This study focuses on the prediction of the engagement of small- and medium-sized enterprises (SMEs) in environmental management practices, based on a random sample of 689 SMEs. The study finds that several endogenous factors, including tangibility of sector, firm size, innovative orientation, family influence and perceived financial benefits from energy conservation, predict an SME’s level of engagement in selected environmental management practices. For family influence, this effect is found only in interaction with the number of owners. Objectives To evaluate whether the requirement of “minimal risk and burden” for paediatric research without direct benefit to the subjects compromises the ability to obtain data necessary for improving paediatric care. To provide evidence-based reflections on the EU recommendation that allows for a higher level of risk. Design and setting Systematic analysis of the approval/rejection decisions made by the Dutch Central Committee on Research involving Human Subjects (CCMO). Review methods The analysis included 165 proposals for paediatric research without direct benefit (...) that were reviewed by the CCMO between January, 2000, and July, 2007. A separate, in-depth analysis of all drug studies included 18 early phase drug studies and nine other drug studies without direct benefit. Results 11 out of 165 studies were definitively rejected because the CCMO did not regard the risk and/or burden to be minimal. In three of these 11 cases (including two early phase drug studies) the requirement of minimal risk and burden was cited as the only reason for rejection. Four other early phase drug studies also involved risks and/or burdens that were not regarded to be minimal but were nevertheless approved. Conclusions The requirement of minimal risk and burden, aiming to protect research subjects, occasionally leads to rejection of protocols. Early phase drug studies relatively often do not comply with the requirement. Committees may find ways to approve important studies that formally should be rejected, but that is not a desirable solution. The regulatory framework should be revised to make such occasional exceptions to the requirement legitimate and transparent. (shrink)

Can gene editing and agroecology be complementary? Various formulations of this question now animate debates over the future of food systems, including in the UN Committee on World Food Security and at the UN Food Systems Summit. Previous analyses have discussed the risks of gene editing for agroecosystems, smallholders, and the concentration of wealth by and for agro-industry. This paper takes a different approach, unpacking the epistemic, socioeconomic, and ontological politics inherent in complementarity. I ask: How is complementarity understood? Who (...) is asking and defining this question? What are the politics of entertaining the debate at all? I sketch the epistemic foundations of science and technology that organize different notions of evidence used in agroecology and genetic engineering. On this base, I offer 8 angles on the compatibility question, exploring the historical contradictions that complementarity discourses reveal and the contemporary work they do. I work through questions of technological neutrality, “root cause” problems, working with nature, encoding racism, and dilemmas of ownership and access. These questions, I argue, require a reckoning with ontologies of coloniality-modernity, which help us get underneath—and beyond—the complementarity question. Finally, I offer a framework for thinking about and working toward technology sovereignty. (shrink)

Narratives of seed ‘loss’ and ‘persistence’ remain at loggerheads. Crop genetic diversity is rapidly eroding worldwide, we are told, and numerous studies support this claim. Other data, however, suggests an alternative storyline: far from disappearing, seed diversity persists around the world, resisting the homogenizing forces of modern capitalism. Which of these accounts is closer to the truth? As it turns out, crop biodiversity is more easily invoked than measured, more easily wielded than understood. In this essay, I contend that the (...) impasse reveals an error in the asking. We must, instead, look to the ontological, epistemic, and narrative dimensions of agrobiodiversity—and to the science, politics, and cultures of each. How is diversity empirically defined and measured? Who creates and categorizes diversity? Who does not? How is such knowledge mobilized in the accounts and narratives of different interest groups? Where, when, and why does a narrative hold true? This multi-dimensional view of agrobiodiversity makes space for a greater understanding of how diversity is created, maintained, and renewed. It suggests policy and institutional support for systems that engender such renewal of diversity, both in and ex situ. (shrink)

