Das Ideal einer vorhersagenden Medizin in Kombination mit wirkungsvollen, kausalen Strategien der Prävention auf molekularer Ebene ist noch immer weit davon entfernt, klinische Realität zu werden. Es ist jedoch schon heute festzustellen, dass zwischen Medizin und Gesellschaft verhandelte Konzepte von Gesundheit in immer stärkerem Maße auf zukünftige Gesundheit ausgerichtet sind, mithin einen immer präventiveren Charakter aufweisen. Der vorliegende Beitrag untersucht die Frage, ob neue Konzepte einer prädiktiv-präventiven Medizin – insbesondere Public Health Genetics bzw. Public Health Genomics – das Kriterium der (...) Verbesserung der sozialen Erreichbarkeit von Gesundheit erfüllen. Diese Analyse wird vor dem Hintergrund der Rolle sozialer Grundwerte, insbesondere dem der Gerechtigkeit, für Funktionen der Medizin in unserer Gesellschaft einerseits sowie der Bedeutung des Wandels der medizinischen Schlüsselkonzepte „Gesundheit“ und „Krankheit“ andererseits vorgenommen. Novel immune therapies are increasingly based on the molecular differentiation of disease patterns. The related clinical studies are thus more often characterized by the so-called adaptive study designs (umbrella or basket studies including platform studies), which are continuously adjusted based on novel results. This paper analyses new study designs beyond the often-postulated need for regulation in order to identify ethical problems based on typical structural features and to—whenever possible—suggest solutions. To do so, it addresses the following topics: the relationship between (...) social and scientific values of a study as well as aspects of the scientific validity of new forms of evidence; the inclusion of study subjects under the condition of relative uncertainty; specific challenges in the process of ethical approval, and ethical and practical challenges in the process of informing patients and receiving informed consent. Additionally, the topic of a potential risk–benefit assessment of such therapies is addressed. (shrink)

Rationalities of Knowledge Production: On Transformations of Objects, Technologies and Information in Biomedicine and the Life Sciences. Since decades, scientific change has been interpreted in the light of of paradigm shifts and scientific revolutions. The Kuhnian interpretation of scientific change however is now more and more confronted with non‐disciplinary thinking in both, science and studies on science. This paper explores how research in biomedicine and the life sciences can be characterized by different rationalities, sometimes converging, sometimes contradictory, all present at (...) the same time with varying ways of influence, impact, and visibility. In general, the rationality of objects is generated by fitting new objects and findings into a new experimental context. The rationality of hypotheses is a move towards the construction of novel explanatory tools and models. This is often inseparable meshing with the third, the technological rationaliy, in which a technology‐driven, self‐supporting and sometimes self‐referential refinement of methods and technologies comes along with an extension into other fields. During the second and the third phase, the new and emerging fields tend to expand their explanatory reach not only across disciplinary boundaries but also into the social sphere, creating what has been characterized as “exceptionalism” (e.g. genetic exceptionalism or neuro‐exceptionalism). Finally, recent biomedicine and life‐sciences reach a level in which experimental work becomes more and more data‐driven because the technologically constructed experimental systems generate a plethora of findings (data) which at some point start to blur the original hypotheses. For the rationality of information the materiality of research practices becomes secondary and research objects are more and more getting out of sight. Finally, the credibility of science as a practice becomes more and more dependent on consensus about the applicability and relevance of its results. The rationality of interest (and accountability) has become more and more characteristic for a research process which is no longer primarily determined by the desire for knowledge but by the desire for relevance. This paper explores in which ways object‐driven and hypotheses‐driven experimental life‐sciences transformed into domains of experimental research evolving in a technologically constructed, data‐driven environment in which they are subjected to constant morphing due to the forces of different rationalities. A philosopher and a lawyer-economist examine the challenges of the last third of life. They write about friendship, sex, retirement communities, inheritance, poverty, and the depiction of aging women in films. These essays, or conversations, will help readers of all ages think about how to age well, or at least thoughtfully, and how to interact with older family members and friends.

John Rawls argues, in The Law of Peoples , that a principle of toleration requires the international community to respect `decent hierarchical societies' that obey certain minimal human rights norms. In this article, I question that line of argument, using women's inequality as a lens. I show that Rawls's principle would require us to treat the very same practices of the very same entity differently if it happens to set up as an independent nation rather than a state within a (...) nation, and I criticize the consequences to which this asymmetry leads. I argue that Rawls gives us no good reason to think that we cannot justify a much richer set of norms for all the world's societies. I argue, however, that issues of justification should be sharply distinguished from issues of implementation, and that respect for the moral significance of national sovereignty ought to restrain us from intervention in all but the most extreme cases. The essays in this volume were written to celebrate the sixtieth birthday of G. E. L. Owen, who by his essays and seminars on ancient Greek philosophy has made a contribution to its study that is second to none.

In 55 B.C. Pompey staged a combat between humans and elephants; the elephants were slaughtered en masse. Moved by their piteous trumpetings, the audience protested—feeling, says Cicero, that there was a certain community, between elephants and themselves. As Sorabji notes, this recognition of belonging is inconsistent with the Stoic thesis that our moral affiliations embrace only the human kind. Cicero as letter-writer allows himself a qualm that his philosophical stance refuses.

