Objectives: To analyse and compare the surveys on German doctors and judges on end of life decision making regarding their attitudes on the advance directive and on the dying process.Design: The respondents were to indicate their agreement or disagreement to eight statements on the advance directive and to specify their personal view on the beginning of the dying process.Participants: 727 doctors in three federal states and 469 judges dealing with guardianship matters all over Germany.Main measurements: Comparisons (...) of means, analyses of variance, pivot tables and factor analyses .Results: Three attitude groups on advance directive were disclosed by the analysis: the decision model, which emphasises the binding character of a situational advance directive; the deliberation model, which puts more emphasis on the communicative aspect; and the delegation model, which regards the advance directive as a legal instrument. The answers regarding the beginning of the dying process were broadly distributed, but no marked difference was observed between the responding professions. The dying process was assumed by most participants to begin with a life expectancy of only a few days.Conclusions: A high degree of valuation for advance directive was seen in both German doctors and judges; most agreed to the binding character of the situational directive. Regarding the different individual concepts of the dying process, a cross-professional discourse on the contents of this term seems to be overdue. (shrink)

Death, like many social problems, has become medicalized. In response to this medicalization, physician-assisted suicide has emerged as one alternative among many at the end of life. And although the practice is currently legal in the states of Oregon and Washington, opponents still argue that PAS is unethical, is inconsistent with a physician's role, and cannot be effectively regulated. In comparison, Switzerland, like Oregon, permits PAS, but unlike Oregon, non-physicians and private organizations play a significant role in assisted death. Could (...) the Swiss model be the answer? The following essay explores the Swiss model of assisted suicide for its potential to enhance the regulation of PAS, reduce physician involvement, and perhaps demedicalize the way we die. (shrink)

Medicalized Death and the Right to Die Movement Prior to the 20th Century, most Americans died at home, surrounded by family, friends, and neighbors. Religion, not medicine, governed the death bed for there was little physicians could do for the dying. Eventually, however, advances in medicine and technology would lead to dramatic changes in the timing and location of death: patients not only began living longer, they were also dying longer, and unlike their predecessors, were more likely to (...) die alone, in institutions, and among strangers. Modern medicine, in its zeal to conquer death, had become obsessed with its curative function and ability to extend the lives of the dying. BackgroundIn most Anglophone nations, policy and law increasingly foster an autonomy-based model, raising issues for large numbers of people who fail to fit the paradigm, and indicating problems in translating practical and theoretical understandings of ‘good death’ to policy. Three exemplar populations are frail older people, people with dementia and people with severe traumatic brain injury. We hypothesise that these groups face some over-lapping challenges in securing good end-of-life care linked to their limited agency. To better understand these challenges, we (...) conducted a scoping review and thematic synthesis.MethodsTo capture a range of literature, we followed established scoping review methods. We then used thematic synthesis to describe the broad themes emerging from this literature.ResultsInitial searches generated 22,375 references, and screening yielded 49, highly heterogeneous, studies that met inclusion criteria, encompassing 12 countries and a variety of settings. The thematic synthesis identified three themes: the first concerned the processes of end-of-life decision-making, highlighting the ambiguity of the dominant shared decision-making process, wherein decisions are determined by families or doctors, sometimes explicitly marginalising the antecedent decisions of patients. Despite this marginalisation, however, the patient does play a role both as a social presence and as an active agent, by whose actions the decisions of those with authority are influenced. The second theme examined the tension between predominant notions of a good death as ‘natural’ and the drive to medicalise death through the lens of the experiences and actions of those faced with the actuality of death. The final theme considered the concept of antecedent end-of-life decision-making, its influence on policy and decision-making, and some caveats that arise from the studies.ConclusionsTogether these three themes indicate a number of directions for future research, which are likely to be applicable to other conditions that result in reduced agency. Above all, this review emphasises the need for new concepts and fresh approaches to end of life decision-making that address the needs of the