Die interdisziplinär angelegte Untersuchung befaßt sich mit John Barclays (1582-1621) neulateinischem Staatsroman "Argenis" (1621), einem tagespolitischen Schlüsselroman auf dem Hintergrund der französischen Religionskriege. Die "Argenis" ist ein parteipolitisches Pamphlet gegen die Monarchomachen, speziell gegen die militanten Hugenotten; zugleich wird untersucht, inwiefern dieser höchst komplexe Roman aber auch Entwurf und Utopie des idealen Staates, Fürstenspiegel für Ludwig XIII. sowie Manifest und Proklamation der absolutistischen Staatslehre ist. Grundlage der Interpretation, die den Roman im Kontext des politischen Denkens und der 'politischen' Schriften seines (...) Autors untersucht, ist die Beschäftigung mit denjenigen staatstheoretischen Werken aus Mittelalter und Früher Neuzeit, die Barclays Denken prägten (u.a. die Schriften seines Vaters William, Jean Bodins und Jakobs I. von England). Als unabdingbar erwies sich dabei auch eine gründliche Auseinandersetzung mit dem Themenkomplex Staatsrechtfertigung, also der Frage nach dem Grund und der Grenze des dem Staat geschuldeten Gehorsams, vor dem Hintergrund der konfessionellen Bürgerkriege und der Suprematieansprüche des Papsttums über die weltlichen Fürsten. Hier wurden erstmals auch die im vatikanischen Geheimarchiv und in der Vatikanbibliothek aufbewahrten Quellen zu Barclay herangezogen. (shrink)

Most models of patient-physician communication take decision-making as a central concept. However, we found that often the treatment course of metastatic cancer patients is not easy to describe in straightforward terms used in decision-making models but is instead frequently more erratic. Our aim was to analyse these processes as trajectories. We used a longitudinal case study of 13 patients with metastatic colorectal and pancreatic cancer for whom palliative chemotherapy was a treatment option, and analysed 65 semi-structured interviews. We analysed three (...) characteristics of the treatment course that contributed to the ‘erraticness’ of the course: (1) The treatment (with or without chemotherapy) contained many options; (2) these options were not stable entities to be decided upon, but changed identity over the course of treatment, and (3) contrary to the closure (option X means no option Y, Z, etc.) a decision implies, the treatment course was a continuous process in which options instead remained open. When the treatment course is characterised by these many and changeable options that do not result in closure, the shared decision-making model should take these into account. More attention needs to be paid to the erratic character of the process in which the doctor has to provide continuous information that is related to the changing situation of the patient; also, flexibility in dealing with protocols is warranted, as is vigilance about the overall direction of the process. : The dual perspective model of agency and communion predicts that observers tend to interpret a target’s behavior more in terms of communion than agency, whereas actors interpret their behavior more in terms of agency. The present research for the first time tests this model in real interactions. Previously unacquainted participants had a short conversation and afterwards rated their own behavior and their interaction partner’s behavior in terms of agency and communion. Supporting the dual perspective model, observers rated the actor’s (...) behavior higher on communion than on agency, and higher on communion than actors themselves did. Findings for actors were more complex: Actors rated their own behavior as more agentic than observers did. However, they also rated their behavior high on communion. We discuss implications for the dual perspective model as well as for understandings in social interactions. (shrink)

The Joint Research Centre (JRC) is the European Commission’s in-house science and knowledge service, employing a substantial staff of scientists devoted to conducting research to provide independent scientific advice for EU policy. Focussed on various research areas aligned with EU priorities, the JRC excels in delivering scientific evidence for policymaking and has published numerous science-for-policy reports and scientific articles. Drawing on a scientific integrity statement, surveys among JRC’s research staff, and thematic discussions with JRC’s research leaders, the JRC has developed (...) a comprehensive Scientific Integrity and Research Ethics (SIRE) framework, including instruments, procedures, and guidelines to ensure high standards and independence in its research. Key components of the SIRE framework include a Scientific Integrity Officer, an Editorial Review Board, a Research Ethics Board, and guidelines for responsible conduct of research. This article provides an overview of the JRC’s SIRE framework and how it was developed, emphasising the importance of maintaining independence, integrity, and ethics in scientific research that supports EU policy. The article also discusses potential gaps in the framework and where additional efforts may be needed, comparing with the recent U.S. National Science and Technology Council report on Protecting the Integrity of Government Science. Gefragt wird nach dem Stellenwert von Elternwünschen nach eindeutiger Geschlechtszuweisung sowie nach den Konfliktfeldern, die zum einen zwischen konkurrierenden Wunschvorstellungen der Eltern und der behandelnden Ärzte, zum andern zwischen Kindeswohl und Kinderrechten entstehen können. Gegenwärtig wird Neugeborenen mit anatomisch uneindeutigem Genital trotz unsicherer Prognose über die Behandlungsergebnisse oft noch ein Geschlecht zugewiesen und operativ erstellt. Dieses Vorgehen ist von verschiedenen Seiten ethisch heftig kritisiert worden. Kipnis u. Diamond forderten 1998 im „Journal (...) of Clinical Ethics“ ein Moratorium für alle nicht vital indizierten geschlechtskorrigierenden Eingriffe. Diese Forderung orientiert sich am Interesse des zukünftigen Erwachsenen, betont dessen prospektive Autonomie und klammert den Elternwunsch aus. Dieses „Modell des antizipierten Konsenses“ kann jedoch mit Bezug auf Neugeborene und Kleinkinder bedeutsame Aspekte des Eltern-Kind-Verhältnisses nicht angemessen erfassen. Im Aufsatz werden Argumente angeführt, die es aus Sicht einer Ethik der Elternschaft rechtfertigen, ethische Entscheidungen auf der Basis eines beziehungsorientierten Modells zu treffen. Business Ethics: A European Review, EarlyView.

