Die Untersuchung analysiert deswegen nach einem einleitenden Vorschlag zur Bestimmung des Verhältnisses von Logik und Metaphysik im Anschluss an Leibniz Baumgartens Erkenntnistheorie in ihrer charakteristischen Komplementarität von Ästhetik und Logik, die das gesamte Feld aller möglichen Gewissheit, d. h. des Bewusstseins der Wahrheit der verschiedensten Erkenntnisse, abdecken. Darüber hinaus erörtert sie auch deren mögliche Gegenstände, nämlich die Beschaffenheit der Dinge, wie sie das Wissen Gottes als eine ideale Metaphysik enthielte. Alexander Gottlieb Baumgarten grenzt sich in seinem Ius Naturae, das einen knappen Kommentar zu den Exercitationes Iuris Naturalis Heinrich Köhlers darstellt, nach über zwanzigjähriger Auseinandersetzung mit dieser Vorlage entschieden von einer der zentralen Thesen Köhlers ab. Baumgarten löst nämlich dessen Identifikation der Stimmen der Vernunft, des Gewissens, der Natur und Gottes in der Moral auf und zeigt, daß im Gegenteil göttlicher und irdischer Bereich vollständig disjunkt sind.Dies folgt aus der Einsicht in die prinzipielle Ungewißheit eines jeden möglichen moralischen Urteils, (...) das von Menschen gefällt werden kann. Baumgarten begreift solche Urteile als Akte der Zurechnung, die wiederum syllogistische Schlüsse darstellen. Die Gewißheit eines moralischen Urteils hängt demnach von der Gewißheit der Prämissen ab, aus denen es gewonnen wurde. Nun entwickelt Baumgarten hinsichtlich der verschiedenen möglichen Typen moralisch relevanter Handlungen und jeweils in Anschlag zu bringender Gesetze eine differenzierte Theorie zurechnender Instanzen, die er „Foren“ nennt und nach dem Grad der Gewißheit der durch sie möglichen Schlüsse hierarchisiert sind. Dabei zeigt sich, daß keiner jener Zurechnungsschlüsse vollständige Gewißheit beanspruchen kann, auch nicht derjenige, bei der das eigene Gewissen eine eigene Vorstellung unter ein rein aus der Vernunft erkennbares Gesetz bringt. Moralische Urteile über einzelne Handlungen können demzufolge nach Baumgarten immer nur mehr oder weniger wahrscheinlich sein.In his Ius Naturae, which is a short commentary on Heinrich Köhler's Exercitationes Iuris Naturalis, Alexander Gottlieb Baumgarten departs significantly from one of Köhler's central theses after spending more than twenty years dealing with this work. Baumgarten dissolves Köhler's identification of the voices of reason, of conscience, of nature, and of God into morality and illustrates, contrary to Köhler's position, that the realms of God and of the earth are completely disjunctive.Baumgarten's position follows from his realization that any possible moral judgment human beings reach is in principle uncertain. Baumgarten characterizes such judgments as acts of imputation, which represent syllogistic conclusions. The certainty of a moral judgment depends, according to Baumgarten, on the certainty of the premises from which it is drawn. Baumgarten develops a differentiated theory of imputing instances, which he calls "fora," depending on the variety of possible types of morally relevant actions and applicable laws. Baumgarten then places these instances in a hierarchy according to the degree of certainty of the conclusions they might reach. He then shows that none of these conclusions on imputation can claim complete certainty, not even one for which one's own conscience subsumes one's own imagination under a law that can be recognized purely from reason. Der Jenenser Philosoph Heinrich Köhler versucht in seinen Exercitationes Juris Naturalis, eiusque cumprimis cogentis, methodo systematica propositi eine rationalistische Begründung des Naturrechts auf der Basis der Metaphysik von Gottfried Wilhelm Leibniz. Die Rekonstruktion dieser metaphysischen Begründung, die mit dem Aufweiß der Erkennbarkeit des obersten Prinzips des Naturrechts rein aus der Vernunft zusammenfällt, ist Gegenstand der vorliegenden Studie. Ausgehend von der Identifikation jenes Erkenntnisgrundes mit der Natur des Menschen zeigt sich vermittels einer Analyse der von Köhler in Anschlag gebrachten Methode, daß (...) diese Begründung unter Ausschluß bloßer empirischer Erkenntnis auf einen metaphysisch fundierten teleologischen Begriff der menschlichen Natur führt. Der verpflichtende Charakter des Naturrechtsprinzips erwächst demnach daraus, daß seine Achtung dem Menschen eine artgemäße Existenz aller erst ermöglicht. Vor diesem Hintergrund erweist sich auch die Schwäche einer solchen Theorie bei der Beurteilung einzelner Handlungen als moralisch, auf die Alexander Gottlieb Baumgarten in seinem Ius Naturae indirekt und kritisch aufmerksam macht. In his Exercitationes Juris Naturalis, eiusque cumprimis cogentis, methodo systematica propositi , the Jena philosopher Heinrich Köhler attempts to provide a rational foundation for natural law based on Gottfried Wilhelm Leibniz's metaphysics. This paper examines a reconstruction of this metaphysical foundation, which coincides with demonstrating that pure reason can recognize the supreme principle of natural law. Assuming that this recognition can be identified with human nature, an analysis of Köhler's methodology shows that if mere empirical recognition is excluded his