Abstract. Con il presente contributo si propone una rilettura critica del concetto di “verità legale”, ove propugnato per estendere l’area di prensione punitiva delle false comunicazioni sociali anche ai giudizi discrezionali. Il disaccordo con l’impianto motivazionale delle Sezioni Unite – nel contesto argomentativo dei valori monetari intesi come “traduzione” di fatti obbiettivi – si radica in particolare nell’assunto del «ridotto margine di opinabilità» delle scienze contabili. L’affermazione, come si vedrà, è foriera di fraintendimenti. Si attribuisce al parametro adottato (normativo prima (...) che scientifico) proprietà che non gli appartengono, legittimandolo ad integrare il contenuto della norma penale. Il “falso per inosservanza” assume, così, i connotati di un mero strumento sanzionatorio in bianco di regole tracciate altrove, con ripercussioni tanto nella prospettiva della riserva di legge, quanto in ordine alla genericità del precetto. In 1731, Filippo Argelati printed for the first time the complete works of the Modenese historian Carlo Sigonio. Intended originally as an edition in five volumes, the collection was augmented by a sixth volume after the discovery in Rome of previously unknown manuscripts of Sigonio. Among the new papers were four sets of ecclesiastical censures which had been secretly directed in the 1580s against four of Sigonio’s works, and, with them, Sigonio’s responses to the papal authorities. According to Argelati, the (...) censures and Sigonio’s responses were found in two manuscripts, one from the vatican Library and the other from the city of Bologna. Until now, the veracity of Argelati’s account has never been questioned. Yet, while there is no doubt about the authenticity of the censures, which are attested also by eight other sixteenth-century manuscripts, Sigonio’s replies do raise doubts, as three-quarters of them are known only from Argelati’s edition of his works. The present article investigates the sources used by the author of the replies. This new evidence clearly proves that, in fact, the replies were written centuries after Sigonio’s death, probably in the same period as Argelati’s edition. In turn, this supports the hypothesis that Sigonio’s works were employed as an instrument to oppose the Roman Church’s political claims, in the jurisdictional debate between the papacy and the empire in the early eighteenth century. The relation between ex falso and disjunctive syllogism, or even the justification of ex falso based on disjunctive syllogism, is an old topic in the history of logic. This old topic reappears in contemporary logic since the introduction of minimal logic by Johansson. The disjunctive syllogism seems to be part of our general non-problematic inferential practices and superficially it does not seem to be related to or to depend on our acceptance of the frequently disputable ex falso (...) rule. We know that the acceptance of the ex falso is a sufficient condition for the acceptance of the disjunctive syllogism, but the interesting question is: is the ex falso a necessary condition for the acceptance of the disjunctive syllogism? The aim of the present paper is to discuss some possible ways to define systems that combines the preservation of the disjunctive syllogism with the rejection of the ex falso. (shrink)

Este trabajo intenta dilucidar el significado de la afirmación polémica de Platón relativa a la índole peculiar de los relatos literarios que, aunque falsos, encierran también algunas verdades, pues resulta problemático que Platón, al mismo tiempo, critique esos relatos y, sin embargo, proponga también hacer uso de otros igualmente falsos. Examino tres posibilidades de desambiguar el sentido de pseûdos en estos contextos -"falso" designaría ficción o mentira verbal o el carácter de uno de los dos niveles que constituiría un (...) relato literario- y defiendo que la falsedad rechazable para Platón es sólo la atinente al núcleo tipológico contenido en esos relatos. This paper attempts to elucidate the meaning of the controversial Platonic statement in relation to the peculiarity in the literary accounts which, in spite of being false, contain at the same time certain truths. Furthermore, there seems to be contradiction in the fact that Plato critiques those writings and still proposes using others equally false. I analyze three possibilities to disambiguate the meaning of pseûdos in these contexts -"false" would point to fiction or to a verbal lie or the character of one of the two levels which would comprise a literary account; and I support the fact that, for Plato, the undesirable falsity is only the one related to the typological core comprised in those accounts. Informally rigorous mathematical reasoning is relevant. So too should be the premises to the conclusions of formal proofs that regiment it. The rule Ex Falso Quodlibet induces spectacular irrelevance. We therefore drop it. The resulting systems of Core Logic C and Classical Core Logic C+ can formalize all the informally rigorous reasoning in constructive and classical mathematics respectively. We effect a revised match-up between deducibility in Classical Core Logic and a new notion of relevant logical consequence. It matches better (...) the deducibility relation of Classical Core Logic than does the Tarskian notion of consequence. It is implosive, not explosive. (shrink)

