A intolerância religiosa possui uma longa história. Na tradição cristã, a mais célebre justificativa do uso da força pelo poder temporal para promover a unidade da igreja foi elaborada por Agostinho (354-430) em alguns de seus tratados, cartas e sermões compostos ao longo da controvérsia donatista. Concentrando-se nas cartas relativas à coerção dos donatistas, especialmente na _Carta a Vicente_ e na _Carta a Bonifácio_, o presente artigo pretende examinar a justificativa agostiniana do uso da força pelo poder temporal para promover (...) a unidade da igreja com o intuito de explicar seu recurso às Escrituras. De maneira mais específica, almeja-se (i) identificar as principais passagens bíblicas que a embasam e (ii) demonstrar como elas se relacionam à concepção agostiniana (ii.a) da coerção e (ii.b) da relação entre poder temporal e igreja. A título de completude e clareza, pretende-se ainda (iii) propor uma breve história do donatismo e (iv) apresentar um quadro sinóptico, em apêndice, de todos os escritos agostinianos na controvérsia. Como de praxe na pesquisa em história da filosofia, a metodologia utilizada é a revisão bibliográfica. (shrink)

In the chapter "Of Identity and Diversity" of An Essay Concerning Human Understanding, Locke claims that justice is based on personal identity and that personal identity is based on consciousness. However, this view of justice leads to an impasse when the defendant alleges that he has no consciousness of the crime and, therefore, that he does not identify himself as the person who committed the crime: if it is not possible to determine that he is the one who committed the (...) crime, can we say that the punishment is just? This article seeks (i) to analyse the impasse exploring (a) its conceptual framework and (b) its development in the letters Molyneux and Locke exchanged in order (ii) to elaborate a criticism of Locke’s answer to it. Compared to the secondary bibliography, in which one objection to Locke’s answer is well established, the originality of this article consists in elaborating a new objection based on the distinction between the first and third person perspectives and in showing that, when questioned by Molyneux, Locke failed to discuss the conceptual issue necessary to give an adequate answer to the impasse. Este trabalho tem como objetivo, investigar como se deu o surgimento do que Hannah Arendt denominou esfera do social, assim como a formação do homem de massa após a vitória do animal laborans na era moderna. Para tanto recorreremos Grécia antiga com o fito de conceituar o que esta autora denominou de público e privado, em seguida mostraremos como está configurado tais domínios na era moderna e suas influências na formação do que se denomina esfera do social na filosofia política (...) arendtiana. Resumé Cette étude a pour objectif analyser l’origine de ce que Hannah Arendt appelait la sphère social, ainsi que la formation de l'homme de masse après la victoire de l’ animal laborans dans l'ère moderne. De ce fait, nous recourrerons à la Grèce antique dans le but de conceptualiser ce qui s’appelais autrefois public et privé, puis nous montrerons comment sont configurés tels domaines dans l'époque moderne et leurs influences sur la formation de ce qu'on appelle la sphère social dans la philosophie politique de Hannah Arendt. Resumo: O presente artigo discute a questão do percurso plástico do pintor Paul Cézanne e a influência direta vivida por Merleau-Ponty nas fases da fenomenologia e da ontologia selvagem. Para tanto, o referido percurso é sustentado pelo tema da organização estruturante das obras de arte que “lançam” os sujeitos da percepção ao mundo vivido. Na fase fenomenológica mostramos o problema da percepção das imagens a partir das criações romântica e impressionista de Cézanne, pintor moderno, que critica a produção clássica pelo (...) poder de representação da natureza em suas formas “nítidas” e delimitadas, por exemplo, pelas linhas e pelos desenhos, estabelecendo-se, a partir dessa questão, a ultrapassagem do mundo determinado. Em seguida, pretendemos mostrar como a pintura do último Cézanne encontra-se aberta, enquanto pintura “selvagem”, ao sujeito e ao mundo, na condição de envolvimento carnal. Desse modo, passamos a compreender questões fundamentais como: o olhar e a experiência perceptiva; o processo de criação pictórica; a constância e os instantes do mundo; a profundidade, a visão radical e a ontologia selvagem. Considerando que muitos livros desenvolvem nossa capacidade de identificação imaginativa e de disposição para evitar a crueldade, aproveitamos as sugestões de Richard Rorty e utilizamos o romance Lolita, de Vladimir Nabokov, como cenário para a redescrição da crueldade. Cabendo prontamente nos critérios liberais rortyanos de combate à crueldade, esse romance nos possibilita perceber os efeitos que as nossas próprias idiossincrasias privadas podem ter sobre a vida de outras pessoas. Dono de metáforas fortes, vívidas, Lolita nos permite abordar o que chamamos (...) de “a pequena crueldade”, a crueldade que um indivíduo pode infligir a outro sem sequer notar que é cruel. (shrink)

