Que ele está preocupado com a legitimidade das normas é algo não controverso; não obstante, a preocupação com o que atualmente denominamos de segurança jurídica é menos evidente. Defende-se aqui que essa preocupação evidencia-se quando ele procura garantir a separação dos poderes e exige a precisão matemática na aplicação das regras jurídicas. É bem conhecida a oposição estabelecida por Kant entre experiência possível e dialética, na medida em que esta última é caracterizada como a “lógica da ilusão”. Ao mesmo tempo, o modo de pensar metafísico, que ocorre dialeticamente, em sentido kantiano, é uma tendência inevitável da razão, expressa na exigência formal de completude das categorias. Como o pensar, enquanto exercício livre da razão, é em si mesmo mais amplo do que a atividade de conhecer, própria do entendimento, o pensar contém o (...) conhecimento, embora este se qualifique pelas regras e pelos limites determinantes da objetividade. A pergunta que tentaremos formular é se essa relação continente-conteúdo não poderia configurar também uma dependência da experiência em relação ao raciocínio dialético, que estaria de algum modo indicada na função reguladora das idéias da razão. Nesse caso, a oposição formal entre conhecer e pensar seria inseparável da inclusão estrutural (dependência) da experiência no âmbito da razão. Na raiz do problema estaria talvez a tensão (dialética) entre a aspiração subjetiva de totalidade e as exigências objetivas de limitação e segmentação da experiência e a forma da experiência teria de ser finalmente concebida a partir de um fundo de inteligibilidade problemática. Dialectics and experienceThe separation of possible experience as objective knowledge and dialetics as a non-objective or non-theoretical knowledge is one of the most important aspects of kantian critical philosophy. But Kant also says that the activity of reason, as a pure thinking, has more amplitude than understanding knowledge. So we could say that theoric knowledge would depend on rational ( and non-theoretical) knowledge, as something contained in it. If we accept that, the consequence would be a relation of dependence between the form of objective knowledge and the background of a problematic – even doubtful – inteligible knowledge. (shrink)

SummaryIn this article, I offer a series of responses to comments by four scholars on my book, Continental Divide: Heidegger, Cassirer, Davos. In my remarks, I take up various questions of both methodology and interpretation, clarifying, for example, why the term “Continental” still seems to me an apt description for the philosophies of both Cassirer and Heidegger, how the two thinkers related to the tradition of philosophical anthropology, how each philosopher conceived of the relation between myth and science, (...) and so forth. Along the way, I also clarify why the terms “spontaneity” and “thrownness” still strike me as helpful for distinguishing between the two rival philosophies, and I explain why it is misguided to believe that philosophical disputes must conclude in dialectical reconciliation. O aparecimento do coronavírus fez ressurgir um antigo debate no âmbito da filosofia política: o debate entre liberdade e segurança. A maioria dos países atingidos precisou adotar medidas que restringiram a liberdade dos cidadãos para conter o avanço da doença. Esse artigo tem o objetivo de apresentar a posição do filósofo inglês, Thomas Hobbes exposta no _Leviatã_, para enfrentar esse problema. O texto está dividido em três partes. Em um primeiro momento, apresento a tese de Hobbes sobre a (...) class='Hi'>segurança e contra a liberdade irrestrita para evitar o estado de natureza. Em um segundo momento, apresento a tese de Hobbes sobre a liberdade limitada no estado político. The thought that empathy plays an important role in moral motivation is almost a platitude of contemporary folk psychology. Parallel themes were mooted in German moral philosophy and aesthetics in the 1700s, and versions of the empathy construct remained prominent in continental accounts of moral motivation through the nineteenth century and early twentieth centuries. This chapter elucidates the Empathic Motivation Hypothesis (EMH) and sets out some of the conceptual and empirical challenges it faces. It distinguishes empathic concern from other (...) dimensions of empathy (e.g., resonance, attunement, distress, and non-empathic concern) and examines the merits of EMH as a developmental thesis, focusing on evidence from psychopathology and attachment theory. In his 1924 Aristotle lectures, Heidegger carries out a phenomenology of being-in-the world which illuminates the “structures” of emotion.Aristotle’s descriptions of emotions in the Rhetoric serve to enrich the structures delineated by Heidegger. Although millennia separate the two thinkers and their civilizations, what they say together about emotion is meaningful today. Their philosophical projects may seem to subordinate consideration of (...) emotion to rhetorical or ontological purposes, but they actually serve to enrich our understanding by recognizing the intertwining of speech, world, and emotion. I first offer a corrective to Meillassoux’s interpretation of Husserl. Then, I turn to Merleau-Ponty’s lectures on the philosophy of nature, where he addresses the paradox by (...) interpreting Husserl in the light of Schelling. I argue throughout that the correct understanding of Husserl’s concept of constitution, and particularly, passive constitution, defangs this realist criticism of phenomenology and suggests phenomenology to be capable of a Naturphilosophie intimating pre-reflective being. When we consider the concepts and assumptions of a way of interpreting we are not abstracting ourselves from concrete analytical practice, but are dealing with one dimension of that practice. When a person’s assumptions and concepts change, aspects of his therapeutic work will also change. The philosophical ideal of conceptual