This paper proposes an interpretation of German idealism which seeks to grant key importance to its connection with romanticism without thereby undermining its philosophical rationality. I suggest that the fundamental motivation of German idealism is axiological, and that its augment of Kant's idealism is intelligible in terms (...) of its combined aim of consolidating the transcendental turn and legitimating the kind of relation to value articulated in German romanticism. /// [Paul Franks] German idealists regard Spinozism as both the realism that outflanks Kant's idealism and the source of the conception of systematicity with which to fortify idealism. But they offer little argument for this view. Sartre’s discussion of «being-with-others» in Part Three of Being and Nothingness is extraordinarily rich and highly original. At its core, I argue, lies an insight into the aporetic character of intersubjectivity – «the scandal of the plurality of consciousnesses», as Sartre puts it – which emerges most clearly in his critique of Hegel’s theory of intersubjectivity. My aim in this paper is to isolate this thesis of Sartre’s and spell out his grounds for it. I argue furthermore that Hegel’s conception (...) of intersubjectivity corresponds to that of natural consciousness, such that, in rejecting Hegel, Sartre is also impugning the reality of a conception integral to ordinary thought. I suggest that Sartre’s insight also holds the key to his distinctive approach to social and political theory in the Critique of Dialectical Reason. (shrink)

Daniel K. Gardner explores the major philosophical ideas of the Confucian tradition, showing the profound social and political impact it had and continues to have in China.

This paper considers some aspects of the morality of complicity, understood as participation in the wrongs of another. The central question is whether there is some way of participating in the wrongs of another other than by making a causal contribution to them. I suggest that there is not. In defending this view I encounter, and resist, the claim that it undermines the distinction between principals and accomplices. I argue that this distinction is embedded in the structure of rational agency.

The _Analects_ is a compendium of the sayings of Confucius (551-479 b.c.e.), transcribed and passed down by his disciples. How it came to be transformed by Zhu Xi (1130-1200) into one of the most philosophically significant texts in the Confucian tradition is the subject of this book. Scholarly attention in China had long been devoted to the _Analects._ By the time of Zhu Xi, a rich history of commentary had grown up around it. But Zhu, claiming that the _Analects_ was (...) one of the authoritative texts in the canon and should be read before all others, gave it a still more privileged status in the tradition. He spent decades preparing an extended interlinear commentary on it. Sustained by a newer, more elaborate language of metaphysics, Zhu's commentary on the _Analects_ marked a significant shift in the philosophical orientation of Confucianism--a shift that redefined the Confucian tradition for the next eight centuries, not only in China, but in Japan and Korea well. Gardner's translations and analysis of Zhu Xi's commentary on the _Analects_ show one of China's great thinkers in an interesting and complex act of philosophical negotiation. Through an interlinear, line-by-line "dialogue" with Confucius, Zhu effected a reconciliation of the teachings of the Master, commentary by later exegetes, and contemporary philosophical concerns of Song-dynasty scholars. By comparing Zhu's reading of the _Analects_ with the earlier standard reading by He Yan (190-249), Gardner illuminates what is dramatically new in Zhu Xi's interpretation of the _Analects._ A pioneering study of Zhu Xi's reading of the _Analects,_ this book demonstrates how commentary is both informed by a text and informs future readings, and highlights the importance of interlinear commentary as a genre in Chinese philosophy. Galenosphere is an environment of silence. The paper addresses the issue of the essence and significance of galenosphere. To this end, it presents the structure and functioning of galenosphere, i.e. its two crucial components. Moreover, the structure of galenosphere includes static and dynamic elements. The latter determine the functioning of this type of environment. Eight most important sectors that affect the operation of galenosphere were identified. Some of them (the culture of language, noise elimination, creating an environment promoting silence and (...) a prayer for silence) contribute to the emergence of a structured environment of silence, whereas others (positive attitude towards calming down, concentration of the mind and emotions, inner concentration and the ability to be silent) constitute components which directly participate in the formation of an environment of silence. A structured environment of silence is the most effective in operation. The paper points out various advantages offered to the human being by a structured galenosphere. The most significant ones include: successful self-improvement, improvement of spoken and written language skills, effective pedagogic activities, establishing good relationships with other people and getting a deeper insight into the sense of life. The discussion leads to the conclusion that the human being should be provided with optimal working conditions and conditions for development in various areas by the formation of a structured galenosphere (in the family, at school, in the office, etc.). This paper is concerned with the issue of public opinion considered from two points of view: ethical and educational. It has been inspired by the insufficient knowledge of society about public opinion as well as the gullibility of the general public as regards the acceptance of the results of public opinion polls. Therefore, the ethical and educational dimension of this phenomenon are not recognized, which results in a severe lack of research and publications on the topic. The paper consists of (...) three parts. The first part introduces basic facts about public opinion and its major mechanisms. The second one deals with the phenomenon of public opinion as an ethical problem, while the third one is devoted to the problem of education aimed at the development of mature perception of public opinion and active participation in the process. The problem of public opinion is treated as an important and urgent task for ethicists and teachers. This seems relevant as an increasing influence of public opinion on both individuals and a whole society is observed in various areas, including politics, economy, culture and trade. Public opinion also affects an information order, which is of significance to the state and its citizens in the light of the emergence of a communication society. (shrink)

