Plans, Takes, and Mis-takes.Nathaniel Klemp, Ray McDermott, Jason Raley, Matthew Thibeault, Kimberly Powell & Daniel J. Levitin - 2008 - Outlines. Critical Practice Studies 10 (1):4-21.
This paper analyzes what may have been a mistake by pianist Thelonious Monk playing a jazz solo in 1958. Even in a Monk composition designed for patterned mayhem, a note can sound out of pattern. We reframe the question of whether the note was a mistake and ask instead about how Monk handles the problem. Amazingly, he replays the note into a new pattern that resituates its jarring effect in retrospect. The mistake, or better, the mis-take , was “saved” by (...)

Sweatshop Boycotts: Can’t Live with Them, Can’t Live without Them.Linan Peng & Benjamin Powell - forthcoming - Business Ethics Quarterly:1-29.
This article explores the moral permissibility of sweatshop boycotts. We build explicitly on Tomhave and Vopat’s (2018) framework for evaluating the moral permissibility of boycotts in general for the specific case of sweatshop labor. We argue that sweatshop boycotts are more likely to be morally justified when targeting forced labor compared to free labor and we explore the relevant moral tradeoffs associated with boycotts of free labor sweatshops. We analyze the morality of three cases of sweatshop boycotts—Indonesia in the 1990s, (...)

  4. Religion as an Evolutionary Byproduct: A Critique of the Standard Model.Russell Powell & Steve Clarke - 2012 - British Journal for the Philosophy of Science 63 (3):457-486.
The dominant view in the cognitive science of religion (the ‘Standard Model’) is that religious belief and behaviour are not adaptive traits but rather incidental byproducts of the cognitive architecture of mind. Because evidence for the Standard Model is inconclusive, the case for it depends crucially on its alleged methodological superiority to selectionist alternatives. However, we show that the Standard Model has both methodological and evidential disadvantages when compared with selectionist alternatives. We also consider a pluralistic approach, which holds that (...)

  5. What's the Harm? An Evolutionary Theoretical Critique of the Precautionary Principle.Russell Powell - 2010 - Kennedy Institute of Ethics Journal 20 (2):181-206.
The precautionary principle (“the Principle”) has been widely embraced as the new paradigm for contending with biological and environmental risk in the context of emerging technologies. Increasingly, it is being incorporated into domestic, supranational, and international legal regimes as part of a general overhaul of health and environmental regulation.1 Codifications of the Principle typically are vague, with their content intentionally left for scholars to debate, decision makers to interpret, and the courts to flesh out through case law. Generally speaking, the (...)

Enhancement of cognitive control by approach and avoidance motivational states.Adam C. Savine, Stefanie M. Beck, Bethany G. Edwards, Kimberly S. Chiew & Todd S. Braver - 2010 - Cognition and Emotion 24 (2):338-356.
Affective variables have been shown to impact working memory and cognitive control. Theoretical arguments suggest that the functional impact of emotion on cognition might be mediated through shifting action dispositions related to changes in motivational orientation. The current study examined the effects of positive and negative affect on performance via direct manipulation of motivational state in tasks with high demands on cognitive control. Experiment 1 examined the effects of monetary reward on task-switching performance, while Experiment 2 examined the effects of (...)

Older Adults and Covid‐19: The Most Vulnerable, the Hardest Hit.Tia Powell, Eran Bellin & Amy R. Ehrlich - 2020 - Hastings Center Report 50 (3):61-63.
Older adults in the United States have been the age group hardest hit by the Covid pandemic. They have suffered a disproportionate number of deaths; Covid patients eighty years or older on ventilators had fatality rates higher than 90 percent. How could we have better protected older adults? Both the popular press and government entities blamed nursing homes, labeling them “snake pits” and imposing harsh fines and arduous new regulations. We argue that this approach is unlikely to improve protections for (...)

Legal and Ethical Concerns about Sexual Orientation Change Efforts.Tia Powell & Edward Stein - 2014 - Hastings Center Report 44 (s4):32-39.
The United States has recently made significant and positive civil rights gains for LGB people, including expanded recognition of marriages between people of the same sex. Among the central tropes that have emerged in the struggle for the rights of LGB people are that they are “born that way,” that sexual orientations cannot change, and that one's sexual orientation is not affected by choice. Writer Andrew Sullivan put it this way: “[H]omosexuality is an essentially involuntary condition that can neither be (...)

The goal of this paper is show how an initially appealing objection to David Hume's account of judgment can only be put forward by philosophers who accept an account of judgment that has its own sizable share of problems. To demonstrate this, I situate the views of John Locke, David Hume, and Thomas Reid with respect to each other, so as to illustrate how the appealing objection is linked to unappealing features of Locke's account of judgment.

Marital Name Change as a Window into Gender Attitudes.Brian Powell, Claudia Geist & Laura Hamilton - 2011 - Gender and Society 25 (2):145-175.
The need to revise scholars’ approach to the measurement of gender attitudes—long dominated by the separate-spheres paradigm—is growing increasingly timely as women’s share of the labor force approaches parity with men’s. Recent years have seen revived interest in marital name change as a gendered practice with the potential to aid in this task; however, scholars have yet to test its effectiveness as one possible indicator of gender attitudes. In this article we present views toward marital name change as a potential (...)