foundation leads to a metaphysically based teleological concept of human nature. The principle of natural law imposes obligations because only through respecting it can a human being live in a manner adequate for his species. Against this background, the weakness of this type of theory for determining whether an act is moral becomes apparent, which Alexander Gottlieb Baumgarten indirectly and critically notes in his Ius Naturae. A. G. Baumgarten's foundation of aesthetics as a branch of philosophical reflection is itself deeply rooted in Leibnizian metaphysics. From this starting-point Baumgarten comes to a kind of monadological concept of the work of art, that gets now an inexhaustible and thruthrepresenting meaning. This truth of the work of art however cannot be recognized rationally, for it is impossible for human beings to be aware of a beautiful object's 'metaphysical truth', which can only be perceived by the senses as - (...) to quote Baumgarten - 'aesthetical truth'. Still it is possible, by rational and scientific hermeneutics, to transfer some aspects of aesthetical to logical truth. The interest in art is therefore at the same time an interest in the cognition of the metaphysical cosmic order, and Baumgarten's aesthetics similarly are the first foundation of philosophical hermeneutics of art. The opinion that imputation to juridical persons is impossible for reasons of their fictionality is commonly held. Analyzing the topic as it was discussed in the 17th and 18th century by Dadino Alteserra (1602-1682) and Nikolaus Hieronymus Gundling (1671-1729) the paper shows that, firstly, juridical persons are not generated by fiction but abstraction. Therefore, secondly, terms denoting moral persons of such kind are, unlike fictional ones, possible parts of true empirical judgements. As true empirical judgements are presupposed by judgements of (...) imputation imputation to juridical persons is, indeed, possible since juridical persons are possible subjects of true empirical judgements. Vorliegende Studie behandelt die philosophiehistorische Bedeutung und den systematischen Gehalt, den zur Zeit seiner Konstruktion, d. h. in der Epoche des Hellenismus, jener Fall zweier Schiffbrüchiger besitzt, denen zur Rettung nur eine Planke, die nur einen von beiden tragen kann, zur Verfügung steht, welcher als "Brett des Karneades" in die abendländische Geschichte des Rechts wie der Rechtsphilosophie eingegangen ist und als Paradigma der europäischen Notrechtslehre ausgezeichnet werden kann. Im ersten Teil der Untersuchung wird anhand einer philosophiegeschichtlichen Auswertung der Quellen des (...) Falles, Ciceros De officiis und Laktanz' Institutiones Divinae, und ihrer historischen Kontexte die Plausibilität der Zuschreibung der Autorschaft an dem Fall an den akademischen Skeptiker Karneades erwiesen. Im zweiten Teil werden die verschiedenen Varianten des Falles und ihre Lösungen, die sich in den Quellen finden, ausführlich auf ihre philosophischen Prämissen hin analysiert, woraus ihre letztliche Fundierung in dem auf einer empiristischen Erkenntnistheorie gegründeten Begriff des Naturrechts der Alten und Mittleren Stoa hervorgeht. Der abschließende dritte Teil erörtert das kritische Potential des Beispieles, indem er seine zersetzende Wirkung auf alle zu seiner Lösung in Anschlag gebrachten Lehrstücke des stoischen Philosophie aufzeigt und so vor Augen führt, daß mit dem Brett des Karneades wenigstens eine empirische Begründung einer möglichen Naturrechtslehre schon aus epistemologischen Gründen zum Scheitern verurteilt ist. The "Plank of Carneades" is the name that has gone down in the Occidental history of law and legal philosophy to characterize the case of two shipwrecked persons who have one plank that can rescue only one of them. The case can be characterized as the paradigm of the European theory of necessity. This study considers the philosophically historical meaning and systemic content this case had at the time of its construction, namely during the Hellenistic epoch. The first part of the study is based on a philosophically historical evaluation of the sources of this case, Cicero's De officiis and Laktanz' Institutiones Divinae, and their historical context. It shows the plausibility of imputing authorship of this case to the academic skeptic Carneades. The second part exhaustively analyzes the various case constellations and the solutions these sources proffer to them. It considers the philosophical premises underlying these solutions and indicates that their ultimate foundation lies in the concept of natural law as based on the empirical epistemology of the ancient and middle-aged Stoics. The third and final part considers the case's critical potential by demonstrating its undermining effect on all of the teachings of Stoic philosophy proffered to solve it. The study thus shows that for the Plank of Carneades any empirical foundation of a possible theory of natural law is condemned to failure for epistemological reasons. (shrink)

Denn er stellt diejenige Verbindung zwischen dem Handelnden, seiner Handlung und ihren Folgen her, die deren moralische, d. h. ethische oder juridische, Beurteilung erst ermöglicht.

