In the Introduction to the Polish-language version of the present book I expressed the hope that Polish studies in semiotics would before long be numerous enough to make possible another anthology on semiotics in Poland containing material published since 1970. That hope has in fact come true. The fact that semiotic research has been gaining momentum in this country is reflected in the growing interest in the discipline, in expanding international contacts, and in the steady increase in the number of (...) publications. Thus, 1972 saw the setting up of the Department of Logical Semiotics, headed by the present writer, at Warsaw University Institute of Phi losophy. The seminar on semiotics, which I started in 1961, had met more than two hundred times by the end of 1976; since 1968, meetings have been held jointly with the Polish Semiotic Society. Another semi nar, confined to university staff and concerned with logical semiotics, which was inithted in 1970, had met more than fifty times by the end of 1976. The former seminar often plays host to foreign visiting pro fessors; so far scholars from Australia, Belgium, Britain, Canada, Czechoslovakia, France, the German Democratic Republic, Italy, the Netherlands, the Soviet Union, and the United States have attended. The article presents so-called “derivational” theory of legal interpretation and analyzes its basic assumptions. The derivational theory of legal interpretation is still little known outside of Poland. The article is divided into two parts. The first part is presenting the normative model of legal interpretation according to the derivational theory. In the second part, the basic assumptions and features of the theory are analysed in context of some other approaches to legal interpretation. The author argues that there are two levels (...) of the derivational theory: local and universal. The local level of theory is related to the fact that it was designed for Polish legal system and legal culture. However, beyond its local features, the derivational theory is presenting strong theoretical framework and some significant universal ideas about legal interpretation. This creates universal level that can be called the “hard core” of the theory. The author characterizes the elements of this hard core, and in particular the most important element: the idea that the legal interpretation consists in the reconstruction of legal norms from legal provisions. Ciencia y lógica de mundos posibles indaga en un aspecto negativo de la visión positivista de la historia del pensamiento. Según esta interpretación, determinante dentro del pensamiento contemporáneo, existe una oposición irredimible entre la metodología del conocimiento científico y la metafísica. El estudio de los supuestos ontológicos de la epistemología aristotélica y de la nueva metodología galileana evidencia, sin embargo, que históricamente la ciencia moderna no nace en oposición a la metafísica, sino que surge a partir de una concepción metafísica (...) determinada. Resulta imposible comprender a fondo el fenómeno de la revolución galileana sin tener en cuenta los aportes lógicos de pensadores medievales que tuvieron una actitud crítica frente a las implicaciones ontológicas de la epistemología aristotélica. Con el advenimiento del idealismo trascendental - a diferencia de Descartes, Leibniz o Newton - la filosofía se separa de la ciencia experimental. Esto se debe a que con Kant la filosofía se aleja de la postura filosófica de los origenes de la ciencia moderna, y retorna a una concepción de la naturaleza en cierto modo similar a la aristotélica. Así mismo, la interpretación propuesta en el manifiesto del Círculo de Viena con respecto a algunas de las revoluciones científicas de los siglos XIX y XX, supone que la ciencia moderna se ha desarrollado en la dirección señalada por la concepción metafísica del mundo que se encuentra en el origen de la revolución galileana. I develop an account of homology and homoplasy drawing on their use in biological inference and explanation. Biologists call on homology and homoplasy to infer character states, support adaptationist explanations, identify evolutionary novelties and hypothesize phylogenetic relationships. In these contexts, the concepts must be understood phylogenetically and kept separate: as they play divergent roles, overlap between the two ought to be avoided. I use these considerations to criticize an otherwise attractive view defended by Gould, Hall, and Ramsey & Peterson. By (...) this view, homology and homoplasy can only be delineated qua some level of description, and some homoplasies (parallelisms) are counted as homologous. I develop an account which retains the first, but rejects the second, aspect of that view. I then characterize parallelisms and convergences in terms of their causal role. By the Strict Continuity account, homology and homoplasy are defined phylogenetically and without overlaps, meeting my restriction. Convergence and parallelisms are defined as two types of homoplasy: convergent homoplasies are largely constrained by external factors, while parallelisms are due to internal constraints. (shrink)

Herbert Spencer is one of the most distinguished representatives of Nineteenth-Century liberalism. Originality of his doctrine is based on combined concepts of social evolutionism with postulates of conservative liberalism. Ethics of an individual were the conceptual point of his philosophical reflection. Thus he believed that a free market economy is the economic foundation of ethical and material development of every individual. Material development may be summarized as achieving ever improving results of performed actions. According to Spencer, the free market critically (...) assesses the quality of goods through increasing demand for goods of better quality. In this manner effective producers develop, because they achieve greater gain from their work. Moral development of an individual is in turn focused on continuous self-improvement. Through developing his skills a man increases the quality of actions carried out by him or of objects that he creates. The “law of equal freedom” – also described by Spencer – is in direct connection with the aforementioned issues. This rule states that every man has the right to do anything, as long as his actions do not infringe upon the freedom of another man which is defined in exactly the same manner. Thus the law of equal freedom can be characterized as a negative freedom if juxtaposed with relations that occur between individuals themselves or between individuals and the state. Combining of ethical and economic topics leads to the presentation of inhibitions that, according to Spencer, should be placed upon the activity of the State in the field of economy. Spencer believed that the State should not interfere with the economy, since all individuals should be granted full freedom of participating in comply with their own interests. (shrink)

