In Athens and other ancient cultures, a woman, whatever her status and whatever her age or social class, was, in law, a perpetual minor. Throughout her life, she was in the legal control of a guardian who represented her in law. Rape, as unlawful carnal knowledge of a woman, warranted a capital charge in the Graeco-Roman world. It still carries a capital charge in some societies and is considered a felony in others. As for adultery, it may be prosecuted in (...) some cultures while in others it is a matter to be decided by the family council. This paper examines laws concerning the abuse of and exploitation of women in ancient and modern societies, especially within the context of their biologically determined roles and sexual culture. It also seeks to establish the socio-legal rights of women, especially those who were traumatised and sexually abused. The research method is mainly content analysis. It employs sources such as legal evidence in the form of recorded speeches of the Attic orators along with literary accounts, historical or legendary and epigraphic inscriptions. (shrink)

Why has autonomy been a leading idea in philosophical writing on bioethics, and why has trust been marginal? In this important book, Onora O'Neill suggests that the conceptions of individual autonomy so widely relied on in bioethics are philosophically and ethically inadequate, and that they undermine rather than support relations of trust. Towards Justice and Virtue challenges the rivalry between those who advocate only abstract, universal principles of justice and those who commend only the particularities of virtuous lives. Onora O'Neill traces this impasse to defects in underlying conceptions of reasoning about action. _Purpose__._ This article aims at outlining the socio-communicative prerequisites for the influence of personality on the acquisition of rigorous scientific knowledge. _Theoretical__ basis__._ The communicative foundations of an individual’s activity in general and the functioning of his consciousness in particular were laid by the philosophy of Edmund Husserl, primarily due to his introduction of the concepts of "intersubjectivity" and "lifeworld". From these positions, attempts were made to understand the discussion of Karl Popper and Thomas Kuhn regarding the role of the (...) individual in science, in particular, the concept of a "normal scientist" as a participant in the lifeworld of scientists who support special intersubjective norms of reproduction of this lifeworld through scientific communication. The concept of "communicative mind", correlated with the philosophy of Jürgen Habermas, best expresses the rational and argumentative principles of achieving consensus in science. _Originality__._ Social anthropology reveals the constitutive significance of teamwork in science as a way of achieving rigorous scientific knowledge. Social phenomenology concretizes this by emphasizing the need for constant improvement of the rules of this communication. The verification of scientific knowledge by facts is strictly determined by the observance of community-recognized scientific tools for achieving such verification, in particular, the conventional agreement within a certain community of scientists regarding the language of science, which is used to describe verification, falsification, and other procedures for organizing scientific knowledge into a system. _Conclusions._ Verification of the obtained scientific knowledge critically depends on the formulation, dissemination and observance of certain institutional rules of scientific communication. This applies, in particular, to the conventionally recognized rules for the verification of scientific knowledge by empirical facts: it is not an isolated scientist who should identify, verify, organize and evaluate empirical facts, but a community of scientists who conduct scientific research in an organized manner. Team scientific work is a special case of collective action, which is characterized by a high level of reflection and application of critical thinking on a communicative basis. In particular, the legitimation of acquired scientific knowledge occurs in the process of scientific research due to the observance of procedural rules and careful work with empirical facts. Many corporations are large, powerful, and wealthy. There are massive shortfalls of global justice, with hundreds of millions of people in the world living below the threshold of extreme poverty, and billions more living not far above that threshold. Where injustice and needs shortfalls must be remediated, we often look towards agents’ capabilities to determine who ought to bear the costs of rectifying the situation. The combination of these three claims grounds what I call a ‘linkage-based’ account of why corporations (...) have demanding positive duties to the global poor. In this paper, I put forward a distinctive linkage-based account of corporations’ positive duties centred on the idea of dependence and the importance of meeting agents’ core needs. In addition to outlining and defending this account, I will show that we can utilise its basic conceptual components to make headway on questions that have received insufficient attention in the business ethics literature; specifically, we can say something substantive about the weighting of needy agents’ competing claims to assistance, and about the limits to the demands that can be lodged against corporations on the basis of others' unmet needs. Having integrated considerations of duties' grounding, their comparative weight, and the limits of their demandingness into a single account of corporate positive duty, I conclude by discussing a challenge to attributing to corporations duties owed to the worst-off amongst the global poor. This paper presents a literature review on the ethics of self-tracking technologies which are utilized by users to monitor parameters related to their activity and bodily parameters. By examining a total of 65 works extracted through a systematic database search and backwards snowballing, the authors of this review discuss three categories of opportunities and ten categories of concerns currently associated with self-tracking. The former include empowerment and well-being, contribution to health goals, and solidarity. The latter are social harms, privacy and (...) surveillance, ownership control and commodification of data, autonomy, data-facilitated harm, datafication and interpretability of data, negative impact on relation to self and others, shortcomings of design, negative impact on health perception, and regulation and enforcement of rules. The review concludes with a critical analysis of the existing literature and an overview of a future research agenda that could complement the current work on ethics of self-tracking. (shrink)

