In the past decade there has been a lot of attention to the quality of the evidence in experimental psychology and in other social and medical sciences. Some have described the current climate as a ‘crisis of confidence’. We focus on a specific question: how can we increase the quality of the data in psychology and cognitive neuroscience laboratories. Again, the challenges of the field are related to many different issues, but we believe that increasing the quality of the data (...) collection process and the quality of the data per se will be a significant step in the right direction. We suggest that the adoption of quality control systems which parallel the methods used in industrial laboratories might be a way to improve the quality of data. We recommend that administrators incentivize the use of quality systems in academic laboratories. (shrink)

In this study we examined whether parents’ perceptions of students’ anxiety as well as perceived support from both teachers and classmates were predictive of changes in students’ academic motivation during the first wave of COVID-19. To this end, we used a retrospective pretest-posttest design together with a latent change score model to analyze our data. From April to May of 2020, 394 Portuguese parents of students in grades 1–9 participated in this study. Our results showed that students’ anxiety and teachers’ (...) social support, as perceived by parents, were highly significant predictors of academic motivation changes. Specifically, we found a negative effect of anxiety and a positive effect of teachers’ social support on students’ academic motivation. Our results did not show, however, a significant predictive role of classmates’ social support. This study provides an important contribution to further understand the intrapersonal and interpersonal factors that are associated with the decline of students’ academic motivation during the COVID-19 pandemic. The pivotal role of teachers in sustaining students’ academic motivation and other relevant educational implications for the ongoing pandemic are discussed. (shrink)

La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. Ensayo que busca profundizar en conceptos claves de la ética y la moral para dar cuenta de la deformidad en la utilización del principio de autonomía para avalar actos éticamente ilícitos como el aborto. El origen de la reflexión está en la experiencia de la autora en las aulas de clase donde captó el fracaso dialéctico en la enseñanza de la ética médica: muchos conceptos fueron impartidos desde una ideología global que lleva a una práctica clínica basada en convicciones individuales, (...) que distan de la verdad ética y de lo filosóficamente demostrable y obedece a las necesidades «poco éticas» del mundo actual. Se hace una aproximación a lo que es la autonomía; se examina si el aborto puede calificarse como un acto moral, partiendo de la realidad biológica de lo que es un embrión humano. Se concluye que el aborto es una práctica en la que no puede primar el principio de autonomía porque no contiene una acción que sea puramente moral: no es posible afirmar que el aborto sea éticamente lícito. La sociedad actual pretende fundamentar legalmente los actos ilícitos antes de revisar los conceptos que conciernen a la ética y a la filosofía; parte del problema es que no se enseñan adecuadamente esos contenidos en las aulas de clase. U ovom članku raspravljamo o hipotezi proširenog jastva Andyja Clarka i Davida Chalmersa, a osobito o prigovoru prema kojemu proširenom jastvu nedostaje stabilnost i kontinuitet koji su potrebni da bismo ga smatrali identičnim kroz vrijeme. Pokušavamo pokazati da je taj prigovor neodrživ. Raspravljamo i o gledištu prema kojemu se drugi tip jastva, to jest narativno jastvo, također može shvatiti kao prošireno, i tvrdimo da stabilnost i kontinuitet toga tipa jastva također nisu ugroženi ako ga proširimo izvan granica čovjekova tijela. Stoga, (...) barem što se tiče tih tipova jastva, kada razmišljamo o problemima osobnog identiteta, nije potrebno ograničiti se na internalizirano jastvo. (shrink)

Spin is a fundamental and distinctive property of the electron, having far-reaching implications. Yet its purely formal treatment often blurs the physical content and meaning of the spin operator and associated observables. In this work we propose to advance in disclosing the meaning behind the formalism, by first recalling some basic facts about the one-particle spin operator. Consistently informed by and in line with the quantum formalism, we then proceed to analyse in detail the spin projection operator correlation function \=\left\langle (...) \left \left \right\rangle \) for the bipartite singlet state, and show it to be amenable to an unequivocal probabilistic reading. In particular, the calculation of \\) entails a partitioning of the probability space, which is dependent on the directions \.\) The derivation of the CHSH- or other Bell-type inequalities, on the other hand, does not consider such partitioning. This observation puts into question the applicability of Bell-type inequalities to the bipartite singlet spin state. (shrink)

