Upon entering the examination room, Caitlyn encounters a woman sitting alone and in distress. Caitlyn introduces herself as the hospital ethicist and tells the woman, Mrs. Dennis, that her aim is to help her reach a decision about whether to perform an autopsy on her recently deceased husband. Mrs. Dennis begins the encounter by telling the ethicist that she has to decide quickly, but that she is very torn about what to do. Mrs. Dennis adds, “My sons disagree about the (...) autopsy.” As a standardized patient, a specialized actor, the woman playing Mrs. Dennis has already delivered the same opening lines several times to different learners practicing their clinical ethics consultation skills. An SP encounter is a simulated patient encounter used for educational purposes that requires the standardization of verbal and behavioral responses. In the encounter, the simulator, or “patient,” uses a scripted medical history to enable the learner to employ a certain skill, say, the ability to perform a neurological exam. The use of standardized patients in the evaluation of clinical skills has become a staple in medical education. To tackle the challenge of teaching clinical ethics consultation skills, we have incorporated SP encounters into the curriculum of the Bioethics Program of The Union Graduate College and the Icahn School of Medicine at Mount Sinai. SP encounters are incorporated into one of our onsite classes, the Onsite Clinical Ethics Practicum, and they are part of the capstone examination, which all of our graduates must complete successfully. The inclusion of simulated encounters into the curriculum is one way in which we equip our students with the core competencies specified by the American Society for Bioethics and Humanities Task Force for clinical ethicists. The purpose of this paper is to examine the effect of corporate governance practices of small cap companies have had on their financial performances. Previous studies have mainly examined governance practices of larger corporations. This analysis focuses on the governance variables that have been highlighted by the New Zealand Securities Commission governance principles and guidelines and also on the governance variables that are supported in the literature as providing an appropriate structure for the firm in the environment in which it (...) operates. The data for 71 small cap companies listed in New Zealand over a five-year period from 2001 to 2005 was analysed. Pooled data, OLS and 2SLS regression techniques were used and Tobin's Q, ROA and OPINC were used as the dependent variables. The evidence does support the hypothesis that the existence of board independence and audit committee has enhanced firm financial performance, as measured by Tobin's Q. (shrink)

Meister Eckhart’s theology is indisputably controversial and the Papal Bull in agro dominico demonstrates the concern that the church had in Eckhart’s own time. Several scholars however, notably Bernard McGinn and Frank Tobin, have presented a more orthodox reading of Eckhart’s theology that reveals his commitment to the church and to Christian doctrine. It is unusual therefore that scholars continue to view Eckhart’s teaching on the ground and the soul’s ‘indistinct’ union with the Godhead or essence, as the (...) pinnacle of his theology. These themes are undoubtedly a major part of Eckhart’s unique contribution to Christian thought, as McGinn and Tobin have pointed out. However, they are most often cited by scholars who focus primarily upon the German sermons and tractates, often at the expense of the Latin commentaries and sermons and also at the expense of other equally significant features of Eckhart’s theology. This thesis questions the emphasis placed upon Eckhart’s teaching on the soul’s ‘indistinct’ union with the Godhead or essence and upon the essence itself. Drawing on the Latin and German works, it will demonstrate that Eckhart is deeply trinitarian and show that he views the Trinity and essence in a way that does not prioritise one over the other. Only once we recognise this non-hierarchical metaphysics can we also understand how Eckhart conceives of the soul’s existence and identity which, this thesis will show, is not absorbed or lost through the soul’s union with God, but perfected and fulfilled. The soul’s identity and indeed, all distinction – everything that exists – is properly understood, therefore, only in terms of the freedom and grace that defines God’s own identity in eternity; as a Trinity of persons whose distinction is not in terms of their separateness from one another, but in terms of their relations to each other. BackgroundViral pandemics present a range of ethical challenges for policy makers, not the least among which are difficult decisions about how to allocate scarce healthcare resources. One important question is whether healthcare workers should receive priority access to a vaccine in the event that an effective vaccine becomes available. This question is especially relevant in the coronavirus pandemic with governments and health authorities currently facing questions of distribution of COVID-19 vaccines.Main textIn this article, we critically evaluate the most common ethical (...) arguments for granting healthcare workers priority access to a vaccine. We review the existing literature on this topic, and analyse both deontological and utilitarian arguments in favour of HCW prioritisation. For illustrative purposes, we focus in particular on the distribution of a COVID-19 vaccine. We also explore some practical complexities attendant on arguments in favour of HCW prioritisation.ConclusionsWe argue that there are deontological and utilitarian cases for prioritising HCWs. Indeed, the widely held view that we should prioritise HCWs represents an example of ethical convergence. Complexities arise, however, when considering who should be included in the category of HCW, and who else should receive priority in addition to HCWs. (shrink)

