Informed consent is recognized as a primary ethical requirement to conduct research involving humans. In the investigations with the use of human biological material, informed consent (IC) assumes a differentiated condition on account of the many future possibilities. This work presents suitable alternatives for IC regarding the storage and use of human biological material in research, according to new Brazilian regulations. Both norms – Resolution 441/11 of the National Health Council, approved on 12 May 2011, and Ordinance 2.201 (NATIONAL GUIDELINES (...) FOR BIOREPOSITORIES AND BIOBANKS OF HUMAN BIOLOGICAL MATERIAL FOR RESEARCH PURPOSE) of the Brazil Ministry of Health, approved on 14 September 2011 – state that the consent of subjects for the collection, storage and use of samples stored in Biobanks is necessarily established by means of a Free and Informed Consent Form (ICF). In order to obtain individual and formal statements, this form should contain the following two mutually exclusive options: an explanation about the use of the stored material in each research study, and the need for new consent or the waiver thereof when the material is used for a new study. On the other hand, ICF suitable for Biorepositories must be exclusive and related to specific research. Although Brazilian and international regulations identify the main aspects to be included in the IC, efforts are still necessary to improve the consent process, so that the document will become a bond of trust between subject and researcher. A new Clinical Ethics Advisory Group was created to contribute to NHS Trust policies and guidelines in response to ethical issues arising from the COVID-19 pandemic. An ethical analysis framework used in medical education, the CoRE-Values Compass and Grid, was adapted to form a step-wise ‘ABC’ decision-making process. CEAG members found the framework simple to understand and use and the model facilitated time-efficient decisions that were explicitly justifiable on moral, ethical, professional and legal grounds. The adapted CoRE-Values framework might help (...) facilitate decision-making processes for similar new clinical ethics advisory or support committees. (shrink)

Gideon Rosen (2014) has drawn our attention to cases of duress of a particularly interesting sort: the person's ‘mind is not flooded with pain or fear’, she knows exactly what she is doing, and she makes a clear-headed choice to act in, as Rosen says, ‘awful ways’. The explanation of why we excuse such actions cannot be that the action was not voluntary. In addition, although some duress cases could also be viewed as necessity cases and thus as justified, Rosen (...) wisely sets aside that complicating factor by zeroing in on those cases where the action clearly is not justified. So why do we excuse in these cases, where the action is not justified and the agent acted voluntarily?Rosen thinks the key lies in the ‘ill will’ condition, ‘the idea that an act is blameworthy only if it manifests insufficient concern or regard for those affected’. He says this is relatively uncontroversial; much of my paper is taken up with calling the ‘ill will’ condition into question. I also take issue with Rosen on just how justifications and excuses differ. I argue in favour of understanding justifications (in a context where we are asking how justifications and excuses differ) as not requiring truth, but only reasonable belief. (shrink)

In this comment Ichallenge two of the arguments made in the paper, “Toward the Feminine Firm.” First I challenge the claim that Gilligan’swork on gender differences in moral orientation provides a logically and empirically sound foundation for an alternative theory of the firm. I cite recent work that discredits any concise notion of a feminine ethic. Second I challenge the claim that, if such a firm were to exist, it would flourish in a competitive market economy. This paper begins by summarizing and distilling Macintyre's sweeping critique of modern business. It identifies the crux of Macintyre's critique as centering on the fundamental Aristotelian concepts of internal goods and practices. Maclntyre essentially follows Aristotle in arguing that by privileging external goods over internal goods, business activity -and certainly modern capitalistic business activity -corrupts practices. Thus, from the perspective of virtue ethics, business is morally indefensible. The paper continues with an evaluation of Macintyre's arguments. The conclusion is drawn that (...) Macintyre's critique, although partially valid, does not vitiate modern business as he claims. In short, modern business need not of necessity be antithetical to individuals' pursuit of internal goods within practices. (shrink)

The article begins with a brief history of aesthetic theory. Particular attention is given to the postructuralist ‘aesthetic return’: the resurgence of interest in aesthetics as an ontological foundation for human being-in-the-world. The disordered individual-as-emergent-artist-and-artifact, who is at the centre of this ‘aesthetic return’, is then translated into the ‘dis’-organization that is the firm. The firm is thus defined in terms of its primal sensory impact on the world. It invokes a myriad of aesthetic relations between its disorganized self and (...) others: its essence resides within these relations; its power of being is determined by its ability to project a unified aesthetic ideal – a ‘mirror fantasy’. The firm thus emerges as a style: where style is defined as an organizing – a sculpting – of aesthetic chaos. In order to achieve a grand style, the firm projects itself through time as a unified aesthetic ideal; as an ongoing work of art. The article concludes with a discussion of how this aesthetic theory of the firm relates to other accepted theories of the nature and purpose of business organizations. (shrink)

