The aim of this paper is to examine the philosophical sources of some of the criticisms made in the second half of the 20th century to the practices and the main assumptions of historiography. In particular, the influence of the writings by Nietzsche dedicated to European Historicism on the renewed concept of history which is imposed in the twentieth century from the thought of Heidegger and Foucault. The divergent concepts of historical time and existential temporality, as well as those of (...) narrative unity and continuity of historical events, are the concepts that mainly fall under the critical scrutiny of these thinkers. Archaeological investigations that Foucault devotes to institutions and procedures of the European past are mentioned as examples of the critical review of traditional historiography. (shrink)

Is it tautological to call an action "wrongful discrimination?" Some philosophers and political theorists answer this question in the affirmative and claim that the term "discrimination" is intrinsically evaluative. Others agree that "discrimination" usually conveys the action’s moral wrongness but claim that the term can be used in a purely descriptive way. In this paper, we present two corpus studies and two experiments designed to test whether the folk concept of discrimination is evaluative. We demonstrate that the term has undergone (...) a historical development and is nowadays no longer used purely descriptively. Further, we show that this evaluation cannot be cancelled without yielding a contradiction. We conclude that the descriptive use of "discriminatory" is a thing of the past. (shrink)

Consent governs innumerable everyday social interactions, including sex, medical exams, the use of property, and economic transactions. Yet little is known about how ordinary people reason about the validity of consent. Across the domains of sex, medicine, and police entry, Study 1 showed that when agents lack autonomous decision-making capacities, participants are less likely to view their consent as valid; however, failing to exercise this capacity and deciding in a nonautonomous way did not reduce consent judgments. Study 2 found that (...) specific and concrete incapacities reduced judgments of valid consent, but failing to exercise these specific capacities did not, even when the consenter makes an irrational and inauthentic decision. Finally, Study 3 showed that the effect of autonomy on judgments of valid consent carries important downstream consequences for moral reasoning about the rights and obligations of third parties, even when the consented-to action is morally wrong. Overall, these findings suggest that laypeople embrace a normative, domain-general concept of valid consent that depends consistently on the possession of autonomous capacities, but not on the exercise of these capacities. Autonomous decisions and autonomous capacities thus play divergent roles in moral reasoning about consent interactions: while the former appears relevant for assessing the wrongfulness of consented-to acts, the latter plays a role in whether consent is regarded as authoritative and therefore as transforming moral rights. abstract G. A. Cohen argues that egalitarians should compensate for expensive tastes or for the fact that they are expensive. Ronald Dworkin, by contrast, regards most expensive tastes as unworthy of compensation — only if a person disidentifies with his own such tastes (i.e. wishes he did not have them) is compensation appropriate. Dworkinians appeal, inter alia, to the so‐called ‘first‐person’ or ‘continuity’ test. According to the continuity test, an appropriate standard of interpersonal comparison reflects people's own assessment of their (...) relative standing: Person A can only legitimately demand compensation from person B if he regards himself as worse off, all things considered, than B. The typical bearer of expensive tastes does not regard herself as being worse off than others with less expensive tastes. Hence, in the typical case, pace Cohen, compensation for expensive tastes is inappropriate. The article scrutinizes this rationale for not compensating for expensive tastes. Especially, we try to bolster the continuity test by relating it to Dworkin's distinction between integrated and detached values, pointing out that an argument for the continuity test can be built on the assumption that equality has integrated value. In brief, the point is that a metric of equality should be assessed, partly, in virtue of its consequences for related ideals. One of these is the kind of justificatory community promoted by the continuity test. We defend this view against an objection to the effect that equality is a detached value. We conclude that the continuity test constitutes a strong foothold for the resourcist egalitarian reluctance to compensate people for their expensive tastes. (shrink)

