensiero hobbesiano: il sorgere del rapporto tra l'uomo ed il potere, tra la naturale condizione umana e la nozione di civiltà, attraverso due frammenti particolarmente rappresentativi della concezione hobbesiana del passaggio dallo stato di natura alla civiltà: il tredicesimo capitolo del Leviathan, sulla condizione naturale dell'uomo, ed il quinto capitolo, sulle cause ed origini della civitas, del De cive, giacché la mera esistenza dell'uomo ed il suo riconoscimento di una legge naturale, a giudizio di (...) Hobbes, non implica affatto necessariamente una qualsiasi forma consolidata di organizzazione sociale. Sebbene il De cive (pubblicato in latino nel 1642 e, in inglese, nel 1651) preceda cronologicamente il Leviathan (pubblicato, viceversa, dapprima in inglese, nel 1651, poi in latino, nel 1668), nell'ordine logico dell'esposizione qui presentata, il brano del Leviathan può essere considerato propedeutico al quinto capitolo del De cive, delineandone i presupposti, segnatamente la condizione di continuo pericolo per tutti causata dallo stato generale di reciproca guerra, che costituisce forse l'aspetto più noto (e frainteso) del pensiero hobbesiano. Per una migliore comprensione dei testi e delle differenti (spesso opposte) interpretazioni cui hanno dato vita, si è ritenuto di proporre, per quanto concerne i brani di Hobbes, tanto la loro traduzione in lingua italiana quanto le stesure originali in latino e inglese, presentate con i testi a fronte; tale scelta fornisce l'opportunità di osservare l'accurata scelta di alcuni dei vocaboli chiave della filosofia di Hobbes, la cui trasposizione da una lingua all'altra è stata spesso causa di fraintendimenti o volgarizzazioni in tutto o in parte ingiustificate. Allo scopo di offrire una più completa prospettiva del pensiero hobbesiano delineato nei brani selezionati, si è ritenuto di affiancare ad essi dei frammenti di interpreti novecenteschi (con delle sintetiche schede bio-bibliografiche) di alcuni concetti formulati da Hobbes e, segnatamente, di F. Tönnies, M. Horkheimer, L. Strauss, C. Schmitt, T. Parsons, N. Bobbio, H. Warrender. (shrink)

