A prolonged confrontation between Yahoo! Inc. and French activists who demand the removal of Nazi items from auction sites as well as restricted access to neo-Nazis sites is described and analyzed. We present the case up to the decision of Yahoo! Inc. to remove the items from yahoo.com following a French court's verdict against the firm. Using a business ethics approach, we distinguish legal, technical, philosophical and managerial issues involved in the case and their management by Yahoo! We conclude on (...) the difficulty of governing relations with society from corporate and legal affairs departments at the headquarters level, and on the clash of two visions over the regulation of social freedom. The main task of Cognitive Science is to construct concepts and models that would be superordinate to knowledge in the various particular cognitive sciences. In particular, one major objective is to formulate a hypergeneral description of representations that could encompass all descriptions given in subordinate domains.A first basic distinction is between natural and rational representations, i.e. given mental entities and representations that are governed by prescriptive rules coming from logical or scientific thought. In addition, representations must be described in respect (...) to several sources of variability, which are tentatively listed here.Description of natural representations is based on a distinction between taken representations, which are mental events, and type representations, which are lasting structures registered in memory. The connection between them can be modelled through the concept of activation.One advantage of activation models is their large compatibilty, not only with experimental evidence in cognitive psychology, but also with facts and hypotheses in neurosciences, and programming modes or requirements in artificial intelligence. In the homogeneous case of one-dimensional objects, we show that any relation that is positive and homothetic can be represented by a ratio-scale and a unique and constant biasing factor. This factor may favor or disfavor the preference for an object over another. In the first case, preferences are complete but not transitive and an object may be preferred even when its value is lower. In the second case, preferences are asymmetric and transitive but not negatively transitive and it may (...) not be sufficient for an object to have a greater value to be preferred. In this manner, the biasing factor reflects the extent to which preferences may depart from a maximization process. (shrink)

Developing a vaccine against HIV is one of the greatest challenges the scientific community faces today. Several vaccine candidates have undergone preliminary safety and immunogenicity studies in humans. Research teams are ready to test these vaccines in the field, yet the scientific community is divided as to whether efficacy trial should begin. This paper addresses the complex scientific and ethical issues raised by clinical trials. Considering the pressure to act rapidly to solve the crisis, scientists need to hold to the (...) fundamental principles that guide decisions in biomedical research: respect for persons, beneficence and justice. Because these studies need to enroll a large number of subjects, prospective vaccines will need to be tested in developing, as well as industrial countries. The international community needs to work to ensure that the populations that accept the risk of the research receive the full benefit of that research and, that the vaccine proven successful, be made accessible and affordable to people in less economically developed situation. This paper proposes an exploration of the methodology of utility functions that distinguishes interpretation from representation. While representation univocally assigns numbers to the entities of the domain of utility functions, interpretation relates these entities with empirically observable objects of choice. This allows us to make explicit the standard interpretation of utility functions which assumes that two objects have the same utility if and only if the individual is indifferent among them. We explore the underlying assumptions of such an hypothesis and (...) propose a non-standard interpretation according to which objects of choice have a well-defined utility although individuals may vary in the way they treat these objects in a specific context. We provide examples of such a methodological approach that may explain some reversal of preferences and suggest possible mathematical formulations for further research. (shrink)

This paper argues that economic rationality and ethical behavior cannot be reduced one to the other, thus casting doubt on the validity of assertions such as ‘profit is ethical’ or ‘ethics pays’. In order to express ethical dilemmas in a way which opposes economic interest with ethical concerns, we propose a model of rational behavior that combines these two irreducible dimensions in an open but not arbitrary manner. Behaviors that are neither ethical nor profitable are considered irrational . However, behaviors (...) that are profitable but unethical, and behaviors that are ethical but not profitable, are all treated as rational . Combining ethical concerns with economic interest, ethical business is in turn seen as an optimal form of rationality between venality and sacrifice. Because everyone prefers to communicate that they act ethically, ethical business remains ambiguous until some economic interest is actually sacrificed. We argue, however, that ethical business has an interest in demonstrating its consistency between communication and behavior by a transparent attitude. On the other hand, venal behaviors must remain confidential to hide the corresponding lack of consistency. This discursive approach based on transparency and confidentiality helps to further distinguish between ethical and unethical business behaviors. (shrink)