This paper tests the ethics-is-good-for-profits as well as the ethics-and-profits-are-joint-outcomes-of-good-management hypotheses in the context of the U.S. defense industry in the 1988–1992 period. Both ethical behaviors (defined and measured as the number and dollar cost of convictions for violations of civil and criminal law as well as reimbursement obligations arising under environmental statutes) and espoused ethical values (in the form of membership in the Defense Industry Initiative and average level of PAC contributions) are compared with measures of profitability for the (...) defense-oriented business segments of sixty-two major U.S. defense contractors. From 1988 to 1992, the U.S. Defense Department gave these contractors an average of 65% of all prime contract awards over $25,000 to business firms for work in the U.S.We found statistically significant, positive correlations between (1) our two measures of espoused ethical values and (2) both measures of espoused ethical values and violative ethical acts. In other words, those contractors with worse ethics records were more likely to be members of the Defense Industry Initiative and give larger PAC contributions. However, we were unable to reject the null hypothesis of no correlation between either ethical behavior or espoused ethical values and profits. Upon entering the examination room, Caitlyn encounters a woman sitting alone and in distress. Caitlyn introduces herself as the hospital ethicist and tells the woman, Mrs. Dennis, that her aim is to help her reach a decision about whether to perform an autopsy on her recently deceased husband. Mrs. Dennis begins the encounter by telling the ethicist that she has to decide quickly, but that she is very torn about what to do. Mrs. Dennis adds, “My sons disagree about the (...) autopsy.” As a standardized patient, a specialized actor, the woman playing Mrs. Dennis has already delivered the same opening lines several times to different learners practicing their clinical ethics consultation skills. An SP encounter is a simulated patient encounter used for educational purposes that requires the standardization of verbal and behavioral responses. In the encounter, the simulator, or “patient,” uses a scripted medical history to enable the learner to employ a certain skill, say, the ability to perform a neurological exam. The use of standardized patients in the evaluation of clinical skills has become a staple in medical education. To tackle the challenge of teaching clinical ethics consultation skills, we have incorporated SP encounters into the curriculum of the Bioethics Program of The Union Graduate College and the Icahn School of Medicine at Mount Sinai. SP encounters are incorporated into one of our onsite classes, the Onsite Clinical Ethics Practicum, and they are part of the capstone examination, which all of our graduates must complete successfully. The inclusion of simulated encounters into the curriculum is one way in which we equip our students with the core competencies specified by the American Society for Bioethics and Humanities Task Force for clinical ethicists. Their belief that the lot represented the true will of Christ stands at odds with a century which had inherited a changing world view in which a strong confidence in the power of human reason gradually replaced (...) the assumption of God’s providential power. 1 Historian Andrew Fix has traced this intellectual shift as it affected the seventeenth-century Dutch Collegiants, who moved from a spiritualist to a rationalist approach to religious questions. The Moravian Brethren, known in Europe as the Renewed Unity of the Brethren, resisted the triumph of reason over revelation into the late eighteenth century. In this they reflected the general hostility toward the emphasis on science and reason to which George Becker has pointed as a hallmark of the Halle Pietists. 2 This similarity is not surprising given the fact that the Brethren were very much a part of the later Pietist movement and had strong ties with Halle during the formative years of the Unity. Count Nicholas Ludwig von Zinzendorf, the dominant influence in the development of the new Unity, attended the Pädegogium at Halle from 1710 to 1716 and modeled his initial projects on his estate after similar ones in Halle. 