For business to flourish, society must flourish. Public-private partnerships are established to specifically harness the potential of Big Data in healthcare and can include partners working across the data chain—producing health data, analysing data, using research results or creating value from data. This domain paper will illustrate the challenges that arise when partners from the public and private sector collaborate to share, analyse and use biomedical Big Data. We discuss three specific challenges for PPPs: working within the social licence, public antipathy to (...) the commercialisation of public sector health data, and questions of ownership, both of the data and any resulting intellectual property or products. As a specific example we consider the case of the UK National Health Service providing patient data to Google’s DeepMind AI program to develop a diagnostic app for kidney disease. This article is an application of the framework presented in this issue of ABR. Please refer to that article for more information on how this framework is to be used, including a full explanation of the key values involved and the balancing approach used in the case study at the end. We use four specific values to help analysis these issues: public benefit, stewardship, transparency and engagement. Livestock is one of the growth sectors in the rural economy. In the third world the provision of livestock services for smallholders has generally been in the hands of the governments, leading to erratic, insufficient, and unreliable delivery systems. Especially in cases where the benefits of services accrue to the owners of the animals, privatization of some of the animal services may improve the delivery system. In order to explore the impact of such a private system, a group of (...) sheep farmers in North Sumatra, Indonesia, were organized in an Animal Health Delivery Network (AHDN). The experience with AHDN indicates that the scope of private sector involvement is promising. Farmers were able to recognize the benefits and willing to pay for the drugs. However, they seem to be reluctant to apply the drugs themselves, thereby relying on the help of extension agents and traders. Selling drugs via poultry shops to farmers was not successful because drug wholesaler firms do not make their products available in small quantities. The study confirmed that the role of Government and private sector in the delivery of livestock services needs to be redefined. (shrink)

The proliferation of public–private partnerships for development as an answer to many public challenges calls for careful evaluation. To this end, tailored frameworks are fundamental for helping understand the PPPs’ impact and for guiding corrective adjustment. Scholars have developed frameworks focusing on the partners’ relationships, the order of effects, and the distinction between outputs and outcomes. To capture a PPP’s complexity and multiple linkages with its environment, we argue that a thorough evaluation should adopt a stakeholder-oriented (...) approach and consider the costs and benefits that a PPP implies for them—especially as taxpayers’ money is involved. For this purpose, we build on a stakeholder-oriented evaluation framework from the nonprofit business partnership literature. In line with our broad evaluation conception, we extend it with the manifold ripple effects that PPPs for development have and include the time dimension for the links between different PPP stages and related outcomes to become clearer. Applying this framework to an illustrative case, we highlight important direct and especially indirect stakeholder outcomes, which a narrow evaluation would omit, point to the challenges involved in the evaluation endeavor, and identify interesting future research areas. In this paper we evaluate the ethical aspects of a public-private partnership (PPP) for the production and distribution of electricity in a particular context, i.e.,in a developing country characterized by a high corruption rate. In general, multinational enterprises (MNE) are considered suspect in developing countries by their own populations and by others, especially in those countries perceived as corrupt. A second source of suspicion concerns the privatization of utilities: utilities such as electricity and clean water play (...) an essential role in people’s lives, thus, leaving their production and distribution in the hands of for-profit companies may seem imprudent, particularly with respect to the poorest people. On the basis of a questionnaire submitted to managers of a privatized utility company in Cameroon, this case study suggests that the combination of these two sources of suspicion does not automatically lead to negative outcomes. This dissertation abstract and the reflection commentary present the work done by Dr. Lea Stadtler. Comprising four articles, the dissertation explores the challenge of designing successful public–private partnerships for development and contributes to the discourse on partnerships and business engagement in society. Article I adopts the company perspective and develops a conceptual framework for interest alignment in PPPs for development. Based on a theoretical analysis, Article II examines the role that different structures play in handling common (...) design challenges. Articles III and IV are empirical: The former analyzes how partners cope with tensions occurring on the PPP’s boundaries, while Article IV explores the roles of broker organizations, which increasingly facilitate the partnering process of PPPs for development. This extended dissertation abstract introduces the dissertation’s research focus and summarizes each article’s research question, methods, and main findings. The Millennium Development Goal (MDG) 5 A states that the maternal mortality ratio has to be reduced to three-quarters between 1990 and 2015. The target for India is a maternal mortality ratio of 109/100,000 live births. The Janani Suraksha Yojna (JSY) (Maternal Protection Scheme) is a centrally sponsored conditional cash transfer scheme to promote institutional deliveries and thus ensure safe delivery and reduce maternal mortality. The JSY scheme and its various evaluations were reviewed. The Tannahill’s ethical framework was (...) applied to the JSY and analyzed. Evaluations have shown that the JSY has significantly increased institutional deliveries. The public health system is not fully geared up for delivering good quality maternal health services. Thus encouraging women to go to them violates the principle of doing good. There are several barriers for availing the scheme. Procuring the certificates to meet eligibility can be difficult. The women do not have power over the cash incentive. There are large inequities in access to the JSY scheme based on socioeconomic status, caste and education. The accountability mechanisms for the scheme are weak at the grassroots level. Without an overall improvement in health system and awareness among women, the JSY cannot be said to empower the women in a sustainable way. In order, that the increases in institutional deliveries due to JSY are more than just a Hawthorne effect, which is a change in behavior just due to the fact that the population is being closely observed and intervened, there is a need to bridge the ethical gaps in the program to make it an empowering, sustainable, accountable and just one. In an effort to create a mechanism for addressing a critical need of providing medicines for economically developing countries, the Chiron Corporation and the Global Alliance for TB Drug Development have entered into an innovative public-private partnership. In the following interview, Craig Wheeler discusses the origins and nature of this agreement that could set a pattern for how corporations and nonprofit organizations can work together in drug development.