Leo Strauss (1899-1973) a inscrit sa pensée dans l'héritage de la tradition grecque, mais également dans celui de la tradition biblique. Se rapportant au judaïsme comme à une révélation de la Loi (pour laquelle la dimension de la foi est secondaire), il fait retour à une pensée juive (Pourquoi nous restons juifs) et tente de prolonger la réflexion de Maïmonide dans les conditions nouvelles des temps présents. Il s'oppose ainsi à sa rénovation par l'approche phénoménologique de Franz Rosenzweig comme à (...) la pensée de Martin Buber, tout en se tenant à distance de la réflexion sur le mysticisme juif de Gershom Scholem avec lequel il dialogue. Cet ouvrage interroge la manière dont Strauss pense les relations de corrélation et de conflit entre philosophie et judaïsme. En quoi la réflexion sur la Loi, dont il poursuit l'élaboration dans la lignée de la pensée médiévale et à contre-courant de la modernité des Lumières, représente- t-elle un approfondissement de la pensée juive et jette-t-elle une lumière crue sur la situation du judaïsme dans le monde? Quels sont les termes du débat avec les penseurs contemporains du judaïsme avec lesquels il est en relation? Quelles sont aujourd'hui les possibilités et les limites d'une telle réflexion pour la vitalité du judaïsme et de la philosophie? Les études présentes ouvrent des voies différentes, voire divergentes, essentiellement heuristiques, sur les possibilités et les limites de la réflexion straussienne pour la vitalité du judaïsme et de la philosophie. The aim of this article is to show the relevance of the sociology of market agencements for studying the creation of alternative agri-food networks. The authors start with their finding that most research into alternative agri-food networks takes a strictly informative, cursory look at the conditions under which these networks are gradually created. They then explain how the sociology of market agencements analyzes the construction of innovative markets and how it can be used in agri-food studies. The relevance of this (...) theoretical frame is shown based on an experiment aimed at creating a local trade scheme between manure from livestock farms and alfalfa grown by grain farmers. By using the concepts of the sociology of market agencements, the authors reveal the operations that are required to create an alternative agri-food network and underscore the difficulties that attend each one of these operations. This paper argues that any specific utility or disutility for gambling must be excluded from expected utility because such a theory is consequential while a pleasure or displeasure for gambling is a matter of process, not of consequences. A (dis)utility for gambling is modeled as a process utility which monotonically combines with expected utility restricted to consequences. This allows for a process (dis)utility for gambling to be revealed. As an illustration, the model shows how empirical observations in the Allais paradox (...) can reveal a process disutility of gambling. A more general model of rational behavior combining processes and consequences is then proposed and discussed. (shrink)

Seriously engaging with the needs, hardships, and aspirations of future generations is an emotional experience as much as an intellectual endeavor. In this essay we describe a guided visualization exercise used to overcome the emotional barriers that often prevent us from dealing effectively with intergenerational decisions. The meditation and dreaming technique was applied to a diverse group of researchers who engaged in a visualized encounter with future generations. Following the exercise, we concluded that a serious analysis of intergenerational conflict requires (...) us to confront our own mortality. Also, somewhat surprisingly to workshop participants, our desire to become stewards of the planet was driven by our fear of death as well as our egoist yearning for immortality. We posit that imagining the unknown with visioning practices might increase our emotional resilience, and hence improve our ability to confront the burdens of intergenerational responsibility. This paper discusses the legal implications of setting up two new biobanks in Belgium. The first is hospital-based and will archive tissue from patients with haematologic cancer, whereas the second is linked to a general practice based morbidity registry and will involve storage of blood samples. To date, Belgium has no specific legislation that regulates storage of human tissue and related databases. Several issues concerning the protection of individuals with regard to the processing of personal medical data are discussed from (...) the existing privacy legislation. We will address the principle of consent (broad versus specific) and the type of data recorded (anonymous, encoded and identifiable) for both biobanks. (shrink)

Au début du mois d'août 1934, Husserl fut invité par Emanuel Radl à prendre part au huitième Congrès international de philosophie qui devait se tenir à Prague du 2 au 7 septembre de la même année. La situation politique allemande interdisait que Husserl et d'autres philosophes se rendissent à l'étranger, aussi Radl demanda-t-il à Husserl de lui envoyer une communication épistolaire destinée à être lue lors des débats. Husserl rédigea donc une lettre, la « Lettre pragoise » — qu'on lut (...) en séance et qui fut publiée d'abord dans le quotidien Prager Tageblatt, puis dans les Actes du colloque² —, mais, outre cela, un texte plus long consacré au même thème : la tâche actuelle de la philosophie. C'est ce texte dont on lira ici la traduction. De multiples péripéties et des circonstances diverses ont empêché que Husserl envoie à temps ce texte plus achevé; quelques indications données par lui-même dans sa correspondance³, avec Patocka notamment, montreni qu'il n'en était pas entièrement satisfait et qu'il souhaitait revoir au moins le début. Ces remaniements vont peu à peu déboucher sur la célèbre conférence de 1935 sur la crise des sciences européennes, qui est fort proche du présent texte bien que le point de départ n 'en soit plus désormais l'interrogation sur le rôle de la philosophie, mais la critique des sciences. Quoi qu'il en soit, la « conférence de Prague » inaugure la série des textes qui aboutiront à la dernière grande œuvre de Husserl, La Crise des sciences européennes et la phénoménologie transcendantale dont l'essai qu'on va lire est, en quelque sorte, la toute première esquisse. Cet article montre, plus précisément, que cette intelligence relationnelle du soi se développe chez Kierkegaard, Buber, Levinas et Marion à travers une reprise philosophique du modèle de l’homme devant Dieu. To do so, they have drawn heavily on the Judeo-Christian tradition, who had already paved the way in this direction. This paper shows, more precisely, that Kierkegaard, Buber, Levinas and Marion develop such relational understanding of the self through a philosophical recovery of the model of human being before God. But the problem is that such approach hardly recognizes a real consistency to the self. Une tentative d'élaborer une théorie de l'art des jardins tel qu'il s'est développé dans la tradition occidentale depuis les Grecs jusqu'à aujourd'hui.

