ZusammenfassungAdipositas ist eine weltweite Herausforderung für die Gesundheitssysteme. In Zeiten des demografischen Wandels sind auch immer mehr ältere Menschen davon betroffen, was sowohl die Akut- als auch die Langzeitpflege vor erhebliche Herausforderungen stellt. Bislang fehlt eine detaillierte Analyse der vielfältigen Gruppe der über 65-Jährigen in diesem Bereich. Weder die Bedürfnisse der Pflegebedürftigen noch der Pflegekräfte und Einrichtungen werden beobachtet, analysiert oder systematisch bewertet. Darüber hinaus sind die ethischen Implikationen der professionellen Pflege von älteren Menschen mit Adipositas in Forschung und Politik (...) noch nicht diskutiert worden. Wir argumentieren, dass ein bedürfnisorientierter Ansatz angemessen ist, um diese ethische Komplexität anzugehen. Dafür sollte eine breite und umfassende Analyse der ethischen Aspekte aus einer interdisziplinären Perspektive erfolgen. Daher führen wir ein systematische Literaturrecherche (Scoping Review) und eine thematische Fallanalyse durch, um den aktuellen Stand der Forschung aus professionellen Pflegeeinrichtungen in europäischen und nordamerikanischen Institutionen zusammenzufassen. So gewinnen wir Einblicke in die direkten Erfahrungen von Leistungserbringern und adipösen Patient*innen im Pflegebereich. Wir kommen zu dem Schluss, dass auch in Deutschland ein erheblicher Forschungsbedarf an der Schnittstelle ethischer Herausforderungen von Langzeitpflege, Alter und Adipositas besteht. Aus der begrenzten Anzahl von (Fall‑)Studien, die sich finden lassen, geht eine Reihe von ethischen Bedenken hervor, die direkte Auswirkungen auf den Zugang, die Inanspruchnahme und die Qualität der Versorgung haben. Ein empirisch-ethischer Ansatz kann die künftige Forschung und Pflegepraxis im Bereich der Adipositas und der Altenpflege leiten. Schwerpunkte der zukünftigen Mixed-methods-Forschung sollten sein: die Bedürfnisse adipöser älterer Menschen und ihrer Pfleger*innen, Kriterien für die Abwägung von Bedürfnissen und Ressourcenallokation sowie praktische Lösungen für mehrfach stigmatisierte Menschen. ZusammenfassungDer vorliegende Beitrag untersucht, wie angesichts eines Interessenpluralismus ethische Diskurse über innovative und hochriskante Forschungsvorhaben angemessen geführt werden können. Dazu rekonstruieren wir erstens den Begriff des Stakeholders im Kontext seiner Entstehung in der Unternehmensethik und Anwendung in der Medizinethik und legen dessen implizite normative Prämissen frei. Wir entwickeln zweitens eine Klassifizierung von Stakeholdern und illustrieren diese am Beispiel der klinischen Forschung. Besonderes Augenmerk wird dabei auf das Kriterium der Betroffenheit gelegt. Drittens werden für unterschiedliche Formen der Betroffenheit von Stakeholdern angemessene (...) Beteiligungsverfahren vorgestellt, die von Information bis Empowerment reichen können. Wir zeigen, warum es für ethische Diskurse in der Medizin- und Bioethik wichtig ist, Betroffenheit und Beteiligungsverfahren auf transparente und nachvollziehbare Weise in ein reflektiertes Verhältnis zu setzen und wie das praktisch zu bewerkstelligen ist. Given the need for organs, public organizations use social marketing strategies to increase the number of donors. Their campaigns employ a variety of moral appeals. However, their effects on audiences are unclear. We identified 14 campaigns in Germany from over the last 20 years. Our approach combined a multimodal analysis of categorized posters with a qualitative analysis of responses, collected in interviews or focus groups, of 53 persons who were either skeptical or undecided about organ donation. The combined analyses revealed (...) that the posters failed to motivate laypersons in general to donate, and were even less effective on skeptical or undecided individuals. We explain this in terms of the types of moral messages found on posters and the limits of such social marketing strategies. Furthermore, we discuss certain ethical aspects of organ donation campaigns pertaining to communicating norms and trust in public institutions. (shrink)

