On March, 24, 2020, 818 cases of COVID-19 had been reported in New South Wales, Australia, and new cases were increasing at an exponential rate. In anticipation of resource constraints arising in clinical settings as a result of the COVID-19 pandemic, a working party of ten ethicists was convened at the University of Sydney to draft an ethics framework to support resource allocation decisions. The framework guides decision-makers using a question-and-answer format, in language that avoids philosophical and medical technicality. The (...) working party met five times over the following week and then submitted a draft Framework for consideration by two groups of intensivists and one group of academic ethicists. It was also presented to a panel on a national current affairs programme. The Framework was then revised on the basis of feedback from these sources and made publicly available online on April 3, ten days after the initial meeting. The framework is published here in full to stimulate ongoing discussion about rapid development of user-friendly clinical ethics resources in ongoing and future pandemics. (shrink)

L’interactivité est communément perçue comme la marque caractéristique des technologies digitales et, par extension, de différentes formes de fictions, de médias ou d’œuvres numériques – de la littérature hypertextuelle et des jeux vidéo au net art. On peut toutefois s’interroger sur le sens précis qu’il convient de donner à cette notion, ainsi que sur les promesses auxquelles elle est souvent associée. À défaut de pouvoir cerner un concept unique et maxi-englobant d’interactivité, nous suggérons qu’il est plus profitable de tenter d’identifier (...) des types et des degrés d’interactivité. Nous tentons de montrer pourquoi cette théorie pluraliste et gradualiste est plus attrayante que d’autres approches développées dans la littérature récente. Nous mettons enfin cette conception à l’épreuve du jeu vidéo, en montrant qu’elle permet de réévaluer le rôle que joue l’interactivité dans ce médium, mais qu’elle met aussi au jour les limitations inhérentes des fictions interactives que l’on y trouve. Être vu, nu, par un chat ; essayer de savoir quel effet cela fait d’être une chauve-souris ; penser les modes de cohabitation et de compagnonnage que nous formons avec les animaux, en dépit de toutes les violences que nous leur faisons subir, constituent autant d’expériences de pensée limites qui ont ponctué le discours philosophique sur l’animalité au xxe siècle. Il n’est pas étonnant que Cora Diamond fasse un cas de toutes ces expériences : ce qu’elle nomme « une difficulté (...) de la réalité », c’est-à-dire un point d’achoppement entre la pensée et ce qu’elle essaye de saisir, le réel, qui est susceptible de nous faire perdre nos concepts. Je me propose dans ce texte d’explorer les voies de cette difficulté, qui sont souvent des voies contournées ou des déviations. L’idée est aussi de réfléchir aux moyens dont la philosophie dispose pour affronter cette difficulté, sans dénégation et sans déviation. (shrink)

We examined the relationship between moral foundations, empathic traits, and moral identity using an online survey via Mechanical Turk. In order to determine how moral foundations contribute to empathic traits and moral identity, we performed classical correlation analysis as well as Bayesian correlation analysis, Bayesian ANCOVA, and Bayesian regression analysis. Results showed that individualizing foundations (harm/care, fairness/reciprocity) and binding foundations (ingroup/loyalty, authority/respect, purity/sanctity) had various different relationships with empathic traits. In addition, the individualizing versus binding foundations showed somewhat reverse relationships (...) with internalization and symbolization of moral identity. This suggests that moral foundations can contribute to further understanding of empathic traits and moral identity and how they relate to moral behavior in reality. We discuss the implications of these results for moral educators when starting to teach students about moral issues. (shrink)

Many philosophers would, in theory, agree that the methods and tools of philosophy ought to be supplemented by those of other academic disciplines. In practice, however, the sociological data suggest that most philosophers fail to engage or collaborate with other academics, and this article argues that this is problematic for philosophy as a discipline. In relation to the value of interdisciplinary collaboration, the article highlights how experimental philosophers can benefit the field, but only insofar as they draw from the distinctive (...) methods of philosophy and overcome the charge of “amateur psychology” by more consistently collaborating with the scientists they seek to emulate. It concludes that philosophers ought to collaborate with other academics in order to gain an experience‐based understanding of the methods of other disciplines in addition to an understanding of the content of these disciplines. Presentists believe that only present things exist. Their theories, at first glance, seem to offer many admirable features: a simple ontology, and a meaningful, objective status for key temporal phenomena, such as the present moment and the passage of time. So intuitive is this theory that, as John Bigelow puts it, presentism was “believed by