3Halle preceded the Brethren in a struggle over the role of reason in spiritual life. In the 1740s the philosophy of Christian Wolff (and hence also of Leibniz) [End Page 267] became popular among many at Halle, despite his having been removed from the faculty in 1722. Although the Halle Pietists did not reject science and reason out of hand, some among the faculty had perceived a distinct threat to faith from Wolff’s particular focus. 4 Through his view of reason as the divine source of human knowledge, Wolff shifted the ultimate test of religious insight from revelation to reason. 5 This same decade saw the Brethren’s piety reach a height of intensely emotional, even sensual, expression. This may have prevented Wolffian ideas from extending their influence into the Unity at that time. By the 1790s, however, it became clear that, at least among many of the lay members of the Unity, the Enlightenment stress on the primacy of reason was winning. Just as the Collegiants had come to view “free prophecy” as a function of human reason, several of the Brethren ultimately saw the lot as something open to human manipulation and objected to its use, arguing that decisions were best left simply to “brotherly reason.” 6Although the emphasis on reason invaded the Unity later than it entered Halle, they shared traits that made them vulnerable. In both cases piety was linked to behavior and a certain level of indoctrination. The tendency to drill young people in proper belief and conduct created a climate in which rival ideas could prove quite seductive. 7 A study of the Unity’s use of the lot and its place within their spiritual life over the course of the century reveals this process. It also reveals something of the nature of authority within the Unity since the change was driven by the laity, while the leadership struggled, largely in vain, to maintain the old order. Most importantly, the debate over the use of the lot shows the dynamics of changing ideas outside of the realm of the university and seminary. This allows a view of the impact of practical concerns and individual desires on intellectual change and illuminates the relationship between abstract ideas and social reality.The Unity of the Brethren began as a gathering of Protestant exiles who settled on the Saxon estate of Count von Zinzendorf in 1722. Can a minority agent, Jamal, discriminate against a majority agent, Dave, conceptually speaking? Taking an experimental-philosophical approach, this article addresses the conceptual puzzle by investigating both the ordinary usage of discrimination and whether the academic literature reflects the folk concept. First, it provides a conceptual analysis of discrimination as it is used across the discrimination research field. The analysis produces two novel definitions of discrimination: a symmetric conception, which implies multi-directionality, and an asymmetric conception, which implies uni-directionality. Then, I empirically (...) investigate the US lay concept of discrimination (N = 1,487). The highlight of the paper is an experiment on whether US ordinary usage is symmetric or asymmetric (Study 1), tested across four contexts and three traits (Hiring: Gender, Club: Sexuality, Dating: Race, Parental: Gender). In addition, I study which groups are most often discriminated against, according to respondents, to record potential sensitivity to the frequency of discrimination (Study 2). Overall, the results show that ordinary usage in the US is symmetric across different contexts and traits, and that paradigmatic minority groups are most often discriminated against. Images are at the heart of strategies of persuasion. They render certain aspects visible and leave others unrepresented; and they may shape processes of scientific reasoning and imagination. By tracing diagrammatic images in the anthropological sciences throughout the 20thcentury, the contributions to this special issue highlight some dominant pictorial traditions for rendering human evolution and diversity visible. This article aims to provide an overview of and an introduction to the special issue ‘Visibility Matters’.