As more young people feel safe to outwardly identify as transgender or gender expansive (TGE), meaning that their gender identity does not align with the sex they were assigned at birth, an increasing number of youth who identify as TGE seek gender-affirming medical care (GAMC). GAMC raises a number of ethical questions, such as the capacity of a minor to assent or consent, the role of parents or legal guardians in decisions about treatment, and implications for equitable access to care (...)

    Précis of The Evolution of Moral Progress: A Biocultural Theory.Russell Powell & Allen Buchanan - 2019 - Analyse & Kritik 41 (2):183-194.
The idea of moral progress played a central role in liberal political thought from the Enlightenment through the nineteenth century but is rarely encountered in moral and political philosophical discourse today. One reason for this is that traditional liberal theorists of moral progress, like their conservative detractors, tended to rely on under-evidenced assumptions about human psychology and society. For the first time, we are developing robust scientific knowledge about human nature, especially through empirical psychological theories of morality and culture that (...)

Reasonable Accommodation of Conscientious Objection in Health Care Is Morally and Legally Required.Kevin Powell - 2019 - Perspectives in Biology and Medicine 62 (3):489-502.
Human beings working in fields involving life, death, and morality are going to have fundamental and occasionally irreconcilable differences of opinion regarding goals, values, and actions. This has been true from the beginning of civilization. Along the way, civilized peoples have created laws that accommodate these differences so that a diverse population can coexist peaceably in one pluralistic society. As such, the Law is the practical, inchoate expression of that society's combined morals. For more than a decade, scholarly articles about conscientious (...)

Peer review has long been regarded as the gold standard of scientific publication, essential to the integrity of science itself. But, as any publishing scientist knows, peer review has its downside, including long delays and reviewer bias. Until the coming of the Internet, there appeared to be no alternative. Now, articles appear online as preprints almost immediately upon submission. But they lack peer review and thus their scientific standing can be questioned. Post-publication discussion platforms such as PubPeer have proven useful, (...)

This study examined audience perceptions of a political candidate’s credibility and likeability as a function of varying the candidate’s responses to an opponent’s nonverbal disparagement during a televised debate. 412 participants watched a purported televised debate between candidates for mayor in a small city in Utah. In all six versions, one debater engaged in strong nonverbal disagreement during his opponent’s opening statement. His opponent responded to the nonverbal behavior with one of six decreasingly polite messages. Results indicated that more direct (...)

Imagine This: Happy Aging in America.Tia Powell - 2023 - Perspectives in Biology and Medicine 66 (4):610-619.
Abstractabstract:This essay explores what it means to age happily, beginning with concepts of aging and happiness and proceeding to factors that promote or undermine happy aging. Relationships, contribution, and personal growth all add value to an aging life. Community also matters, as does the acceptance that a happy older age requires neither perfect health nor immense wealth.

  30. Just Imagining Things: Hume's Conception-Based Account of Cognition.Lewis Powell - 2011 - Dissertation, University of Southern California
Philosophers have routinely taken a pessimistic view of the account of cognition offered by David Hume in his Treatise of Human Nature, claiming that Hume's limited explanatory resources cannot capture the rich complexity of our thought, judgment, and reasoning. I provide a qualified defense of Hume's attempt to analyze a cognitive activity in terms of objectual conception, ie conceiving or imagining an object. I defend Hume from objections offered by his contemporary Thomas Reid (and echoed by various recent Hume scholars), (...)

Kant and Kantians on “the Normative Question”.Brian K. Powell - 2006 - Ethical Theory and Moral Practice 9 (5):535-544.
After decades of vigorous debate, many contemporary philosophers in the Kantian tradition continue to believe, or at least hope, that morality can be given a firm grounding by showing that rational agents cannot consistently reject moral requirements. In the present paper, I do not take a stand on the possibility of bringing out the alleged inconsistency. Instead I argue that, even if a successful argument could be given for this inconsistency, this would not provide an adequate answer to “the normative (...)

Killing, Letting Die, and the Death Penalty.Brian K. Powell - 2016 - International Journal of Applied Philosophy 30 (2):337-346.
One popular sort of argument for the death penalty depends on the idea of possibly saving innocent lives through added deterrent value. Defenders of such arguments generally concede that: a) we do not know whether or not the death penalty actually adds marginal deterrent value beyond life in prison, and b) any actual death penalty regime is likely to include the execution of some innocent people. Use of the death penalty might save some innocent people, but it is also likely (...)

Kierkegaard on the eternal validity of the self.Brian K. Powell - 2015 - International Journal of Philosophy and Theology 76 (4):305-314.
The mysterious phrase, ‘the eternal validity of the self,’ is clearly quite important in Kierkegaard’s pseudonymous works. A reader of those works will see that becoming aware of your eternal validity is a prerequisite for becoming both Judge William’s ‘ethical man’ and Johannes de Silentio’s ‘knight of faith,’ but the same reader is likely to be unsure just what it means to become aware of yourself in your eternal validity. In this paper, I discuss and critique various accounts of the (...)

The sixth and most recently published of the seven Heidegger manuscripts from his literary remains, The Event , is itself something of an event. If the Beiträge zur Philosophie was to set the stage for what has been received as an even more experimental Heidegger, then The Event in many ways might look back on that experimentation as yesterday’s news. The Event seems to begin where the Beiträge ended, as if there was no longer the need to justify its sentences (...)