In the Posterior Analytics, Aristotle imposes some requirements on the formulation of scientific propositions: their terms must be able to perform the role of subject as well as of predicate; their terms should be universal; every demonstration must involve “primary” subjects denoted by terms that “cannot be said of another underlying subject”. Several interpreters, inspired by theses from the Categories, believed that this third requirement refers to names and descriptions of particular substances as basic subjects of predicative statements, since they (...) cannot perform the logical role of predicate. However, such reading puts the third requirement in conflict with the other two. I shall argue that this interpretation is wrong and that the third requirement does not assign to singular terms the function of basic subjects of scientific discourse, but rather acknowledges that substantial predicates have a certain prerogative to occur in denoting phrases. Consequently, Aristotle’s three demands turn out to be compatible with one another. (shrink)

The author analyzes the interpretation of Boethius’ “timelessness solution” developed in contemporary Analytic Philosophy of Religion, and the main objections that have been moved to it, trying to draw some conclusions about its effectiveness (a) in solving the antinomy between omniscience and human freedom; (b) in weakening the argument of Open Theism. La nuova prospettiva teoretica proposta dall’Open Theism impone un approfondimento e una rivalutazione delle soluzioni “classiche” all’antinomia tra onniscienza divina e libertà umana. Tra queste “soluzioni” vi è, com’è (...) noto, quella di Boezio, ripresa e resa più sofisticata da molti autori nel dibattito contemporaneo, all’interno della filosofia analitica della religione. L’Autore intende analizzare, quindi, l’interpretazione della timelessness solution sviluppata in tale contesto e le principali obiezioni che le sono mosse, cercando di tracciare alcune conclusioni circa la sua efficacia nel risolvere l’antinomia e nell’indebolire le tesi dell’Open Theism. Inside it, were compared many authors and many “solutions”. One of these is the one that is inspired by Ockham’s thought. The author, therefore, aims to present the main theoretical nodes of this solution, following the development that it has had in the various publications about this question. Il saggio esamina la produzione musicale dell'ultimo trentennio alla luce degli accadimenti più importanti che hanno caratterizzato la recente storia del mondo globalizzato. La molteplicità di proposte offerte dalla scena musicale contemporanea, nei campi popular, 'classica' e jazz, presenta caratteristiche di livellamento estetico e produttivo nonché di reciproca contaminazione e meticciato frutto dell'esaurirsi di una progettualità lineare e chiara sostituita dall'accavallarsi di esperienze individuali, provvisorie e superficialmente seducenti il cui scopo primario è da un lato la comunicazione, dall'altro la conquista (...) del mercato attraverso sconfinamenti e ibridazioni in grado di sollecitare estemporaneo quanto effimero interesse. Il saggio propone una periodizzazione del manifestarsi di questo fenomeno segnata da alcuni eventi epocali, sul piano storico, sociale ed economico che in parte hanno influito sulla produzione musicale del periodo in esame, in parte ne sono stati anche una conseguenza. Al crollo del muro di Berlino del 1989 non è estranea la diffusione globale, tramite emittenti televisive, della popular music di stampo occidentale con messaggi nell'ambito del consumismo e delle libertà individuali che hanno sollecitato lo spirito di omologazione delle giovani generazioni delle nazioni del blocco dell'est; l'estinguersi della guerra fredda a sua volta ha favorito il superamento di ideologie e di programmi estetici formalizzati in favore di libere quanto 'anarchiche' manifestazioni della creatività. A seguito di altri snodi epocali quali il crollo delle Twin towers (2001) e quello del sistema finanziario internazionale (2008) la produzione musicale ha intensificato l'esplorazione di inediti percorsi creativi ed il superamento di confini stilistici e produttivi a compensazione dello smarrimento di linee guida organiche e coerenti ed in risposta alla cresciuta domanda di un uso compulsivo dell'ascolto musicale sollecitato dalle recenti tecnologie digitali. This work proposes an interpretation of Euthydemus 283c-288b taking into account the problem of the false in the Sophist. My hypothesis will be that the second eristic demonstration of the Euthydemus can be understood as a representation of Sophist 236d-239b: while in this passage there it is the Stranger is the one who states what the sophist would say to defend himself from the seventh definition, in which he is accused of producing falsehoods, in the Euthydemus two sophists are who (...) use the notions of non-being and falsehood to refute such accusation. The work has three parts. Firstly, I shall analyze Sophist 236d-239b and contextualize it within the framework of the seventh definition. Secondly, I focus on the characterization of Euthydemus and Dionysodorus as sophists. Finally, I analyze the three arguments that organize the second demonstration of the Euthydemus, trying to understand its structure and its role in the drama of the dialogue. (shrink)