The paper presents the structure and functioning of mediosphere and then discusses it in the context of ethics. It is a phenomenon which belongs to the domain of environment, and therefore exhibits a high level of effectiveness. Mediosphere is an environment generated by the media which are used by people. The human being is the most important element of this environment and influences it in a peculiar way. Hence, each mediosphere is different. The structure and functioning of mediosphere is affected (...) by its layers, namely logosphere, iconosphere, sonosphere, and galenosphere. A consequence of the ‘environmental’ nature of mediosphere is that negative effects of particular phenomena pertaining to the activity of the media are cumulated. Therefore, the ethical aspects of mediosphere are very important and topical. Reflections on this facet of mediosphere may prove useful for both people involved in the media and teachers, whose task, among others, is to prepare students for an adequate reception of what is offered by the press, radio, television, and the Internet. The discussion includes reference to examples of studies by those Western authors who propose practical guidelines and precautionary measures to prevent violation of ethical principles in the functioning of mediosphere. This paper is concerned with the attitude of communication society towards the layer of ethical values. Contrary to what constitutes information society, the conception of communication society is based on the credibility of information, which is a significant component of human communication, and social bonds, which are the basis for any communication. Therefore, it is hypothesized that logosphere, which is the environment of the word, can effectively influence the ethical foundations of communication society and contribute to the development of such (...) society. The chief asset of logosphere is based on its properties: the primacy of the word, dialogicity, and its environmental character. Owing to these features logosphere can positively affect the ethical layer of communication society, provided it constitutes an arranged environment of the word. (shrink)

Michael Hand has recently challenged certain religious organisations that run Academies in the United Kingdom to devise and pursue their own faith-based curricula in their schools. In this short article I examine some of the problems Hand's challenge might encounter, including whether religious conceptions of worthwhile activities and of human flourishing can be as devoid of religious beliefs as Hand would seem to wish and whether his challenge can be met.

This paper offers a critical discussion of Jonathan Israel’s thesis that the political and moral ideas and values which define liberal democratic modernity should be regarded as the legacy of the Radical Enlightenment and thus as deriving from Spinoza. What I take issue with is not Israel’s map of the actual historical lines of intellectual descent of ideas and account of their social and political impact, but the accompanying conceptual claim, that Spinozism as filtrated by the naturalistic wing of eighteenth-century (...) French thought, is conceptually sufficient for the ideology of modernity. The post-Kantian idealist development, I argue, qualifies as radical, and hinges on Spinoza, but its construal of Spinoza does not fit Israel’s thesis, and reflects an appreciation of the limitations, for the purpose of creating a rational modernity, of the naturalistic standpoint represented by thinkers such as d’Holbach. Many of us agree that we ought not to wrong future people, but there remains disagreement about which of our actions can wrong them. Can we wrong individuals whose lives are worth living by taking actions that result in their very existence? The problem of justifying an answer to this question has come to be known as the non-identity problem.[1] While the literature contains an array of strategies for solving the problem,[2] in this paper I will take what I call (...) the harm-based approach, and I will defend an account of harming—which I call the existence account of harming—that can vindicate this approach. -/- Roughly put, the harm-based approach holds that, by acting in ways that result in the existence of individuals whose lives are worth living, we can harm and thereby wrong those individuals. An initially plausible way to try to justify this approach is to endorse the non-comparative account of harming, which holds that an event harms an individual just in case it causes her to be in a bad state, such that the state’s badness does not derive from a comparison between that state and some alternative state that the individual would or could have been in. However, many philosophers argue that the non-comparative account of harming is inadequate,[3] and one might be tempted to infer from this that any harm-based approach to the non-identity problem will fail. My proposal, which I call the existence account of harming, will show that this inference is faulty: we can vindicate the harm-based approach without relying on the non-comparative account of harming. This volume, edited by a philosopher and an anthropologist, is a collection of essays on the philosophical implications of laboratory and field research. While neither the best nor the worst of the genre, it is a collection that offers a representative sample of traditional themes. As practicing scientists who view the implications of behavioural research from a somewhat different perspective we offer this critical review.

