The Sovereignty of Human Rights advances a legal theory of international human rights that defines their nature and purpose in relation to the structure and operation of international law. Professor Macklem argues that the mission of international human rights law is to mitigate adverse consequences produced by the international legal deployment of sovereignty to structure global politics into an international legal order. The book contrasts this legal conception of international human rights with moral conceptions that conceive of human rights (...) as instruments that protect universal features of what it means to be a human being. The book also takes issue with political conceptions of international human rights that focus on the function or role that human rights plays in global political discourse. It demonstrates that human rights traditionally thought to lie at the margins of international human rights law - minority rights, indigenous rights, the right of self-determination, social rights, labor rights, and the right to development - are central to the normative architecture of the field. Legal debates about humanitarian intervention tend to assume that its legitimacy is irrelevant to its legality, while political theorists often assume the inverse. This paper defends an alternative account, which sees the legality and legitimacy of humanitarian intervention as intertwined.

The language of “participant-driven research,” “crowdsourcing” and “citizen science” is increasingly being used to encourage the public to become involved in research ventures as both subjects and scientists. Originally, these labels were invoked by volunteer research efforts propelled by amateurs outside of traditional research institutions and aimed at appealing to those looking for more “democratic,” “patient-centric,” or “lay” alternatives to the professional science establishment. As mainstream translational biomedical research requires increasingly larger participant pools, however, corporate, academic and governmental research programs (...) are embracing this populist rhetoric to encourage wider public participation. We examine the ethical and social implications of this recruitment strategy. We begin by surveying examples of “citizen science” outside of biomedicine, as paradigmatic of the aspirations this democratizing rhetoric was originally meant to embody. Next, we discuss the ways these aspirations become articulated in the biomedical context, with a view to drawing out the multiple and potentially conflicting meanings of “public engagement” when citizens are also the subjects of the science. We then illustrate two uses of public engagement rhetoric to gain public support for national biomedical research efforts: its post-hoc use in the “care.data” project of the National Health Service in England, and its proactive uses in the “Precision Medicine Initiative” of the United States White House. These examples will serve as the basis for a normative analysis, discussing the potential ethical and social ramifications of this rhetoric. We pay particular attention to the implications of government strategies that cultivate the idea that members of the public have a civic duty to participate in government-sponsored research initiatives. We argue that such initiatives should draw from policy frameworks that support normative analysis of the role of citizenry. And, we conclude it is imperative to make visible and clear the full spectrum of meanings of “citizen science,” the contexts in which it is used, and its demands with respect to participation, engagement, and governance. This book explores the role of aggression in primate social systems and its implications for human behavior.

We write as Australian youth work educators. We consider some of the ethical challenges involved in teaching youth work ‘in a warm climate’, situated in the diaspora of English youth work but where youth work also has a uniquely Australian character, placing us in an ethically liminal space in our teaching between an understanding of youth work that is robustly defended as being both ‘good’ and ‘true’, and what we do, which is different from this, and has its own character (...) and strengths. We situate this in the policy history of youth work in Australia, particularly in the ‘neoliberal turn’ that this has taken in the last four decades which has created ethical challenges for us, just as it has for those elsewhere. Two guiding questions shape this paper. The first is, given our differences, what challenges do we face in maintaining connections with ‘good’ youth work and its value base as traditionally defined and defended in England, and relatedly, given that policy and funding regimes in the UK seem to be aligning more with an Australian model, is there anything that the youth work community in the UK can learn from the Australian experience? How is the validity of our consent, and others’ moral permission to act on our consent affected by coercion? Everyone agrees that in cases of two-party coercion—when X coerces Y to do something with or for X—the consent of the coerced is invalid, and the coercer is not permitted to act upon the consent they receive. But coercers and the recipients of consent are not always identical. Sometimes a victim, Y, agrees to do something to, with, or for Z because (...) they are being coerced by X. Recently, several philosophers have argued that consent under third-party coercion can be fully valid. We argue that this view has troubling implications. We develop a novel view of consent in third-party coercion cases, which we call the partial validity account. The core idea is that, under severe coercion, Y’s consent is at most partially valid—it reduces the strength of, but does not completely dissolve, Z’s consent-sensitive duties. We argue that the partial validity account gets the right results in important cases and explains the moral factors at play better than alternative accounts. (shrink)