In the article, the authors have raised an urgent topic related to the provision of state support for rural areas. Attention is focused on the deficit of most of the budgets of both the municipal and regional levels, which does not contribute to the development of the infrastructure of the territories. In addition, the low investment attractiveness does not allow relying on private capital. (Pre-publication draft November 2015: Partial content of "Introduction: The 2030 Agenda," Journal of Global Ethics 11:3 [December 2015], 262-270) This introduction briefly explains the process through which the Sustainable Development Goals have developed from their receipt in 2014 to their passage in September 2015 by the UN General Assembly, and it considers their development in prospect. The Millennium Development Goals, which spanned 1990-2015, present a case study that reveals the changeability of such long-term multilateral commitments. They (...) were enmeshed in overlapping and inconsistent national and intergovernmental commitments reaching from 1995 to 2005, and the text of those goals also evolved, stabilizing for the last time in 2007. The Sustainable Development Goals and attendant commitments should be expected to evolve similarly over their fifteen year run. This presents a concern, for among the three committees established by the UN to create the goals, the two committees charged with public consultation were retired as planned in 2014. The process evident thereafter has displayed a shift towards a strategy of enrolling broad public endorsement that leaves such consultation and specific responsibility to those consulted in doubt. This bodes ill for public deliberation on the goals and for public accountability as the agenda proceeds towards 2030. (shrink)

Until the recent spread of public-private partnerships, pharmaceutical firms had avoided research and development into neglected tropical diseases (NTDs). Because these are diseases that affect the poorest populations in developing regions, research and development initiatives have for the most part depended on the resources and expertise drawn from academia, international organizations, and intermittent state interventions in disease-endemic countries. Over the last few decades, however, public-private product development partnerships (PDPs) have been introducing new (...) collaborative agreements in which the existing resources and expertise combine with the those traditionally withheld by the pharmaceutical industry and global health NGOs. This paper explores recent transformations in the representation of NTDs by examining the shifting logic and spaces of knowledge production which the advent of PDPs has enabled. An analysis of two case studies focused on Chagas disease-related initiatives addresses recurring preoccupations in Science, Technology and Society studies as well as in critical analyses of PDPs: that is, the back-and-forth movement of the disease from being an object of scientific inquiry to a public health concern, and the legitimacy risks and material asymmetries entailed in global health PDPs. Both cases show that it is major global health stakeholders and experts in non-endemic countries, rather than transnational pharmaceutical firms, that exert the greatest influence upon these changing representations: PDPs attempt to expand the preexisting biomedical focus on NTDs by means of incorporating “real world” drug development preoccupations (which I term epistemic shifts), but they also combine their stated global humanitarian aim with security concerns about the diseases spreading to non-endemic, industrialized countries (which I term geographical shifts). This article compares two transnational public–private partnerships against hunger and malnutrition, the Global Alliance for Improved Nutrition and the International Alliance Against Hunger with regard to their degree of business involvement and their input and output legimacy. We examine the participation of stakeholders, the accountability and transparency of the decision-making process, and the perceived provision of a public good. This paper makes a contribution to ongoing debates about whether and how we can empirically assess the potential, limitations, and actual impacts of public-private partnerships in developing countries. Several United Nations and bilateral aid agencies have called for the development of impact assessment methodologies that can help clarify when, how, where, and for whom partnerships work. This paper scrutinizes some of the key assumptions underlying this debate, arguing that no objective ' truth' about the effects of (...) PPPs can be discovered through the use of such methodologies. The paper then investigates what can actually be known about a PPP's effects by testing a PPP IA framework that is recommended by the Organization for Economic Cooperation and Development. This is done using a case study from Pakistan. The paper shows that IA methodology may provide an indication of how well a PPP has fared, but not why the PPP has turned out the way it has. At the same time, win-win and win-lose outcomes may exist simultaneously, even for the same stakeholder in the PPP. While the importance of ensuring proper design, monitoring, and IA of PPPs cannot be denied, their effects must be seen as an outcome of struggles between a variety of actors over the distribution of social and environmental hazards associated with broader processes of economic development and industrialization. Every year thousands of computers deemed obsolete by companies upgrading to newer models are kept out of landfills by organizations like World Computer Exchange 1 which recycle them to schools in developing countries. It is possible to set up at a very low cost, clusters of recycled PCs, using Linux software to substantially reduce the cost of establishing school‐based community Internet centers. In the case of such an implementation in Goa, India by a WCE partner‐NGO the key to its (...) success has been collaboration between the NGO and the private sector to encourage the growth of local Linux support skills and with the government sector ‐ the Goa State Education Department ‐ to ensure the acceptance of Linux in the curriculum, and the provision of teacher training. The Goa Schools Computers project 2 project provides an example of how low initial costs of infrastructure and linkages between different stakeholders can result in cost savings of up to 60% over a conventional community Internet center thereby increasing their chances for financial viability. The article examines the possibilities of using the mechanisms of public-private partnership when implementing the projects on urban agglomerations development. Specific features of the urban agglomerations development are identified. They are based on combining the efforts of the territorial communities and aimed at implementing joint projects by attracting the appropriate resources, which allows to obtain an agglomeration effect and ensure the improvement of the quality of life of the population. It was proved that to implement joint (...) projects on the basis of using the mechanisms of public-private partnership it is necessary to attract private investors. The experience of using the mechanisms of public-private partnership in Ukraine is analyzed in two directions: by region and by type of activity. It was found that a significant part of projects with using public-private partnership mechanisms in the sphere of life support for large cities and agglomerations is carried out in the form of a concession. Concession allows to attract financial resources needed for the implementation of the development projects due to the ability to manage property over a long period of time, and also helps to prevent a monopolistic increase in the cost of services. The necessity of expanding the use of mechanisms of public-private partnership when implementing joint projects on the development of life support sphere for urban agglomerations was substantiated. Undoubtedly, it will be of great interest for private investors. In particular, it is the improvement of the tariff setting and tariff regulation policy, a strict control over the targeted use of funds, the transparency and economic certainty of costs, the balance of economic interests and the responsibility of those people who take part in the implementation of public-private partnership projects. Here, the scheme of the formation and implementation of joint projects on public-private partnership is presented that includes the observance of certain principles, the use of appropriate regulatory, economic and organizational methods, as well as the support of the economic security through risk management. Scientific approaches to improving the regulatory support for the use of public-private partnership mechanisms have been generalized, and the directions for making changes in the current legislation have been determined. The above measures will contribute to increased use of public-private partnership mechanisms when implementing joint projects aimed at developing the sphere of life support for urban agglomerations. However, reports of the corrupt practices of both governments and businesses have plagued international peace building efforts, deepening the distrust of stricken communities. Businesses are perceived as being selfish and indifferent to the impact their operations may have on the social and political development of local communities. Additionally, the corruption of local governments (...) has been cited as interfering with the creation of stability in conflict areas. Within this framework, multinational Public-Private Partnerships can exert two forms of influence: they can either exacerbate these problems, or they can become part of the solution. Without a relationship of trust among local businesses, government, and the private sector, peace building efforts will at best be mixed, and could possibly perpetuate violence in fragile states. Public and private interests are better served when Public-Private Partnerships are based upon collaboration and assist in establishing principles of good governance in conflict areas. This in turn can help build trust and regain the credibility of both sectors among local communities, which are essential in making Public— Private Partnerships more effective. (shrink)

