Au vu de l’éclosion soudaine de ce « printemps arabe » qui a essaimé de pays en pays, cet article montre comment, à l’ère de la transparence et de la simultanéité, les moyens d’information et de communication ont créé un champ d’action propice au soulèvement contre les dictatures. Mais, si les réseaux sociaux numériques – Facebook en particulier –, les SMS, et les e-mails, ont donné aux citoyens les moyens de leur révolution, il est aussi question d’imagination constituante. En effet, (...) les chaînes d’information en continu du monde arabe – Al Jazeera principalement –, ont alimenté un imaginaire révolutionnaire à coup d’images télévisuelles, et surtout de discours informationnel « ami », souvent protecteur, qui a en même temps insufflé des idées et du courage à des peuples arabes endormis depuis des décennies, qui soudain croient en une révolution possible et passent à l’action.This article shows how, in the sudden “Arab Awakening” and its domino effect as it spread from country to country, means of information and communication in an age of transparency and simultaneity opened up a sphere for action that could potentially trigger an uprising against dictatorship. But although the social networking sites – especially Facebook –, text messaging and emails gave citizens the means to revolt, there is also the question of the imagination that created that terrain. The 24-hour news channels in the Arab world, especially Al Jazeera, nourished the revolutionary imagination with telegenic images and especially a “ friendly” and often protective informational discourse that, in parallel, inspired people with courage and ideas after decades of slumber, galvanising them into action. Recently, there has been much research into conceptual engineering in connection with feminist inquiry and activism, most notably involving gender issues, but also sexism and misogyny. Our paper contributes to this research by explicating, in a principled manner, a series of other concepts important for feminist research and activism, to wit, feminist political identity terms. More specifically, we show how the popular Conceptual Spaces Framework (CSF) can be used to identify and regiment concepts that are central to feminist research, focusing (...) especially on feminism in France. According to the CSF, concepts can be represented geometrically, as regions in similarity spaces. A particular strength of the CSF framework is its empirically-focused methodology, which allows researchers to infer the boundaries of concepts from empirical data, thus eliminating the need to strongly rely on intuitions about meanings. This is shown to be especially valuable for the explication of concepts relating to feminist political identity, given that the intuitions of feminist scholars and activists about what would appear to be core concepts in the area tend to be poorly aligned or even conflicting. We report the results from an empirical categorization study conducted among French feminists and show how they support the view that the CSF can contribute to both the conceptual engineering project and our understanding of the structure of social reality. Probabilism is committed to two theses: 1) Opinion comes in degrees—call them degrees of belief, or credences. 2) The degrees of belief of a rational agent obey the probability calculus. Correspondingly, a natural way to argue for probabilism is: i) to give an account of what degrees of belief are, and then ii) to show that those things should be probabilities, on pain of irrationality. Most of the action in the literature concerns stage ii). Assuming that stage i) has been (...) adequately discharged, various authors move on to stage ii) with varied and ingenious arguments. But an unsatisfactory response at stage i) clearly undermines any gains that might be accrued at stage ii) as far as probabilism is concerned: if those things are not degrees of belief, then it is irrelevant to probabilism whether they should be probabilities or not. In this paper we scrutinize the state of play regarding stage i). We critically examine several of the leading accounts of degrees of belief: reducing them to corresponding betting behavior (de Finetti); measuring them by that behavior (Jeffrey); and analyzing them in terms of preferences and their role in decision-making more generally (Ramsey, Lewis, Maher). We argue that the accounts fail, and so they are unfit to subserve arguments for probabilism. We conclude more positively: ‘degree of belief’ should be taken as a primitive concept that forms the basis of our best theory of rational belief and decision: probabilism. (shrink)

