This article examines two medieval sermons that examine philosophic and halakhic issues: the Passover sermon of Hasdai Crescas, which discusses the laws of Passover, and a sermon of Zerahia Halevi Saladin, a disciple of Crescas, which probes an aspect of the laws of vows ( nedarim ). In the analysis of Zerahia's sermon, a comparison is made between his discussion and Thomas Aquinas's examination of vows in his Summa Theologica . The comparison establishes the dependency of (...) Zerahia on Aquinas regarding this issue. Likewise, Zerahia's sermon is compared with Crescas's, and the relationship between the legal theories of Crescas and Zerahia is investigated. The articles concludes with a brief examination of the significance of the analysis these sermons for understanding of the impact of scholastic sources on Spanish-Jewish philosophy and the relationship between law and philosophy in the writings of Hasdai Crescas and his students. The Kuzari: In Defense of the Despised Faith is the first new translation into English of The Kuzari since 1905, annotated and explained based on the classic commentaries. Written by Rabbi Yehuda HaLevi of Spain over a period of twenty years and completed in 1140, The Kuzari has enthralled generations of Jews and non-Jews alike with its clear-cut presentation on Judaism, and its polemics against Greek philosophy, Christianity, Islam, and Karaism.

English summary: Within the span of a single century (from the mid-15th to the mid-16th centuries), the Greek language, which was well on its way to oblivion, became the focus of one of the most heated debates of the Renaissance period. Greek was accused by what was then a Catholic and Latin Europe of being a vehicle for ancient paganism, Byzantine schism, and even Lutheran heresy. The Council of Trent, which deemed that Roman authority was being undermined by the Vulgate's (...) philological criticism, went so far as to confirm the obvious collusion that existed between Greek and heresy. In fact, behind such accusations can be discerned the power struggles that were taking place between ecclesiastical, academic and political factions. Analysis of such confrontations and of the difficulties that Humanists had in circumventing them, infers that, despite its ultimate success, Greek literature remained suspect in Europe throughout the Counter-Reformation. In this very meticulous study, based on previously unpublished texts, of what was at stake in this anti-Greek movement (a resistance actually based on free, progressive and critical thought), the author combines the thoroughness of an historian with a mine of true anecdotes about the moral standards of that era : the censure practices, legal disputes, self-serving denouncements, etc. That, indeed, were the most evident driving forces behind the intellectual and power struggles. French description: Le grec, disparu d'Europe depuis les Grandes Invasions, fit un retour spectaculaire au XVe siecle. Mais l'enthousiasme des humanistes pour la langue d'Homere a fait oublier la violence des resistances que lui opposerent les maitres scolastiques. Lorsque Erasme osa contester la Vulgate latine au nom de la verite grecque (1516), le scandale eclata publiquement et Luther en prit argument pour contester l'autorite de Rome, si bien que les hellenistes furent accuses de faire le jeu de la Reforme. Le statut du grec se vit etroitement lie a celui de l'hebreu, l'autre langue sacree rivale du latin (l'Affaire Reuchlin). Pour extirper le mal a sa racine, le concile de Trente decida finalement d'imposer la legitimite du latin biblique (1545) et d'interdire l'acces aux sources grecques et hebraiques, puis de mettre a l'index les principaux hellenistes et leurs imprimeurs. Les etudes grecques allaient en rester durablement affaiblies dans l'Europe de la Contre-Reforme. En faisant revivre les oeuvres et les hommes qui en furent les acteurs, et en devoilant ses veritables enjeux, ce livre retrace les deux siecles de cette bataille du grec, restee un point aveugle dans l'histoire de la culture occidentale. We initiate the study of definable [Formula: see text]-topologies and show that there is at most one such [Formula: see text]-topology on a [Formula: see text]-henselian NIP field. Equivalently, we show that if [Formula: see text] is a bi-valued NIP field with [Formula: see text] henselian, then [Formula: see text] and [Formula: see text] are comparable. As a consequence, Shelah’s conjecture for NIP fields implies the henselianity conjecture for NIP