growing population of frail older people, people with dementia and those with severe traumatic brain injury. Das Insolvenzrecht gehört zu dem Kernbestand der Regelwerke, die das Vertrauen der Rechtsgenossen in eine Rechtsordnung sichern. Es regelt die Bedingungen allseitiger Haftung eines Schuldners und steckt damit zugleich den Rahmen ab, innerhalb dessen die Gläubiger erwarten können, dass ihre Rechte in einer und durch eine Reorganisation und Sanierung des schuldnerischen Unternehmens gewahrt werden. Die faktische Wirkung des Insolvenzrechts endet nicht an nationalstaatlichen Grenzen. Das Insolvenzverfahren ist nach seinem Anspruch auf universelle Geltung angelegt. In fast allen Mitgliedstaaten der Europäischen Union (...) gilt heute als innerstaatliches Recht ein gemeinsames Recht grenzüberschreitender Insolvenzverfahren. Dieses gemeinsame europäische Recht strahlt auf die innerstaatlichen Reformbemühungen aus - es hat Einfluss auf die Insolvenzgesetzgebung. Die innerstaatlichen Gesetzgebungen werden zudem von UNCITRAL-Modellgesetzgebungen beeinflusst. Die wissenschaftliche Diskussion geht zusehends auf die damit ausgelösten Konvergenzbewegungen ein; die Praxis bedarf rechtsdogmatischer Aufklärung über die komplexer werdenden Regelungen des Insolvenzrechts und der Unterrichtung über die Strukturen und Problemstellungen ausländischer europäischer und außereuropäischer Insolvenzrechte, auch und gerade in ihrer Wechselwirkung mit dem deutschen Recht. Die Schriftenreihe der DZWIR ist ein Forum dieser Diskussionen. Sie wird in loser Folge monographische Untersuchungen zu Grundsatzfragen des deutschen, europäischen und internationalen Insolvenzrechts veröffentlichen. ArgumentThe spread of Darwinian ideas by the late nineteenth century in Argentina transformed the intellectual elites' notion of progress and civilization. While before Darwin, union, harmony, and assimilation were the ideas most commonly associated with the civilizatory process; variation, struggle, and divergence dominated the post-Darwin discussion. More importantly, unlike in Europe, in Argentina the theory not only triggered interest in the process of speciation, but also its relationship with extinction. Extinction became the benchmark of progress, and the sign (...) of success for the nation. If the country was civilizing itself, the “natural” elimination of inferior individuals, unfit for the struggle for existence, had to be proved and displayed. The origin of modernity was here associated with the existence of evolutionary waste that revealed the work of natural selection on behalf of national improvement. (shrink)

Using 20 video recordings of Emergency Room treatment and over 5 years of Emergency Room fieldwork data, this study elucidates how interactional processes serve as resources for generating a cultural script of death in Japan called ‘Mitori’. A sudden death at a hospital, in which a patient is removed from their social network, is often considered as the opposite of a ‘good home death’. This study shows how hospital deaths in Japan are strongly interrelated with family participation. After showing the (...) point where medical professionals decide to terminate resuscitation attempts, the analysis depicts interactional steps that shift the definition of environment from a place for treatment toward a place where ‘Mitori’ occurs; that is, a family encounter occurs with a dying patient. Conversation between a doctor and a family member consists of a step-by-step evidence- building story. The final section displays both conversational and physical resources used to establish ‘Mitori’. (shrink)

This is the first English translation published of Jean-Luc Nancy's acclaimed consideration of the law's most pervasive principles in the context of actual systems and contemporary institutions, power, norms, laws.

In earlier publications, we had argued that Paul Ramsey is inconsistent because he simultaneously asserts that (i) 'all our days and years are of equal worth' and (ii) 'that it is permissible to refrain from prolonging the lives of some dying patients'. Thomas Long has suggested that we have not shown that Paul Ramsey is inconsistent. Ramsey and we, he holds, start from incommensurable metaphysical views: for Ramsey, the dying process has religious significance--God is calling his servant (...) home. While it is normally a good thing to keep a patient alive, it would, for Ramsey, show deafness to God's call to keep a dying patient alive. It is true we do not share Paul Ramsey's religious views. It is, however, not necessary to rely on any particular metaphysical views to refute Ramsey's position. For Ramsey's view to be internally consistent, Ramsey would have to be able to distinguish between dying and non-dying patients. We examine some of Ramsey's examples and show that his practical judgements do not allow us to draw this distinction. This means that, contra Long, we hold fast to our charge that Ramsey's view is inconsistent. (shrink)

This book examines when it is morally appropriate for medical intervention to hasten the dying process. The authors’ overriding goal is to humanize the dying process by expanding patient centered autonomous control.