The British writer John Wyndham (1903–1969) explored societal effects of surprising or mystical events. A paradigmatic example is _The Midwich Cuckoos_ (1957), which portrays identical-looking children born without sexual intercourse. I propose a reading strategy that focuses on the fictional spatial order and analyses how the construction of the children’s otherness interferes with the village’s demarcation. Furthermore, I interpret the mysterious pregnancies as a reference to basic embryo research in the 1950s – cloning. Finally, I scrutinize Wyndham’s negotiation of utilitarianism (...) throughout the novel and his critique of truly utilitarian decisions that are based on constructions of Otherness. (shrink)

In the film Never Let Me Go, clones are forced to donate their organs anonymously. As a work of fiction, this film can be regarded as a negotiation of limited agency, since the clones are depicted as vulnerable individuals. Thereby, it evokes a confrontation with underprivileged positions in technocratic societies, encouraging the audience to take the perspective of the marginalised. The clones are situated in ‘privileged deprivation’; from the audience’s point of view, they are unable to evolve into autonomous agents—but (...) from their own perspective within the dystopian system, they are still ‘privileged’. In this paper, we analyse the depiction of the clones’ personal development. Further, we examine references to bioethical aspects as well as technologies that affect the human body both on a micro and macro level—cloning and its impact on the human embryo and organ donation practised on the full-grown human body. We argue that this film as a reference for the discussion in popular culture focuses on individuals who do not profit from modern technical progress or do not have enough agency to refuse it. To make this point, we analyse the film’s fictional story, set in a form of alternate history, as a negotiation of a historical context which brings out the idea of neglected voices. (shrink)

ZusammenfassungDer vorliegende Beitrag erläutert anhand ausgewählter Beispiele das Potential von Dystopien für die Bioethik. Hierfür werden bestehende Ansätze narrativer Ethik kritisch rekonstruiert und erweitert. Mittels eines Theorieangebots aus der Literaturwissenschaft wird vorgeschlagen, moralische Überzeugungen, die Dystopien motivieren, in kohärentistische Reflexions- und Begründungsverfahren einzubeziehen. Weiterhin wird systematisch herausgearbeitet, welches Potential Dystopien durch sozio-kulturell dichte Szenarien, einen zeitgeschichtlichen Kontext und durch eine Sensibilisierung für die moralische Relevanz der Sprache für die bioethische Forschung bieten. Die dargestellten methodologischen Überlegungen bieten zum einen praktische Bezugspunkte (...) für didaktische Ansätze und zum anderen für die öffentliche Deliberation. Der Beitrag analysiert Techniken öffentlicher Gesundheitskommunikation und skizziert im Ausblick Minimalbedingungen für ihre ethische Vertretbarkeit. Dazu wird erstens an einem aktuellen Beispiel veranschaulicht, wie mittels Text und Bild die Öffentlichkeit überzeugt werden soll, ein bestimmtes Gesundheitsverhalten an den Tag zu legen. Zweitens werden anhand der internationalen Ethik-Debatte fünf Grundtypen von Techniken in der Gesundheitskommunikation (Information, Argumentation, Persuasion, Manipulation und Zwang) rekonstruiert und entlang von Mittel, Zweck, Folgen für Adressaten sowie Implikationen für Autonomie aus ethischer Sicht unterschieden. Am besonders ambivalenten Beispiel (...) der Persuasion wird dann drittens diskutiert, welche ethischen Fallstricke es bei Gesundheitskommunikation zu bedenken gibt. Schließlich zeigen wir argumentativ auf, dass es in sensiblen bioethischen Themenfeldern wichtig ist, zwischen verschiedenen Techniken der Gesundheitskommunikation analytisch zu differenzieren. This paper gives an introduction to the interdisciplinary special section. Against the historical and ethical background of reproductive technologies, it explores future scenarios of human reproduction and analyzes ways of mutual engagement between fictional and academic endeavors. The underlying idea is that we can make use of human reproduction scenarios in at least two ways: we can use them to critique technologies by imagining terrible consequences for humanity but also to defend positions that favor scientific and technological development.