This is a comprehensive study of the far-reaching changes that led to a re-shaping of the philosophical discourse in Islam during the sixth/twelfth century. Whereas earlier Western scholars thought that Islam's engagement with the tradition of Greek philosophy ended during that century, more recent analyses suggest its integration into the genre of rationalist Muslim theology (kalam). This book proposes a third view about the fate of philosophy in Islam. It argues that in addition to this integration, Muslim theologians picked up (...) the discourse of philosophy in Islam (falsafa) and began to produce books on philosophy. Written by the same authors, books in these two genres, kalām and philosophy, argue for opposing teachings on the nature of God, the world's creation, and on the afterlife. This study explains the emergence of a new genre of philosophical books called "hikma" that stand opposed to Islamic theology and at the same wishes to complement it. Offering a detailed history of philosophy in Iraq, Iran, and Central Asia during the sixth/twelfth century together with an analysis of the circumstances of practicing philosophy during this time, this study can show how reports of falsafa, written by major Muslim theologians such as al-Ghazali (d. 505/1111), developed step-by-step into critical assessments of philosophy that try to improve philosophical teachings, and eventually become fully fledged philosophical summas in the work of Fakhr al-Din al-Razi (d. 606/1210). The book ends in a discussion of the different methods of kalam and hikma and the coherence and ambiguity of a Muslim post-classical philosopher's œuvre. (shrink)

We enter here upon a history of conversational traffic between the respective departments of philosophy and law in the old academy of liberalism, where lawyers hear much from philosophers, yes-and philosophers hear from lawyers, too, in what has fruitfully been a both-ways exchange. Our philosophical protagonist is John Rawls. This book comprises a study of the rise and workings, within the Rawlsian political-liberal philosophy, of the idea of a country's higher-legal constitution as a public platform for the justification of political (...) coercion. A study of Rawls on constitutionalism can help us, I believe, in scoping out and managing a cluster of constitutional lawyers' debates-interminable ones, it seems, in the constitutional-democratic precincts of our times-that I will catalogue soon below. But conversely, I believe, those seeking the best and truest readings of Rawls might have something to learn from the controversies of the lawyers. My approach to Rawls has accordingly been that of a critically leavened (while no doubt broadly sympathetic) exegesis, while with the legal-discursive materials I take more of a diagnostic turn. My hope is that a treatment of these two discourses in relation to each other will prove an aid to both political-philosophical and legal-practical reflection. (shrink)

Human cognition is unique in the way in which it relies on combinatorial (or compositional) structures. Language provides ample evidence for the existence of combinatorial structures, but they can also be found in visual cognition. To understand the neural basis of human cognition, it is therefore essential to understand how combinatorial structures can be instantiated in neural terms. In his recent book on the foundations of language, Jackendoff described four fundamental problems for a neural instantiation of combinatorial structures: the massiveness (...) of the binding problem, the problem of 2, the problem of variables, and the transformation of combinatorial structures from working memory to long-term memory. This paper aims to show that these problems can be solved by means of neural “blackboard” architectures. For this purpose, a neural blackboard architecture for sentence structure is presented. In this architecture, neural structures that encode for words are temporarily bound in a manner that preserves the structure of the sentence. It is shown that the architecture solves the four problems presented by Jackendoff. The ability of the architecture to instantiate sentence structures is illustrated with examples of sentence complexity observed in human language performance. Similarities exist between the architecture for sentence structure and blackboard architectures for combinatorial structures in visual cognition, derived from the structure of the visual cortex. These architectures are briefly discussed, together with an example of a combinatorial structure in which the blackboard architectures for language and vision are combined. In this way, the architecture for language is grounded in perception. Perspectives and potential developments of the architectures are discussed. This unusually accessible account of recent Anglo-American philosophy focuses on how that philosophy has challenged deeply held notions of subjectivity, mind, and language. The book is designed on a broad canvas in which recent arguments are placed in a historical context. The author then explores such topics as mental content, moral realism, realism and antirealism, and the character of subjectivity. Much of the book is devoted to an investigation of Donald Davidson's philosophy, and there is also a sustained critique of (...) the position of Richard Rorty. A final chapter defends the realist position against objections from postmodern thought. This paper investigates the structure of lattices of normal mono- and polymodal subframelogics, i.e., those modal logics whose frames are closed under a certain type of substructures. Nearly all basic modal logics belong to this class. The main lattice theoretic tool applied is the notion of a splitting of a complete lattice which turns out to be connected with the “geometry” and “topology” of frames, with Kripke completeness and with axiomatization problems. Inhabitants of low-lying islands flooded due to anthropogenic climate change will lose their territory and thereby their ability to exercise their right to political self-determination. This paper addresses the normative questions which arise when climate change threatens territorial rights. It explores whether the loss of statehood supports a claim to territorial compensation, and if so, how it can be satisfied. The paper concludes that such claims are well founded and that they should be met by providing compensatory territories. After introducing (...) a differentiation between land rights and territorial rights, previous theoretical responses to the problem of sinking islands are criticized. It is argued that states may be required to give up parts of their territory as compensation. The paper develops criteria of sufficiency for compensatory territories and proposes to base their selection process on a negative auction. Since it is unlikely that unsettled compensatory territories that meet the specified requirements are available, the rights of their original inhabitants are discussed. (shrink)