Possediamo un testo parallelo delle prime sei lezioni sul terzo libro, in cui possiamo mettere a con-fronto la dottrina di Pietro con quella di s. Tommaso. Il confronto proposto verte sul tema delle inclinazioni naturali e, segnatamente, sul loro rapporto con il bene e con il diritto naturale. Si presentano in sinossi su tre colonne il testo di Aristotele (nella traduzione latina di Guglielmo di Moerbeke utilizzata dai due commentatori), il commento di s. Tommaso ed il commento di Pietro d’Alvernia. (...) Alla fine di ciascuna sezione ho sviluppato alcune considerazioni conclusive di taglio teoretico. L’elemento teoreticamente più interessante introdotto da Pietro è costituito dall’affermazione che l’uomo “è nato per perfezionarsi” quanto al corpo e quanto all’anima ed ha a questo una esplicita in-clinazione naturale: “[Homo] natus est perfici et naturaliter inclinatur ad hoc quod perficiatur”. Qui si riecheggia l’ontologia tommasiana delle inclinazioni naturali e la metafisica del bene che le è sotte-sa. Bonum est quod omnia appetunt, ma le sostanze appetunt quella perfezione a cui sono inclinate in virtù della loro propria forma, cum unumquodque sit id quod est per suam formam. Il bene è dunque ciò che viene richiesto dalla forma dell’ente, per giungere alla piena realizzazione del dinamismo insito nella forma stessa, dinamismo che si placa solo nella piena attualizzazione di sé, ossia nella perfezione dell’ente. Bisogna notare l’attitudine di Pietro ad usare la categoria dell’inclinazione naturale, anche quando il testo aristotelico non la contiene. È necessario indugiare un po’ su questo tema, giacché in esso - a nostro giudizio - è possibile leggere il fondamento dell’etica classica, così spesso frainteso dai moderni. L’uomo è una creatura strutturalmente “indigente”: homo pluribus indiget. Quest’indigenza, per usare la terminologia di Hume contro lo stesso Hume, è un is da cui consegue rigorosamente un ought. L’indigenza è un fatto, è una carenza costatabile empiricamente; ma costatare una carenza significa scoprire nell’essere fattuale il dover essere: lo stato in cui la carenza è tolta. L’uomo, imperfectus et ex parte animae et ex parte corporis, in ragione della sua stessa imperfezione, rimanda all’uomo “perfetto”, come la potenza rimanda all’atto ed anzi è preceduta dall’atto. L’articolo esamina il rapporto fra individuo e comunità nel pensiero politico di Tommaso d’Aquino. In particolare, il problema filosofico qui discusso può es­sere presentato nel modo seguente: secondo Tommaso, l’essere di un singolo in­­dividuo è determinato dalla sua appartenenza a una data comunità politica o, vice­versa, l’essere di una comunità dipende da quello di ciascuno dei suoi mem­bri? L’articolo argomenta che Tommaso ha alcune ragioni filosofiche per an­teporre la comunità all’individuo, ma anche alcune ragioni teologiche per porre al centro l’individuo. (...) Alla fine, l’interpretazione è che, nonostante al­cu­ne possibili oscillazioni, Tommaso assuma che essere parte di una comunità po­litica, o essere cittadini, sia una proprietà necessaria ma non essenziale per definire l’essere uomo.This paper aims to reconstruct the relationship between individual and com­munity in Thomas Aquinas’s political thought. The philosophical problem I discuss is the following: On Aquinas’s writings, is the metaphysical value of an individual man finally expressed by its belonging to a certain political com­munity or, vice versa, the value of a community ensue from that of its mem­berships? I show that Aquinas has some philosophical arguments to put the community before the individual, but also some theological reasons to prefer the individual. At the end of the day, my interpretation is that, except for some hesitations that can be found in his writings, Aquinas subscribes to the view that the property of being a member of a political community, namely being a citizen, is a necessary but not an essential property for being a man. Nelle opere di Gilberto di Poitiers e dei suoi allievi più speculativi, è possibile rintracciare diverse declinazioni dell’essere, sviluppate lungo due direttriciprincipali. Dal punto di vista più squisitamente ontologico, il realismo gilbertino si presenta come un’acuta riformulazione del formalismo platonico-boeziano chetrova espressione nelle tesi della pluralità delle forme, della conformità degli individui e della partecipatio extrinseca. Da un punto di vista logico-linguistico, i Porretani riflettono con particolare acribia sulle caratteristiche e sulle componenti del sermo, elaborando un’originale teoria relativa all’applicazione criticadelle (...) categorie umane alla natura divina. Solo la fondazione di un discorso teologico rigoroso consente dunque di tenere insieme, in un pensiero coerente eschiettamente cristiano, l’essere finito e l’Essere divino. (shrink)

Nel XIII sec., il dibattito su Dio come primum cognitum si sviluppò all'interno della tradizione agostiniana anche attraverso la mediazione di Avicenna, per poi essere decisamente attaccato da Tommaso. La prima metà dello studio verte sulla posizione di Guiberto, esposta nel suo Rudimentum doctrinae, dove il problema è inquadrato all'interno della dottrina agostinana dell'illuminazione, e rapportato alla tesi bonaventuriana. La seconda parte è invece centrata sulla confutazione tomista, desunta principalmente dal prologo e dal trattato Super librum Boetii De trinitate. Nelle (...) conclusioni l'A. ribadisce, tra l'altro, la posizione intermedia presente nella Summa fratris Alexandri. (shrink)