fields. Furthermore, the latter conjecture is proved for any field admitting (...) a henselian valuation with a dp-minimal residue field. In lieu of an abstract, here is a brief excerpt of the content:The Theologian's Doubts:Natural Philosophy and the Skeptical Games of GhazālīLeor HaleviIn the history of skeptical thought, which normally leaps from the Pyrrhonists to the rediscovery of Sextus Empiricus in the sixteenth century, Abū Ḥāmid Muḥammad al-Ghazālī (1058-1111) figures as a medieval curiosity. Skeptical enough to merit passing acknowledgment, he has proven too baffling to be treated fully alongside pagan, atheist, or materialist philosophers. As a theologian defending certain Muslim (...) dogmas, Ghazālī has not met what historians consider the mark of the true skeptic, a mind doubting the possibility of all systems of knowledge. But what is fascinating about him is that he brought into practical operation the tools of what I call "functional skepticism."1He denied the claims to truth of Aristotelian physics—whose basis he showed to rest on groundless belief—then turned and argued for the possibility of the Resurrection tooth and nail. The scholarly debate on The Incoherence of the Philosophers (Tahāfut al-falāsifa) has concentrated on the extent to which Ghazālī qua Ashcarite theologian was seduced into Aristotelian philosophy despite himself.2 In my view this debate has been misguided in the attempt to distill the [End Page 19] essence of Ghazālī from the book's eclectic theology; I will argue for a different view of Ghazālī on the basis of a close reading of key passages. In the unusual sections where Ghazālī applies Aristotelian language to a world not following the ordinary laws of physics, some have found Ghazālī slipping, unconsciously perhaps, into an Aristotelian frame of mind. I will show that, as a skeptical theologian with a dialogic imagination, he was rather deconstructing Aristotelian discourse while playing a Wittgensteinian sort of language game.Natural Philosopher or Speculative Theologian?The disagreement about the extent to which philosophy infected Ghazālī is ancient. Ghazālī might have studied philosophy only in order to refute it. He himself defended his philosophizing with the claim that one cannot deconstruct a system of thought until one has understood it so deeply as to elaborate upon its fundamental principles.3 His Maqāṣid al-falāsifa was in fact received, especially in trans-Pyrenean Europe, as a philosopher's genuine summary of the object of philosophy.4 The book strikes me as suspiciously creative in its representation of philosophical discourse, but it appears in any case as an expert and surprisingly unbiased treatment.5 Arabic readers knew that Ghazālī had also written a polemical treatise against philosophy, Tahāfut al-falāsifa, but they still wondered about his engagement with the ideas he challenged. Abū Bakr Ibn al-cArabī, for example, commented that Ghazālī had been unable to extricate himself from philosophy.6 Other philosophers pondered whether or not he had been a closeted member of their charmed circle and sought in his writings traces of esoteric philosophy.7Averroës's own sober sense of distance between philosophy and theology was partially a reaction to what he perceived as Ghazālī's dangerous and carefree mixture of the two sciences.8 He attacked Ghazālī's book in The Incoherence [End Page 20] of the Incoherence to restore philosophy's sense of purity, an aim he sought to accomplish by separating religious concerns from the philosopher's field of inquiry.9 Ironically, such a separation is precisely what Ghazālī might have wished to provoke by crisscrossing and blurring the line between religion and philosophy.The modern debate on chapter 17 of Tahāfut al-falāsifa has concentrated on defining Ghazālī as either a natural philosopher or an occasionalist theologian. In his defense of the possibility of miracles Ghazālī presented two theories of causation, one denying the logical basis of Aristotelian notions of natural causality, and the other more or less adopting these notions. Fear can undermine cooperation. It may discourage individuals from collaborating with others because of concerns about potential exploitation; prompt them to engage in defensive aggression by launching a preemptive strike; and propel power-seeking individuals to act dominantly rather than compassionately. Therefore, accumulated evidence requires a more contextualized consideration of the link between fear and cooperation in adults.

