The dynamic development of science and technology in the last decades has led to new challenges in jurisprudence. This holds for individual fields of doctrinal law as well as the concerned fields of jurisprudence. It is especially significant for the structure of justice, the efficiency of law as a steering instrument of society, and the empirical conditions of legal responsibility. This paper throws some light on the nature of argumentation, its use and advantages, within the setting of doctor–patient interaction. It claims that argumentation can be used by doctors to offer patients reasons that work as ontological conditions for enhancing the decision making process, as well as to preserve the institutional nature of their relationship with patients. In support of these claims, selected arguments from real-life interactions are presented in the second part of the paper, and analysed by means of (...) a model of argumentation borrowed from classical rhetoric, and refined according to the modern orientation of the pragma-dialectic approach. A knowledge-based decision theory faces what has been called the prodigality problem : given that many propositions are assigned probability 1, agents will be inclined to risk everything when betting on propositions which are known. In order to undo probability 1 assignments in high risk situations, the paper develops a theory which systematically connects higher level goods with higher-order knowledge.

Many languages allow for “fake” uses of their past tense marker: the marker: can occur in certain contexts without conveying temporal pastness. Instead it appears to bear a modal meaning. Iatridou :231–270, 2000) has dubbed this phenomenon Fake Tense. Fake Tense is particularly common to conditional constructions. This paper analyzes Fake Tense in English conditional sentences as a certain kind of ambiguity: the past tense morphology can mark the presence of a temporal operator, but it can also signal a specific (...) modal operator. The ambiguity is proposed to be the result of recategorization: the Simple Past develops a second, modal meaning because of structural similarities between the temporal and the modal/epistemic domain. The proposal is spelled out in the generative semantics framework, using the restrictor approach to conditionals Semantics from different points of view, 1979; in: A. von Stechow and D. Three facts are widely thought to be key to the characterization of human cognitive uniqueness (though a number of other factors are often cited as well): (a) humans are sophisticated cultural learners; (b) humans often rely on mental states with rich representational contents; and (c) humans have the ability and disposition to make and use tools. This article argues that (a)–(c) create a positive feedback loop: Sophisticated cultural learning makes possible the manufacture of tools that increase the sophistication of representational (...) decision-making, which in turn allows for yet further increases in the sophistication of cultural learning and tool manufacture. Drawing upon ideas and techniques from logical geometry, we show that Schopenhauer’s partition diagrams systematically give rise to a special type of Aristotelian diagrams, viz. (strong) α -structures.

Landgrebe and Smith provide an argument for the impossibility of Artificial General Intelligence based on the limits of simulating complex systems. However, their argument presupposes a very contemporary vision of artificial intelligence as a model trained on data to produce an algorithm executable in a modern digital computing system. The present contribution explores what it means to be artificial. Current artificial intelligence approaches on modern computing systems are not the only conceivable way in which artificial intelligence technology might be created. (...) If there are conceivable routes by which an artificial intelligence might be developed that are not constrained in the same way as the current generation of artificial neural networks, then these might be plausible routes towards the engineered generation of artificial general intelligence that are not precluded by the Landgrebe and Smith argument against the possibility of artificial general intelligence. This paper studies degrees of doxastic justification. Dependency relations among different beliefs are represented in terms of causal models. Doxastic justification, on this picture, is taken to run causally downstream along appropriate causal chains. A theory is offered which accounts for the strength of a derivative belief in terms of (i) the strength of the beliefs on which it is based, and (ii) the epistemic quality of the belief-forming mechanisms involved. This paper argues that the exclusion problem for mental causation can be solved by a variant of non-reductive physicalism that takes the mental not merely to supervene on, but to be grounded in, the physical. A grounding relation between events can be used to establish a principle that links the causal relations of grounded events to those of grounding events. Given this principle, mental events and their physical grounds either do not count as overdetermining physical effects, or they do so (...) in a way that is not objectionable. (shrink)