This is the second volume of the author's ambitious attempt at outlining the history of the dogma of original sin from its beginning to our days. The reader of the first volume witnessed a concerted attack against the dogma and especially against its Augustinian formulation. The second volume deals with perhaps the most obscure period of this dogma's development: the one between the fifth and the eleventh centuries. In the West—thanks to Augustine's undisputed authority—the dogma became accepted as an integral (...) part of Christian theology, even though those theologians of the Dark Ages tried to "humanize" its original, savage formulation. The Christian East, however, would never have accepted it, and took a rather ambiguous position towards the meaning of the "curse of Adam." This is, briefly, the author's thesis, and to prove it he marshals an impressive array of quotes and references, fruits of a wide and often really impressive scholarship. Yet, the whole book is written in the same spirit of crusading, shallow rationalism as was the preceding volume. The speculative issues are not really treated and the whole work lacks that synthetical approach which is so indispensable for an enterprise of such magnitude.—M. J. V. (shrink)

Witnessing to the strong present-day interest in the formation of the great scholastic syntheses of the thirteenth century are the large number of studies devoted to the lesser thinkers of the preceding century. The English-born Robert of Melun is one of these so far largely neglected authors. Despite the edition of his major works in Louvain by R. M. Martin, little has been written on this gifted pupil of Abelard. Horst cuts a large and central piece out of Robert's "system": (...) the doctrines of the Trinity and of God. After a detailed analysis of the sources of his thinking, the Trinity is dealt with and then God. Under the pen of Robert, the sharp dialectical method of Abelard serves to elaborate Augustine's speculation on the Trinity. Yet the author—in line with the contemporary interest in trinitology—is not satisfied to expound the subtle distinctions Robert made but strives to show also how they can have a bearing on the "economy of salvation." There is a rather liberal dose of lengthy Latin quotes, footnotes mushroom, and secondary literature is quoted by the yard. To sum up: this is a serious and articulate treatment of two central questions of scholastic theology and we are glad to read the promise of a continuation treating Robert's anthropology, angelology, and his views on the First Man.—M. Starting with Richard Wright’s controversial address to the Paris Congress of Black Writers and Authors of 1956, this article explores Wright’s and Simone de Beauvoir’s focus on existential freedom as key to an emancipatory political subjectivity. Both Wright and Beauvoir reject the content of identity formed via oppression, seeking to move beyond categories of culture, religion, femininity and blackness. They argue that solidarity can be better forged across identity groups by nurturing a political subjectivity that recognizes the historical and political (...) impact of embodied identities but is driven by ontological freedom expressed in collective action and dissociation with normative categories. Putting Wright’s 12 Million Black Voices in conversation with Beauvoir’s The Second Sex, we can more fully appreciate Wright’s political writing after he left the United States. Here we see the potential for solidarity across borders, and with women and other oppressed peoples. Most important, we witness these two thinkers imagining political invocations that do not reinforce political meanings given to bodies, thus allowing new forms of solidarity and collective action to emerge. This paper proposes a novel measure of civic norm compliance. We combine the literature on norm compliance from institutional economics and social philosophy. Institutional economics draws on survey data to measure civic norms, whereas social philosophy offers a theoretical framework that proves fruitful when used to operationalize civic norms. This paper shows that significantly different results emerge when the operationalization of civic norms in institutional economics draws on the theoretical framework that social philosophy offers. A series of Enlightenment commentators (Montesquieu, Rousseau, Hume, Jefferson) and their progeny have hailed Fénelon (...) as a political subversive who boldly attacked the injustices of the reign of Louis XIV and who prepared the arrival of an egalitarian society with socialist and pacifist traits. Hanley, however, argues that Fénelon actually defended a more moderate and realistic model of political society than his Enlightenment exegetes have suggested. Like earlier commentators, Hanley attempts to prove his argument primarily through an analysis of Telemachus, the pedagogical novel Fénelon had composed for Louis, duc de Bourgogne, the "petit Dauphin" and grandson of Louis XIV, when Fénelon served as his tutor.Three strong chapters demonstrate Hanley's thesis concerning Fénelon's moderate politics and philosophy. Hanley argues that Fénelon's philosophy of education rests on a distinction between