Recent studies show that returning global health trainees often report having felt inadequately prepared to deal with ethical dilemmas they encountered during outreach clinical work. While global health training guidelines emphasize the importance of developing ethical and cultural competencies before embarking on fieldwork, their practical implementation is often lacking and consists mainly of recommendations regarding professional behavior and discussions of case studies. Evidence suggests that one of the most effective ways to teach certain skills in global health, including ethical and (...) cultural competencies, is through service learning. This approach combines community service with experiential learning. Unfortunately, this approach to global health ethics training is often unattainable due to a lack of supervision and resources available at host locations. This often means that trainees enter global health initiatives unprepared to deal with ethical dilemmas, which has the potential for adverse consequences for patients and host institutions, thus contributing to growing concerns about exploitation and “medical tourism.” From an educational perspective, exposure alone to such ethical dilemmas does not contribute to learning, due to lack of proper guidance. We propose that the tension between the benefits of service learning on the one hand and the respect for patients’ rights and well-being on the other could be resolved by the application of a simulation-based approach to global health ethics education. This paper identifies the ultimate justification for business activity as an aesthetic justification. Aesthetics, loosely defined as the appreciation of beauty, subsumes both ethics and economics within an holistic justificatory mechanism for business decisions. Five essential qualities of aesthetic judgment are identified: disinterest, subjectivity, inclusivity, contemplativity, and internality. The quality of aesthetic judgment, exercised by the individual through the organization, will determine the extent to which business activity enhances quality of life.

This book advocates for the philosophical import of care in re-evaluating problems of humanitarianism in the context of the ongoing international refugee and forced migration situation. In doing so, it rethinks the human capacity to care about the suffering of distant others. At a time when emotional resources are running low, there is a need to recast what it means to care, with the aim of generating a productive movement against the rise of value fundamentalism globally—embraced in mantras of ‘good (...) and evil’ and ‘us and them’—and to confront xenophobia and oppressive politics. The author draws upon a wide array of rich traditions, including historical and contemporary writings on self-care and care of the other, to re-examine the intersection of care ethics and justice. She also rethinks the relationship between care and contestation, here analyzed in the aesthetic, ethical, political, and religious domains of human experience. From within the context of this contingent historical repetition of political oppression, the book constructs a reminder not only of what it feels like to care, but how and why we should act upon our care. Care Ethics and the Refugee Crisis is an important contribution to the growing literatures on care ethics and immigration/forced migration in philosophy. In her article, "Is Depression Sin? A Philosophical Examination of Christian Voluntarism," Anastasia Phillippa Scrutton has offered a thoughtful contribution to the philosophical literature regarding depression and freedom of the will. Her analysis provides a careful and well-organized review of the position, prevalent in some Christian literature, that depression is within the individual's control and is thus a sin. She describes various components of this view, which she labels Christian voluntarism, and distinguishes it from more moderate versions of free will, (...) in its assumptions that nearly all persons in all situations possess total freedom, and thus the inherent ability to prevent or to overcome depression.... This paper challenges Alasdair MacIntyre’s assertion that the modern firm — such as Google, Unilever, or Microsoft — is inimical to human flourishing within an Aristotelian framework. The paper begins by questioning MacIntyre’s rendering of utopian communities. It then addresses four specific criticisms of the modern firm to be found throughout MacIntyre’s oeuvre, namely compartmentalisation, myopia, inequality, and loss of community. Arguments are made to the effect that these criticisms do not vitiate the institutional role of the modern firm in (...) an Aristotelian context. The paper concludes with an invocation of the modern firm as institutional ideal within an evolving utopian vision of human flourishing. This is a utopian vision in which the modern firm plays a constructive, not corruptive, institutional role. (shrink)

It is widely agreed that the top three Model Penal Code culpability levels suffice for criminal liability, but the fourth is controversial. And it isn’t just the particular MPC wording; that negligence should be on the list at all is controversial. My question is: What makes negligence so different? What is it about negligence that gives rise to the view that it should not suffice for criminal liability? In addressing it, I draw attention to how we conduct the debate, and (...) how our framing of the issues is shaping it. My hope is to prompt thought and discussion on just what we want the element of mens rea to provide, and to draw attention to background assumptions that shape our views of what it should take for negligence to count as a species of mens rea. A obra pretende discutir essas e outras questões.