Some combinations of attitudes--of beliefs, credences, intentions, preferences, hopes, fears, and so on--do not fit together right: they are incoherent. A natural idea is that there are requirements of "structural rationality" that forbid us from being in these incoherent states. Yet a number of surprisingly difficult challenges arise for this idea. These challenges have recently led many philosophers to attempt to minimize or eliminate structural rationality, arguing that it is just a "shadow" of "substantive rationality"--that is, correctly responding to one's (...) reasons. -/- In *Fitting Things Together*, Alex Worsnip pushes back against this trend--defending the view that structural rationality is a genuine kind of rationality, distinct from and irreducible to substantive rationality, and tackling the most important challenges for this view. In so doing, he gives an original positive theory of the nature of coherence and structural rationality that explains how the diverse range of instances of incoherence can be unified under a general account, and how facts about coherence are normatively significant. Images and concepts of the 'posthuman' go back at least as far as the famous 'madman parable' in F. Nietzsche's The Gay Science, and their 'roots' go back much further still. In turn, the image or theme of the posthuman has played an increasingly important role in recent literature, film, and television, where the notion of humanity as a 'larval being' (G. Deleuze) that transforms itself or is being transformed into something else, for better or worse, has become increasingly common. (...) This book explores these concepts in relation to biblical texts, particularly texts from the gospel of Mark but also from the books of Daniel, Jonah and Qoheleth (Ecclesiastes), and the Acts of the Apostles. At the same time, texts from recent popular culture are examined, including novels by J. Morrow, C. Miéville and G. Ryman, the movies Local Hero and Lars and the Real Girl, and the Heroes TV series among others. Through a kind of inverted causality, recent texts in various media such as these transform earlier and otherwise unrelated ones, including biblical texts, into precursors, giving them new, postmodern meanings, just as the older texts once signified in still other ways before the advent of the familiar modern world. As a result, biblical texts signify in remarkably different ways in relation to the posthuman. Posthuman beings appear in both biblical and non-biblical texts, and the biblical phrase 'sons of men' (in both plural and singular versions) plays a crucial role, where it too takes on meanings that range far beyond the conventional or traditional ones. In the spring of 2019, a group of Orthodox Christian scholars drawn from a wide variety of academic disciplines met together to offer responses to the moral crisis our generation faces, elaborating upon its various forms and facilitating a fuller understanding of some of its theological and philosophical foundations. In doing so they offer support to all those who question the claims that are so forcefully insisted upon today--a clarity that will aid them in standing up and resisting trends that have already shown to be the cause of great suffering and unhappiness. In the paper, a detailed analysis of some new logical aspects of Cantor’s diagonal proof of the uncountability of continuum is presented. For the first time, strict formal, axiomatic, and algorithmic definitions of the notions of potential and actual infinities are presented. It is shown that the actualization of infinite sets and sequences used in Cantor’s proof is a necessary, but hidden, condition of the proof. The explication of the necessary condition and its factual usage within the framework of Cantor’s (...) proof makes, Cantor’s proof invalid. It’s shown that traditional Cantor’s proof has a second necessary, but hidden as well, condition which is teleological by its nature, i.e., is not mathematical. The explication of the second necessary condition makes Cantor’s statement on the uncountability of continuum unprovable from the point of view of classical logic.One of the most dramatic facts in history of science is connected just with the notion of actual infinity and consists in the following. On the one hand, Aristotle, Berkeley, Locke, Descartes, Spinoza, Gauss, Kant, Cauchy, Kronecker, Hermite, Poincaré, Bair, Borel, Brouwer, Quine, Wittgenstein, Weyl, Luzin, and a lot of other outstanding creators of