To say that the liturgy is a question of faith means that your object is transcendent and has to do with God and with one unique feature, ie, the very act of celebrating an act of faith. The liturgy is not only motivated by faith, but it is their faith in words, which is a very peculiar dimension.

O artigo propõe uma análise multidisciplinar sobre o pensamento jurídico, tendo como objetivo a reflexão crítica sobre os saberes e práticas jurídicos na sociedade brasileira. O artigo elabora inicialmente uma análise crítico-conceitual de trabalhos de Guillermo O´Donnell sobre estado de direito e democracia na América Latina. Em seguida, adota a noção de agregados jurídicos para apresentar distintas dimensões de pesquisas sócio-jurídicas sobre o direito. Enfim, usa a metáfora da nebulosa de imunidades para a proposta de discernir os atributos positivos do (...) estado de direito no pensamento jurídico brasileiro e suas consequências para a democracia. I conclude that, in principle, Aliseda’s theory of abduction fits better with a heuristic account of IBE.

Epidemiological models have played a central role in the COVID-19 pandemic, particularly when urgent decisions were required and available evidence was sparse. They have been used to predict the evolution of the disease and to inform policy-making. In this paper, we address two kinds of epidemiological models widely used in the pandemic, namely, compartmental models and agent-based models. After describing their essentials—some real examples are invoked—we discuss their main strengths and weaknesses. Then, on the basis of this analysis, we make (...) a comparison between their respective merits concerning three different goals: prediction, explanation, and intervention. We argue that there are general considerations which could favour any of those sorts of models for obtaining the aforementioned goals. We conclude, however, that preference for particular models must be grounded case-by-case since additional contextual factors, as the peculiarities of the target population and the aims and expectations of policy-makers, cannot be overlooked. Bayesianism and Inference to the best explanation are two different models of inference. Recently there has been some debate about the possibility of “bayesianizing” IBE. Firstly I explore several alternatives to include explanatory considerations in Bayes’s Theorem. Then I distinguish two different interpretations of prior probabilities: “IBE-Bayesianism” and “frequentist-Bayesianism”. After detailing the content of the latter, I propose a rule for assessing the priors. I also argue that Freq-Bay: endorses a role for explanatory value in the assessment of scientific hypotheses; (...) avoids a purely subjectivist reading of prior probabilities; and fits better than IBE-Bayesianism with two basic facts about science, i.e., the prominent role played by empirical testing and the existence of many scientific theories in the past that failed to fulfil their promises and were subsequently abandoned. There are different Bayesian measures to calculate the degree of confirmation of a hypothesis H in respect of a particular piece of evidence E. Zalabardo (Analysis 69:630–635, 2009) is a recent attempt to defend the likelihood-ratio measure (LR) against the probability-ratio measure (PR). The main disagreement between LR and PR concerns their sensitivity to prior probabilities. Zalabardo invokes intuitive plausibility as the appropriate criterion for choosing between them. Furthermore, he claims that it favours the ordering of pairs evidence/hypothesis generated by (...) LR. We will argue, however, that the intuitive non-numerical example provided by Zalabardo does not show that prior probabilities do not affect the degree of confirmation. On account of this, we conclude that there is no compelling reason to endorse LR qua measure of degree of confirmation. On the other side, we should not forget some technicalities which still benefit PR. (shrink)

Aliseda’s Abductive Reasoning is focused on the logical problem of abduction. My paper, in contrast, deals with the epistemic problems raised by this sort of inference. I analyze the relation between abduction and inference to the best explanation (IBE). Firstly a heuristic and a normative interpretation of IBE are distinguished. The epistemic problem is particularly pressing for the latter interpretation, since it is devoid of content without specific epistemic criteria for separating acceptable explanations from those which are not. Then I (...) discuss two different normative interpretations of IBE. I. Niiniliuoto favours a “probabilistic-confirmational” translation of explanatory merit while S. Psillos thinks that the insight of IBE is lost in a pure probabilistic format. My conclusion is that Aliseda’s theory of abduction fits better with a heuristic account of IBE. (shrink)