In this article, we describe the social and economic changes that have contributed to contemporary problems of work—family conflict, gender inequality, and risks to children's healthy development. We draw on feminist welfare state scholarship to outline an institutional arrangement that would support an earner—carer society—a social arrangement in which women and men engage symmetrically in paid work and unpaid caregiving and where young children have ample time with their parents. We present a blueprint for work—family reconciliation policies in three areas—paid (...) family-leave provisions, working-time regulations, and early childhood education and care—and we identify key policy design principles. We describe and assess these work—family reconciliation policies as they operate in six European countries widely considered to be policy exemplars: Denmark, Finland, Norway, Sweden, Belgium, and France. During the past decade ethical theory has been in a lively state of development, and three basic approaches to ethics - Kantian ethics, consequentialism, and virtue ethics - have assumed positions of particular prominence.

This article argues that the mid-1960s saw a dramatic shift in how ‘brainwashing’ was popularly imagined, reflecting Anglo-American developments in the sciences of mind as well as shifts in mass media culture. The 1965 British film The Ipcress File provides a rich case for exploring these interconnections between mind control, mind science and media, as it exemplifies the era’s innovations for depicting ‘brainwashing’ on screen: the film’s protagonist is subjected to flashing lights and electronic music, pulsating to the ‘rhythm of (...) brainwaves’. This article describes the making of The Ipcress File’s brainwashing sequence and shows how its quest for cinematic spectacle drew on developments in cybernetic science, multimedia design and modernist architecture. I argue that often interposed between the disparate endeavours of 1960s mind control, psychological science and media was a vision of the human mind as a ‘cybernetic spectator’: a subject who scrutinizes how media and other demands on her sensory perception can affect consciousness, and seeks to consciously participate in this mental conditioning and guide its effects. Tendo como fundamento as bases epistemológicas que emergem do contexto latino-americanos por meio de pensadores como Educardo Restrepo, Axel Rojas, Erick Torrico Villanueva e Catherine Walsh, é realizada uma análise de duas encíclicas e duas exortações apostólicas de Papa Francisco. O objetivo da análise é identificar como e em que aspectos o pensamento de Papa Francisco é influenciado pelo pensamento decolonial. A escolha pela (...) figura de Papa Francisco deve-se ao fato, de que vindo da América do Sul, pela sua experiência de vida e pela formação recebida pode ser considerado uma voz ativa em nível mundial em favor das periferias do mundo. When God gave humankind dominion over the earth he may not have known exactly what we would be able to do with it. The technical capacities to which the production and reproduction of our everyday life have given rise have grown at an astonishing and, it seems, ever-increasing rate. The instruments that we use to do work on the world have become sharper and more refined, and the implications of human interventions in the nonhuman environment are much more far-reaching than (...) could have been imagined even forty years ago. It has become something of a cliche to say that our technical abilities have outstripped the wisdom to know when, where, and how we should appropriately use them, but techniques such as genetic engineering invite the dusting-off of the cliche and the asking of the question implicit in it: We know we can splice genes, but should we splice them? We might of course come to the conclusion that we should only splice some of them some of the time, but even arriving at that conclusion presupposes that the ethical question has been asked and answered. What is the relation between shame and shamelessness? It may seem obvious: shamelessness is simply the absence of shame. But on reflection, it becomes clear that the story is considerably more complicated. Michelle Mason's intriguing "On Shamelessness" prompts such reflection. Mason argues that we should be mindful of the "moral importance of shame" and "unapologetic in its defense", and she does so via an examination of shamelessness and an argument to the effect that shamelessness is a moral fault. The tacit (...) assumption is that insofar as shamelessness is a moral fault, the value of shame is vindicated. I challenge that assumption. (shrink)