true and false glory. True glory resides in virtue and a humble recognition of divine glory, while false glory is the self-centered glorification of the human agent, which easily deteriorates into vanity. Rather than simply condemn self-interest, in his treatment of the education of the prince Fénelon argues that self-interest must be gradually transformed into a broader interest for the good of one's subjects and a deeper recognition of the glory of God. Earning the praise of his Enlightenment acolytes and later feminist commentators, Fénelon defends a solid education for women, but he clearly wants this education to prepare women for their domestic role as wives and mothers; his celebrated treatise and letters on the education of women are not an exercise in gender equality.The economic theory of Fénelon has often been interpreted as a type of utopian socialism. This is largely based on the central place taken by Bétique in the Telemachus. In this mythical land, the happy citizens practice a communist economics; private property is foreign to them. All their basic needs are provided for through communal cooperation. Luxury is also foreign to them; precious metals like gold and silver are used in practical construction as if they were pieces of iron. But Hanley argues that the prosocialist exegetes ignore the varied economies presented in the passages concerning Egypt, Crete, and Tyre. Bétique does not stand alone as an economic ideal. When Fénelon details how the economy of contemporary France should be reformed, it is far from simple socialism. The state has a strong initial role in the state's economic reform, but it works in tandem with private initiatives that will gradually become the stronger partner. "Fénelon differs from later socialists in insisting that the use of state power is not an end in itself, but necessary only to establish the conditions whereby a free economic system can emerge and flourish—at which point direct intervention of the state into economic affairs will diminish, and a free (though hardly unbridled) pursuit of self-interest will be encouraged" (81).Hanley also attacks the common argument that Fénelon is a pacifist who excoriates all recourse to war. Fénelon does indeed condemn war in the most graphic terms. As Archbishop of Cambrai in northern France, he had witnessed the brutal carnage and attendant famines that had decimated the population in repeated wars in this border area. But his nuanced critique of war rests on a distinction between false and true courage. False courage is found in the warrior who initiates war for the sake of his own false glory. True courage lies in those who defend the innocent out of a proper sense of duty; this courage contrasts with cowardice disguised as pacificism. Hanley argues that the confederation of nations that Fénelon envisions as a mechanism to mediate conflict and reduce the recourse to war is less a species of international government than... Live streaming platforms such as Twitch that facilitate participatory online communities have become an integral part of game culture. Users of these platforms are predominantly teenagers and young adults, who increasingly spend time socializing online rather than offline. This shift to online behavior can be a double-edged sword when coping with difficult periods in life such as relationship issues, the death of a loved one, or job loss. On the one hand, platforms such as Twitch offer pleasure, distraction, and relatedness (...) with others to help with coping, and the increased sense of anonymity and control could stimulate self-disclosure. However, the prevalence of trolling and memes may also discourage people from opening up, and relationships that are built online—especially those with microcelebrity streamers—could be perceived as more meaningful than they actually are. To create a deeper understanding of Twitch as a new media platform embedded in game culture, and how users perceive its potential as a coping mechanism, we have conducted a first exploration by means of a survey. The questions focused on general Twitch behavior, the difficult period in life, and the role of Twitch during this period. It was distributed online among people who considered themselves active Twitch users, and who had gone through a difficult period. Eighty-four participants completed the entire survey. The majority of participants indicated that Twitch helped them cope, and that it became a larger part of their lives during the difficult period compared to regular viewing. Recurring themes were the entertainment, distraction, and sense of community Twitch offers. Viewing behavior during difficult periods appears to remain largely the same in terms of the streamers that are watched, although time spent viewing increases, and there is a change toward more time spent actively watching rather than having the stream on in the background. With this work, we aim to create a deeper understanding of Twitch as a platform, and its importance for gamers that are going through difficult periods in life. (shrink)

