It is commonly assumed that the pre-codified, customary law of war had little true influence on the decisions or behavior of combatants in the western world. Evaluating this assumption concerning the custom (or norm) of the giving of quarter to enemy combatants in the Texas War of Independence of 1835--1836, this paper finds a strong and widely accepted norm on this subject already by the early 19th century, which exerted significant influence on the behavior in and the results (...) and consequences of the war. The following of this custom of war by the Texian Army, on the one hand, and its intentional and preplanned breaking by the Mexican army headed by Santa Anna for the supposed military and psychological benefits that would accrue from it, on the other, such as in the cases of the Alamo and Goliad, led to severe internal and external consequences for the Mexican side in the short and long term that greatly contributed to their failure to achieve their objectives and to the Texian success in achieving theirs. These consequences indicate the importance of the norms of warfare, even in the pre-codification era, and the major potential costs involved in their breaking or disregard by decision makers. In the Algerian War of Independence, women famously used both traditional and modern clothing as part of their revolutionary efforts against French colonialism. This paper uncovers some of the principal lessons of this historical episode through a phenomenological exploration of agency, religion, and political transformation. Part I draws primarily on the philosophical insights of Martin Heidegger and Maurice Merleau-Ponty alongside the memoirs of Zohra Drif, a young woman member of the Algerian Front de Libération Nationale, in order to explore (...) the worldly and habitual nature of human agency in contrast to the Enlightenment stress on individual rationality and autonomy. Part II turns to John Russon’s phenomenological interpretation of religion in order to argue for the ineluctable significance of religion on human existence, in contrast to the modern tendency to oppose religious tradition and secular modernity. Part III analyzes the dynamics of intercultural communication, and argues for the political power of phenomenology as a critical enterprise that enables more just and emancipatory visions of collective human life and political transformation to come to the fore. This article looks at the ways in which Spanish American women exploited the political and social turmoil of the late 18th and early 19th centuries to move beyond their traditional sphere of influence in the home. Women directly participated in the Túpac Amaru Rebellion (1780–1781) and in the Wars of Independence (1810–1825) providing funding, food supplies, infrastructure and reinforcements for the troops, and nursing the wounded. Others contributed by taking part in the physical fighting (both openly and disguised as (...) men) and a few led troops into battle. This article looks at some of the individuals behind the statistics and reveals their determination to participate despite the punishments imposed on women found guilty of disloyalty to the Spanish crown. Spanish colonial law had to be amended to ensure that women dissidents were given as equally harsh sentences as men. In the immediate post-independence period, rather than be seen as misfits or a threat to the patriarchal system, several of these women were given national awards. (shrink)

This paper examines changing conceptions of honour and masculinity during the Colombian Wars of Independence in the early 19th century. It explores the position of the foreign women who accompanied British and Irish expeditions to join the war against Spanish rule, and shows how colonial, imperial and republican conceptions of masculinity were affected by the role that women played in these volunteer expeditions and in the wars in general. The paper considers women's experiences during war and peace, and examines (...) their experiences in the light of changing conceptions of masculinity at home, in the British empire and in Hispanic America in the early nineteenth century. The social mobility of the Wars of Independence shifted the ground on which these concepts rested for all groups involved. The participation of foreign women alongside male adventurers was a further ingredient in this disorientating period. (shrink)

This book argues that the negotiation of agency is central not only to the experience of war but also to its representation in cultural expressions, ranging from a notion of disablement, expressed in victimization, immobilization, traumatization, and death, to enablement, expressed in the perpetration of heroic, courageous, skillful, and powerful actions of assertion and dominance. In order to illustrate this thesis, it provides a comprehensive analysis of literary representations of the American War of Independence from 1775, the beginning of (...) the war, up until roughly 1860, when the Civil War marked a decisive historical turning point. As the first national war, it has an unquestionably exemplary status for the development of American conceptions of war. The in-depth study of exemplary texts from a variety of