The past decade has seen a burgeoning of scholarly interest in conscientious objection in healthcare. While the literature to date has focused primarily on individual healthcare practitioners who object to participation in morally controversial procedures, in this article we consider a different albeit related issue, namely, whether publicly funded healthcare institutions should be required to provide morally controversial services such as abortions, emergency contraception, voluntary sterilizations, and voluntary euthanasia. Substantive debates about institutional responsibility have remained largely at the level of (...) first-order ethical debate over medical practices which institutions have refused to offer; in this article, we argue that more fundamental questions about the metaphysics of institutions provide a neglected avenue for understanding the basis of institutional conscientious objection. To do so, we articulate a metaphysical model of institutional conscience, and consider three well-known arguments for undermining institutional conscientious objection in light of this model. We show how our metaphysical analysis of institutions creates difficulties for justifying sanctions on institutions that conscientiously object. Thus, we argue, questions about the metaphysics of institutions are deserving of serious attention from both critics and defenders of institutional conscientious objection. (shrink)

Although the expression 'intellectual property' is widely used, it could be argued that the very idea of intellectual property is incoherent. After all, ideas are not like land, houses or clothing; surely they are not the sorts of things that can be owned? I shall examine two arguments - one ontological, one jurisprudential - that put pressure on the coherence of the idea of intellectual property, both leading to the conclusion that intellectual property rights are not genuine property rights, but (...) rights to monopolies. In setting up and responding to the first argument, I discuss the applicability of the type/ token distinction to intellectual property law; a distinction I also appeal to as a way of clarifying my response to the second argument. PURPOSE: The purpose of this paper is to consider some of the philosophical and bioethical issues raised by the creation of the draft social values framework developed to facilitate data collection and country-specific presentations at the inaugural workshop on "Social values and health priority setting" held in February 2011. -/- DESIGN/METHODOLOGY/APPROACH: Conceptual analysis is used to analyse the term "social values", as employed in the framework, and its relationship to related ideas such as moral values. The structure of the framework (...) (process and content values) is considered in light of current debate in philosophy and bioethics about the political and moral aims served by these kinds of values, and the extent to which they are either suited to, or sufficient for, the policy context. -/- FINDINGS: There is much to be gained by engaging with the arguments presented in the philosophical literature in order to further refine the framework. The framework should remain neutral in respect of the importance of procedural values in different contexts and should be as inclusive as possible in respect of the principles it includes. Further development would be best served by taking a multidisciplinary approach. The framework could provide a valuable space in which future debates about procedural/substantive values can be considered. -/- ORIGINALITY/VALUE: The paper brings philosophical and bioethics perspectives to bear on a new framework proposed for the analysis of social values in health priority setting. It identifies how such a practical, policy-focused framework might be informed by engagement with deeper, and often unresolved, questions or principle around resource allocation in health. (shrink)

A partir do século XVIII, a imposição do controle das principais instituições políticas e sociais à população passa a ocorrer precipuamente por meio de estratégias urbanísticas. A arquitetura revela o objetivo de disciplinamento dos corpos de modo a prepará-los para a inserção na incipiente sociedade capitalista, seja na forma das escolas, fábricas ou prisões. Objetivamos num primeiro momento refletir, por meio da trajetória histórica e arquitetônica da Biblioteca Pública Municipal de Marília, se a biblioteca antiga tem preponderância de uma instituição (...) disciplinar; para, em um segundo momento, apresentar a arquitetura no novo prédio, verificando se o novo modelo de biblioteca pode evidenciar a transição do modelo disciplinar ao de controle. Metodologicamente, trata-se de uma pesquisa de natureza qualitativa, documental e bibliográfica, na qual utilizamos o método Análise de Conteúdo da Bardin para analisarmos categorias de entrevista. Para tanto, nos valemos um pouco do pensamento de Foucault e Deleuze acerca do tema, bem como o histórico, arquitetura e um pouco da organização das coleções da biblioteca em questão, nos espaços e tempos diferentes. Concluímos que a nova biblioteca não é melhor do que a anterior. Ela apenas se adequa melhor aos ditames dos novos tempos, com novas perspectivas sociais e tecnológicas. A antiga biblioteca teve uma função muito importante na história da cidade e dos seus usuários. Somente não estava mais apropriada ao século XXI, necessitando de novo aspecto e sentido. (shrink)

Conceptual congruency effects are biases induced by an irrelevant conceptual dimension of a task (e.g., location in vertical space) on the processing of another, relevant dimension (e.g., judging words’ emotional evaluation). Such effects are a central empirical pillar for recent views about how the mind/brain represents concepts. In the present paper, we show how attentional cueing (both exogenous and endogenous) to each conceptual dimension succeeds in modifying both the manifestation and the symmetry of the effect. It is shown that a locally finite polyadic algebra on an infinite set V of variables is a Boolean-algebra object, endowed with some internal supremum morphism, in the category of locally finite transformation sets on V. Then, this new categorical definition of polyadic algebras is used to simplify the theory of these algebras. Two examples are given: the construction of dilatations and the definition of terms and constants.