Im Folgenden wird der Versuch unternommen, ausgehend von John Deweys Kunst als Erfahrung ein Verständnis des Kitsches als ästhetischer Untugend zu entwickeln. Dabei wird der leitenden Frage des Bandes, ob Kunst moralisch sein muss, in der Weise begegnet, dass nach der spezifischen moralischen Wirkungsweise von Kunstwerken gefragt wird. Nachdem entgegen einer Dichotomisierung von Kunst und Moral die Leistung moderner Literatur und Kunst darin erkannt wird, die Grenzen lebensleitender moralischer Begriffe und Werte anschaulich zu machen und damit Lern- und Reflexionsprozesse auszulösen, (...) wird Kitsch als Umkehr dieser Wirkungsweise von Kunst aufgearbeitet. Kitsch stabilisiert demnach moralische Überzeugungen, Wertvorstellungen und Lebensmodelle, indem er eine sinnliche Welt vor Augen führt, die einen stetigen Resonanzraum letzterer darstellt. Vom Befund ausgehend, dass sein ideologischer Gebrauch in der Natur des Kitsches angelegt ist, wird schließlich Krieg – und insbesondere der gegenwärtige Krieg in Europa – als ein Anlass betrachtet, der die Untugend der Kunst zum Gedeihen bringt. -/- The following paper aims at developing an understanding of Kitsch as an aesthetic vice, drawing mainly upon John Dewey’s Art as Experience. Does art have to be moral? - the guiding question of this volume is addressed by reflecting on the specific operativity of art in moral terms. The genuine force of modern art and literature lies, contrary to a dichotomic view of the relation of morality and the arts, in showing the limits of concepts and values guiding the recipient and therefore activating processes of learning and reflection. It is then argued that Kitsch is the inversion of such an activity. Kitsch stabilizes moral convictions, value orientations and thus ways of life by creating an image of the world that resonates with the latter. Following the observation that Kitsch has a manifest affinity to be used for ideological purposes, war – with focus on the current war in Europe – is considered a primal occasion for the thriving of the aesthetic vice. Wir werden so umfassend und tief wie möglich spekulieren und die Ergebnisse unserer Gedanken ausdrücken. Trotz des multidisziplinären Charakters des Themas und der methodischen (...) Offenheit für die Annahme. Beiträge aus jedem Bereich der Wissenschaft, diese Arbeit gehört zu Psychologie und Ontologie oder, mit anderen Worten, soziale und ontologische Psychologie. Influenced by James Bernat’s approach, the US President’s 1981 Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioural Research concluded that human death is an instant that separates the dying process from the cadaveric state. Death, as Bernat and the President’s Commission argue, cannot be a process. Because organisms cannot be both alive and dead, Bernat claims, the transition from one state to the other must be sudden and instantaneous. Since then, few have (...) argued the opposite notion that death is a process, and that the transition between living and perishing is not a discrete event. In this article we argue that human death is a process that comprises three distinct phases: dying (when the physiological responses against the shutdown of vital organs and systems are in an imminence of breaking down), decease (when events such as respiratory and cardiac arrest indicate the critical failure of vital organs or systems), and decay (the irreversible and accelerated systemic biological process of cellular death that eventually takes over the whole body). We also argue that human death differs from the ‘time of death’ indicated by death certificates, which is pointed out only to clinically and legally establish the irreversibility of the entire process. Husserl discovered that the phenomenon of time cannot be analyzed in terms of objective temporality. The intuitively given succession is not one of worldly objective time, but rather of the time of consciousness itself. Here it seems that the successive phases can exist together, such as they are given together in intuition. This poses the problem of how the time of consciousness can appear in its own course, that is, how to understand the relation between the time that appears and (...) the process of its appearing. Die eingefassten Gärten oder horti conclusi der Augustiner-Schwestern von Mechelen in Belgien stammen aus dem frühen 16. Jahrhundert und bilden einen außergewöhnlichen Teil des spätmittelalterlichen Kulturerbes. Aufgrund von mangelndem Verständnis und Interesse sind die meisten eingefassten Gärten verloren gegangen. Nicht weniger als sieben dieser Gärten sind allerdings bis in das späte 20. Jahrhundert in ihrem ursprünglichen Kontext erhalten geblieben: Der kleinen Gemeinschaft der Augustiner-Schwestern