everyone...until at least the nineteenth century”. Yet, in the last 200 years presentism has been beset by criticisms from both physicists and metaphysicians. One of the (...) most significant criticisms is that presentists cannot provide an acceptable system of truthmaking. If there is no past, how can there still be truths about the past? In this paper, I introduce a new theory of presentism, which addresses this problem in a novel way: by simply denying that there are any truths about the past. While prima facie an unintuitive position, I will argue that a sensible presentist philosophy of this kind can be described, so long as it is accompanied by an appropriate system of physics. I will also indicate at certain points that adopting presentism could allow us to understand fundamental physics in new, more intuitive ways. By the end of the paper, I hope to not only show that hard presentism is a defensible theory of time, but also that it could offer a number of advantages to the physicist and the philosopher alike. During the WHO-GloPID COVID-19 Global Research and Innovation Forum meeting held in Geneva on the 11th and 12th of February 2020 a number of different ethical concepts were used. This paper briefly states what a number of these concepts mean and how they might be applied to discussions about research during the COVID-19 pandemic and related outbreaks. This paper does not seek to be exhaustive and other ethical concepts are, of course, relevant and important.

This paper expands on “An Ethics Framework for Making Resource Allocation Decisions within Clinical Care: Responding to COVID-19,” which is also published in this special issue of the Journal of Bioethical Inquiry. I first describe and explain the steps we took to develop this framework, drawing on previous experience and literature to explain what frameworks can and cannot do. I distinguish frameworks from other kinds of guidance and justify why our framework takes the form it does. Our key aim was (...) to help answer practical questions faced by frontline clinicians. I then explain some of the normative issues that shape the content of the framework itself. Here, I engage critically with the resource allocation literature and justify the particular positions that we take in the framework. Although we undertook this work to address resource allocation decisions anticipated during the unfolding COVID-19 pandemic, it will also serve as an example for others who wish to design practical ethics frameworks for other bioethical issues that will emerge in the future. Je m’emploie à montrer qu’une intelligence du monde social (des rapports de classe, de genre, de race et d’autres formes de domination) s’exerce à l’étage des vécus singuliers. Ce n’est pas seulement que les gens sont différents les unes des autres – encore que j’insiste sur la vérité et la force d’une affirmation à première vue si banale –, mais aussi qu’un sens renouvelé de l’objectivité (...) s’obtient lorsque la production d’un savoir est réfléchie depuis la position particulière de celui qui l’énonce. In his 1951 Gibbs Memorial Lecture, Kurt Gödel put forth his famous disjunction that either the power of the mind outstrips that of any machine or there are absolutely unsolvable problems. The view that there are no absolutely unsolvable problems is optimism, the view that there are such problems is pessimism. In his 1995—and, revised in 2013—Verificationism Then and Now, Per Martin-Löf presents an illustrative argument for a constructivist form of optimism. In response to that argument, Solomon Feferman points out (...) that Martin-Löf’s reasoning relies upon constructive understandings of key philosophical notions. In the vein of Feferman’s analysis, one might be object to Martin-Löf’s argument for either its reliance upon constructivist considerations, or for its appeal to non-unproblematically mathematical premises. We argue that both of these responses fall short. On one hand, to be critical of Martin-Löf’s reasoning for its constructiveness is to reject what would otherwise be a scientific advance on the basis of the assumption of constructivism’s falsehood or implausibility, which is of course uncharitable at best. On the other hand, to object to the argument for its use of non-unproblematically mathematical premises is to assume that there is some philosophically neutral mathematics, which is implausible. Martin-Löf’s argument relies upon his third law, the claim that from the impossibility of a proof of a proposition we can construct a proof of its negation. We close with a discussion of some ways in which this claim can be criticized from the constructive point of view. Specifically, we contend that Martin-Löf’s third law is incompatible with what has been called “Poincaré’s Principle of Epistemic Conservation”, the thesis that genuine increase in mathematical knowledge requires subject-specific insight. In Black Skin, White Masks Frantz Fanon discusses the neurotic condition that typifies the oppressed black subject, their 'psychoexistential complex'. He argues that this neurotic condition is closely related to another, the 'psychoexistential complex' of the white oppressor. Both of these complexes sustain and are sustained by social and economic injustice. But Fanon does not delve in detail into the nature of this second neurosis, for he was