Este artículo se centra en dos cuestiones: por un lado, la presunción de libertad en el «período literario» (desde el s. VIII en adelante); y, por otro, la cuestión de la esclavización, venta o servidumbre ¿voluntaria o no¿ de personas libres en la «época preliteraria» (ss. VII y VIII). Asumiendo de partida la idea de que la práctica legal en la Antigüedad Tardía influyó en las discusiones de los primeros juristas musulmanes, trataré de reconstruir el discurso legal de los siglos (...) I/VII y II/VIII y de mostrar que ese discurso contenía interesantes opiniones legales en relación a la venta de niños, servidumbre por deudas y la situación legal de los huérfanos. En la literatura legal que emergió desde el s. II/VIII los juristas, al contrario de lo que se hubiese esperado, no trataron estas cuestiones intensamente. Tal y como se muestra, existe una cierta inconsistencia entre el discurso ameno y controvertido sobre el tema del «período preliterario», que se reconstruye en este artículo, y la marginalización del tema en la literatura legal posterior. Among critics of corporate social responsibility (CSR), there is growing concern that CSR is largely ineffective as a corrective to the shortcomings of capitalism, namely, the negative effects of business on society and the undersupply of public goods. At the same time, researchers suggest that despite the shortcomings of CSR, it is possible to make it more effective in a stepwise manner. To explain the frequent failures of current CSR practices and to explore the possibilities of remedying them, I examine (...) the close relationship between CSR, the persistent expansion of capitalism, and the pressure that capitalism puts on companies to legitimize their business operations. My analysis shows that the failure of CSR to serve as a corrective to the problematic effects of capitalism is, in fact, an inevitable consequence of the problematic dynamics of the capitalist system. On this basis, I suggest that capitalism limits the possibilities of making CSR more effective, argue for change on the systemic level of capitalism, and explore the ways in which CSR research can contribute to this political endeavor. Contemporary reasoning about health is infused with the work products of experts, and expert reasoning about health itself is an active site for invention and design. Building on Toulmin’s largely undeveloped ideas on field-dependence, we argue that expert fields can develop new inference rules that, together with the backing they require, become accepted ways of drawing and defending conclusions. The new inference rules themselves function as warrants, and we introduce the term “warranting device” to refer to an assembly of the (...) rule plus whatever material, procedural, and institutional resources are required to assure its dependability. We present a case study on the Cochrane Review, a new method for synthesizing evidence across large numbers of scientific studies. After reviewing the evolution and current structure of the device, we discuss the distinctive kinds of critical questions that may be raised around Cochrane Reviews, both within the expert field and beyond. Although Toulmin’s theory of field-dependence is often criticized for its relativism, we find that, as a matter of practical fact, field-specific warrants do not enjoy immunity from external critique. On the contrary, they can be opened to evaluation and critique from any interested perspective. (shrink)

