In this paper I discuss and evaluate different arguments for the view that the laws of nature are metaphysically necessary. I conclude that essentialist arguments from the nature of natural kinds fail to establish that essences are ontologically more basic than laws, and fail to offer an a priori argument for the necessity of all causal laws. Similar considerations carry across to the argument from the dispositionalist view of properties, which may end up placing unreasonable constraints on property identity across (...) possible worlds. None of my arguments preclude the possibility that the laws may turn out to be metaphysically necessary after all, but I argue that this can only be established by a posteriori scientific investigation. I therefore argue for what may seem to be a surprising conclusion: that a fundamental metaphysical question – the modal status of laws of nature – depends on empirical facts rather than purely on a priori reasoning. This paper discusses the relationship between dispositions and laws and the prospects for any analysis of talk of laws in terms of talk of dispositions. Recent attempts at such a reduction have often been motivated by the desire to give an account of ceteris paribus laws and in this they have had some success. However, such accounts differ as to whether they view dispositions as properties fundamentally of individuals or of kinds. I argue that if dispositions are properties of individuals, (...) we cannot give a complete account of ceteris paribus laws. Alternatively, if dispositions are properties of kinds, any reductive analysis of laws would require an extension of the notion of the dispositional beyond its usual meaning so that in effect there can be no reduction of laws to dispositions as traditionally understood. An attempt to reduce the nomological to the dispositional is therefore not the way to provide a unified account of traditional and ceteris paribus laws. (shrink)

This book presents work at the forefront of scholarly debate about the relevance of substantial metaphysical theories to science. Responds in particular to recent publications by Brian Ellis on scientific essentialism, especially on the topics of laws, natural kinds and realism. Contains a new paper by Brian Ellis, commentary and criticism from philosophers on Ellis’s work, and a reply by Ellis to his critics.

First order logic does not distinguish between different forms of universal generalization; in this paper I argue that lawlike and accidental generalizations (broadly construed) have a different logical form, and that this distinction is syntactically marked in English. I then consider the relevance of this broader conception of lawlikeness to the philosophy of science.

Sentences of the form ‘Fs are Gs’ can express laws of nature, weaker Special Science laws, and also regularities which are not a part of any explicit science. These so-called generic sentences express nomic relationships which may have exceptions. I discuss the kinds of regularities expressed by generic sentences and argue that since they play a similar role in determining our ability to categorise and reason about the world, we should look for a unified treatment of them.

This paper discusses recent attempts to use essentialist arguments based on the work of Kripke and Putnam to ground causal necessity in the world. I argue in particular that arecent argument by Alexander Bird relies on controversial intuitions about the natures of substances which no Humean would accept. While a case can be made that essentialism reflects some assumptions within scientific practice, the same can be said of Humeanism; ultimately neither Bird’s arguments, nor any empirical facts, can decide the question (...) for or against Humeanism. Romanis and Adkins discuss pregnancy loss in relation to artificial amnion and placenta technology (AAPT) for treatment of extremely preterm infants.1 I agree with the authors that AAPT, although it is expected to provide better care for extremely preterm infants, will also be challenging for parents. I, therefore, commend Romanis and Adkins for promoting a more holistic care that includes parents and pregnant persons. However, I believe that they create two false dichotomies, one between the pregnant person/parent and the fetus/child (...) and one between current neonatal intensive care unit (NICU) and AAPT that hinder holistic care. Romanis and Adkins correctly point out that much of the discourse and care surrounding preterm deliveries focuses mainly on the infant. I agree with Romanis and Adkins that true holistic care should also include the parents rather than focusing exclusively on the child. However, the language they use to petition for more inclusive care can be problematic and counteractive to achieve holistic care. The problem is that they accuse any fetal/child consideration of being fetal-centric and, in the same breath, they state that it is something to be challenged. This attitude is problematic as it feeds into the rhetoric of the maternal–fetal conflict. This is a common rhetoric in reproductive and neonatal care used mainly in situations …. (shrink)

