Can desert be the foundation of justice? Recent attempts to redefine distributive justice in the light of the notions of desert and merit depend largely upon how much independent moral force can be attributed to these notions. This is why a number of theorists, following in Joel Feinberg’s wake, assume desert to be a natural feature, independently of the institutions that may reward it, and of the socio-political background against which it stands out. This article criticizes such a view, trying (...) to establish that desert cannot exist but ‘in the eyes’ of some person or group who already possesses some system of values. Thus, the concept lacks the moral force for defining the rightness of a society. In the last section, David Miller’s thesis that there is one specific, right pattern for rewarding desert will be examined. (shrink)

Psychoanalysis is sometimes thought to rely on a “pragmatic theory of truth,” whose chief assumption should be that the effectiveness of a treatment counts as evidence for the truth of the interpretations provided during each treatment, and/or the psychoanalytic ontology of mind itself. While there is some support for this claim in psychoanalytic views both on the nature of psychic reality and on clinical practice, it needs qualification. It should not be taken to imply that the theory is true because (...) or insofar as it (clinically) works. What I mean to show is, rather, that psychoanalysis is a distinctive illustration of the pragmatist concept that effective explanations are, in Dewey’s words, “experimental,” and adjust themselves to real processes while changing reality, and indeed by changing reality. Truth enjoys, in psychoanalysis, a peculiar status, being what one might call an emergent property of a relational process. But not just any relational process, even if it “works,” will produce truth. The key of psychoanalytic treatment is transference, and the main pragmatic character of transference is what one may call its theatrical quality. I try to clarify this through a comparison of Freud’s and Pierre Janet’s clinical approaches. (shrink)

En el presente trabajo nos hemos propuesto la factura de una exposición sucinta en torno a la crítica contra la metafísica clásica desde la perspectiva de Eduardo Nicol. Puede decirse que, desde el punto de vista de nuestro autor, la característica básica de la metafísica ha consistido en el soterramiento del ser, es decir, la metafísica clásica, de alguna u otra manera, ha versado acerca de un ser atemporal y oculto. El ocultamiento del ser ha estado íntimamente ligado al olvido (...) del tiempo y al endiosamiento de la razón; justo por esto Nicol se propone ahora una recuperación de la visibilidad del ser en aras de un contradiscurso del método. We investigate an expansion of quasi-MV algebras ([10]) by a genuine quantum unary operator. The variety of such quasi-MV algebras has a subquasivariety whose members—called cartesian—can be obtained in an appropriate way out of MV algebras. After showing that cartesian . quasi-MV algebras generate ,we prove a standard completeness theorem for w.r.t. an algebra over the complex numbers.

Confirmation of a hypothesis by evidence can be measured by one of the so far known incremental measures of confirmation. As we show, incremental measures can be formally defined as the measures of confirmation satisfying a certain small set of basic conditions. Moreover, several kinds of incremental measure may be characterized on the basis of appropriate structural properties. In particular, we focus on the so-called Matthew properties: we introduce a family of six Matthew properties including the reverse Matthew effect; we (...) further prove that incremental measures endowed with reverse Matthew effect are possible; finally, we shortly consider the problem of the plausibility of Matthew properties. The debate over the question whether quantum mechanics should be considered as a complete account of microphenomena has a long and deeply involved history, a turning point in which has been certainly the Einstein-Bohr debate, with the ensuing charge of incompleteness raised by the Einstein-Podolsky-Rosen argument. In quantum mechanics, physical systems can be prepared in pure states that nevertheless have in general positive dispersion for most physical quantities; hence in the EPR argument, the attention is focused on the question whether (...) the account of the microphysical phenomena provided by quantum mechanics is to be regarded as an exhaustive description of the physical reality to which those phenomena are supposed to refer, a question to which Einstein himself answered in the negative. However, there is a mathematical side of the completeness issue in quantum mechanics, namely the question whether the kind of states with positive dispersion can be represented as a different, dispersion-free kind of states in a way consistent with the mathematical constraints of the quantum mechanical formalism. From this point of view, the other source of the completeness issue in quantum mechanics is the no hidden variables theorem formulated by John von Neumann in his celebrated book on the mathematical foundations of quantum mechanics, the preface of which already anticipates the program and the conclusion concerning the possibility of ‘neutralizing’ the statistical character of quantum mechanics. In this work I reconstruct the physical and mental descriptions of perception in Aristotle. I propose to consider the thesis that αἴσθησις is a μεσότης as a description of the physiological aspect of perception, meaning that perceiving is a physical act by which the sensory apparatus homeostatically counterbalances, and thence measures, the incoming affection produced by external perceptible objects. The proposal is based on a revision of the semantics of the word mesotês in Plato, Aristotle and later Greek mathematicians. I (...) show how this interpretation fits the text, and how it solves problems that afflict the rival interpretations. I further develop a ‘non-dephysiologizing’ spiritualist reading of the additional description of perception as reception of forms without the matter. I show that Aristotle uses the expression ‘forms without matter’ to describe actually abstracted items in one’s mind rather than the way in which the form are received. In opposition to forms-in-matter, such items are causally powerless and metaphysically sterile: an F-without-matter somewhat determines the subject it is in without qualifying or identifying it as an F-subject. Thus, we have a second ‘mental’ description of perception. Further parts of the thesis are devoted to settle interpretive questions raised by controversial statements about perception found in De Anima II 5 and III 2, and to discuss the question of how the mental and physiological descriptions of perception Aristotle offers are related. My conclusion is that Aristotle’s views combines a form of quasi-dualist vitalism about powers which is nonetheless compatible with hylomorphism, and a form of epiphenomenalism with regard to perceptual events. SummaryThe idea of interdisciplinarity can be articulated in different ways. The aim of the article is to criticise the view that interdisciplinarity is to be treated as a quality of the historian's approach to his subject-matter, and to argue for a constructivist interpretation of that notion. A constructivist account of interdisciplinarity relies on the thesis that the latter is one of the manifold ways in which it is possible to give sense to the historical records of which the historian wants (...) to gain knowledge. In the paper it is maintained that the function of the notion of interdisciplinarity is to account for the clash of languages that can be found when disciplines converge. This new paradigm is highlighted by taking into consideration the history of American pragmatism. (shrink)

