A charming black-figured olpe in the Ashmolean Museum, Oxford shows two warriors playing a game. Between them stands the goddess Athena, an alert figure looking sharply to the left while holding her shield to the right. She holds it rather tactlessly, for the shield entirely obscures the head of the right-hand warrior. Although Cassandra, clinging desperately to the statue of Athena, sometimes has her head obscured in a similar manner behind the goddess's shield, it seems more likely that the painter (...) here has simply misjudged the space available than that he has conflated two iconographical types.The Oxford olpe, though imperfectly planned and executed, is clearly an example of the subject which is best known through the beautiful amphora in the Vatican painted by Exekias. This is a review essay of Lagasnerie, Judge and Punish and Fassin, The Will to Punish. It explores the way that these two books challenge conventional thinking about the relationship between crime and punishment.

This paper seeks to answer the question: Can contemporary forms of artificial intelligence be creative? To answer this question, I consider three conditions that are commonly taken to be necessary for creativity. These are novelty, value, and agency. I argue that while contemporary AI models may have a claim to novelty and value, they cannot satisfy the kind of agency condition required for creativity. From this discussion, a new condition for creativity emerges. Creativity requires curiosity, a motivation to pursue epistemic (...) goods. I argue that contemporary AI models do not satisfy this new condition. Because they lack both agency and curiosity, it is a mistake to attribute the same sort of creativity to AI that we prize in humans. Finally, I consider the question of whether these AI models stand to make human creativity in the arts and sciences obsolete, despite not being creative themselves. : There is a concern that genetic engineering will exacerbate existing social divisions and inequalities, especially if only the wealthy can afford genetic enhancements. Accordingly, many argue that justice requires the imposition of constraints on genetic engineering. However, it would be unwise to decide at this time what limits should be imposed in the future. Decision makers currently lack both the theoretical tools and the factual foundation for making sound judgments about the requirements of justice in a genetically transformed society. (...) Moreover, focusing on the uncertain inequities of the future may result in failure to give priority to more pressing inequities of the present. Scholars have long recognized the importance of liberty in Milton's early prose, but they tend to center their analysis on republicanism. Although he would go on to express republicanism, Milton's early tracts tie liberty to English political and legal traditions rather than classical ones. Milton, in his early tracts, utilizes the language of the ancient constitution and the common law as he centers liberty on the property and bodies of English citizens, thus framing liberty in distinctly English terms. In this paper I articulate a view of doxastic control that helps defend the legitimacy of our practice of blaming people for their beliefs. I distinguish between three types of doxastic control: intention-based, reason-based, and influence-based. First I argue that, although we lack direct intention-based control over our beliefs, such control is not necessary for legitimate doxastic blame. Second, I suggest that we distinguish two types of reason-responsiveness: sensitivity to reasons and appreciation of reasons. I argue that while both capacities (...) are necessary for satisfying the control condition, neither is sufficient. Finally, I defend an influence-based view of doxastic control according to which we have the capacity to execute intentions to engage in reflection that causally influences our beliefs in positive epistemic ways. This capacity is both necessary and sufficient for satisfying the control condition for legitimate doxastic blame. I end by defending the view from two objections: that reflection is not necessary for meeting the control condition, and that it is not sufficient. (shrink)