This essay investigates the way in which Wolff takes an interest in the hypothesis of an emendatio of the prima philosophia from Leibniz’s incitement in De primae philosophiae emendatione, et de notione substantiae (1694) to re-found metaphysics. This makes it possible, secondly, to examine the way in which Wolff takes Johannes Clauberg’s ontology as a model, even though it represents in his view only a failed attempt at that same emendatio. Through the analysis of the texts, this article considers the (...) possibility of a new reading of the ‘failure’ attributed by Wolff to Clauberg, which would consist in his having ‘emended’ first philosophy by expelling it from the domain of ontology and finally identifying it with Cartesian prima philosophia. According to the received view in the literature on homonymy and polysemy representation, there is a difference between how polysemes and homonyms are represented in our mental lexicons. More concretely, the received view holds that whereas the meanings associated with a homonymous expression are (mentally) represented in separate lexical entries, the meanings associated with a polysemous expression are represented together in a single lexical entry. It is usually argued that this is the picture that is supported by the growing body (...) of empirical evidence coming from psycholinguistics. Empirical studies of ambiguity processing and resolution consistently show that polysemous expressions enjoy various processing advantages compared to homonyms, and the received view is generally taken to be required in order to explain these results. The aim of this paper is not only to show that this is not the case but also, and more fundamentally, that the received view falls far short of explaining the available data to a sufficient degree. As a result, the received view is caught up in an explanatory dilemma that I dub the Continuum Puzzle. I then claim that the best way to escape this puzzle is to give up the received view’s core thesis in favor of an alternative view consistent with the empirical evidence. Reaching such an alternative will require rejecting the following pervasive but ill-motivated assumption: Differences in ambiguity processing and resolution can only be explained by there being some corresponding differences in the architecture of our mental lexicons. This piece continues an exchange between David Beaver and Jason Stanley, on the one hand, and Alice Crary, on the other, to which Beaver’s and Stanley’s “Neutrality” (immediately above) is a contribution. All three authors agree that the critique of ideology, propaganda, and oppressive structures should not be conceived as eliminating socially-situated perspectives and subjectively-mediated sensibilities from an allegedly neutral discursive space. Their exchange began with Crary’s 2018 article, “The Methodological as Political: What’s the Matter with ‘Analytic Feminism’?” which (...) attacks appeals to neutrality, including one Crary finds in Stanley’s 2015 book, How Propaganda Works, for obscuring a pivotal methodological insight of radical feminist thought, namely, that feminism’s political radicalism is complemented by a “methodological radicalism that involves making use of the practical power of ethically non-neutral resources, conceived as in themselves cognitively authoritative” (Crary 2018: 47). This new reply argues that Beaver’s and Stanley’s practice-based image of language, while at first seemingly aligned with this rejection of neutrality as an ideal for political discourse, fails to fully respond to her original complaint. The ideal of neutrality is problematic, not only in masking social location, but in wrongly impugning as ‘non-cognitive’ or ‘irrational’ critical resources drawn from socially-situated perspectives—the sorts of perspectives to which notable strands of feminist theory give voice precisely for their cognitive value. The current piece claims that to address this further danger it is necessary to go beyond Beaver’s and Stanley’s study of meaning and critically examine engrained philosophical assumptions about how to construe logical notions such as objectivity and truth. It closes by suggesting that, within philosophy of language broadly conceived, the tradition of ordinary language philosophy provides a more promising source of resources and illumination for struggles to make gender-based and overlapping forms of structural bias socially visible. The paper explores whether the method of reflective equilibrium (RE) in ethics and political philosophy should be individual or public in character. I defend a modestly public conception of RE, in which public opinion is used specifically as a source of considered judgments about cases. Public opinion is superior to philosophical opinion in delivering judgments that are untainted by principled commitments. A case-based approach also mitigates the methodological problems that commonly confront efforts to integrate philosophy with the investigation of popular (...) attitudes. This conception of RE is situated in relation to alternative accounts, including those of Daniels, Rawls, and Wolff and de-Shalit. (shrink)

Philosopher Ludwig Wittgenstein had an enormous influence on twentieth-century philosophy even though only one of his works, the famous Tractatus Logico-Philosophicus, was published in his lifetime. Beyond this publication the impact of his thought was mainly conveyed to a small circle of students through his lectures at Cambridge University. Fortunately, many of his ideas have survived in both the dictations that were subsequently published, and the notes taken by his students, among them Alice Ambrose and the late Margaret Macdonald, (...) from 1932 to 1935. These notes, now edited by Professor Ambrose, are here published, and they shed much light on Wittgenstein's philosophical development. Among the topics considered are the meaning of a word and its relation to common usage, rules of grammar and their relation to fact, the grammar of first person statements, language games, and the nature of philosophy. This volume is indispensable to any serious discussion of Wittgenstein's work. (shrink)