The Aristotelian square of oppositions is a well-known diagram in logic and linguistics. In recent years, several extensions of the square have been discovered. However, these extensions have failed to become as widely known as the square. In this paper we argue that there is indeed a fundamental difference between the square and its extensions, viz., a difference in informativity. To do this, we distinguish between concrete Aristotelian diagrams and, on a more abstract level, the Aristotelian geometry. We then introduce (...) two new logical geometries, and develop a formal, well-motivated account of their informativity. I critically discuss a recent innovation in the debate surrounding the plausibility of rational choice theory : the appeal to evolutionary theory. Specifically, I assess Gigerenzer and colleagues’ claim that considerations based on natural selection show that, instead of making decisions in a RCT-like way, we rely on ‘simple heuristics’. As I try to make clearer here, though, Gigerenzer and colleagues’ arguments are unconvincing: we lack the needed information about our past to determine whether the premises on which they are (...) built are true—and, hence, we cannot tell whether they, in fact, speak against RCT. I distinguish two versions of kin selection theory—a purely genetic version and a version that also appeals to cultural forms of cooperation —and present an argument in favor of using the former when it comes to accounting for the evolution of cooperation in non-human organisms. Specifically, I first show that both GKST and WKST are equally mathematically coherent—they can both be derived from the Price equation—but not necessarily equally empirically plausible, as they are based on different assumptions about the inheritance (...) system underlying the cooperative phenotype. Given this, I then, second, present a model selection theoretic argument in favor of GKST over WKST. This argument is based on the fact that, in non-human cases, the former theory is likely to be as empirically successful as WKST, while containing fewer degrees of freedom. I end by defending both the intrinsic importance of this argument and its relevance to the discussion surrounding the “gene’s eye view of evolution.”. (shrink)

The article critically engages Menachem Fisch’s account of normative frameworks, in particular of (rational) transitions between them. I argue, first, that exposure to the normative criticism leveled at us by other human beings is indeed “capable of destabilizing normative commitment” to one’s own underlying framework beliefs and standards, as Fisch holds; however, closer scrutiny reveals that such exposure is neither sufficient nor necessary but rather accidental in this respect. Second, I will try to show that Søren Kierkegaard’s account of how (...) people fundamentally change their mind provides resources for both a substantial critique of Fisch and a more adequate understanding of the transitions in question. The article argues, third, that Fisch’s framework model – though meaningful, in fact heuristically indispensable in and as of itself – has robust transcendental implications which as such are being ignored, if not directly denied by Fisch and, precisely by being ignored or denied, unnecessarily weaken the overall plausibility of his account. Finally, and ex post, I will address an important objection raised by some commentators. (shrink)

Analyses of so-called ‘post-truth’ discourse in populist politics have so far largely focussed on sorting it into cases of lying, bullshitting, bubble-like epistemic constraints, or alternative epistemic norms flouting objective truth. We review these proposals and point out problems with each. Some scholars, however, have recently drawn attention to how apparent assertions of facts in these contexts seem to be functionally entangled with expressing or affirming social identities. To get a clearer picture of what such an explanation might amount to, (...) we differentiate four different ways in which social identities might be connected to apparently assertive discourse: signalling, expressive affirmation, dissonance reduction, and identity grounding. Distinguishing and deciding among these will matter not only for providing an accurate analysis of post-truth discourse, but also for determining the exact grounds on which it merits criticism and for what might be done about it. The current debate about peer disagreement has so far mainly focused on the question of whether peer disagreements provide genuine counterevidence to which we should respond by revising our credences. By contrast, comparatively little attention has been devoted to the question by which process, if any, such revision should be brought about. The standard assumption is that we update our credences by conditionalizing on the evidence that peer disagreements provide. In this paper, we argue that non-dogmatist views have good reasons (...) to reject conditionalization. Instead, peer disagreements should be understood to call for a revision of our prior conditional probabilities: rather than merely adding to our original evidence, they pose a challenge to the thought that we have properly assessed the probative force of our original evidence. There is a renewed debate about modus ponens. Strikingly, the recent counterexamples in Cantwell, Dreier and MacFarlane and Kolodny are generated by restricted readings of the ‘if’-clause. Moreover, it can be argued on general grounds that the restrictor view of conditionals developed in Kratzer and Lewis leads to counterexamples to modus ponens. This paper provides a careful analysis of modus ponens within the framework of the restrictor view. Despite appearances to the contrary, there is a robust sense in which modus (...) ponens is valid, owing to the fact that conditionals do not only allow for restricted readings but have bare interpretations, too. The desideratum of semantic interoperability has been intensively discussed in medical informatics circles in recent years. Originally, experts assumed that this issue could be sufficiently addressed by insisting simply on the application of shared clinical terminologies or clinical information models. However, the use of the term ‘ontology’ has been steadily increasing more recently. We discuss criteria for distinguishing clinical ontologies from clinical terminologies and information models. Then, we briefly present the role clinical ontologies play in two multicentric research projects. Finally, (...) we discuss the interactions between these different kinds of knowledge representation artifacts and the stakeholders involved in developing interoperational real-world clinical applications. Several authors have recently argued that the excessive focus on equilibrium models in mainstream economic analysis prevents economists from providing accurate representations of the complex and dynamic nature of real economic systems. In response, this paper argues the following. Many economic systems are the products of deliberate and centralized human design. People can and do build and support structures, such as social institutions, aiming to enhance the predictability of economic systems, and thus to move them toward being equilibrium systems. While corruption has long been recognized as a major social problem, only relatively recently has the importance of a specific institutional form of corruption been noted. However, despite the fact that institutional corruption has come to be seen as very important, it remains a challenge to specify exactly what makes something a case of institutional corruption. To overcome this challenge, this paper argues that institutional corruption is the result of an individual or collective agent acting in ways that prevent a (...) social institution from partially or fully fulfilling its function. In turn, the function of a social institution is spelled out in line with what is shown to be the most compelling account of social functionalism in the literature: Presentist Social Functionalism. Presentist Social Functionalism sees the function of a social institution as those of its features that increase its expected reproductive or survival success in the current socio-cultural environment. This theory of institutional corruption is shown to have a number of highly desirable features: it is general, fully spelled out, situated in a wider functionalist approach towards the social sciences, and does justice to the complexity of institutional corruption. ABSTRACT Is uncertainty about preferences rationally possible? And if so, does it matter for rational decision? It is argued that uncertainty about preferences is possible and should play the same role in rational decision-making as uncertainty about worldly facts. The paper develops this hypothesis and defends it against various objections.