primarily interested in discussing this neurosis only insofar as it helps him understand (...) the first. My aim in this paper is to provide an account of the white neurosis, and why it should be understood literally as a neurotic condition. Typical, white oppressors, not solely those who are militantly committed to oppressing others, are alienated from the world and from themselves, making their behaviour seem like that of soulless dolls, to use J.M. Faithful to the symbolic turn of aesthetics in the twentieth century, Goodman argues that pictures are as conventional and natural as scripts. Unlike scripts, however, pictures work in dense symbolic systems. The difference between image and script cannot be found where we would have spontaneously looked: in our perceptual experience of pictures. Obviously, the structural approach which is at stake in Languages of Art is iconoclast; we often consider it surprising, or even absolutely misleading, perhaps because we do not connect the analyses Goodman conducts in his essay with the experience we ordinarily have of pictures. I argue that Goodman's position becomes clearer when it is reduced to a much more modest philosophical purpose: to offer a criterion for discrimination between scripts and pictures. Pictures, unlike scripts, are dense. Of course, that does not explain depiction. However, my account of Goodman's view, when connected to intuitions about cognitive processes that have spread elsewhere in his work, sheds light on the way pictures are connected with the objects they depict. Dans la littérature contemporaine, plusieurs philosophes se sont demandé s’ils entraient dans la catégorie traditionnelle de l’art. Une autre façon de considérer la chose, qui ne présuppose aucune définition de l’art, consiste à appréhender la forme artistique particulière à laquelle appartiennent les œuvres vidéoludiques. Cet article propose ainsi de repérer les propriétés esthétiques standards et variables des œuvres vidéoludiques (...) en tant que forme artistique, pour partie déterminée par les propriétés du medium des arts numériques. M’appuyant sur la pratique de l’artiste Marina Abramović qui vise à constituer la performance en art de répertoire, je propose dans cet article une ontologie des œuvres performatives. Est-il possible de re-performer une œuvre du passé, comme on exécuterait une œuvre musicale définie par sa partition? La question philosophique que j’adresse s’inscrit dans le cadre d’une ontologie appliquée sensible aux problèmes concrets que soulèvent certaines pratiques bien identifiées dans le monde de l’art : identification, préservation et conservation des œuvres. J’examine (...) successivement différentes hypothèses : une performance artistique est un événement typique identifié par son script et multiplement instanciable ; la performance artistique est l’énonciation d’une idée ; la performance artistique est un événement doublement initié et par le contexte de sa composition et par celui de son exécution. Ces différentes formulations conduisent à interroger la place de l’interprète dans les performances artistiques. Ma contribution principale consiste à mettre au jour les conditions de félicité des œuvres performatives et à interroger la relation que ces conditions de félicité entretiennent avec les critères d’identification des œuvres dans le cadre d’une interprétation contextualiste de l’ontologie. ABSTRACT It used to be said that shame culture waned in early modernity, but there is a growing body of historiography on the vital role that recognition and the opinion of others continued to play. Honour mattered; for some it was the mark and the maker of your true self. While philosophers like Hobbes, Locke, Mandeville, Hume, Smith, and Rousseau disagreed in their evaluations of the phenomenon, they were united in thinking that the great engine of recognition whirred like furious (...) clockwork through human society. When one listens to voices from the margins of power, however, to formerly enslaved black women and men, and white women, one hears a different story – that the machine is broken. I argue that, albeit from incomparable positions, they articulate a theory of misrecognition in the face of systematic power. Sensitive to the entanglements of epistemology and naturalised inequality, they offer a politics of vision that deconstructs the punitive lenses of gender and race which render people invisible and misunderstood, and in so doing they try to write themselves into view. They offer an account of the mysterious intractability of hegemonic ways of seeing that poses a challenge to both the putatively laissez-faire economy of recognition of their enlightened contemporaries, and to the emancipatory teleology of modern recognition theorists. Le crédit philosophique à faire à la philosophie mécaniciste réside dans son ambition à sauver l'unité de la science et à retrouver l'idée de nécessité. Pour les philosophies de la finitude, ce projet est illusoire. The idea behind engaging in war has often been based on assuring a place for peace in the not so distant future, whether the motivation was normative, as within the Just War Doctrine, or simply the hope that victory would lead to the end of organized violence. A group of scholars, intellectuals, and practitioners has been brought together in this volume (...) to posit an alternative