Aesthetics is thought of as not only a theory of art or beauty, but also includes sensibility, experience, judgment, and relationships. This paper is a study of Bernard Stiegler’s notion of Aesthetic War (stasis) and symbolic misery. Symbolic violence is ensued through a loss of individuation and participation in the creation of symbols. As a struggle between market values against spirit values human life and consciousness within neoliberal hyperindustrial society has become calculable, which prevents people from creating affective and meaningful (...) attachments to symbols in relation to our retentional apparatuses, technology and memory. Such tension can be thought of as a dissonance between overlapping domains of social life, private and public. New Media is a reflection of aesthetic dissonance, an experience such as being bored and entertained at the same time, between antagonistic experiences, values, and behavior. Moreover, new media is at once a medium of customizing aesthetic experience individually as well as the threat and practice of prioritizing calculability and modeling of consumer behavior in favor of capitalistic effectiveness, which results in the simultaneous categorization of an individual as a data point, putting those who do not fit an algorithm’s premises at a disadvantage. For a little more than a decade, professional organizations and healthcare institutions have attempted to develop guidelines and policies to deal with seemingly intractable conflicts that arise between clinicians and patients (or their proxies) over appropriate use of aggressive life-sustaining therapies in the face of low expectations of medical benefit. This article suggests that, although such efforts at conflict resolution are commendable on many levels, inadequate attention has been given to their potential negative effects upon particular groups of patients/proxies. Based (...) on the well-documented tendency among many African Americans to prefer more aggressive end-of-life medical interventions, it is proposed that the use of institutional policy to break decision making impasse in cases for which aggressive treatment is deemed "medically inappropriate" will fall disproportionately on that group. Finally, it is suggested that the development and application of institutional conflict-resolution policies should be evaluated in the context of historical and current experiences of marginalization and disempowerment, lest such policies exacerbate that experience. Although climate change has become the dominant concern of the twenty-first century, global powers refuse to implement the changes necessary to reverse these trends. Instead, they have neoliberalized nature and climate change politics and discourse, and there are indications of a more virulent strain of capital accumulation on the horizon. Adrian Parr calls attention to the problematic socioeconomic conditions of neoliberal capitalism underpinning the world's environmental challenges, and she argues that, until we grasp the implications of neoliberalism's interference in (...) climate change talks and policy, humanity is on track to an irreversible crisis. Parr not only exposes the global failure to produce equitable political options for environmental regulation, but she also breaks down the dominant political paradigms hindering the discovery of viable alternatives. She highlights the neoliberalization of nature in the development of green technologies, land use, dietary habits, reproductive practices, consumption patterns, design strategies, and media. She dismisses the notion that the free market can solve debilitating environmental degradation and climate change as nothing more than a political ghost emptied of its collective aspirations. Decrying what she perceives as a failure of the human imagination and an impoverishment of political institutions, Parr ruminates on the nature of change and existence in the absence of a future. The sustainability movement, she contends, must engage more aggressively with the logic and cultural manifestations of consumer economics to take hold of a more transformative politics. If the economically powerful continue to monopolize the meaning of environmental change, she warns, new and more promising collective solutions will fail to take root. (shrink)

Historical sciences like paleontology and archaeology have uncovered unimagined, remarkable and mysterious worlds in the deep past. How should we understand the success of these sciences? What is the relationship between knowledge and history? In Scientific Knowledge and the Deep Past: History Matters, Adrian Currie examines recent paleontological work on the great changes that occurred during the Cretaceous period - the emergence of flowering plants, the splitting of the mega-continent Gondwana, and the eventual fall of the dinosaurs - to (...) analyse the knowledge of historical scientists, and to reflect upon the nature of history. He argues that distinctively historical processes are 'peculiar': they have the capacity to generate their own highly specific dynamics and rules. The character of computational modelling of cognition depends on an underlying theory of representation. Classical cognitive science has exploited the syntax/semantics theory of representation that derives from logic. But this has had the consequence that the kind of psychological explanation supported by classical cognitive science is " _conceptualist_: " psychological phenomena are modelled in terms of relations that hold between concepts, and between the sensors/effectors and concepts. This kind of explanation is inappropriate for the Proper Treatment of Connectionism.