Background: Moral distress, which is especially high in critical care nurses, has significant negative implications for nurses, patients, organizations, and healthcare as a whole. Aim: A moral distress workshop and follow-up activities were implemented in an intensive care unit in order to decrease levels of moral distress and increase nurses’ perceived comfort and confidence in ethical decision-making. Design: A quality improvement (QI) initiative was conducted using a pre- and post-intervention design. The program consisted of a four-hour interactive workshop, followed by (...) two individual self-reflection activities at 2–3 weeks and 5–6 weeks after the workshop. Participants: Critical care nurses working in a heart and vascular intensive care unit at a large academic medical center. Ethical Considerations: This study was deemed to be a QI project by the institution’s Institutional Review Board. Participation was voluntary. Findings: Nurses experienced a significant decrease in moral distress. The participants’ average ethical confidence increased in four areas (ability to identify the conflicting values at stake, knowing role expectations, feeling prepared to resolved ethical conflict, and being able to do the right thing), with knowledge of role expectations and feeling prepared to resolve ethical conflict yielding statistically significant increases. Qualitative findings resulted in consistent themes related to causes of moral distress and ways nurses approached addressing moral distress. Discussion: This study reinforces previous evidence on moral distress and its causes in critical care nurses, and provides a mechanism for improving moral distress and ethical confidence. Conclusions: This QI study demonstrates the effectiveness of an evidence-based program for decreasing critical care nurses’ moral distress and increasing their ethical confidence. The strategies described in this paper can replicated by nursing leaders who wish to effect change at their local level, or adapted and expanded to other professions and clinical care units. A bridge between semipopular works for the general reader and technical treatises written for specialists, this excellent work discusses the foundational ideas and background of modern physics. It is not a text on theoretical physics, but a discussion of the methods of physic description and construction of theory. As such, it is especially valuable for the physicist with a background in elementary calculus who is interested in the ideas which give meaning to the data and tools of modern physics.

Explaining how something is possible is a familiar and epistemically important achievement in both science and ordinary life. But a satisfactory general account of how-possibly explanation has not yet been given. A crucial desideratum for a successful account is that it must differentiate a demonstration that something is possible from an explanation of how it is possible. In this paper, I offer an account of how-possibly explanation that fully captures this distinction. I motivate my account using two cases, one from (...) ordinary life and one from ornithology. On my account, a how-possibly explanation is a greater achievement than a mere description of how a state of affairs might possibly obtain. In addition to being a potential explanation of why some state of affairs actually obtains, a how-possibly explanation must involve the relief of an imaginative frustration on the part of its recipient. When a recipient’s imaginative frustration is relieved, she does not just know that the state of affairs in question is possible, but is also able to imagine how it could possibly obtain. (shrink)

This paper reviews some of the social, historical, and political forces and events that influenced the development of Bennett Reimer’s early philosophy of music education in the late 1950s and continuing to his death in 2013. John Dewey’s ideas about the moral and political purposes of art education are employed as critical tools for understanding the political dynamics of Reimer’s career during the early Cold War as all education was conceived by government and prominent education reformers as social control rather (...) than liberation. This paper is an invited response to a one published by David Elliott in _The Music Educator_ in 2012 in which music teachers were enjoined to encourage children to use music’s expressive power as a political tool in pursuit of social justice. While in agreement with him that this can be an appropriate use of music, there is a curious avoidance of controversy in Elliott’s article that might frustrate that end in that nothing is said about whether students should be (...) prompted to critically examine sacred myths, such as the American Dream or historical narratives, and pedagogical practices that might limit their understanding of social problems. Much of my response is given to consideration of some of the possible reasons for Elliott’s avoidance of controversy, including an over-emphasis on “doing” or “making” music that might leave little curricular time for the kinds of study and controversy and debate that are essential to understanding social (in)justice. Though studies of development and evolution were closely connected during the 19th century, continued work in genetics fostered a general split between the two during the first decades of the twentieth century (e.g., Allen 1978; Gilbert 1978; Mayr and Provine 1980; Gilbert, Opitz and..