From an historical point of view, the Italian reception of Whitehead’s philosophy of religion turns out to be defective and the last translation of Process and Reality is the occasion to fill these gaps. The evaluation of Whitehead’s position in the field of analytical philosophy of religion, the right contextualization of his thought and a critical interpretation of the fifth part of Process and Reality show that regarding Whitehead only as the father of process theology is rather reductive and even (...) misleading. His legacy grows more fruitful considering the recent development of analytic philosophy of religion, with peculiar reference to his reflections on religious language and evil. (shrink)

We define a system IR of first-order intuitionistic relevant logic. We show that intuitionistic mathematics (on the assumption that it is consistent) can be relevantized, by virtue of the following metatheorem: any intuitionistic proof of A from a setX of premisses can be converted into a proof in IR of eitherA or absurdity from some subset ofX. Thus IR establishes the same inconsistencies and theorems as intuitionistic logic, and allows one to prove every intuitionistic consequence of any consistent set of (...) premisses. (shrink)

In the past few years, there has been an increase in the number of cases in which OSSs have been abused, mostly by the authorship, either through the creation of fake identities or the use of false e-mail accounts. Although the (...) abusive or fraudulent authors are at fault in such cases, the fact that such cases remained undetected for so long is of concern. Moreover, the current OSSs are imperfect, have security issues and may not be able to detect false information, except through post-submission verification. Sting operations, which involve the submission of false manuscripts with false identities and false affiliations, are no less unethical, and those who abuse the publishing protocol deserve to be as reprimanded as those who abuse OSSs. It is sometimes said that there are two, competing versions of W. V. O. Quine’s unrelenting empiricism, perhaps divided according to temporal periods of his career. According to one, logic is exempt from, or lies outside the scope of, the attack on the analytic-synthetic distinction. This logic-friendly Quine holds that logical truths and, presumably, logical inferences are analytic in the traditional sense. Logical truths are knowable a priori, and, importantly, they are incorrigible, and so immune from revision. The other, radical (...) reading of Quine does not exempt logic from the attack on analyticity and a priority. Logical truths and inferences are themselves part of the web of belief, and the same global methodology applies to logic as to any other part of the web, such as theoretical chemistry or ordinary beliefs about ordinary objects. Everything, including logic, is up for grabs in our struggle for holistic confirmation. The purpose of this paper is to examine the law of non-contradiction, and the concomitant principle of ex falso quodlibet, from the perspective of the principles advocated by the radical Quine. I show that he has no compelling reason to accept either of these. To put it bluntly, neither the law of non-contradiction nor the rule of ex falso quodlibet is empirically confirmed, and these principles fare poorly on the various criteria for theory acceptance on the methodology of the radical Quine. So the radical Quine is led rather quickly and rather directly into something in the neighborhood of Graham Priest’s dialetheism. (shrink)

Paraconsistent dialetheism is the view that some contradictions are true and that the inference rule ex falso quod libet is invalid. A long-standing problem for paraconsistent dialetheism is that it has difficulty making sense of situations where people use locutions like ‘just true’ and ‘just false’. Jc Beall recently advocated a general strategy, which he terms shrieking, for solving this problem and thereby strengthening the case for paraconsistent dialetheism. However, Beall’s strategy fails, and seeing why it fails brings into (...) greater focus just how daunting the just-true problem is for the dialetheist. (shrink)