clarity means that one strives to be able to recognize how he interprets what is going on—he strives to recognize how he proceeds with the therapeutic process in relation to other (...) options. In that way he has a far better chance of allowing the experience to speak for itself to him, i.e., when he knows something about his own assumptions in relation to a variety of other assumptions, he is able to hear how an occurrence exceeds or differs from his own accustomed ways in which he makes sense of things. A justiça entre as gerações transformou-se num problema particularmente urgente nos nações industnalizadas devido ao decréscimo da população e à crescente divida pública. Isto verificase sobretudo em refoçao ao seguro social de reforma. O principal objectivo do presente artigo é investigar até que ponto o Estado Providência da Europa continental está possuído por urna tendência nele embutida a cair em ilusões acerca da sua verdadeira riqueza bem como acerca da sua efectiva e real protecção contra o problema que é (...) o empobrecimento das pessoas uma vez chegado o tempo da terceira idade. O autor analisa esta tendência a partir do que chama de ilusão do Estado Providencia, e isso por analogia com a ilusão da divida pública de que falava Ricardo. Dado que as pessoas tendem a agir sob o pressuposto de que a população permanece constante, hoje é um facto que elas tendem sistematicamente a sobrevalorizar o valor dos direitos acumulados em termos de segurança social. É que, diz o autor do artigo, o valor real dos direitos que as pessoas pretendem ter em relação ao sistema público de pensões é, de facto, muito mais baixo em situação de diminuição de população do que aquilo que eles supõem. Esta ilusão do Estado Providência, de facto, conduz os cidadãos a um inevitável desapontamento por relação às expectativas criadas em termos do pagamento de pensões urna vez chegada a idade de as receber e, ao mesmo tempo, a inevitáveis conflitos com a geração mais jovem, ou seja, com aqueles e aquetas que terão de trabalhar para que essas pensões possam efectivamente ser pagas. Nesse sentido, declara o autor do artigo, é preciso reconhecer que a questão da justiça inter-geracional a curto prazo entre as gerações actualmente vivas é ainda mais central e premente do que a questão da justiça para com as gerações futuras, malgrado o facto de esta ser frequentemente discutida sob o rótulo de justiça inter-geracional. Finalmente, o artigo discute também as consequências destes desenvolvimentos para o mercado global de capitals bem como a importância de se proceder a uma transição para um sistema de pensões de velhice financiado com fundos gerados no mercado de capitais. Justice between generations has become an urgent problem for the Industrialized nations due to decreasing populations and high public debt. This is particularly true for the old age pension social insurance. The article investigates the question whether the continental European welfare state show an in-built tendency towards illusions about their real wealth and the degree of their insuredness against old age poverty. It analyzes this tendency as "welfare state illusion" in analogy to Ricardos public debt illusion. Since people act under the assumption of a constant population they tend to overestimate systematically the value of their accumulated claims to the social insurance. The value of their claims to the public pension system is indeed much lower under conditions of shrinking populations then they assume. This welfare state illusion leads to the disappointment of expectations concerning the level of the old age pensions and to conflicts with the younger generation that has to work for the old age pensions. According to the author of the article, this question of the short term intergenerational justice of generations presently living is much more central then the question of justice towards future generations, a problem abo often discussed under the label of intergenerational justice. Finally, the article also discusses the consequences of these developments for the global capital market as well as the importance of a transition to a system of capital funded old age pensions. Michael Dummett begins The Logical Basis of Metaphysics by noting that most of the work done in analytic philosophy seems disconcertingly remote from any concern with the “deep questions of great import for an understanding of the world” that the non-professional expects it to answer. In part, he says, this is because modern analytic philosophy is founded upon a more penetrating analysis of the general structure of our thoughts than was available to past ages, namely, the apparatus of modern logic, (...) beginning with Frege’s Begriffsschrift in 1879. Analytic philosophers take for granted the principles of semantic analysis embodied in the notation of modern logic. Even if they do not make use of a technical vocabulary, having taken these principles for granted is itself often enough to render their approach opaque to the layperson. Appearances aside, he claims, analytic philosophy is still concerned with the “deep questions.” And, to his credit, Dummett keeps an eye focused on some of the central questions of philosophy, those concerning metaphysical realism, throughout the book. O presente artigo aborda a instituição de órgãos de polícia como representantes do poder e da autoridade do Estado sob a ótica da filosofia, sobretudo no contexto do contrato social, fundamentada em revisão bibliográfica. Ainda que o homem tenha preterido sua liberdade natural em prol de uma liberdade assistida, e sendo a polícia um dos órgãos responsáveis por essa assistência, não há como afirmar que esse trabalho está correspondendo aos anseios da sociedade, sobretudo ao se analisar os índices de violência (...) que a envolvem. Nesse sentido, a sociedade vem questionando a necessidade da existência dessas instituições, muitas vezes, inclusive, pedindo sua extinção. (shrink)
