Many debates in biomedical ethics today involve inconsistencies in defining the key term, person. Both sides of the abortion debate, for instance, beg the question about what constitutes personhood. This book explores the arguments concerning definitions of personhood in the history of modern philosophy, and then constructs a superior model, defined in terms of distinctive features. This model is shown to have distinct advantages over the necessary and sufficient condition models of personhood launched by essentialists. Philosophers historically have been correct (...) about what some of the pivotal distinctive features of personhood are, _e.q._, rationality, communications and self-consciousness, but they have been wrong about the _methods_ of recognizing and asserting personhood, and about the relative importance of feelings. In clinical care, complaints often surface that care is not personal. This book aims to improve care through providing a method of attending to patients as people. Charts in the Appendices show that where physicians attended to personal features important to their patients, sometimes the patients rated the care even higher than the physician did. The book will be useful to health-care providers whose goals include improving quality of care, listening to patients, and preventing malpractice. (shrink)

Two inscriptions, one found at Tylissos on Crete, the other found at Argos, both dated about 450, concern relations between Argos and the Cretan towns of Knossos and its smaller neighbour, Tylissos. The close relationship between the treaties of fragment A and fragment B – and therefore the interconnection among Argos, Knossos, and Tylissos – seems generally recognized by scholars. The articles of the agreement lay down a diverse and complex set of arrangements among the three parties, but as a (...) whole, the treaty has been interpreted in two ways: the three πóλεις have entered into some sort of federal union; only Argos and Knossos are signatories to the treaty, while Tylissos is a dependency of Argos. The former interpretation has gained wider acceptance than the latter, and if it is correct, just such a federal union would represent a remarkable advance in the development of Greek political institutions. In this paper we shall press a philological point based upon the information we have both from the treaty and from contemporary sources, and in so doing, we shall attempt to show that a federal union is unlikely. We shall then offer our own interpretation of the regulations governing the insular cities with regard to the formation of alliances and the declaration of friends and enemies. (shrink)

Unlike the radical historicist and the radical logicist, the moderate historicist in the philosophy of science adopts the position that neither purely a priori (i.e., logical or philosophical) nor purely historical considerations alone determine the acceptability of a philosophical analysis of science. A dilemma arising from the nature of this position is first described and then it is argued that what is perhaps the most plausible way of avoiding this dilemma is doomed to failure. A particular example of this attempt (...) at escaping the dilemma is considered in some detail, and along the way evidence is amassed in support of the view that no non-trivial statement of moderate historicism will be coherent. Two experiments are reported that evaluated survey learning of youth with DS and typically developing children (TD) matched on Mental Age (MA). In Experiment 1, the experimenter navigated participants through a novel virtual environment along a circuitous path, beginning and ending at a target landmark (i.e., a door). Then, the participants were placed at a pre-specified location in the environment and instructed to navigate to the same door using the shortest possible path from their current location. They completed the task (...) three times: once after being shown the environment one time, once after three exposures, and once after five exposures. Results indicated that the participants with DS exhibited significantly less skill at identifying the shortcut than did the TD participants. In Experiment 2, participants learned two overlapping routes through a simple environment. Following acquisition, they were tested on several measures of survey knowledge: finding a shortcut, identifying the direction of landmarks not currently visible from their location in the environment, and recognizing a bird’s-eye representation of the overall environment. The results of Experiment2 indicated that the participants with DS were at least as good as the TD participants on all of our measures of survey learning. Hence, we concluded that people with DS can acquire some survey knowledge when they learn a simple environment. However, the performance of both groups was relatively poor in Experiment 2, indicating a need to consider identifying the mechanisms underlying the poor performance on wayfinding of people with DS. Identifying the underlying mechanisms, is a logical first step in devising methods of enhancing environmental learning of people with DS. (shrink)