A frequent justification in the literature for using stated preference methods (SP) is that they are the only methods that can capture the so-called total economic value (TEV) of environmental changes to society. Based on follow-up interviews with SP survey respondents, this paper addresses the implications of that argument by shedding light on the construction of TEV, through respondents’ perspective. It illuminates the deficiencies of willingness to pay (WTP) as a measure of value presented as three aggregated themes considering respondents’ (...) unintentionality, their retraction once they understood that their WTP could be decisive in cost-benefit analysis and the inherent incompleteness of WTP. We discuss why the TEV discourse persists, how it conceals rather than reveals broader notions of value and in what ways our results support the development of alternative approaches that truly endorse plurality in environmental valuation and decision-making. The article deals with the application rationae personae of the right to selfdetermination. Relying on the existing international legal framework, decisions of the judicial bodies and doctrine, the author analyses conceivable beneficiaries of the above-mentioned right: the inhabitants of Trust and Non-Self-Governing territories, peoples under foreign occupation, the entire population of a state and subgroups within a state.

Objectification is a notion central to contemporary feminist theory. It has famously been associated with the work of anti-pornography feminists Catharine MacKinnon and Andrea Dworkin, and more recently with the work of Martha Nussbaum. However, objectification is a notion that has not yet been adequately defined. It has been used rather vaguely to refer to a broad range of cases involving, in some way or another, the treatment of a person as an object. My purpose in this paper is to (...) offer a plausible understanding of objectification. I do that by focusing on the work of four prominent thinkers: Immanuel Kant, and contemporary feminists Catharine MacKinnon, Andrea Dworkin and Martha Nussbaum. Through drawing on these thinkers' conceptions of objectification, I am finally led to a more complete and coherent understanding of this notion. (shrink)

Kant has famously argued that monogamous marriage is the only relationship where sexual use can take place "without degrading humanity and breaking the moral laws." Kantian marriage, however, has been the target of fierce criticisms by contemporary things: it has been regarded as flawed and paradoncal, as being deeply at odds with feminism, and, at best, as plainly uninteresting. In this paper, I argue that Kantian marriage can indeed survive these criticisms. Finally, the paper advances the discussion beyond marriage. Drawing (...) on Kant 's conception of friendship, I suggest that he might have overlooked the possibility of sex being morally permissible in yet another context. (shrink)

I show that the Lottery Paradox is just a version of the Sorites, and argue that this should modify our way of looking at the Paradox itself. In particular, I focus on what I call “the Cut-off Point Problem” and contend that this problem, well known by Sorites scholars, ought to play a key role in the debate on Kyburg’s puzzle. Very briefly, I show that, in the Lottery Paradox, the premises “ticket n°1 will lose”, “ticket n°2 will lose”… “ticket (...) n°1000 will lose” are equivalent to soritical premises of the form “~(the winning ticket is in {…, (tn)}) ⊃ ~(the winning ticket is in {…, tn, (tn + 1)})” (where “⊃” is the material conditional, “~” is the negation symbol, “tn” and “tn + 1” are “ticket n°n” and “ticket n°n + 1” respectively, and “{}” identify the elements of the lottery tickets’ set. The brackets in “(tn)” and “(tn + 1)” are meant to point out that in the antecedent of the conditional we do not always have a “tn” (and, as a result, a “tn + 1” in the consequent): consider the conditional “~(the winning ticket is in {}) ⊃ ~(the winning ticket is in {t1})”). As a result, failing to believe, for some ticket, that it will lose comes down to introducing a cut-off point in a chain of soritical premises. In this paper I explore the consequences of the different ways of blocking the Lottery Paradox with respect to the Cut-off Point Problem. A heap variant of the Lottery Paradox is especially relevant for evaluating the different solutions. One important result is that the most popular way out of the puzzle, i.e., denying the Lockean Thesis, becomes less attractive. Moreover, I show that, along with the debate on whether rational belief is closed under classical logic, the debate on the validity of modus ponens should play an important role in discussions on the Lottery Paradox. -/- . This paper generalizes the (epistemic) preface paradox beyond the principle of belief aggregation and constructs a similar paradox for deontic reasoning. The analysis of the deontic case yields a solution strategy---restricting belief/obligation aggregation rather than giving it up altogether---that can be transferred to the epistemic case. Our proposal amounts to a reasonable compromise between two goals: (i) sticking to bridge principles between evidence and belief, such as the Lockean Thesis, and (ii) obtaining a sufficiently strong logic of doxastic and deontic (...) reasoning. The paper’s target is the historically influential betting interpretation of subjective probabilities due to Ramsey and de Finetti. While there are several classical and well-known objections to this interpretation, the paper focuses on just one fundamental problem: There is a sense in which degrees of belief cannot be interpreted as betting rates. The reasons differ in different cases, but there’s one crucial feature that all these cases have in common: The agent’s degree of belief in a proposition A does not (...) coincide with her degree of belief in a conditional that A would be the case if she were to bet on A, where the belief in this conditional itself is conditioned on the supposition that the agent will have an opportunity to make such a bet. Even though the two degrees of belief sometimes can coincide (they will coincide in those cases when the bet has no expected causal bearings on the proposition A and the opportunity to bet have no evidential bearings on that proposition), it is the latter belief rather than the former that guides the agent’s rational betting behaviour. The reason is that this latter belief takes into consideration potential interferences that bet opportunities and betting itself might create with regard to the proposition to be betted on. It is because of this interference problem that the agent’s degree of belief in A cannot be interpreted as her betting rate for A. (shrink)

