A limiting factor in ethics education in medical training has been difficulty in assessing competence in ethics. This study was conducted to test the concept that content analysis of pediatric residents’ personal reflections about ethics experiences can identify changes in ethical sensitivity and reasoning over time. Analysis of written narratives focused on two of our ethics curriculum’s goals: 1) To raise sensitivity to ethical issues in everyday clinical practice and 2) to enhance critical reflection on personal and professional values as (...) they affect patient care. Content analysis of written reflections was guided by a tool developed to identify and assess the level of ethical reasoning in eight domains determined to be important aspects of ethical competence. Based on the assessment of narratives written at two times (12 to 16 months/apart) during their training, residents showed significant progress in two specific domains: use of professional values, and use of personal values. Residents did not show decline in ethical reasoning in any domain. This study demonstrates that content analysis of personal narratives may provide a useful method for assessment of developing ethical sensitivity and reasoning. (shrink)

We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. Though Calkins held that her self-psychology and absolute personalistic idealism were compatible in many ways, the two schools of thought offer different conceptions of personhood with respect to animals and nature. On the one hand, Calkins's self-psychology classified animals and nature as non-persons, due to the fact that self-psychology viewed animals and nature as physical entities bereft of the psychical qualities necessary for (...) personhood. On the other hand, Calkins's absolute personalistic idealism classified animals and nature as persons, due to the absolute personalistic idealist understanding of the universe as ultimately mental and personal. Because Calkins's ethics requires the ethical individual to will for the benefit of all human beings, an ethics that adopts Calkins's psychological conception of personhood promotes an anthropocentrism that views animals and nature as possessing merely instrumental value, while an ethics that adopts Calkins's philosophical conception of personhood views animals and nature as possessing intrinsic value. School gardens and garden-based learning continue to gain great popularity in the United States, and their pedagogical potential, and ability to impact students’ fruit and vegetable consumption and activity levels have been well-documented. Less examined is their potential to be agents of food system reskilling and transformation. Though producer and consumer are inextricably linked in the food system, and deskilling of one directly influences the other, theorists often focus on production-centered and consumption-centered deskilling separately. However, in a school garden, the (...) production/consumption disconnect is erased, by virtue of the design of the site itself and how it is utilized by the actors within it. School gardens provide the critical component of education in alternative food networks, and contribute to the producer/consumer reskilling that is a necessary part of food system transformation. We conducted a case study of an established school garden program during its transition from autonomous non-profit to official, district-funded program of a rural school district in the Midwest. By participating in the full “seed to plate” life cycle of a garden crop, students in the garden were actively involved in the reconnection of producer and consumer, while educators were fostering in students an appreciation for fresh, healthy foods and actively challenging the “McDonaldization” of both students’ diets and education. Based upon these findings, we argue that school gardens in rural areas could leverage the dominant role of rural America in developing and shifting food system paradigms. (shrink)

Rosalind Hursthouse The daughter of a pacifist rector who answered "No!" when his congregation asked him "Is everything in the bible true?", perhaps Mary Midgley was destined to become a philosopher. Yet few would have thought this inquisitive, untidy, nature-loving child would become "one of the sharpest critical pens in the west." This is her remarkable story. Probably the only philosopher to have been in Vienna on the eve of its invasion by Nazi (...) Germany in 1938 and dance in Trafalgar Square on VE day seven year later, she studied philosophy at Oxford in the same year as Iris Murdoch, Elizabeth Anscombe and Philippa Foot, all of whom became close friends. Midgley tells us in vivid and humorous fashion how they cut a swathe through the arid landscape of 1950s British philosophy, writing and arguing - often with each other - about the grand themes of character, beauty and the meaning of rudeness while the spectral figure of Ludwig Wittgenstein hovered in the background. She also charts the highs and lows of philosophy and academia in Britain. On joining the Reading philosophy department on £400 a year in 1949, she doubled its staff complement. But her many years at Newcastle University - where Mike Brearley, who later captained England at cricket, also used to teach - were rewarded with the closure of the philosophy department in the 1980s. The mother of three children, her journey is also one of a woman who in the 1950s and 1960s was fighting to combine a professional career with raising a family. In startling contrast to many of the academic stars of her generation, we learn that Midgley nearly became a novelist and started writing philosophy only when in her fifties, suggesting that Minerva's owl really does fly at dusk. Plainly told like her philosophy, this is an elegiac and moving account of friendships found and lost, bitter philosophical battles and of a profound love of teaching all too rarely acknowledged today. In recent years, there has been a growing anti-feminist, conservative movement across many parts of the world known as the anti-gender movement. This movement has been especially strong in Central Eastern Europe, where anti-gender actors have framed ‘gender’ as a static, foreign concept imported from ‘the West’ and destructive to ‘traditional’ societies. Utilising a postcolonial feminist approach, I examine the concept of ‘gender’ in Czechia, drawing attention to the role played by Czech academics, activists and policymakers in negotiating the use (...) of the term ‘gender’. This article traces the history of the term from the 1990s when ‘gender’ was first introduced to a Czech academic audience, through public seminars and lectures hosted by the Prague Gender Studies Centre, to the present-day inclusion of gender mainstreaming discourse in Czech policy documents. I reveal that ‘gender’ is not a timeless, clearly defined, fixed term wholly imported from ‘the West’ but rather a concept with a variable and complicated history. Thus, this crucial term, first developed in Anglo-academia, is not uncontested or uncritically accepted, contrary to the claims made by anti-gender actors. The findings presented in this article hold implications critical to transnational feminist dialogue and activism during the current period of growing global anti-feminist sentiment. (shrink)