Dès lors, cette perfection ontologique est thématisée suivant le concept de protensio, concept qui, en énonçant la positivité pure et le mouvement d’autoposition de l’être, rend pensable le primat de l’infini sur le fini.— Mentre in Tommaso d’Aquino e Bonaventura, l’infinità divina è ancora intesa negativamente, è proprio in Enrico di Gand che si può percepire l’inflettere verso la positività che annuncia la determinazione propriamente moderna del concetto di infinito : discorsivamente associato alla bontà, alla totalità e alla perfezione, presuppone una concezione quantificatrice dell’essere e l’identità dell’essere e della perfezione : enuncia allora il grado ontologico supremo in una gerarchia dei gradi dell’essere. Quindi, questa perfezione ontologica viene tematizzata secondo il concetto di protensio, concetto che, nell’enunciare la positività pura e il movimento di autoposizione dell’essere, rende pensabile il primato dell’infinito sul finito. O tema da igualdade foi tratado ao longo dos séculos das luzes em par com o tema da liberdade, contudo nesta parceria a igualdade é considerada _condição para_, e não algo _a ser buscado por si mesmo_, ao contrário da liberdade. Esse tratamento, que quase tornou a igualdade um mal necessário, exigiu uma série de restrições – ou tropeços - que introduziram nova série de desigualdades entre os membros do Estado. Os tropeços a serem discutidos aqui dizem respeito à diferença (...) entre a igualdade natural e inerente aos seres humanos e a igualdade civil construída social e politicamente, que transparecem no caminho percorrido pelo _Segundo Discurso _de Rousseau. Naquele _Discurso_, cada pessoa tinha por natureza as mesmas condições para viver independente do socorro do outro, mas desde que passaram a reunir-se e a singularidade de cada pessoa apareceu aos demais tiveram início as comparações e as preferências que as distinguiram umas das outras. Das distinções à desigualdade o caminho é curto, pois a estima pública supõe um juízo de valor acerca das habilidades que merecem ser honradas por todos e, em consequência, a diferenciação entre honrados e poderosos e aqueles que devem honrar e obedecer. A socialização parece, então, criar a desigualdade. Nosso propósito será, inicialmente, investigar o caminho da (des)igualdade entre a natureza e a sociedade com base no _Segundo Discurso_, para discutir, no âmbito do _Contrato Social_, as possibilidades de igualdade civil e sua relação com a liberdade. Die Abhängigkeit des Menschen von der Natur ist der Grund der Religion. In diesem Satz verdichtet sich das Religionsverständnis, das Ludwig Feuerbach in seiner kurzen Schrift "Das Wesen der Religion" (1846) dargelegt hat. Mit ihr rückte er den Naturbegriff in den Mittelpunkt seiner Religionsforschung. Gegenüber seiner berühmtesten Abhandlung "Das Wesen des Christentums" (1841) trieb er auf diesem Wege die Gedankengänge, die zum Ursprung der Religion führen sollten, um einige Stollen tiefer. Feuerbach erkannte in dieser Bestimmung den Schlüssel zu einem aufgeklärten Religionsverständnis. The Essence of Religion The dependence of human beings on nature is the basis of religion. This statement summarizes the understanding of religion of Ludwig Feuerbach as he presented it in his short treatise "The Essence of Religion" (1846). With this work he shifted the focus of his religious research on the concept of nature. In comparison with his most famous work "The Essence of Christianity" (1841) his thinking, trying to get to the origins of religion, is working here on a somewhat deeper level. The root of religion is not to be found only in humanity but much more in the relationship of humanity with a nature which is independent from human beings. Feuerbach saw in this definition the key to an enligthened understanding of religion. (shrink)