Late in his career, Immanuel Kant would turn his attention to this perennial question with an elaborate account of " radical evil " in Religion within the Limits of Reason Alone. His discussion produced consternation among his admirers, such as Goethe, and continues to produce puzzlement among his commentators. Among the chief difficulties facing the modern-day interpreter has been (...) the welter of complex terminology tossed up by Kant's attempts to tame his topic. The Kant specialist can justifiably suppose that if only he or she could un-scramble the terminology, grasp the intended interconnections among the terms, and set the discussion within the context of the entire critical philosophy, the result would be a reasonably clear view of Kant's theory of the nature and source of moral evil. There is of course some justification to this vaguely masochistic approach to the matter, yet such an approach, I fear, leads inevitably to frustration. This is because, despite all the appearances to the contrary, Kant never really explains moral evil in the discussion of radical evil in Religion. To be sure, he offers a definition of what moral evil is, by the terms of his philosophy. Nevertheless, he never really accounts for evil, nor does he offer anything remotely approaching an answer to my opening question. The deepest part of Kant's analysis is not a response to that question, but a link between moral evil and human freedom, and this link is utterly inexplicable, for the same reason that freedom itself is, for Kant, ultimately inexplicable. Thus, by this reading of the theory of radical evil, we are not finally led to comprehend Kant's view of evil. Instead, we are 246 THE INSCRUTABILITY OF MORAL EVIL IN KANT 247 reminded of the contingent nature of the exercise of freedom, the unfathomable quality of the process of character-building, and, finally, the sheer inscrutability of moral evil itself. Kant is theorizing about human nature in a way that gradually discloses the futility of domesticating this topic conceptually or rationally. This point is worth stressing, partly because of certain stereotypes that persist regarding the things Kant's philosophy supposedly renders in rational form. And, obviously, the point can be stressed in the present context by pursuing further the notion that moral evil is, for Kant, inscrutable. The inscrutability of moral evil does not pop into view all at once, for Kant's discussion in Religion is set in the context of a complex account of the structure of the will, the nature of the incentives capable of determining the will, and the issue of freedom. Consequently, in what follows I shall attempt to trace the Kantian line of thought lying behind his agnosticism regarding the source of moral evil. -IFor Kant, moral evil resides in a maxim.1 A maxim is for him a special kind of principle, one which guides or informs actionin effect, a "practical principle." The very idea of a maxim is a key element in Kant's efforts to determine how reason can be practical. This is an excellent addition to Bobbs-Merrill's "Text and Commentary Series." In addition to the text of the Principles, there are eleven critical essays, three of which are original with this volume. Turbayne has arranged the essays to parallel the unfolding of the major themes in the Principles. Thus, he himself opens with "Berkeley's Metaphysical Grammar," which picks up and develops the theme of the centrality of the study of language to the philosophical enterprise, a point Berkeley makes in (...) his "Preface." Next, W. H. Hay and Richard Van Iten are paired together with different perspectives on Berkeley's nominalism. By way of comment on esse is percipi, G. E. Moore and W. T. Stace present their respective refutations of idealism and realism. Richard Popkin discusses skepticism and Berkeley. Popper examines the ways in which Berkeley anticipated Mach and Einstein, as well as significant features of contemporary philosophy of science. Turbayne and Cornman offer differing appraisals of the philosophy of mind that is sketched in the Principles. Paul Olscamp attempts to systematize the elements of Berkeley's critical theory. Finally, J. D. Mabbott treats of "The Place of God in Berkeley's Philosophy" and argues for a radical voluntarism in Berkeley--a not surprising analysis, but one which often gets buried under the epistemological issues raised in the Principles. Turbayne has also supplied an excellent introduction, a chronology of Berkeley's life, a working bibliography, and an analytical index. This enhances the usefulness of an already first-rate book.--E. In 1926, C. E. Ayres, a young assistant editor of The New Republic, had completed a draft of his first book, Science: The False Messiah. His publishers, Bobbs-Merrill, were enthusiastic but also somewhat worried—the book, which was a blistering critique of the public understanding of science, was engagingly written and eminently readable, but it was also provocative. Legal philosophers and property scholars sometimes disagree over one or more of the following: the meaning of the word 'property,' the concept of property, and the nature of property. For much of the twentieth century, the work of W.N. Hohfeld and Tony Honoré represented a consensus around property. The consensus often went under the heading of property as bundle of rights, or more accurately as a set of normative relations between persons with respect to things. But by the mid-l 990s, (...) the consensus was under attack. Key figures in the attack were James Penner, a legal philosopher, and Thomas W. Merrill and Henry E. Smith, two highly regarded professors of property law. This article aims to repel the attack and argues for property as a set of normative relations between persons with respect to things. The positive case for this view of property pays special attention to the philosophy of language and the analysis of concepts. The positive case also maintains that the right to use and the power to transfer are as central to property as the right to exclude. It is possible that the virtues of Smith's modular theory of property differ from the virtues of a well-crafted bundle theory. Indeed, it may be the case that these two theories throw light on different features of property law and are not, save at the margin, competitors with each other. The label 'new essentialism' sometimes applied to the work of Penner, Merrill, and Smith seems inapt if property does not have an essence. Of course, they might refuse the label. (shrink)