Online Public Shaming is a form of norm enforcement that involves collectively imposing reputational costs on a person for having a certain kind of moral character. OPS actions aim to disqualify her from public discussion and certain normal human relations. We argue that this constitutes an informal collective punishment that it is presumptively wrong to impose on others. OPS functions as a form of ostracism that fails to show equal basic respect to its targets. Additionally, in seeking to mobilise unconstrained (...) collective power with potentially serious punitive consequences, OPS is incompatible with due process values. (shrink)

This second installment in a chronologically arranged, three-part sequence continues the author's examination of Anglo-American literati who, in the later nineteenth and twentieth centuries, turned — in acts of combined xenophilia and xenophobia — to Russian literature and literary theory in order to escape the dominant influence of avant-garde movements in France. These Anglophone writers found in Russian exemplars a responsible, morally rigorous, and pragmatic, yet philosophically sophisticated, alternative to what they described as the amoral, superficial, and pretentious aestheticism of (...) French literary culture. Part 2 treats the poetry and criticism of the English “Movement” poet Donald Davie in light of his turn, in 1958, toward the example of Boris Pasternak as a way of escaping the influence of French Symbolist poetics and the post-Symbolist poetics of anglophone modernism. Although Davie understood that Pasternak was as much a modernist as T. S. Eliot or Ezra Pound, he also argued that the Russian's poetry, unlike theirs, sought, on explicitly moral grounds, to maintain conventional syntax and purity of diction, with the result that Pasternak's verse communicates with the reader more as prose than as music does. This article is the first installment of a three-part contribution to the Common Knowledge symposium on xenophilia. The series of three examines the ways in which Anglo-American writers, from the mid-nineteenth until the late twentieth century, turned to Russian literature and literary theory to escape the otherwise inevitable influence of French avant-garde literary movements. These writers—Henry James in part 1, Donald Davie in part 2, and the “American Bakhtinian” critics in part 3—found in Russian examples a responsible yet radical and (...) morally oriented alternative to what they considered the extravagant, haughty, and corrupt aestheticism of French literary culture. Thus, these essays concern the interplay of xenophilia with xenophobia. Part 1 treats James's turn, commencing around 1875, to the example of Ivan Turgenev as a way of getting beyond the example of Flaubert and the other “grandsons of Balzac” with whom he was then keeping company in Paris. Turgenev and Flaubert were both Realists, but the Russian writer, in contrast to the French, cared not only for verbal beauty but also for what James called “moral glamour” in the art of fiction. Is reducing large-scale intergroup conflict the business of corporations? Although large corporations can use their power and prominence to reduce intergroup conflict in society, it is unclear to what extent stakeholders support corporate Intergroup Responsibility. Study 1 showed that support for CIR correlates in theoretically meaningful ways with relevant economic, social, and moral attitudes, including fair market ideology, consumer support for corporate social responsibility, social dominance orientation, symbolic racism, and moral foundations. Studies 2 and 3 employed experimental designs to test (...) the hypothesis that business leaders who advocate for intergroup tolerance boost perceptions of corporations and their leaders as moral, just, and fair, which in turn, increases stakeholders’ support for CIR. We found support for this hypothesis across two highly publicized and contentious events related to racial conflict in the U.S.: The White supremacy rally in Charlottesville and the federal government’s announcement about the planned rescinding of the Deferred Action for Childhood Arrivals immigration policy. Specifically, exposing participants to real-world tweets by CEOs who advocated intergroup tolerance following these events increased participants’ support for CIR. This effect was mediated by heightened perceptions of corporations and their leaders as moral, just, and fair. Taken together, these findings enhance our understanding of the factors that shape stakeholders’ reactions to CIR; highlight intergroup conflict as an emerging arena for CSR; and illustrate the power of ethical intergroup leadership. The paper engages the conceptual question of the nature of rights. First, moral methodology for developing criteria to judge the adequacy of theories for the concept of rights is discussed. Standard methodologies for conceptual theory, such as analysis of language practices, appealing to intuitions to test and correct hypotheses, and mixtures of these with appeals to substantive moral values, are shown to fail in important ways to give us reasons to adopt one or another view of the concept. An alternative (...) methodology is proposed which appeals to the distinct role of concepts in our value scheme (the added value of being able to employ such concepts in our moral judgments). This is then used to develop criteria for a successful theory of rights. Two existing theories are shown, as a matter of illustration, to fail to satisfy the criteria, and finally an alternative theory of rights which does satisfy these criteria is proposed and defended. Transnational effects are identified as those economic effects which cross state boundaries. Where these effects are negative, as illustrated by the ‘transnational case’, it is asked what the appropriate ethical analysis of such a case might be. If we leave aside a social distributive justice analysis, for reasons given, then a typical move is to claim that transnational economic effects are analysable as human rights violations. The paper examines this claim and identifies the specific view of human rights which motivates (...) it: the ‘outcomes view of human rights’. It is then shown how the outcomes view of human rights ultimately collapses into social distributive justice-type standards and so suffers from the same problems raised against using those standards for transnational effects. An alternative approach to human rights is sketched, although a complete theory of human rights is not offered. Finally, a different type of justice analysis for transnational cases is offered in which a form of international justice proper is proposed. (shrink)

