The Catholic Church proscribes methods of birth control other than sexual abstinence. Although the U.S. Food and Drug Administration (FDA) recognizes abstinence as an acceptable method of birth control in research studies, some pharmaceutical companies mandate the use of artificial contraceptive techniques to avoid pregnancy as a condition for participation in their studies. These requirements are unacceptable at Catholic health care institutions, leading to conflicts among institutional review boards, clinical investigators, and sponsors. Subjects may feel coerced by such mandates to (...) adopt contraceptive techniques inconsistent with their personal situation and beliefs; women committed to celibacy or who engage exclusively in non-heterosexual activities are negatively impacted. We propose principles to insure informed consent to safeguard the rights of research subjects at Catholic institutions while mitigating this ethical conflict. At the same time, our proposal respects the interests of pharmaceutical research agencies and Catholic moral precepts, and fully abides by regulatory guidance. (shrink)

As cognitive science and empirical psychology strive to uncover the mind's secrets, it is fitting to inquire as to what distinctive role is left for philosophy in the study of mind. How does character information inform judgments of blame? Some argue that character information is indirectly relevant to blame because it enriches judgments about the mental states of a wrongdoer. Others argue that character information is directly relevant to blame, even when character traits are causally irrelevant to the wrongdoing. We propose an empirical synthesis of these views: a Two Channel Model of blame. The model predicts that character information directly affects blame when this information is relevant to the wrongdoing that (...) elicits blame. Further, the effect of character information on blame depends on judgments about the true self that are independent of judgments of intentionality. Across three pre-registered studies (N = 662), we found support for all three predictions of the Two Channel Model. We propose that this reflects two distinct functions of blame: a social regulatory function that encourages norm compliance and a pedagogical function that encourages personal improvement. (shrink)

The theoretical framework proposed by Dienes & Perner sets the wrong standards for knowledge to be considered explicit. Animals other than humans possess knowledge, too, some of which is probably explicit. We argue that a comparative approach to investigating knowledge is likely to be more fruitful than one based on linguistic constructs and unobservable phenomena.

This paper argues that professionals who make boundary-related decisions should be guided by relationship-based practice. In our roles as service users and professionals, drawing from our lived experiences of professional relationships, we argue we need to move away from distance-based practice. This includes understanding the boundary stories and narratives that exist for all of us – including the people we support, other professionals, as well as the organisations and systems within which we work. When we are dealing with professional boundary (...) issues, we should centre relationship-building skills that are central to many other aspects of our work. Skills that foster relationships at all levels – between professionals, service users, and services – need to be revalued. Our final recommendation is to create, develop, and foster safer spaces within and outside of organisations, as well as inter-professionally, for the discussion and exploration of boundary-related issues and practice. We are interested in hearing from those with experiences of being marginalised by boundaries so that they can inform a reshaping of our collective ideas around boundary related practices. To foster relationship-based practices in organisations, we have outlined several recommendations here; however, we recognize that these do not go far enough, and that collective action is needed to inform systemic change. BackgroundUse of modified texture diets—thickening of liquids and modifying the texture of foods—in the hope of preventing aspiration, pneumonia and choking, has become central to the current management of dysphagia. The effectiveness of this intervention has been questioned. We examine requirements for a valid informed consent process for this approach and whether the need for informed consent for this treatment is always understood or applied by practitioners.Main textValid informed consent requires provision of accurate and balanced information, and that agreement is (...) given freely by someone who knows they have a choice. Current evidence, including surveys of practitioners and patients in different settings, suggests that practice in this area is often inadequate. This may be due to patients’ communication difficulties but also poor communication—and no real attempt to obtain consent—by practitioners before people are ‘put on’ modified texture diets. Even where discussion occurs, recommendations may be influenced by professional misconceptions about the efficacy of this treatment, which in turn may poison the well for the informed consent process. Patients cannot make appropriate decisions for themselves if the information provided is flawed and unbalanced. The voluntariness of patients’ decisions is also questionable if they are told ‘you must’, when ‘you might consider’ is more appropriate. Where the decision-making capacity of patients is in question, inappropriate judgements and recommendations may be made by substitute decision makers and courts unless based on accurate information.ConclusionResearch is required to examine the informed consent processes in different settings, but there is ample reason to suggest that current practice in this area is suboptimal. Staff need to reflect on their current practice regarding use of modified texture diets with an awareness of the current evidence and through the ‘lens’ of informed consent. Education is required for staff to clarify the importance of, and requirements for, valid informed consent and for decision making that reflects people’s preferences and values. (shrink)