Human rights have become an important ideal in current times, yet our age has witnessed more violations of human rights than any previous less enlightened one. This book explores the historical and theoretical dimensions of this paradox. Divided into two parts, the first section offers an alternative history of natural law, in which natural rights are represented as the eternal human struggle to resist opression and to fight for a society in which people are no longer degraded or despised. At (...) the time of their birth in the 18th Century and again in the popular uprisings of the last decade, human rights became the dominant critique of law and society. The radical rhetoric of rights and its apparently endless expansive potential has led to its adoption by governments and individuals alike seeking to justify their actions on moral grounds and has undermined its radical edge. Part Two examines the philosophical logic of rights. The classical critiques of Kant, Burke, Hegel and Marx illuminate traditional aproaches to the concept of human rights. The work of Heidegger, Sartre and psychoanalysis is used to deconstruct the metaphisical essentialism of bothe universalists and cultural relativists. Finally, through a consideration of the ethics of otherness, and with reference to recent human rights violations, it is argued that the end of human rights is to judge law and politics from a moral stand point which both transcends the present and is historically relevant. According to the “no-miracles argument” (NMA), truth is the best explanation of the predictive-instrumental success of scientific theories. A standard objection against NMA is that it is viciously circular. In Scientific Realism: How Science Tracks Truth Stathis Psillos has claimed that the circularity objection can be met when NMA is supplemented with a reliabilist approach to justification. I will try to show, however, that scientific realists cannot take much comfort from this policy: if reliabilism makes no qualifications about the domain (...) where inference to the best explanation is reliable, scientific realists flagrantly beg the question. A qualified version of reliabilism, on the other side, does not entitle us to infer the realist conclusion. I conclude, then, that Psillos’s proposal does not make any significant progress for scientific realism. (shrink)

Jurisprudence is the prudence of jus, law's consciousness and conscience. Throughout history, when thinkers wanted to contemplate the organisation of society or the relationship between authority and the subject, they turned to law. All great philosophers, from Plato to Hobbes, Kant, Hegel, Marx and Weber had either studied the law or had a deep understanding of legal operations. But jurisprudence is also the conscience of law, the exploration of law's justice and of an ideal law or equity at the bar (...) of which state law is always judged. Jurisprudence brings together 'is' and 'ought', the positive and the normative, law and justice. But after a long process of decay, legal theory is today characterised by cognitive and moral poverty. Jurisprudence has become restricted and academically peripheral, a guidebook to technocratic legalism and a legitimation of the existent. Critical jurisprudence returns to the classical tradition of a general philosophy of law and adopts a much wider concept of legality. It is concerned both with posited law and with the law of the law. All legal aspects of the economic, political, emotional and physical modes of production and reproduction of society are part of critical jurisprudence. This widening of scope allows a radical rethinking of the nature of rights, justice, sovereignty and judgement. A political philosophy of justice today must examine the political economy of law; transitions from Empire to nation; ideological and imaginary constructions through which we understand ourselves and relate to others; ways in which gender, race or sexuality create forms of identity that both discipline bodies and offer sites of resistance. Law's complicity with political oppression, violence and racism has to be faced before it is possible to speak of a new beginning for legal thought, which in turn is the necessary precondition for a theory of justice. Critical Jurisprudence offers an ethics of law against the nihilism of power and an aesthetics of existence for the melancholic lawyer. (shrink)

The concept of fitness, central to population genetics and to the synthetic theory of evolution, is discussed. After a historical introduction on the origin of this concept, the current meaning of it in population genetics is examined: a cause of the selective process and its quantification. Several difficulties arise for its exact definition. Three adequacy criteria for such a definition are formulated. It is shown that it is impossible to formulate an adequate definition of fitness respecting these criteria. The propensity (...) definition of fitness is presented and rejected. Finally it is argued that fitness is a conceptual device, a useful tool, only for descriptive purposes of selective processes, changing from case to case, and thus devoid of any substantial physical counterpart. Any attempt to its reification is an apport to the metaphysical load evolutionary theory has inherited from Natural Theology. (shrink)

An introduction to the model-theoretic approach in the philosophy of science is given and it is argued that this program is further enhanced by the introduction of partial structures. It is then shown that this leads to a natural and intuitive account of both "iconic" and mathematical models and of the role of the former in science itself.