This paper distinguishes four major types of futility (physiological, imminent demise, lethal condition, and qualitative) that have been advocated in the literature either in a patient dependent or a patient independent fashion. It proposes five criteria (precision, prospective, social acceptability, significant number, and non-agreement) that any definition of futility must satisfy if it is to serve as the basis for unilaterally limiting futile care. It then argues that none of the definitions that have been advocated meet the criteria, primarily because (...) their proponents have not paid sufficient attention to the problematic nature of the data supporting the use of their definitions. Cosmopolitan critics attack the scope-limitation of justice of egalitarian liberal theorists to states. They treat justice as the production of a given set of outcomes for people regardless of location or relationship. However, in doing so they either ignore the relevant agent towards whom principles of justice are addressed or see the question of agency as a practical, derivative question, of a secondary character. This paper argues that a principle of justice without a clearly justified agent is not a genuine (...) principle at all. This is what writers like Rawls mean by the "subject" of justice (analogous to the grammatical subject of a sentence, i.e.,the agent). We should reflect on agents and why they would or would not justifiably carry certain burdens for others and what kind of benefits or goods they are able to secure. The answers to those questions explain why the idea of cosmopolitan global justice is incomplete, either requiring a global basic structural agency or not applying because no relevant agent is present that can create cooperative arrangements between individual persons across the globe. Other moral principles will still apply globally, but they will be distinct from those that apply to basic-structural agencies. This account is not a practice dependence account, as it bases the distinctness of moral and political principles on purely moral and value-based considerations. (shrink)

We put in print a classical result that states that for most purposes, there is no harm in assuming the existence of saturated models in model theory. The presentation is aimed for model theorists with only basic knowledge of axiomatic set theory.

In his introduction to part 2 of the Common Knowledge symposium on xenophilia, the journal's editor tours the reader through two private apartments and through two public art collections in an effort to establish that aesthetically coherent mixtures of apparently immiscible objects from widely divergent cultures are possible and also morally glamorous. Xenophobia at its least reprehensible, he argues, is a fear of ecumenism and its consequences, as well as a fear of one's own conversion — of “turning Turk.” Xenophilia (...) at its most admirable is a pursuit of coherent mixtures where others cannot imagine their possibility. Bits lifted from reputedly pure and organic wholes may be transformed by means of overlap and mediated juxtaposition into a novel milieu that has a wholeness, authenticity, and charisma of its own. Such coherence depends on minds that are capable of loving what does not satisfy their narcissism and that can sense in the products of their own culture elements or signs of enervation, anomie, lack, derangement, waywardness, rigidity, preciousness, or warping. The author concludes that xenophilia neither signals nor facilitates the adulteration that xenophobes so fear. (shrink)

The author introduces us to the mythology, system of thought and social practices of the Inuit in an attempt to discover their conception of social sex (or gender). Unlike the binary conception that predominates among westerners, the Inuit have a tripartite system in which some individuals, men or women, straddle the social frontier between the sexes/genders. This third social sex, which is prominent in mythology and among the great mythical figures, is also found at the heart of shamanistic mediations, as (...) well as in many families, where the identity of dead relatives is transmitted to the 'newborn', regardless of their sex. When the sex is different, the children are cross-dressed till puberty, after which time they have to take on the gender corresponding to their sex, but a number of these young people used to become shamans and so continued to assume the mediations of the third social sex. Halevy (1872-1962) was a French historian who became a friend of Marcel Proust while studying at the Lycee Condorcet. This biography of the celebrated German philosopher, Nietzsche, was first published in the original French in 1909 and appeared in this English translation in 1911.