This art-science-interaction article focuses on moral implications of a recent science announcement. Against the background of literary and cultural theories, it compares a YouTube story with narratives employed in fictional stories.

In diesem Aufsatz eröffnen wir durch die Auseinandersetzung mit einem Dokumentarfilm ethische Fragen, die mit der transnationalen indischen Leihmutterschaft in Verbindung stehen. Über den filmisch präsentierten Alltag von Leihmüttern wird deutlich, dass der Diskurs über kommerzielle Leihmutterschaft einer sensiblen Kontextualisierung für den spezifischen indischen Kontext bedarf. Die Perspektive von Surabhi Sharma bereichert die Diskussion, da sie den Zusammenhang von (...) Leihmutterschaft und Arbeit fokussiert. With regard to organ donation, Germany is an ‘opt-in’ country, which requires explicit consent from donors. The relatives are either asked to decide on behalf of the donors’ preferences, if these are unknown or if the potential donor has explicitly transferred the decision to them. At the core of this policy lies the sociocultural and moral premise of a rational, autonomous individual, whose rights require legal protection in order to guarantee a voluntary decision. In concrete transplantation practices, the family plays (...) an even more important role. Potential donors and their families decide while being embedded in relations, a point which does still not gain full recognition. This particular discrepancy between policy and practice creates conflicts, which remain taboos of academic inquiry and public discourse. Our analysis shows a plurality of the family’s role in the transplantation process, which reveals an inner tension of the organ donation system. This tension provokes epistemic opacity on the one hand and different collective strategies as responses to discursive exclusion on the other. In future deliberations about organ donation, it is important to create spaces for open discussion, but also practices of communicative engagement, which take care of the needs and emotions attached to taboos. In the traditions of narrative ethics and casuistry, stories have a well-established role. Specifically, illness narratives provide insight into patients’ perspectives and histories. However, because they tend to see fiction as an aesthetic endeavour, practitioners in these traditions often do not realize that fictional stories are valuable moral sources of their own. In this paper I employ two arguments to show the mutual relationship between bioethics and fiction, specifically, science fiction. First, both discourses use imagination to set a scene and (...) determine a perspective. Second, bioethics and science fiction share the family resemblance of expressing moral beliefs. I then consider how understanding bioethics and science fiction as interrelated discourses can be the basis of a methodology for inquiry into relational autonomy in the context of biotechnologies and medicine. This book explores how a sense of wonder and the musicality of silence can be a rehumanizing force in education, health and welfare, countering overly anthropocentric and instrumental worldviews. Wonder - in an aesthetic, philosophical, and spiritual sense - brings human beings in resonance with the world again.

In the past few years there has been a turn towards evaluating the empirical foundation of epistemic contextualism using formal (rather than armchair) experimental methods. By-and-large, the results of these experiments have not supported the original motivation for epistemic contextualism. That is partly because experiments have only uncovered effects of changing context on knowledge ascriptions in limited experimental circumstances (when contrast is present, for example), and partly because existing experiments have not been designed to distinguish between contextualism and one of (...) its main competing theories, subject-sensitive invariantism. In this paper, we discuss how a particular, "third-person", experimental design is needed to provide evidence that would support contextualism over subject-sensitive invariantism. In spite of the theoretical significance of third-person knowledge ascriptions for debates surrounding contextualism, no formal experiments evaluating such ascriptions that assess contextualist claims have previously been conducted. In this paper, we conduct an experiment specifically designed to examine that central gap in contextualism’s empirical foundation. The results of our experiment provide crucial support for epistemic contextualism over subject-sensitive invariantism. (shrink)