Consider a duty of beneficence towards a particular individual, S, and call a reason that is grounded in that duty a “beneficence reason towards S.” Call a person who will be brought into existence by an act of procreation the “resultant person.” Is there ever a beneficence reason towards the resultant person for an agent to procreate? In this paper, I argue for such a reason by appealing to two main premises. First, we owe a pro tanto duty of beneficence (...) to future persons; and second, some of us can benefit some of those persons by procreating. In support of the first premise I reject the presentist account of time in favor of the view that future persons are just as real as presently existing persons. I then argue that future persons are like us in all the morally relevant ways, and since we owe duties of beneficence to each other, we also owe duties of beneficence to future persons. In support of the second premise I offer an account of benefiting according to which an individual can be benefited by an action even if it makes her no better off than she would have been, had the action not been performed. This account of benefiting solves what I call the “non-identity benefit problem.” Finally, I argue that having a life worth living is a benefit, and some of us can cause some persons that benefit by causing them to exist. Schelling’s 1809 Freiheitsschrift, perhaps his most widely read work, presents considerable difficulties of understanding. In this paper, I offer an interpretation of the work in relation to Kant. My focus is on the relation in each case of their theory of human freedom to their general metaphysics, a relation which both regard as essential. The argument of the paper is in sum that Schelling may be viewed as addressing and resolving a problem which faces Kant’s theory of freedom and transcendental (...) idealism, deriving from the challenge posed by Spinozism. One major innovation in Schelling’s theory of human freedom is his claim that it presupposes the reality of evil. I argue that Schelling’s thesis concerning evil also provides a key to the new and highly original metaphysics of the Freiheitsschrift. The relation of Schelling’s theory of freedom to his general metaphysics is therefore complex, for it goes in two directions: the metaphysics are not simply presupposed by the theory of freedom but are also in part derived from it. These new metaphysics also, I argue, allow Schelling to resolve a problem which his own earlier Spinozistic system had left unresolved. (shrink)

Action-relative accounts can be contrasted with effect-relative accounts, which hold that an action may harm an individual in virtue of its effects on that individual, regardless of whether the individual would have been better off in the absence of the (...) action. In this paper, I argue that our judgments about the strength of the reason against harming lend support to effect-relative accounts over action-relative accounts. I first criticize Fiona Woollard’s argument for the claim that an effect-relative account of harming could ground only a weak reason against harming. I then argue for a set of three principles that can be conjoined with an effect-relative account to explain the strength of the reason against harming. (shrink)

Social scientists have drawn attention to the role of hype and optimistic visions of the future in providing momentum to biomedical innovation projects by encouraging innovation alliances. In this article, we show how less optimistic, uncertain, and modest visions of the future can also provide innovation projects with momentum. Scholars have highlighted the need for clinicians to carefully manage the expectations of their prospective patients. Using the example of a pioneering clinical team providing deep brain stimulation to children and young (...) people with movement disorders, we show how clinicians confront this requirement by drawing on their professional knowledge and clinical expertise to construct visions of the future with their prospective patients; visions which are personalized, modest, and tainted with uncertainty. We refer to this vision-constructing work as recalibration, and we argue that recalibration enables clinicians to manage the tension between the highly optimistic and hyped visions of the future that surround novel biomedical interventions, and the exigencies of delivering those interventions in a clinical setting. Drawing on work from science and technology studies, we suggest that recalibration enrolls patients in an innovation alliance by creating a shared understanding of how the “effectiveness” of an innovation shall be judged. In this paper I attempt a general explanation of the role played by the reasonable person in law, especially but not only in the common law. I relate my explanation to some problems about the very nature of law, and some problems about the ideal of the rule of law.