Since their inception, the Perspectives in Logic and Lecture Notes in Logic series have published seminal works by leading logicians. Many of the original books in the series have been unavailable for years, but they are now in print once again. This volume, the fifteenth publication in the Lecture Notes in Logic series, collects papers presented at the symposium 'Reflections on the Foundations of Mathematics' held in celebration of Solomon Feferman's 70th birthday (The 'Feferfest') at Stanford University, California in 1988. We describe a model-theoretic approach to ordinal analysis via the finite combinatorial notion of an α-large set of natural numbers. In contrast to syntactic approaches that use cut elimination, this approach involves constructing finite sets of numbers with combinatorial properties that, in nonstandard instances, give rise to models of the theory being analyzed. This method is applied to obtain ordinal analyses of a number of interesting subsystems of first- and second-order arithmetic.

A behavioral drive directed solely at minimizing prediction error would cause an agent to seek out states of unchanging, and thus easily predictable, sensory inputs (such as a dark room). The default to an evolutionarily encoded prior to avoid such untenable behaviors is unsatisfying. We suggest an alternate information theoretic interpretation to address this dilemma.

In eukaryotic cells terminally misfolded proteins of the secretory pathway are retarded in the endoplasmic reticulum (ER) and subsequently degraded in a ubiquitin‐proteasome‐dependent manner. This highly conserved process termed ER‐associated protein degradation (ERAD) ensures homeostasis in the secretory pathway by disposing faulty polypeptides and preventing their deleterious accumulation and eventual aggregation in the cell. The focus of this paper is the functional description of membrane‐bound ubiquitin ligases, which are involved in all critical steps of ERAD. In the end we want (...) to speculate on how the modular architecture of these entities ensures the specificity of substrate selection and possibly accomplishes the transport of misfolded polypeptides from the ER into the cytoplasm. By manipulating the location of prosodic boundary and the semantic bias of the ambiguous “V+N1+de+N2” phrase, which is composed of one verb (V), one noun (N1), one functional word (de), and another noun (N2), this study investigated how prosodic boundary and the semantic bias affect the processing of temporary ambiguous sentences formed by the ambiguous phrase “V+N1+de+N2” through an eye movement experiment. We found the effect of prosodic boundary in the late processing stage and observed an interaction between prosodic boundary (...) and the semantic bias of ambiguous phrases as well. The participants required more time for fixation and more regressions occurred when the meaning of the ambiguous phrase guided by prosodic boundary was inconsistent with context, especially when the ambiguous phrase was biased to the narrative-object phrase. This result suggests that prosodic boundary affects the processing of temporal ambiguous sentences and is influenced by the semantic bias of the ambiguous phrase. These findings provide further evidence from Chinese that indicate that implicit prosody plays a general role in language comprehension. (shrink)

What does morality require of individuals in their dating and sex life? In this article I challenge recent outlines of antidiscrimination duties in the dating sphere and present a plausible alternative: the deliberative duty. This duty avoids the risks and limitations of earlier outlines: it is time-sensitive regarding the malleability of intimate preferences, it avoids being too demanding on the duty-bearer and minimizes the risk of generating mere dutiful attraction behavior towards right-holders. In addition, it is better suited for universal (...) action guidance in the dating sphere than earlier outlines of individual antidiscrimination duties. (shrink)

Africa, along with Asia, is the continent with the highest number of ‘living’ indigenous languages. European languages, mainly English, French and Portuguese, have spread throughout all African nations during the last 200 years; however, until today, the use of these ‘foreign’ languages has been mostly restricted to certain domains, such as higher education, politics and business, and also to a relatively small number of people. According to Scotton (1982: 68) only 10 per cent or less of the rural African population (...) have a considerable competence in the imported languages, even though these are in many instances the official languages of their home countries. African vernaculars are generally not in danger of being replaced by European languages. However, we observe a diminishing use of African vernaculars, not only in an increasing number of domains, but also with regard to the absolute number of indigenous languages; that means, in short, that linguistic vitality and variety on the African continent is decreasing. The problem of the relation between mind and brain has been among the most persistent in modern Western thought, one that even recent advances in neuroscience haven't been able to put to rest. Historian Larry McGrath's Making Spirit Matter is about how a particularly productive and influential generation of late nineteenth- and early twentieth-century French thinkers attempted to answer this puzzle by showing the mutual dependence of spirit and matter. The veritable revolution taking place across disciplines, from philosophy to psychology, (...) located our spiritual powers in the brain and offered a radical reformulation of the meaning of science, spirit, and the self. Pulling out connections between thinkers such as Bergson, Blondel, and Fouille̹e, among others, McGrath plots the intellectual movements that brought back to life themes of agency, time, and experience by putting into action the very sciences that seemed to undermine metaphysics and theology. In so doing, Making Spirit Matter lays bare the long legacy of this moment in the history of ideas and how it might renew our understanding of the relationship between mind and brain. (shrink)

Le colloque de Québec, documenté par le présent ouvrage et complété par des textes inédits, se concentrait moins sur le maître-ouvrage Être et temps que sur la période complexe initiée avec la conférence "L'essence de la vérité". C'est en effet à partir du « tournant » des années 1930 qu'émergent les concepts qui guident la pensée de l'Ereignis inscrite dans une « Histoire de l'être », selon ses dimensions phénoménologique et herméneutique, mais aussi théologique et politique.Les contributions ici réunies, portant sur l'histoire, la technique, l'art, le politique, le mythe ou le divin, tentent d'éclairer la nature et les limites de ce legs philosophique majeur du XXe siècle en envisageant la question de sa postérité et de son actualité pour nous, aujourd'hui.