Tense logics in the bimodal propositional language are investigated with respect to the Finite Model Property. In order to prove positive results techniques from investigations of modal logics above K4 are extended to tense logic. General negative results show the limits of the transfer.

The paper considers the set ML 1 of first-order polymodal formulas the modal operators in which can be applied to subformulas of at most one free variable. Using a mosaic technique, we prove a general satisfiability criterion for formulas in ML 1 , which reduces the modal satisfiability to the classical one. The criterion is then used to single out a number of new, in a sense optimal, decidable fragments of various modal predicate logics.

We shall describe the set of strongly meet irreducible logics in the lattice ϵLin.t of normal tense logics of weak orderings. Based on this description it is shown that all logics in ϵLin.t are independently axiomatizable. Then the description is used in order to investigate tense logics with respect to decidability, finite axiomatizability, axiomatization problems and completeness with respect to Kripke semantics. The main tool for the investigation is a translation of bimodal formulas into a language talking about partitions of (...) general frames into intervals so that relative to both Kripke frames and descriptive frames the expressive power of both languages coincides. In this paper we investigate first order common knowledge logics; i.e., modal epistemic logics based on first order logic with common knowledge operators. It is shown that even rather weak fragments of first order common knowledge logics are not recursively axiomatizable. This applies, for example, to fragments which allow to reason about names only; that is to say, fragments the first order part of which is based on constant symbols and the equality symbol only. Then formal properties of "quantifying into" (...) epistemic contexts are investigated. The results are illustrated by means of epistemic representations of Nash Equilibria for finite games with mixed strategies. (shrink)

Sociologists studying gender have debated West and Zimmerman’s premise that “doing gender is unavoidable,” seeking to ascertain whether people can “undo” or only “redo” gender. While sociologists have been correct to focus on the interactional accomplishment of gender, they have neglected one of Garfinkel’s key insights about interaction: that people hold each other accountable to particular narratives. Neglecting the narrative aspect of doing—and undoing—gender impedes our ability to recognize processes of social change. Based on a qualitative study, we show how (...) the movement for LGBTQI acceptance within U.S. conservative Protestant churches works to make gender not “omnirelevant” by challenging conservative “complementarity” narratives that posit two complementary, opposite sexes as a commandment preceding the Ten Commandments in time and importance. We explore this movement’s ambivalent relationship with homonormativity, highlight three ways this movement resists projecting binary gender narratives into scripture, and examine how some in this movement see the pursuit of social justice as a Christian mandate. The efforts of LGBTQI conservative Christians exemplify how reshaping sex/gender/sexual narratives can create possibilities for undoing gender. (shrink)

The secession of prosperous regions may negatively affect the redistributive scheme of an established state. As a consequence, the capacity of its welfare system to support the inhabitants of poorer regions may be significantly reduced. Some authors assert that affluent groups who opt for full political independence violate duties of solidarity. This objection to the secession of prosperous regions can be based on different views of distributive justice. Here, following a distinction that has been introduced by Allen Buchanan, ‘subject centred’ (...) and ‘justice as reciprocity’ theories are explored. It is argued that both theories fail to support the case against the secession of wealthy groups. ‘Subject centred’ theories cannot explain special duties toward compatriots, whereas ‘justice as reciprocity’ theories cannot justify restrictions on exit rights. However, this does not mean that separatists have no moral duties vis-à-vis their fellow citizens. They are obliged to dissolve the political union in a fair way, e.g., by accepting responsibility for some share of the public debts. (shrink)