Member States of the United Nations proposed Seventeen Sustainable Development Goals (SDGs) in 2015, emphasizing the well-being of people, planet, prosperity, peace, and partnership. Countries are expected to work diligently to achieve these goals by the year 2030. The paths chosen to achieve the SDGs depend on each country’s specific needs, challenges, and opportunities. This contribution conducts a bibliometric study of selected SDG research related to hunger and climate change among countries of the North Asia Pacific region. A review (...) of literature related to the seventeen SDGs is provided to update the current research in SDGs as a background for the regional bibliometric search. The academic published literature related to this work were collected and text mined to create a research database for trend analysis. In this research, the natural language model KeyBERT and a text mining algorithm for normalized term frequency were used to extract key terminologies for bibliometric analysis. The study provides an overview of the seventeen SDGs in the literature review and then focuses on SDG 2 (zero hunger) and SDG 13 (climate action) publication trends. These two SDGs are in close alignment with sustainable food systems and agricultural development. The conclusion indicates that greater cooperation (SDG 17) is critical to improving the quality of life within the region and in building an ethical framework that restricts external exploitation of resources that benefit newly developed economies over developing economies. The American Institute of Certified Public Accountants monitors the misconduct of its members using the AICPA Code of Professional Conduct. To accomplish this task, the AICPA relies on various stakeholders to report known violations of its CPC. We examine the full population of sanctions imposed by the AICPA on its members under its CPC from 2008–2013 to identify recent trends in the misconduct of accounting professionals. While we find that multiple stakeholders identify and report violations, we also find that (...) the most common types of violations remain consistent with those reported in the 1990s. Further, we develop a taxonomy based on prior accounting literature to determine whether the AICPA CPC is being enforced to defend the public interest and/or the private interests of the accounting profession. In contrast to prior studies, our results suggest that as the accounting profession emerges from a recession and period of intense public scrutiny, the AICPA CPC is largely being enforced to defend the public interest. This public interest focus was most pronounced during the recessionary years of 2008–2010, as evident from misconduct reported by parties such as the Internal Revenue Service, Securities and Exchange Commission, Public Company Accounting Oversight Board, and state boards of accountancy. Although key stakeholders have recently focused on reporting misconduct that threatens the public interest, we believe there are still areas in need of improvement, especially around the level of detail provided in the AICPA’s sanction records. The world is not on track to achieve Agenda 2030—the approach chosen in 2015 by all UN member states to engage multiple stakeholders for the common goal of sustainable development. The creation of the 17 Sustainable Development Goals (SDGs) arguably offered a new take on sustainable development by adopting hybrid and principle-based governance approaches, where public, private, not for profit and knowledge-institutions were invited to engage around achieving common medium-term targets. Cross-sector partnerships and multi-stakeholder engagement (...) for sustainability have consequently taken shape. But the call for collaboration has also come with fundamental challenges to meaningful engagement strategies—when private enterprises try to establish elaborate multi-stakeholder configurations. How can the purpose of businesses be mitigated through multi-stakeholder principle-based partnerships to effectively serve the purpose of a common sustainability agenda? In selecting nine scholarly contributions, this special issue aims at advancing this discourse. To stimulate further progress in business studies, this introductory essay, furthermore, identifies three pathways for research on multi-stakeholder engagement processes in support of the Decade of Action along three coupling lines: multi-sector alignment (relational coupling), operational perception alignment (cognitive coupling) and goal and strategic alignment (material coupling). This study reports on the hierarchy of organizational values in public and private sector organizations in Slovenia and the Netherlands. We surveyed 400 managers in Slovenia and 382 in the Netherlands using an identical questionnaire on the importance of a selection of values in everyday decision making. In Slovenia, impartiality, incorruptibility, and transparency were rated significantly higher in the public sector, while profitability, obedience, and reliability were rated more important in business organizations. In contrast, in the (...) Netherlands, 11 values differed significantly between the sectors. Thus, a greater value congruence exists between the sectors in Slovenia than in the Netherlands, with a larger “common core” of values in Slovenia (14) compared with the Netherlands (9), just as we hypothesized. Historical and cultural developments, such as the communist rule in Slovenia and the different influences of the Protestant work ethic in both countries, led to more similarities between business and government organizations in the “new” EU member state, Slovenia. There is increasing consensus that the right to health can provide ethical, policy and practical groundings for health systems development. The goals of the right to health are congruent with those of health systems development, which are about strengthening health promotion organizations and actions so as to improve public health. The poor shape and performance of health systems in Chad question the extent of realization of the right to health. Due to its comprehensiveness and inclusiveness, the right (...) to health has the potential of being an organizational and a normative backbone for public health policy and practice. In recent years, the United Nations has taken a lead in advocating public-private partnerships (PPPs), and various UN entities actively seek partnerships and alliances with transnational corporations and other companies. Although there has been a rapid growth of PPPs, relatively little is known about their contribution to basic UN goals associated with inclusive, equitable and sustainable development. In response to this situation, there are increasing calls for impact assessments. This article argues that such assessments need to recognize (...) the range of ideational, institutional, economic and political factors and forces underpinning the turn to PPPs, and the very different logics and agendas involved, some of which seem quite contradictory from the perspective of equitable development and democratic governance. The article examines these different forces and logics, focusing on (a) the institutional turn towards "good governance", (b) economic contexts that relate to the very mixed "fortunes" of UN agencies and corporations, (c) structural determinants associated with "corporate globalisation" and (d) political drivers that relate to the struggle for hegemony and legitimisation. The article ends by reflecting critically on the tendency within mainstream development institutions and some strands of academic literature to highlight logics associated with good governance and pragmatism, and to disregard those associated with the strengthening of corporate interests and the neoliberal policy regime. It is argued that knowledge networks associated with the UN need to go beyond "best practice learning" and embrace "critical thinking", which has waned within UN circles since the 1980s. (shrink)