The online space has become a digital public square, where individuals interact and share ideas on the most trivial to the most serious of matters, including discussions of controversial ethical issues in science, technology and medicine. In the last decade, new disciplines like computational social science and social data science have created methods to collect and analyse such data that have considerably expanded the scope of social science research. Empirical bioethics can benefit from the integration of such digital methods to (...) investigate novel digital phenomena and trace how bioethical issues take shape online.Here, using concrete examples, we demonstrate how novel methods based on digital approaches in the social sciences can be used effectively in the domain of bioethics. We show that a digital turn in bioethics research aligns with the established aims of empirical bioethics, integrating with normative analysis and expanding the scope of the discipline, thus offering ways to reinforce the capacity of bioethics to tackle the increasing complexity of present-day ethical issues in science and technology. The ‘cosmological constant problem’ has historically been understood as describing a conflict between cosmological observations in the framework of general relativity and theoretical predictions from quantum field theory, which a future theory of quantum gravity ought to resolve. I argue that this view of the CCP is best understood in terms of a bet about future physics made on the basis of particular interpretational choices in GR and QFT, respectively. Les données présentées sont extraites d’une étude exploratoire française portant sur le développement socio-affectif de vingt enfants élevés au sein de douze familles homoparentales. Elles portent sur la qualité des relations entre les enfants et leur parent biologique, d’une part, et leur parent non biologique, d’autre part, l’évaluation étant réalisée à la fois par les parents et par les enfants. Si la qualité des relations apparaît globalement satisfaisante, la qualité des relations enfant-parent non biologique apparaît davantage marquée par les caractéristiques (...) de l’environnement social que ne l’est la qualité des relations enfant-parent biologique. Many recent gene knockout experiments cause anatomical changes to the jaw region of mice that several investigators claim are evolutionary reversals. Here we evaluate these mutant phenotypes and the assertions of atavism. We argue that following the knockout of Hoxa-2, Dlx-2, MHox, Otx2, and RAR genes, ectopic cartilages arise as secondary consequences of disruptions in normal processes of cell specification, migration, or differentiation. These disruptions cause an excess of mesenchyme to accumulate in a region through which skeletal progenitor cells usually (...) migrate, and at a site of condensation that is normally present in mammals but that is too small to chondrify. We find little evidence that these genes, when disrupted, cause a reversion to any primitive condition and although changes in their expression may have played a role in the evolution of the mammalian jaw, their function during morphogenesis is not sufficiently understood to confirm such hypotheses. The recent alleged doping case of the figure skater Kamila Valieva at the Winter Olympic Games in Beijing 2022 dramatically raised the issue of the protection of minors in anti-doping policy. We firstly present the literature on doping in relation to minors. Secondly, we present WADA’s Protected Person (PP) concept and its implications. Thirdly, we analyse the WADA Code’s purpose and the vulnerability of minors under the Code, and fourthly, we identify the real threats from which minors should be protected (...) by analysing the ineffective PP concept, and showing how it cannot be a real protection. We explain how preventing one threat can generate another, thus converting minor athletes from victims into suspects. We conclude by stressing the necessity for further research, and we indicate our future research direction, towards the development of a much wider concept of protection, and its application into sporting contexts. Under conditions of growing interconnectedness of the global economy, more and more stakeholders are exposed to risks and costs resulting from business activities that are neither regulated nor compensated for by means of national governance. The changing distribution of risks poses a threat to the legitimacy of business firms that normally derive their legitimacy from operating in compliance with the legal rules of democratic nation states. However, during the process of globalization, the regulatory power of nation states has been weakened (...) and many production processes have been shifted to states with weak regulatory frameworks where businesses operate outside the reach of the democratic nation state. As a result, business firms have to address the various legitimacy challenges of their operations directly and cannot rely upon the legitimacy of their regulatory environment. These developments challenge the dominant approach to corporate governance that regards shareholders as the only stakeholder group in need of special protection due to risks not covered by contracts and legal regulations. On the basis of these considerations, we argue for a democratization of corporate governance structures in order to compensate for the governance deficits in their regulatory environment and to cope with the changing allocation of risks and costs. By way of democratic involvement of various stakeholders, business firms may be able to mitigate the redistribution of individual risk and address the resulting legitimacy deficits even when operating under conditions of regulatory gaps and governance failure. Currie (2019) has introduced a novel account of creativity within the social epistemology of science. The account is intended to capture how conservatism can be detrimental to the health of inquiry within certain scientific communities, given the aims of research there. I argue that recent remarks by Rovelli (2018) put pressure on the applicability of the account. Altogether, it seems we do not yet well understand the relationship between creativity, conservatism, and the health of inquiry in science.

Although emotions play a crucial role in understanding and encouraging sustainable behavior and decision-making, many open questions currently remain unanswered. In this review, we advance three broad areas of particular theoretical and applied importance that affective science and emotion researchers could benefit from engaging with: (1) “ sustainable emotions” or empirically testing the possibility of positive reinforcing feedback loops between anticipatory and experienced emotions following the adoption of sustainable behaviors, (2) “ non- Western emotions” or exploring the extent to which (...) people's understanding and experience of climate-relevant emotions differs across non-WEIRD populations, and (3) “ impactful emotions” or the need to carefully differentiate the conceptual and empirical role of emotions in encouraging the adoption of low-impact (e.g., recycling) versus high-impact (e.g., flying less) environmental behaviors. Over the last three decades, studies in microbiology have exposed a world of diverse and dynamic interactions. Through metagenomic sequencing, complex bacterial communities became visible and proved important for many biological phenomena. As a result of discovering the connection between microorganisms and organisms’ survival, the notion of the holobiont has become prominent and has been suggested as a biological individual. The view of the holobiont as an individual, commonly known as the Hologenome Theory, focuses on the interactions and relations between (...) the host and its symbionts in the host’s development and evolution. Today, the holobiont is at the heart of the debate on the nature of the biological individual, a debate which is connected to the same question about the nature of the individual organism. (shrink)

I critically discuss a controversial ‘trans-Planckian censorship’ conjecture, which has recently been introduced to researchers working at the intersection of fundamental physics and cosmology. My focus explicitly avoids any appeals to contingent research within string theory or regarding the more general gravitational ‘swampland’. Rather, I concern myself with the conjecture’s foundations in our current, well-trodden physics of quantized fields, spacetime, and gravity. In doing so, I locate what exactly within trans-Planckian censorship amounts to a departure from current physics—identifying what is, (...) ultimately, so conjectural about the conjecture. (shrink)

