This paper analyzes what may have been a mistake by pianist Thelonious Monk playing a jazz solo in 1958. Even in a Monk composition designed for patterned mayhem, a note can sound out of pattern. We reframe the question of whether the note was a mistake and ask instead about how Monk handles the problem. Amazingly, he replays the note into a new pattern that resituates its jarring effect in retrospect. The mistake, or better, the mis-take , was “saved” by (...) subsequent notes. Our analysis, supported by reflections from jazz musicians and the philosopher John Dewey, encourages a reformulation of plans, takes, and mis-takes as categories for the interpretation of contingency, surprise, and repair in all human activities. A final section suggests that mistakes are essential to the practical plying and playing of knowledge into performances, particularly those that highlight learning. (shrink)

This article explores the moral permissibility of sweatshop boycotts. We build explicitly on Tomhave and Vopat’s (2018) framework for evaluating the moral permissibility of boycotts in general for the specific case of sweatshop labor. We argue that sweatshop boycotts are more likely to be morally justified when targeting forced labor compared to free labor and we explore the relevant moral tradeoffs associated with boycotts of free labor sweatshops. We analyze the morality of three cases of sweatshop boycotts—Indonesia in the 1990s, (...) Bangladesh following the 2013 Rana Plaza disaster, and the Uyghur region in China—and then discuss how insights from these cases might provide a model to guide activists and business ethicists in analyzing the morality of other sweatshop boycotts. The dominant view in the cognitive science of religion (the ‘Standard Model’) is that religious belief and behaviour are not adaptive traits but rather incidental byproducts of the cognitive architecture of mind. Because evidence for the Standard Model is inconclusive, the case for it depends crucially on its alleged methodological superiority to selectionist alternatives. However, we show that the Standard Model has both methodological and evidential disadvantages when compared with selectionist alternatives. We also consider a pluralistic approach, which holds that (...) religion or various aspects of religion originated as byproducts of evolved cognitive structures but were subsequently co-opted for adaptive purposes. We argue that when properly formulated, the pluralistic approach also has certain advantages over the Standard Model. (shrink)

The precautionary principle (“the Principle”) has been widely embraced as the new paradigm for contending with biological and environmental risk in the context of emerging technologies. Increasingly, it is being incorporated into domestic, supranational, and international legal regimes as part of a general overhaul of health and environmental regulation.1 Codifications of the Principle typically are vague, with their content intentionally left for scholars to debate, decision makers to interpret, and the courts to flesh out through case law. Affective variables have been shown to impact working memory and cognitive control. Theoretical arguments suggest that the functional impact of emotion on cognition might be mediated through shifting action dispositions related to changes in motivational orientation. The current study examined the effects of positive and negative affect on performance via direct manipulation of motivational state in tasks with high demands on cognitive control. Experiment 1 examined the effects of monetary reward on task-switching performance, while Experiment 2 examined the effects of (...) both rewards and punishments on working memory, using primary (liquid) reinforcers. In both experiments, dissociable trial-by-trial and contextual (block-related) enhancements of cognitive control during task performance were observed in relationship to motivational incentive value. Performance enhancements were equivalent in the reward and punishment conditions, but were differentially impacted by individual difference measures of trait reward and punishment sensitivity. Together, the results suggest both common and specific mechanisms by which approach and avoidance motivational states influence cognitive control, via activation of reward and punishment processing systems. Older adults in the United States have been the age group hardest hit by the Covid pandemic. They have suffered a disproportionate number of deaths; Covid patients eighty years or older on ventilators had fatality rates higher than 90 percent. How could we have better protected older adults? Both the popular press and government entities blamed nursing homes, labeling them “snake pits” and imposing harsh fines and arduous new regulations. We argue that this approach is unlikely to improve protections for (...) older adults. Rather than focusing exclusively on acute and critical resources, including ventilators, a plan that respected the best interests of older adults would have also supported nursing homes, a critical part of the health care system. Better access to protective equipment for staff members, early testing of staff members and patients, and enhanced means of communication with families were what was needed. These preventive measures would have offered greater benefit to the oldest members of our population than the exclusive focus on acute care. (shrink)