After a short history of the Akademie-Ausgabe der Werke Immanuel Kants, it is shown that the edition is incomplete in some essential parts: The central topic of the first part of the article is the Opus postumum. Here we have a new critical transcription which differs not only in the composition but even in many details. The second project is focused on Nachschriften of Kant’s lectures on Physische Geographie. The three volumes will show that Kant continually actualized the material for (...) this complex area of problems, for which he presented the outlines of a new academic discipline . The other central topic is the new edition of the three Critiques. The second part of the article demonstrates principle steps of critical editing using the example of Kant’s third Critique, the Critique of Judgment. (shrink)

No presente artigo nos propomos a analisar a importancia atribuida por Tocqueville às associações civis e políticas como meio de combater a tendência natural dos homens no Estado Democrático,ao isolamento e à indiferença pública, posto que essa tendência constitui-se como ameaça à liberdade e impede que a democracia reine no mundo político.

Para Tocqueville, a igualdade e a liberdade são ambas necessárias à existência de um estado democrático.No presente artigo,tentaremos provar que a realização da liberdade em um tal estado,no pensamento de Tockeville, está intrinsicamente ligada à virtude dos cidadãos.

Nosso propósito é tematizar um possível vínculo entre a natureza e a sociedade a partir da análise do sentimento espontâneo de piedade ou comiseração.

Democracy can be regarded, following Alexis de Tocquevilles thoughts, from two complementary standpoints: the equality standpoint – where equality is understood as a social condition; and the liberty standpoint – understood as a political condition. However, he observes, democracy is not a priori what it should be, denunciating, in this way, the imbalance between equality and liberty, the greater the imbalance as poor are the public virtues. We intend to enroll in a debate involving ethics and politics, by considering vices (...) and virtues inherent to democracy, analyzing Tocqueville´s ideas. Pragmatic language competence plays a central role in how aviation flight crews perform crew resource management ; this competence significantly affects aviation safety. This paper contributes to existing literature on interventionist applications of conversation analysis by defining and evaluating a novel collaborative transcription and repair based learning method for aviation CRM learning. CTRBL was evaluated using a quantitative quasi-­experimental repeated-measure design with 42 novice, university pilots. Results support that CTRBL is an effective, low-resource CRM learning method that will benefit from (...) exploratory applications and further study in pragmatics, aviation, and other sociotechnical domains. Autism research is increasingly moving to a view centred around sensorimotor atypicalities instead of traditional, ethically problematical, views predicated on social-cognitive deficits. We explore how an enactivist approach to autism illuminates how social differences, stereotypically associated with autism, arise from such sensorimotor atypicalities. Indeed, in a state space description, this can be taken as a skewing of sensorimotor variables that influences social interaction and so also enculturation and habituation. We argue that this construal leads to autism being treated on a (...) par with other sensorimotor atypicalities such as blindness or atypical height. This leads to our conclusion that, insofar there is an ethical call to inclusion in our public sphere regardless of contingent bodily difference, an enactivist take on autism naturally leads to extending such inclusion to autism. Moreover, our analysis suggests a concrete way forward to achieve inclusion of autistics: by being more attentive to autistic sensorimotor specifics. (shrink)

Human beings by nature have an end to which they are directed and concerning which they do not deliberate, namely happiness. Humans achieve this end by performing good human acts, which are produced by the intellect and the will, and perfected by the relevant virtues. Buscar nexos entre o pensamento de Rousseau e Tocqueville é facilitado porque o próprio Tocqueville afirma que Rousseau foi um dos autores que mais influenciou seu pensamento. Influência, contudo, não significa concordância; e, ser um dos que mais o influenciou não significa uma única influência; razões que tornam nossa tarefa de buscar compreender os nexos entre um e outro mais instigante. Nosso esforço, neste artigo, recairá sobre a compreensão da concepção de democracia em cada um dos autores e, neste sentido, (...) buscaremos evidenciar as características fundamentais que Rousseau, por um lado, e Tocqueville, por outro, atribuem à democracia. Em seguida, com base naquelas características apresentadas, investigaremos possíveis influências do pensamento rousseauísta sobre a concepção tocquevilleana, a fim de elucidar convergências e divergências entre os autores.