As we approach the end of the twentieth century, humanity is facing a crisis in definition and ways of thinking across the boundaries of identity, politics, and culture. This paper briefly addresses unusual forums and forms for expressing the anxiety surrounding change and the ability to analyze it, forms linked to the media and its intensive focus on particular “human interest” stories, but also to the uncertainty that a lack of precedent for thinking creates. One of the questions that most (...) interests me is how the malaise of society and the malaise of political change is expressed through the debates around maternity, birth, and the custody of children, how socio-political problems are made intelligible through dramatization of individual struggle involving family relations. What is compelling is the way in which certain stories followed by the media gravitate around facts that speak of what we do not know. Recent advances in reproductive technologies have put into question the belief (whether implicit or explicit) that biology, as a teleological process, can hold cultural chaos in abeyance. The doors have been opened wide as the definition and status of mother, father, and child have all been deeply questioned. Yet at the very moment when the so-called nuclear family is endangered, it is the extraordinarily powerful metaphor of the family that rings insistently in social and political discourse. There is a sense that the threat to the family signals a disintegration of order, leaving the contemporary sense of self bereft of a discourse that can represent universal order. (shrink)

My argument is that poststructuralist and postmodernist theory carries on and intensifies the main lines of a characteristically modern tradition of aesthetics whose most important point of reference is not French structuralism – as the term, ‘poststructuralism’, implies – but the tradition of 18th-century German romanticism and idealism that culminated in the work of Heidegger during the Weimar period in Germany between the world wars and afterward. What characterizes this modernist tradition of aesthetics is its valorization of language as a (...) mode of being possessed of an ‘ontological’ status. I place the term ‘ontology’ in quotes in order to highlight the distinction between ‘metaphysics’, with its Aristotelian and neo-Platonic connotations of a ‘chain of being’, and the more modern term ‘ontology’, which was coined in the 17th century and which became widely used during the 18th century by Leibnizian philosophers Christian Wolff and Alexander Baumgarten; the latter, not incidentally, also helped to establish modern usage of the term ‘aesthetics’. ‘Metaphysics’ and ‘ontology’ have their roots, respectively, in those two most major currents of our western heritage, the Graeco-Roman and Judaeo-Christian. These currents, although inextricably linked to one another in innumerable ways, have nonetheless been engaged, as Nietzsche put it, ‘in a fearful struggle on earth for thousands of years’ that has been obscured by Heidegger’s and Derrida’s accounts of the history of western philosophy. Such accounts have projected what is basically a romanticist critique of Enlightenment values and thought on to a totalizing account of the history of Western thought since Plato. My purpose in emphasizing the distinction between metaphysics and ontology is to provide a conceptual framework within which our understanding of the development of modern aesthetics, and the concept of language that informed that development, can be related to the larger philosophical issues at hand. Literary theorists in the United States, by endorsing Heidegger’s and Derrida’s self-serving accounts of their writings as assaults on the entire history of Western philosophy, and by failing to judge them critically as outgrowths of that history, have not only obscured these developments. They have also sustained the central tenet of American literary theory since the 1960s: that there is such a thing as a ‘Western philosophical tradition’ on the ‘other’ side of which, through an endless series of linguistic coinages and ‘erasures’, we may maneuver ourselves. My claim is that to the extent that there is such an other side, we are already on it, and that we fundamentally misunderstand our situation if we regard it as ‘other’ to the Western philosophical tradition. Arbery; 255 pp. Wilmington, Delaware: ISI Books, 2001, $24.95. Over the last decade or so, there has appeared an increasing number of books critical of the profession of literary studies. Such criticism has typically been directed (...) at literary theory and its preoccupation with the politics of race, class, and gender. To a limited extent, Glenn Arbery's Why Literature Matters: Permanence and the Politics of Reputation can be classified as belonging to such a "genre." Early in the book, for example, Arbery argues in favor of the "old-fashioned" idea, as he calls it, that literature is a "mode of knowledge" with the potential to open up transcendent modes of experience. Yet Why Literature Matters is so short on polemics and so long on incisive, sometimes brilliant readings of works ranging from the poetry and fiction of Seamus Heaney, Tom Wolfe, Toni Morrison, and Emily Dickinson to Shakespeare's Othello and Homer's Iliad, that such a characterization is insufficient at best and distorting at worst. Notwithstanding its title, this book is devoted less to advancing a polemic about "why literature matters" than to dramatizing, with performative power and grace, why most of us, politically oriented or not, are already quite sure that it does.Such performative power can be felt throughout Why Literature Matters, but [End Page 373] its presence is especially strong in the final, lengthy chapter on the Iliad, "The Sacrifice of Achilles." He was also the greatest hero of the entire classical world: "Achilles has no rival in glory, either in the generation of heroes before him (not even Herakles), or in the ages after him. In the Philippines, all transplant centers are mandated by the Department of Health (DOH) to have a Hospital Transplant Ethics Committee (HTEC) to ensure that donations are altruistic, voluntary and free of coercion/commercial transactions. This study was undertaken primarily to describe the organizational and functional profile of existing HTECs and identify areas for improvement. This is a descriptive cross‐sectional study. There was variation in their logistical arrangements (support from hospital, filing systems, office spaces), operations (length and frequency of meetings, number (...) of referrals) and membership (composition, qualifications, occupation, training). The approval rate for donor‐recipient pairs is high with the majority of cases made by living non‐related donors. Appropriate reasons were cited for rejection. The perception of HTECs is that they are competent and confident in their decision‐making. However, there is a need to standardize HTEC composition, provide operating procedures and additional training which can be done by the DOH. (shrink)

