In recent years, the rights of patients have assumed a more pivotal role in international discussion. Stricter laws on the protection of patients place greater priority on the perspective and the status of patients. The purpose of this study is to emphasize ethical aspects in communication, the role of patient advocates as contacts for the concerns and suggestions of patients, and how many problems of ethics disappear when communication is highlighted. We reviewed 680 documented cases of consultation in a 10-year (...) period of patient advocates’ activity at a big German university hospital with 1,300 beds. On the basis of this extensive material, the article will focus on the intersection of the advocate’s work with the problems of patients in hospitals. Deficits in the level of communication between health care professionals and patients were frequently uncovered. Patients primarily complain about the lack of dialogue and empathy. Middle-aged patients consulted the patients’ advocate disproportionately more often. Measured against this baseline, the group of 65 and older complained less frequently. Besides complaints the advocate was asked in more than one-third of all cases for information about medical matters, hospital regulations or administrative problems. Patients obviously see the advocate as a well-connected and ideally unbiased contact person for uncertainties concerning their malady or a potential stay in hospital. Those seeking help often set hope in the information given by the voluntary patient representative. It should be highly recommended for every German hospital to establish the position of a patient advocate. Furthermore, patients can profit from regular exchange between the advocate and the Ethics Committee, also, to help ensure that their rights are taken into account and implemented in an ethically desirable context. Das Nichtwissen ist in aller Munde. Von Nichtwissenskulturen in der zweiten oder reflexiven Moderne ist die Rede, von Agnotologie als neuem Forschungszweig, von wicked problems und ihren clumsy solutions. Wo Nichtwissen sich durch Komplexitäts­steigerung unwiderruflich im zu Wissenden einnistet, fordert es als Grenze, Schranke und Kehrseite des Wissens die sogenannte Wissensgesellschaft heraus. Vor allem Risiko­poten­ziale und Gefahren kommen hier in den Blick, von denen wir gerade genug wissen, um Wissensansprüche zu formulieren, die sich womöglich nie einlösen lassen. Das klassisch erkenntnistheoretische (...) Problem: „Was können wir wissen?“ steht heute in einem Spannungsverhältnis zu der wissenspolitischen Frage: „Was müssen wir wissen?“ Was wir wissen müssen, ist einerseits so viel wie nötig, wenn es um Fragen von Sicherheit und Gesundheit geht – andererseits aber so wenig wie möglich, wenn es in Alltag, Wirtschaft oder Wissen­schaft darauf ankommt, Wissen an technische Systeme oder Expertenkulturen zu delegieren. Bezeichnet politisch handlungsorientiertes und wissenschaftliches Nichtwissen zunächst ein Defizit, ist technisches Nichtwissen gleichermaßen erstrebenswert und problematisch. Einige, die Technik für angewandtes Wissen halten, mögen darin eine contradictio in adjecto sehen, manche sich um eine dem technischen Nichtwissen geschuldeten Technik­feindlichkeit sorgen, andere daraus die nötige Demut gegen verstiegene Allmachts­fantasien beziehen, während ihre Gegenspieler von Maschinen träumen, die über den Horizont intellektueller Nachvollziehbarkeit immer weiter hinauseilen. Spiel und Arbeit gelten oft als Gegensätze: Das Spiel als freie Betätigung menschlicher Vermögen, die Arbeit als deren Subordination unter einen äußeren Zweck. Die Festlegung des Spiels auf konsequenzlose Wiederholbarkeit hat ihm den Ruf des Unernsten eingetragen, während das Abzwecken der Arbeit auf die Nützlichkeit ihres Resultats im Bund mit der Sorge ums Dasein steht. Auf einen zweiten Blick scheint dieser Gegensatz jedoch, gerade in den hochentwickeltsten Ausprägungen beider Tätigkeitsformen, zu verschwinden. So kann eine hochgradige Rationalisierung von Spielpraktiken in Arbeit (...) umschlagen, wie etwa im Leistungssport, oder ein komplexer Arbeitsvorgang selbstzweckhafte Momente und Eigendynamiken gewinnen, die ihm Spielcharakter verleihen. Auch andere technologische Entwicklungen geben Anlass dazu, das Verhältnis von Spiel und Arbeit noch einmal grundsätzlich zu bedenken, etwa im Hinblick auf: adaptive Systeme in der Robotik, serious games, Kreativitätstechniken in Unternehmenskulturen, wissenschaftliche Experimentalanordnungen, Online-Rollenspiele oder die Kommodifizierung nicht-zweckrationaler Lebensvollzüge, die traditionell vom Begriff produktiver Arbeit ausgeschlossen waren – einschließlich der Spielräume, die durch neue Umwelt- und Biotechniken erschlossen werden. Die Beschaffenheit der jeweils zum Einsatz kommenden Mittel und Verfahren sowie die Setzung, Variation oder Preisgabe von Zwecken können den Charakter von Spiel und Arbeit sowie ihr Verhältnis zueinander bestimmen oder verändern. El artículo examina la presencia de Friedrich Nietzsche a finales del siglo XX en Colombia, especialmente el periodo 1990-2010, a partir de varios presupuestos de la Historia social de la filosofía (HSF) y del enfoque genealógico planteado por el filósofo alemán. Para dar cuenta del anterior objetivo se establecen tres momentos. En el primer apartado I. Nietzsche y la Historia social de la filosofía, se analizan varios presupuestos de la HSF a partir de los cuales se señalan aspectos característicos (...) del periodo 1990-2010. En el segundo apartado II. Edgar Garavito y la filosofía del transcurso, se destaca el trabajo del filósofo colombiano Edgar Garavito, en especial su obra La transcursividad. Crítica de la identidad psicológica como un vector fundamental de la clave interpretativa “postestructuralista” de Nietzsche. Finalmente, en el tercer apartado III. Otros devenires de Nietzsche, se destacan algunos trabajos de Jaime Toro y Víctor Florián, filósofos colombianos que han hecho tanto lecturas como usos otros del pensador alemán. (shrink)