I examine the feminist epistemic values in science, presented by Helen Longino, and their role in framing microbiome causality in the study of inflammatory bowel disease (IBD). In particular, I show how values presented as feminist give an alternative view in scientific theories—focusing on ontological heterogeneity and mutuality of interactions rather than simplicity and one causal direction—when looking at relations between organisms and microorganisms, and between organisms (particularly humans) and their environment. I identify two approaches in microbiome study, an immunological (...) approach that looks at the microbiome pathogenicity and an ecological approach that studies the microbial activity and functions. I show the puzzles stemming from the traditional background beliefs of the immune self and germ theory in the study of IBD causality. Furthermore, I argue for the benefits of a shift to the ecological view of body-microbe interrelations. I conclude with the benefits and advantages of feminist values over traditional ones, both in creating new ways of understanding organisms’ physiology and immune systems and for future biomedical studies involving microbiome causality. Background Despite the bourgeoning of digital tools for bioethics research, education, and engagement, little research has empirically investigated the impact of interactive visualizations as a way to translate ethical frameworks and guidelines. To date, most frameworks take the format of text-only documents that outline and offer ethical guidance on specific contexts. This study’s goal was to determine whether an interactive-visual format supports frameworks in transferring ethical knowledge by improving learning, deliberation, and user experience.Methods An experimental comparative study was conducted with (...) a pre-, mid-, and post-test design using the online survey platform Qualtrics. Participants were university based early-stage health researchers who were randomly assigned to either the control condition (text-only document) or the experimental condition (interactive-visual). The primary outcome variables were learning, (measured using a questionnaire), deliberation (using cases studies) and user experience (measured using the SED/UD Scale). Analysis was conducted using descriptive statistics and mixed-effects linear regression.Results Of the 80 participants, 44 (55%) used the text-only document and 36 (45%) used the interactive-visual. Results of the knowledge-test scores showed a statistically significant difference between participants’ post-test scores, indicating that the interactive-visual format better supported understanding, acquisition, and application of the framework’s knowledge. Findings from the case studies showed both formats supported ethical deliberation. Results further indicated the interactive-visual provided an overall better episodic and remembered user experience compared with the text-only document.Conclusions Our findings show that ethical frameworks formatted with interactive and visual qualities provide a more pleasing user experience and are effective formats for ethics learning and deliberation. These findings have implications for practitioners developing and deploying ethical frameworks and guidelines (e.g., in educational or employee-onboarding settings), in that the knowledge generated can lead to more effective dissemination practices of normative guidelines and health data ethics concepts. Before examining de Moivre's contributions to the science of mathematics, this article reviews the source materials, consisting of the printed works and the correspondence of de Moivre, and constructs his biography from them. The analytical part examines de Moivre's contributions and achievements in the study of equations, series, and the calculus of probability. De Moivre contributed to the continuing development from Viète to Abel and Galois of the theory of solving equations by means of constructing particular equations, the roots of (...) which can be written in the form $$\sqrt[n]{{a + \sqrt b }} + \sqrt[n]{{a - \sqrt b }}$$. He also discovered the reciprocal equations. In the course of this work de Moivre discovered an expression equivalent to (cos α+i sin α) n =cos n α+i sin n α and, following Cotes, he succeeded in expressing the nth roots of unity in trigonometric form. In the theory of series, de Moivre developed a polynomial theorem encom-passing Newton's binomial theorem and, in particular, a theorem of recurrent series useful in the calculus of probability. The demands of the calculus of probability led de Moivre to an approximation for the binomial coefficients $$\left( {_m^n } \right)$$ for large values of n. The interaction between de Moivre and James Stirling, particularly in regard to the asymptotic series for log (n!), is treated at length. This work supplied the foundation for de Moivre's limit theorem for the binomial distribution. The calculus of probability, which occupied him from 1708 onward, became in time ever more the center of de Moivre's inquiries. Proceeding from contemporary collections of gambling exercises, de Moivre, by introducing an explicit measure of probability for the so-called Laplace experiments, found the beginnings of a theory of probability. De Moivre expanded the classic application of probability calculus to games of chance by addressing himself to the problem of annuities and by adopting Halley's work with its conception of “Probability of life”. De Moivre was the first to publish a mathematically formulated law for the decrements of life derived from mortality tables. (shrink)