We create a database of company codes of ethics from firms listed on the Standard & Poor's 500 Index and, separately, a sample of small firms. The SEC believes that "ethics codes do, and should, vary from company to company." Using textual analysis techniques, we measure the extent of commonality across the documents. We find substantial levels of common sentences used by the firms, including a few cases where the codes of ethics are essentially identical. We consider these results in (...) the context of legal statements versus value statements. While legal writing often mandates duplication, we argue that value-based statements should be held to a higher standard of originality. Our evidence is consistent with isomorphic pressures on smaller firms to conform. (shrink)

We examine the occurrence of ethicsrelated terms in 10-K annual reports over 1994-2006 and offer empirical observations on the conceptual framework of Erhard et al. 2007). We use a pre-Sarbanes-Oxley sample subset to compare the occurrence of ethics-related terms in our 10-K data with samples from other studies that consider virtue-related phenomena. We find that firms using ethics-related terms are more likely to be "sin" stocks, are more likely to be the object of class action lawsuits, and are more likely (...) to score poorly on measures of corporate governance. The consistency of our results across these alternative measures of ethical behavior suggests that managers who portray their firm as "ethical" in 10-K reports are more likely to be systematically misleading the public. Over the past decade, corporate scandals have proliferated. These scandals, along with the emergence of the #MeToo movement and Environmental, Social, and Corporate Governance (ESG) mandates, have increased the scrutiny of corporations’ ethics culture. How have companies responded in terms of the language appearing in their public ethics documents? We compare the Code of Ethics in 2008 versus 2019 for a sample of S&P 500 firms. For the vast majority of firms, their Code of Ethics lengthened, with the average 2019 (...) code having 29% more words (about 1760 words) than the 2008 average. The language of the codes has also changed. Words such as _bribery, corruption, sustainability, speak up, bullying, slavery,_ and _human rights_ all saw significantly higher usage in the later period. We review possible reasons for the dramatic changes and suggest what questions remain about the motivations behind them. Whether the changes we observe are primarily intrinsically motivated or simply market responses to public pressures is yet to be determined. What is clear from our findings is that society seems to be entering a new age of increasingly moral—or, at least, moralized—corporate governance. (shrink)

This paper looks at conflicts of interest in the not-for-profit sector. It examines the nature of conflicts of interest and why they are of ethical concern, and then focuses on the way not-for-profit organisations are especially prone to and vulnerable to conflict-of-interest scandals. Conflicts of interest corrode trust; and stakeholder trust (particularly from donors) is the lifeblood of most charities. We focus on some specific challenges faced by charitable organisations providing funding for scientific (usually medical) research, and examine a case (...) study involving such an organisation. One of the principal problems for charities of this kind is that they often distribute their funds within a relatively small research community (defined by the boundaries of a small region, like an American state or Spanish Autonomous region, or a small country), and it often proves difficult to find high-level researchers within the jurisdiction to adjudicate impartially the research grants. We suggest and recommend options appropriate for our case study and for many other organisations in similar situations. (shrink)

