Luck, Value, and Commitment comprises eleven new essays which engage with, or take their point of departure from, the influential work in moral and political philosophy of Bernard Williams (1929-2003).

Hannah Arendt's approach to politics focuses on action and conduct, rather than institutions, constitutions, and states. In light of Arendtian conceptions of politics, essays in this book challenge conventional IR theories. The contributions on agency explore concepts and categories of political action that enable individuals to act politically and to re-make the world in new, unpredictable ways. The contributions on structure explore how Arendt provides new critical purchase upon often reified structures and categories.

In much of pre-Qin political philosophy, including those thinkers usually labeled Confucian, Daoist, or Mohist, at least part of the justification of the political state comes from their views on morality, and the vision of the good ruler was quite closely tied to the vision of the good person. In an important sense, for these thinkers, political philosophy is an exercise in applied ethics. Han Fei, however, offers an interesting break from this tradition, arguing that, given the vastly different goals (...) of moral theory and political theory, it would be disastrous to rely upon the former to undergird the latter. He develops a distinctly amoral political philosophy that avoids many of the problems he sees as arising from a reliance on particular virtues on the part of the ruler or others within the state. In this paper, I analyze the source of normativity in Han Fei’s political philosophy, arguing that he demonstrates a keen understanding of the problems inherent in any system that relies upon moral standards to develop a strong, stable, and prosperous state. Rather, he demonstrates how an understanding of human nature, along with a recognition of facts about the natural world, allows for the development of a non-moral political philosophy that relies on a systematic bureaucracy and an inviolate system of law, one which will be much more successful, he believes, than anything his competitors can construct. Emerging forms of empowered participatory governance have generated considerable scholarly excitement, but critics continue to ask if such initiatives are “for real”: Are participatory governance processes sufficiently independent? Do citizen participants make good policy choices? An in-depth look at the case of the British Columbia Citizens’ Assembly on Electoral Reform suggests that real citizen empowerment depends on both the institutional constraints of the participa-tory setting and how citizen interests and arguments for policy outcomes crystallize over the course of a participatory (...) process. According to Saul Smilansky's ‘Paradox of Beneficial Retirement’, many serving members of professions may have decisive integrity-based reasons for retiring immediately. The Paradox of Beneficial Retirement holds that a below-par performance in one's job does not require any outright incompetence, but may take a purely relational form, in which a good performance is not good enough if it would be improved upon by someone else who would be appointed instead. It is argued, in response, that jobs in the sectors Smilansky (...) mentions are not merely positions to optimize the goals of the profession, but are professional careers in which there is the possibility of security and personal fulfilment. The article also explores connections between Smilansky's argument and G. A. Cohen's anti-incentives argument against Rawls. It is suggested that both thinkers underappreciate the relationship between personal reasons and institutional reasons. (shrink)