_Purpose._ The paper is aimed at identifying the ways of scientist’s influence on the development of modern society as compared to those of intellectuals. _Theoretical basis._ The socio-anthropological approach to the role of scientists in post-industrial society shows the leading role of people of science as a social group in present-day society. However, philosophical axiology reveals that scientists in today’s society do not have the appropriate social status: neither in state governance nor in the sphere of forming public opinion. The (...) classical doctrine concerning intellectuals has suffered a crisis in recent decades, which is due to the growing gap between the group of intellectuals recognized by society and the sphere of science. A new theoretical approach to determining the role of present-day research scientists as intellectuals is necessary. _Originality._ Successful development of modern society in conditions of growing social turbulence necessitates the access of research scientists to the sphere of public communication. This is required both by the needs of science advancement itself – to receive its adequate funding and win wide public recognition, and by society’s needs – as it is scientists who can provide reliable diagnostics of social problems and formulate well-grounded programs for overcoming them. _Conclusions._ For overcoming social barriers and getting access to public space, scientists themselves have to recognize themselves as a destitute social group – those who are unfairly deprived of making principal decisions in today’s society. For that, scientists should become modern intellectuals. Unlike media intellectuals, scientists are to interact not with social masses but, first and foremost, with public elites. The scientist has to gain his/her independent status by achieving the recognition of his/her own ideas among social elites rather than by winning wide personal popularity. Hence, scientists must aim at obtaining the status of the elite for elites – this would reveal in scientists the deepest potential of a modern man. (shrink)

Knowledge aims to fit the world, and action to change it. In this collection of essays, Onora O'Neill explores the relationship between these concepts and shows that principles are not enough for ethical thought or action: we also need to understand how practical judgement identifies ways of enacting them and of changing the way things are. Both ethical and technical judgement are supported, she contends, by bringing to bear multiple considerations, ranging from ethical principles to real-world constraints, and while we (...) will never find practical algorithms - let alone ethical algorithms - that resolve moral and political issues, good practical judgement can bring abstract principles to bear in situations that call for action. Her essays thus challenge claims that all inquiry must use either the empirical methods of scientific inquiry or the interpretive methods of the humanities. This paper explores how to deliberate about food choices from a Stoic perspective informed by the value of environmental sustainability. This perspective is reconstructed from both ancient and contemporary sources of Stoic philosophy. An account of what the Stoic goal of “living in agreement with Nature” would amount to in dietary practice is presented. Given ecological facts about food production, an argument is made that Stoic virtue made manifest as wisdom, justice, courage, and temperance compel Stoic practitioners to select locally (...) sourced, low resource input, plant-based foods whenever circumstances allow. Over 1000 companies have either curtailed or else completely ceased operations in Russia as a response to its invasion of Ukraine, a mass corporate exodus of a speed and scale which we’ve never seen. While corporate withdrawal appears to have considerable public support, it’s not obvious that it has done anything to hamper the Russian war effort, nor is it clear what the long-run effects of corporate withdrawal as a regularised response to war might be. Given this, it’s important the (...) evaluate the ethical merits of such a response. In this paper I critique what I take to be the two most common arguments given in favour of voluntary corporate withdrawal, which I label ‘the instrumental argument’ and ‘the clean hands argument’ respectively. After illustrating their shortcomings, I reframe corporations’ predicament as a ‘spattered hands’ case—one where they may do good by remaining in a war-waging state, but where they contribute indirectly to grave wrongdoing by doing so. Drawing on ideas from the ‘Business for Peace’ and ‘Business and Human Rights’ literature, I highlight the potentially positive role of corporate presence within war-waging countries, before highlighting four considerations which corporations ought to bear in mind when determining whether to withdraw, or whether it is the lesser evil to stay and to let their hands be spattered. The distinctive feature of Aristotle's philosophical discourse lies in its subtle transition, at a particular juncture, from metaphysical to ontological discourse. The proactive restoration of the original metaphysical framework pertaining to specific concepts facilitates the identification of the precise location or moment at which their spontaneous reinterpretation transpires. The recognition of the threshold of semantic "recalculation," employed as a hermeneutic procedure, constitutes a novel methodological approach to the analysis of Aristotle's works. In accordance with this approach, it is imperative to (...) regard the concepts and categories within Aristotelian philosophy, particularly those authored by Aristotle himself, not merely as representations of meanings unfolding within the primary text (a methodology not applicable in Aristotle's case), but rather as autonomous metatexts. The interpretation of these metatexts may initially appear as a thematically abstract exercise. Engaging with metatextual scenarios in Aristotle's philosophy unveils fresh perspectives, thereby enriching the understanding of his philosophical framework. (shrink)