The United States has recently made significant and positive civil rights gains for LGB people, including expanded recognition of marriages between people of the same sex. Among the central tropes that have emerged in the struggle for the rights of LGB people are that they are “born that way,” that sexual orientations cannot change, and that one's sexual orientation is not affected by choice. Writer Andrew Sullivan put it this way: “[H]omosexuality is an essentially involuntary condition that can neither be (...) denied nor permanently repressed.… [S]o long as homosexual adults as citizens insist on the involuntary nature of their condition, it becomes politically impossible to deny or ignore the fact of homosexuality.… [The strategy for obtaining LGB rights is to] seek full public equality for those who, through no fault of their own, happen to be homosexual.”This idea of linking LGB rights to empirical claims about sexual orientations has become so central that casting doubt on these claims is, in many circles, tantamount to opposing LGB rights. Nonetheless, claims about innateness, immutability, and lack of choice about sexual orientation should not be the primary basis for LGB rights. (shrink)

The goal of this paper is show how an initially appealing objection to David Hume's account of judgment can only be put forward by philosophers who accept an account of judgment that has its own sizable share of problems. To demonstrate this, I situate the views of John Locke, David Hume, and Thomas Reid with respect to each other, so as to illustrate how the appealing objection is linked to unappealing features of Locke's account of judgment.

The need to revise scholars’ approach to the measurement of gender attitudes—long dominated by the separate-spheres paradigm—is growing increasingly timely as women’s share of the labor force approaches parity with men’s. Recent years have seen revived interest in marital name change as a gendered practice with the potential to aid in this task; however, scholars have yet to test its effectiveness as one possible indicator of gender attitudes. In this article we present views toward marital name change as a potential (...) window into contemporary gender attitudes and most centrally as an illustration of the types of measures that hold great potential for attitudinal research. Using quantitative analyses from a national survey, we show that views on name change reflect expected sociodemographic cleavages and are more strongly linked to a wide array of other gender-related attitudes than are views regarding gendered separate spheres—even net of sociodemographic factors. We then turn to interlinked qualitative data to illustrate three reasons why name-change measures so effectively capture broader beliefs about gender. We conclude by looking at what attitudes about name change can tell us about future directions for the conceptualization and measurement of gender attitudes. (shrink)

As more young people feel safe to outwardly identify as transgender or gender expansive (TGE), meaning that their gender identity does not align with the sex they were assigned at birth, an increasing number of youth who identify as TGE seek gender-affirming medical care (GAMC). GAMC raises a number of ethical questions, such as the capacity of a minor to assent or consent, the role of parents or legal guardians in decisions about treatment, and implications for equitable access to care (...) when differing parental or custodial viewpoints are present. These questions are further complicated by the difficulties in explaining the limits of long-term research in GAMC, with regard to the preservation of fertility, for example. We present two de-identified composite case studies to highlight dilemmas that may arise and offer recommendations to better support patient- and family-centered decision making for GAMC. These include employing a multidisciplinUniverary shared decision-making approach, disentangling informed consent and assent from chronological age, developing a consistent approach to the assessment of decisional capacity, and developing age-appropriate informational materials. The idea of moral progress played a central role in liberal political thought from the Enlightenment through the nineteenth century but is rarely encountered in moral and political philosophical discourse today. One reason for this is that traditional liberal theorists of moral progress, like their conservative detractors, tended to rely on under-evidenced assumptions about human psychology and society. For the first time, we are developing robust scientific knowledge about human nature, especially through empirical psychological theories of morality and culture that (...) are informed by evolutionary theory. On the surface, evolutionary accounts of morality paint a rather pessimistic picture of human moral nature, suggesting that certain types of moral progress are unrealistic or inappropriate for beings like us. Humans are said to be ‘hard-wired’ for tribalism. However, such a view overlooks the great plasticity of human morality as evidenced by our history of social and political moral achievements. To account for these changes while giving evolved moral psychology its due, we develop a dynamic, biocultural theory of moral progress that highlights the interaction between adaptive components of moral psychology and the cultural construction of moral norms and beliefs, and we explore how this interaction can advance, impede, and reverse moral progress. Peer review has long been regarded as the gold standard of scientific publication, essential to the integrity of science itself. But, as any publishing scientist knows, peer review has its downside, including long delays and reviewer bias. Until the coming of the Internet, there appeared to be no alternative. Now, articles appear online as preprints almost immediately upon submission. But they lack peer review and thus their scientific standing can be questioned. Post-publication discussion platforms such as PubPeer have proven useful, (...) but are no substitute for pre-publication peer review. Nevertheless, some may be tempted to believe that peer review can now be done without. This article challenges that view by analyzing a recent, non-peer-reviewed article in Skeptical Enquirer, a magazine published by the Committee for Skeptical Enquiry (CSI). The article, “Sodom Meteor Strike Claims Should Be Taken With a Pillar of Salt,” casts doubt on one of the most widely read scientific articles of the last decade and provides a stern warning of the cost of abandoning peer review. This study examined audience perceptions of a political candidate’s credibility and likeability as a function of varying the candidate’s responses to an opponent’s nonverbal disparagement during a televised debate. 412 participants watched a purported televised debate between candidates for mayor in a small city in Utah. In all six versions, one debater engaged in strong nonverbal disagreement during his opponent’s opening statement. His opponent responded to the nonverbal behavior with one of six decreasingly polite messages. Results indicated that more direct (...) messages increased audience perceptions of the speaker’s expertise and character compared to providing no response. The results also showed a significant interaction between response type and audience member’s level of trait verbal aggressiveness. The “indirect” and “on-record with redress” responses led to stronger perceptions of speaker composure and extroversion for members high in verbal aggression and the “off the record” strategy led to higher perceptions of extroversion and composure for members low in verbal aggression. Abstractabstract:This essay explores what it means to age happily, beginning with concepts of aging and happiness and proceeding to factors that promote or undermine happy aging. Relationships, contribution, and personal growth all add value to an aging life. Community also matters, as does the acceptance that a happy older age requires neither perfect health nor immense wealth.

