L’objectif de cet article est d’analyser les relations entre les mères ayant des enfants en situation de handicap ou présentant des difficultés développementales et les professionnelles au sein de crèches collectives dites inclusives. Dans le cadre d’une étude plus vaste, réalisée en France, portant sur le soutien des familles de jeunes enfants porteurs de handicap ou présentant des difficultés développementales, un entretien semi-directif a été réalisé auprès de neuf mères et de dix professionnelles pour analyser leurs relations. L’analyse qualitative de (...) données est réalisée selon l’approche de Braun et Clarke (2006). Les principaux résultats mettent en évidence, pour les mères, l’importance du partage d’informations, le soutien apporté par les professionnelles ainsi que leurs compétences. Les professionnelles, quant à elles, soulignent l’échange d’informations et leur rôle d’accompagnement dans l’acceptation du handicap de l’enfant ou dans le processus de parentalité. Plausibly, only moral agents can bear action-demanding duties. Not all groups are moral agents. This places constraints on which groups can bear action-demanding duties. Moreover, if such duties imply ability then moral agents – of both the individual and group varieties – can only bear duties over actions they are able to perform. I tease out the implications of this for duties over group actions, and argue that groups in many instances cannot bear these duties. This is because only groups (...) with the right kind of structure – groups I call ‘collectives’ – have the agency to bear action-demanding duties. Yet neither can individuals bear these duties, assuming that individuals cannot perform group actions and that duty implies ability. This appears to leave us at a loss when assigning duties to perform some group actions. I argue we can solve this problem by assigning collectivization duties to individuals – duties to form a collective that then incurs a duty over the action. I give criteria for when individuals have collectivization duties and discuss the demands these duties place on their bearers. (shrink)

Which kinds of responsibility can we attribute to which kinds of collective, and why? In contrast, which kinds of collective responsibility can we not attribute—which kinds are ‘gappy’? This study provides a framework for answering these questions. It begins by distinguishing between three kinds of collective and three kinds of responsibility. It then explains how gaps—i.e. cases where we cannot attribute the responsibility we might want to—appear to arise within each type of collective responsibility. When a liberal-democratic state signs a treaty or wages a war, does its whole polity do those things? In this article, we approach this question via the recent social ontological literature on collective agency. We provide arguments that it does and that it does not. The arguments are presented via three considerations: the polity's control over what the state does; the polity's unity; and the influence of individual polity members. We suggest that the answer to our question differs for different (...) liberal-democratic states and depends on two underlying considerations: the amount of discretion held by the state's officeholders; the extent to which the democratic procedure is deliberative rather than aggregative. A collective duty gap arises when a group has caused harm that requires remedying but no member did harm that can justify the imposition of individual remedial duties. Examples range from airplane crashes to climate change. How might collective duty gaps be filled? This paper starts by examining two promising proposals for filling them. Both proposals are found inadequate. Thus, while gap-filling duties can be defended against objections from unfairness and demandingness, we need a substantive justification for their existence. I (...) argue that substantive justification can be found in the normative force of commitments individuals make to others with regard to ends. Along the way, I argue that gap-filling duties must be conceptualized differently in group agents, as compared to non-agent groups: in the former, gap-filling duties can be understood as duties to “take up the slack”; in the latter, this would be a category error. Why, morally speaking, ought we do more for our family and friends than for strangers? In other words, what is the justification of special duties? According to partialists, the answer to this question cannot be reduced to impartial moral principles. According to impartialists, it can. This paper briefly argues in favour of impartialism, before drawing out an implication of the impartialist view: in addition to justifying some currently recognised special duties, impartialism also generates new special duties that are not yet (...) widely recognised. Specifically, in certain situations, impartial principles generate duties to take actions and adopt attitudes in our personal lives that increase the chance of new or different special relationships being formed—new or different friendships, family-like relationships, relationships akin to co-nationality, and so on. In fact, even if one thinks partialism is the best justification of the duties we have once in special relationships, impartialist justifications for taking steps to form such relationships should have some sway. Moreover, a little reflection shows that these duties are not as demanding or counterintuitive as one might expect. (shrink)

In order for states to fulfil their moral duties, costs must be passed to individual citizens. This paper asks how these costs should be distributed. I advocate the common-sense answer: the distribution of costs should, insofar as possible, track the reasons behind the state’s duty. This answer faces a number of problems, which I attempt to solve.