Matching the development of mind of their eighteenthcentury rationalist compatriots with the development of love and action, the Saint-Simonians, Fourier and Comte saw hardly any stop to the inevitability and infinitude of progress and perfectibility. The prospect of the twentieth century, however, shows an "uneasy consensus." Manuel is not concerned to swell the flood of philosophical history but to bear (...) witness to it, and it is as a witness that he reports that man's "urge to place himself in a total time sequence" is undiminished, if anything it continues to grow and magnify. The search for a total meaning of historical existence is an apparently irrepressible drive. In this concluding chapter Manuel shows how the threads of the previously expressed ideas, particularly from French and German sources, are tied and knotted in the more familiar figures, Spengler, Sorokin, Toynbee, and a group of Christian writers and philosophers of history (de Chardin, Niebuhr, Dawson, Tillich, Pope Plus XII, and Pope John XXIII) illustrating and instantiating the vitality and longevity of the archetypal conceptions he began with. The great divide between theorists persists pretty much in the present as it did in older times. There are the progressists among whom are distinguished those still loyal to the French concept of perfectibility, a new school of philosophical life scientists writing cosmic history, and contemporary Marxists. Manuel classes the Christian theologians of history in a special category, which, although progressist in a sense, like Augustine denigrate earthly progress and restrict themselves to spiritual advance. Then there are the non- or anti-progressists, circular theorists, among whom Spengler, Sorokin, and "Toynbee I" are to be found. Having done duty for the Greeks and Romans, the Italians, French and Germans (surprisingly omitting the figure of Schopenhauer in his account) it would be a further service to have Professor Manuel's reading of English and Scottish involvement in philosophies of history of the sort he defines as "pictures of the total meaning of historical existence... (which have) included predictions of things to come as well as a reduction of the whole of the past to an order," for despite their professed empiricism it will not be denied that in figures like Hobbes, Locke, and Hume, as in some of the lesser figures of the English and Scottish Enlightenment (he mentions the "imitative works" of Price, Priestly, Spencer and Buckle), philosophies of history of the sort defined are implicit where they are not explicit and outspoken. Perhaps one day Professor Manuel will turn his illuminating searchlight to this area. While conceding Manuel's point that philosophies of history of the more distinctly speculative type have grown and even multiplied over the recent past, it should be added (what is common knowledge) that many equally responsible philosophers have tried both to discourage this growth and at the same time to make a contribution to the discipline through a more analytic approach. So far has this movement gone, indeed, that it would appear that the tide of speculative philosophies of history has ebbed greatly, and that "theories" of history are now pretty much restricted to poets, novelists, dramatists and their brethren in some of the social sciences, particularly psychology and sociology, especially in the Englishspeaking world. Whether the "analysts" are making a substantial contribution to our knowledge of historical processes (as distinguished from the language and logic of historical discourse) is still somewhat moot, but there is little doubt that the analysts are rapidly displacing the synthesists in philosophy of history. Dat geldt ook voor zijn benadering van het vraagstuk van de relatie tussen religie en politiek. Schmitt zoekt hierbij aansluiting bij zulke uiteenlopende en incompatibele auteurs als Juan Donoso Cortes en Thomas Hobbes. Vooral recent onderzoek heeft duidelijk gemaakt dat Schmitts juridisch-politieke denken inderdaad steunt op een aantal politiek-theologische premissen. Toch moeten we de actualiteit van zijn werk vooral zoeken (...) bij zijn politiek-filosofische probleemstelling die aanhaakt bij Thomas Hobbes. This book presents an analysis of how speakers of typologically diverse languages report present-time situations. It begins from the assumption that there is a restriction on the use of the present tense to report present-time dynamic/perfective situations, while with stative/imperfective situations there are no such alignment problems. Astrid De Wit brings together cross-linguistic observations from English, French, the English-based creole language Sranan, and various Slavic languages, and relates them to the same phenomenon, the 'present perfective paradox'. The proposed analysis is (...) founded on the assumption that there is an epistemic alignment constraint preventing the identification and reporting of events in their entirety at the time of speaking. This book