Nature did not equip any of its creatures with wheels, but that means of locomotion was discovered anyway; an even swifter vehicle for the mind has been found in the atom—that irreducible unit which by virtue of its ubiquity provides reason with immediate access to alien objects, naturalizes nature, and urges an essential likeness beneath appearances so diverse that only an improbable imagination would even have placed them in a single world. The goal of atomism is to find one entity, (...) a building block which then in multiples constitutes the structures of reality and appearance. All that is needed, given this once and future One, is a set of transformational rules—and everything comes to life that has been dreamed of in the topologies of geometry, physics, history, even of metaphysics: a full representation of the world as it has been, is, will be. The ideology of atomism includes the assumption that, for structures distinguishable into parts and wholes, the parts precede the whole, temporally and logically. For the atomist, all structures can be analyzed in this way; that, in fact, turns out to be his definition of structure. This premise is already evident in the building-block universe first depicted by Democritus and Leucippus; it is no less present in the heady days of twentieth-century physics . It is slightly more pliable in latter-day atomists like Claude Lévi-Strauss and Noam Chomsky and their descendent structuralists; but here, too, atomic units of linguistic or social discourse are claimed as blind first causes of the sighted and complex structures allegedly derived from them. And if the followers of even these contemporary advocates find themselves still waiting for the promises of atomism to be kept, the imaginative turns of those promises—the binary code, the rules of an innate grammar—keep old expectations alive. In contrast to this general ideological assertion, the search for artistic atoms by poetics and aesthetic theory has lagged noticeably. We can see this disparity in the characteristic resistance to fragmentation by works of art; for many writers, the will of artistic appearance to exhibit itself as a whole, to insist on an undivided surface rather than on the elements within or beneath it, is precisely what distinguishes the structures of art from others. Even where a craftsmanlike impulse breaks into the surface of artistic unity , the pieces are usually counted teleologically: they matter as contributions to an effect, retrospectively. The artist himself, it is implied, deployed them in the first place to anticipate the unified surface; we , in turn, then understand them only in terms of that whole, not—with the atomist—by conjuring a unity from the earlier accidental joining of what then become accidental parts. This article analyses the slippery notions of the normal and normality in select works of Richard von Krafft-Ebing (1840–1902) and Sigmund Freud (1856–1939) and argues that homosexuality became a ‘boundary object’ between the normal and the abnormal in their works. Constructing homosexuality as ‘normal enough’ provided these two key thinkers of the fin de siècle with an opportunity to challenge societal and medical norms: Krafft-Ebing did this through mapping perversions; Freud, by challenging perceived norms about sexual development more broadly. The (...) article submits that the scientific logic presented in Krafft-Ebing’s seminal case study compilation Psychopathia Sexualis and Freud’s early theoretical writings and cases, including Three Essays on the Theory of Sexuality (1905), was itself haunted by notions of norms and the normal that were not always easy to resolve, and sometimes involved a certain amount of inspired conjecture on the part of both thinkers in order to develop and validate their differing tripartite models of normality. Krafft-Ebing imagined homosexuality as a variation of the normal by generalizing a gay male experience. He also recorded the obstreperous cases of homosexual women based largely inside the clinic but by and large ignored this evidence. Freud inextricably bound homosexuality to normality (and vice versa) by redefining homosexuals as a group to include individuals with unconscious same-sex desire. Doing so allowed him to conceptualize the fear of homosexuality as crucial in the formation of neurosis and psychosis, and at the same time put him at odds with relevant early identity politics. Defence cases with an escalatory structure, in which the levels of violence between aggressor and defender start out as minor and then become major, even lethal, raise sharp problems for defence theory, and for our understanding of the conditions of defence: proportionality, necessity, and imminence. It is argued here that defenders are not morally required to withdraw from participation in these cases, and that defensive escalations do not offend against any of the conditions of defence, on an adequate understanding of (...) them. No plausible interpretation of proportionality or necessity excludes defensive permissions in escalatory cases. Moreover, the structure of escalatory defensive cases also sheds useful light on permissible responses to conditional deadly threats. This is because we can analyse conditional deadly threats as disguised cases of escalation. Because defensive resistance is permissible in escalatory cases, it is also permissible in cases involving conditional deadly threats. (shrink)

Ronald Dworkin’s Justice for Hedgehogs renews and amplifies his earlier attacks on metaethics. This article reviews the main lineaments of Dworkin’s anti-metaethical arguments and discusses, in detail, a number of issues which arise from them. First, it is suggested that Dworkin’s ap- praisal of what is doing most of the explanatory work in his account is largely askew. Second, it is claimed that Dworkin’s allegation that expressivism is self-defeating is wide of the mark, but that another charge in the same (...) vicinity might be more effective. Third, it is argued that Dworkin’s incuriosity about moral metaphysics is misplaced. What his ar- guments actually support is an opposition to leaving metaphysical hostages to fortune, rather than an opposition to pursuing greater clarification about moral metaphysics. In this connection, it is tentatively suggested that Dworkin might be tempted by a certain version of naturalism.Resumen:En su trabajo Justice for Hedgehogs, Ronald Dworkin renueva y amplía sus primeras críticas a la metaética. En este artículo se estudian los principales rasgos de los argumentos antimetaéticos que elabora Dworkin, y se analiza con detalle un número de problemas que surgen de esos argumentos. En primer lugar, se sugiere que la apreciación de Dworkin, con respecto a lo que se está haciendo en buena parte de los trabajos de carácter explicativo, está tergiversada. En segundo lugar, se sostiene que la acusación de Dworkin de que el expresivismo es auto-derrotable es inofensiva, aunque otra acusación en las mismas cercanías podría ser más efectiva. En tercer lugar, se afirma que la falta de interés de Dworkin acerca de la metafísica moral está mal orientada. Lo que realmente apoyan sus argumentos es una oposición a dejar los rehenes metafísicos a la fortuna, y no una oposición a perseguir una mayor clarificación de la metafísica moral. Se examina también cómo la estética del grotesco y el modelo carnavalesco son puestos en movimiento para desestabilizar la identidad de género y así mostrar la imposibilidad de reconstruirse después de la catástrofe de la guerra.