We vindicate the widespread intuition that there is something morally problematic with for-profit corporations providing care to young children and elders. But instead of putting forward an empirical argument showing that for-profit corporations score worse than not-for-profits when it comes to meeting the basic needs of these vulnerable groups, we develop a philosophical argument about the nature of the relationship between a care organisation, its role-occupants, and care recipients. We argue that the correlation between profit and lower-quality care is a (...) result of intrinsic features of a for-profit model, combined with conceptual features of meaningful caring relationships, such that non-profits are the most reliable institutional providers of adequate care. Our claim is that care requires a kind of commitment that for-profit institutions are constituted to avoid, and that non-profit institutions are constituted to embrace. (shrink)

Cet article rend compte d’une expérience pédagogique consistant à proposer à des étudiants de 2e année en orthophonie de constituer leur propre corpus de productions orales ou multimodales (enregistrement audio ou vidéo et transcription de cet enregistrement). Il met en évidence un certain nombre de questionnements auxquels cet exercice conduit les étudiants et souligne les liens avec leur pratique future.

Economic sanctions are a primary tool the US government and international organizations use to promote human rights abroad, yet they have proven to be largely ineffective and harmful to civilians. There is accumulating evidence that this paradox may be explained by the expressive purposes of sanctions and domestic politics. This article further explores these explanations by examining human rights sanction policy debates. Specifically, I analyzed 27 US Congressional hearings on human rights policy toward China. I argue that moral pressure enabled (...) support for human rights sanctions, high costs fueled opposition to them, and discussions of effectiveness were marginal to the debate. The findings contribute to past studies by identifying the psychological and sociological mechanisms by which legislators circumvent arguments of sanction ineffectiveness and harmfulness and delineating the role of business, human rights, and ethnic interest groups in enabling and constraining support for human rights sanctions. The urgency of the problem of climate change calls upon us to investigate the climate duties of agents beyond the state. Individuals are the most salient candidate in this respect. In section I, I argue that the idea that individuals might have duties to reduce their emissions raises difficult issues about individual difference-making. The rest of the chapter, then, focuses on what I take to be the third most-salient duty-bearer: large for-profit corporations. These entities have largely been overlooked in philosophical (...) discussions of climate-related duties. In Section II, I consider two possible reasons for this neglect, and argue that neither are good reasons. In Section III, I give a positive case for weighty and demanding duties for corporations, to cut back their present and planned emissions and to offset their past emissions. In Section IV, I bring the discussion full circle: corporations’ duties always imply duties for corporations’ members, that is, for the individuals who constitute the corporation. Drawing on earlier work, I give an account of who corporations’ members are and how their duties are structured. In heavily-emitting corporations, members prominently include managers, shareholders, and rank-and-file employees. So a range of individuals are on the hook after all, because the corporations that they constitute bear duties. Additionally, even non-members may have duties to act upon corporations, from the outside, with a view to inducing corporate duty-fulfillment. (shrink)

This chapter focuses on the question of who has duties regarding poverty and what those duties demand, from within the perspective of contemporary analytic normative philosophy. The chapter is structured in three sections. Section 1 considers the duties of those living in poverty, which might be either self-regarding or other-regarding duties, and which must be tempered by concerns of overdemandingness. Section 2 considers the duties of affluent individuals. These are imperfect duties grounded in affluent individuals’ relations to the structures that (...) produce poverty: relations of contribution, benefit, and ability to change. Section 3 considers duties of collective agents – including states, for-profits, charities, and civil society groups. When an organisation does wrong, each of the members is part of the entity that authored that wrong—or so I shall assume. But it does not follow that each of the members has herself done wrong. Doing wrong, I will assume, results from the combination of two conditions: first, authoring (or being part of the entity that authored) a harm; and second, lacking an excuse for that (part-) authorship. To answer my title question, then, we have to know which members (...) of an organisation have excuses for their part-authorship of an organisation’s wrong. I will argue that members gain excuses for their part-authorship only by using their role in the organisation to signal their disavowal of the organisation’s wrongdoing. The answer to the title question, then, is “all those members who don’t use their role to signal their disavowal of the organisation’s wrongdoing.” In the final section, I apply my proposal to citizens of liberal democratic states. This supports the common-sense intuition that, when such states do wrong, wrong is done by those citizens who support or acquiesce in the wrongful policy. (shrink)

Being Sure of Each Other: An Essay on Social Rights and Freedoms, by KimberleyBrownlee. Oxford: Oxford University Press, 2020. Pp. 256.

This paper explores what it takes for research laboratories to produce valuable knowledge in academic institutions marked by the coexistence of multiple evaluative frameworks. Drawing upon ethnographic fieldwork carried out in two UK-based epigenetics research laboratories, I examine the set of practices through which research groups intertwine knowledge production with the making of scientific, health, and wealth value. This includes building and maintaining a portfolio of valuable resources, such as expertise, scientific credibility, or data, and turning these resources into assets (...) by carefully organizing and managing their value. Laboratories then put these assets to productive use within and outside their labs toward the creation or extraction of value. I identify two models for producing value within academic science: a commodity-based model whereby laboratories mobilize their assets to produce results, which can be converted into publications for the accumulation of credibility capital, and a rentier model of accumulation whereby laboratories own valuable assets, which they rent out to others outside their lab against revenue. Following recent developments in Science and Technology Studies on value production in the bioeconomy, I argue that the concepts of asset and rent are essential analytical tools for getting to grips with the origins of value within academic science. As part of a volunteering program, a medical student learns the story of a sick infant whose survival was wholly dependent on modern medicine. The family was pacified by believing, during pregnancy, that the fetus would be healthy. Poor counseling and unethical physician behavior led to the trauma of the family’s struggle to keep its baby alive, happy, and as healthy as possible. The need for adequate, thorough, and individualized counseling is a critical and still unfulfilled need in patient care.