IntroductionMaking appropriate plans for the provision of hospice care is considered a perceived need in the Iranian health system. The current study aimed to develop a model for establishing hospice care delivery system for the adult patients with cancer.Materials and MethodsThis study is part of a larger study that has been done in four phases. This Health System Policy Research utilized a mixed qualitative-quantitative approach. At the first phase, a qualitative study was conducted which explained the care needs and the (...) requirements for establishing this system from the stakeholders’ perspective. The second phase aimed to examine the current situation of hospice care delivery in Iran and identify and determine the similarities and differences among them in the selected countries. At the third phase, the main areas of the model and the related indicators were extracted and prioritized by consulting with experts. Then the model was formulated. At the fourth phase, the proposed model was validated and finalized in terms of importance, scientific acceptability, and feasibility.ResultsBased on the developed model the first and the most important step in establishing the hospice care delivery system is laying the groundwork in the health system which requires focusing on policymaking. It is necessary to establish hospice centers and implement public awareness raising programs, train, and supply expert manpower, strengthen family physician and referral process, formulate clinical guidelines, encourage the private sector and NGOs.) to invest, develop end-of-life and hospice care service packages, and create quality care indicators. The proposed model had moderate feasibility.ConclusionThis model was developed based on the current Iranian healthcare structure and the needs of terminally ill cancer patients. It can be used as a model tailored to the current state of the health system and community in Iran. It is suggested to use this model as a pilot at the regional level. (shrink)