This paper is an investigation of the relationship between G\"odel's second incompleteness theorem and the well-foundedness of jump hierarchies. It follows from a classic theorem of Spector's that the relation $\{(A,B) \in \mathbb{R}^2 : \mathcal{O}^A \leq_H B\}$ is well-founded. We provide an alternative proof of this fact that uses G\"odel's second incompleteness theorem instead of the theory of admissible ordinals. We then derive a semantic version of the second incompleteness theorem, originally due to Mummert and Simpson, from this result. Finally, (...) we turn to the calculation of the ranks of reals in this well-founded relation. We prove that, for any $A\in\mathbb{R}$, if the rank of $A$ is $\alpha$, then $\omega_1^A$ is the $(1 + \alpha)^{\text{th}}$ admissible ordinal. It follows, assuming suitable large cardinal hypotheses, that, on a cone, the rank of $X$ is $\omega_1^X$. (shrink)

Certain philosophers have argued in favour of recognising a right to freedom of conscience that includes a defeasible right of individuals to live in accordance with their perceived moral duties. This right requires the government to exempt people from general laws or regulations that prevent them from acting consistently with their perceived moral duties. The importance of protecting individuals’ integrity is sometimes invoked in favour of accommodating conscience. I argue that personal integrity is valuable since autonomy, identity and self-respect are (...) all dependent on the preservation of personal integrity. I respond to two objections, one pressed by Andrew Koppelman and the other by Richard Arneson, to the claim that personal integrity is valuable, and to a further argument by Arneson to the effect that it is unfair to others claiming accommodations to exempt those with conscience-based claims. Deontic necessity modals (e.g. 'have to', 'ought to', 'must', 'need to', 'should', etc.) seem to vary in how they interact with negation. According to some accounts, what forces modals like 'ought' and 'should' to outscope negation is their polarity sensitivity -- modals that scope over negation do so because they are positive polarity items. But there is a conflict between this account and a widely assumed theory of if-clauses, namely the restrictor analysis. In particular, the conflict arises for constructions containing (...) a bound pronoun in the if-clause. This note spells out the core conflict. (shrink)

This paper addresses the relationship between amnesty granted to perpetrators of serious human rights abuses and retributivism. It rebuts arguments advanced by Dan Markel and Lucy Allais in support of their claim that the granting of conditional amnesty—amnesty in exchange for perpetrators’ confessing to, and disclosing the details of, their wrongdoing—by the South African Truth and Reconciliation Commission (TRC) was consistent with retributivism. Markel contends that conditional amnesty was perfectly in line with recipients’ desert, while Allais submits that the TRC (...) secured as much retribution as was possible in the circumstances of South Africa’s democratic transition. The argument of the paper is that while retributivists have good reasons to view conditional amnesty as justified, the reasons provided by Markel and Allais are not among them. (shrink)

One of Derek Parfit’s greatest legacies was the search for Theory X, a theory of population ethics that avoided all the implausible conclusions and paradoxes that have dogged the field since its inception: the Absurd Conclusion, the Repugnant Conclusion, the Non-Identity Problem, and the Mere Addition Paradox. In recent years, it has been argued that this search is doomed to failure and no satisfactory population axiology is possible. This chapter reviews Parfit’s life’s work in the field and argues that he (...) provided all the necessary components necessary for a Theory X. It then shows how these components can be combined together and applied to the global challenges Parfit argued matter most: preventing human extinction, managing catastrophic risks, and eradicating global poverty and suffering. This paper proposes that there is a kind of moral luck that hasn’t been recognized in the philosophical literature: luck in the ‘wide’ contents of one’s concepts. We will treat moral luck as occurring when an agent is morally responsible for X—when X is a matter of luck for that agent. If moral luck is possible and content externalism is true, then there is a heretofore unrecognized kind of moral luck. We call it “conceptual moral luck.” This new kind of (...) moral luck poses significant problems for two major theories of morally responsible agency, Agent-Causal Libertarianism and the Real Self View. Drawing on Max Scheler’s political-programmatic writings produced during and after World War I, this contribution intends to examine the content and consistency of the ideal of a cultural-spiritual unity of Europe (as distinct from its political, legal, or economic unity), and to provide a basis for discussing its plausibility and fruitfulness for the present time. About 100 years ago, the philosopher thought about the future of Europe, and claimed to be able to infer concrete orientations for political action from fundamental (...) philosophical insights. Thus, the paper proceeds from conceptual foundations to their application to concrete practical problems. The first section intends to outline the concept of cultural unity and the principle of solidarity between cultural unities; this makes it possible, in the second part, to distinguish the European cultural sphere from others; the final section gives a positive determination of the specific unity of European culture, including some educational consequences. While game theory has been transformative for decision making, the assumptions made can be overly restrictive in certain instances. In this work, we investigate some of the underlying assumptions of rationality, such as mutual consistency and best response, and consider ways to relax these assumptions using concepts from level-k reasoning and quantal response equilibrium (QRE) respectively. Specifically, we propose an information-theoretic two-parameter model called the quantal hierarchy model, which can relax both mutual consistency and best response while still approximating level-k, (...) QRE, or typical Nash equilibrium behavior in the limiting cases. The model is based on a recursive form of the variational free energy principle, representing higher-order reasoning as (pseudo) sequential decision-making in extensive-form game tree. This representation enables us to treat simultaneous games in a similar manner to sequential games, where reasoning resources deplete throughout the game-tree. Bounds in player processing abilities are captured as information costs, where future branches of reasoning are discounted, implying a hierarchy of players where lower-level players have fewer processing resources. We demonstrate the effectiveness of the quantal hierarchy model in several canonical economic games, both simultaneous and sequential, using out-of-sample modelling. (shrink)