Anniversaries and funding crises prompt periodic calls to reevaluate the mission and public perceptions of the U.S. Land-Grant University system. One such call was issued by the Kellogg Commission on the Future of State Colleges and Land Grant Universities in their 1999 report, “Returning to Our Roots: the Engaged Institution.” Written by leaders of state universities and land-grant colleges, this report urges these institutions to engage more authentically and equitably in two-way relationships with their local constituents. Twenty years later, Land-Grant (...) Universities continue to struggle with building widespread public support for their missions and equitable involvement in research, teaching, and extension functions across diverse constituencies. While largely discounted by the Kellogg Commission, a fresh look at the role originally envisioned for the extension arm of the trifold land-grant mandate suggests that we may be conceiving of this system too narrowly. The establishment of statewide extension systems was once seen as a way to ensure that Land-Grant Universities would be accessible and responsive to all of a state’s residents. Extension systems continue to offer a front-door to a major public university in almost every county of the United States, but they tend to be viewed primarily as a way to translate science or distribute information from the university to the public. This discussion uses a historical and modern lens to reimagine the role that Extension could potentially play in catalyzing reciprocal, co-learning relationships between Land-Grant Universities and their diverse local constituencies. This paper addresses the leitmotif of Alan Holland's work, which is argued here to be a defence of the existence and worth of nonhuman nature. Definitions of politics have always depended on the idea of nature as a contrasting non-political realm, usually turning on the centrality of speech. Referencing the work of Aristotle, Kant and Bentham, I suggest that the instability of the distinction between the human and the nonhuman means that politics, as 'thing and activity', must itself be unstable. The question of whether there can be a politics without nature is explored through an analysis of the work of Latour, and the conclusion is reached that listening may well be just as important as speaking. This article revisits a forgotten, late project by the social psychologist Stanley Milgram: the ‘cyranoid’ studies he conducted from 1977 to 1984. These investigations, inspired by the play Cyrano de Bergerac, explored how individuals often fail to notice when others do not speak their own thoughts, but instead relay messages from a hidden source. We situate these experiments amidst the intellectual, cultural, and political concerns of late Cold War America, and show how Milgram’s studies pulled together a variety of ideas, (...) anxieties, and interests that were prevalent at that time and have returned in new guises since. In discussing the cyranoid project’s background and afterlife, we argue that its strikingly equivocal quality has lent itself to multiple reinterpretations by historians, psychologists, performers, artists, and others. Our purpose is neither to champion Milgram’s work nor to amplify the critiques already made of his methods. Rather, it is to consider the uncertain, allusive, and elusive aspects of the cyranoid project, and to seek to place that project in context, whilst asking where ‘context’ might end. We show how the experiments’ range of meanings, in different temporal registers, far exceeded the explanatory rubric that Milgram and his intellectual critics provided at that time, and ponder the risk for the historian of making anachronistic or teleological assumptions. In short, we argue, cyranoids invite our open-ended exploration of ‘voices offstage’ in social and psychological relations, and offer a useful tool for thinking about historical context and the nature of historical interpretations. I argue that Hume's ethics can be characterized as a virtue ethics, by which I mean a view according to which character has priority over action and the principles governing action: virtuous character guides and constrains practical deliberation. In a traditional utilitarian or Kantian ethics, character is subordinate to practical deliberation: virtue is needed only to motivate virtuous action. I begin by outlining this approach in Aristotle's ethics, then draw relevant parallels to Hume. I argue that virtuous character in Aristotle (...) is understood in terms of "self-love." A true self-lover enjoys most the exercise of the characteristic human powers of judging, choosing, deciding and deliberating. A virtuous agent's self-love enables sizing up practical situations properly and exhibiting the virtue called for by the situation. But if an agent's character is defective, the practical situation will be misapprehended and responded to improperly. I argue that though Hume claims moral judgments are the product of sympathy, they are actually the result of a complex process of practical reflection and deliberation. Although Hume writes as though anyone can be a judicious spectator, there is reason to think that persons of calm temperament, who enjoy deliberation and have a facility for it, are more likely to perform the corrections in sentiments that may be necessary. If this is so, an agent's character has priority over his or her practical deliberations. (shrink)

On a view derived from Plato and Aristotle, being virtuous involves entrenched, wide-ranging dispositions not only to reason and act, but also to respond and feel. Because affective responses are crucial to being virtuous, Plato and Aristotle thought that it made all the difference how we are brought up. For Aristotle, this is matter of habituation: we learn by doing. What is it that we do when we learn by doing? There is no specific act associated with any virtue, so (...) the answer cannot be that we perform the same kind of action countless times. Moreover, being virtuous involves caring sufficiently about someone or something such that we want to be virtuous. These remarks suggest that habituation is not a straightforward matter. I argue that we become virtuous not by performing actions stereotypically associated with the virtues, but by engaging in activities that give rise to the right loves and attachments. These attachments are the psychological grounding of virtue; without them, having a virtuous character is not possible. (shrink)

This paper applies Alain Badiou’s ethic-of-truths to the context of business ethics. Business ethics is redefined as self-regarding, aspirational, and internal to a given firm. Firms are defined as sites. The event is a radical innovation experienced by a given firm. Ethics emerges as the challenge of fidelity to the truths engendered by the event.