Lors de son séjour à Berne, celui qui deviendra le plus grand philosophe de la réconciliation pense l’échec, voire l’impossibilité de toute réconciliation. Le jeune Hegel commence par affirmer la nécessité d’un retour aux sources de la réconciliation chrétienne; puis il s’interroge sur l’échec de la réconciliation proposée par le Christ, sur la persistance de l’irréconciliation, et sur la fausse réconciliation. La conclusion fait ressortir le thème du renversement d’une doctrine initialement pure et celui du remède contre la fausse réconciliation.

Karl Marx est censé avoir livré au monde une science nouvelle, le " socialisme scientifique ". Cette science démontrait la fatalité de l'effondrement prochain du mode de production capitaliste et, dans la foulée, d'une révolution qui conduirait l'humanité au collectivisme et puis au communisme. Cette thèse a soutenu l'espérance militante pendant plus d'un siècle en dépit des polémiques interminables qui l'ont accompagnée. Marc Angenot a choisi de prendre à bras le corps les Grands récits militants de toutes natures des (...) XIXe et XXe siècles ; il repense la question du " socialisme scientifique " en reconstituant l'histoire de la légitimation des remèdes ultimes aux maux sociaux, remontant aux prophètes romantiques fondateurs de " religions de l'humanité ". Exploitant des données largement ignorées ou oubliées de nos jours, il provoque des confrontations inattendues, réfute des idées toutes faites et montre des enchaînements qui renouvellent l'histoire des idéologies modernes. Une religion sensible et une religion populaire , la critique de la philosophie des Lumières et de la religion chrétienne, le modèle de la belle et pieuse cité grecque, une pensée du lien et de la conciliation, le sens du destin, tels sont quelques-uns des thèmes successivement abordés par Hegel. Enfin, nous verrons que la question de l’immédiateté distingue clairement la jeunesse de la maturité, et peut apparaître comme l’un des nœuds de la passion hégélienne pour la réconciliation.— Hegel was the most radical thinker of reconciliation . Hegel engaged in turn the themes of sentivive religion and popular religion , the criticism of the philosophy of the Enlightenment and of the Christian religion, the model of the beautiful worshipping Greek city, a thinking of the communal tie and of conciliation and the meaning of fate. Finally this paper looks at the question of immediacy : how young Hegel’s view of it sharply differs from the one he was to take later in life and how it can therefore be seen as one of the critical knots of the Hegelian passion for reconciliation. Deux grands philosophes français contemporains, deux regards sur la métaphysique. Le regard de Dominique Janicaud propose de préserver l'inquiétude métaphysique, sans les excès de la métaphysique, avec l'intention d'ébaucher des tâches nouvelles. Le regard de Jean-François Mattéi tente d'instaurer une nouvelle métaphysique, pour réaliser à la fois la conservation et le dépassement de la métaphysique ancienne. Nous ne pouvons pas en rester à la métaphysique. Mais nous ne pouvons pas non plus nous passer de la métaphysique. Nous vivons dans cet (...) inconfort. Janicaud et Mattéi sont conscients de la situation. Le chemin de Janicaud passe par la pensée de la contiguïté et par l'intelligence du partage. Le chemin de Mattéi veut nous conduire vers une renaissance de la métaphysique, qui ne se distinguerait pas d'une critique radicale de la métaphysique. Ces deux chemins s'appellent et se répondent. Ils s'excluent et se complètent. Ils sont, peut-être, les deux seuls chemins possibles pour la métaphysique aujourd'hui. Cet essai interroge tantôt la pensée de Janicaud, tantôt la pensée de Mattéi, tantôt les deux pensées ensemble. Il s'articule autour d'une thèse centrale, qui rassemble les deux pensées, et nous indique la direction à suivre : celle du souci de la métaphysique, dans le double sens de sa critique radicale et de son renouveau. Depuis ses premiers travaux pour élaborer une phénoménologie de la volonté jusqu’à son tout dernier écrit inachevé sur la mort, Paul Ricoeur a médité sur le problème du mal. Or, à l’intime de sa vie, une épreuve terrible l’a frappé, celle du suicide de l’un de ses fils. L’article tente d’évaluer en quoi la pensée de Ricoeur sur le mal s’est modifiée et approfondie à la suite de ce malheur. Il repère plusieurs déplacements. Même si toute l'expression humaine ne saurait se réduire à l'esthétique littéraire et cinématographique, celle-ci n'en occupe pas moins une place importante dans ce qui révèle le sentiment de l'homme dans son adhésion à l'existence, aussi élaboré soit le cri qu'explicite et déploie cette expression. Liées à des moments de l'histoire, ces formes d'expression les expriment en même temps qu'elles s'en distancient, disant, de façon originale en chaque oeuvre ou en chaque courant, cette résistance de l'humanité à ce qui normalement (...) devrait l'anéantir.