The paper generalises Goldblatt's completeness proof for Lemmon–Scott formulas to various modal propositional logics without classical negation and without ex falso, up to positive modal logic, where conjunction and disjunction, andwhere necessity and possibility are respectively independent.Further the paper proves definability theorems for Lemmon–Scottformulas, which hold even in modal propositional languages without negation and without falsum. Both, the completeness theorem and the definability theoremmake use only of special constructions of relations,like relation products. No second order logic, no general frames (...) are involved. This paper is an attempt to solve the following problem: given a logic, how to turn it into a paraconsistent one? In other words, given a logic in which ex falso quodlibet holds, how to convert it into a logic not satisfying this principle? We use a framework provided by category theory in order to define a category of consequence structures. Then, we propose a functor to transform a logic not able to deal with contradictions into a paraconsistent one. (...) Es un hecho natural que la vida no puede ser suspendida, al contrario de los juicios. Admitimos que tenemos que decidir en la vida, y que nos movemos o tenemos impulsos hacia las cosas. Por ello, actuamos de una manera o de otra, sirviéndonos y prestando cierta validez a impresiones de nuestros sentidos, frente a otras que no nos merecen confianza. Esto es lo que quiere decir Sexto, cuando advierte que el escéptico tiene un criterio no para distinguir lo verdadero (...) de lo falso, sino para conducirse en la vida. En este artículo queremos defender que las diferencias entre los diversos tipos de filosofías, y hasta de escepticismos, se producen más en el plano gnoseológico que en el práctico. Es más, defendemos que, en la mayoría de las ocasiones, no actuamos con principios establecidos, actuamos con cierto escepticismo “socializado” que todos activamos, dejándonos convencer con los datos que tenemos, de manera relativa, asimilando que lo probable o lo plausible o lo razonable en cada situación decide que actuemos en una dirección u otra, y todo presidido por lo que se nos aparece, por el fenómeno. Quella del Guzzo ~una intelligenza aperta e comprensiva, ma che non smarrisce in un sincretismo venato di scetticismo il discrimen trail vero ed il falso, la gerarchia dei valori intellettuali e morali. Egli tratteggia in un arguto viaggio immaginario lo stato dell'Italia aecademica ai principi del secolo, illustrando i fermenti complessi e molteplici che s'agitavano in quella che si suol rappresentare come una eultura positivistica piatta ed informe. Comunque eceo emergere in polemica battagliera e mordace contro di essa la figura dl Benedetto Croce, che le contrappone un hegelismo interpretato alquanto unilateralmente. I1 Guzzo sagacemente lumeggia la grande opera di rinnovamento culturale operata dal grande meridionale e tenta di illuminarne lo spirito profondo riportandosi alla testimonianza, --ch'~ poi un'interpretazione-- di uno dei mlgliori discepoli: Carlo Antoni. Secondo quest'ul- BOOK REVIEWS 139 timo Croce avrebbe avuto coscienza dell'abissale differenza tra lo Spirito universale e l'uomo transeunte. ​In risposta all’ipotesi di estendere la categoria del falso valutativo alle motivazioni di una sentenza, l’articolo tenta una ricostruzione critica della progressiva apertura del falso intellettuale ad atti dispositivi e giudizi tecnici, ponendone in evidenza alcune aporie e proponendo specifici temperamenti. Tanto la teoria dei fatti psichici, quanto quella delle attestazioni implicite e del vero legale, nella loro congiunta sovrapposizione alla struttura della fattispecie penale, possono scadere in una violazione del divieto di analogia in materia penale. In response to the hypothesis of extending the category of "evaluative" falsehood to the motivations of a judicial decision, the paper attempts a critical reconstruction of the progressive evolution of these crimes in matter of acts of will and technical judgments, highlighting some aporias and proposing some corrections. Both the theory of psychic facts, as well as the theory of implicit attestations and the legal truth, in their joint action, can violate the prohibition of analogical interpretation in criminal matters. The controversial case from which the analysis starts concerns a public competition for a university professorship and the T.A.R.’s judgment that decides on a candidate's appeal. (shrink)

