La arquitectura del derecho a la autodeterminación informativa, en su vertiente digital, está ahormada por la doctrina jurisprudencial. Ayuna de una regulación propia hasta la entrada en vigor del Reglamento General de Protección de Datos, el 25 de mayo de 2018, la autodeterminación informativa se ha ido conformando con el cincel de tres órganos jurisdiccionales (el Tribunal de Justicia de la Unión Europea, el Tribunal Constitucional y el Tribunal Supremo) que han ido perfilando y delimitando su contenido y alcance. Desde (...) su reconocimiento por el TJUE en su archiconocida decisión de 13 de mayo de 2014, la evolución que presenta es muy notoria. En la actualidad, una búsqueda en Internet con dos apellidos es suficiente para reconocer este derecho si con ello se lesiona el honor, la intimidad personal o familiar o la propia imagen de su titular. Así lo ha avalado el Tribunal Supremo en la STS 4016/2020, de 27 de noviembre. En este artículo se abordan los hitos jurisprudenciales más relevantes al objeto de bosquejar una cartografía jurídica actual del derecho a la autodeterminación informativa. (shrink)

BackgroundThe COVID-19 pandemic has hit almost all countries around the globe, seriously affecting the welfare of populations. Spain is especially hard-hit. In this context, the purpose of the present study is to analyze social, demographic, and economic correlates of mental health during the COVID-19 pandemic in the population residing in Spain.MethodThe sample of this cross-sectional study was comprised of 801 participants aged 18 or older and residing in Spain. Data collection was carried out during March and April 2020. Data of (...) mental health and well-being indicators, and those of a wide number of social, demographic, and economic variables were recorded. Linear regression models were built to value associations between mental health and social, demographic, and economic indicators.ResultsMental health morbidity was higher in women, younger people, individuals with medium studies, people with fewer children, singles, students, and unemployed individuals. Positive affect was higher among women, people with a high level of studies, those not co-living with dependent seniors, the self-employed, the employed, and those working outside home. Negative affect was negatively associated with age and number of children and was higher among women, people with basic studies, singles, individuals co-living with dependent seniors, homemakers, and students.ConclusionThe most vulnerable populations were found to be women, younger people, people with basic or medium studies, students and individuals with no remunerated activities, single populations, and those co-living with dependent seniors as well as those with a reduced number of children. Pan es un dios peculiar en muchos aspectos. Al contrario que los restantes dioses del panteón griego, él no es antropomorfo, sino que tiene patas, cola y cuernos de carnero. Un dios con características tan arcaicas sólo puede sobrevivir confinado a la Arcadia, una región que conserva numerosos arcaísmos religiosos. Sin embargo, a partir del 490 a.C. en que se instaura su culto en Atenas, el dios comienza a cambiar. En su evolución, Pan se asimila cada vez más a Dioniso. (...) A god like Pan can only survive in Arcadia, a region that preserves many religious archaisms. However, from 490 BC, when his cult is established in Athens, this god begins to change. In his evolution, Pan becomes increasingly assimilated the god Dionysus. The rapprochement between the two gods left his mark on the mythology, but especially in the cult of Pan. Thus, a god who was worshiped in Arcadia in sanctuaries built by men, in the rest of Greece is worshiped in wild shrines, mainly caves. La disfasia es un término que conceptualiza una entidad gnoseológica relacionada con la organización del lenguaje en su evolución. Es un trastorno grave y de prolongada duración que afecta a niños desde el inicio del desarrollo del lenguaje, se extiende a toda la infancia y la adolescencia y puede dejar secuelas en el estado adulto. En esta revisión bibliográfica se propone un acercamiento a la comprensión de sus dimensiones, concepto, síntomas y pautas para el diagnóstico e intervención desde el enfoque (...) de la Comunicación. Dysphasia is a term that conceptualizes a gnoseologic entity related to the organization of language in its evolution. It is a severe and prolonged duration disorder that affects children since the beginning of the language development and extends to all children and adolescents; it can also leave consequences in the adult stage. This review proposes an approach to the understanding of its dimensions, concept, symptoms and guidelines for the diagnosis and involvement from a communication perspective. (shrink)