In this paper, we demonstrate how the collaborative and sequential unfolding of a story ties into the constitution of a membership categorization device which we have glossed as ‘us and them’. The data come from a focus group activity where first and second generation immigrants to Denmark have been asked to discuss their situation in Denmark. Using Ethnomethodological Conversation and Membership Categorization Analysis, we present one story which involves a story-teller and his family and an elderly Danish couple living in (...) the same block of flats. In the telling of the story, co-participants align and affiliate, and disalign and disaffiliate, at sequentially relevant junctions. We will argue that not only do such phenomena indicate listenership and possible agreement to the moral of the story in its telling, but also to the morally implicative categorical work involved in the story’s telling. Dabei stutzt er sich auf das Denken Franz Rosenzweigs, das bereits in der Formulierung von Sein und Zeit erkennbar ist, in den Schriften der 40er und 50er Jahre aber in besonders intensiver Weise nachwirkt. The European Union’s policies regarding genetically modified food are based on the precautionary principle and the requirement of respecting consumers’ autonomy. We ask whether the requirement of respecting consumers’ autonomy regarding GMF implies that both GMF and non-GMF products should be available in the market. According to one line of thought, consumers’ choices may be autonomous even when the both types of products are not available. A food market with only GMF or only non-GMF products does not strictly speaking compel (...) people to buy the type of products available, and a possibility to refuse to buy is enough for consumers’ choice to be autonomous. According to another line of thought, the unavailability of GMF or non-GMF products restricts the autonomy of those consumers who are unwilling to use the only type of products available in the market. From the point of view of autonomy, a food market with only GMF or only non-GMF products does not offer enough alternatives for consumers. Moreover, the whole point of the European Union’s requirement of respecting consumers’ autonomy is to enable an autonomous choice between GMF and non-GMF—not just to give a possibility to refrain from buying. However, this does not imply that producers, processors, wholesalers, retailers, or public authorities have a moral duty to see that there are both GMF and non-GMF products available in the market. The requirement to respect autonomy is prima facie in nature, and in the context of GMF, other prima facie requirements are often stronger and override it. Not only the consumers’ autonomy of choice but also environmental values, other people’s well-being, and the autonomous choice of farmers, retailers, and other relevant parties should be respected. Thus, according to the both lines of thought, the requirement to respect consumers’ autonomy of choice does not imply that there should be both GMF and non-GMF products available in the market. The main objective of this paper is to describe how quality of care may be improved during an involuntary admission process of patients suffering from Korsakoff's syndrome. It presents an empirically grounded analysis with different perspectives on ‘doing good’ during this process. Family carers', healthcare professionals' and legal professionals' ways of understanding and ordering this problematic situation appear very different. This could prevent patients from getting the proper care they need, with risk of more suffering and quality of life below (...) the minimum acceptable. All this possibly lead to immoral dehumanizing situations. Firstly, the background of our empirical study is sketched. Secondly, the different perspectives on ‘doing good’ are summarized and compared. Thirdly, the tensions arising from the different conceptualizations of autonomy and different types of responsibilities of the actors are clarified. A common ‘doing good’ during involuntary admission necessitates removal of any tensions within the relational network by weighing and balancing the different perspectives on autonomy and the resulting responsibilities. With this in mind, we propose a renewed time/action table for involuntary admission, which tends to address all patients' needs at the right time. The solution presented might help healthcare professionals, who are squeezed in between patients, family carers, legal professionals and overall rules, to create practices in which patients suffering from Korsakoff's syndrome can maintain their dignity and receive the care they need. Earlier interventions, timely and adequate diagnosis, and diminishment of tensions between the different actors by fine‐tuning their paradigmatic frameworks are suggested to be part of a solution. When states cooperate in refugee protection and implement a scheme with fixed rules allocating refugees to host states, should they consider refugees' interests and preferences regarding where they receive protection? This article briefly examines the kinds of preferences and interests that are relevant to both refugees and states before discussing the moral principles determining the respective weight that should be attributed to them. We conclude that states must adhere to some minimal constraints concerning the consideration of refugees' concerns, and should (...) promote some further moral goals that go beyond these constraints. Finally, we suggest a scheme that meets all the moral demands we argued for and seems feasible without posing serious threats to the destination states. (shrink)