Data access and data sharing are vital to advance medicine. A growing number of public private partnerships are set up to facilitate data access and sharing, as private and public actors possess highly complementary health data sets and treatment development resources. However, the priorities and incentives of public and private organizations are frequently in conflict. This has complicated partnerships and sparked public concerns around ethical issues such as trust, justice or privacy—in turn (...) raising an important problem in business and data ethics: how can ethical theory inform the practice of public and private partners to mitigate misaligned incentives, and ensure that they can deliver societally beneficial innovation? In this paper, we report on the development of the Swiss Personalized Health Network’s ethical guidelines for health data sharing in public private partnerships. We describe the process of identifying ethical issues and engaging core stakeholders to incorporate their practical reality on these issues. Our report highlights core ethical issues in health data public private partnerships and provides strategies for how to overcome these in the Swiss health data context. By agreeing on and formalizing ethical principles and practices at the beginning of a partnership, partners and society can benefit from a relationship built around a mutual commitment to ethical principles. We present this summary in the hope that it will contribute to the global data sharing dialogue. (shrink)

In 2002, as part of its urban policy, the city of Kristiansand set up a giant foundation, for the purpose of soliciting projects, talents and strategies for growth in the city’s cultural economy. There was conflict over core values in the promotion of culture and heritage, and discussion on the transformation of power and democracy. The article assesses the challenges facing the foundation “Cultiva”, including institutional ramifications related to régimes of public planning and governance. Cultiva introduces new discourses of (...) culture in urban development, with impacts on both the outside perception of the city and the everyday culture among the inhabitants of Kristiansand. The public health measures implemented in response to the COVID-19 pandemic have resulted in a substantially increased shared reliance on private infrastructure and digital services in areas such as healthcare, education, retail, and the workplace. This development has (i) granted a number of private actors significant (informational) power, and (ii) given rise to a range of digital surveillance practices incidental to the pandemic itself. In this paper, we reflect on these secondary consequences of the pandemic and (...) observe that, even though collateral data disclosure and additional activity monitoring appears to have been generally socially accepted as inevitable consequences of the pandemic, part and parcel of a larger conglomeration of emergency compromises, these increased surveillance practices were not directly justified by appeals to solidarity and public health in the same way that the instigating public health measures were. Based on this observation, and given the increased reliance on private actors for maintaining the digital space, we argue that governments have a duty to (i) seek and ensure that there are justifications for collateral data disclosure and activity monitoring by private actors in the context of (future) public health emergencies like the COVID-19 pandemic, and (ii) regulate and provide accountability mechanisms for and oversight over these private surveillance practices on par with governmental essential services that engage in surveillance activities. The theoretical foundations of the development of the "green" economy, the features of the functioning of the markets for "green" goods and services, the world experience in the development of the "green" economy, the prospects for the development of the "green" economy at the local and regional level are substantiated. United Nations (UN) leaders suggest that the world is not on track to meet the Sustainable Development Goals (SDGs) by 2030. The purpose of this paper is to explore whether the SDGs provide a valuable platform to call for a basic income (BI) globally. Adopting a critical historical studies approach, the article traces the evolution of ‘development’, including the UN decades of development, the Millennium Development Goals, and the SDGs. It subsequently describes the structural adjustment (...) and poverty reduction efforts by the World Bank and International Monetary Fund, and then outlines why the SDG framework may be helpful in advancing a BI. We argue that as climate-related disasters increase, a BI will be vital in providing a modicum of security in an increasingly unstable world. Calls for BI must be anchored to a broader change agenda that recognizes the causes of poverty and income inequality, and seeks their dismantling and redress. (shrink)

From total rejection to reluctant acceptance and eventually to full acceptance with new justifications, the Chinese attitude towards the public/private divide has undergone several stages in theory and practice. During the early stages of the People’s Republic of China, Chinese scholars of law and political science firmly rejected the divide between the public and the private as being a distinction made in bourgeois law that should be replaced by a new socialist legal system, which would acknowledge (...) no such difference. Since the start of reforms in the late 1970s, the newly ascendant private sector of the economy called for legal recognition of its status, but due to ideological constraints inherited from the pre-reform era, it was not easy to give meaning to the existence of the private sector. Debates were waged among Chinese scholars over the distinction between the public and the private for the purpose of recognizing private ownership. Eventually, the distinction was recognized. The Chinese case is obviously a very good example to show that such a distinction does play a role in shaping or improving a legal system. The emergence of “social law,” however, has blurred the demarcation between the two, calling for new theorization. The “publicization of private law” and “privatization of public law” have further strengthened the ambiguity with respect to the public/private divide. (shrink)