The notion of being a burden to others is mostly discussed in the context of care‐intensive diseases or end‐of‐life decisions. But the notion is also crucial in decision‐making at the beginning of life, namely regarding prenatal testing. Ever more sophisticated testing methods, especially non‐invasive prenatal testing (NIPT), allow the detection of genetic traits in the unborn child that may cause disabilities. A positive result often influences the decision of the pregnant women towards a termination of the pregnancy. Thus, critics claim (...) that these testing methods send a negative message to people with disabilities. At the core of this is what we call the burden assumption. This assumption claims that children with disabilities are necessarily a burden to others, especially to their parents and other family members. In this paper, we discuss what being a burden to others means in this context and how such an attitude can be avoided without restraining reproductive autonomy. A closer examination shows that the burden assumption is mostly based on misinformation and a false model of disability. Empirical studies as well as narrative evidence from parents who raise a child with disabilities show that the burden assumption is wrong. Raising a child with disabilities does not necessarily mean a decrease in the quality of life. We show how the burden assumption can be challenged through an advanced genetic counselling that combines empirical evidence with narratives from a first‐person perspective. (shrink)

This book offers a critical update of current Wittgenstein research on the Tractatus logico-philosophicus (TLP) and its relation to the Vienna Circle. The contributions are written by renowned Wittgenstein scholars, on the occasion of the "Wittgenstein Years" 1921/1922 with a special focus on its origin, reception, and interpretation then and now. The main topic is the mutual relation between Wittgenstein and the Vienna Circle (esp. Schlick, Waismann, Carnap, Gödel), but also Russell and Ramsey. In addition, included in this volume are (...) new studies on Wittgenstein's life and work, on the philosophy of the TLP, and on the Wittgenstein family in philosophical and historical context. In a 1978 lecture in Tokyo, Foucault drew a comparison between his own philosophical methodology and that of ‘Anglo-Saxon analytic philosophy’, claiming the label ‘analytic philosophy of politics’ for his own approach. This may seem like a somewhat surprising comparison given the gulf between contemporary analytic and continental philosophy, but I argue that it is a very productive one which indeed might help us reconsider this gulf. I proceed through a comparison between Foucault and the speech act theory of J. (...) L. Austin, one of the analytic philosophers Foucault had in mind in his Tokyo lecture. By focusing on the methodological commonalities between Foucault and Austin, this article identifies the core of a philosophical methodology that cuts across the analytic/continental divide in philosophy in general while constituting a powerful alternative to the methods applied by analytic political philosophers specifically. This approach, which I term ‘analytic critique’, is one that starts from a critical analysis of what happens in ordinary lived experience and theorizes ‘bottom-up’ in an avowedly politically engaged way – thereby challenging the conceptual and political aloofness of contemporary political philosophy in the liberal-Rawlsian tradition. Foucault’s appropriation of the label ‘analytic philosophy’, it is argued, ought to function as a call to more imaginative methodological-theoretical engagement across the traditional division between continental and analytic approaches. Faraday's view of the mutual relation of speculative theories and laws of nature implies that there should be a procedure, leading from speculative considerations to a system of facts and laws in which theories do no longer play any role. In order to make out the degree in which Faraday's claims correspond to his practice, the way in which he gains an explanation of Arago's effect is analyzed. The thesis is proposed that he indeed has a procedure of leaving theories (...) aside. It is intimately connected with certain methodological guidelines of his experimentation. (shrink)

The more unknowns there are and the newer a field of research is, the less well defined are the experiments. Once a field has been sufficiently worked over so that the possible conclusions are more or less limited to existence or nonexistence, and perhaps to quantitative determination, the experiments will become increasingly better defined. But they will no longer be independent, because they are carried along by a system of earlier experiments and decisions, which is generally the situation in physics (...) and chemistry today. Such a system will then become self-evident know-how itself. A lattice L is coordinatizable, if it is isomorphic to the lattice L of principal right ideals of some von Neumann regular ring R. This forces L to be complemented modular. All known sufficient conditions for coordinatizability, due first to von Neumann, then to Jónsson, are first-order. Nevertheless, we prove that coordinatizability of lattices is not first-order, by finding a non-coordinatizable lattice K with a coordinatizable countable elementary extension L. This solves a 1960 problem of Jónsson. We also prove that (...) there is no [Formula: see text] statement equivalent to coordinatizability. Furthermore, the class of coordinatizable lattices is not closed under countable directed unions; this solves another problem of Jónsson from 1962. (shrink)