In his Rights Forfeiture and Punishment, Christopher Heath Wellman argues that his preferred ‘strong’ version of rights forfeiture theory makes the moral rights of due process and a fair trial null and void for guilty offenders. They may still possess legal rights to due process, but these are not strong pre-institutional moral rights. I explain here why I disagree with Wellman. I also suggest that he is not entitled, by his own lights, to affirm strong forfeiture theory, at least in (...) our social world. (shrink)

In _War By Agreement_, Yitzhak Benbaji and Daniel Statman argue that the morality of war can be governed by a freely accepted agreement over the principles that apply to it. This war contract supersedes the application of the principles of everyday morality to war, thus defying ‘revisionist’ approaches to war, and it upholds a recognizable version of traditional just war theory. This article argues for three claims. First, the contractarian apparatus Benbaji and Statman deploy is actually inconsistent with the deep (...) reasoning they advance on its behalf, since, unsatisfactorily, the contract is supposed to retain normative force even when it is breached by aggressors. Second, the underlying character of their theory makes it something closer to a consequentialist account. Third, this new understanding of their account renders it less distinct from certain articulations of revisionism than they think. (shrink)

Thucydides' account of the Athenian general Phrynichus' secret correspondence with the Spartan admiral Astyochus is both troubling and obscure. It may be summarized as follows: Phrynichus, having eloquently opposed Alcibiades' efforts to be recalled from exile and fearing that a repatriated Alcibiades would take vengeance on him, wrote to Astyochus revealing Alcibiades' pro-Athenian activities. Astyochus handed the letter to Alcibiades, who then wrote to the ranking Athenians on Samos concerning Phrynichus' ‘treason’ and demanded his execution. Phrynichus then wrote again to (...) Astyochus, now proposing to make it possible for the Spartans to destroy the whole Athenian force at Samos. (shrink)

The principles whereby the reason operates in ethically complicated situations has been subject to long-standing debates in Catholic Philosophy. A classic text which exemplifies this is Aquinas’s consideration of self-defensive killing. In this paper I clarify two central issues in double-effect reasoning debates surrounding this text. Both issues are connected to the seemingly simple but actually complex task of accounting for the “chosen means” of self-defense. The first issue is whether the “chosen means” are also able to be considered a (...) “proximate end,” to which the intention is directed. The second is determining whether the assailant’s death is related to the “chosen means” per se and therefore to the rest of the moral action. Resolving these issues will provide grounds for answering the broader question implicit in the situation of self-defensive killing: what is to be done when human actions would inevitably entail that some evil is instrumentally tied to realizing some good? La question de l’accès ouvert se pose pour leurs productions de manière différente selon qu’il s’agit de conception de logiciels ou de publication de texte, de recherche industrielle ou publique, de secteurs brevetables, de données ouvertes ou non.Computer scientists, who were the first to work on open access (...) design, have not necessarily been its most fervent users in their own scientific publication practice, since they have long given preference to interpersonal exchanges. Concerning their output, the question of open access arises in different terms, depending on whether the context is software design, text publishing, industrial public research, patentable sectors, or open or restricted access data.