Ambos asumen que la idea de intuición es necesaria para la invención matemática. En este artículo se muestran los puntos coincidentes entre Bergson y (...) Poincaré en torno a la relación intuición-invención, mostrando cómo su definición lleva a interpretar la intuición como un proceso y, finalmente, cómo la idea de esquema dinámico introducida por Bergson para explicar la invención está implícita en el pensamiento de Poincaré. A number of philosophers have recently suggested that some abstract, plausibly non-causal and/or mathematical, explanations explain in a way that is radically dif- ferent from the way causal explanation explain. Namely, while causal explanations explain by providing information about causal dependence, allegedly some abstract explanations explain in a way tied to the independence of the explanandum from the microdetails, or causal laws, for example. We oppose this recent trend to regard abstractions as explanatory in some sui generis way, and argue (...) that a prominent ac- count of causal explanation can be naturally extended to capture explanations that radically abstract away from microphysical and causal-nomological details. To this end, we distinguish di erent senses in which an explanation can be more or less abstract, and analyse the connection between explanations’ abstractness and their explanatory power. According to our analysis abstract explanations have much in common with counterfactual causal explanations. (shrink)

Por su parte la fenomenología de la mística contemporánea ha señalado la necesidad de distinguir las experiencias místicas de otros tipos de experiencia de trascendencia, y para ello autores como Juan Martín Velasco han rescatado la relevancia de un rasgo que para James era secundario, a saber, la pasividad. A partir de este aporte, es (...) posible entablar un diálogo entre ciencia y mística y lograr así una definición naturalizada de la experiencia mística que revele la importancia tanto de la pasividad mística como de las técnicas para lograrla, de modo que se considere la experiencia mística en su calidad de vía mística. Vann McGee has presented a putative counterexample to modus ponens. I show that (a slightly modified version of) McGee’s election scenario has the same structure as a famous lottery scenario by Kyburg. More specifically, McGee’s election story can be taken to show that, if the Lockean Thesis holds, rational belief is not closed under classical logic, including classical-logic modus ponens. This conclusion defies the existing accounts of McGee’s puzzle.