It is shown that axiomatic extensions of intuitionistic propositional calculus defining univocally new connectives, including those proposed by Gabbay, are strongly complete with respect to valuations in Heyting algebras with additional operations. In all cases, the double negation of such a connective is equivalent to a formula of intuitionistic calculus. Thus, under the excluded third law it collapses to a classical formula, showing that this condition in Gabbay's definition is redundant. Moreover, such connectives can not be interpreted in all Heyting (...) algebras, unless they are already equivalent to a formula of intuitionistic calculus. These facts relativize to connectives over intermediate logics. In particular, the intermediate logic with values in the chain of length n may be "completed" conservatively by adding a single unary connective, so that the expanded system does not allow further axiomatic extensions by new connectives. Several bioethicists have recently discussed the complexity of defining human death, and considered in particular how our definition of death affects our understanding of the ethics of vital organ procurement. In this brief paper, we challenge the mainstream medical definition of human death—namely, that death is equivalent to total brain failure—and argue with Nair-Collins and Miller that integrated biological functions can continue even after total brain failure has occurred. We discuss the implications of Nair-Collins and Miller’s argument and suggest that (...) it may be necessary to look for alternative biological markers that reliably indicate the death of a human being. We reject the suggestion that we should abandon the dead-donor criteria for organ donation. Rather than weaken the ethical standards for vital organ procurement, it may be necessary to make them more demanding. The aim of this paper is not to justify the dead donor rule. Rather, we aim to explore the perspective of those who agree with critiques of the whole brain and cardiopulmonary definitions of death but yet disagree with the proposal that we should abandon the dead-donor rule. We will consider what those who want to retain the dead-donor rule must argue in light of Nair-Collins and Miller’s critique. (shrink)

We prove strong completeness of the □-version and the ◊-version of a Gödel modal logic based on Kripke models where propositions at each world and the accessibility relation are both infinitely valued in the standard Gödel algebra [0,1]. Some asymmetries are revealed: validity in the first logic is reducible to the class of frames having two-valued accessibility relation and this logic does not enjoy the finite model property, while validity in the second logic requires truly fuzzy accessibility relations and this (...) logic has the finite model property. Analogues of the classical modal systems D, T, S4 and S5 are considered also, and the completeness results are extended to languages enriched with a discrete well ordered set of truth constants. Insurance is pervasive in many social settings. As a cooperative device based on risk pooling, it serves to attenuate the adverse consequences of various risks by offering policyholders coverage against the losses implied by adverse events in exchange for the payment of premiums. In the insurance industry, the concept of actuarial fairness serves to establish what could be adequate, fair premiums. Accordingly, premiums paid by policyholders should match as closely as possible their risk exposure. Such premiums are the product of (...) the probabilities of losses and the expected losses. This article presents a discussion of the fairness of actuarial fairness through three steps: defining the concept based on its formulation within the insurance industry; determining in which sense it may be about fairness; and raising some objections to the actual fairness of actuarial fairness. The necessity of a normative evaluation of actuarial fairness is justified by the influence of the concept on the current reforms of public insurance systems and the fact that it highlights the question of the repartition of the gains and burdens of social cooperation. In this paper, we present a prenex form theorem for a version of Independence Friendly logic, a logic with imperfect information. Lifting classical results to such logics turns out not to be straightforward, because independence conditions make the formulas sensitive to signalling phenomena. In particular, nested quantification over the same variable is shown to cause problems. For instance, renaming of bound variables may change the interpretations of a formula, there are only restricted quantifier extraction theorems, and slashed connectives cannot be (...) so easily removed. Thus we correct some claims from Hintikka [8], Caicedo & Krynicki [3] and Hodges [11]. We refine definitions, in particular the notion of equivalence, and sharpen preconditions, allowing us to restore those claims, including the prenex form theorem of Caicedo & Krynicki [3], and, as a side result, we obtain an application to Skolem forms of classical formulas. It is a known fact that a complete calculus for IF-logic is impossible, but with our results we establish several quantifier rules that form a partial calculus of equivalence for a general version of IF-logic reflecting general properties of information flow in games. There has been significant debate about whether the moral norms of medical practice arise from some feature or set of features internal to the discipline of medicine. In this article, I analyze Edmund Pellegrino’s conception of the internal morality of medicine, and situate it in the context of Alasdair MacIntyre’s influential account of “practice.” Building upon MacIntyre, Pellegrino argued that medicine is a social practice with its own unique goals—namely, the medical, human, and spiritual good of the patient—and that the (...) moral norms that govern medical practice are derived from these goals. After providing an overview of Pellegrino’s work, I discuss some forceful objections to his theory—specifically, that it is too rigid and incapable of entering into dialogue with contemporary values systems; that it is dependent on an external conception of human flourishing; and that it is incompatible with the rapidly changing nature of modern medicine. In the final section of this article, I consider how theorists working in the Hippocratic tradition might respond to these objections against ethical essentialism by drawing upon MacIntyre’s historico-cultural method as well as what he calls Aristotle’s “metaphysical biology.”. In this article we defend the inferential view of scientific models and idealisation. Models are seen as “inferential prostheses” (instruments for surrogative reasoning) construed by means of an idealisation-concretisation process, which we essentially understand as a kind of counterfactual deformation procedure (also analysed in inferential terms). The value of scientific representation is understood in terms not only of the success of the inferential outcomes arrived at with its help, but also of the heuristic power of representation and their capacity to (...) correct and improve our models. This provides us with an argument against Sugden’s account of credible models: the likelihood or realisticness (their “credibility”) is not always a good measure of their acceptability. As opposed to “credibility” we propose the notion of “enlightening”, which is the capacity of giving us understanding in the sense of an inferential ability. (shrink)