The Fourth Industrial Revolution based on digitalization, the development of AI, robotics, big data, and increasing automation is dredging up older debates on the end of human work. This article contributes to this debate arguing that these changing circumstances represent an opportunity to advance a renewed consideration of human work. By emphasizing its most distinctively human dimensions, including gratuitousness, relationality, and meaningfulness, we propose the articulation of a social model that recognizes relational goods as a specific contribution of human work (...) in an attempt to overcome the state and the market's monopoly of public life built around the dichotomy between the private and the public. Such a social model is based on the concept of circular subsidiarity, which represents a departure from traditional notions of subsidiarity by promoting a dynamic and reciprocal interplay between three essential societal spheres: the state, the market, and organized civil society, all of which have their role to fulfill by providing security, efficiency, and relational goods. Ultimately, this article suggests that circular subsidiarity can lead to a more inclusive and equitable social model by acknowledging how relational goods not only humanize civil society but also sustain the functioning of both the market and the state. Rigorous attention has been paid to moral distress among healthcare professionals, largely in high-income settings. More obscure is the presence and impact of moral distress in contexts of chronic poverty and structural violence. Intercultural ethics research and dialogue can help reveal how the long-term presence of morally distressing conditions might influence the moral experience and agency of healthcare providers. This article discusses mixed-methods research at one nongovernmental social support agency and clinic in Rio de Janeiro, Brazil. Chronic levels of moral (...) distress and perceptions of moral harm among clinicians in this setting were both violent, following Nancy Scheper-Hughes’ use of that term, and a source of exceptional and innovative care. Rather than glossing over the moral variables of work in such desperate extremes, ethnography in these settings reveals novel skills and strategies for managing moral distress. (shrink)

In this article, I explore the way in which Korsgaard’s approach to obligation as springing from the reflective rejection of that which threatens one’s own identity can account for obligations towards others, without making the latter relative to obligations to oneself. To this end, I begin by stressing the role of reflexivity in ethical relationships, and show how this reflexivity is mediated by reference to law, which applies both to the self and to the other. On this basis, I then (...) argue that Korsgaard’s account of the interplay between practical and moral identity reflects the very structure of practical reason, which requires both a particular and a universal premise in order to issue practical reasons for action– and the corresponding obligations. Within this framework, I argue that Korsgaard’s solution to the problem outlined above lies in having stressed the shareable character of reasons such that it is neither your reason nor my reason that obligates me, but rather reason as such. This solution, however, requires a further argument aimed at clarifying what makes your reasons different from my own. (shrink)