Male-to-female transsexualism manifests itself in the form of a discrepancy between the male sex assigned at birth and the subjective experience of belonging to the female gender, which in many cases also involves a somatic transition by cross-sex hormone treatment and genital surgery. Until now, no studies related to MtF transsexualism have been carried out within the framework of a phenomenological/existential approach. This paradigm would make it possible to better articulate the transsexual experience beyond the simplistic diagnostic criteria by which (...) it is currently defined. In this study, I will reread MtF transsexualism in the light of Ludwig Binswanger’s theories on Mannerism and Jean Paul Sartre’s remarks on the self and the body. I will do this largely by focusing on first-hand accounts of the MtF transsexual’s experience, in other words from a first-person viewpoint. Finally, I will present some considerations on the meaning of psychological intervention in this field. (shrink)

This article discusses the controversy between Schelling and Eschenmayer regarding the Freiheitsschrift of 1809. Eschenmayer, a follower of the ideas of Jacobi, accuses Schelling of degrading God in applying to Him human concepts. Schelling, on the contrary, thinks that the faith needs the understanding.

In this paper it is argued that qualitative theories (Q-theories) can be used to describe the statistical structure of cross classified populations and that the notion of verisimilitude provides an appropriate tool for measuring the statistical adequacy of Q-theories. First of all, a short outline of the post-Popperian approaches to verisimilitude and of the related verisimilitudinarian non-falsificationist methodologies (VNF-methodologies) is given. Secondly, the notion of Q-theory is explicated, and the qualitative verisimilitude of Q-theories is defined. Afterwards, appropriate measures for the (...) statistical verisimilitude of Q-theories are introduced, so to obtain a clear formulation of the intuitive idea that the statistical truth about cross classified populations can be approached by falsified Q-theories. Finally, it is argued that some basic intuitions underlying VNF-methodologies are shared by the so-called prediction logic, developed by the statisticians and social scientists David K. Hildebrand, James D. Laing and Howard Rosenthal. (shrink)

But we still need an explicit theory of holes to do justice to the ordinary way of counting holes--or so says Cargle.