Trust is both ethically important and essential for business but difficult to measure. This paper contributes toward clarifying the nature of trust in a way that is both conceptually helpful for ethical inquiries concerning business and pertinent to the measurement of trust as an element in organizations. Several papers hypothesize that increasing the role of trust in a corporation reduces the need for external monitoring and contracts. Assessing this important hypothesis requires a way to gauge whether a firm has a (...) trusting corporate culture. We develop an objective measure of trust in a firm’s corporate culture by counting the number of times 21 trust-related words appear in an important kind of document: the Management Discussion and Analysis section of the annual report. We report two significant findings: that, contrary to what one might think, firms with a trusting culture frequently use audit and control-type words and that trust is positively linked with subsequent share price volatility. We propose explanations of these findings with the hope of facilitating the objective measurement of trust and enhancement of a trusting atmosphere in corporate culture. (shrink)

Our analysis in this paper unfolds on two levels: a critique of the ‘realities’ of graduate nursing education and an argument to sustain its ‘ideals’. We open for discussion an aspect of graduate nursing education dominated by instrumental reason, namely the research industry, using an internal critique approach developed by Max Horkheimer and Theodor Adorno of the Early Frankfurt School. As we explain, internal critique arises out of, and relies on, the mismatch between goals, or ‘ideals’, and existing realities. Thinking (...) about ‘ideals’ of the academy, we draw on Hans-Georg Gadamer's view of the university as a place to think freely, creatively, and critically. The contemporary realities of the university, on the other hand, that emphasize the market values of the research industry forcefully shape nursing academic scholarship in a particular direction. In our attempt to recognize and disrupt the forces of the research industry with its instrumental reason, we consider Judith Butler's writings on how norms operate in society. We show that our growing involvement in the research industry makes it very difficult to disentangle ourselves from that situation. The values of the research industry actually suppress the very ideals of education and scholarship that we would like to uphold. As a contra-force, the internal critique of the ‘existing realities’ in the graduate nursing education unmasks the tyranny of the research industry and makes visible the importance of sustaining the higher goals and ideals in nursing scholarship. The aim of this paper has been to contribute to the ongoing discourse on skill, know-how, and expertise in the sporting world by posting an alternative view, one that explores the meaningfulness of difference from the outlook of difference. Hence, my ambition was to put focus on how we look at difference in the sporting world and, subsequently, to set the stage for expanding the analytical framework we use in exploring sports today. Essentially, my argument is based on an assumption (...) that the prevailing paradigm of sports is constructed and continuously redeveloped on the grand narrative of modernity emphasizing sameness over difference, and consequently, leaving sportification as its evolutionary footprint. Accordingly, in pursuit of an alternative, I have utilized a postmodern outlook with emphasis on emancipation, deconstruction, vocabulary, dialog, diversity, and aesthetics as the analytical framework in constructing a narrative of difference, rather than sameness. The purpose of this inquiry is to explore the experience of Borderline Personality Disorder with the aim of developing a more liberating approach to its diagnosis and treatment. Eight participants diagnosed with Borderline Personality Disorder were recruited from a psychiatric hospital operated by the Surrey and Borders NHS Trust and an outpatient daycentre based in London, United Kingdom. A narrative approach to methodology was employed to collect and analyse the participants’ life-stories. Themes to emerge from the participant’s narratives were found (...) to coincide with R.D. Laing’s concept of ontological insecurity. Ontological insecurity describes a number of aspects of the participant’s distress. First published in 1984, Cultural Analysis is a systematic examination of the theories of culture contained in the writings of four contemporary social theorists: Peter L. Berger, Mary Douglas, Michel Foucault, and Jürgen Habermas. This study of their work clarifies their contributions to the analysis of culture and shows the converging assumptions that the authors believe are laying the foundation for a new approach to the study of culture. The focus is specifically on culture, a concept that remains subject to (...) ambiguities of treatment, and concentrates on questions concerning the definition and content of culture, its construction, its relations with social conditions, and the manner in which it may be changing. Out-of-network air ambulance bills are a pernicious and financially devastating type of surprise medical bill. Courts have broadly interpreted the Airline Deregulation Act to preempt most state attempts to regulate air ambulance billing abuses, so a federal solution is ultimately needed. However, in the absence of a federal fix, states have experimented with a variety of approaches that may survive preemption and provide some protections for their citizens.

The catholicity of the theater is found in acknowledging its inherent commitment to telling the whole truth, or at least endeavoring to tell what is true, about human existence. We are by (...) nature story-telling creatures, and the narratives embodied in the theater aid in interpreting and reflecting on mystery and truth, in the exegesis of our lives and of our way of being in the world.