Pretende simplesmente esclarecer a versão de Russell quanto ao atomismo lógico, apresentando a sua teoria do juízo empírico num contexto histórico. A maior parte dos comentários contemporâneos falham neste ponto; contudo, afigura-se impossível compreender perfeitamente a teoria de Russell aeerca do conhecimento, bem como a Teoria das Descrições, como parte integrante daquela teoria, se não for encarada como uma tentativa para evitar (...) as consequencias de certas teorias alternativas do juízo. Pensa o autor que muitas críticas contemporâneas da Teoria das Descrições estão deslocadas, simplesmente por não conseguirem apreender o papel que aquela teoria devia desempenhar na análise russelliana do juízo empírico. A título de exemplo tenta o autor mostrar como as críticas de P. F. Strawson a respeito da Teoria das Descrições, como foram formuladas no seu artigo On Referring, não vêm a propósito (cf. Secção VT). A principal comparação histórica aqui apresentada refere-se à teoria idealista do juízo de F. H. Bradley. Contudo, parece também importante salientar o acordo que existe entre Russell e Bradley quanto a rejeitar como inadequado o tipo de análise do juízo apresentado por Leibniz e, numa primeira etapa da sua carreira, por G. E. Moore. Leibniz e Moore apresentaram, em moldes diversos, aquilo a que podíamos chamar teorias 'essencialmente genéricas' do juízo. Para Leibniz uma proposição é uma conexão analitica de conceitos, para Moore uma proposição é uma conexão sintética de conceitos. Tanto Russell como Bradley afirmam que é impossível formular uma teoria do juízo satisfatória, se concebermos a relação entre uma mente e uma proposição, implicada no juízo, como uma simples conexao de conceitos. O juízo deve ser apresentado como algo que implica experiência imediata pré-conceitual, experiência essa que, embora em si mesma não seja capaz de verdade ou falsidade, está pressuposta na própria possibilidade de qualquer juízo, verdadeiro ou falso, acerca da realidade. Dum modo geral, podíamos dizer que um juízo, cujo conteúdo é conceitual, é em virtude da experiência imediata que 'atinge a realidade' ('reaches right up to reality'). Contudo, embora Russell e Bradley concordem neste ponto, a análise da experiência imediata apresentada pelo primeiro é muito diferente da do segundo. Como Carnap, mas diferentemente de Quine, Peirce considera que o conhecimento científico reside em princípios lógicos que devem se sustentar para que o discurso sobre o verdadeiro e o falso tenha sentido. Ele também compartilha a visão de Carnap de que esses princípios são anteriores à, e independentes das constatações nas ciências naturais, uma visão que Quine notoriamente rejeita. Todavia, como Quine, mas (...) diferentemente de Carnap, Peirce insiste que não há conhecimento além daquele que é obtido por meio de testes empíricos, que as verdades da lógica estão epistemologicamente a par das verdades descobertas nas ciências naturais, e que nos revelam algo sobre como as coisas são, em vez de carecerem de conteúdo fatual, como Carnap afirma. In this paper I offer an account of the meaning of must and can within the framework of possible worlds semantics. The paper consists of two parts: the first argues for a relative concept of modality underlying modal words like must and can in natural language. I give preliminary definitions of the meaning of these words which are formulated in terms of logical consequence and compatibility, respectively. The second part discusses one kind of insufficiency in the meaning definitions given in (...) the first part, which arise from the ex falso quodlibet paradox of logical consequence. In stepwise fashion, I make an attempt to avoid most of the consequences of this paradox for the meaning definitions of must and can. (shrink)

ABSTRACT In “Die Verneinung”, Frege discusses two types of negation, a semantic one and a pragmatic one. Semantic negation consists in the application of the logical function denoted by ‘it is false that p’ to a thought, and pragmatic negation in the act of asserting or judging a thought as false. According to the standard interpretation, Frege does not acknowledge pragmatic negation, because it is logically redundant. He therefore rejects the classical dualistic view that both truth and falsity are qualities (...) of judgement and adopts instead the monistic view that to judge is always to recognize a thought as true. My aim in this paper is to show that this interpretation cannot be sustained. Though Frege does not endorse the classical view, he defends a dualistic conception that is characterized by the claim that judging is a binary operation that contains both the act of recognizing a thought as true and the act of rejecting the opposite thought as false. To make this interpretation plausible, Frege’s dualistic remarks on negation in three posthumous writings, which have received little attention so far, are analyzed in detail and their background is reconstructed. It is argued that Frege acknowledges negative judgements to account for the epistemic role of the act of judgement in the acquisition of knowledge. In addition to post-Enlightenment critiques of religion, the constitutional separation of church and state, and the retreat of religion resulting from, in Darwin’s words, “the gradual illumination of men’s minds” by advances in science, globalization’s world-transforming integration of individuals from diverse religious backgrounds into communities of shared interest and concern are further weakening the confidence with which any particular religious tradition