The article analyzes one of the fundamental rights – the right to maintenance, which proper implementation ensures normal development of the child. This right matches with the duty of parents to maintain their minor children. Paragraph 6 of Article 38 of the Constitution of the Republic of Lithuania states that parents have a duty to educate their children to be honest people and loyal citizens, supporting them until adulthood. The obligation to maintain children is established in the first 3.192 Article (...) paragraph of the Civil Code of the Republic of Lithuania, and the responsibility for avoiding to maintain a child is provided in Article 164 of the Criminal Code. The article discusses the fact that the analysis of criminal law rate is not precise enough. Article 164 of the Criminal Code does not match with the child maintenance methods specified in the CC Article 3.196 paragraph 1. Since criminal liability is only for judgment in default in civil cases, a person shall only be liable for breaking the right to maintain a child, provided in the CC 3.196 paragraph 1. This article deeply analyzes the problematic qualification aspects of the avoidance to maintain a child. Some alternative ways of child maintenance are mentioned, as can be chosen from other law instruments (bailiffs, Guarantee child support fund) and it leads to the ultima ratio principle. On the other hand, it is not required to seek alternative remedies for affected interests, and it is possible to initiate a pre-trial investigation. Therefore, this article seeks to identify specific civil and criminal law rules delimitation. Avoidance of child maintenance is an ongoing crime. The main problem in legal practice is to determine an end of this ongoing criminal conduct. The practice of the Supreme Court of Lithuania is not unanimous. In some cases, the end of this ongoing conduct is considered to be a moment when the past judgment has entered into force, in other cases – the moment of indictment. These positions are criticized by many authors and it is suggested to follow the Supreme Court’s practice, according to which the moment when a judgment of conviction for the criminal act is passed should be considered as an end of an ongoing criminal conduct. System-level change is crucial for solving society's most pressing problems. However, individual-level interventions may be useful for creating behavioral change before system-level change is in place and for increasing necessary public support for system-level solutions. Participating in individual-level solutions may increase support for system-level solutions – especially if the individual-level solutions are internalized as part of one's social identity.

This paper employs _Conversation Analysis_ to investigate a specific interactional environment in Swedish police interviews (PIs): sequences where the interviewee asserts an inability to recollect specific events, and the police subsequently challenge this assertion. The police interview serves as a crucial setting for reconstructing past events and identifying the distribution of knowledge among participants. While previous research has delved into the cognitive mechanisms underlying memory retrieval in PIs, there exists a scarcity of empirical investigation of how memories and their associated (...) knowledge are interactionally managed within this high-stakes activity. Prior Conversation Analytic studies exploring how epistemic dimensions shape social interaction form the theoretical basis for the current study, including research indicating how ‘forgetfulness’ can be strategically employed as an interactional resource. Only a few studies have targeted recorded high-stakes interviews in Swedish, and the lack of such is problematic since international research have highlighted the influence of cultural and social factors on conditions and outcomes. Data used for this study comprises anonymized audio recordings (N = 51) from a preliminary murder investigation, making a valuable contribution to the understanding of interactional practices in Swedish police interviews. Results indicate a discrepancy in orientation between the police and the interviewee. The former treats the memories as accessible _knowables_ possible to retrieve, in contrast to the latter, who uses the police’s challenge as a vehicle for contesting the ‘impossible action of remembering.’. At the heart of Kantian theory lies the prohibition against treating humanity merely as a means. Two of the most influential interpretations of what this means are Wood's and O'Neill's. Drawing on these thinkers' ideas, Kerstein formulates two accounts of what is involved in the idea of treating a person merely as a means: the and accounts. Kerstein's attempt is to show that they are problematic. He introduces his to alleviate the problems they face. I argue that the end-sharing and (...) possible consent accounts are not vulnerable to Kerstein's criticism. However, they both face a shortcoming: they fail to support the Kantian conclusion that the prostitute and the servile person are treated merely as means. Through reconstructing these accounts, I surmount this difficulty. Moreover, my proposal helps Kerstein's own account overcome a problem he admits it has, without the need to resort to consequentialism. (shrink)