in Mechelen. Gleich ›schlafenden Schönheiten‹ sind sie in den Zellen der Schwestern als Hilfestellung bei der Andacht (...) verborgen geblieben. In meinem Beitrag stelle ich diese Gärten vor als eine Symbolisierung des Paradieses und der mystischen Unio, als ein Heiligtum der Verinnerlichung, als eine Sublimierung des sensorium (insbesondere des Geruchs), als Gartenbau, der im Prozess der Entstehung Sinn gewinnt und als ein Paradigma des Nests The early sixteenth-century Enclosed Gardens or horti conclusi of the Augustinian Hospital Sisters of Mechelen, Belgium, form an exceptional part of late medieval world heritage. Most Enclosed Gardens have been lost, through the ravages of time exacerbated by lack of understanding and interest. No fewer than seven Enclosed Gardens, however, were preserved until the late twentieth century in their original context: the small community of Augustinian nuns in Mechelen. Like ›sleeping beauties‹, they remained secluded in the sisters’ rooms as aids to devotion. In this paper I discuss these gardens as a symbolisation of Paradise and the mystical union, as a sanctuary for interiorisation, as a sublimation of the sensorium (particularly smell), as horticulture that gains meaning in the making process and as a paradigm for the nest. Recent debates about aesthetics are characterized by a partly intentional, but also partly involuntary, vagueness. Whether it be aestheticisation or anesthetisation, articisation or desartification: what is upheld or deplored under one and the same label in fact designates rather different things. The paper makes a suggestion as to how the field could be reorganized. Taking heed of what political theory discusses as the “political difference” between “politics” and “the political”, the aim is to examine what would be gained by working (...) with an “aesthetic difference” that does not straightforwardly equate “the aesthetic” with “art”, and “the aesthetic” with the totality of sensuous-aisthetic processes. An aesthetic thinking would then amount to a thinking that does justice to these inner polarities and remains faithful to the ambiguity of its objects. (shrink)

"Der Aufsatz zielt darauf, der Prozess der historischen Überlagerung, Substitution und Verbreitung des theoretischen Paradigmas der Depression gegenüber jenem der Melancholie darzustellen. Im ersten Teil wird versucht, einige der einschneidenden Eigenschaften der Thematisierungen der Melancholie in der Frühen Neuzeit anzugeben, auch im Verhältnis zum Geist des Kapitalismus. Nachdem eine Skizze der Entstehung der moderne Kategorie der Depression, geht es darum, den Verlauf nachzuzeichnen, der im 20. Jahrhundert zu ihrer Transformation in ein weitläufiges theoretisches Paradigma geführt hat, das schließlich jenes der (...) Melancholie ersetzt hat. Der zweite Teil stellt den Versuch dar, eine Zeitdiagnose umzureißen: An dieser Stelle ist die psychosoziale Bedeutung bestimmter sozioökonomischer und kultureller Mechanismen zu untersuchen, unter besonderem Hinweis auf das, was als »der neue Geist des Kapitalismus« bezeichnet worden ist, sowie auf neue Formen des Individualismus und ihre paradoxen Dynamiken. The second part is the attempt to draw up a Zeitdiagnose: the aim is to assess the ‘depressive’ psychosocial impact exercised by particular socio-economic mechanisms and cultural trends, with particular reference to what has been defined as the ‘new spirit of capitalism’, as well as the new forms of individualism and their paradoxical dynamics. In conclusion, I will form a bridge between the history of the two aforesaid paradigms and the contemporary psychosocial dynamics correlated to the phenomenon today interpreted as a ‘depression epidemic’.". This is somewhat puzzling given that considerable resources have been devoted to bringing public attention to this problem, we have the knowledge and expertise to provide such care, and we have a government-financed benefit that covers this type of care - the Medicare hospice benefit.While utilization of hospice care has increased during the last decade, there is considerable evidence that hospice care remains underutilized particularly in the long term care setting. The second part is the attempt to draw up a Zeitdiagnose: the aim is to assess the ‘depressive’ psychosocial impact exercised by particular socio-economic mechanisms and cultural trends, with particular reference to what has been defined as the ‘new spirit of capitalism’, as well as the new forms of individualism and their paradoxical dynamics. In conclusion, I will form a bridge between the history of the two aforesaid paradigms and the contemporary psychosocial dynamics correlated to the phenomenon today interpreted as a ‘depression epidemic’. Der