route — through justice — to what has thus far been elusive for humankind: a durable peace among and between peoples. The debate about the moral status of the embryo has gained new impetus because of the advances in reproductive technology that have made early human embryo experimentation a possibility, and because of the public concern that this arouses. Several philosophical arguments claiming that fertilisation is the event that accords moral status to the embryo were initially formulated in the context of the abortion debate. Were they formulated with sufficient precision to account for the scientific facts as we now understand them? (...) Or do these arguments need modification? Aspects of three arguments for moral status being acquired at fertilisation are examined in relation to current scientific knowledge, highlighting the reasons why such arguments, at present, seem to provide an inadequate basis for the determination of moral status. In this concluding chapter, Allan and Keller posit that Just Peace should be defined as a process resting on four necessary and sufficient conditions: thin recognition whereby the other is accepted as autonomous; thick recognition whereby identities need to be accounted for; renouncement, requiring significant sacrifices from all parties; and rule, the objectification of a Just Peace by a ‘text’ requiring a common language respecting the identities of each, and defining their rights and duties. This approach, based on a language-oriented (...) process amongst directly concerned parties, goes beyond liberal and culturalist perspectives. By moving beyond the idea of a peace founded on norms claiming universal scope, each side of a conflict has a place at the negotiating table to present their own perspective on what justice might entail. This inclusion into the decision-making process helps create the feeling of personal investment in the final negotiated product. In addition, negotiators need to work towards building a novel shared reality as well as a new common language to help foster an enduring harmony between previously clashing peoples. (shrink)

In this paper I criticize political realism in International Relations for not being realistic enough, for being unrealistically pessimistic and ultimately incoherent. For them the international arena will always be a place where a battle of wills, informed by the logic of power, is fought. I grant that it may be true that the international political domain is a place where such battles are fought, but this alleged infelicitous situation does not in and of itself entail the normative pessimism informing (...) their assessments of the international domain, and it does not entail the recommendations offered by political realists, particularly relating to balance of power concerns. Their lack of realism stems from total or partial blindness to the proper and coherent ideals that ought to be informing their analyses of the international domain. Such blindness does not allow them properly to grasp what actually is the case. As we can only properly understand what an eye is by knowing the ideal that defines eyes — proper vision — so too we can only properly identify the movements of the international political arena in relation to ideals that ultimately define this arena, ideals that stem from a proper understanding of the human person. Following an Aristotelian teleological technique of analysis, I show that ideals are a constitutive part of the international domain and I recommend an alternative to political realism, namely, realistic idealism. Assessing children's episodic future thinking by having them select items for future use may be assessing their functional reasoning about the future rather than their future episodic thinking. In an attempt to circumvent this problem, we capitalised on the fact that episodic cognition necessarily has a spatial format (Clayton & Russell, 2009; Hassabis & Maguire, 2007). Accordingly, we asked children of 3, 4, and 5 to chose items they would need to play a game (blow football) from the opposite side (...) of the table on which they had never before played. The crucial item was the box that was needed by children to reach the table from the other side. Over four experiments, we demonstrated that, while children of 3 perform poorly on future questions and children of 5 generally perform quite well, children of 4 years find a question about what they themselves will need to play in the future harder to answer than a similar question posed about another child. We suggest that this result is due to the 'growth error' of over-applying newly-developed Level 2 perspective-taking skills (Flavell et al., 1981), which encourages the selection of non-functional items. The data are discussed in terms of perspective-taking abilities in children and of the neural correlates of episodic cognition, navigation, and theory of mind. (shrink)

Although the mental time travel (MTT) hypothesis provides a rich, conceptual framework, the absence of clear, empirically tractable, behavioural criteria for determining the capacity for MTT restricts its usefulness in comparative research. Examples of empirical criteria for evaluating MTT in animals are given. We also question the authors' evaluation of semantic foresight and their even-handedness in assessing human and nonhuman behaviour.