may claim to possess absolute truth and, even more, fostering transreligious conversation and the formation of a postmetaphysical spiritual culture.The future of religion, writes Vattimo in Vero e falso Universalismo cristiano, lies not in “seeking the triumph of one faith over the others.” Rather we must “rediscover—after the ‘metaphysical’ age of absolutisms and of the identity between truth and authority—the possibility of a postmodern religious experience in which the relation with the divine is no longer corrupted by fear, violence, and superstition” (p. 26). We know all to well the horrific costs of failing to accomplish this goal, and today the union of religious absolutisms and weapons of mass destruction make our failure potentially catastrophic.In his introduction, “A Religion without Theists or Atheists,” Zabala notes that Rorty and Vattimo present a way of thinking beyond the ontotheological tradition that “consists of weakening and dissolving the ancient European concept of ‘Being’ and the very idea of ‘ontological status.’ This new, weak way of thought not only opens up alternative directions, it also recovers tradition: the relationship between the believer and God is not conceived as power-laden but as a gentler relationship, in which God hands over all his power to man” (p. 3). In the “Age of Interpretation” neither science, nor philosophy, nor religion enjoys epistemological or ontological authority over the other. The resulting “Gadamerian culture of dialogue,” which understands that “all positions are equally ‘valid’ because ‘of the lack of confidence in truth’ constitutes the greatest success obtained by the deconstruction of metaphysics” (p. 11). After metaphysics, “postmodern man, no longer needful of the extreme, magical reassurance supplied by the idea of God, accepts the probably that history is not on his side at all and that there is no power capable of guaranteeing him the happiness he seeks” (ibid.). Living without metaphysical foundations means affirming our ontological historicity, epistemological insecurity, and existential finitude. In this paper, I criticize Mark Sainsbury's proposal concerning the semantic analysis of fictional discourse, as it has been put forward in chapter 6 of his Reference without Referents. His main thesis is that fictional names do not refer, and hence statements containing them are genuinely false and must be interpreted in terms of true paraphrases, arrived at on a case-by-case basis. In my opinion, the proposal has a problem derived from the fact that the relation between some problematic examples (...) -"Holmes is a detective", "Tony Blair admires Holmes"- and their suggested paraphrases needs to be clarified and further elaborated. /// En este artículo analizo críticamente el análisis semántico de los enunciados que contienen nombres de ficción propuesto por Mark Sainsbury en el capítulo 6 de su libro Reference without Referents. I believe that, for this very reason, Camporeale engaged with Valla (to whom he devoted most of his scholarly work): because the latter had, with extraordinary lucidity, raised issues and proposed solutions in perfect keeping with his own essential needs.Naturally, arriving at such a perception of the innovativevalue and ideological depth of Valla's thoughtinvolved far more than this. We are indebted to Camporeale for having developed the lesson of his mentor, Eugenio Garin: that is, the view that—against the interpretive limitations widely heldby other scholars and other schools—Lorenzo Valla was not onlythe excellentphilological emender of Livy's text, nor simply the "grammarian" restorer of the Latin language, but that such tangible gifts and capacities were sustained by more general philosophical motives and by an organic project of cultural refounding, that would challenge established categoriesin all fields, from language to history to theology.Camporeale was thus able to identify—beginning with his distinguished book published in 1972, Lorenzo Valla. And yet, Camporeale correctly identifies a peculiar and intrinsic unity in these works, namely the effort to rediscover an authentic Christianity: an authentic "form" of the church on the one hand, and an authentic "form" of Christian theology on the other.I will start with, and devote special attention to, the Encomion sancti Thomae. Camporeale correctly recognized this short text as Valla's "spiritual testament," not only, or not so much because it is his last piece of writing (he died a few months after the Encomion), but because, in a few dense but clear pages, it sums up Valla's entire logico-linguistic program and, consequently, his stance on the expressive potentialities of human language, up to the highest levels of the expressible, those of metaphysics and of theology. The way Camporeale develops his considerations on the "panegyric" is admirable, as he supports it with the experienced philosophical and theological competence (in the history of theology, and especially Thomistic theology) that he, as a Dominican, mastered so well. A particularly privileged position has been (...) reserved for the ars rhetorica, which, considered in its “purely formal instrumentality,” has been treated as though immune from ideological contamination. 