The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. In this comprehensive new study of human free agency, Laura Waddell Ekstrom critically surveys contemporary philosophical literature and provides a novel account of the conditions for free action. Ekstrom argues that incompatibilism concerning free will and causal determinism is true and thus the right account of the nature of free action must be indeterminist in nature. She examines a variety of libertarian approaches, ultimately defending an account relying on indeterministic causation among events and appealing to agent causation only in (...) a reducible sense. La gestión del aprendizaje es una obra que refleja el quehacer educacional de los educadores que tienen la responsabilidad de formar al ser humano en la sociedad del conocimiento, bajo la óptica de la educación críti-reflexiva que permita al humano insertarse en la sociedad eficientemente. La condición cambiante del mundo contemporáneo hace que el concepto de aprendizaje tome una dimensión más amplia y que se maneje en función del cambio en el significado de la experiencia, para que puedan desarrollarse los (...) humanos con comportamientos a la altura de los tiempos en que vivimos y no a los anteriores, en que el aprendizaje era el símbolo del que más sabía. El aprendizaje es hoy algo que esta en estrecha vinculación con la formación cognitiva, afectiva, valórica y motriz, a partir de la visión holística que se requiere para poder mirar los fenómenos desde una óptica más global que nos permita ver el proceso ante nosotros como una complejidad justo en la medida de lo que es. La gestión del aprendizaje es lo que se requiere para lograr estos propósitos. (shrink)

We designed an experiment to explore the learning effectiveness of three different ways of practicing dance movements. To our surprise we found that partial modeling, called marking in the dance world, is a better method than practicing the complete phrase, called practicing full-out; and both marking and full-out are better methods than practicing by repeated mental simulation. We suggest that marking is a form of practicing a dance phrase aspect-by-aspect. Our results also suggest that prior work on learning by observation (...) and learning by mental practice may not scale up to complex movements. (shrink)

Los servicios de anestesia han adoptado una amplia variedad de modelos para hacer frente a las necesidades del medio local, la relación entre los anestesiólogos y la comunidad, y los papeles desempeñados por los anestesiólogos en el tratamiento perioperatorio. Anesthesiology services have adopted a wide variety of models to face up to the needs the city, the relationship between anesthesiologists and the community and the role anesthesiologists play in perioperative treatment have. The Cuban health system services are in a process of permanent adaptation to the problems, demands and needs the Cuban population and its determinants have. Business orientation toward sustainable development goals and the circular economy are relevant research topics today in business theory and practice. The waste recycling sector is a key industry in the circular economy framework for promoting clean production and environmental sustainability. This study analyzes business performance in the recycling sector, focusing on efficiency indicators. The associations between firm efficiency and risk variables were also evaluated. The study goes through several methodological stages, including a Data Envelopment Analysis (DEA) multistage method and multivariate (...) modeling: tobit regression, bootstrap models, and generalized method of moments (GMM). The main results indicate that the average efficiency of waste recycling firms is at a medium level. Large-sized firms achieve higher levels of efficiency than medium-sized and small firms, supporting the economies of scale hypothesis. The evidence also suggests that risk variables (rating score and Zscore) and capital structure are key determinants of firm efficiency in the waste recycling industry. (shrink)

Cognitive dysfunction in Alzheimer’s disease is caused by disturbances in neuronal circuits of the brain underpinned by synapse loss, neuronal dysfunction and neuronal death. Amyloid beta and tau protein cause these pathological changes and enhance neuroinflammation, which in turn modifies disease progression and severity. Vagal nerve stimulation, via activation of the locus coeruleus, results in the release of catecholamines in the hippocampus and neocortex, which can enhance synaptic plasticity and reduce inflammatory signalling. Vagal nerve stimulation has shown promise to enhance (...) cognitive ability in animal models. Research in rodents has shown that VNS can have positive effects on basal synaptic function and synaptic plasticity, tune inflammatory signalling, and limit the accumulation of amyloid plaques. Research in humans with invasive and non-invasive VNS devices has shown promise for the modulation of cognition. However, the direct stimulation of the vagus nerve afforded with the invasive procedure carries surgical risks. In contrast, non-invasive VNS has the potential to be a broadly available therapy to manage cognitive symptoms in early AD, however, the magnitude and specificity of its effects remains to be elucidated, and the non-inferiority of the effects of non-invasive VNS as compared with invasive VNS still needs to be established. Ongoing clinical trials with healthy individuals and patients with early AD will provide valuable information to clarify the potential benefits of non-invasive VNS in cognition and AD. Whether invasive or non-invasive VNS can produce a significant improvement on memory function and whether its effects can modify the progression of AD will require further investigation. (shrink)