Arousal is one of the dimensions of core affect and frequently used to describe experienced or observed emotional states. While arousal ratings of facial expressions are collected in many studies it is not well understood how arousal is displayed in or interpreted from facial expressions. In the context of socioemotional disorders such as Autism Spectrum Disorder, this poses the question of a differential use of facial information for arousal perception. In this study, we demonstrate how automated face-tracking tools can be (...) used to extract predictors of arousal judgments. We find moderate to strong correlations among all measures of static information on one hand and all measures of dynamic information on the other. Based on these results, we tested two measures, average distance to the neutral face and average facial movement speed, within and between neurotypical individuals and individuals with autism. Distance to the neutral face was predictive of arousal in both groups. Lower mean arousal ratings were found for the autistic group, but no difference in correlation of the measures and arousal ratings could be found between groups. Results were replicated in an high autistic traits group. The findings suggest a qualitatively similar perception of arousal for individuals with and without autism. No correlations between valence ratings and any of the measures could be found, emphasizing the specificity of our tested measures. Distance and speed predictors share variability and thus speed should not be discarded as a predictor of arousal ratings. (shrink)

The main aim of a theory of events is to propose and defend an identity condition on events; that is, a condition under which two events are identical. For example, if Brutus kills Caesar by stabbing him, are there two events, the stabbing and the killing, or only one event? Each of the leading theories of events is surveyed in (...) this article. According to Jaegwon Kim, events are basically property instantiations. In contrast, Donald Davidson attempts to individuate events by their causes and effects. However, Davidson eventually rejects this view and, together with W.V.O. Quine, individuates events with respect to their location in spacetime. What is the link between the discovery of the relativistic expanding Universe and British imperialism? A public panel debate in the early days of relativistic cosmology shows how fundamental scientific research, whether there are obvious political stakeholders (like biosecurity and climate) or not, runs real-time risks of being repurposed for political ends.

In the work of Karl Polanyi, the negative effects of a self-regulating market economy are described as being limited by societal forces such as the policies of the welfare state. With the decline of the modern welfare state since the late 1970s, social activities of business firms are increasingly regarded as an important complement to or even as a substitute for welfare state policies by a part of the literature. However, and controversially, another stream of argumentation regards these activities as (...) being aimed at advancing the reach of market forces. To fully grasp the ambiguous nature of the social activities of business, in this paper I provide an account of affirmative as well as of critical interpretations of these activities throughout the history of modern capitalism. On this basis, the power of critique to disentangle the diverse motivations that underlie the social engagement of business is highlighted as a condition for facilitating a role of business in society that balances economic and social considerations. This article discusses madness and saintliness in Dostoevsky’s novels and investigates how the madman and the saint discern between good and evil. I first explore the metaphysical, spiritual, and moral universe of Dostoevsky’s characters by drawing on William Desmond’s philosophy of the between. Second, I argue that the madman’s misconstrual of reality can be grasped as an idolatrous, divisive, and parodic imitation of the good. Third, I reflect on disembodied discernment. In some cases, due to the weakness of the moral (...) agent, the good cannot be properly embodied in space and time, even if a person exhibits ethically sound discernment. Fourth, I look at examples of holy discernment and examine how, through love, the genuinely good person is able to transform idolatry into a universal and cosmic sacramentalism. (shrink)

This paper argues that Reason Responsiveness (RR) accounts of rationality, proposed for example by Benjamin Kiesewetter and Error Lord, fail to explain structural irrationality (i.e., the irrationality involved in holding incoherent attitudes). Proponents of RR hold that rationality consists in correctly responding to available reasons. Structural irrationality, they argue, is just a “by‐product” of incorrect reason‐responding. Applying this idea to cases of means–end incoherence, this paper shows that RR accounts must rely on a certain transmission principle. Roughly, this amounts to (...) the principle that necessarily, if (1) A has decisive available reason to intend to E and (2) A has decisive available reason to believe that intending to M is necessary for E‐ing, it follows that (3) A has decisive available reason to intend to M. By considering an example, this paper argues that even the most plausible version of this transmission principle does not hold true. It follows that one can correctly respond to one's available reasons while being means–end incoherent. (shrink)

This study aims to establish ideological effects of the pre-pandemic metaphor use in the mainstream media on users’ perceptions of their relationship with technologies during the COVID-19 pandemic. To achieve that, 120 media articles from global mainstream media sources during the pre-pandemic period were collected and analysed at three levels: (1) metaphor identification; (2) deconstruction of conceptual source domains; (3) the coding of metaphorical expressions into psychological types of interpersonal relationships that are projected on technologies. The established metaphorical patterns were (...) tested in an online survey with 100 young adults and adults from Lithuania during the COVID-19 pandemic period of 2019-2020. The research findings resulted in the ideological perceptions of Reversed Agentivity and Mechanised Action characterising our relationship with technology and pointing out to the loss of individual autonomy, a lack of personal growth and more fragmented personal identity during the pandemic.