Philosophers have routinely taken a pessimistic view of the account of cognition offered by David Hume in his Treatise of Human Nature, claiming that Hume's limited explanatory resources cannot capture the rich complexity of our thought, judgment, and reasoning. I provide a qualified defense of Hume's attempt to analyze a cognitive activity in terms of objectual conception, ie conceiving or imagining an object. I defend Hume from objections offered by his contemporary Thomas Reid (and echoed by various recent Hume scholars), (...) presenting an interpretation of the account that resolves these worries. After decades of vigorous debate, many contemporary philosophers in the Kantian tradition continue to believe, or at least hope, that morality can be given a firm grounding by showing that rational agents cannot consistently reject moral requirements. In the present paper, I do not take a stand on the possibility of bringing out the alleged inconsistency. Instead I argue that, even if a successful argument could be given for this inconsistency, this would not provide an adequate answer to “the normative (...) question” (i.e., “why should I be moral?”). My defense of this claim emerges from a defense of a claim about Kant, namely, that he did not attempt to answer the normative question in this way. After carefully articulating Kant’s answer to the normative question, I argue that his answer to this question contains a lesson about why we should not embrace the approach that is popular among many contemporary Kantians. One popular sort of argument for the death penalty depends on the idea of possibly saving innocent lives through added deterrent value. Defenders of such arguments generally concede that: a) we do not know whether or not the death penalty actually adds marginal deterrent value beyond life in prison, and b) any actual death penalty regime is likely to include the execution of some innocent people. Use of the death penalty might save some innocent people, but it is also likely (...) that it will lead us to kill some innocent people. In the present paper, I attempt to give consideration to both sorts of innocents. I argue that it is morally more serious to intentionally kill people who are innocent than it is to fail to save innocent people whose death is in no way intended. Thus, in the absence of compelling evidence that our use of the death penalty would save significantly more innocent people than it would kill, we should err on the side of not using the death penalty as a means to try to achieve added deterrent value. The mysterious phrase, ‘the eternal validity of the self,’ is clearly quite important in Kierkegaard’s pseudonymous works. A reader of those works will see that becoming aware of your eternal validity is a prerequisite for becoming both Judge William’s ‘ethical man’ and Johannes de Silentio’s ‘knight of faith,’ but the same reader is likely to be unsure just what it means to become aware of yourself in your eternal validity. In this paper, I discuss and critique various accounts of the (...) concept of the eternal validity of the self. Then, I offer an account of that notion which proceeds from careful attention to Judge William’s use of the phrase in Either/or. Finally, I connect my account with some of Kierkegaard’s writings beyond Either/or. (shrink)

The sixth and most recently published of the seven Heidegger manuscripts from his literary remains, The Event , is itself something of an event. If the Beiträge zur Philosophie was to set the stage for what has been received as an even more experimental Heidegger, then The Event in many ways might look back on that experimentation as yesterday’s news. The Event seems to begin where the Beiträge ended, as if there was no longer the need to justify its sentences (...) by means of an appeal to the historical tradition; in fact, such an appeal goes further towards confirming that tradition and its corresponding metaphysics than it does towards problematizing it. This is not to say that The Event progresses as if the historical tradition were no longer unfolding, but that it is much less concerned with trying to make sense of its own unfolding from out of some vaguely universal understanding of that tradition.