Resumen: Este trabajo investiga las traducciones realizadas por Aphra Behn a partir de la clasificación tripartita que estableció John Dryden entre metáfrasis, paráfrasis e imitación. Behn cultiva la metáfrasis principalmente en sus traducciones de La Rochefoucauld, la paráfrasis en las versiones de Cowley o Tallemant, entre otros; mientras que aplica la imitación a las Fábulas de Esopo. Se constata que Behn rompe con la tradición de traducir principalmente a los autores clásicos, ensanchando los cauces de entrada de literatura moderna en (...) Inglaterra y ampliando las posibilidades de la traducción literaria. Analizando unas muestras, se infiere la manipulación del texto original que la autora realiza en ocasiones, en consonancia con su ideario creativo, generando un texto meta provisto de nuevas resonancias de género y políticas contextualizadas en su época. Asimismo, se deduce que la escritora profesional de la Restauración cultiva la traducción movida, entre otros motivos, por los gustos del naciente mercado literario en cuanto a las novedades del país galo y, por tanto, motivada por un afán comercial.: This paper examines the translations by Aphra Behn based on the tripartite classification that John Dryden established between metaphrase, paraphrase and imitation. Behn employs mainly metaphrase in her translations of La Rochefoucault; paraphrase in her versions of Cowley and Tallemant, among others; while applying the imitation to Aesop's Fables. It is found that Behn breaks with the tradition of translating principally classical authors, broadening channels for the entrance of modern literature into England and expanding the possibilities of literary translation. Analyzing the samples, the author's occasional manipulation of the original text is identified, consonant with her creative ideas and generating a metatext featuring new political and gender resonances contextualized in her era. It is also concluded that the professional writer of the Restoration employs translation spurred by the tastes of the burgeoning literary market, among other factors, shaped by recent developments in France and, as such, motivated by commercial interests. As library collections and services have increasingly moved from print to digital, much of the work that used to be done by libraries themselves with regard to creating, maintaining, and managing the systems that hold collections and facilitate user access to them is now done primarily by vendors. This change to the information services landscape for academic libraries is the occasion not only of technical and procedural challenges, but also some internal conflicts concerning the ethical demands of the library profession. This essay examines the ways in which these conflicts become acute and obvious when attention is paid to the way in which attempts to promote equity, diversity, and inclusion (EDI) are undermined by the handover of library services to vendors, even when—or perhaps especially when—those vendors use their control of content and platforms to commodify diverse content instead of making the necessary systemic changes required by truly effective EDI efforts. This paper uses some recent ideas in biology as starting point to explore analogous concepts and tendencies in semiotics and biology, leading to reflections on interdisciplinarity itself within the framework of theories of chaos and complexity. It sees affinities between the biological concept of species and the semiotic category of discipline. It finds many suggestive parallels with semiotics from the recently emerging synthesis of evolution and development, built around the discovery of ‘homeobox’ genes which are present in many very different (...) lineages, opening up possibilities for ‘deep’ homologies between species, and providing a powerful model for semiotic homology. GraphicalThe need to encourage individuals as active change agents for sustainability transitions has led researchers across disciplines to conceptualize over 70 constructs to assess relevant dispositions to environmental protection and green consumption behaviors. The generated knowledge is, however, fragmented by an unconsolidated set of constructs developed within parallel literature streams. We, hence, use an integrative review method to capture conceptual and operational similarities and distinctiveness of constructs across disciplines in the literature, attempting to unify the knowledge base. Thereby, we identify (...) 34 conceptually distinct constructs relevant for the thematic synthesis on individual-level constructs framing contributions to environmental measures and issues. We followingly propose a taxonomy, systemizing constructs based on their concept type and contextual scope of the environmental challenge addressed. We capture these dimensions in critically assessing relevant and salient conceptual and operational features. We thus create a consolidated picture of extant constructs capturing individual-level environmental sustainability by which we intend a three-fold contribution to the interdisciplinary field. First, the taxonomy and guiding framework for the choice of constructs should assist substantive researchers in identifying appropriate constructs of interest. Second, the systematic integration of similar concepts available in parallel literature streams should assist