genres and by authors like Thomas Paine, Benjamin Franklin, James Fenimore Cooper, Catharine Sedgwick, William Gilmore Simms, and Herman Melville, demonstrates that the overall character of Revolutionary War literature presents the war as a forum in which collective and individual agency is expressed, defended, and cultivated. It uses the military environment in order to teach the values of discipline and self-subordination to a communal good, which are perceived as basic principles of a Republican virtue to guide the actions of the autonomous individual in a popular democracy. This paper focuses on independent training providers (ITPs) – in other words, private companies – as suppliers of vocational education and training in post-war England. Whilst acknowledging the central role of further education (FE) colleges in delivering vocational learning, it draws attention to a large, diverse sector of ITPs operating alongside FE colleges, particularly during the 1960s and 1970s. Data suggest that around 15–20% of vocational learners were enrolled as fee-paying customers with private providers at that time – a figure (...) broadly similar to today. There are, it is argued, three related reasons for this. First, the post-war policy environment, and the varied and uneven nature of colleges at that time, allowed significant room for ITPs to operate as alternative providers of vocational education. Second, the far-reaching ‘efficiency’ gains required since FE colleges left local authority control have largely attenuated the space in which ITPs previously operated. Third, neoliberal assumptions about the superiority of private enterprise mean that ITPs now receive significant funding from the state, largely to deliver Apprenticeships and other programmes of work-related learning – which has, somewhat perversely, reduced the incentive for them to act as bone fide commercial providers of a broader range of vocational learning. The article deals with the legal acts which were adopted by the Supreme Council Reconstituting the Seimas of the Republic of Lithuania on 11 March 1990, and which are related to the restoration of the independent State of Lithuania. The author discloses the chronology of the legal acts adopted on that day and investigates why some particular act was adopted first, and only later another act was passed; he investigates the circumstances which determined the content of the legal acts and (...) shows the interconnection between these acts. The sequence and content of the legal acts of restoration of independence were determined by the fact that the independent State of Lithuania could not arise from the so-called “Lithuanian SSR” which had never been a form of Lithuanian statehood. The restoration of independence could and had to be grounded only upon the continuation of the pre-war Republic of Lithuania. One had to draw a boundary line between the Supreme Soviet of the Lithuanian SSR, which was elected in democratic and free elections on 24 February 1990, and which was a genuine representation of the Nation, from the former Supreme Soviets of the Lithuanian SSR—the essence and formation procedure of which was completely different. This was done by adopting the Declaration “On the Powers of the Supreme Soviet of the Lithuanian SSR” in which it was held that in the 24 February 1990 elections the Nation vested to the deputies of the Supreme Soviet of the Lithuanian SSR the mandate and the duty to restore the State of Lithuania and express the sovereign will of the Nation through this body, which, from 11 March 1990, 6 p.m., would be referred to as the Supreme Council of Lithuania. Was the American War for Independence just? In July 1775, a full year before the Declaration of Independence, the colonists argued that they had the right to self-defense. They made this argument using language that accords with what we can broadly call classical just war thinking, based, inter alia, on their claim that their provincial authorities had a responsibility to defend the colonists from British violence. In the 1775 Declaration of the United Colonies, written two months after British (...) troops attacked colonial citizens, such arguments are made. This essay carefully looks at the historical context of the 1775 Declaration, the arguments made by the colonists, and the philosophical and theological underpinnings of those claims, and concludes that the colonists made a compelling argument commensurate with just war thinking. The ArgumentThe article studies a small Hebrew book called “The Wars of God” composed by an Anglo-Jewish jeweler who lived in London at the end of the eighteenth century. The book is interesting in further documenting the Jewish response to Newtonianism, that amalgam of scientific, political, and religious ideas that pervaded the culture of England and the Continent throughout the century. Hart, while presenting Newton in a favorable light, departs from other Jewish Newtonians in voicing certain reservations about Newton's alleged (...) religious orthodoxy, specifically his fear that the force of gravitation might be explained independent of God's divine providence. The key to understanding Hart's unique stance is his reliance on two