BackgroundIn December 2014, China announced that only voluntarily donated organs from citizens would be used for transplantation after January 1, 2015. Many medical professionals worldwide believe that China has stopped using organs from death-row prisoners.DiscussionIn the present article, we briefly review the historical development of organ procurement from death-row prisoners in China and comprehensively analyze the social-political background and the legal basis of the announcement. The announcement was not accompanied by any change in organ sourcing legislations or regulations. As a (...) fact, the use of prisoner organs remains legal in China. Even after January 2015, key Chinese transplant officials have repeatedly stated that death-row prisoners have the same right as regular citizens to “voluntarily donate” organs. This perpetuates an unethical organ procurement system in ongoing violation of international standards.ConclusionsOrgan sourcing from death-row prisoners has not stopped in China. The 2014 announcement refers to the intention to stop the use of organs illegally harvested without the consent of the prisoners. Prisoner organs procured with “consent” are now simply labelled as “voluntarily donations from citizens”. The semantic switch may whitewash sourcing from both death-row prisoners and prisoners of conscience. China can gain credibility only by enacting new legislation prohibiting use of prisoner organs and by making its organ sourcing system open to international inspections. Until international ethical standards are transparently met, sanctions should remain. (shrink)

Over 90% of the organs transplanted in China before 2010 were procured from prisoners. Although Chinese officials announced in December 2014 that the country would completely cease using organs harvested from prisoners, no regulatory adjustments or changes in China’s organ donation laws followed. As a result, the use of prisoner organs remains legal in China if consent is obtained. We have collected and analysed available evidence on human rights violations in the organ procurement practice in China. We demonstrate that the (...) practice not only violates international ethics standards, it is also associated with a large scale neglect of fundamental human rights. This includes organ procurement without consent from prisoners or their families as well as procurement of organs from incompletely executed, still-living prisoners. The human rights critique of these practices will also address the specific situatedness of prisoners, often conditioned and traumatized by a cascade of human rights abuses in judicial structures. To end the unethical practice and the abuse associated with it, we suggest to inextricably bind the use of human organs procured in the Chinese transplant system to enacting Chinese legislation prohibiting the use of organs from executed prisoners and making explicit rules for law enforcement. Other than that, the international community must cease to abet the continuation of the present system by demanding an authoritative ban on the use of organs from executed Chinese prisoners. This book examines the moral philosophy of Paul Ramsey--one of the 20th century's most influential ethicists--from a theological perspective illustrating that religion can still play a substantial role in our ongoing moral inquiries. Ramsey wrote prodigiously on ethical issues including politics, medical research, the Vietnam war, and nuclear proliferation. His ethical theory, which concentrates on divine love, or `agape, ' as well as justice and order, provides a middle ground between fundamentalism and secularism. Therefore, Ramsey's ethics will appeal to the (...) 21st-century social conscience. McKenzie grounds his theological exploration in a comprehensive history of the theological and philosophical influences on Ramsey's thought, including Jonathan Edwards' theory of natural morality. He also explores a multidisciplinary selection of Ramsey's writings. In conclusion, McKenzie argues that Ramsey's natural law theory will continue to have significant and increasing relevance for morality in the postmodern world. Although there is a large literature on referentiality, going back to at least the nineteenth and early twentieth century, much of this early work is based on constructed data and most of it is on English. The chapters in this volume contribute to a growing body of work that examines referentiality through naturalistic data in context. Taking an interactional approach to (non)referentiality, contributors to this volume ask how participants talk in real time about persons and things as individuals or as (...) categories, and what distinguishes 'referential' from 'nonreferential', 'specific' from 'nonspecific', and 'generic' from 'nongeneric'. Crucially, we ask whether these distinctions even matter to participants in conversation, and if they do, what the evidence for that would be. Contributors investigate these issues using data from conversational interaction in a variety of social contexts - from close friends and family to more casual acquaintances, in service encounters, and between adults and children - and in a range of languages: English, Finnish, French, Indonesian, Japanese, and Mandarin. Collectively, the chapters develop insights showing that reference is often fluid, dynamic, and indeterminate, that referential indeterminacy is typically unproblematic for participants, that shifts in referentiality tend to be tied to specific social goals, and that reference and referentiality emerge dialogically and interactionally. In the present article, he explains why divine silence poses a serious intellectual obstacle to belief in God, and then goes on to consider ways of overcoming that obstacle. After considering several ways in which divine silence might actually be beneficial to human beings, he argues that perhaps silence is nothing more or less than God’s preferred mode of interaction with creatures like us. Perhaps God simply desires communion rather than overt communication with human beings, and perhaps God has provided (...) ways for us to experience God’s presence richly even amidst the silence. This article challenges conventional readings of Michel Foucault by examining his fascination with neoliberalism in the late 1970s. Foucault did not critique neoliberalism during this period; rather, he strategically endorsed it. The necessary cause for this approval lies in the broader rehabilitation of economic liberalism in France during the 1970s. The sufficient cause lies in Foucault's own intellectual development: drawing on his long-standing critique of the state as a model for conceptualizing power, Foucault concluded, during the 1970s, that economic liberalism, (...) rather than “discipline,” was modernity's paradigmatic power form. Moreover, this article seeks to clarify the relationship between Foucault's philosophical antihumanism and his assessment of liberalism. Rather than arguing that Foucault's antihumanism precluded a positive appraisal of liberalism, or that the apparent reorientation of his politics in a more liberal direction in the late 1970s entailed a partial retreat from antihumanism, this article contends that Foucault's brief, strategic, and contingent endorsement of liberalism was possible precisely because he saw no incompatibility between antihumanism and liberalism—but only liberalism of the economic variety. Economic liberalism alone, and not its political iteration, was compatible with the philosophical antihumanism that is the hallmark of Foucault's thought. (shrink)