David Lewis's untimely death on 14 October 2001 deprived the philosophical community of one of the outstanding philosophers of the 20th century. As many obituaries remarked, Lewis has an undeniable place in the history of analytical philosophy. His work defines much of the current agenda in metaphysics, philosophical logic, and the philosophy of mind and language. This volume, an expanded edition of a special issue of the Australasian Journal of Philosophy, covers many of the topics for which Lewis was well (...) known, including possible worlds, counterpart theory, vagueness, knowledge, probability, essence, fiction, laws, conditionals, desire and belief, and truth. Many of the papers are by very established philosophers; others are by younger scholars including many he taught. The present article represents a further critical use of this material that we deem worthy of publication.in this vital and splendidly crafted work, Bethany Henning recovers a philosophy of aesthetic wisdom far richer (...) than the narrow epistemological lens dominant today. From its start, American philosophy looked beyond Europe's atomistic empiricism toward a continuity between our thought and nature's aesthetic splendor. Jonathan Edwards found beauty in the structure of being reflected in relations among ideas. For Emerson, each of us is a "transparent eyeball" in which nature's beauty fortifies our moral and spiritual agency. At the apex of this tradition is John Dewey, for whom "aesthetic experience [is] the highest mode of human experience" (Henning 55).Although aesthetic theory is usually associated with the cognitive evaluation of art, Dewey explores a broader non-reflective or unconscious dimension. Henning's appropriation of "unconscious"—the cradle of Freud's infantile id—is intentionally provocative. American culture, reflected in academic thought, has largely resisted appeals to subterranean urges and drives. In doing so, however, we perpetuate a myth of rational and moral exceptionalism masking a history of colonialism, oppression, and crass commercialism. In accepting the unconscious, European thought has taken strides to acknowledge and address such ills. Henning wonders whether America might accept "a dynamic unconscious, were it presented with an alternative mythology" (10) and finds a viable candidate in Dewey's underappreciated notion of qualitative immediacy: an "aesthetic (directly felt) connection between ourselves and [End Page 77] the world" (Henning 5). In affirming the unconscious depth of experience, this American reconfiguration welcomes "aesthetic experience back into our philosophical lives" (Henning 5).When embodied meaning supplements cognitive reflection, we come to champion "the sensuous, lived body" as "the primary reality" of qualitative immediacy—a felt aesthetic unity punctuated by "impulsions" arising from an organism's needs (Henning 69). As "a site of adaptive adjustments," Henning continues, "the body is responsive to the brink of coalescence at the point of contact with the world, in which things that are 'outside of it' belong to it" (71). "To move adeptly into aesthetic experience means to be skilled at loosening focal consciousness" so as to cultivate "the essential porousness of the world" (130).With this, the body-mind relation becomes a problem of normative aesthetics, not epistemology. The Cartesian detachment of intellect from nature perpetuated our cultural alienation from our bodies, our environments, and one another (Henning 81–84). It is proved that all minimal tense extensions of modal logics of finite width (in the sense of K. Kine) as well as all minimal tense extensions of cofinal subframe logics (in the sense of M. Zakharyaschev) are complete. The decidability of all finitely axiomatizable minimal tense extensions of cofinal subframe logics is shown. This paper investigates partitions of lattices of modal logics based on superintuitionistic logics which are defined by forming, for each superintuitionistic logic L and classical modal logic , the set L[] of L-companions of . Here L[] consists of those modal logics whose non-modal fragments coincide with L and which axiomatize if the law of excluded middle p V p is added. Questions addressed are, for instance, whether there exist logics with the disjunction property in L[], whether L[] contains a (...) smallest element, and whether L[] contains lower covers of . Positive solutions as concerns the last question show that there are (uncountably many) superclean modal logics based on intuitionistic logic in the sense of Vakarelov [28]. Thus a number of problems stated in [28] are solved. In a modern, plural society, there can be no settled agreement on the concrete legal content of a country's constitution. The idea of the constitution is nonetheless pivotal in contemporary, liberal‐minded theories of political justification, such as the ones advanced by Jürgen Habermas and John Rawls. Justification in these theories depends finally on “constitutional patriotism,” a consciously shared sentiment arising from an ethical assessment of their country by the country's people, according to which the country credibly pursues a certain regulative (...) political ideal for which the constitution stands. The topic of homonymy, especially the variety of homonymy that has gone under the title, “focal meaning,” is of fundamental importance to large portions of Aristotle’s work—not to mention its central place in the ongoing controversies between Aristotle and Plato. It is quite astonishing, therefore, that the topic should have gone so long without a book-length treatment. And it is all the more gratifying that the new book on homonymy by Christopher Shields should be so comprehensive, and of such uniformly (...) high quality.