Van Fraassen's argument from the "bad lot" challenges realist interpretations of inference to the best explanation. In this paper I begin by discussing the replies suggested by S. Psillos and P. Lipton. I do not find them convincing. However, I think that van Fraassen's argument is flawed. First of all, it is a non sequitur. Secondly, I think that the real target for the scientific realist is the underlying assumption that epistemic justification results from a comparative assessment among rival explanations. (...) I argue that justification for believing an explanation does not depend on comparison, but on the extent that criteria of explanatory goodness are fulfilled. Therefore, in addition to offering more or less intuitive IBE-tailored arguments, realists fond of IBE should have to analyze the implicit standards of explanatory goodness. In the last section I distinguish between contextual and transcontextual criteria concerning explanatory goodness. Concerning the latter, I focus on consilience, simplicity, analogy and conservatism. \\\ Un argumento empleado por van Fraassen contra las interpretaciones realistas de la inferencia a la mejor explicación es el argumento "del mal lote". El articulo comienza discutiendo las réplicas de S. Psillos y P. Lipton. Aunque ninguna me parece convincente, pienso que el argumento de van Fraassen no resiste un examen cuidadoso. En primer lugar, la conclusión antirrealista que él extrae es un non sequitur. Además, el argumento parte de un supuesto muy cuestionable, a saber, que la justificación de una explicacion es resultado de una comparacion con sus rivales. En mi opinion, la justificación no depende de esto, sino del grado en que la explicacion satisface ciertos criterios de bondad explicativa, independientemente de que haya o no comparación. En consecuencia, la socorrida estrategia de defender el realismo cientifico basándose en la IBE pasa necesariamente por un análisis de los criterios implicitos de bondad explicativa. Mi propuesta es distinguir entre criterios contextuales y transcontextuales. En los últimos incluyo: la diversidad de la evidencia explicada, la simplicidad, la analogia y el conservadurismo. The current crisis is one outcome of the financialisation of contemporary capitalism. It arose in the USA because of the enormous expansion of mortgage-lending, including to the poorest layers of the working class. It became general because of the trading of debt by financial institutions. These phenomena are integral to financialisation. During the last three decades, large enterprises have turned to open markets to obtain finance, forcing banks to seek alternative sources of profit. One avenue has been provision of financial (...) services to individual workers. This trend has been facilitated by the retreat of public provision from housing, pensions, education, and so on. A further avenue has been to adopt investment-banking practices in open financial markets. The extraction of financial profits directly out of personal income constitutes financial expropriation. Combined with investment-banking, it has catalysed the current gigantic crisis. More broadly, financialisation has sustained the emergence of new layers of rentiers, defined primarily through their relation to the financial system rather than ownership of loanable capital. Finally, financialisation has posed important questions regarding finance-capital and imperialism. (shrink)

El artículo pretende comparar y valorar dos enfoques diferentes del argumento de la manipulabilidad -I. Hackin y R. Harré-, cuya idea básica es que, de cara a establecer la existencia de una entidad, manipularla puede ser tan importante como observarla. Por último, a fin de evitar los aspectos más cuestionables de ambos enfoques, propongo entender la eficacia manipulativa como obtención de información (...) fiable. (shrink)

This volume of essays traces the history of jurisprudence from classical times, and examines various interpretations of written laws.

The aim of this essay is to present a reading of Plato's utopianism, as expressed mainly through the 'big letters' of the Republic, which will lead us beyond Karl Popper's and Leo Strauss' modernist understandings of Plato and of his world. The author argues that, despite the 'transcendent' aspects of Platonic utopianism, the ideal city should be understood neither as a blueprint to be realized through some totalitarian political project nor as a mere fiction that cannot by definition give rise (...) to a viable existential prospect. The power of Platonic utopianism lies in its articulation to a value-laden cosmological continuum, which may be understood in terms of the self-instituting (through political persuasion and story-telling activites, among others) capacities of ancient Greek city. The utopian perspective is marked by shareability of political reason and by mutuality between participants in a common discursive venture rather than by individualist authoritarian projections or by harmless (that is, non-political in it orientation and ideological in its repercussions) day-dreaming. Even if Plato's philosophical project aspires to transcend the boundaries of ancient Greek cosmos, Platonic politics cannot be separated from its historical context, that is, the circumstances that gave rise to philosophy as a silent perhaps, but revolutionary, in it intentions political act. La estética se introdujo en España con ocasión de la constitución del sistema de instrucción pública y vinculada a la enseñanza de la retórica y la poética. En 1814, los liberales propusieron reunir la retórica y la poética en una única disciplina que ofreciese los principios de la literatura. Estos principios se venían elaborando para las bellas letras y las bellas artes desde el siglo XVIII y de ellos surgiría la estética como ciencia del gusto y de lo bello. La (...) estética entró a formar parte de la asignatura de _Literatura _en 1846 bajo la influencia de la filosofía ecléctica francesa y, en particular, de la teoría estética de Victor Cousin. Esto propició la producción de los primeros textos sobre estética en España, orientados a la enseñanza de la literatura. (shrink)

This study proposes and tests a model that integrates ethical leadership, internal social capital, and firm performance in small- and medium-sized family firms at different generational stages. Using the upper echelons theory and the social capital perspective of familiness, this study shows that ethical leadership can explain the effectiveness of certain behaviors in relation to family firm performance. Moreover, social capital helps spread a leader's business ethics to firm members, thus improving the family firm's performance. Our results show that founders' (...) personalities and identities determine high internal social capital, which decreases over generations. The study also shows that internal social capital is a communicative element crucial to ethical leadership, facilitating the absorption of the culture and values of the family in the firm. This powerful resource should be promoted and supported by coherent behavior over time by senior leaders. (shrink)