Abstract: In this article, I offer a proposal to clarify what I believe is the proper relation between value maximization and stakeholder theory, which I call enlightened value maximization. Enlightened value maximization utilizes much of the structure of stakeholder theory but accepts maximization of the long-run value of the firm as the criterion for making the requisite tradeoffs among its stakeholders, and specifies long-term value maximization or value seeking as the firm’s objective. This proposal therefore solves the problems that arise (...) from the multiple objectives that accompany traditional stakeholder theory. I also discuss the Balanced Scorecard, which is the managerial equivalent of stakeholder theory, explaining how this theory is flawed because it presents managers with a scorecard that gives no score—that is, no single-valued measure of how they have performed. Thus managers evaluated with such a system (which can easily have two dozen measures and provides no information on the tradeoffs between them) have no way to make principled or purposeful decisions. The solution is to define a true (single dimensional) score for measuring performance for the organization or division (and it must be consistent with the organization’s strategy), and as long as their score is defined properly, (and for lower levels in the organization it will generally not be value) this will enhance their contribution to the firm. In this critical examination of recent accounts of the nature of science and of its justification given by Kuhn, Popper, Lakatos, Laudan, and Newton-Smith, Banner contends that models of scientific rationality which are used in criticism of religious beliefs are in fact often inadequate as accounts of the nature of science. He argues that a realist philosophy of science both reflects the character of science and scientific justifications, and suggests that religious belief could be given a justification of the same (...) sort. My goal in this paper is to provide characterizations of matter, form and constituency in a way that avoids what I take to be the three main drawbacks of other hylomorphic theories: (i) commitment to the universal-particular distinction; (ii) commitment to a primitive or problematic notion of inherence or constituency; (iii) inability to identify viable candidates for matter and form in nature, or to characterize them in terms of primitives widely regarded to be intelligible.

This paper defends Mereological Universalism(the thesis that, for any set S of disjoint objects, there is an object that the members of S compose. Universalism is unpalatable to many philosophers because it entails that if there are such things as my left tennis shoe, W. V. Quine, and the Taj Mahal, then there is another object that those three things compose. This paper presents and criticizes Peter van Inwagen's argument against Universalism and then presents a new argument in favor of (...) Universalism. It turns out that the most reasonable way to resist the argument for Universalism is to deny the existence of artifacts; thus, if we believe in artifacts, we have no real choice other than to embrace Universalism. Equally, procedures ensuring humane treatment of farm animals often increase sustainability, for example in disease control and manure management. This overlap between sustainability and humaneness is not coincidental. Both approaches can be said to be animal centered, to be based on the fact that animal production is primarily a biological process.