The Reshaping of Phytogeographical Knowledge as the “Transition zone” Wallacea: An American Expansion Project in the Philippines, 1902–1928. This paper examines the development of a concept that to this day plays an important role in biogeography: the region Wallacea. Focussing on the work of the American tropical botanist Elmer D. Merrill in the Philippines, I argue that his research on the geographical movement and settlement of Philippine plants reflects a shift in the United States’ scientific and cultural understanding of (...) the Pacific area towards a notion of “American tropics”. While inventorying plants for the American administration from 1901 to 1923, the composition of Philippine flora prompted Merrill to question biogeographical regionalization in Wallace's Malay Archipelago. Not being able to situate the Philippine flora within “Asian” or “Australasian” biota, Merrill described the islands as an area of trans‐regional plant migration. Together with the paleontologist Roy E. Dickerson, he later conceptualized the region Wallacea as biogeographical “transition zone” between the Philippines and Australia. In addition to the scientific conceptualization, Wallacea constitutes a space between two biogeographical subregions, whose flora was considered as being part of both, but could not be unambiguously attributed to either of these regions. In this respect, the plants resembled the inhabitants of the United States’ insular overseas territories, who were legally defined neither as aliens nor as citizens. In this sense, Wallacea embodies epistemic as well as geopolitical boundaries, while its case also illustrates some of the ways in which colonial interests in the usability of plants found expression in botanical research during the early period of American overseas expansion. Margaret Wise Brown's The Important Book, which is a childrens' picture book, provides an excellent opportunity to discuss metaphysics. The book opens up for our reflection the viability of a certain metaphysical account of the nature of objects. In making a distinction between the important feature or property of an object and all the others that it simply is or has, The Important Book operates with the assumption that all objects have what metaphysicians call an essential property. As the book (...) has it, while there are many things that are true of any object, only one is essential to it. These other things are accidents or non‐essential properties of the object. Essentialism is the metaphysical view that objects have one property — their essential property — that cannot change while the object remains the same thing. (shrink)

Shrek! focuses on an issue in the philosophy of language, a relatively new area of philosophical investigation that first emerged during the twentieth century. Some philosophers disagree with the claim that you cannot separate the descriptive and evaluative elements of linguistic statements. This is because they take descriptive statements to be the basic elements of language, to which our subjective attitudes get attached later in a contingent manner. At its most basic level language presents a symbolic picture of facts in (...) the world. Instead of living a life just like everyone else and fulfilling expectations that others have for us, our lives should resemble the transformed facades of all the homes on Mr. Plumbean's (...) street: reflections of our own, individual dreams. The story of a relationship between a boy and a tree is charming for, despite the vicissitudes of the relationship, the two end up together at the end, with the boy — now an old man — sitting contentedly on the tree — itself reduced to a mere stump. The book raises an important issue in the field of environmental ethics. It (...) asks us to recognize that between childhood and old age, people operating within the Western tradition of ethics are not mindful of the value that the non‐human beings in their environment have for them as well as for future generations. Robert Mursch's picture book, The Paper Bag Princess, inverts many of the gender roles traditionally found in fairy tales: It's a prince (Roland) who gets abducted in this story, not a princess, though it's the princess (Elizabeth) who must come to the rescue and save him. Although these reversals are a source of the book's humor, they also underscore claims made in feminist philosophy, the specific branch of social and political philosophy considered in this chapter. Feminist philosophers and literary scholars (...) have pointed out that happy endings reassert harmful gender norms. Elizabeth's rejection of Roland marks her as a truly feminist hero, for she won't let him treat her in a demeaning manner even though she has staked her own life on saving him. With this story, you can hopefully steer children into a discussion of gender bias and oppression, and how traditional stories function to support it. (shrink)

The Sneetches by Theodor Geisel (otherwise known as Dr Seuss) is a satirical story that targets illicit discrimination. The book presents its parable about discrimination by depicting a society in which one group discriminates against another group because of an easily perceptible difference between them. The real irrationality of discrimination in both The Sneetches and real life is that it is based on the false claim that members of the discriminated‐against group are inferior to members of the discriminating group. The (...) book ends with all of the Sneetches playing with one another, paying no attention to the presence or absence of stars on their bellies. The lesson that children draw from The Sneetches is clear: Discriminating against people in a different social group is wrong. (shrink)

Modern scholars have been concerned with the hostility shown to Alexander by the Hellenistic schools of philosophy. Two literary portraits have been distinguished, the Peripatetic and the Stoic, the former deriving from Theophrastus' book on Callisthenes, or starting with this work the Peripatetics worked out a theory of and applied it to Alexander, in order to belittle his achievements. It was a case of giving sophisticated expression to the kind of crude resentment expressed by Demades.

The locus classicus for Plutarch's own views on his methods is in the Alexander He has begun by asking for the indulgence of his readers if they do not find all the exploits of Alexander and Caesar recounted by the biographer or if they discover him not reporting some famous incident in detail (); and he goes on to compare his own search for evidence which will indicate the kind of soul, with the activity of the painter, who, in order (...) to create a likeness, concentrates on the eyes and pays little attention to the other parts. Commentators and critics have been right to take this as a key text for the purpose of understanding Plutarch's attitude towards his biographical work; nevertheless there are other passages in the Lives where we can at least glimpse his attitude to his subject, and we can only see the Alexander-remarks in correct perspective if we take these other passages into account. I propose therefore, starting with the Alexander, to see how far these critical remarks apply to Plutarch's theory and practice elsewhere in the Lives. (shrink)