Research supporting cognitive reserve theory suggests that engaging in a variety of cognitive, social, and physical activities may serve as protective factors against age-related changes in mental functioning, especially if the activities are cognitively engaging. Individuals who participate in a variety of cognitive activities have been found to be more likely to maintain a higher level of cognitive functioning and be less likely to develop dementia. In this study, we explore the relationship between engaging in a variety of activities and (...) cognitive performance amongst 206 healthy older adults between the ages of 65–85. Age and years of education were found to be the most significant predictors of a global composite representing cognitive performance, consistent with previous work linking these variables to age-related changes in cognition and the cognitive reserve. We interpret these results to suggest that age and education are better predictors of global cognitive performance in older adults than self-reported activity engagement. (shrink)

The societal roots of the environmental discussion are discussed. Attention focusses on the roles played by the nature conservation, environmental, consumer and anti-nuclear movements, popular and popularized science, the media and the development of environmental policy and regulation.The scientific approach and the societal background enable us to understand the concept of the “environmental crisis”, which itself provides the most important contextual background to environmental ethics. To illustrate contemporary thinking, an analysis of Agenda 21 shows how environmental problems are currently seen (...) as the result of poverty, consumption and production patterns and demographic and decision making issues.Using this environmental knowledge background as a reference, the main lines of thinking in environmental ethics are overviewed. The overview begins by looking at approaches which value the environment because it is or might be of value to man. It continues by considering approaches which are intermediate between the anthropocentric and deep ecological viewpoints. In particular, Leopold's”Land Ethic” and Singer's”Animal Liberation” ideas are discussed.Deep ecology is based on the idea that nature as a whole has moral value. Reference is made to the work of the Norwegian philosopher Naess and to the more scientifically-rooted “deep green theory” of Sylvan and Plumwood.In addition to these different lines of theorising within environmental ethics, the ethical aspects of such anchorpoints in the environmental discussion as sustainable development and the Gaia theory, are also discussed. This review article summarizes various functions of the dorsolateral prefrontal cortex that are related to language processing. To this end, its connectivity with the left-dominant perisylvian language network was considered, as well as its interaction with other functional networks that, directly or indirectly, contribute to language processing. Language-related functions of the DLPFC comprise various aspects of pragmatic processing such as discourse management, integration of prosody, interpretation of nonliteral meanings, inference making, ambiguity resolution, and error repair. Neurophysiologically, the DLPFC seems to (...) be a key region for implementing functional connectivity between the language network and other functional networks, including cortico-cortical as well as subcortical circuits. Considering clinical aspects, damage to the DLPFC causes psychiatric communication deficits rather than typical aphasic language syndromes. Although the number of well-controlled studies on DLPFC language functions is still limited, the DLPFC might be an important target region for the treatment of pragmatic language disorders. (shrink)

Based on an ethnographic fieldwork the article analyses the experiences of 8-10 year old children in three different institutions. It is shown how the children create and maintain different social landscapes in each setting. This means that children's experiences are related to the position they have in the landscape. The notion social identity is used to discuss and explain these findings. With this notion identity is explained as an interplay between internal and external factors: between group-identification and categorisation. Children's different (...) identities in different settings are not created by children themselves, but must bee seen in relation to the categorisation used by the adults to classify children. The professional categorisations of children are a central part of the social space in relation to which children act, talk, and play. (shrink)

How can we deal with the diversity of theories in mathematics education? This was the main question that led the authors of this book to found the Networking Theories Group. Starting from the shared assumption that the existence of different theories is a resource for mathematics education research, the authors have explored the possibilities of interactions between theories, such as contrasting, coordinating, and locally integrating them. The book explains and illustrates what it means to network theories; it presents networking as (...) a challenging but fruitful research practice and shows how the Group dealt with this challenge considering five theoretical approaches, namely the approach of Action, Production, and Communication (APC), the Theory of Didactical Situations (TDS), the Anthropological Theory of the Didactic (ATD), the approach of Abstraction in Context (AiC), and the Theory of Interest-Dense Situations (IDS). A synthetic presentation of each theory and their connections shows how the activity of networking generates questions at the theoretical, methodological and practical levels and how the work on these questions leads to both theoretical and practical progress. The core of the book consists of four new networking case studies which illustrate what exactly can be gained by this approach and what kind of difficulties might arise. (shrink)

Why is there such a striking discrepancy between the flexibility, democracy and empowerment that the Bologna process aims for, and the superficial educational activities that it actually results in? Our answer is based on the ritual theory of the American anthropologist Roy Rappaport and the psychoanalytical framework of the Austrian philosopher Robert Pfaller. Interpreting schoolified education as a ritual, we argue that both the reform initiative and its ensuing educational activities should be interpreted as mainly productive of a certain appearance, (...) of compliance with prominent norms of modern society: the norms are articulated in policy documents and enacted in educational activity. We take schoolified education to be a normal ritual, in that this appearance is accepted ‘as if’ it corresponded with reality, while at the same time most people are aware (in a certain sense) of its superficial and ritualistic character. A twist, however, is added by the fact that modern society is distinctly anti-ritualistic, and therefore constantly tries to make education work ‘for real’. Drawing on Pfaller’s distinction between belief and faith, we show that this pursuit of de-ritualisation actually makes education progressively more formalised and coercive. (shrink)