This article examines how algorithmic accountability is translated into action at the municipal level in the United States. Based on a review of task forces, ordinances, and policy toolkits from New York City and Seattle, I demonstrate the ways municipalities and local publics operationalize abstract notions of accountability. Municipal interventions often prioritize revealing computational tools (transparency) and their effects on people (impact assessments). While these two forms of accountability are crucial, they may neglect to examine institutions—and how they change—as (...) they incorporate automated decision systems. I thus propose a political-economic approach that recognizes algorithmic systems as part of municipal institutions and focuses on their role in intensifying data collection and commodification between public agencies and markets. I argue that algorithmic accountability, especially in public agencies, needs to focus on incompetence and asymmetries of power within a network of governments, tech companies, community groups, and technologies. With a mix of transparency, impact assessments, and political economic review, the paper proposes a more comprehensive assessment of automated decision systems through their development, procurement, use, impact, and decommissioning. This article explores the tension between the fundamental perception that the provision of privatized services such as health and social care remain inherently public and the absence of any clearly developed juridical concept of ‘public services’ as the basis of judicial control in accordance with public law standards. In a series of recent cases, courts have had the opportunity to determine whether private contractors engaged in the provision of local authority residential and social care services are (...) amenable to judicial review or susceptible to direct vertical proceedings under the Human Rights Act, on grounds that they are performing functions which are by their very nature quintessentially public. However, conflating questions of amenability to review and susceptibility to the Human Rights Act (hereafter HRA), courts have refused to adopt a test based on the public character of a body's functions, irrespective of the source of power. This article acknowledges the constitutional propriety and rationality of a broad based functional test of review. Nevertheless, it is argued that if courts continue to resist such a test, Parliament must legislate to ensure judicial regulation of decisions by independent contractors of health and social care services, in accordance with public law principles and HRA obligations, which transcend the boundaries of their strict contractual undertakings. The article presents the results of a study of the interaction between the public and private sectors in the field of outer space exploration. The purpose of the study was to identify the peculiarities of interaction between public authorities and private companies involved in space activities. It has been established that all leading space powers create favorable conditions for attracting private companies to space exploration. The main areas of space activity that are most attractive for (...) private investment are identified: 1) production, launch and operation of spacecraft and launch vehicles; 2)production and operation of ground equipment; 3) space research; 4) satellite observation of the Earth; 5) TV and radio broadcasting and lease of repeaters; 6) satellite internet; 7) mining in space; 8) space tourism; 9) space waste management; 10) cargo delivery to Earth orbit, etc. The current state of the space industry in Ukraine is determined. The main obstacles to space commercialization in Ukraine are also highlighted: 1) legal regulation lags far behind and does not meet the needs of space activities in Ukraine; 2) international agreements are not in line with the level of national regulation of advanced countries and new global trends; 3) Ukraine’s space industry is focused mainly on less profitable areas of the space economy, which reduces the attractiveness for private investors; 4) there is no clear distinction between national interests and commercial activities in space; 5) mechanisms for coordinating private, state and public interests in the context of space commercialization are either absent or extremely ineffective; 6) there are no effective mechanisms for attracting foreign capital to space exploration. The authors identify two main competitive models of the interplay between the public and private sectors in space exploration: “American” and “European.” It is emphasized that both models can serve as a model for the space policy implementation in Ukraine. However, given a number of considerations, it is determined that the “European” model is more optimal. (shrink)