1 The fear of becoming entangled in matters of ideological interpretation may, in turn, give rise to new and more seriously flawed readings. Although this is a matter which I shall not now emphasize, it should be clear that when the interpretation of a text is limited to its “purely formal instrumentality,” the vacuum that results can be filled more easily with matter that is new and different. Ideology chased from the doorstep may yet sneak in through the window, sometimes completely stripped of its real historical context. However, what is more important to note here as a premise to my discussion is that, along with the formalism already referred to, one finds in recent studies a tendency to diminish or minimize the significance of writings that were celebrated by the historical traditions of the last century and felt to belong to a shared cultural, religious, or political legacy.Among such writings the De falso credita et ementita Constantini donatione of Lorenzo Valla has certainly played an important part, beginning at least with the clamor that was raised on its behalf by Ulrich von Hutten and Martin Luther. Yet it is quite typical that the work’s most recent [End Page 79] editor, who has dedicated much careful research to Valla’s treatise and its reception, should have attempted to disconnect the meaning of Valla’s treatise in its own time from the influence it would later have, concluding that “the influence [of Valla’s work] manifested itself in accents quite different from those that have resulted from [current] interpretation.” 2 In the view of this scholar, at the time of the composition of Valla’s work, Constantine’s alleged “donation” was no longer a matter of contemporary relevance; rather, it furnished the theme for a brilliant exercise in legal rhetoric. He writes: “By then the Donation of Constantine was no longer an urgent theme for political theory. (Die Konstantinische Schenkung war damals kein beherrschendes Thema der politischen Theorie mehr.)” 3My discussion takes its cue from this point. Scholars have rightly seen the De falso credita et ementita Constantini donatione (1440) as one of Valla's earliest attempts to apply the principles of Quintilian's rhetoric to textual scholarship. Valla followed Quintilian (...) both in the structure of his arguments against the authenticity of the actions described in the Donation, as well as in the critical tools that he employed while attacking the language found in the text itself.1 In his use of philology and grammar as analytical tools and in his perception that historical development was reflected by changes in linguistic style and word meaning, Valla closely followed Quintilian.2 [End Page 55]The scholarly methodology employed in this work helped Valla lay the foundations for his radical reorientation of the ars rhetorica in which he established philology, grammar, and historical perspective as essential components of his textual scholarship. Using the principles of rhetoric that Quintilian laid out in his Institutio oratoria, Valla sought to broaden the scope of humanist critical activity and present humanists with several key elements with which to engage in linguistic and textual studies.3 The significance of what he had accomplished was clear to the Roman humanist. In December 1443 he boasted to Giovanni Aurispa that "I have never written anything more oratorical than my oration" on the Donation of Constantine.4 Valla here expressed his belief that his treatise had succeeded in incorporating the strictures and theories espoused in Quintilian's work into a viable humanist program of textual and linguistic scholarship.Valla's De Constantini donatione is of undeniable importance for understanding his early development as a humanist textual critic and language philosopher. But what has escaped most historians is the oration's problem of methodology, and the deficiencies of philology and grammar as tools of textual criticism in this work. To put it bluntly, scholars, while focusing on the promising innovations found there, have consistently ignored what by later standards would be considered the serious methodological flaws in Valla's treatise. The Vallian ars rhetorica as articulated in this work by no means presented a model from which later humanists would derive the foundations of modern textual criticism. By the late fifteenth and early sixteenth centuries, textual scholars had shown the inadequacies of the methodology Valla employed in this treatise. In fact the best humanist scholars of the period approached the task of textual criticism and manuscript emendation using procedures that were essentially at odds with the philological, grammatical critique used in this work.5While most modern historians have overlooked