The present study seeks to treat in depth a relatively restricted portion of Hegel's thought but one that has not yet received intensive treatment by Hegel scholars in English. In the Hegelian system of philosophical sciences, the Anthropology directly follows the Philosophy of Nature and forms the first of the three sciences of Subjective Spirit: 1 Anthropo logy, Phenomenology, and Psychology. The section on Subjective Spirit is then followed by sections on Objective Spirit and Absolute Spirit. The three sections together (...) comprise the Philosophy of Spirit (Philosophie des Geistes 2), which constitutes the third and concluding main division of Hegel's total system as presented in the Encyclopedia of Philosophic Sciences in Outline. a Hegel intended to write a separate full-scale work on the philosophy of Subjective Spirit as he had done on Objective Spirit (the Philosophy of Right), but died before he could do so. · Thus the focus of our study is quite concentrated. The most controversial condition that the AGM theory of rational belief change places on belief contraction is the recovery condition. The condition is controversial because of a series of putative counterexamples due (separately) to I. Levi and S. O. Hansson. In this paper we show that the conflicts that Levi and Hansson arrange between AGM contraction and our intuitions about how to give up beliefs are merely apparent. We argue that these conflicts disappear once we attend more closely to the (...) identification of the beliefs contracted away in each counterexample case. Since, on our view, speakers' belief contraction intentions are often more complicated than they may first appear, we are led to develop apparatus for thinking about the communication and identification of those intentions. Our argument refocuses attention on the difficult question of how to apply the AGM theory to particular cases. (shrink)

Timothy O’Connor has recently defended a version of libertarianism that has significant advantages over similar accounts. One of these is an argument that secures indeterminism on the basis of an argument that shows how causal determinism threatens agency in virtue of the nature of the causal relation involved in free acts. In this paper, I argue that while it does turn out that free acts are not causally determined on O’Connor’s view, this fact is merely stipulative and the argument that (...) he presents for this conclusion begs the question. John Courtney Murray is openly acknowledged as one of the greatest public political thinkers that American Catholicism has produced. His work significantly influenced the Catholic Church's public understanding of the role of religion in a pluralistic society through his contributions to the Declaration on Religious Liberty (Dignitatis Humanae) of the Second Vatican Council. He was even acclaimed in the secular world, appearing on the cover of Time on December 12, 1960. His legacy in the area of church–state relations, however, (...) ran into serious difficulties shortly after his death. Many have alleged that the cause of this nonreception lay in a new religious pluralism in the United States or in a lack of consensus on basic moral or philosophical issues. I will argue, by contrast, that one overlooked, but highly influential, reason for this lack of reception lies in Murray's position on the relationship between nature and grace. The triumph of a competing view in the post-conciliar Catholic Church and wider academy, both in theology and in philosophy, undermined the possibility of Murray's vision finding traction within either realm. Neste sentido, o artigo passa em revista a estrutura fundamental do argumento em favor da liberdade religiosa de John Courtney Murray, focalizando a atenção sobre o momento em que este autor contribui directamente, como primeiro escriba, para a (...) construção do primeiro esquema autónomo sobre a Liberdade Religiosa no Concílio Vaticano II. O artigo destaca ainda, numa análise sucinta sobre este texto conciliar, os contributos lonerga-nianos que explicitamente transitam, através de Murray, para o corpo do documento, que foram decisivos para um novo enquadramento metodológico da problemática e, assim, para a aprovação final do Documento. /// The main purpose of this article is to show how certain notions and insights of Bernard Lonergan's theological and epistemological reflection exert their influence upon the basic structure of Dignitatis Humanae, through the active conciliar participation of John Courtney Murray on the subject. Thus, the focus of the article is on the main structure of Murray's apologetic argument for religious freedom, precisely when the author works, as first scribe, upon the first conciliar autonomous draft on Religious Liberty. Through a brief scrutiny of this conciliar text, the article also points out Lonergan's decisive assessments, although indirectly through the hands of Murray, for a new methodological stance that allowed the final Declaration's approval.