eighteenth-century Christian theologians: William Whiston and Robert Greene, particularly the latter. In staking out this position, Hart also endorsed the theological position of his more well known Jewish colleague David Levi, the publisher of his Hebrew text. Both men reveal together the capacity of Jewish thinkers to absorb the dominant trends of thinking by the majority culture while defending honestly and defiantly the integrity of their religious faith and community. The discussion of the American Civil War as a bourgeois revolution, reopened by John Ashworth’s recent work, needs to be based on a more explicit conceptualisation of what the category does, and does not, involve. This essay offers one such conceptualisation. It then deals with two key issues raised by the process of bourgeois revolution in the United States: the relationship between the War of Independence and the Civil War, and whether the nature of the South made conflict unavoidable. It then argues that the American Revolution is unique for two reasons: the non-feudal nature of Southern society and the fact that the Northern industrial bourgeoisie, unlike their European contemporaries, were still prepared to behave in a revolutionary way. The traditional theory of the just war comprises two sets of principles, one governing the resort to war ( jus ad bellum) and the other governing the conduct of war ( jus in bello). The two sets of principles are regarded, in Michael Walzer’s words, as “logically independent. War is a highly gendered experience which is both informed by and informs constructions of masculinity and femininity. The dominant depiction of masculine heroes and feminine victims simplifies the complex intersections of militarism, nationalism and gendered roles and identities. Focusing on a case study of the Anglo-Irish War or War of Independence (1919–1921), this paper examines how violence against women, especially sexual violence, was written about and reported in ways which framed representations of Irish and British masculinity and Irish (...) femininity. In addition, by analysing a range of varied sources including newspapers, autobiographical accounts and recorded testimonies, this paper attempts to assess the extent to which violence against women formed a key aspect of military practice in the war. In conclusion, I engage with some of the difficulties faced by researchers today in exploring evidence of gendered violence in specific historical, cultural and militarized contexts. (shrink)

My claim is that despite powerful arguments to the contrary, a coherent moral distinction between the jus in bello code and the jus ad bellum code can be sustained. In particular, I defend the traditional just war doctrine according to which the independence between the in bello and ad bellum codes reflects the moral equality between just and unjust combatants and between just and unjust non-combatants. The writer devoted her two books to the wars in Algeria - they were written to be adapted to the theatre: Entendez-vous dans les montagnes… and Pierre Sang Papier ou Cendre. In Entendez-vous dans les montagnes..., the memory in question is that of the War of Independence against the colonization during the years 1956-1962, while Pierre Sang Papier ou Cendre addresses the French colonization that lasted 132 (...) years, from 1830 to 1962. In other words, the first relies on individual and collective memories, while the second concerns especially the collective memory. (shrink)

ABSTRACT Amongst the Italian exiles who arrived at the Canton of Ticino following repression perpetrated by the Di Rudinì and Pelloux administrations – after the popular uprisings of 1898 – are Enrico Bignami, Giuseppe Rensi and Arcangelo Ghisleri, who, in Lugano, created a sort of secular symposium for fostering spiritual values. This gave birth to Coenobium, the ‘international journal of independent studies’, which remained in operation between 1906 and 1919. This periodical distinguished itself due to the diversity of the issues (...) addressed: from science to law, from history to philosophy, from literature to spiritualism, philosophy and psychology. With the beginning of the First World War, however, Coenobium’s focus was on the spiral of violence triggered by the war; hence a series of denunciations entrusted to the column ‘War to war!’, which marked a dramatic change in the editorial policy of the magazine edited by Bignami, who was determined to turn it into a strong instrument of pacifist propaganda. Several prestigious figures in Europe’s cultural and political milieus participated in this venture, notably Norman Angell, Romain Rolland, Angelo Crespi, Raffaele Ottolenghi, Claudio Treves, Filippo Turati, Henri La Fontaine, Nicholas Murray Butler and Enrico Bignami. Russia took the advantage of the contribution of the Armenian armed organizations in order to possess Istanbul, straits around it, Eastern Anatolia, to weaken Turkey, to be strengthen in the Southern Caucasus, organized the rebellion of the Armenians living in Turkey against the government. Russian ruling circles put forward the Armenian matter in order to take advantage of them. Armenians involved in the war to create their own government by obtaining the territory including Van, Bitlis, Tigranakert, Erzurum, Kharberd and Sebastya, (...) as well as Cilicia from Turkey, to solve their Armenian problem. But in fact, Russia, France and England tried to blow to Turkey pretending to try for building an independent Armenian government. The grade of contribution of Armenian military units in the First World War can be characterized as following: 1. Creating the Armenian volunteer units. 