Barack Obama has called him “one of my favorite philosophers.” John McCain wrote that he is “a paragon of clarity about the costs of a good war.” Andrew Sullivan has said, “We need Niebuhr now more than ever.” For a theologian who died in 1971, Reinhold Niebuhr is maintaining a remarkably high profile in the twenty-first century. In _Why Niebuhr Now?_ acclaimed historian John Patrick Diggins tackles the complicated question of why, at a time of great uncertainty about America’s (...) proper role in the world, leading politicians and thinkers are turning to Niebuhr for answers. Diggins begins by clearly and carefully working through Niebuhr’s theology, which focuses less on God’s presence than his absence—and the ways that absence abets the all-too-human sin of pride. He then shows how that theology informed Niebuhr’s worldview, leading him to be at the same time a strong opponent of fascism and communism and a leading advocate for humility and caution in foreign policy. Turning to the present, Diggins highlights what he argues is a misuse of Niebuhr’s legacy on both the right and the left: while neoconservatives distort Niebuhr’s arguments to support their call for an endless war on terror in the name of stopping evil, many liberal interventionists conveniently ignore Niebuhr’s fundamental doubts about power. Ultimately, Niebuhr’s greatest lesson is that, while it is our duty to struggle for good, we must at the same time be wary of hubris, remembering the limits of our understanding. The final work from a distinguished writer who spent his entire career reflecting on America’s history and promise, _Why Niebuhr Now? _is a compact and perceptive book that will be the starting point for all future discussions of Niebuhr. This paper investigates the consequences of taking seriously the metaphysics of Object-Oriented Ontology (OOO), as defined by Graham Harman, in the field of literature. Acutely focusing on just one possible mobilisation and application of the theory, the essay deploys OOO to read two major writers of the late 20th century, Don DeLillo and Murakami Haruki, in novel configurations made possible by applying an Object-Oriented method to the genre of Magic Realism. Using this method, the essay unearths an unarticulated avenue for (...) studying the genre and these authors against established national, cultural, and canonical boundaries in literature, putting into conversation various literary traditions based on formal characteristics found in the texts through OOO’s metaphysics, and suggesting wholly untested paths for literary study in the wake of Object-Oriented philosophies. Fénelon may be the most neglected of all the major early modern philosophers. His political masterwork was the most-read book in eighteenth-century France after the Bible, yet today even specialists rarely engage his work directly. This problem is particularly acute in the Anglophone world, for while Fénelon's works have been published in several excellent modern French editions, only the smallest fraction of his vast and influential corpus has appeared in modern English translation. This volume aims to help remedy this by (...) bringing to English-language audiences the first collection of his moral and political writings in translation. By so doing it hopes to make more widely available the riches of one of the leading voices of resistance to the absolutism of Louis XIV. Fénelon's political thought will thus be of particular interest to students and scholars of French history, as well as to those today engaged in questions of political resistance and reform. But Fénelon's reach also extends to fields well beyond politics and ethics. We answer a question of Slaman and Steel by showing that a version of Martin’s conjecture holds for all regressive functions on the hyperarithmetic degrees. A key step in our proof, which may have applications to other cases of Martin’s conjecture, consists of showing that we can always reduce to the case of a continuous function.

Critical theory has recently charted the rise of an unprecedented wave of social acceleration transforming Western capitalism. Within that body of work, a tendency has emerged to frame this new temporality as a stable structure lacking in the possibility for visions of alternatives, let alone for substantive revolt or challenge. This essay argues that recent struggles like Occupy and 15-M experimented with an alternative, utopian temporality that challenged and disrupted acceleration, revealing the latter to be prone to generating and expanding (...) the conditions of temporal struggle. Acceleration is therefore unstable, and cannot be adequately understood apart from its increasing cultivation of visions of and experiments in other temporalities. (shrink)