discusses the various strategies that the aforementioned languages have developed to resolve this conceptual difficulty, and demonstrates that many of the features of their tense-aspect systems can be regarded as the result of this conflict resolution. Five distinguished philosophers survey the contributions to philosophical scholarship in the United States from 1930 to 1960. For the most part the survey is fair, comprehensive, and informative. Passmore's general survey of the philosophic scholarship during this period is a tour de force written with wit, grace, and insight. But while the contributions are a pleasure to read, one wonders for whom this survey has been written. Philosophers acquainted with the various areas discussed will learn little that is new. As such the concept of ‘strangeness’ has lost its relevance. In recent times we witness a new turn in the dialectics of tolerance. It becomes a political and polemical category allowing for a distinct segregation between ‘them’ and ‘we’. The concept explains ‘why we are civilized and they are (...) barbarian’ . The sarcasm of the nineteenth-century Catholic conservative thinker Joseph de Maistre with regard to the abstraction-tainted works of revolutionary thinkers, has become famous: “In my life I have met Frenchmen, Italians, and Russians, but Man, I solemnly declare, I have never met before; perhaps he exists, but not to my personal knowledge.”1These concepts acquire a practical, political, and even (...) polemical meaning when acted upon in the name of man, human rights, and finally humanity against “inhuman” practices…. The Last Judgement, heaven, hell, purgatory, the wrathful God: today, these notions seem to belong to a remote past we have - thank goodness! - left behind. The more remarkable is that, today, prisoners sometimes refer to the representation of God as Judge, as in the proposition ‘Only God can judge me’ you can find as graffito on a cell wall, or tattooed on the body of an inmate. Is this statement born from defiance of the constitutional state, from fundamentalism, (...) or from the fiction of an all-forgiving God? Nowadays, we, modern democrats, have a suspicion towards criminals and fanatics who seem to think that they can get away with an Only God can judge me. Much more common today is the reversal: not a judging God but people assuming judgement over God and over those who persist in referring to God. But the tradition of the ‘theodicee’ shows that this reversed movement of man judging God is not in the least a gesture limited to those outside the religions. In a theodicee, man summons God to appear in front of an imaginary tribunal, only for God to be defended and subsequently acquitted. As Odo Marquard argues, the modern problem of the theodicee – bringing into question God’s justice – in the end favoured atheism. Human autonomy which exonerates God by eliminating him, would imply something like an ‘atheism ad maiorem Dei gloriam’. But when humankind becomes responsible for the creation of its own history, God can no longer be summoned to any tribunal. Now only man can be summoned, and more particularly: humans which may be held accountable for the persistence of evil, responsible for our enduring discontent, obstacles of human progress or annoying remnants of the past. Here we find the beginning of the secularization of the Last Judgement. As Peter Sloterdijk argues, the vindictive God who judges and punishes at the end on times is succeeded by revolutionary groups from the nineteenth century onwards. These not only transform feelings of humiliated anger and powerlessness into those of pride and hope, but also into an effective force of revenge. In short, the theological constellation of rage and eternity has been succeeded by a political-psychological constellation of rage and history. Our representative democracy can be seen as an answer to the dangerous modern tendency to ‘tribunalising’ , because conditions of division and conflict are regarded as normal and lasting, and not as Fremdkörper or indicative of pathology. The Last Judgement becomes indefinitely suspended. However, a certain kind of ‘populism’ holds that unity and homogeneity can very well be made visible and audible’; and nowadays this seems to be accompanied by the longing to give evil, thus a form of negative transcendence, a face and parade it in front of the tribunal of the people. For prisoners, this is bad news. Against its background, the Only God can judge me may yet well up from a different source than that which I had suggested at the beginning of my argument. (shrink)