In Understanding Moral Obligation (2012), Robert Stern sets out to provide a fresh interpretation of the role of autonomy in Kant’s moral philosophy and attempts to rectify J. B. Schneewind’s standard account in The Invention of Autonomy (1998). While Stern agrees that Kant’s resort to autonomy is at the basis of a constructivist account of moral obligation, he claims that autonomy plays no role in Kant’s theory of value, such that, in this respect, Kant remains a realist. Accordingly, Stern characterizes (...) Kant’s moral philosophy as a “hybrid” view because he sees it as involving a compromise between realism with regard to value and constructivism with regard to obligation. Stern’s interpretation relies on a sharp distinction between value and obligation. The purpose of the present article is to question his reliance on that rigid distinction, which involves intermixing theoretical and practical reason and assumes a distorted view of human agency. El objetivo de este artículo es evaluar dos fundamentos morales que permiten enmarcar la discusión acerca de la justicia social y el desarrollo humano. Por un lado, Amartya Sen parte de presupuestos éticos como la libertad para brindar un marco evaluativo que analice la pobreza y la calidad de vida. Por el otro, Martha Nussbaum, desde presupuestos filosóficos como la dignidad, establece una guía práctica para el correcto funcionamiento y desarrollo de la vida humana. Ambos autores convergen en la idea (...) según la cual la pobreza es una condición de vulnerabilidad ante la vida y que, además, sus consecuencias transgreden las distintas dimensiones políticas, económicas y sociales de la vida humana. De ahí que se pueda decir que la pobreza transgrede y obstruye el pleno goce de los derechos políticos, económicos, sociales y culturales de los ciudadanos. A pesar de sus diferencias conceptuales, ambas posturas brindan nuevas herramientas interpretativas a la hora de tematizar el desarrollo humano y analizar la pobreza. Estas amplían y enriquecen el concepto de justicia social. Esta ampliación da un nuevo sentido a lo concebido como desarrollo humano, toda vez que este puede ser considerado como un derecho. Ahondar sobre el carácter vinculante de considerar el desarrollo humano como un derecho, se convierte en una herramienta conceptual eficaz en la lucha contra la pobreza. (shrink)

Within the field of didactics of second language teaching, it is believed that phonic errors cannot be completely corrected due to the significant influence of L1. However, improving the processes of acquisition of an L2 implies learning pronunciation properly. Given the importance of pronunciation for communication, it is necessary to deeply know the nature of phonic errors, which requires a specific classification aimed to describe, classify and categorize them. This article is intended to test the validity and efficiency of the (...) taxonomy developed in the project AACFELE. To accomplish our objective we: a) collected the most significant phonic errors made by learners of Spanish from nine different nationalities and b) categorized those errors. As a result, we found that the classification entails plenty of trouble caused by the impossibility of marking the boundaries of the numerous phenomena involved in the pronunciation of a sound; that is why we considered the need of redefining some of the suggested categories and assessed the adequacy of maintaining other ones less useful. Despite these circumstances, the most significant outcome was the reliable proof that the taxonomy AACFELE allowed us to label and describe diverse phonic errors using common criteria, which represents the first step to accurately study phonic acquisition of a foreign language. This review essay explores recent historical and anthropological literature on the emergence and development of transcultural psychiatry in the second half of the twentieth century. It examines how postcolonial psychiatry attempted to remove itself from its erstwhile colonial frameworks and strove to introduce new concepts and paradigms to make itself relevant in the context of decolonization and postwar reconstruction. The essay looks at both continuities and discontinuities between colonial and post-colonial transcultural psychiatry, asking how the recent surge of scholarly literature (...) in this field engaged with these issues. RESUMEN:En este trabajo se analiza el modo en que Kant distingue entre sentimiento y emoción, por un lado, y emoción y pasión, por otro, para mostrar: 1) que bajo el término “emoción” Kant entiende principalmente la afección orgánica privada de contenido cognitivo, aunque precedida y seguida de representaciones; 2) que la emoción constituye un elemento integral de lo que Kant denomina “sentimiento”, término del que se sirve para designar la dimensión subjetiva de la experiencia en sentido amplio, no limitado a (...) la afección empírica; 3) que su concepción negativa de la pasión justifica la posterior distinción entre emoción y pasión introducida en los estudios científicos. ABSTRACT:In this article I analyze Kant’s distinction between feeling and emotion, on the one hand, and emotion and passion, on the other. The objective is to show: 1) that by the term “emotion” he understands organic affection, deprived of cognitive content, although preceded and followed by representations; 2) that emotion so understood constitutes for Kant an integral part of “feeling”, by which Kant designates the subjective dimension of experience, in a broad sense, which is not limited to empirical affection; 3) that his negative approach to passion justifies the sharp distinction between emotion and passion introduced in scientific studies of emotion. Populism’s Challenges to Political Reason can be seen as a consequence of social and cultural trends, the so called ‘emotional culture’, that have been accentuated in recent decades. By considering those trends, this article aims at shedding light on some distinctive marks of contemporary populism in order to argue for a reconfiguration of the public sphere that, without ignoring emotion, recovers argumentation and persuasion based on facts and reason.