2. Establishing the regular battalions and infantry regiments and forming the national corpuses. The organizations of Hnchak and Dashnaksutyun actively participated in creating the Armenian volunteer units. Dashnaks mobilized 40 000 people to destroy the Turkish people. They established tens of khumbas. The Armenian volunteer units were commanded by Andranic Ozanyan, Dro, Amazasp, Keri, Checho, Vardan and others terrorists. Armenian volunteer units which were supposed to move in 4 directions, should act in the directions where the Armenian people were densely populated. These 4 Armenian volunteer units fight against Turks in all important combat operations from Sarigamish to Erzurum. The same time Russian army and Armenians triggered the rebellion of the local population against the Turkish government. 50000 of Armenians were fighting in French, England and USA armies. The Eastern legion of Armenians was established in French army on November 1916. On November 15, 1918, the Eastern Legion was named Armenian legion. The number of the Armenians in the legion riched to 4000. In the beginning of 1916, there was an announcement about subordination of the military detachments to army and establishment of infantry regiments based on that. Establishment of the separate Armenian corpus started at the end of December 1917. In 1917, 8 Armenian shooter regiments were established. From the mentioned 8 regiments two Armenian shooter divisions, the special Armenian division of Andranic, 3 infantry brigades of western Armenians in the Southern Caucasus region, some guerrilla troops in Erevan, Igdir guerrilla infantry and rider regiments, Zeytun regiment in Tbilisi were established. At present, Armenia often raises false claims such as the "Armenian genocide" in the parliaments of the world, trying to confirm this lie. This research proves that Armenians betrayed the Ottoman state during the First World War and also committed Turkish genocides. (shrink)

Alexander James Dallas' An Exposition of the Causes and Character of the War was written as part of an effort by the then US government to explain and justify its declaration of war in 1812. However publication coincided with the ratification of the Treaty of Ghent, which ended the War. The Exposition is especially interesting for the insight it provides into the self-constraint of American foreign policy and of the conduct of a war. The focus is on the foreign policy (...) of the early republic and the related philosophy of law and war. A central idea is that international law should chiefly benefit those remaining at peace. -/- Dallas was a Philadelphian who settled there in 1783, the year of the Peace of Paris which ended the War of Independence, arriving from Jamaica after a British education. He wrote much on law, becoming the first recorder of cases before the U.S. Supreme Court. He later served as Secretary of the Commonwealth of Pennsylvania, and federal district attorney for Eastern Pennsylvania, appointed by President Jefferson. He was appointed Secretary of Treasury by President Madison. -/- In this edition the original text is presented with annotations to help identify persons and events of interest. The editor has also added an Introduction, a Bibliography, a short Chronology of Dallas' life and the events of the War, and an analytical Index. This Article aims to extend contractarianism in just war theory to the case of asymmetric war of independence. Its main thesis is that within asymmetric wars, the traditional rule of noncombatant immunity has no contractarian justification: It systematically discriminates against the weak part to the conflict, and thus it is unfair. On the other hand, a rule that allows those who take themselves to be freedom fighters to threaten civic life, yet prohibits deliberately targeting individuals, is fair and mutually (...) beneficial. The branch of the war convention I called “justice in asymmetric war” instructs militants to treat civilians as if they bear no personal responsibility for the evil that their society causes. In this book Uwe Steinhoff describes and explains the basic tenets of just war theory and gives a precise, succinct and highly critical account of its present status and of the most important and controversial current debates surrounding it. Rejecting certain in effect medieval assumptions of traditional just war theory and advancing a liberal outlook, Steinhoff argues that every single individual is a legitimate authority and has under certain circumstances the right to declare war on others or the state. He (...) also argues that the just cause cannot be established independently of the other criteria of jus ad bellum (the justification of entering a war), except for right intention, which he interprets