In this paper, we identify the way in which various forms of legal personhood can be differentiated from one another by comparing these entities with a—not too farfetched—hypothetical situation in which intelligence spontaneously evolves within the internet: spontaneous intelligence. In these terms, we consider the challenges that may arise where SI as an entity: has no owner, no designer, and no controller; has evolved into existence as a non-human created intelligence; is autonomous; has no physical form; and, although it exists (...) around the world, exists in no particular jurisdiction. Based on this refined notion of SI, we consider issues related to the recognition of such an entity’s legal personhood. By briefly exploring the attribution of legal personality to various entities—including, humans, corporations, artificial intelligence and higher forms of animal life—we differentiate SI from these other forms of intelligence whilst illustrating it shares most characteristics with human intelligence and not, as may intuitively be thought, with various forms of AI. After critically evaluating the classification of these various forms of intelligence, we briefly suggest some ramifications of these differences and suggest that the approach adopted may assist in drawing more effective boundaries between the entities that are already recognised as legal persons, as well as between sub-categories of entities, such as various forms of AI. Technology scholars and journalists have recently called attention to digital platforms’ and devices’ ability to influence users based on their present moods, stress level, hunger, and other transient features. For them, such influence based on users’ present status – what the chapter calls “real-time profiling” – is not only a clear form of wrongful manipulation but also online manipulation’s future. The chapter aims to explain what makes real-time profiling wrong (when wrong) and discusses problems associated with its regulation. After explaining (...) what real-time profiling consists in and showing that it can be presumed to be a form of manipulation, the chapter argues that real-time profiling is wrong both because the profiler psychologically hijacks profiled subjects and because it works as a gateway to further wrongs. Towards the end, the chapter discusses some implications of the proposed account for the legal regulation of online manipulative technologies like real-time profiling. It is argued that existing legal frameworks are not fine-grained enough to deal with the wrongs associated with real-time profiling and related forms of online manipulation. (shrink)

The main task is to discuss the issue in belief dynamics in which philosophical beliefs and rational introspective agents incorporate Moorean type new information. First, a brief survey is conducted on Moore’s Paradox, and one of its solutions is introduced with the help of Update Semantics. Then, we present a Dynamic Doxastic Logic (DDL) which revises the belief of introspective agents put forward by Lindström & Rabinowicz. Next, we attempt to incorporate Moorean type new information within the DEL (DDL) framework, (...) as advised by van Benthem, Segerberg et al. Though we maintain the principle of “the primacy of new information” from the literature on traditional belief revision theory, several unsuccessful ways are also presented. We then conclude that some special kind of success (weak success) can still be found in those revision processes although absolute success does not hold. At last, the relevant problem of “learnability” is re-considered through weak success. (shrink)

In this article, we consider the possible application of the European General Data Protection Regulation to “citizen scientist”-led health research with mobile devices. We argue that the GDPR likely does cover this activity, depending on the specific context and the territorial scope. Remaining open questions that result from our analysis lead us to call for lex specialis that would provide greater clarity and certainty regarding the processing of health data by for research purposes, including these non-traditional researchers.