This article argues that late Heidegger’s analyses of the Fourfold can be used as a methodological starting point for discourse analyses. It argues that the Fourfold points out elements or foundations of discursive structures that orient us to differing, and to some extent opposing, directions that are at the same time mutually interdependent. A discursive analysis of how the Fourfold is at play in prevailing discursive exchanges and structures will thus be a matter of situating ourselves in a conceptual space (...) beyond existing practices and structures, from which we get a picture of their inadequacies. As such, the article contributes to a critical understanding of discourse analysis. It will be argued that through understanding the Fourfold, we can better understand the problems with various aspects of ‘measuring’, which are founded upon the (concealed) instability of elements of the Fourfold – which shapes practical discursive engagements. By foregrounding this structural instability we can approach it critically. I demonstrate how this approach might be used in an analysis of a debate between Greta Thunberg and Bjørn Lomborg. Abstract In this article, we investigate the merits of an enactive view of cognition for the contemporary debate about social cognition. If enactivism is to be a genuine alternative to classic cognitivism, it should be able to bridge the “cognitive gap”, i.e. provide us with a convincing account of those higher forms of cognition that have traditionally been the focus of its cognitivist opponents. We show that, when it comes to social cognition, current articulations of enactivism are—despite their celebrated successes (...) in explaining some cases of social interaction—not yet up to the task. This is because they (1) do not pay sufficient attention to the role of offline processing or “decoupling”, and (2) obscure the cognitive gap by overemphasizing the role of phenomenology. We argue that the main challenge for the enactive view will be to acknowledge the importance of both coupled (online) and decoupled (offline) processes for basic and advanced forms of (social) cognition. To meet this challenge, we articulate a dynamic embodied view of cognition. We illustrate the fruitfulness of this approach by recourse to recent findings on false belief understanding. Alice Crary has recently developed a radical reading of J. L. Austin's philosophy of language. The central contention of Crary's reading is that Austin gives convincing reasons to reject the idea that sentences have context-invariant literal meaning. While I am in sympathy with Crary about the continuing importance of Austin's work, and I think Crary's reading is deep and interesting, I do not think literal sentence meaning is one of Austin's targets, and the arguments that Crary attributes to Austin or (...) finds Austinian in spirit do not provide convincing reasons to reject literal sentence meaning. In this paper, I challenge Crary's reading of Austin and defend the idea of literal sentence meaning. (shrink)

G. A. Cohen argues that egalitarians should compensate for expensive tastes or for the fact that they are expensive. Ronald Dworkin, by contrast, regards most expensive tastes as unworthy of compensation — only if a person disidentifies with his own such tastes (i.e. wishes he did not have them) is compensation appropriate. Dworkinians appeal, inter alia, to the so-called ‘first-person’ or ‘continuity’ test. According to the continuity test, an appropriate standard of interpersonal comparison reflects people's own assessment of their relative (...) standing: Person A can only legitimately demand compensation from person B if he regards himself as worse off, all things considered, than B. The typical bearer of expensive tastes does not regard herself as being worse off than others with less expensive tastes. Hence, in the typical case, pace Cohen, compensation for expensive tastes is inappropriate. The article scrutinizes this rationale for not compensating for expensive tastes. Especially, we try to bolster the continuity test by relating it to Dworkin's distinction between integrated and detached values, pointing out that an argument for the continuity test can be built on the assumption that equality has integrated value. In brief, the point is that a metric of equality should be assessed, partly, in virtue of its consequences for related ideals. One of these is the kind of justificatory community promoted by the continuity test. We defend this view against an objection to the effect that equality is a detached value. We conclude that the continuity test constitutes a strong foothold for the resourcist egalitarian reluctance to compensate people for their expensive tastes. (shrink)