Como hipótesis se plantea que la reescritura discute fenómenos sociales vinculados con las fisuras de la nación chilena y los procesos políticos de la actual coyuntura. Como objetivo, se busca establecer un diálogo con la tradición y el campo literario en torno a la (...) épica, por un lado, y con las reconsideraciones críticas acerca de la imaginación poética de la historia, por otro. Abstract The article focuses on the poem Seudoaraucana by Elvira Hernández (2010; 2017) based on the rewriting as an articulating resource of an off-center and amplified look at the source text, La Araucana de Ercilla y Zúñiga. As a hypothesis, it proposes that the rewriting discusses social phenomena linked to the fissures of the Chilean nation and the political processes of the current situation. As an objective, it tries to establish a dialogue with the tradition and the literary field around the epic, on the one hand, and with critical reconsiderations about the poetic imagination of history, on the other. This study explores nurses' experiences of workplace conflict with patients and their family members, how it differs by ethnic/racial identity, and highlights the coping strategies engaged to lessen these conflicts. Using a qualitative research design, this study draws on phenomenology and in‐depth interviews of 66 registered nurses and registered practical nurses from multiple sites in two Canadian cities to explore the experiences of nurses with multiple marginalized identities in relation to nurse–patient and nurse–patient's family member conflicts in direct care practice. (...) The results show that horizontal conflicts, especially, ones involving nurses, patients, and their family members are quite pervasive in the nursing profession. Direct care nurses, especially, ethnic minorities relative to majority groups experience excessive physical assaults, verbal aggressive behaviors, racial stereotyping and discrimination, and sexual harassment from patients and patients' family members. Institutional support through policies and practices designed to de‐escalate aggressive behavior from patients and their family members were identified as important support systems. We conclude that policies aimed at creating a safe and strong health‐care system call for holding patients and th'eir family members legally responsible for uncivil and aggressive behavior against caregivers. The Old Testament furnishes its readers with two pictures of Christ’s coming: his coming to earth as a servant in glorious apparel and his coming to earth as a king in glorious apparel. This has brought about bewilderment both to the Jews who expected only the kingly and glorious Christ and the 21st century Christian who are being misled by some preachers and teachers of the Gospel of Christ. The objective of this paper, therefore, is to unearth two forms of (...) Christ’s second coming: a secret coming – as a thief in the night, and public, universal coming, when every eye shall see him. Therefore through lexicosemantics analysis which reveals, its root-words and word-stems and the various possible semantic categories created by the human mind, this paper claims that the secret coming of Christ is what is called the rapture and the public coming is called the παρουσία. It conveys the idea that Christ’s return will be a definite and decisive action on his part. He will come himself, as surely as he came in the incarnation. (shrink)

Leading political theologian Oliver O'Donovan here takes a fresh look at some traditional moral arguments about war. Modern Christians differ widely on this issue. Philosophers of science discuss whether theory selection depends on aesthetic judgments or criteria, and whether these putatively aesthetic features are genuinely extra-epistemic. As examples, judgments involving criteria such as simplicity and symmetry are often cited. However, other theory selection criteria, such as fecundity, coherence, internal consistency, and fertility, more closely match those criteria used in art contexts and by scholars working in aesthetics. Paying closer attention to the way these criteria are used in art contexts allows us to understand some (...) evaluative and developmental practices in scientific theory selection as genuinely aesthetic, enlarging the scope of the goals of science. In this commentary, John O'Neill concentrates upon three themes in the goal Merleau-Ponty set for himself, namely "to restore to things their concrete physiognomy, to organisms their individual ways of dealing with the world, and to subjectivity its inherence in history." O'Neill considers the three objectives in their original order: first, the study of animal and human psychology; then, the phenomenology of perception; and finally, certain extensions of these perspectives in the historical and social sciences.