The question of forgiveness in politics has attained a certain cachet. Indeed, in the fifty years since Arendt commented on the notable absence of forgiveness in the political tradition, a vast and multidisciplinary literature on the politics of apology, reparation, and reconciliation has emerged. To a novice scouring the relevant literatures, it might appear that the only discordant note in this new veritable symphony of writings on political forgiveness has been sounded by philosophers. There is a more-than-healthy cynicism directed at (...) what many philosophers see as an uncritical promotion of forgiveness, which – they fear – risks distorting and cheapening forgiveness as a moral ideal, on the one hand, and ignoring the moral and political values of justice, accountability and the cessation of harmful relationships, on the other. Are philosophical fears about the dangers of thinking about forgiveness in political terms warranted – or do they perhaps depend in part on conceptual conservatism regarding what exactly political forgiveness might be? I argue that most, if not all, standard objections to political forgiveness emerge from theoretical reliance on a picture of forgiveness I will call the Emotional Model. Once we make conceptual space for descriptions of forgiveness in performative and social terms, the concept is more easily adapted to a political account without at least some of the risks feared by philosophers. This article proposes that restorative justice practices, as used in New Zealand schools, are better understood as an instrument of social development than a behaviour management practice. Concerns about the achievement of Māori students are relocated, from an individualised psychological and pedagogical problem to an interdisciplinary context of historical and social development. Social constructionist theory is suggested as a lens through which RJPs in schools may be seen as the intentional production of respectful social relationships, rather than as behaviour management. (...) A restorative process has the productive capacity to restore healthy relational functioning, both for those who have been offended against and those who have offended. It is argued that the primary function of restorative justice in schools is not about resolving specific conflicts, but rather, about the production and maintenance of respectful relationship, which is the antithesis of colonised relationship. Such a position reflects accountability on a communal, rather than individualised basis, and accords with recent moves in the United Nations Development Programme to look at Human Development as building agentive capacity. Images of nature abound in the practice of international environmental law but their significance in law is unclear. Drawing on visual jurisprudence, and interpretative methods for visual art, this book analyses photographs for their representations of nature's aesthetic value in treaty processes that concern world heritage, whales and biodiversity. It argues that visual images should be embraced in the prosaic practice of international law, particularly for treaties that demand judgements of nature's aesthetic value. This environmental value is in practice conflated (...) with natural beauty, ethical and cultural values, and displaced by economic and scientific values. Interpretations of visual images can serve instead to critique and conceive sensory, imaginative and emotional appreciations of nature from different cultural perspectives as proposed by philosophers of environmental aesthetics. Addressing questions of value and the visual, this landmark book shows how images can be engaged by nations to better protect the environment under international law. (shrink)

As obstetric medicine has become more sophisticated, so Caesarean section (CS) has become safer. It is now seen as equally safe or, in some circumstances, safer than vaginal birth. Under the new National Institute for Clinical Excellence (NICE) guidelines on CS that were published in November 2011, requests for CS are to be given more weight. Women requesting CS can no longer be seen as compromising their control over birth. Rather, they are merely exercising their power, with the new guidelines (...) offering them an increasing role in the decision-making process regarding how they give birth. However, these new guidelines also present new problems, bringing the rights of patients and obstetricians into conflict. In order to mediate these tensions, a virtue-based approach to obstetric ethics is needed as a supplement to the rule- and right-based guidance provided by NICE. (shrink)

Nasir-i Khusraw is a major literary figure in medieval Persian culture. He was a Muslim philosopher, poet, travel writer, and Ismaili da'i who lived a thousand years ago in the lands known today as Afghanistan, Iran, and Tajikistan. Although known in the West mainly for his Safarnama, or travelogue, which describes his seven-year journey from Khurasan, in the eastern Islamic lands, to Cairo, the city of the Fatimid imam-caliphs, his poetry and ideas are less familiar. Yet, over the centuries, Persian-speaking (...) lands have consistently ranked him as one of the finest poets of all time. But today, even among those who know Nasir-i Khusraw's poetry, few understand the philosophical and Ismaili concepts the poet expounds. And while mystical and epic genres of Persian poetry are memorized and studied, the genre of philosophical poetry in Persian remains basically unexplored. This collection of studies seeks to redress the balance. Originally presented at a conference at the School of Oriental and African Studies (SOAS), University of London in 2005 to commemorate the millenary of Nasir-i Khusraw's birth, the papers published here examine his poetry both for philosophical meaning and poetic method. They address a variety of topics, ranging from metaphysics, cosmology, and ontology to prophecy, as well as rhythm and structure, and analysis of individual poems and authorship. (shrink)

Those who wish to defend the role of aesthetic values in science face a dilemma: Either aesthetic language is used metaphorically for what are ultimately epistemic features, or aesthetic language is used literally but it is difficult to see the importance of such values in science. I introduce a new account that gets around this problem by looking to an overlooked source of aesthetic value in science: the relation between form and content. I argue that a fit between the content (...) of a thought experiment, and the way in which that content is formulated, can have important epistemic pay offs through contributing to scientific understanding. Is there a role for aesthetic judgements in science? One aspect of scientific practice, the use of thought experiments, has a clear aesthetic dimension. Thought experiments are creatively produced artefacts that are designed to engage the imagination. Comparisons have been made between scientific (and philosophical) thought experiments and other aesthetically appreciated objects. In particular, thought experiments are said to share qualities with literary fiction as they invite us to imagine a fictional scenario and often have a narrative form (Elgin 2014). (...) But philosophical discussions of aesthetics in science have focused mainly on the epistemic role of beauty and elegance when it comes to theories and mathematical proofs, and thought experiments have been widely overlooked. My aim in this chapter is to address how the aesthetic choices scientists make in the design of a thought experiment contribute to its function: to communicate, convince, or explain a theory or phenomenon. A key issue is whether any aesthetic features in science provide anything beyond catching our attention, or are at best, a mere heuristic aid. I respond to accounts that argue this way and show how formulation is important in scientific thought experiments and, similarly to literary fictions, there is more than one way of interpreting a thought experiment scenario. I end by considering which literary examples are most appropriate when making comparisons with thought experiments. As a result, the difference between representations in art and science raised in current discussions is not as stark as it has been made out to be, and science is a more heterogeneous practice than has been allowed. Part of the value of thought experiments in scientific practice includes the qualities they share with literary works. (shrink)