future endeavors aiming at integrating substantive findings with regard to antecedents, consequences, and other relevant variables. Finally, the taxonomy revealed that conceptualizations mainly scatter around specific combinations of types and scopes while others remain unaddressed. Based on our critical assessment of the relevant features and resulting taxonomy, we identify avenues for future research dedicated to enhancing conceptual rigor and measurement quality in the field and introducing concepts addressing missing but potentially valuable combinations of types and scopes. We conclude that researchers engaging in the proposed avenues with conceptual, methodological, or empirical contributions should consider four critical aspects to advance knowledge accumulation and prevent fragmentation in the interdisciplinary field. We thereby hope to pave the way for a collective, interdisciplinary knowledge base of concepts used to describe and assess individual’s pro-environmental dispositions and practices of green consumption. Although the view that sees proper names as referential singular terms is widely considered orthodoxy, there is a growing popularity to the view that proper names are predicates. This is partly because the orthodoxy faces two anomalies that Predicativism can solve: on the one hand, proper names can have multiple bearers. But multiple bearerhood is a problem to the idea that proper names have just one individual as referent. On the other hand, as Burge noted, proper names can have predicative (...) uses. But the view that proper names are singular terms arguably does not have the resources to deal with Burge’s cases. In this paper I argue that the Predicate View of proper names is mistaken. I first argue against the syntactic evidence used to support the view and against the predicativist’s methodology of inferring a semantic account for proper names based on incomplete syntactic data. I also show that Predicativism can neither explain the behaviour of proper names in full generality, nor claim the fundamentality of predicative names. In developing my own view, however, I accept the insight that proper names in some sense express generality. Hence I propose that proper names—albeit fundamentally singular referential terms—express generality in two senses. First, by being used as predicates, since then they are true of many individuals; and second, by being referentially related to many individuals. I respond to the problem of multiple bearerhood by proposing that proper names are polyreferential, and also explain the behaviour of proper names in light of the wider phenomenon I called category change, and show how Polyreferentialism can account for all uses of proper names. Much is being made of local food. It is at once a social movement, a diet, and an economic strategy—a popular solution—to a global food system in great distress. Yet, despite its popularity or perhaps because of it, local food (especially in the US) is also something of a chimera if not a tool of the status quo. This paper reflects on and contrasts aspects of current local food rhetoric with Dalhberg’s notion of a regenerative food system. It identifies three (...) problematic emphases—the locavore emphasis, the Wal-Mart emphasis, and the Pollan emphasis—and argues that they are shifting local food (as a concept and a social movement) away from the deeper concerns of equity, citizenship, place-building, and sustainability. It is suggested that local food activists and advocates might consider the use of multiple methodologies and forms of expression to explore the integration and reintegration of local food into diverse and redundant place-based practice. A short case study of a low-income, urban neighborhood in Lansing, Michigan, illustrates the value of contextual analysis for more fully enabling the local food movement and a regenerative food system. The orthodox view of anger takes desires for revenge or retribution to be central to the emotion. In this paper, I develop an empirically informed challenge to the retributive view of anger. In so doing, I argue that a distinct desire is central to anger: a desire for recognition. Desires for recognition aim at the targets of anger acknowledging the wrong they have committed, as opposed to aiming for their suffering. In light of the centrality of this desire for recognition, (...) I argue that the retributive view of anger should be abandoned. I consider and dismiss two types of moves that can be made on the part of a proponent of the orthodox view in response to my argument. I propose that a pluralist view, which allows for both retribution and recognition in anger, is to be preferred. (shrink)

In this article I present a disagreement between classical and constructive approaches to predicativity regarding the predicative status of so-called generalised inductive definitions. I begin by offering some motivation for an enquiry in the predicative foundations of constructive mathematics, by looking at contemporary work at the intersection between mathematics and computer science. I then review the background notions and spell out the above-mentioned disagreement between classical and constructive approaches to predicativity. Finally, I look at possible ways of defending the constructive (...) predicativity of inductive definitions. (shrink)