For Gianni Vattimo in his essay Belief , the widespread modern conviction that the longing for lucidity and religiosity are irreconcilable has today become questionable. In this article the author first discusses an actual instance of the philosophical yearning for lucidity, namely ‘cognitive melancholy'. This melancholia already appears in the sociologist Max Weber's diagnoses of the ‘disenchantment of the world' and of the separation of faith and kwowledge. The author sharpens somewhat further the dualism to which Weber pointed, and relates (...) it to Vattimo's attempt at softenung this dualism – of even abrogating it altogether by reconciling Christian religion with modernity. Some critical observations with regard of this attempt evoke the question of whether philosophical lucidity should not be pursued further than Vattimo does. In consequence of this the radical thrust of the Christian religion to which Vattimo claims to be returning can be percieved more clearly. (shrink)

In the past few years in the Netherlands and other multi-ethnic democratic states we hear sharp political and intellectual criticism on the philosophical idea of a ‘multicultural society’. In this article, the author questions the criticism of several liberal and conservative political philosophers, who in their approach give attention to the genealogy of multiculturalism. While a liberal as Brian Barry sees multiculturalism as a regression, the conservative Roger Scruton on the other hand considers this political and intellectual phenomenon as a (...) bridge too far, a symptom of the disintegration of the modern nation. The author argues that these criticisms are forcing us to abandon a form of multiculturalism that considers ‘toleration’ as the highest principle. The ‘toleration-multiculturalist’ gets entangled in inconsistencies and moral paradoxes, as soon as he wants to determine his position towards intolerant and immodest variations of the Volksgeist, the cultural homogeneity and identity. The underlying problem in the discussion among liberals, conservatives and multiculturalists is the ontological vulnerability of cultures. This vulnerability has to do with the fact that cultures, traditions and identities are dependant on the constructive work of autonomous interpreters. Therefore a permanent dialogue with the past is necessary. While nationalists and multiculturalists are inclined to eliminate this vulnerability by fixating and immunizing the cultural and national identity, the liberals are neutralizing the cultural loyalties of people through the privatisation of identities. In contrast to these positions the author pleads for a form of democracy in which the rituals of democracy mediate the permanent dissensus about the meaning of nevertheless being a national community. In the past few years in the Netherlands and other multi-ethnic democratic states we hear sharp political and intellectual criticism on the philosophical idea of a ‘multicultural society’. In this article, the author questions the criticism of several liberal and conservative political philosophers, who in their approach give attention to the genealogy of multiculturalism. While a liberal as Brian Barry sees multiculturalism as a regression, the conservative Roger Scruton on the other hand considers this political and intellectual phenomenon as a (...) bridge too far, a symptom of the disintegration of the modern nation. The author argues that these criticisms are forcing us to abandon a form of multiculturalism that considers ‘toleration’ as the highest principle. The ‘toleration-multiculturalist’ gets entangled in inconsistencies and moral paradoxes, as soon as he wants to determine his position towards intolerant and immodest variations of the Volksgeist, the cultural homogeneity and identity. The underlying problem in the discussion among liberals, conservatives and multiculturalists is the ontological vulnerability of cultures. This vulnerability has to do with the fact that cultures, traditions and identities are dependant on the constructive work of autonomous interpreters. Therefore a permanent dialogue with the past is necessary. While nationalists and multiculturalists are inclined to eliminate this vulnerability by fixating and immunizing the cultural and national identity, the liberals are neutralizing the cultural loyalties of people through the privatisation of identities. In contrast to these positions the author pleads for a form of democracy in which the rituals of democracy mediate the permanent dissensus about the meaning of nevertheless being a national community. In lieu of an abstract, here is a brief excerpt of the content:Three Probes into St. Francis of Assisi's Second Letter to the Faithful1Robert J. Karris, OFMFrancis' Second Letter to the Faithful2 is so rich that it would take a lengthy book to probe most of its treasures. My goal is to make three probes: 1) from a literary analysis of this letter of exhortation, 2) from the results of a more thorough search for the biblical sources behind its eighty-eight (...) lines, and 3) from the insights achieved through literary and theological parallels to its contents.3 I accomplish my goals by going systematically through this letter, which I contend has introduction, positive exhortations, conclusion to positive exhortations and bridge to second part of the letter, negative exhortations, aka polemic, the example story of the unrepentant rich man, and ending.4 At the very beginning, I