Como se aprende? O que é uma imagem sem imagens? Estas questões são o ponto de partida para o estudo das relações das imagens com a aprendizagem. Propomo-nos pensar que a aprendizagem não se pode fazer sem uma unidade de conexão, um processo criador virtual-actual. Aprender é uma “tarefa infinita” e transformadora dos movimentos do corpo, do pensamento e do espaço-tempo conjugados, que exige um encontro concreto feito de uma “familiaridade prática” experimental. Fundado em 14 de janeiro de 1933 como remanescente das associações culturais criadas pelo movimento anarquista e anarco-sindicalista nas primeiras décadas do século XX, o Centro de Cultura Social de São Paulo tem por objetivo o aprimoramento intelectual, a prática pedagógica e os debates públicos. Nesse intuito, organiza palestras, cursos, seminários, filmes, peças teatrais, entre outros, além de manter um acervo de arquivo e biblioteca voltada principalmente para os estudos. Desenvolve formas de ação e formação de militantes e de livres (...) pensadores, tendo sido comum a formação de diversos centros de cultura ou congêneres em meados do século XX. A obra Pedagogia, sujeitos e resistências é resultado de um seminário promovido pelo Centro de Cultura Social de São Paulo em Junho de 2009 com o propósito de discutir o funcionamento das verdades do poder e dos poderes da verdade que circundam as várias práticas políticas e pedagógicas na contemporaneidade. Nesse sentido, a obra em questão, como bem apresenta Silvio Gallo, é resultado do esforço intelectual de jovens pesquisadores que transformaram um encontro de estudos em matéria concreta e viva de resistência ao instituído em prol da liberdade de expressão e de criação de novos modos de vida. Esta coletânea de textos apresenta-se extremamente inovadora no que concerne a educação e a pedagogia porque apresenta o funcionamento de micropolíticas cotidianas capazes de mobilização-transformação do mesmo e da mesmidade político,pedagógica e educacional tão correntes nos dias de hoje. RESUMO Um retorno ao ser aparece na contemporaneidade como uma via teórica importante para se pensar as possibilidades de uma política e de uma ética livres das conformações legadas pela história do Ocidente. É nesse sentido que Giorgio Agamben desenvolve em "O uso dos corpos" o que chamará de uma arqueologia da ontologia, buscando verificar se o acesso a uma ontologia ainda é possível nos dias de hoje. Partindo de Aristóteles, passando pela escolástica, até chegar a Heidegger, Agamben evidencia como (...) a divisão binária do ser - em duas experiências contrapostas e ao mesmo tempo dependentes - mantém-se como uma aporia no pensamento e na práxis ocidental. A ontologia, como lugar originário da articulação histórica entre linguagem e mundo, é então percorrida por suas fraturas, levando o filósofo a propor uma nova leitura do ser a partir do que entende como ontologia modal. A partir dessas ideias, busca-se investigar como essa articulação medial entre essência e existência, ser e ente, comum e singular - constituída sempre em devir - propiciaria uma nova perspectiva do ser, na qual ontologia e ética se confundem. ABSTRACT A return to the being emerges in the contemporaneity as an important theoretical way to think about the possibilities of a politics and an ethics free from the legacy bequeathed by the Western history. In this sense, Giorgio Agamben develops, in the book "The use of the bodies", what he calls an archaeology of ontology, seeking to verify if the access to an ontology is still possible nowadays. Starting from Aristotle, passing by the Scholastics, until arriving at Heidegger, Agamben highlights how the binary division of being - in two opposed and, at same time, dependent experiences - remains an aporia in Western thought and praxis. The ontology, as the origin of the historical articulation between language and world, is then traversed by its fractures, leading the philosopher to propose a new reading of the being from what he understands as modal ontology. From these ideas, we intend to investigate how this medial articulation between essence and existence, being and entity, common and singular -always founded in a becoming - would provide a new perspective of the being in which ontology and ethics end up mixed. Analisando a comunicação memética a partir dos pontos de vista da semiologia saussuriana e do dispositivo biopolítico tal como pensado por Foucault e Agamben, bem como estabelecendo conexões entre essas teorias e o uso desse tipo de comunicação na política brasileira contemporânea, foi possível perceber neste artigo que os memes, em especial os memes políticos, em vez de operarem por meio da subjetivação, operam como dispositivos dessubjetivantes.