Le Pere Xavier Tilliette est l'un des plus grands historiens contemporains de la philosophie. Il est l'auteur d'une monumentale etude en deux volumes sur Schelling... qui il avait d'ailleurs consacre plusieurs autres ouvrages. Il a egalement ecrit d'excellents livres sur d'autres grandes figures de la philosophie occidentale notamment Fichte, Merleau-Ponty, Lequier. Il est aussi et surtout le representant le plus connu d'un genre unique de la philosophie de la religion, celui qui traite des grands themes de la theologie chretienne (...) selon leurs dimensions proprement philosophiques. Rappelons simplement plusieurs travaux tres novateurs sur le Christ et la philosophie, mais aussi sur la philosophie et l'Eglise ou encore la philosophie et l'Eucharistie. Toutefois, Xavier Tilliette n'est pas seulement philosophe, il est aussi un grand erudit de l'histoire litteraire francaise, notamment de l'oeuvre de Paul Claudel. Apres deux Festschrift anterieures parues respectivement en Allemagne et en Italie, ce troisieme recueil publie en l'honneur du Pere Tilliette est edite en Belgique. Il contient trente contributions, plus de la moitie consacrees... l'histoire de la philosophie, avec un nombre eleve de textes sur Schelling. Les autres etudes, tres variees, tres originales, relevent de la philosophie de la religion, de la theologie philosophique et de l'histoire de la litterature. Ces travaux dont les auteurs, en provenance de huit pays et de trois continents, vont de jeunes erudits... peine trentenaires jusqu'aux contemporains de l'illustre jesuite, sont rediges en Francais, en Italien, en Allemand et en Anglais. Ils manifestent et illustrent la fecondite de l'oeuvre de ce disciple fervent des Peres de Lubac et Danielou, son rayonnement extraordinaire, les richesses multivalentes de ses deux-mille publications. The Statesman is a difficult and puzzling Platonic dialogue. In A Stranger's Knowledge Marquez argues that Plato abandons here the classic idea, prominent in the Republic, that the philosopher, qua philosopher, is qualified to rule. Instead, the dialogue presents the statesman as different from the philosopher, the possessor of a specialist expertise that cannot be reduced to philosophy. The expertise is of how to make a city resilient against internal and external conflict in light of the imperfect sociality of human (...) beings and the poverty of their reason. This expertise, however, cannot be produced on demand: one cannot train statesmen like one might train carpenters. Worse, it cannot be made acceptable to the citizens, or operate in ways that are not deeply destructive to the city's stability. Even as the political community requires his knowledge for its preservation, the genuine statesman must remain a stranger to the city. Marquez shows how this impasse is the key to understanding the ambiguous reevaluation of the rule of law that is the most striking feature of the political philosophy of the Statesman. The law appears here as a mere approximation of the expertise of the inevitably absent statesman, dim images and static snapshots of the clear and dynamic expertise required to steer the ship of state across the storms of the political world. Yet such laws, even when they are not created by genuine statesmen, can often provide the city with a limited form of cognitive capital that enables it to preserve itself in the long run, so long as citizens, and especially leaders, retain a “philosophical” attitude towards them. It is only when rulers know that they do not know better than the laws what is just or good (and yet want to know what is just and good) that the city can be preserved. The dialogue is thus, in a sense, the vindication of the philosopher-king in the absence of genuine political knowledge. (shrink)

The flâneur has remained little more than a hazy, nostalgic figure since first described in detail by Baudelaire in 19th-century Paris. Here, the work of Walter Benjamin, who did more than any other to advance the notion of flânerie post-Baudelaire, is considered alongside that of his friend and critic Theodor Adorno, in an attempt to conceive of a modern-day version of the type. The many critical exchanges between Adorno and Benjamin are envisioned as a moving dialectic: a constant interplay between (...) anticipation and suspicion. What results is a concept of flânerie that mingles a tentatively optimistic Benjamin with a perpetually sceptical Adorno, in order to conjure up an image of the individual strolling and wandering about the margins of contemporary urbanity, balanced on the cusp of hope and hopelessness.