more leniently than the tradition does. Turning to jus in bello (which governs the conduct of a war) he criticizes the Doctrine of Double Effect and concludes that insofar as wars kill innocents, and be it as "collateral damage", they cannot be just but at best justified as the lesser evil. Steinhoff gives particular attention to the question why soldiers, allegedly, are legitimate targets and civilians not. Discussing four approaches to the explanation of the difference he argues that the four principles underlying them all need to be taken into account and outlines how their weighing can proceed if applied to concrete cases. The resulting approach does not square the distinction between legitimate and illegitimate targets with the distinction between soldiers and civilians, which has extremely important consequences for the conduct of war. Finally, Steinhoff analyses the concept of terrorism and argues that some forms of "terrorism" are actually not terrorism at all and that even terrorism proper can under certain circumstances be justified. This topic goes beyond the temporal framework or the periodization of the wars of independence; instead, it covers the entire nineteenth century and part of the twentieth, and appears discontinuously and non-simultaneously in the different nations. The path followed by Spanish American literature was filled with vicissitudes,manifestations, and regressions of diverse types. (...) This paper traces how media representations encouraged enthusiasts, youth and skilled volunteers to participate actively in science and technology during the twentieth century. It assesses how distinctive discourses about scientific amateurs positioned them with respect to professionals in shifting political and cultural environments. In particular, the account assesses the seminal role of a periodical, Scientific American magazine, in shaping and championing an enduring vision of autonomous scientific enthusiasms. Between the 1920s and 1970s, editors Albert G. Ingalls and Clair L. Stong (...) shepherded generations of adult ‘amateur scientists’. Their columns and books popularized a vision of independent nonprofessional research that celebrated the frugal ingenuity and skills of inveterate tinkerers. Some of these attributes have found more recent expression in present-day ‘maker culture’. The topic consequently is relevant to the historiography of scientific practice, science popularization and science education. Its focus on independent nonprofessionals highlights political dimensions of agency and autonomy that have often been implicit for such historical (and contemporary) actors. The paper argues that the Scientific American template of adult scientific amateurism contrasted with other representations: those promoted by earlier periodicals and by a science education organization, Science Service, and by the national demands for recruiting scientific labour during and after the Second World War. The evidence indicates that advocates of the alternative models had distinctive goals and adapted their narrative tactics to reach their intended audiences, which typically were conceived as young persons requiring instruction or mentoring. By contrast, the monthly Scientific American columns established a long-lived and stable image of the independent lay scientist. (shrink)

Eritrean higher education faced numerous challenges over many years. It was particularly suffered during the colonial periods. Eritrea exerted its efforts to develop its dilapidated educational system with the advent of its independence. Eritrea celebrated its sixteenth birthday recently. However, the educational challenges in higher education still remain high. The government of Eritrea established different colleges in different administrative regions. The University of Asmara is the only university in the country that had to be revitalized after its devastation by (...) the 30-year war of independence. Since independence, the University has been able to contribute to the nation's skill manpower considerably. This paper examines higher education of Eritrea for about 60 years period. It delves the University of Asmara and its birth, development and apogee. The paper also gives some insights on recent educational development in Eritrea. (shrink)

Culturally inherited institutional norms structure much of human social life. Successfully replicating institutions train their current members to behave in the generally adaptive ways that served past members. Ancestor veneration is a well-known manifestation of this phenomenon whereby deference is conferred to prestigious past members who are used as cultural models. Such norms of respect may be maintained by punishment based on evidence from theory and laboratory experiments, but there is little observational evidence to show that punishment is commonly used. (...) To test for punishment as a mechanism that maintains these norms, we examine a norm of ancestor veneration in a natural field experiment at the Memorial Student Center at Texas A&M University. The MSC is a memorial to university war dead, and the expectation is that all who enter the building remove their hats out of respect. Observations reveal that hat removal is significantly more common at the MSC than at two control locations. Survey data indicate that most, but not all, subjects understand the norm to be veneration of the dead, and most expect others to follow the norm. Many report a strong negative emotional response when asked to imagine the norm being violated. Sixty-two percent report they would definitely or probably ask the noncompliant to uncover. Focal follow data show that punishment is relatively rare, however, with the majority of behatted subjects going unreproached as they pass through the building. Both survey and observational data indicate there is a motivated minority that enthusiastically enforces the norm. (shrink)