Die vorliegende Untersuchung wird von der Frage geleitet, ob und wie sich philosophische Aussagen zur Kunst mit kunsthistorischen Sichtweisen verbinden und für die Rezeption nichtgegenständlicher Kunst fruchtbar machen lassen. Sie basiert auf der Analyse von Positionen des kunsthistorischen Kanons sowie auf der Untersuchung fünf philosophisch-ästhetischer Theorien essentialistischer und antiessentialistischer Art. Aufgrund dieses hermeneutischen Prozesses wird eine Systematik der Bildbefragung entwickelt, die sich als Interpretationsansatz insbesondere für nicht gegenstandsbezogenere Werke eignet. Die interdisziplinäre Arbeit gliedert sich in vier Kapitel. Sie beginnt mit (...) der Untersuchung Elemente Zeigen und Sagen. Im zweiten Kapitel werden Elemente der ikonischen Logik untersucht, die das Sein des Bildes als sein Scheinen definieren. Dabei werden vier Typen ikonisch absenter Charakteristiken systematisiert. Das dritte Kapitel analysiert signifikante Texte zur Ästhetik von G.W.F. Hegel, M. Weitz, N. Goodman, M. Heidegger und H.-G. Gadamer. Aus ihnen werden Leitgedanken deduziert, die im vierten Kapitel die Grundlage von drei systematischen Bildbefragungen bilden. Die kunstwissenschaftliche Relevanz dieses philosophischen Ansatzes wird durch die damit generierten Werkinterpretationen belegt. (shrink)

Lakoff (1993) argued that basic level conceptual metaphors are grounded in human experience, and are therefore likely to be found widely across different languages and cultures. However, other mappings may not be shared. It is well documented that many metaphorical expressions vary across languages, and a number of researchers have argued cultural motivations for this. Possible reasons for cross-linguistic differences in metaphor are that different cultures hold different attitudes to metaphor vehicles, or that the source domain entities and events are (...) more salient in one culture than another. However, the corpus data discussed here suggest that rather than being a synchronic reflection of culture, metaphorical expressions are to some extent a cultural reliquary, and an incomplete one. Marc Lange’s new book on laws offers a restatement and development of the account he proposed in Natural Laws and Scientific Practice (Oxford University Press, 2000), henceforth NLSP, and the new material is helpfully summarized in the preface. Laws and Lawmakers presents the key idea from NLSP in a rather more reader-friendly manner – this idea being roughly that the difference between laws and accidents is that laws, unlike accidents, form a ‘stable’ set, i.e. a logically closed set of truths (...) such that they would all still hold under any counterfactual supposition consistent with the set. So, for example, the natural laws all still hold under counterfactual suppositions such as ‘had this match been struck …’, ‘had Bill Gates wanted to build a gold cube one mile across’ and so on; thus this set is stable. But the set of laws plus the accidental claim ‘there is no gold cube one mile across’ fails to hold under such counterfactual suppositions because had Bill Gates wanted to build a gold cube one mile across, such a cube might well have come into existence; thus this set is not stable. While the influence of emotion on individuals'' ethical decisions has been identified by numerous researchers, little is known about how emotions influence individuals'' ethical decision process. Thus, it is not clear whether different emotions promote and/or discourage ethical decision-making in the workplace. To address this gap, this paper develops a model that illustrates how emotion affects the components of individuals'' ethical decision-making process. The model is developed by integrating research findings that consider the two dimensions of emotion, arousal and feeling (...) state, into an applied cognitive-developmental perspective on the process of ethical decision-making. The model demonstrates that certain emotional states influence the individual''s propensity to identify ethical dilemmas, facilitate the formation of the individual''s prescriptive judgments at sophisticated levels of moral development, lead to ethical decision choices that are consistent with the individual''s prescriptive judgements, and promote the individual''s compliance with his or her ethical decision choices. In particular, the model suggests that individuals experiencing arousal and positive affect resolve ethical dilemmas in a manner consistent with more sophisticated cognitive moral structures.