the scholarly shortcomings of Valla's treatise, the sixteenth century produced one critic who raised serious questions about the scholarship underlying the critique of the Donation. Twice in his lifetime, the Italian humanist Agostino Steuco (1497-1548) [End Page 56] published significant replies to Valla. First in his Pro religione christiana adversus Lutheranos (1530), and then in his Contra Laurentium Vallam de falso donatione Constantini libri duo (1547), Steuco raised substantial objections to a number of Valla's philological, grammatical, and historical arguments against the authenticity of the edict.6In each treatise Steuco's textual scholarship on the Donation formed part of a larger effort on his part to defend the cultic practices, institutions, and hierarchy of the late medieval church against the reformers. As he made clear in both works, he believed that Valla's attacks upon the papacy and Donation put him in league with Luther and Erasmus in undermining respect for the papacy in the early sixteenth century. Pretopologies were introduced in [S], and there shown to give a complete semantics for a propositional sequent calculus BL, here called basic linear logic, as well as for its extensions by structural rules,ex falso quodlibetor double negation. Immediately after Logic Colloquium '88, a conversation with Per Martin-Löf helped me to see how the pretopology semantics should be extended to predicate logic; the result now is a simple and fully constructive completeness proof for first order BL and virtually all its (...) extensions, including the usual, or structured, intuitionistic and classical logic. Such a proof clearly illustrates the fact that stronger set-theoretic principles and classical metalogic are necessary only when completeness is sought with respect to a special class of models, such as the usual two-valued models.To make the paper self-contained, I briefly review in §1 the definition of pretopologies; §2 deals with syntax and §3 with semantics. The completeness proof in §4, though similar in structure, is sensibly simpler than that in [S], and this is why it is given in detail. In §5 it is shown how little is needed to obtain completeness for extensions of BL in the same language. While this circularity makes so-called sourcing-arguments fallacious if applied against moral sentimentalism, moral cognition research has much to contribute. Indeed, moral cognition research will be instrumental for clarifying the sentimentalist position, shedding light on the mental mechanics underlying emotional moral processing. After all, evidence from moral cognition points to substantial involvement of affective processes in human moral cognizing and their embodied nature; thus, challenging long held beliefs about morality. L’errore degli argomenti basati sulla cognizione morale contro il sentimentalismo morale Riassunto: Si è spesso ritenuto che la ricerca nell’ambito della cognizione morale costituisse, almeno in parte, un problema per il sentimentalismo morale, il quale sostiene che le emozioni sono sensibili all’informazione morale. In particolare, si può pensare che Joshua Greene abbia portato un argomento contro il sentimentalismo morale basato su evidenza neuropsicologica. Secondo il suo argomento le emozioni non costituiscono una fonte affidabile di comprensione morale. E tuttavia questo argomento fa leva su una circolarità: gli unici fattori qualificati come moralmente rilevanti sono quelli razionali; le emozioni non sono sensibili a questi fattori; pertanto, considerato che solo i fattori razionali sono giustificati, il sentimentalismo morale è falso. Tale circolarità rende fallaci i cosiddetti argomenti sorgente, laddove questi siano applicati al sentimentalismo morale. Al contempo, la ricerca sulla cognizione morale ha molto da dire su questo argomento perché può contribuire a chiarire la posizione sentimentalista, gettando luce sulla meccanica mentale sottostante i processi morali che fanno leva su emozioni. Anzi questa prospettiva di ricerca evidenzia che i processi di carattere affettivo sono coinvolti in maniera sostanziale nella cognizione morale umana e hanno una natura incarnata; in questo modo essa mette in discussione convinzioni di vecchia data sulla morale. I suoi Saggi danteschi e, in particolare, Il falso problema di Ugolino, consentono di rintracciare alcuni degli aspetti più pregnanti del legame che Borges stabilisce tra sé e lo scrittore toscano e di fare luce su alcuni dei principi chiave che guidano la poetica borgesiana. In particolare, l’episodio di Ugolino e, più precisamente, il verso , in cui Dante trasmette (...) l’eterna oscillante immagine di Ugolino [che] divora e non divora gli amati cadaveri, costituisce per Borges una delle massime espressioni di un principio estetico fondamentale per la propria poetica: la capacità di esprimere i fatti tramite allusioni – evitando quindi di limitarne le possibili infinite biforcazioni – piuttosto che attraverso la mera esposizione circostanziata.