In the context of the global COVID-19 pandemic, the fast and equitable distribution of effective vaccines worldwide is one of the challenges faced by international institutions in charge, as global equity in vaccine supply has not yet been achieved. Our paper explains the current state of ethical research on equity in global COVID-19 vaccine allocation, focusing on the COVAX Facility established by the WHO, acting as the global vaccine distributor. The article presents a detailed analysis of the first year of (...) COVAX allocation in 2021 identifying problematic aspects of its allocation framework regarding the implementation of COVAX’s fundamental allocation principles. We argue that the COVAX Facility has developed a proper concept to deal with global vaccine allocation—but to address uncovered defaults, we introduce the ‘Prioritized Distribution of Equal Shares’ model—a both ethical and practically feasible alternative allocation framework to protect the value of human lives in both high- and low-income countries through fair and fast global vaccine distribution in health emergencies. Nonetheless, we argue that the COVAX Facility remains the main organization to provide equitable access to vaccines. Yet, the global community has to consider further aspects such as patent protection, vaccine production and the lack of power of global structures to address the inequities that have arisen. Since new wars and further crises have arisen, a shift in public global attention endangers the processing of COVID-19-related issues. That is why now more than ever extensive efforts to achieve vaccine equity are needed. (shrink)

Following Alexander Herzen, Tolstoy came to regard the Decembrists as full-fledged individualities and “beautiful souls”. Thus, Tolstoy’s much debated “conversion” and subsequent (...) attempts to transform literary art into a medium of religious and moral reform can also be viewed as extensions of his project of self-understanding and self-formation according to the model of kalokagathia provided by Russia’s aristocratic revolutionaries. The aim of the paper is a critical evaluation of Mikhail Bakhtin’s carnival laughter’s theory, and along the analysis of Walter Benjamin’s notion of laughter, and its relation to modernity. While Bakhtin concentrates his attention on a few medieval festivities, this paper focuses on the “feast of fools” (festa stultorum) as a metaphor for carnival laughter. For Bakhtin, clown, joker, etc. represents Medieval and Renaissance carnival spirit, while an animated Mickey Mouse, alongside with Charlie Chaplin’s movie character, appears in Benjamin’s (...) texts as a figure of modernity. Carnival laughter can be cruel, and it was cruel indeed, participated in violence during the festivities. The same cruelty Benjamin had found in a few fairy tales collected by the Brother Grimm. How cruelty and laughter are connected? The lack of common experiences in modernity was the reason why Bakhtin wanted to find a counterbalance to modern atomistic bourgeois society, and laughter could have given it. According to Bakhtin, the spirit of carnival as a collective laughter gradually dried up and in the 16th century it has self-transformed into a novel and became a genre of grotesque realism. For Benjamin, only epic, architecture and cinematograph are able to create the collective experience. (shrink)

In 2016, Davis and Zhang surveyed 71 Chinese engineers to investigate the claim that the concept of “profession” may have a far wider range than the term. They concluded that China seems to have a profession of engineering even though the Chinese still lacked an exact translation of the English term. In part, the survey reported here simply continues the work of Davis and Zhang. It confirms their result using a much larger, better educated, demographically different pool of 229 Chinese (...) engineers. But, in part too, it does something else. It investigates the concept professional competence—the perceived knowledge, skill, and judgment that those surveyed attribute to themselves and other engineers. The article has four parts. The first part describes the basics of the survey. The second part describes some important features of the survey’s questions, explaining how the questions closely track both the concept of profession and the concept of professional competence. The third part reports and interprets the results relevant to the presence or absence of the concepts of profession and professional competence. The fourth part reports the conclusions. (shrink)

Classification and gradation system adopts different security protection schemes for different types of data by implementing classification and gradation management of data, which is an important pretechnical means for data security protection and prevention of data leakage. This paper introduces artificial intelligence classification, machine learning, and other means to learn and train enterprise documents according to the characteristics of enterprise sensitive data. The generated training model can intelligently identify and classify file streams, improving work efficiency and accuracy of classification and (...) gradation. At the same time, the differences, advantages, and disadvantages of K-NN, DT, and LinearSVC algorithms are compared. The experimental data shows that LinearSVC algorithm is applicable to high-dimensional data, with discrete, sparse data features and large number of features, which is more suitable for classification of sensitive data of enterprises.