remind myself and my readers of something that we might take for granted: The dominant figure of this letter is "our Lord Jesus Christ," an expression and reality that pulses through its eighty-eight lines. Take, as [End Page 79] an example, n. 49–50, which are staggering in scope: "And they (who persevere in penance) will be children of the heavenly Father, whose works they are doing. And they are spouses, brothers, and mothers of our Lord Jesus Christ."Methodology: Search for Literary and Theological ParallelsEarly on in my doctoral studies, I learned the importance and value of investigating New Testament texts by means of their literary parallels.5 For example, there were significant interpretive payoffs to be gained by comparing St. Paul's use of polemic in the Pastoral Epistles (1–2 Timothy and Titus) to that employed by the Stoics.6 Paul probably never met a Stoic philosopher in his life, but their means of no-holds-barred polemic was "in the air" he breathed. Daniel J. Harrington expresses well this common methodology in New Testament Studies: "In literature a parallel involves some point or points of similarity between two texts where literary dependence is unlikely or not proved. Parallels to New Testament texts can be taken from any body of literature and from any period of history…"7So what parallels do I suggest as background for the interpretation of Francis' 2LtF? There may be many, since Francis' letter is dealing with fundamental human and Christian realities: sin and virtue. I have selected what I call The Big Three:In his De Virtutibus et Vitiis Liber,8 Alcuin of York (d. 800) wrote a letter to Count Guy, who is engaged in martial activities. Alcuin has followed Guy's request for paternal admonition and prays that his writing may help Guy to perpetual salvation (n. 6). Alcuin writes briefly about 35 topics: wisdom, faith, charity, hope, zeal of reading, peace, mercy, remission, patience, humility, compunction of the heart, confession, repentance, not delaying conversion to God, fear of God, fasting, almsgiving, chastity, avoiding fraud, judges, false witnesses, envy, pride, proneness to anger, not seeking human praise, perseverance in good works, eight principal vices, greed, fornication, avarice, anger, [End Page 80] weariness (acedia), sorrow, cenodoxia (vainglory), and the four virtues.9 It is abundantly clear that Francis does not engage in 35 topics, but his exhortations do overlap with a number of Alcuin's, e.g., almsgiving, judges, perseverance in good works.In his Liber exhortationis,10 Archbishop St. Paulinus of Aquileia (d. 802) wrote to Count or Duke Henry of Fruilli. His treatise has 66 chapters and covers virtually all spiritual and moral topics. Of singular interest is Chapter 8, "On Friendship with God and Keeping God's Commandments." His final chapter is a long prayer to resist the wiles of the devil and to persevere in virtue. Saints Paulinus of Aquileia and Francis of Assisi's 2LtF have numerous points in common.11Archbishop Hincmar of Reims (d. 882) wrote a very polished and regarded letter, De cavendis vitiis et virtutibus exercendis to King Charles the Bald.12 It has ten chapters. The first seven deal chiefly with vices such as avarice, pride, voluptuousness, gluttony, envy, anger, and jealousy. Since the Reformation and Enlightenment, the Western world has witnessed the incremental decline of religious influence. Yet, key legal protections and duties incumbent on civilians and state actors in both avowedly secular states and ruling theocracies, predominantly Islamic, are to a lesser or greater extent determined by religious values. Although it is often claimed that the modern secular state encourages the adoption of liberal values and allows for the formulation of general law according to the free will of its people, (...) the historical legacy of law and particularly its synthesis with the Judeo-Christian heritage is apparent. In the UK, the continuing centrality of religion in what purports to be a secular system of laws, is demonstrated by the introduction of elements of Sharia law. In an increasingly culturally-diverse society, the recognition of Islamic law may be interpreted as the tacit acknowledgement of the existing inherent faith influences which continue to inform many legal innovations, and represents an explicit attempt to rebalance the privileging of one set of precepts above another. It is suggested that religion continues to occupy a central position in lawmaking; performing a cultural, political, institutional and, importantly, symbolic role and this is evidenced for instance by the narratives which are imposed on individuals in relation to areas of topical significance such as matrimony, terminal illness, abortion, gender and sexual morality. This paper argues against those pronouncements of the retreat of religion in state affairs and, rather, reveals a set of key structural relations and signifiers which are informed by opinions redolent of, not least of all, a peculiar generic proscriptive religiosity.