As a way to advance integration between traditional readings of the medical encounter and argumentation theory, this article conceptualizes the doctor–patient interaction as a form of info-suasive dialogue. Firstly, the article explores the relevance of argumentation in the medical encounter in connection with the process of informed consent. Secondly, it discloses the risks inherent to a lack of reconciliation of the dialectical and rhetorical components in the delivery of the doctor’s advice, as especially resulting from the less-than-ideal conditions of the (...) internal states of the doctor and the patient, and the lack of symmetry in their status. In describing and classifying things we often rely on their modal characteristics. We will in general not have a satisfactory account of the nature and character of an object, unless we specify at least partly how the thing might be or cannot be, and also how it might have been or could not have been. In his contribution to the Second Jerusalem Philosophical Encounter,1 Strawson addressed the issue of how to understand such ascriptions of modal characteristics. Although his paper is (...) terse and provocative, and develops an intriguing account of modal predications, it has never received much attention in the philosophical literature. Recently, the issues dealt with in Strawson’s paper have become the subject of a widespread debate. Hence, we think it worthwhile to put Strawson’s account under closer scrutiny. In what follows, we first discuss his account of present tense ‘might’-statements, then his account of past perfect ‘might’-statements, and finally some essentialist remarks that he makes in his paper. That the discussion will be rather critical for the most part (though not exclusively so) should not belie the originality and inherent value of his pioneering approach. (shrink)

In order to protect the indigenous population of the Americas from slavery and war, Bartolomé de Las Casas carries out a cultural turn in the understanding of what is considered “natural”. The idea that there are slaves by nature was explained in the colonial period by recourse to Aristotle and in view of the inhabitants of the West Indies. A warlike subjugation of disobedient and rebellious slaves was therefore a “natural” affair - like the entire European expansion. Drawing on Aristotle’s (...) understanding of ethos and Aquinas’ considerations of human beings’ natural knowledge of God, Las Casas initiates a culturalist interpretation of human nature. In this way, the indicators that are supposed to qualify the Indians as homunculi and slaves by nature are re-qualified as indicators of authentic humanity. Humans discount rewards as a function of the delay to their receipt. This tendency is referred to as delay discounting and has been extensively researched in the last decades. The magnitude effect and the trait effect are two phenomena which have been consistently observed for a variety of reward types. Here, we wanted to investigate if these effects also occur in the context of the novel but widespread reward types of Instagram followers and likes and if delay discounting of these (...) outcomes is related to self-control and Instagram screen time. In a within-subject online experiment, 214 Instagram users chose between smaller, immediate and larger, delayed amounts of hypothetical money, Instagram followers and likes. First, we found that the magnitude effect also applies to Instagram followers and likes. Second, delay discounting of all three reward types was correlated, providing further evidence for a trait influence of delay discounting. Third, no relationships were found between delay discounting and self-control as well as Instagram screen time, respectively. However, a user’s average like count was related to delay discounting of Instagram likes. (shrink)