Aufsatz zielt darauf, der Prozess der historischen Überlagerung, Substitution und Verbreitung des theoretischen Paradigmas der Depression gegenüber jenem der Melancholie darzustellen. Im ersten Teil wird versucht, einige der einschneidenden Eigenschaften der Thematisierungen der Melancholie in der Frühen Neuzeit anzugeben, auch im Verhältnis zum Geist des Kapitalismus. Nachdem eine Skizze der Entstehung der moderne Kategorie der Depression, geht es darum, den Verlauf nachzuzeichnen, der im 20. Jahrhundert zu ihrer Transformation in ein weitläufiges theoretisches Paradigma geführt hat, das schließlich jenes der Melancholie ersetzt hat. Der zweite Teil stellt den Versuch dar, eine Zeitdiagnose umzureißen: An dieser Stelle ist die psychosoziale Bedeutung bestimmter sozioökonomischer und kultureller Mechanismen zu untersuchen, unter besonderem Hinweis auf das, was als »der neue Geist des Kapitalismus« bezeichnet worden ist, sowie auf neue Formen des Individualismus und ihre paradoxen Dynamiken. In lieu of an abstract, here is a brief excerpt of the content:284 HISTORY OF PHILOSOPHY Although this is not the first time that Gentile has been translated into French (a major work of his, L'esprit, acte pur, was published in Paris in 1925), the fact remains nevertheless that his neo-Hegelian system of philosophy fell on deaf ears originally in France, due to the predominance then of Bergsonism and positivi.sm in different areas of French thought. However, as Michele F. Sciacca (...) (another commentator on Gentile) notes in the Preface, the Gentilian system of "actual idealism" should get a better hearing in France from now on, because the widespread interest in Hegel there since 1925 has prepared the ground for its proper reception. The Bibliography, for which Sciacca himself is responsible, includes a section on Gentile's own writings "concerning the national and political formation of Italy" (p. 14); but, significantly enough, those dealing directly with Fascism are all omitted. This omission seems a deliberate attempt to separate Gentile the philosopher from Gentile the Fascist. No matter how understandable psychologically and politically may be the motive here--to have French readers forget that Gentile was the philosopher of Fascism--the attempt itself at bibliographical expurgation, ironically, runs completely counter to the very accent of the Gentilian theory of "pure act" on the unity of thought and action in human experience and history. Rightly or wrongly, Gentile (in sharp contrast to Croce) saw in Fascism the political expression of that unity. As to the secondary sources, the Bibliography again is unnecessarily incomplete, citing as it does only one work in English on Gentile. The anthology closes with a critical note on Gentile's transcendental conception of immortality by the translator (Joseph Moreau), who argues that the "actualistic" philosophy, despite its "religious tone," defeats itself by ending up with an "Epicurean attitude" (p. 324) toward death and the afterlife. Miss Isadora Bauer's book lends a salutory touch to contemporary philosophical literature, so much of which is abstract and removed from experience. Her treatise, on the other hand, has for its subject matter the human condition, its finitude, and its inescapable tragedy. Georg Simmel, an early twentieth-century philosopher, is less known in this country than he deserves to be. His "Lebensphilosophie," as Miss Bauer points out, although it was influenced by Schopenhauer and Nietzsche, found an original expression through him and foreshadowed in many ways the work of Husserl and the contemporary existential thinkers. Miss Bauer's presentation of Simmel's concept of the tragic is lucid and thorough and manages in a wonderful way to let us see through this one aspect the broad outlines of Simmel 's philosophy as a whole. In Simmel's formulation, life itself, unfolding in tragic antinomy of flux and form, of becoming and being, is the ultimate ground of all tragic conflict. The dynamic life process brings forth all forms and also endangers and destroys them over and over again. The human being encounters these opposites in all aspects of his experience: his existence is tragic at its core. "Moira," the ancient goddess who confronted the Greek hero as an alien power, is in Simmel's modern view of tragedy within man himself. She is the opposition between continuity and discontinuity, the mere stream of events and their form or meaning broken in tragic conflict. At this point, Simmel's dialectics leads to a "third realm," a "more BOOK REVIEWS 285 than" which is both immanent and transcendent, a kind of "coincidentia oppositorum" beyond logic and definition. It is the realm of the "person" within