With the ultrahigh-speed, large-scale development of tourism and the increasing frequency, intensity, and scope of extreme natural hazards in the context of climate warming, tourism has entered a high-risk era. Based on the central urban area within the outer ring of Shanghai as the research area and the tourism attraction as the research object, this paper takes the flood scenario simulation combined with GIS network analysis to evaluate the spatial accessibility of the emergency response of urban key public service departments (...) under current and future river flood scenarios in different return periods. The results of the study show that, under the current and future flood scenarios, the submergence range is mainly distributed within 2 ∼ 3 km along the banks of the Huangpu River, and it tends to increase from north to south; there are 6, 9, and 21 tourism attractions in the emergency blind area under the once-in-a-century floods in 2010, 2030, and 2050 and 98, 105, and 112 tourism attractions in the emergency blind area under the once-in-a-millennium floods in 2010, 2030, and 2050, respectively; in the flood scene, local road traffic in the inundation area is interrupted by water, and 120 first aid cannot get or be delayed to some tourist attraction ; and in 2030, under the normal and flooding scenarios, 120 first aid in the downtown area of Shanghai has the fastest route to tourism attractions according to the speed of S1, S2, S3, and S4. The flooding intensity, road traffic conditions, and the number and location of key public service departments jointly determine the service scope and response time of medical emergency in urban floods. Since the flood control area of the central city in Shanghai is mainly distributed in the 2 ∼ 3 km area on both banks of the Huangpu River, the impact of flood on the emergency medical service in the entire central city is limited, mainly in some hospitals in the riverside area, where 120 emergency vehicles are unable or delayed to reach some tourism attractions. The research indicates that the quantitative assessment method of spatial accessibility of the emergency response under flood scenario simulation has important scientific value and practical significance, which can provide decision-making basis for emergency management of tourism in China’s urban flood disaster. Vaccine research, as well as the development, testing, clinical trials, and commercial uses of vaccines involve complex processes with various biological data that include gene and protein expression, analysis of molecular and cellular interactions, study of tissue and whole body responses, and extensive epidemiological modeling. Although many data resources are available to meet different aspects of vaccine needs, it remains a challenge how we are to standardize vaccine annotation, integrate data about varied vaccine types and resources, and support advanced vaccine (...) data analysis and inference. To address these problems, the community-based Vaccine Ontology (VO) has been developed through collaboration with vaccine researchers and many national and international centers and programs, including the National Center for Biomedical Ontology (NCBO), the Infectious Disease Ontology (IDO) Initiative, and the Ontology for Biomedical Investigations (OBI). VO utilizes the Basic Formal Ontology (BFO) as the top ontology and the Relation Ontology (RO) for definition of term relationships. VO is represented in the Web Ontology Language (OWL) and edited using the Protégé-OWL. Currently VO contains more than 2000 terms and relationships. VO emphasizes on classification of vaccines and vaccine components, vaccine quality and phenotypes, and host immune response to vaccines. These reflect different aspects of vaccine composition and biology and can thus be used to model individual vaccines. More than 200 licensed vaccines and many vaccine candidates in research or clinical trials have been modeled in VO. VO is being used for vaccine literature mining through collaboration with the National Center for Integrative Biomedical Informatics (NCIBI). Multiple VO applications will be presented. (shrink)

We give a general proof showing that if the evolution from one state to another is not reversible, then the projective measurements on the superposition of these two states are impossible. Applying this no-go result to the Schrödinger’s cat paradox implies that if something is claimed to be a real Schrödinger’s cat, there will be no measurable difference between it and a trivial classical mixture of ordinary cats in any physically implementable process, unless raising the dead becomes reality. Other similar (...) macroscopic quantum superpositions cannot be observed either, due to the lack of non-commuting measurement bases. Our proof does not involve any quantum interpretation theory and hypothesis. (shrink)