As identity and authenticity discourses increasingly saturate everyday life, so too have these concepts spread across the humanities and social sciences literatures. Many scholars may be interested in identity and authenticity, but lack knowledge of paradigmatic or disciplinary approaches to these concepts. This volume offers readers insight into social constructionist approaches to identity and authenticity. It focuses on the processes of identification and authentication, rather than on subjective experiences of selfhood. There are no attempts to settle what authentic identities are. (...) On the contrary, contributors demonstrate that neither identities nor their authenticity have a single or fixed meaning. Chapters provide exemplars of contemporary research on identity and authenticity, with significant diversity among them in terms of the identities, cultural milieu, geographic settings, disciplinary traditions, and methodological approaches considered. Contributors introduce readers to a number of established and emerging identity groups from sites around the world, from yogis and punks to fire dancers and social media influencers. Despite the challenges associated with virtually mediated communication, remote collaboration is a defining characteristic of online multiplayer gaming communities. Inspired by the teamwork exhibited by players in first-person shooter games, this study investigated the verbal and behavioral coordination of four-player teams playing a cooperative online video game. The game, Desert Herding, involved teams consisting of three ground players and one drone operator tasked to locate, corral, and contain evasive robot agents scattered across a large desert environment. Ground players could move (...) throughout the environment, while the drone operator’s role was akin to that of a “spectator” with a bird’s-eye view, with access to veridical information of the locations of teammates and the to-be-corralled agents. Categorical recurrence quantification analysis was used to measure the communication dynamics of teams as they completed the task. Demands on coordination were manipulated by varying the ground players’ ability to observe the environment with the use of game “fog.” Results show that catRQA was sensitive to changes to task visibility, with reductions in task visibility reorganizing how participants conversed during the game to maintain team situation awareness. The results are discussed in the context of future work that can address how team coordination can be augmented with the inclusion of artificial agents, as synthetic teammates. (shrink)

This article explores what Cicero as a political thinker can offer to the study of international relations. Although previous readings of Cicero have emphasized his Stoic influences and his natural law teaching as the basis of a cosmopolitan world society, I emphasize the way in which Cicero can deepen the concept of international society. International society relies on certain norms and institutions to function properly, such as international law, sovereignty, and the use of war to restrain violence and redress injustice. (...) We find all these concepts articulated clearly in Cicero’s moral and political thought. Cicero also shows the limits of these institutions and norms, explaining why none of them is absolute. Finally, Cicero adds to our theorizing about international society by drawing attention to the role of honor, ruling, and inequality in international society. As such, classical political thought, and Cicero’s in particular, provide a valuable resource for future thinking about international theory. (shrink)

Our thesis is that there can be no question that Derridean deconstruction is a philosophy that concerns the animal, that is, it is a thought that not only reflects on the animal, but which more originally is reflected in (...) it. the pharmacological reading of life is what defines the singularity of Derrida's philosophy of the animal, the consequences of which are considerable for taking the interests of animals into account. By interiorization, as a process that is carried out by touch, one must also hear the fact that for the animal touch becomes a self‐touching: touching is firstly a being touched by oneself. (shrink)

ZUSAMMENFASSUNGIm Rahmen des Artikels wird die Debatte zwischen Schelling und Eschenmayer inden Jahren 1803–1804 als eine Kontroverse analysiert, die deren vorherige um die Naturphilosophie weiterführt. Der Zentralgedanke Eschenmayers wird in dessen Theorie der »Potenzierung« gesehen. Auf dieser Grundlage entwickelt Eschenmayer 1803 eine Theorie der intellektuellen Anschauung, die seine Theorie des »Überganges« in methodischer Hinsicht tragen und dabei den Glauben in einer grundsätzlichen Bedeutung für das Wissen und die Philosophie wiedereinführen soll. Ferner soll damit die Generierung von Differenz in der absoluten (...) Identität erklärbar sein. So erscheint die Debatte über den Zusammenhang von Philosophie und Religion von 1803 und 1804 zunächst als eine Debatte um die Methodik und die Theorie der Philosophie selbst. Die Analyse von Schellings Methodik, der »Konstruktion«, macht die tiefen Differenzen zwischen Eschenmayer und Schelling deutlich. So the debate about the connection of philosophy and religion in 1803 and 1804 seems to be mainly one about the methods and theory of philosophy. Looking at Schellings method of »Konstruktion« the fundamental differences between both get visible. Most philosophers who have expressed a view about whether forgiveness is compatible with forgivers’ continuing to punish, or support the punishment of, people who have wronged them hold that forgiveness is compatible with punishing or favouring punishment of wrongdoers. I argue that whether forgiveness entails forbearing punishment depends on which of two senses of forgiveness is operative. On the first, sentiment-based sense of forgiveness as consisting essentially in a change of heart on the part of a victim, a victim can, (...) I submit, forgive while continuing to punish or to support the punishment of a person who has wronged her. On the second sense of forgiveness as consisting in debt remission whether or not accompanied by a change of heart, the state’s remission of the entirety of criminal offenders’ punishment qualifies as forgiveness and, moreover, the state could not forgive offenders in this sense while continuing to punish them.