Visual Associative agnosia is a rare perceptual impairment generally resulting from lesions in the infero temporal cortex. Patients suffering from associative agnosia are able to make accurate copies of line drawings, but they are unable to visually recognize objects - including those represented in line drawings - as belonging to familiar high-level kinds. The Rich Content View claims that visual experience can represent high-level kind properties. The phenomenon of associative agnosia appears to present us with a strong case for the (...) Rich Content View. There are reasons for thinking that the experiences of an agnosic patient differ from those of a healthy subject. Given that there is a phenomenal contrast between the experiences of an associative agnosic and those of a healthy perceiver, one may argue that this contrast is due to differences in abilities to represent high-level kinds. I claim that there is indeed a phenomenal contrast between the visual experiences of an agnosic and those of a healthy perceiver. However, the explanation of this contrast that best fits the empirical data is compatible with the view that visual experience does not represent high-level kinds. (shrink)

This symposium of the Journal of Bioethical Inquiry illustrates structural competency: how clinical practitioners can intervene on social and institutional determinants of health. It will require training clinicians to see and act on structural barriers to health, to adapt imaginative structural approaches from fields outside of medicine, and to collaborate with disciplines and institutions outside of medicine. Case studies of effective work on all of these levels are presented in this volume. The contributors exemplify structural competency from many angles, from (...) the implications of epigenetics for environmental intervention in personalized medicine to the ways clinicians can act on fundamental causes of disease, address abuses of power in clinical training, racially desegregate cities to reduce health disparities, address the systemic causes of torture by police, and implement harm-reduction programs for addiction in the face of punitive drug laws. Together, these contributors demonstrate the unique roles that clinicians can play in breaking systemic barriers to health and the benefit to the U.S. healthcare system of adopting innovations from outside of the United States and outside of clinical medicine. The rapid and unplanned change to teaching and learning in the online format brought by COVID-19 has likely impacted many, if not all, aspects of university students' lives worldwide. To contribute to the investigation of this change, this study focuses on the impact of the pandemic on student well-being, which has been found to be as important to student lifelong success as their academic achievement. Student well-being has been linked to their engagement and performance in curricular, co-curricular, and extracurricular activities, (...) intrinsic motivation, satisfaction, meaning making, and mental health. The purpose of this study was to examine how student perceptions of their degree completion and future job prospects during the pandemic impact their well-being and what role university support plays in this relationship. We used the conservation of resources theory to frame our study and to develop five hypotheses that were later tested via structural equation modeling. Data were collected from 2,707 university students in France, Germany, Russia, and UK via an online survey. The results showed that university support provided by instructors and administration plays a mediating role in the relationship between the perceived impact of COVID-19 on degree completion and future job prospects and levels of student well-being. Student well-being is decreased by their concerns for their degree completion but not by their concerns for future job prospects. In turn, concerns for future job prospects affect student well-being over time. These results suggest that in a “new normal,” universities could increase student well-being by making support to student studies a priority, especially for undergraduates. Also, universities should be aware of the students' changing emotional responses to crisis and ensure visibility and accessibility of student support. (shrink)

Accessing BRCA1/2 data facilitates the detection of disease-associated variants, which is critical to informing clinical management of risks. BRCA1/2 data sharing is complex and many practices exist. We describe current BRCA1/2 data-sharing practices, in the United States and globally, and discuss obstacles and incentives to sharing, based on 28 interviews with personnel at U.S. and non-U.S. clinical laboratories and databases. Our examination of the BRCA1/2 data-sharing landscape demonstrates strong support for and robust sharing of BRCA1/2 data around the world, increasing (...) global accesses to diverse data sets. In her recent writings on the powers and limits of psychoanalysis, Julia Kristeva develops a theory of power and subjectivity that engages implicitly, if not explicitly, with biopolitical themes. Exploring these engagements, this paper draws on Kristeva to discuss the mute symptoms of homo sacer and the regulatory power of the spectacle. Staging an uncommon (and sometimes antagonistic) conversation between Kristeva, Agamben, and Foucault, I construct a field of inquiry that I term the “psychic life of biopolitics.”.