Three philosophical accounts of risk dominate the contemporary literature. On the probabilistic account, risk has to do with the probability of a disvaluable event obtaining; on the modal account, it has to do with the modal closeness of that event obtaining; on the normic account, it has to do with the normalcy of that event obtaining. The debate between these accounts has proceeded via counterexample-trading, with each account having some cases it explains better than others, and some cases that it (...) cannot explain at all. In this article, we attempt to break the impasse between the three accounts of risk through a shift in methodology. We investigate the concept of risk via the method of conceptual reverse-engineering, whereby a theorist reconstructs the need that a concept serves for a group of agents in order to illuminate the shape of the concept: its intension and extension. We suggest that risk functions to meet our need to make decisions that reduce disvalue under conditions of uncertainty. Our project makes plausible that risk is a pluralist concept: meeting this need requires that risk takes different forms in different contexts. But our pluralism is principled: each of these different forms are part of one and the same concept, that has a ‘core-to-periphery’ structure, where the form the concept takes in typical cases (at its ‘core’) explains the form it takes in less typical cases (at its ‘periphery’). We then apply our findings to epistemic risk, to resolve an ambiguity in how ‘epistemic risk’ is standardly understood. (shrink)

_Purpose._ The main purpose of this research is to comprehend the philosophical principles in the spread and legitimation of the Self-made-man idea in the worldview transformations of the 17th century. _Theoretical basis._ Historical and comparative methods became fundamental ones for the research. The research is based on the creative heritage of R. Descartes, T. Hobbes, J. Locke, as well as the works of modern researchers. _Originality._ The analysis shows that the Self-made-man idea, which originated in the ancient world and gradually (...) spreads in the Christian Middle Ages, gained a powerful impetus in the philosophical and moral-legal metamorphoses of the 17th century. These metamorphoses theoretically substantiated and radically accelerated the transition from mystical to rational, from theocentric to the anthropocentric worldview, and, as a result, to the recognition of the intellectual autonomy of the individuals and the freedom of their own will, the emergence of the construct of natural human rights, the requirements of religious tolerance and freedom of conscience, ultimately, to the principle of reliance on one’s own strength and the individual’s personal responsibility for one’s own destiny. Exactly these ideas in interaction with the ideas of Puritanism became the theoretical basis for the formation of B. Franklin’s views and the corresponding cultural code. _Conclusions._ The philosophy of the 17th century, having laid the principles of a new – subject-centric – metaphysics, as well as the philosophical and legal foundations of liberal ideology, provided philosophical and moral-legal legitimation to the sporadic attempts of man to break out of the triple circle of fatalism, paternalism, and conformity to a rationally founded and the ever-growing orientation of the individual towards active self-determination and self-realization, self-reliance and personal responsibility for their own destiny as key principles of the Self-made-man concept. _Purpose._ This research involves revealing the methodological significance of the anthropological understanding of values for conducting modern scientific research. _Theoretical basis._ Philosophical anthropology acts as an epistemological basis for answers to ontological questions that are part of the structure of such problems in modern science as the construction of a scientific picture of the world, the ordering of data of natural attitude, and anthropocosmism. The ontological basis for the formation of the anthropological theory of values is the teaching of Wilhelm (...) Leibniz, Immanuel Kant, Rudolf Lotze, and Martin Heidegger. _Originality._ The creation of a scientific picture of the world, the research of natural attitude, and an anthropological approach to cosmology carried out from the viewing angle of the philosophy of values show the close mutual conditioning of these scientific issues. A successful determination of one’s value positions by a scientist-researcher is impossible without his/her agreeing with his/her picture of the world with the prevailing ideas about the world in their society. Such ideas are studied by anthropocosmism, which researches not so much the world in itself, but a view of this world from the standpoint of the existing state of society and the main intentions of its development. _Conclusions._ The value attitude of scientists at a certain stage of the development of scientific knowledge forms their picture of the world, which has the form of self-explanatory scientific provisions. The facts of modern physics must always, one way or another, receive their legitimation through the world of the human natural attitude. Even the unobservable characteristics of the microcosm are explained by appealing to knowledge about the observable characteristics of the world. The anthropocentric nature of cosmology is determined by the fact that in modern philosophy, the values of a person explain not only the way of one’s cognition but also the way of one’s inclusion in the world. We review several topics of philosophical interest connected to misleading online content. First we consider proposed definitions of different types of misleading content. Then we consider the epistemology of misinformation, focusing on approaches from virtue epistemology and social epistemology. Finally we discuss how misinformation is related to belief polarization, and argue that models of rational polarization present special challenges for conceptualizing fake news and misinformation.