In a reconstruction of the theories of Freud and Klein, Sebastian Gardner asks: what causes irrationality, what must the mind be like for it to be irrational, to what extent does irrationality involve self-awareness, and what is the point of irrationality? Arguing that psychoanalytic theory provides the most penetrating answers to these questions, he rejects the widespread view of the unconscious as a 'second mind', in favour of a view of it as a source of inherently irrational desires seeking expression (...) through wish-fulfilment and phantasy. He meets scepticism about psychoanalytic explanation by exhibiting its continuity with everyday psychology. (shrink)

According to various “harm-based” approaches to the non-identity problem, an action that brings a particular child into existence can also harm that child, even if his or her life is worth living. In the third chapter of The Non-Identity Problem and the Ethics of Future People, David Boonin surveys a variety of harm-based approaches and argues that none of them are successful. In this paper I argue that his objections to these various approaches do not impugn a harm-based approach that (...) Boonin does not consider, an approach I call the “existence solution to the non-identity problem.” I also argue that the existence solution is more plausible than Boonin’s own proposed solution. The term `code-switching' is used to describe the mixing of different language varieties which often results from language contact. This book is the first full-length study of code-switching in a European context.

This paper examines how the exercises offered to the young Socrates in the Parmenides can be understood as an educational practice, or a gymnastic that is prior to and instrumental for defining forms. To this end, I argue that the subject of the exercises given to Socrates can be understood as an open and indeterminate ‘one’, rather than a form per se. I show that the description of the gymnastic exercises, the demonstration of the hypotheses themselves, and the language concerning (...) the ‘one’, are consistent with an indeterminate subject ‘one’. In this engaging volume, Daniel Gardner explains the way in which the Four Books--_Great Learning_, _Analects_, _Mencius_, and _Maintaining Perfect Balance_--have been read and understood by the Chinese since the twelfth century. Selected passages in translation are accompanied by Gardner's comments, which incorporate selections from the commentary and interpretation of the renowned Neo-Confucian thinker, Zhu Xi. This study provides an ideal introduction to the basic texts in the Confucian tradition from the twelfth through the twentieth centuries. It guides the reader (...) through Zhu Xi's influential interpretation of the Four Books, showing how Zhu, through the genre of commentary, gave new coherence and meaning to these foundational texts. Since the Four Books with Zhu Xi's commentary served as the basic textbook for Chinese schooling and the civil service examinations for more than seven hundred years, this book illustrates as well the nature of the standard Chinese educational curriculum. How do laws resemble rules of games, moral rules, personal rules, rules found in religious teachings, school rules, and so on? Are laws rules at all? Are they all made by human beings? And if so how should we go about interpreting them? How are they organized into systems, and what does it mean for these systems to have 'constitutions'? Should everyone want to live under a system of law? Is there a special kind of 'legal justice'? Does it consist (...) simply in applying the law of the system? And how does it relate to the ideal of 'the rule of law'?These and other classic questions in the philosophy of law form the subject-matter of Law as a Leap of Faith. In this book John Gardner collects, revisits, and supplements fifteen years of celebrated writings on general questions about law and legal systems - writings in which he attempts, without loss of philosophical finesse or insight, to cut through some of the technicalities with which the subject has become encrusted in the late twentieth century. Taking his agenda broadly from H.L.A. Hart's The Concept of Law, Gardner shows how the key ideas in that work live on, and how they have been and can still be improved in modest ways to meet important criticisms - in some cases by concession, in some cases by circumvention, and in some cases by restatement. In the process Gardner engages with key ideas of other modern giants of the subject including Kelsen, Holmes, Raz, and Dworkin. Given that one of the major goals of the practice of Philosophy for Children (P4C) is the development of critical thinking skills (Sharp 1987/2018, pp. 4 6), an urgent question that emerged for one of the authors, who is of Chinese Heritage and a novice practitioner at a P4C summer camp was whether this emphasis on critical thinking might make this practice incompatible with the fabric of Chinese culture. Filial piety (孝), which requires respect for one’s parents, elders, and ancestors (...) is considered an important virtue in Asian culture, as is the preservation of harmony. But if one of the goals of P4C is to teach youngsters to courageously pursue reasoned dialogue, does this not set-up young Asians for serious conflict when they come face-to-face with positions that are articulated by elders, but which are ones to which they are diametrically opposed; a racist grandmother, for instance, or an uncle who insists that those at the Tiananmen Square uprising were nothing but hooligan’s. It is this question that we will explore in this presentation. In the process, we will come to the conclusion that, when positions seem irreconcilable, rather than continuing to pursue rigorous critical interchange that may do little other than escalate insult, the facilitator, rather, ought to move toward creating a deeper understanding of each position juxtaposed against its opposing view (a process that we refer to as ‘collaborative caring’), so as to produce side-by-side understanding, knowing that communal bonds have been maintained and, hence, that the opportunity for genuine reasoned collaborative inquiry on other issues and at future times remains open.