Populism’s Challenges to Political Reason can be seen as a consequence of social and cultural trends, the so called ‘emotional culture’, that have been accentuated in recent decades. After many years drawing attention to the differences between Aristotelian and Kantian Ethics, recent scholarship tends to stress their commonalties instead. Among the authors representing this trend of contemporary moral philosophy, Christine Korsgaard has undoubtedly a leading role. Without denying the differences existing between them, Korsgaard has been particularly keen on calling our attention to their shared views.Yet Korsgaard herself has acknowledged an obvious difference between Aristotle and Kant, regarding their approach to emotions : unlike Kant, Aristotle does not think (...) of inclinations and emotions as mere feelings, but rather as valuable sources of information about morally salient aspects of our situation. In other words : they provide us with (germinal) reasons for action. Korsgaard, however, keeps this difference at the level of moral psychology, arguing that it does not make a great difference at the level of ethical theory. Now, this is precisely what I find controversial. My point is that this sort of difference imports a more fundamental one about practical reason in its entirety, a difference which used to be preserved in Kant’s own reference to a “pure practical reason” – against which Aristotle’s might be called “impure practical reason”. Para ello pone en juego su distinción entre obligación natural —u obligación de interés—y obligación moral —-avalada por el sentimiento. Al hilo de esta distinción puede señalarse un criterio para distinguir normalidad y excepción, y, eventualmente, el tipo de situación que podría respaldar (...) acciones de resistencia civil. This book is a major contribution to the renewed interest in natural law. It provides the reader with a comprehensive overview of natural law, both from a historical and a systematic point of view. It ranges from the mediaeval synthesis of Aquinas through the early modern elaborations of natural law, up to current discussions on the very possibility and practical relevance of natural law theory for the contemporary mind.

I examine all the occasions on which Aquinas uses a particular example, which goes back to Plato's Republic, to shed light on the controversial subject of the immutability of natural law. Aquinas usually transcribes it as depositum gladius non debet restitui furioso, although some variations also occur. We shall first look at the context in which Plato situates this idea, then go on to examine the occasions on which Aquinas draws on it: in the Summa, when discussing the question as (...) to whether the natural law is the same for everyone; in his Commentary on the Nicomachean Ethics, when he explains in what sense natural law may change, and in what sense it remains the same; and finally, where he examines the virtues of gnome and epieikeia, also in the Summa. La idea moderna de derechos humanos y el concepto clásico de ley natural no son equivalentes. Ciertamente comparten la idea de que no toda ley es convencional. Pero más allá de esto, la noción clásica de ley natural es definida claramente en el marco de las virtudes y, consecuentemente, tiene una orientación más práctica y está atada más de cerca a la historia; la noción de derechos humanos, que han heredado las teorías modernas de los derechos naturales, conduce a la (...) subjetivación del concepto de derecho y tiende a separar al ser humano de su contexto histórico y político, donde los eventos se llevan a cabo. En ese sentido, el concepto clave asociado con los derechos humanos es aquel de “dignidad”. Dado que las dos ideas tienen diferentes puntos de partida y son diferentes en su estatuto epistemológico, no hay, estrictamente hablando, fundamento alguno para imaginar una síntesis de las dos teorías. En el plano teórico sólo podemos hablar de su complementariedad. La síntesis es algo que sólo surgirá en la práctica. (shrink)