Ku, O.P., is an intriguing attempt at a comprehensive approach to the question of theistic evolutionism from the perspective of Thomistic tradition. The breadth of the approach offered by the authors, starting with the problem of the relationship between reason and faith and subsequently reaching to the foundations of the philosophy of nature, natural theology, and theology of creation, as well as biblical exegesis, provides an appropriate introduction and background for the analysis of a thesis suggesting that it is possible for God to create new species of living organisms (including the Homo sapiens sapiens species) through the processes of evolution. The comprehensible manner in which the discussed questions are presented renders the book accessible to a wide audience.Although one should agree with the main thesis formulated by the authors of Thomistic Evolution regarding the possibility of God expressing his creative power through the emergence of new species of living beings by way of evolution, it also has to be noticed that the arguments they present do not always take fully into consideration certain significant difficulties that arise along the way and the resulting necessity to broaden and adjust the ideas of the Aristotelian-Thomistic tradition to present-day standards in order for it to engage in a dialogue with contemporary science. In the absence of such broadening and adjusting, one might arrive at an overly simplified view of things in which St. Thomas himself would easily come to agree with the main assumptions of theistic evolutionism. Our aim, thus, is to reveal a more profound level of the complexity of the debate regarding the Thomistic view of creation and evolution.St. Thomas and EvolutionismOn the one hand, Brent's intuition seems justified that the Thomistic definition of creation as being dependent on God in existence (depicted in chapter 7) is compatible with both the image of the world in which various kinds of species are immutable and the image of the world in which they are subject to change. On the other hand, we cannot forget that St. Thomas himself perceived forms of species as permanently fixed in the moment of the first member of a given species coming into existence and—consequently—not being subject to any future alterations. Hence, reproduction, according to Aquinas, serves as a continuation of species without the introduction of any significant variations: "Nature produces like from like. Now the thing generated is like its generator in [End Page 226] species and form. Therefore the form is produced by the action of the generator and not by creation" (De pot., q. 3, a. 8, sc 4).This quotation from Questiones disputatae de potentia points us towards the theological question of creation. Here, we must emphasize that, according to St. Thomas, at its origin, the world was perfect as to the number of created species. Hence, "something can be added every day to the perfection of the universe, as to the number of individuals, but not as to the number of species" (ST I, q. 118, a. 3, ad 2).1 It is true that Aquinas allowed for the arising of new animal species through putrefaction caused by the power of the sun, as well as through the crossbreeding of already existing species (see ST I, q. 73, a. 1, ad 3, a portion of which is quoted by Austriaco in chapter 24). However, the emergence of new forms of animal organisms in this way by no means implies or anticipates the theory of their descent from a common ancestor by way of evolutionary transformation. Nor is it a manifestation or expression of the most basic rules governing nature, but rather an exception and a departure from their regularity... (shrink)

An appropriate description for the Buddha's philosophy of persons within the frame of materialist philosophy of mind, prima facie, would understandably be a kind of reductionism, given that the Buddha reduced the self to nothing but a collection of impersonal and impermanent psychophysical elements. In this article, I argue that this view is only appropriate for understanding the self within conventional reality, as is the term used by Buddhists, and does not tackle the other half, namely, ultimate reality. I claim (...) that eliminative materialism provides a more accurate description of the Buddha's prescriptive practice, and although falling prey to the same problems that reductionism faces, creates a good basis for an alternative position of the Buddha as a Hard Eliminativist.