which, although the tragic conflict is not resolved, there arises the free self from whose non-dual perspective the unity and eternity of life are seen. Within this realm the individual gains an illumination the result of which is "amor fad," his free decision to affirm his being. In this act of decision lies the "meaning" and "value" of life. The debate over Plato’s “ so called unwritten doctrines”, which he communicated only to a small circle of trusted disciples, has caused a stir among philosophers in recent decades. Rafael Ferber assumes a differentiated position in this controversy. He is convinced that the unwritten doctrines did exist, but that Plato, for reasons inherent in the process of gaining knowledge, was unable to communicate these doctrines even to his closest disciples. In this book, Ferber outlines the discussion and summarizes the (...) standpoints of greatest interest. Ever since Aristotle, we have known that Plato did not put his most important teachings into writing, but instead communicated them only orally to the inner circle of his disciples. While the extant dialogues merely pass down Plato’s “exoteric” doctrines, his most important “esoteric” insights were not meant for the general public. In the meantime, the contents and the significance of Plato’s “unwritten doctrines” have become the subject of debate in philosophical circles. Fifteen years ago, at the height of the controversy over the “unwritten doctrines”, Rafael Ferber entered the fray with a small book. He proposed that Plato was also unable to communicate the “unwritten doctrines” because the highest principles (i.e. the subject of the unwritten doctrines) cannot be known through logical operations due to an epistemological paradox. Ferber’s differentiated position met with great respect and acceptance, although in individual cases it was also rejected. Ferber’s new book again presents the text of 1991, but significantly expands on it through new perspectives and an outline of the discussion it triggered. Philosophers and laymen alike have traditionally assumed that whether you can reason well, make valid inferences, avoid logical mistakes and so forth is entirely a matter of how well the cogs in your head are fashioned and oiled. Partner to this is the assumption that careful reflection is always the method by which we discover whether an inference or reasoning process is correct. Against this, I argue that good reasoning needs constant empirical support; conceptual clarity is not an a (...) priori, but a deeply empirical matter. "The Trinity" is arguably Augustine's (philosophically) most demanding work. Yet it is (...) precisely its philosophical quality that is nowadays sometimes called in question for its apparent lack of argumentative coherence. H. I. Marrou has even expressed the view that this may have been intended, as the text is designed as an exercitatioanimi, a spiritual-mental exercise; i.e., the argumentative gaps are deliberately left open to be filled in by whoever undergoes the exercise. This would mean that "The Trinity" lacks any philosophical or theological position or doctrine in particular, and that it must not be judged by the standards of philosophical discourse, even those of Augustine's own day and age. Brachtendorf sets out with a revision of that view. Augustine, he argues, does indeed formulate a particular position. The impression that there may be gaps in his arguments could well stem from a misunderstanding of some of them. Augustine, Brachtendorf reports in his first chapter (1), developed his teaching of the triune God in close contact with the philosophy of Plotinus. However, he distanced himself from Plotinus by analyzing the process of cognition not by taking as an example the divine nous, but the menshumana. Apart from that he developed an ontology of the Trinity (2) and only then analyzed the human mind in analogy to it (3-4). He also looked into the relationship of mind and language ("word") (5) and developed further some aspects of this relationship such as the trinitarian structure of the human mind (6), the relationship of knowledge and wisdom (7), the human mind as the image of God (8), the self-reflection of the human mind (9), language as an expression of that self-reflection in the image of God (10), and the concept of the "inner word" (11).Brachtendorf concludes with an appeal not to read into Augustine's link of notitia and amor that he was interested in the analysis of self-knowledge merely for ethical reasons. Amor, he argues, expressly includes operations of the intellect. Augustine's interest was therefore genuinely theoretical and intellectualist. Amor, for Augustine, was a force that creates knowledge as such, no matter what the