Valadez’ book is an excellent investigation of the question of group rights. Nonetheless, there are some serious objections to group rights that he does not investigate. Groups contain hierarchies of power: thus giving legal privileges to a group is usually tantamount to giving more power to those already in power within the group. Groups have unclear and changing boundaries of membership; group rights often reify the current definition of a group and militate against change. Finally, there are ‘dispersed groups’ that (...) may be very important in people’s identity, but that do not figure in the usual discussions of group ethno-cultural rights; the group of women, groups defined by sexual orientation, profession or the love of something. Such groups are unlikely to win legal privileges but then, giving legal privileges to the ethno-cultural groups makes them more salient by contrast with the ‘dispersed groups’. I investigate these points, using a variety of examples. (shrink)

Philipp Mayring und Norbert Rath greifen zentrale Fragen der heutigen Zeit auf: Was ist Glück? Woher kommt Glück? Wie kann man Glück erreichen? Zunächst geht es um klassische philosophische Ansätze – was verstehen antike Denker wie Demokrit, Platon, Aristoteles und Epikur sowie neuzeitliche Philosophen wie Montaigne, Kant, Hegel, Nietzsche, Freud und Adorno darunter? Es zeigt sich die Historizität der Glückskonzepte und die Notwendigkeit einer Kritik am »falschen« Glück. Psychologische Konzepte von Glück sind ebenso schillernd. Sie untersuchen empirisch, wie subjektive (...) Glücksgefühle zustande kommen, welche emotionalen, kognitiven und handlungsbezogenen Prozesse ihnen zu Grunde liegen und in welchen Situationen sich Menschen glücklich fühlen. Auch hier erscheint ein kritischer Standpunkt notwendig: Kritik an unterschiedlichen Glücksdefinitionen, Kritik an Erhebungsinstrumenten und Kritik an der Instrumentalisierung und Kommerzialisierung von Forschungsergebnissen. Gerade im Blick auf eine neuerdings weit verbreitete Positive Psychologie besteht ein Ideologieverdacht: Könnte es sich hier um kaum einlösbare Versprechungen einer affirmativen psychologischen Glücksforschung handeln? Philipp Mayring und Norbert Rath gehen diesen Fragen im Dialog zwischen Philosophie und Psychologie nach. Trotz der unterschiedlichen Herangehensweisen und Perspektiven der beiden Autoren zeigen sich erstaunliche Übereinstimmungen hinsichtlich einer kritischen Theorie des Glücks. (shrink)

Los feministas han sostenido algunas veces que las teorías filosóficas de la justicia que provienen de la tradición liberal no pueden tratar adecuadamente las preocupaciones de las mujeres. Yo sostengo que de muchas maneras este argumento está errado: las mejores teorías liberales de la justicia proporcionan una base muy fuerte para pensar acerca de lo que requiere el respeto por la dignidad humana. Sin embargo, hay dos áreas pertinentes a la igualdad sexual en las cuales incluso las teorías liberales más (...) fuertes hallan graves dificultades. La primera es el área de la necesidad y la dependencia. Ninguna de las teorías de la justicia y la moralidad que provienen de la tradición europea del contrato social logra introducir en la estructura social básica la preocupación por el cuidado en tiempos de dependencia asimétrica. El segundo problema que investigo es aquél de la distribución justa al interior de la familia. Centrándome en la teoría de John Rawls, sostengo que suc ompromiso liberal de ver a la familia como una esfera de elección personal protegida se halla en tensión con su afirmación de que la familia es parte de la "estructura básica" de la sociedad. Asimismo, la familia no existe por naturaleza, es siempre algo construido por la acción estatal. El Estado debería, por ende, asegurar que esta construcción se haga bien, de modo compatible con la justicia para mujeres y niños. (shrink)

This interdisciplinary volume of contributed essays focuses on issues of gender in the British novel of the eighteenth and nineteenth centuries, particularly Hardy and Trollope. Approaching the topic from a variety of backgrounds the contributors reinvigorate the law-and-literature movement by displaying a range of ways in which literature and law can illuminate one another, and in which the conversation between them can illuminate deeper human issues with which both disciplines are concerned.

Cass Sunstein and Martha Nussbaum bring together an all-star cast of contributors to explore the legal and political issues that underlie the campaign for animal rights and the opposition to it. Addressing ethical questions about ownership, protection against unjustified suffering, and the ability of animals to make their own choices free from human control, the authors offer numerous different perspectives on animal rights and animal welfare. They show that whatever one's ultimate conclusions, the relationship between human beings and nonhuman (...) animals is being fundamentally rethought. ABSTRACT:The relationship between equality and equity has been theorized and described in many ways. Recently, this relationship has been popularly illustrated via a meme depicting three people watching a baseball game while standing on boxes. The meme's analogy, that achieving health equity is the ability to view a spectator sport, is a neoliberal account of health. The analogy defines equality at the expense of equity, characterizes health as individualistic, describes health equity as a static outcome, and implies that the bioethical (...) questions for achieving health equity are about the distribution and redistribution of resources. As the SARS CoV-2 pandemic vividly reminded us, health equity is no spectator sport. Health equity is the intentional removal of obstacles to health and the enabling of human flourishing to assure that everyone has fair and just opportunities for health. That relational and radical account of health equity requires different analogies. This article reimagines and re-illustrates the relationship between equality and equity using an organic analogy of three plants. The analogy calls for bioethics to nurture communal relationships and engage community leaders in pursuit of communal flourishing. (shrink)

: In this commentary on Eva Feder Kittay's Love's Labor: Essays on Women, Equality, and Dependency, I focus on Kittay's dependency theory. I apply this theory to an analysis of women's inadequate access to high-quality, cost-effective healthcare. I conclude that while quandaries remain unresolved, including getting men to do their share of dependency work, Kittay's book is an important and original contribution to feminist healthcare ethics and the development of a normative feminist ethic of care.