In recent years, many Small Island Developing State governments have worked to increase openness and transparency of their transactions as a means to enhance efficiency and reduce corruption in their economies. In order to achieve a cost-effective and efficient strategy to implement a transparent government, Information Communication Technologies offer an opportunity of virtualization by deploying e-government services to promote transparency, accountability and consistency in the public sector and to minimize corruption. This paper explores the potential impact (...) of government virtualization by SIDS and against corruption by comparing the corruption perception index rates of 15 SIDS countries. The CPI relates to the degree by which corruption is perceived to exist among public officials and politicians by business people and country analysts. In order to reveal the long-term impact of virtual deployment and its consequences on corruption, an in-depth case analysis based on the CPI index rates was conducted on the deployment of the e-government system in Cyprus. The Millennium Development Goals (MDG) set time-bound targets that are powerful shapers of how and for whom health is pursued. In this paper we examine some ramifications of both the temporal limitation, and maternal-child health targeting of MDG 4 and 5. The 2015 end date may encourage increasing the number of mass campaigns to meet the specific MDG objectives, potentially to the detriment of a more comprehensive approach to health. We discuss some ethical, political, and pragmatic ramifications of (...) this tendency, and show that these are not unique to the MDGs but rather have a long history in health policy debates. We also examine attempts to counter a narrow focus on vertical interventions in campaigns through integrated health system delivery platforms. We argue that the way forward is not to assume that evidence is value free, but rather to make explicit the political and ethical decisions in the design of metrics and evaluation research. We propose an index of five factors that should be included in research designed to inform decision making about providing interventions as part of routine services or periodic campaigns, toward serving more members of the population, and long-term strengthening of the health system via integrated health interventions. The familiar problems of democratic capitalism have given way to a deep crisis challenging the basic forms of governance introduced around the late 18th century and then gradually expanded and developed until the late 20th century. Associative Democracy and the Crises of Representative Democracies argues that we are in urgent need of normative guidelines and a strong understanding of a broad range of institutional options and innovative experiments in associative democracy in order to address the structural problems that existing institutional (...) arrangements are confronted with whilst maintaining and strengthening democratic forms of government and governance. The argument is developed against the background of a thorough survey of empirical social scientific studies on the crises of capitalisms and representative democracies. This book focuses primarily on democratic alternatives, though it also works out principles and institutions of democratic socialism as alternatives to capitalism. After introducing the theoretical approach, the book illustrates the ways this framework of analysis can be of use, with particular focus on three issues that are highly topical when it comes to the challenges our institutions are confronted with: democratic governance in relation to ecological crises and uncertainty; the threats to democracy raised by the crisis of political parties and representative party-democracy, and the challenges related to privatization and marketization of public services, particularly in healthcare. The book concludes by exploring opportunities to democratize the economy, locating viable alternatives to capitalism in the tradition of democratic socialism. This urgent and thought-provoking book will be of great interest to academics and students in various disciplines in the humanities and social sciences, including political science, sociology, and economics. Cochran has argued that Catholic health care occupies a “unique place on the border of public and private life”. Catholic health care is accountable to both its religious and sacramental traditions and its public responsibilities. It is inevitable that “border skirmishes” will arise. Yet there is no single formula for suggesting what public-private collaboration should comprise or how conflicts between values ought to be resolved. It may be, as Cochran suggests, that increasingly bitter conflicts over (...) widely valued services such as sterilization, combined with market pressures to conform to for-profit trends in health care, will make divestiture of faith-based hospitals in favor of other types of church-community partnerships the best course for the future. Adoption of the Millennium Development Goals triggered much discussion among donor states, multilateral institutions, and developing countries towards changing dysfunctional patterns of interaction that seemed to put the MDGs at risk from their inception. Initially in these high-level discussions, accountability was understood in a state-centric way, primarily as accountability to donors. This needed to be modified with the shift towards developing-country ownership of development strategies and programs. Yet an even greater change was in store when (...) civil society organizations were included in the discussions, since their focus was on accountability to project-affected persons and communities. Hence a new and irreducible conception of accountability came on stage. I characterize this as accountability to the subjects of development and show how it is required and justified by development ethics, based on values of agency and justifiability. This results in a dual standard for accountability: reducing stakeholders’ vulnerability to harmful and inequitable outcomes, and ensuring the justifiability of development projects to affected persons and communities. This article provides a conceptual and empirical assessment of UN brokered partnerships that seek to deepen or create inclusive and sustainable agricultural supply chains in sub-Saharan Africa. More specifically it appraises the decision-making mechanisms, processes of partnership brokerage and project implementation within the UNDP Growing Sustainable Business Initiative (GSB) in Kenya. The paper argues that the lack of bottom-up participation in decision-making mechanisms and the predominantly economic imperatives driving the GSB partnership projects have failed to reach out to the partnerships’ (...) intended beneficiaries—Kenyan small producers of nuts and mangoes. In conclusion it is suggested that opening up the GSB platform might hold the promise of reconciling sustainable business models with (some) poverty reduction. (shrink)

The resuscitation of deliberative democracy in the Information Age requires the construction of transparent public spaces ‐ public arenas where power relationships between speakers are discernible and debate ensues according to the rules of civility and reason (conversational transparency). The metaphor of transparency, in the sense of legal accountability, also connects the role of communications regulation to the development of democratic political culture (legal transparency). Fragile states and developing countries increasingly contract out health services to non-state providers (NSPs) (such as non-governmental organisations, voluntary sector and private sector). The paper identifies ethical issues when contracts involve devolution of health services to NSPs and proposes procedures to prevent or resolve these ethical dilemmas. Ethical issues were identified by examining processes of contracting out. Health needs could be used to select areas to be contracted out and to identify service needs. Health needs comprise “disease-burden-related (...) needs”, “health-service needs”, and “urgency of health-service needs”. The mix of services should include an analysis of cost-effectiveness. NSPs should be selected fairly, without bias, and conflicts of interest during their work must be avoided. The population’s views must be respected and accountability structures established. Devolved health services should ensure equity of access to healthcare. The services ought to be sustainable and evaluated objectively. Of these issues, conflicts of interest among NSPs and sustainability of health services have not attracted attention in the literature on ethics of health policy. Fair procedures could address these ethical issues—for example, public consultation on issues; decisions based on the public consultation and made on evidence; principles of decisions stated and reasonable; decisions given adequate publicity; a mechanism established to challenge decisions; assurance that mechanisms meet the above conditions; and regular review of the policies. These procedures are complemented by improving self-governance of NSPs, countries’ development of guidelines for devolving health services, and measures to educate the public of the client countries on these issues. Abstract Private security contractors are just the tip of an outsourcing iceberg. Across the three Ds of defense, diplomacy, and development, American foreign policy has been privatized. The Obama administration inherited a government that had been hollowed out to an unprecedented extent, and in many realms it had and has no choice but to depend on contractors to conduct what used to be state business. This essay examines the reasons for and unintended negative consequences of this outsourcing of (...) American power. It argues that turning the clock back and returning everything to in-house assignments is both undesirable and impossible. Instead, government must pursue contracting in ways that do not undermine the public interest. It can do this by identifying the things that should never be outsourced and ensuring that the letter and spirit of the Federal Funding Transparency and Accountability Act is upheld. Greater transparency in contractor?government relations will foster private security contractor compliance with ethical norms while bolstering our capacity for self-government. Transparency is thus both an end in itself and a means to sustainable democratic deliberation. While tension can exist between national security and open government, that tension is often overestimated. (shrink)