Les Sphériques ont été écrites par Ménélaos sous la forme d’un traité d’apparence purement mathématique. Cependant, la matière qui y est développée dans les deuxième et troisième livres est étroitement liée à des problèmes rencontrés en astronomie: calcul des coordonnées équatoriales du Soleil, établissement de tables d’ascensions, étude du mouvement du Soleil dans la sphère oblique, levers simultanés. Ce lien, qui demeure implicite dans le texte, a été mis en évidence par deux mathématiciens et astronomes arabo-musulmans, qui ont exposé la (...) signification astronomique de certains théorèmes des Sphériques. Nous présenterons, commenterons et complèterons cette explicitation en classant les théorèmes concernés en trois groupes: sens de variation de certaines grandeurs sur la sphère, propositions de trigonométrie sphérique et applications, sens de variation de rapports entre certaines grandeurs sur la sphère. The Spherics were written by Menelaos in the form of a purely mathematical treatise. However, the material developed in the second and third book is closely linked to problems met in astronomy: computation of equatorial coordinates of the Sun, setting up of rising-time tables, study of the motion of the Sun in the sphaera obliqua, simultaneous risings. This link, which remains implicit in the text, was clearly displayed by two arabo-islamic mathematicians and astronomers, who expounded the astronomical meaning of some theorems of the Spherics. We describe, comment and complement their explanations, by classifying the implications of the theorems in three groups: direction of variation of some quantities on the sphere, spherical trigonometry and applications, direction of variation of ratios of some quantities on the sphere. There is disagreement in the literature about the exact nature of the phenomenon of empathy. There are emotional, cognitive, and conditioning views, applying in varying degrees across species. An adequate description of the ultimate and proximate mechanism can integrate these views. Proximately, the perception of an object's state activates the subject's corresponding representations, which in turn activate somatic and autonomic responses. This mechanism supports basic behaviors that are crucial for the reproductive success of animals living in groups. The Perception-Action Model, (...) together with an understanding of how representations change with experience, can explain the major empirical effects in the literature. It can also predict a variety of empathy disorders. The interaction between the PAM and prefrontal functioning can also explain different levels of empathy across species and age groups. This view can advance our evolutionary understanding of empathy beyond inclusive fitness and reciprocal altruism and can explain different levels of empathy across individuals, species, stages of development, and situations. A new examination of the remains still in place and the missing blocks from the Daochos monument leads to the restoration of a brick chamber on a stone base opening to the west. There must have been statues of family members of the tetrarch and hieromnemom Daochos of Pharsala there, as well as a second group of effigies placed differently. Throughout the Covid-19 pandemic, people have been eager to learn what factors, and especially what public health policies, cause infection rates to wax and wane. But figuring out conclusively what causes what is difficult in complex systems with nonlinear dynamics, such as pandemics. We review some of the challenges that scientists have faced in answering quantitative causal questions during the Covid-19 pandemic, and suggest that these challenges are a reason to augment the moral dimension of conversations about causal inference. We (...) take a lesson from Martha Nussbaum—who cautions us not to think we have just one question on our hands when we have at least two—and apply it to modeling for causal inference in the context of cost-benefit analysis. A surfeit of research confirms that people activate personal, affective, and conceptual representations when perceiving the states of others. However, researchers continue to debate the role of self–other overlap in empathy due to a failure to dissociate neural overlap, subjective resonance, and personal distress. A perception–action view posits that neural-level overlap is necessary during early processing for all social understanding, but need not be conscious or aversive. This neural overlap can subsequently produce a variety of states depending on the context (...) and degree of common experience and emotionality. We outline a framework for understanding the interrelationship between neural and subjective overlap, and among empathic states, through a dynamic-systems view of how information is processed in the brain and body. Noninvasive, prenatal whole genome sequencing may be a technological reality in the near future, making available a vast array of genetic information early in pregnancy at no risk to the fetus or mother. Many worry that the timing, safety, and ease of the test will lead to informational overload and reproductive consumerism. The prevailing response among commentators has been to restrict conditions eligible for testing based on medical severity, which imposes disputed value judgments and devalues those living with eligible conditions. To avoid these difficulties, we propose an unrestricted testing policy, under which prospective parents could obtain information on any variant of known significance after a careful informed consent process that uses an interactive decision aid to deliver a mandatory presentation on the purposes, techniques, and limitations of genomic testing, as well as optional resources for reflection and consultation. Many meta-ethicists are alethists: they claim that practical considerations can constitute normative reasons for action, but not for belief. But the alethist owes us an account of the relevant difference between action and belief, which thereby explains this normative difference. Here, I argue that two salient strategies for discharging this burden fail. According to the first strategy, the relevant difference between action and belief is that truth is the constitutive standard of correctness for belief, but not for action, while according (...) to the second strategy, it is that practical considerations can constitute motivating reasons for action, but not for belief. But the former claim only shifts the alethist's explanatory burden, and the latter claim is wrong—we can believe for practical reasons. Until the alethist can offer a better account, then, I argue that we should accept that there are practical reasons for belief. (shrink)