Recent evidence indicates that transcriptional bursts are intrinsically amplified by messenger RNA cytoplasmic processing to generate large stochastic fluctuations in protein levels. These fluctuations can be exploited by cells to enable probabilistic bet‐hedging decisions. But large fluctuations in gene expression can also destabilize cell‐fate commitment. Thus, it is unclear if cells temporally switch from high to low noise, and what mechanisms enable this switch. Here, the discovery of a post‐transcriptional mechanism that attenuates noise in HIV is reviewed. Early in its (...) life cycle, HIV amplifies transcriptional fluctuations to probabilistically select alternate fates, whereas at late times, HIV utilizes a post‐transcriptional feedback mechanism to commit to a specific fate. Reanalyzing various reported post‐transcriptional negative feedback architectures reveals that they attenuate noise more efficiently than classic transcriptional autorepression, leading to the derivation of an assay to detect post‐transcriptional motifs. It is hypothesized that coupling transcriptional and post‐transcriptional autoregulation enables efficient temporal noise control to benefit developmental bet‐hedging decisions. (shrink)

In "New Forms of Revolt," Julia Kristeva maintains that intimate revolt is a necessary, if imperiled, mode of contemporary resistance. This essay reflects on the pedagogical dimensions of intimate revolt and its fate in university contexts, especially in the United States. I argue that a Kristevan pedagogical revolt involves upheavals of thought supported by loving listening relationships.

In a recent systematic review of the Sustainability Balanced Scorecard literature in this journal, we developed a typology of architectures as a basis for the process of SBSC design, implementation, use, and evolution. This paper addresses a comment by Hahn and Figge designed to stimulate further research. We argue that the existing literature demonstrates that the SBSC management tool can play an important role in corporate sustainability. The SBSC architectures—as representations of goals and priorities—form an integral and iterative part of (...) the corporate sustainability strategy-making process and therefore cannot be isolated from it. However, the concept as such should not be overloaded. In this paper, we first reflect on the potentials and constraints of the SBSC in relation to radical or transformational change and measuring performance outcomes on the level of human–earth systems. Second, we discuss the importance of SBSC architecture concerning how it enables the integration of sustainability into business organisations; how both strictly hierarchical cause-and-effect chains and less hierarchical designs can allow companies to seek inclusive profits; and the contingency-based use of generic architectures in contrast to its use as a diagnostic tool. Many contemporary critiques of `modernity' target a caricatured construction of `modernity-as-universalist-reason'. Such critiques are often blind to the constitutive splits and tensions within the philosophical and political horizons of modernity between a rationalist and a romanticist episteme. These critiques are therefore also oblivious to the fact that their own critiques of modernity move on a terrain heavily structured and prefigured by older romanticist critiques of reason and scientific objectivity. Some of the persistent problems in romanticist thought - the celebration of (...) authenticity and a recurrent essentialism - reappear in current post-structuralist critiques of modernity. This is particularly evident in the debates in South Asia - emerging from the subaltern studies group in India, from debates on hybridity and migration, and on post-coloniality as a critique of Western modernity. Rather than launching essentializing and totalizing critiques of `modernity-as-universalist-reason', which tend to reproduce the metaphysical fallacies of romanticism, critiques of modernity could more fruitfully unfold as concrete critiques of modern practices and institutions. Abstract The use of photo research methods is influenced by underlying ontological and epistemological assumptions. Variant assumptions about reality and knowledge converge to conceive a relationship between the knower and what can be known. These assumptions provide the rationale for decided ways of engaging participants in the process of scientific inquiry. In this paper, we examine how perspectives of realism and relativism may shape epistemological understandings and influence type and use of photo methods in qualitative research. Based on deliberations about (...) underlying ontological and epistemological assumptions and related strengths and challenges of photo methods, we assert that photo methods contribute to the development of knowledge that both matters to participants and informs nursing practice. This paper introduces a logic to reason about a well-known model of opinion dynamics in socialnetworks initially developed by Morris DeGroot as well as Keith Lehrer and Carl Wagner. The proposed logic is an extension of Lukasiewicz' famous fuzzy logic with additional equational expressivity, modal operators, machinery from hybrid logic, and dynamic modalities. The model of opinion dynamics in social networks is simple enough to be easily grasped, but still complex enough to have interesting mathematical properties and applications.