In this paper I offer a first account of a practice-based conception of normativity for the political domain. This standpoint is used to relocate the most sophisticated normative practices of justification and critique within an experience-based framework, that of the human being as a “normative creature.” I begin by discussing the two major paradigms in political theory, showing that their neglect of this broad framework of normativity is a serious drawback. I then proceed to articulate the central elements of a (...) practicebased account of normativity: the notions of normative practices and normative orders, and an account of the rationality potential of normativity as practice. Los textos recopilados aquí nos invitan a explorar los múltiples laberintos que plantea la polifórmica noción de responsabilidad, una categoría que se ha vuelto central e imprescindible en nuestro horizonte actual. Ciertamente, se impone introducirnos y avanzar por los vericuetos, a veces pobremente iluminados, de los complejos laberintos de la responsabilidad: el incremento de la desigualdad fruto de la globalización económica, la guerra de Irak y sus funestos corolarios, catástrofes ecológicas como la del Prestige o el cambio climático, los vertiginosos (...) avances de la biotecnología, el desolador y trágico atentado del 11 de marzo, plantean graves interrogantes respecto al valor de la responsabilidad en el mundo actual dado que unas decisiones políticas y técnicas imprudentes, precipitadas, conllevan espirales de violencia, horror y devastación que nos estremecen. Todo ello nos exige, imperiosamente, replantear el significado y alcance de la noción de responsabilidad desde la reflexión ética, desde la filosofía social y política e igualmente desde la filosofía de la ciencia y la tecnología. Riassunto : Il presente articolo intende lumeggiare l’esito tanto fecondo quanto problematico a cui conduce l’originale opera laskiana di risemantizzazione del concetto di soggettività. Al centro di tale opera si staglia la progressiva elaborazione di ciò che il filosofo rubrica, al termine del suo Denkweg, sotto il titolo di soggetto ricettivo. Con tale concetto, a cui è intimamente legato quello di “dedizione”, Lask individua in una mera ricettività intuitiva il momento sorgivo e originario di ogni processo cognitivo; il solo momento (...) che rende possibile un accesso diretto all’oggetto trascendente. Ma come si realizza questo accesso? Qual è lo statuto di ciò che il filosofo nomina “dedizione”? L’insufficiente risposta a tali quesiti conduce il pensiero laskiano ad un esito aporetico, ossia alla riduzione della dedizione a momento ideale e alla conseguente riattivazione, in ambito conoscitivo, dell’inaggirabile distanza tra soggetto e oggetto. Ma, se in tale aporia è riconosciuto il limite del modello della conoscenza elaborato da Lask nel suo sistema maturo, non è comunque possibile occultare il decisivo contributo offerto dalla sua riflessione al problema gnoseologico: il superamento del coscienzialismo attraverso l’elaborazione di un soggetto concreto-ricettivo e, accanto a esso, di un peculiare realismo. Subjectivity and Receptiveness: This paper intends to illuminate the problematic outcome of Lask’s redefinition of the concept of subjectivity. The main result of this operation is the elaboration of the notion of receptive subject. With this concept, strictly linked to the notion of Hingabe, Lask identifies the original element of every cognitive process in simple intuitive receptivity. Intuitive receptivity alone provides direct access to the transcendent object. But how is this access possible? What is the relation between the receptive-intuitive element of knowledge and predicative activity? What is the status of Hingabe? The insufficient answers to these questions lead the Lask’s thought to an aporetic outcome, namely, the reduction of Hingabe to an exclusively abstract and ideal receptivity, and consequently to the reactivation, in the theory of knowledge, of the distance between subject and object. However, while this distance marks the limit of the model of knowledge developed by Lask, the main contribuition of his thought remains valid: the overcoming of trascendental subjectivism through the elaboration of a concrete-receptive subject and of an original form of realism. El debate de la reciente filosofía de la imagen está estructurado en la oposición entre enfoques semióticos y perceptualistas. Entre estos últimos, los especialistas suelen incluir a la fenomenología. Ahora bien, ¿es correcto caracterizar a la fenomenología como una posición perceptualista acerca de la imagen? Defenderé la tesis de que la fenomenología representa un perceptualismo indirecto o débil. Con todo, el lugar que pueda ocupar la fenomenología en el debate no se restringe a su cercanía con el perceptualismo. Intentaré mostrar (...) que la fenomenología plantea temáticas puntuales, tales como la relación entre sentido y presencia, las cuales puede conducir hacia un análisis crítico de los supuestos en los que se apoya el encuadre actual de la discusión. The debate of the recent philosophy of the image is organized in the opposition between semiotic and perceptualistic approaches. Scholars often include the phenomenology into the perceptualistic view. Yet, ¿is it right to characterize the phenomenology as a kind of perceptualism about the image? The first goal of the paper is to demonstrate that phenomenology represents an indirect or weak perceptualism. Anyway, the place of the phenomenology in the debate does not consist only in being a kind of perceptualism. The second goal of the paper is to show that phenomenology raises certain questions, like the relationship between sense and presence, which can lead us to criticize the assumptions the current articulation of the debate is based on. This paper deals with the relationship between law and social protests, a topic that seems particularly relevant at this time, when recent public events show the existence of growing tension between citizens and public officers. The paper does not explore the ultimate causes that triggered these social protests, but rather the normative and legal questions raised by these conflicts. The main question that it addresses is the following: How should the law act in the face of these growing expressions of (...) social discontent? The main point that it defends is that social protests are political expressions that, as such, deserve a special public (and particularly judicial) protection. The argument is particularly directed at studying the legal consequences of taking the expressive components of social protests seriously. The exploration may have a further theoretical interest for those who are interested in reflecting upon the scope and limits of the theory of deliberative democracy. (shrink)