content. Its impact is practical and theoretical. Referring to the works of Charles Taylor, Martin Heidegger, Max Scheler, Hans-Georg Gadamer, and Hannah Arendt, Brachtendorf demonstrates how influential Augustine was with this aspect of his thought in the development of "Subjekt"-centered philosophies in the twentieth century. Yet, as influential as this approach may have been in this particular field, arguing, as it did, for the ontological character of human subjectivity (i.e., that the human mind was naturally structured in a trinitarian way, but had to make its natural intelligence explicit in thought through the learning of language) it did not revolutionize [End Page 256] the understanding of language. Recently, some critics have pointed to the deficits in this model. Especially, the temporal, contextual, and dynamic aspects of teams need to be investigated further (multilevel approach). Emergent states, such as team cognitions, team emotions, and team hierarchies, comprise a promising field of (...) study that leads to a more comprehensive and holistic understanding of teams. These emergent states offer an opportunity to reconcile former concepts (Lewin’s gestalt, Koestler’s holarchy, and Cattell’s syntality) with topical team research. Purpose The paper aims to investigate whether dissent—within hospices and palliative care units—can be observed with regard to typical characteristics of “good dying”, how statements about dying processes that are not perceived as good are expressed, and finally which ethically significant normative consequences arise from this. Method The study is conducted on the basis of a qualitative interview study in different groups of actors and the relationships of these groups are compared with each other. Results Notions of good (...) and bad dying are articulated—even dissented upon—not so much by the patients and their relatives themselves as by the professional actors. This is connected with the requirements of a practice, which evidently evokes a need for accountability, namely for communicative assurance. Conclusion An abstract designation of “good dying” is in danger of losing sight of the contextual characteristics of the practice associated with it, which can lead to situations that are problematic from an ethical viewpoint. Background: After over 4 years since medical assistance in dying legalization in Canada, there is still much uncertainty about how this ruling has affected Canadian society. Objective: To describe the positive aspects of medical assistance in dying legalization from the perspectives of hospice palliative care providers engaging in medical assistance in dying. Design: In this qualitative descriptive study, we conducted an inductive thematic analysis of semi-structured interviews with hospice palliative care providers. Participants and setting: Multi-disciplinary hospice palliative (...) care providers in acute, community, residential, and hospice care in Vancouver and Toronto, Canada, who have engaged in end-of-life care planning with patients who have inquired about and/or requested medical assistance in dying. Ethical considerations: The research proposal was approved by University of British Columbia Research Ethics Board in Vancouver and University Health Network in Toronto. Participants were informed regarding the research goals, signed a written consent, and were assigned pseudonyms. Results: The 48 participants included hospice palliative care physicians, nurses, social workers, and allied health providers. The average interview length was 50 min. Positive aspects of medical assistance in dying legalization were identified at the individual level: a new end-of-life option, patients’ last chance to express control over their lives, patient and family comfort and relief, and a unique learning experience for hospice palliative care providers; the team level: supportive collegial relationships, broadened discussions about end-of-life and palliative care, and team debriefs provide opportunities for education and support; and the institutional level: improved processes to facilitate the implementation logistics. Conclusion: While being involved in the medical assistance in dying process is complex and challenging, this study sheds light on the positive aspects of medical assistance in dying legalization from the hospice palliative care provider’s perspectives. Medical Assistance in Dying legalization has resulted in improved end-of-life conversations between hospice palliative care providers, patients, and their families. Improved communication leads to a better understanding of patients’ end-of-life care plans and bridges some of the existing gaps between hospice palliative care and medical assistance in dying.