Tolstoy’s War and Peace is a magnificent work; as any such work, it can be read in a variety of ways and be found to teach us important lessons at a number of independent levels. Here I want to look at it as an extended meditation on historical causality---and, by implication, on causality, period. So I will not be taking it for granted that it is a novel; I will be treating it as if it were an outcome of the (...) conceptual reflection philosophers engage in---though, when all is said and done, I will be able to shed light on some of its structural features as a novel. The vast majority of work on the ethics of war focuses on traditional wars between states. In this chapter, I aim to show that this is an oversight worth rectifying. My strategy will be largely comparative, assessing whether certain claims often defended in discussions of interstate wars stand up in the context of civil conflicts, and whether there are principled moral differences between the two types of case. Firstly, I argue that thinking about intrastate wars can help us make progress (...) on important theoretical debates in recent just war theory. Secondly, I consider whether certain kinds of civil wars are subject to a more demanding standard of just cause, compared to interstate wars of national-defence. Finally, I assess the extent to which having popular support is an independent requirement of permissible war, and whether this renders insurgencies harder to justify than wars fought by functioning states. This paper surveys the most important recent debates within the ethics of war. Sections 2 and 3 examine the principles governing the resort to war (jus ad bellum) and the principles governing conduct in war (jus in bello). In Section 4, we turn to the moral guidelines governing the ending and aftermath of war (jus post bellum). The “right intention” requirement, in the form of a requirement that the agent must have a justified true belief that the mind-independent conditions of the justification to use force are fulfilled, is not an additional criterion, but one that constrains the interpretation of the other criteria. Without it, the only possible interpretation of the mind-independent criteria is purely objectivist, that is, purely fact-relative. Pure objectivism condemns self-defense and just war theory to irrelevance since it cannot provide proper action guidance: it (...) is impractically demanding. This means that “revisionist” just war theories which base their doctrine of the moral inequality of combatants on the idea that objective justification defeats liability are irrelevant for the real world, where objective justification is virtually inaccessible. Moreover, only the right intention requirement in the form of a knowledge requirement, as opposed to requiring “good intentions” or “acceptable motivations,” can solve this problem. (shrink)

A survey of just war theory literature reveals the existence of quite different lists of principles. This apparent arbitrariness raises a number of questions: What is the relation between ad bellum and in bello principles? Why are there so many of the former and so few of the latter? What order is there among the various principles? To answer these questions, I first draw on some recent work by Jeff McMahan to show that ad bellum and in bello principles are (...) not, as often portrayed, independent—the justice of conduct in war largely presupposes the justice of the recourse to war. Undermining this independence claim is one important step toward revealing the unified logical structure of just war theory. I then argue that we can see the dependence of the jus in bello upon the jus ad bellum , not just in the content of certain principles, but also in the structure of the two sets of principles: I construct a one-to-one mapping between ad bellum and in bello principles. In doing so, I argue also that the shared structure successfully finds place for the questions central to the evaluation of the morality of war: what is a sufficient provocation to use force, what objectives may be sought by force, why or for what ends, who has authority to decide to use force, and when or in what circumstances? Despite variations in expression, the theory allows for a coherent and comprehensive evaluation of morality in warfare. (shrink)