This article seeks to advance ethical dialogue on choosing standards of prevention in clinical trials testing improved biomedical prevention methods for HIV. The stakes in this area of research are high, given the continued high rates of infection in many countries and the budget limitations that have constrained efforts to expand treatment for all who are currently HIV-infected. New prevention methods are still needed; at the same time, some existing prevention and treatment interventions have been proven effective but are not (...) yet widely available in the countries where they most urgently needed. The ethical tensions in this field of clinical research are well known and have been the subject of extensive debate. There is no single clinical trial design that can optimize all the ethically important goals and commitments involved in research. Several recent articles have described the current ethical difficulties in designing HIV prevention trials, especially in resource limited settings; however, there is no consensus on how to handle clinical trial design decisions, and existing international ethical guidelines offer conflicting advice. This article acknowledges these deep ethical dilemmas and moves beyond a simple descriptive approach to advance an organized method for considering what clinical trial designs will be ethically acceptable for HIV prevention trials, balancing the relevant criteria and providing justification for specific design decisions. In this paper I provide a critique of a set of assumptions relating to agency, choice and the legitimacy of actions impacting health that can be seen in some approaches to health promotion. After a brief discussion about the definition of health promotion, I outline two contrasting approaches to this area of health care practice. The first is focused on the provision of information and the second is concerned with seeking to change people’s preferences in a particular way. It has (...) been argued by a number of critics of health promotion that only the first approach is ethical, as it is for individuals to make their own lifestyle choices and adopt their own conception of the good life. I argue against this ‘information’ approach to health promotion on two grounds. First, I suggest that given the aims of health promotion, the provision of information is, as a matter of fact, of limited effectiveness in achieving these aims. Second, I argue that we have good reasons to question the appropriateness of respecting many of the preferences that individuals happen to have, given the origins and quality of such preferences. I then go on to argue, that by contrast we have good reasons to focus on changing at least some of the preferences that people have related to their lifestyle choices. This involves a commitment to both paternalism and a defence of a certain conception of the good life, but both can be defended. I use the example of potential responses to the growing problem of obesity to illustrate my argument, arguing that only policy that, at least sometimes, aims at preference change will be both effective and ethical. L.E.J. Brouwer famously took the subject’s intuition of time to be foundational and from there ventured to build up mathematics. Despite being largely critical of formal methods, Brouwer valued axiomatic systems for their use in both communication and memory. Through the Dutch Mathematical Society, Gerrit Mannoury posed a challenge in 1927 to provide an axiomatization of intuitionistic arithmetic. Arend Heyting’s 1928 axiomatization was chosen as the winner and has since enjoyed the status of being the de facto formalization of intuitionistic (...) arithmetic. We argue that axiomatizations of intuitionistic arithmetic ought to make explicit the role of the subject’s activity in the intuitionistic arithmetical process. While Heyting Arithmetic is useful when we want to contrast constructed objects with platonistic ones, Heyting Arithmetic omits the contribution of the subject and thus falls short as a response to Mannoury’s challenge. We offer our own solution, Doxastic Heyting Arithmetic, or $${\textsf{DHA}}$$, which we contend axiomatizes Brouwerian intuitionistic arithmetic. (shrink)

In crafting our paper on addressing the ethical challenges in HIV prevention research with people who inject drugs,1 we had hoped to stimulate further discussion and deliberation about the topic. We are pleased that three commentaries on our paper have begun this process.2 3 4 The commentaries rightly bring up important issues relating to community engagement and problems in translating research into practice in the fraught environments in which PWID face multiple risks. These risks include acquisition of HIV as well (...) as criminalisation, stigma and lack of access to needed healthcare, prevention and social services. We take this opportunity to respond to the excellent points raised by the commentators. All of the commentaries support our emphasis on robust community engagement with PWID and other stakeholders in designing and conducting HIV prevention research, but urge us to go farther. Wolfe highlights the difficulty of even engaging with community members in oppressive settings, where authorities severely restrict civil liberties of PWID so that even discussing issues related to drug use and enforcement may place individuals at risk. To overcome such limitations, he appropriately suggests interviewing confidentially those who have previously been detained in closed settings as part of the community engagement process. Similarly, Wolfe observes that critical issues can be overlooked with a narrow focus on study procedures if contextual factors before, during or after a study are ignored. For example, he cites the risk of overdose for study participants who have been abstinent during a study and subsequently resume injecting when the study concludes.