Resenha do livro de Maria Judith Sucupira da Costa Lins "Educação Moral na Perspectiva de Alasdair MacIntyre".

O uso da inteligência artificial no Poder Judiciário ainda encontra fortes limitações à luz da compreensão representacional-computacional da mente. A exemplo do projeto pioneiro do juiz robô na Estônia, a dificuldade reside na incapacidade de apreensão da narrativa subjetiva da máquina. Logo, através da experiência do ser-aí-no- mundo de Heidegger, define-se um contraste entre cognição humana e funcionamento computacional. Partindo de uma pesquisa qualitativa e de cunho bibliográfico, busca-se demonstrar a complexidade de conceber dispositivos puramente físicos com inteligências aptas a (...) substituírem juízes por robôs. Conclui-se que ainda não há tecnologia capaz de substituir a ciência cognitiva heideggeriana do Dasein. (shrink)

ABSTRACT This article presents John Locke’s defence of toleration in the Epistola de Tolerantia and assesses the possibility of interpreting it as a vindication of a secular State. In particular, the goal is to analyse Locke’s distinction of the ends of Church and State and to determine to which degree it answers to the concept of laïcité formulated in the Universal Declaration of Laïcité in the 21st century.

O ceticismo antigo se concebia como um modo de vida. Para acadêmicos e pirrônicos, a suspensão do juízo era o único caminho para a felicidade e a sabedoria. Na Antiguidade, essa filosofia recebeu inúmeras críticas, como o argumento da apraxia, mas talvez a principal delas tenha sido a de Agostinho, que buscou reformular o conceito de sabedoria. Para Agostinho, a sabedoria não pode ser definida como mera abstenção do erro e a felicidade não é concebível sem a presença daquilo que (...) se deseja. De Cícero e Sexto Empírico a Agostinho, portanto, há uma transformação muito relevante na maneira de se avaliar a relação entre a verdade e o bem viver, que, quando compreendida, permite que se perceba com mais clareza as diferenças entre autores modernos como, por exemplo, Montaigne e Pascal. O presente estudo objetiva apresentar o direito e a prática jurídica como categorias cognitivas e linguísticas expressas metaforicamente, bem como a importância da metáfora para a capacidade humana de pensar e construir sentidos. Para tanto, utiliza-se de metodologia qualitativa mediante a abordagem da Teoria da Metáfora Conceptual de George Lakoff e Mark Johnson, apresentada na obra “Metáforas da Vida Cotidiana” (1980[2002]), tudo com amparo em instrumentais bibliográficos, notadamente literatura nacional e estrangeira. Os resultados alcançados indicam que a retórica jurídica é (...) estruturada metaforicamente para ocultar seu caráter, expressando uma pretensa objetividade, mas que o discurso emergente é interacional e negociado. Whereas previous discussions on ownership of biological material have been much informed by the natural rights tradition, insufficient attention has been paid to the strand in liberal political theory represented by Felix Cohen, Tony Honoré, and others, which treats property relations as socially constructed bundles of rights. In accordance with that tradition, we propose that the primary normative issue is what combination of rights a person should have to a particular item of biological material. Whether that bundle qualifies to be (...) called “property” or “ownership” is a secondary, terminological issue. We suggest five principles of bodily rights and show how they can be applied to the construction of ethically appropriate bundles of rights to biological material. (shrink)