Depuis quelques décennies, un nombre grandissant de philosophes ont manifesté un intérêt accru pour la question du don. D'abord pour mettre en cause la toute puissance du marché qui étend son emprise. Mais au-delà de cette inquiétude liée à une situation historique, nombre de penseurs ont construit une réflexion sur le monde - sur l'être - comme donné. On tend alors à rattacher cette " donation originaire " à une éthique de la gratuité. Gratuité pure, geste unilatéral : telle est (...) la pensée du don qui, selon des styles et des arguments propres, domine chez J. Derrida, E. Levinas, J.-L. Marion et bien d'autres. Il était sans doute temps de se défaire de toutes les pensées du don un peu trop pieuses, devenues envahissantes dans la philosophie française de tradition phénoménologique. Confrontant le travail de ces philosophes au célèbre Essai sur le don de Marcel Mauss, Marcel Hénaff montre que le don est d'abord et avant tout une procédure de reconnaissance publique entre groupes au moyen de ces biens compris comme symboles d'une alliance. Si la metaphysique cartesienne permet a la raison d'eprouver sa finitude en erigeant au-dessus d'elle l'infinite incomprehensible du Dieu qui garantit ses verites, l'apologetique pascalienne, en attestant sa corruption, double son usage demonstratif d'un usage critique qui place la theologie au centre de toutes ses verites. C'est donc a la lumiere du dispositif qui provoque l'eclatement des Pensees qu'il convient de lire l'oeuvre entiere afin d'apercevoir sa rigoureuse systematicite et d'en reconnaitre la portee anticartesienne. Automated reasoning issues are addressed for a finite lattice-valued propositional logic LnP(X) with truth-values in a finite lattice-valued logical algebraic structure—lattice implication algebra. We investigate extended strategies and rules from classical logic to LnP(X) to simplify the procedure in the semantic level for testing the satisfiability of formulas in LnP(X) at a certain truth-value level α (α-satisfiability) while keeping the role of truth constant formula played in LnP(X). We propose a lock resolution method at a certain truth-value level α (α-lock (...) resolution) in LnP(X) and have proved its theorems of soundness and weak completeness, respectively. We provide more efficient resolution based automated reasoning in LnP(X) and key supports for α-resolution-based automated reasoning approaches and algorithms in lattice based linguistic truth-valued logic. ABSTRACT:Drawing upon John Rawls's framework inThe Law of Peoples,this paper argues that MNEs have a responsibility to promote well-ordered social and political institutions in host countries that lack them. This responsibility is grounded in a negative duty not to cause harm. In addition to addressing the objection that promoting well-ordered institutions represents unjustified interference by MNEs, the paper provides guidance for managers of MNEs operating in host countries that lack just institutions. Noonan and Jago proposed an answer to the challenge, by invoking a duplicate interpretation of the modal truths. Here I present a slightly different kind of modal truths which would prove inconvenient even for a Lewisian who accepts Noonan and Jago’s proposal.

The Consequence Argument for incompatibilism is beset by two rival interpretations: the counterfactual sufficiency interpretation and the counterfactual might interpretation. Waldrop recently argued that the counterfactual sufficiency interpretation conflicts with certain principles governing the logic of counterfactuals. In this paper, I show that Waldrop’s argument can be adapted to prove that the counterfactual might interpretation also conflicts with the same principles. So the problem Waldrop pointed out is not peculiar to the counterfactual sufficiency interpretation.

Second, by extending Rawls’s account to include a right to protection against arbitrary interference, the paper argues that TNCs can be said to have negative and positive obligations in the areas of human rights, labor standards, and environmental protection, as outlined in the U.N. China now faces a national identity problem, that is, sections of the national population do not identify with the Chinese nation-state in which they live. Tibetans, for example, endeavor to create their own political identity through the reconstruction of a Tibetan cultural and ethnic identity. China's national identity problem also involves the question of reunification with Taiwan. In Taiwan, both the Guomindang and the Democratic Progressive Party governments have refused to reunify with China. Technology and Ethics. A European Quest for Responsible Engineering, edited by B. Heriard Dubreuil and his team (University Lille) is in many regards an innovative publication. It is the first fully European contribution to the field of engineering ethics and the result of an intensive cooperation between ethicists and engineers from all the member countries of the European Union. The basic structure of the book is both the distinction and interaction between three levels of analysis: personal responsibility of engineers, the (...) institutional level (business organisations) and the impact of technology on society and culture. On the personal level, the book deals with problems such as the role of professional codes and the fact that engineers must cope with flexibility, shorter lines of decision and erosion of the boundaries between private and professional life. On the meso level, the book deals with different aspects of decision making in the context of business organizations, such as quality management, technology assessment procedures, business ethics committees etc... On the macro level, the authors focus on the power of technology.