This article argues that although post-truth is understood to pose a particular misogynistic threat to feminism, we cannot assume that feminists should simply oppose post-truth. The way the post-truth debate is constructed is problematic for feminism in three ways: it misconceives the relationship between democracy and truth; utilizes a questionable binary between reason and emotion; and propagates elitist assumptions about protecting democracy from the people. Recognizing the insufficiency of our understanding of post-truth, feminists have called for greater understanding of the (...) roles of language, affect and truth in the post-truth debate. In response, I suggest that the theories of Judith Butler and Bonnie Honig can help. However, I seek to emphasise that if feminists are to intervene meaningfully in the inequalities and intensified affective flows that structure the post-truth paradigm they would benefit from a deintensifying, confrontational but nonaggressive, approach. I argue for an account of creativity that unifies creative achievements in the arts, sciences, and other domains and identifies its characteristic value. This account draws upon case studies of creative work in both the arts and sciences to identify creativity as a kind of successful exploration. I argue that if creativity is properly understood in this way, then it is fundamentally a property of processes, something only agents can achieve, something that comes in degrees, subjectively novel, and non-formulaic. As (...) I develop the account, I show how it avoids challenges faced by other accounts of creativity, especially concerning creativity’s value. Hills and Bird (2018, 2019) have together argued that creativity is not necessarily valuable. My account challenges this view. In this paper, I solve a puzzle generated by three conflicting claims about the relationship between faith, belief, and control: according to the Identity Thesis, faith is a type of belief, and according to Fideistic Voluntarism, we sometimes have control over whether or not we have faith, but according to Doxastic Involuntarism, we never have control over what we believe. To solve the puzzle, I argue that the Identity Thesis is true, but that either Fideistic Voluntarism or Doxastic Voluntarism is (...) false, depending on how we understand "control." I distinguish two notions of control: direct intention-based control and indirect reflective control. I argue that though we have direct intention-based control over neither belief nor faith, we have indirect reflective control over each of them. Moreover, indirect reflective control helps explain how we can be held accountable for each. (shrink)

Some philosophers argue that friendship can normatively require us to have certain beliefs about our friends that epistemic norms would prohibit. On this view, we ought to exhibit some degree of doxastic partiality toward our friends, by having certain generally favorable beliefs and doxastic dispositions that concern our friends that we would not have concerning relevantly similar non-friends. Can friendship genuinely make these normative demands on our beliefs, in ways that would conflict with what we epistemically ought to believe? On (...) a widely influential evidentialist approach to thinking about epistemic norms, friendship cannot normatively require things of our beliefs, because friendship cannot generate reasons for belief. And this is due, in part, to the alleged fact that we are incapable of forming beliefs directly in response to, or on the basis of, non-epistemic reasons. In this paper, I argue that this evidentialist response to alleged cases of conflict between friendship and epistemic norms fails. Instead, I argue that friendship cannot generate reasons for belief due to an underappreciated feature of friendship: that being a good friend constitutively involves forming attitudes about one’s friends that are appropriately responsive to the features that one’s friends have that appear to warrant those attitudes. I argue that this feature of friendship helps explain why friendship cannot give us reasons to have beliefs that are doxastically partial. (shrink)

What is it to suspend judgment about whether p? Much of the recent work on the nature and normative profile of suspending judgment aims to analyze it as a kind of doxastic attitude. On some of these accounts, suspending judgment about whether p partly consists in taking up a certain higher-order belief about one's deficient epistemic position with respect to whether p. On others, suspending judgment about whether p consists in taking up a sui generis attitude, one that takes the (...) question of whether p? as its content. In this paper, I defend an account on which suspending judgment about whether p is not a matter of taking up a doxastic attitude, but rather a way of intentionally omitting to judge whether p. I then close with a discussion of how an account like mine, which sees suspending judgment as fundamentally practical, rather than doxastic, can accommodate what appear to be distinctively epistemic reasons to suspend judgment. Populated by lesbian, gay, bisexual, trans*, queer (LGBTQ) and allied youth, school-based gay straight alliances (GSAs) offer a unique opportunity to re-imagine or redefine youth subjectivity, especially with regards to the intersections of sexual orientation, gender identity, and civic rights. Tracing the evolution of youth subjectivity from the emergence of Canadian schooling in the 1860s, I turn to Ontario’s Bill 13 as a recent example of how GSAs are subverting, or resisting these norms, and in so doing, operate as a (...) kind of counter-public. Drawing from Jenks’ (2005) archetypes of the Dionysian and Apollonian child, I assert that GSAs can embody a third type of child subjectivity, the Athenian child (Smith, 2011; 2014) and, in so doing, provide theoretical space to reconstitute subjectivity for all youth. Do AI programs just make it quicker and easier for humans to do what they can do already, or can the range of do-able things be extended? This paper suggests that cognitively-oriented technology can make it possible for humans to construct and carry out mental operations, which were previously impossible. Probable constraints upon possible human mental operations are identified and the impact of cognitive technology upon them is evaluated. It is argued that information technology functions as a cognitive prosthetic enhancing (...) human intelligence and planning capabilities. Boundaries and constraints which Kant, Whorf, and many post-modernist theorists have seen as intrinsic to human cognition now cease to apply. (shrink)