This paper traces how media representations encouraged enthusiasts, youth and skilled volunteers to participate actively in science and technology during the twentieth century. It assesses how distinctive discourses about scientific amateurs positioned them with respect to professionals in shifting political and cultural environments. In particular, the account assesses the seminal role of a periodical, Scientific American magazine, in shaping and championing an enduring vision of autonomous scientific enthusiasms. Between the 1920s and 1970s, editors Albert G. Ingalls and Clair L. Stong (...) shepherded generations of adult ‘amateur scientists’. Their columns and books popularized a vision of independent non-professional research that celebrated the frugal ingenuity and skills of inveterate tinkerers. Some of these attributes have found more recent expression in present-day ‘maker culture’. The topic consequently is relevant to the historiography of scientific practice, science popularization and science education. Its focus on independent non-professionals highlights political dimensions of agency and autonomy that have often been implicit for such historical actors.The paper argues that the Scientific American template of adult scientific amateurism contrasted with other representations: those promoted by earlier periodicals and by a science education organization, Science Service, and by the national demands for recruiting scientific labour during and after the Second World War. The evidence indicates that advocates of the alternative models had distinctive goals and adapted their narrative tactics to reach their intended audiences, which typically were conceived as young persons requiring instruction or mentoring. By contrast, the monthly Scientific American columns established a long-lived and stable image of the independent lay scientist. (shrink)

Unarmed surviving Parbatya Chittagong nation of Buddhists population in Bangladesh has not yet been able to form their government since 1997 to 2023, so it has been assumed that Prime Minister Sheikh Hasina & Awami League Government of Bangladesh (ALGOB) cheated to weaponless freedom fighters Buddhists people (...) by taking their weapons through the Chittagong Hill Tracts Peace Accord 1997 that was signed between Bangladesh and Chittagong HillTracts in order to a Commonwealth of Independence of Autonomy Government, Formation of Legislative Assembly House and Parliament Building Construction, which is also the last official initiative of the Parbatya Peace Process in the Chinese Belt and Road. Following the theater of war between the US-led NATO—Ukraine alliance and the Russian Federation, the 3rd World War situations intended to expand between Bangladesh and Myanmar. This doctrinal paper has been presented through codification of situations of the post-seizure war-fighting battles surviving cold and silent conflicts in Parbatya, Chittagong Hill Tracts, in order to deliver the seized nation onto a free pathway. Attempts to simplify ethics in war by claiming exclusive legitimate authority for the law of armed conflict underestimate the moral complexities facing soldiers. Soldiers risk wrongdoing if they refuse moral guidance that can independently evaluate their legal permissions. State soldiers need to know when to object to a legal duty to fight; nonstate fighters need to know when to disregard legal prohibitions against fighting. And both might sometimes best discharge their moral duties by following a bespoke rule departing from noncombatant (...) immunity in a principled way that has been designed for a particular conflict by an authoritative leadership. Using fractal analyses to study events allows us to capture the scale-independence of those events, that is, no matter at which level we study a phenomenon, we should get roughly the same results because events exhibit similar structure across scales. This is demonstrably true in mathematical fractals but is less assured in behavioral fractals. The current research directly tests the scale-independence hypothesis in the behavioral domain by exploring the fractal structure of aggression, a social phenomenon comprising events that (...) span temporal scales from minutes of face-to-face arguments to centuries of international armed conflicts. Using publicly available data, we examined the temporal fractal structure of four scales of aggression: wars, riots, violent crimes, and body movement during arguments. Our results lend mixed support to the scale-independence hypothesis and provide insight into the self-organization of human interactions. (shrink)

When placed into longer historical perspective using an interdisciplinary approach that fuses historical anthropology, history and political science, as well as hitherto unutilized primary sources, it can be demonstrated that the newly independent Indian Union right from the start under Nehru used constitution and law as instruments of subjugation that, since the latter remained incomplete, have prepared the ground for a war without end in the Naga Hills of Northeast India. Moreover, its history since the 1820s shows that constitution- and (...) law-making are in essence shaped by power politics only to be countered by force, leading in this constellation to an unending guerrilla war transforming ever larger circles of terrain into a low- level war-zone and firmly enthroning a culture of violence with all its concomitants.