Either a person's claim to subsistence goods is held against institutions equipped to distribute social benefits and burdens fairly or it is made regardless of such a social scheme. If the former, then one's claim is not best understood as based on principles setting out a subsistence goods entitlement, but rather on principles of equitable social distribution — a fair share. If, however, the claim is not against a given social scheme, no plausible principle exists defining what counts as a (...) reasonable burden for any of the available agents to secure subsistence. No justifiable principle exists implying generalised perfect duties any agent could clearly follow or clearly breach that secure subsistence conditions for others. At best we can justify rescue duties under very specific conditions, or general but imperfect duties to improve arrangements. Neither of these obviously correlates with human rights standards. Attempts in the literature to overcome the dilemma by claiming basic rights can correlate with imperfect duties or can generate duties to work towards institutions that ‘perfect’ our imperfect duties, are faulty. I then show how the dilemma can be avoided by accounts of human rights focusing on minimum respectful treatment rather than goods or interests. (shrink)

International Human Rights Law is clear in holding only states or state-like entities responsible for human rights abuses, yet activists and philosophers alike do not see any rational basis for this restriction in responsibility. Multi-national corporations, individuals and a whole array of other 'non‐state actors' are capable of harming vital human interests just as much as states, so why single-out the latter as human rights-responsible agents? In this paper I distinguish two ways of looking at human rights responsibility. One is (...) simply in terms of the outcomes that are deemed desirable to avoid (or secure), and the other is in terms of the relationships one sees these moral standards as governing. I argue that the peculiar form of responsibility and responsiveness (the way of 'holding to account')inherent to human rights principles is directed at establishing a particular type of relationship: one in which individuals are empowered in the face of a very special form of communal power. Other kinds of relationship and potential transgression are more appropriately governed by different kinds of moral principles, such as those relating to criminality. The outcomes view fails to incorporate this insight and for that reason fails to see the distinct role played by human rights standards in our moral reasoning: they are precisely valuable because they provide a way to judge the relationship of individuals to the peculiar kind of power exercised by the state. Part of this project is a re-assessment of the methodology employed by philosophers in establishing moral principles and concepts, such as those relating to human rights standards. (shrink)

In this paper, I make three points. The first is that there is indeed a distinctive approach to moral methodology, different from standard moral reasoning, that can be described as “practice-dependence”. I argue that its distinctness lies in recommending an aptness claim , namely that moral principles for regulating social practices must be principles for better fulfilling the point of those practices, a point discoverable in shared understandings of the practice. Participants treat domestic political societies as having a different point (...) to the practice of international relations. On this approach, then, different moral principles apply in each case: principles of distributive justice between citizens in the former and principles of cooperative fairness between states in the latter. My second point is that this approach fails, however, an important test which I call the justifiability constraint . Any formulation of a moral principle assigning rights and duties, benefits and burdens, to people should be justifiable to those persons by reference to a moral value. Yet, as I show, the practice-dependence view cannot offer any justification based on moral value for the aptness claim. My last point is that both endorsers and critics of practice-dependence have mistakenly attributed this approach to theorists who restrict the scope of justice on the basis of moral justification. Such views are, in fact, incompatible with the aptness claim given that they offer plausible independently derived moral grounds for restricting the scope of justice. They are also compatible with the justifiability constraint. For these reasons, I conclude that practice-dependence is a red herring for debates on global justice. (shrink)

A branch of political philosophy treats human rights as the output of democratic deliberations by a certain kind of polity. This school, represented by theorists like Benhabib and Besson, do not see detailed human rights as constraints on legitimacy but rather as the specification of abstract human rights (such as the "right to have rights") in terms of obligations and the distribution of burdens. This paper argues that the position is untenable as the notion of democratic decision-making depends on sufficiently (...) clear and specified human rights standards and the political respect they guarantee. Furthermore, the form that any democratic deliberation will take must express respect and reasonableness towards both rights recipients and burden-bearers. To do so, a clear sense of human rights must exist as a threshold, as must standards of societal justice and fairness. Human rights must come first, as a background condition of democracy. (shrink)

When they are, they are often offered as two complementary solutions for the problem of achieving political unity and a degree of mutual acceptance within a pluralist liberal polity. The essay shows the concepts to be fundamentally distinct, and then argues that instead of being mutually supporting, they are mutually exclusive. Neutralist liberals, it is argued, must give up toleration in favour of the virtue of neutrality on the part of citizens.