The significance of scientific research into the evolution of altruism for environmental ethics can be highlighted through an analysis of recent debates over William Hamilton’s theory of inclusive fitness. Recent debates over how to explain altruism have become particularly charged with ideological weight because they are seen to have some consequence for how we understand the human moral project, especially with regard to nonhuman life. By analyzing the place of evolutionary theory in the work of environmental ethicists some conclusions can (...) be drawn about the extent to which these debates, and evolutionary research into behavior more generally, are and are not significant for environmental ethics. In particular, the most important issues at stake for environmental ethicists concern the conditions under which altruistic forms of behavior can thrive and the degree to which we can consider intensive forms of altruism to be unstable and anomalous, or rather stable and predictable outcomes of social evolution given favorable conditions. On the basis of what Aristotle says in the Posterior Analytics about how sciences are differentiated and about the impermissibility of ‘kind-crossing’, many commentators suppose that when it comes to his scientific practice, Aristotle treats the boundaries of the sciences as impermeable, so that if subject-matter X is the business of one science, it simply cannot be the business of another. I call this the impermeable boundary theory of the sciences: knowledge is divided into watertight compartments, determined by their distinct (...) genera, and what goes on in one compartment cannot turn up in another. I argue that, even if this is a correct account of Aristotle’s position in the Analytics, the view that he accepts the impermeable boundary theory when it comes to his scientific and philosophical work outside the Analytics is simply untenable. This book examines the relationship between legal tradition and national identity to offer a critical and historical perspective on the study of criminal law. It develops a radically different approach to questions of responsibility and subjectivity, and was among the first studies to combine appreciation of the institutional and historical context in which criminal law is practised with a critical understanding of the law itself. Applying contemporary social theory to the particular case of nineteenth-century Scottish law, Lindsay Farmer is (...) able to develop a critique of modern criminal law theory in general. He traces the development of the modern characteristics of criminal law and legal order, tracing the relationship between legal practice and national culture, and showing how contemporary criminal law theory fundamentally misrepresents the character of modern criminal justice. At the same time as fair trade certified products are capturing an increasing market share, a growing number of scholars and practitioners are raising serious questions about who benefits from certification. Through a critique of north–south narratives, this paper draws on contemporary themes in fair trade scholarship to draw out different ways of thinking about fair trade outside of the dichotomous north–south framing. I argue that, through the creation of fair trade subjects of the “global north” and “global south,” certification (...) has normalized and naturalized dichotomous power relations. The primary concern of this paper is to demonstrate the problems with situating certification and scholarship in the north–south binary and to push examination toward a more nuanced analysis of how certification and development are shaped in-place. This intervention is important for assisting with stepping away from long-standing debates regarding the effectiveness of certification, and additionally in contributing to critical thinking on economic development more broadly. In June 2012, New York City Mayor Michael Bloomberg announced his plans for a ban on the sale of sugary beverages in containers larger than 16 ounces. Shortly thereafter, the Center for Consumer Freedom took out a full-page ad in the New York Times featuring Bloomberg photo-shopped into a matronly dress with the tag line “New Yorkers need a Mayor, not a Nanny.” On television, the CATO Institute's Michael Cannon declared, “This is the most ridiculous sort of nanny state-ism; [i]t’s (...) none of the mayor's business how much soda people are drinking.” And in newspapers around the country, editorial pages featured headlines such as “Gulp! Yet Another Intrusion of the Nanny State.” Just like that, the public debate about this measure became focused on government overreach, while the public health problem of obesity faded into the background.