ABSTRACT:In this article, we examine how regulators, prosecutors, and courts might support and encourage the efforts of organizations to not only reintegrate after misconduct but also to improve their conduct in a way that reduces their likelihood of re-offense (rehabilitation). We explore a novel experiment in creative sentencing in Alberta Canada that aimed to try to change the behaviour of an industry by publicly airing the root causes of a failure of one the industry’s leaders. Drawing on this case and (...) prior work, we articulate a model for a responsive and restorative approach to organizational misconduct that balances the punitive role of regulators and courts with new roles in supporting and overseeing rehabilitation. Growing interest in embedded research approaches—where research is incorporated into clinical care—has spurred numerous studies to generate knowledge relevant to the real-world needs of patients and other stakeholders. However, it also has presented ethical challenges. An emerging challenge is how to understand the nature and extent of investigators’ obligations to patient-subjects. Prior scholarship on investigator duties has generally been grounded upon the premise that research and clinical care are distinct activities, bearing distinct duties. Yet this premise—and its corresponding implications—are challenged (...) when research and clinical care are deliberately integrated. After presenting three case studies from recent pragmatic clinical trials, we identify six differences between explanatory trials and embedded research that limit the application of existing scholarship for ascertaining investigator duties. We suggest that these limitations indicate a need to account for the implications of usual care and to move beyond a narrow focus on the investigator-subject dyad, one that better reflects the team- and institution-based nature of contemporary health systems. It is widely held that children’s linguistic input underdetermines the correct grammar, and that language learning must therefore be guided by innate linguistic constraints. Here, we show that a Bayesian model can learn a standard poverty‐of‐stimulus example, anaphoric one, from realistic input by relying on indirect evidence, without a linguistic constraint assumed to be necessary. Our demonstration does, however, assume other linguistic knowledge; thus, we reduce the problem of learning anaphoric one to that of learning this other knowledge. En dehors des frontons du temple, patiemment reconstitués par Francis Croissant, l’image d’Apollon à Delphes au ive siècle est restée jusqu’à présent largement méconnue. Nous proposons, à la suite d’un réexamen des figures centrales de ces frontons, de les redistribuer et les réinterpréter. L’interversion, qui en résulte, des représentations d’Apollon et de Dionysos s’explique, selon nous, par un programme général qui concerne également la figure d’acrotère central du fronton est. Dans cette nouvelle proposition, nous incluons une statue monumentale d’Apollon, qui (...) se trouvait selon nous sur la grande base de l’opisthodome. L’observation de la pierre interprétée comme un omphalos et récemment replacée au sommet de la colonne d’acanthe nous conduit à y reconnaître une représentation non figurative du dieu, rappelant les Agyieis connus à Cyrène et Apollonia d’Illyrie. Cette nouvelle lecture du monument nous amène à l’identifier au Sitalkas de trente‑cinq coudées connu par Pausanias. Par ailleurs, nous replaçons sur une fondation anciennement attribuée au monument d’Aristainéta une base pour deux statues, contemporaine, également, de l’achèvement du temple. (shrink)

Nous revenons sur la restitution de quatre trésors de Delphes bien connus. La barrière de cippes qui ferme à l’est la terrasse orientale du trésor des Athéniens invite à s’interroger sur la fonction de cet enclos. De nouvelles données permettent de proposer des hypothèses de restitution du plan de la lesché des Cnidiens et de son élévation tenant compte des nécessités liées à la présence de peintures, mais aussi de réinterpréter le mur de soutènement au sud. Le réexamen du trésor (...) des Thébains conduit à changer son orientation et à interpréter la fenêtre de la publication comme une ouverture destinée à la ventilation du prodomos. Le trésor des Cyrénéens est doté d’une nouvelle porte, plus conforme aux usages de l’architecture grecque classique. Les circonstances de sa consécration sont revues dans le cadre de la nouvelle datation imposée par sa nouvelle situation sur la fondation SD 302. (shrink)