classical logic and classical mathematics, during millenniums, stated categorically and insistently warned about that the actual infinity is a self-contradictory notion and its usage in mathematics is inadmissible (e.g., according to Poincare, “There is no actual infinity. - Cantorians forgot that and fell into contradictions. Later generations will regard Mengenlehre (set theory) as a disease from which one has recovered”). On the other hand, a lot of outstanding scientists of the XX c.c., such as Hilbert, Church, Turing, Gödel, etc., and modern axiomatic set theory as a whole ignored this (intuitive though) opinion of genii and accepted Cantor’s “transfinite paradise”, based on the actual infinity. In the paper some logical, philosophical, and psychological aspects of this historical “favorable opposition” are analyzed, and the fact that the scientific intuition of genii has won the historical battle against the mytho-’logic’ of Cantor’s transfinite ‘paradise’ is explained and logically justified. Comment developper une phenomenologie de la connaissance qui, tout en restant fidele aux perspectives fondamentales des deux peres fondateurs de la phenomenologie, tire profit des acquis essentiels des deux generations posterieures de phenomenologues? L'auteur se propose de poursuivre le projet d'une refondation de la phenomenologie qui prend au serieux les critiques du fondationalisme (traditionnel) sans pour autant abandonner une perspective visant a legitimer le bien-fonde de tout discours exhibant le sens de ce qui apparait. La these fondamentale est qu'une telle (...) refondation se doit de mettre en son centre non plus la perception objectivante, mais l'imagination (Einbildungskraft) a la source de toute formation ou configuration du sens (Sinnbildung), laquelle constitue la base de tout apparaissant et de tout evenement. L'imagination est ici comprise a la fois comme devoilant la constitution imageante (imaginaire et imaginal) du reel et comme productrice d' images (ou d' icones ) dont il s'agit de preciser la dimension genetique, voire generative, eu egard a plusieurs concepts determinants de la phenomenologie (tels que la verite, la subjectivite, le reel, l' inconscient, le temps, l' espace, etc.). This dissertation examines the theory of perceptual cognition laid out by the 7th century Buddhist scholar, Dharmakīrti, in his magnum opus, the Pramāṇavārttika. Like most theories of perception, both ancient and modern, the sensory cognition of ordinary objects is a topic of primary concern. Unlike other theorists, however, Dharmakīrti advances a technical definition of “perception” as a cognition which is both nonconceptual and non-erroneous. Dharmakīrti’s definition of perception is thereby deliberately inclusive of three additional types of “perceptual” cognition, in addition (...) to veridical sensory awareness: the nonconceptual mental apprehension of an immediately-preceding cognition (“mental perception”), the vivid appearance of soteriologically efficacious objects of contemplative practice (“yogic perception”), and the sheer unmediated presence of the contents of cognition—whatever these might be—to the cognizing mind (“reflexive awareness”). Through the logical examination of what it means to be aware of an object, Dharmakīrti demonstrates that the awareness of an object is just the awareness of a phenomenal form or cognitive image produced by that object. Pursuing this analysis further, however, Dharmakīrti argues that the very notion of an object of cognition that exists “externally” or outside the mind is incoherent. Additionally, Dharmakīrti maintains that the phenomenological structure of subject and object—that is, the “first-personal” sense of one’s own cognitions as pertaining to oneself (“for-me-ness”), together with the inseparably concomitant sense that the objects of cognition exist “out there” in an extramental world—is strictly a form of cognitive error. Therefore, because ordinary sensory cognition is inherently structured by this subject-object duality, ordinary sensory cognition must in the final analysis be understood as erroneous. According to Dharmakīrti, in other words, ultimately only the nondual “luminosity” of reflexive awareness is genuinely perceptual, because only reflexive awareness is undistorted by nature. In this way, Dharmakīrti’s epistemology provides a theoretical foundation for the advanced nondual contemplative practices of Indian and Tibetan Buddhism, particularly Mahāmudrā and rDzogs chen.