Il s’attache à montrer la diversité de ce marché en fonction des champs scientifiques, notamment par le type d’éditeurs impliqués, les lectorats concernés, les économies associées. Il met en exergue le nécessaire discernement de ces marchés face aux critiques générales de dysfonctionnement soulignées. Il pointe certains effets contrastés du numérique conduisant à certaines reconfigurations paradoxales. Enfin, la vision (...) prospective sur le devenir de ce marché insiste sur la pluralité des modalités de progression vers le libre accès, le poids de la dimension politique et celui des processus d’évaluation de la recherche. La voie d’un partenariat public-privé est privilégiée au regard de certaines valeurs centrales : indépendance, qualité, accessibilité et pérennité des publications scientifiques.This article investigates the scientific publishing market and how it is being transformed by the Internet and the development of open-access services. We illustrate the diversity of the market in terms of scientific fields, and especially in the types of publishers and readerships concerned, and of the associated economics. In view of the sweeping criticisms of dysfunctional practices illustrated in the article, we alert readers as to the need for discernment among these markets. The article points to a number of contrasting effects of digital publishing that are leading to various paradoxical reconfigurations. Finally, this forward-looking study of the publishing market’s future emphasises the multiple forms of the onward march towards open access and the influence exerted by the political dimension and the research evaluation process. Public-private partnerships are the preferred option to cater for the central values of independence, quality, accessibility and the enduring nature of scientific publications. (shrink)

Several insider accounts of the formation of the Sustainable Development Goals suggest that the process (the procedures used and the emergent organizational and governance system features) was as important as the resulting goal-set. The paper looks at both aspects, and relationships between them: the rising influence of Southern nations (seen in the roles played by Colombia, Brazil, some African countries and the G77); the partial transcendence of traditional inter-bloc negotiation, including through adoption of elements of deliberative decision-making; the major (...) involvement of civil society and business organizations, thanks especially to the IT revolution; the adoption of a goals-targets-indicators frame that has flexibility at national level and implicit reliance on intensive further civil society activism and monitoring. The paper considers these features and the implied prospects for the SDGs in relation to various perspectives on global governance, with special reference to norm-setting: Ruggie’s concepts of ‘global public domain’ and ‘polycentric global governance’, Risse and Sikkink’s ‘norms cascade’, Murphy’s posited required elements for progressive global innovation, and Raskin’s model of transition through responses to crises. It concludes with questions for further work, including regarding the possibly problematic absence of an explicit inspirational value-core. (shrink)

This book bridges media, technocultural, urban and journalism studies to examine the role of journalism in relation to a smart city project on Toronto’s waterfront. From the announcement of the public-private partnership called Sidewalk Toronto to the project’s termination, a mediatized controversy unfolded. Through an assemblage approach and a comprehensive case study of the Globe and Mail and the Toronto Star, it follows the actors and chronicles the Quayside project story as a conversation about the promise and perils (...) of a future “smart” neighbourhood. In the news of Waterfront Toronto, Sidewalk Labs, other actors, events and developments, there were multiple voices and views, interpretations and arguments, that manifested conflicting interests and values. As a situated actor, journalism produced a porous discourse where the prognostic value of the project to come could be expressed. The Quayside story not only described the project and the process with an active propose-and-public pushback movement but articulated relations of transparency and trust, governance and accountability. Journalist’s work of mediation conditioned the project’s emergence and dissolution within asymmetrical relations of power. Sidewalk Lab’s bid for legitimacy would face an oppositional dimension that indented the project’s enactment. Moreover, a time lag between project time and governmental policymaking made the mediatized controversy intractable. With their residual symbolic power, quality journalism contributed to dialogical urban learning. (shrink)

The World Bank is no stranger to criticism of its projects, especially in respect of its privatization and private sector development projects. Critics point to the environmental, social and cultural damage that certain projects have caused, which for some appears not just to be a product of the individual projects themselves, but symptomatic of a broader policy failure within the Bank to engage with the social consequences of its actions. In fact, and somewhat surprisingly, both the Bank's critics (...) and its defenders seldom employ human rights language in their reasoning and rhetoric, and where they do, it is only fleetingly and often lacking in any real substance. This is surprising because of so much of what the Bank does can be, and is, supportive of the objects of international human rights standards, especially in respect of economic, social and cultural rights. It is a central theme of this Discussion Paper that for the Bank to embrace this fact alone would be a very significant step towards it being better able not only to respond to its critics, but also, crucially, to deliver upon its own objectives as most recently expressed in the Millennium Development Goals. This Discussion Paper was commissioned by the World Bank. The brief was to provide an account of the major criticisms directed at the World Bank's private sector-oriented projects, and to determine what, if any, consequences for the protection of human rights are revealed by those criticisms. The approach adopted in this paper is first to identify key criticisms through empirical research and then to subject them to human rights analysis. This provides the basis for a clear account of the legal and programmatic implications for the Bank, today and in the future, of those human rights obligations and duties raised, directly or indirectly, by the critics of the Bank.
