The authors articulate a global public standard for the normative legitimacy of global governance institutions. This standard can provide the basis for principled criticism of global governance institutions and guide reform efforts in circumstances in which people disagree deeply about the demands of global justice and the role that global governance institutions should play in meeting them.

Preventive use of force may be defined as the initiation of military action in anticipation of harmful actions that are neither presently occurring nor imminent. This essay explores the permissibility of preventive war from a cosmopolitan normative perspective, one that recognizes the basic human rights of all persons, not just citizens of a particular country or countries. It argues that preventive war can only be justified if it is undertaken within an appropriate rule-governed, institutional framework that is designed to help (...) protect vulnerable countries against unjustified interventions while also avoiding unacceptable risks of the costs of inaction. The key to ensuring the fairness of rules governing the preventive use of force is accountability.This essay proposes a scheme that would make those promoting and those rejecting the preventive use of force more accountable. The proposal contains the following crucial features:States proposing preventive war are required to enter into a contract with a diverse body of states as a condition for authorization of their actions;Prior to taking preventive action, states must make an evidence-based case to the UN Security Council, and agree in advance to submit themselves to an evaluation by an impartial body after the preventive action occurred;Both proponents of action and those opposing it will be held accountable ex post for the accuracy of their prior statements and the proportionality of their actions;Sanctions will be imposed against intervening states or states that opposed preventive action, respectively, depending on the findings of the ex post evaluation.If preventive action were blocked in the Security Council, states seeking to engage in preventive action could then present their case in a different body–a coalition of democratic states–with its own ex post and ex ante accountability procedures. As global governance institutions proliferate and become more powerful, their legitimacy is subject to ever sharper scrutiny. Yet what legitimacy means in this context and how it is to be ascertained are often unclear. In a previous paper in this journal, we offered a general account of the legitimacy of such institutions and a set of standards for determining when they are legitimate. In this paper we focus on the legitimacy of the UN Security Council as an institution for making (...) decisions concerning the use of military force across state borders. The context for this topic has changed over the last decade as a result of the ongoing development of the responsibility to protect (RtoP) doctrine and extensive discussions about it in the United Nations. Yet the mostly widely accepted proposals for RtoP still require Security Council authorization for forceful intervention, and strictly limit the conditions under which such intervention may take place. We describe food transfer patterns among Ache Indians living on a permanent reservation. The social atmosphere at the reservation is characterized by a larger group size, a more predictable diet, and more privacy than the Ache typically experience in the forest while on temporary foraging treks. Although sharing patterns vary by resource type and package size, much of the food available at the reservation is given to members of just a few other families. We find significant positive correlations between amounts (...) transferred among pairs of families, a measure of the "contingency" component required of reciprocal altruism models. These preferred sharing partners are usually close kin. We explore implications of these results in light of predictions from current sharing models. (shrink)

Wood] Kant's moral philosophy is grounded on the dignity of humanity as its sole fundamental value, and involves the claim that human beings are to be regarded as the ultimate end of nature. It might be thought that a theory of this kind would be incapable of grounding any conception of our relation to other living things or to the natural world which would value nonhuman creatures or respect humanity's natural environment. This paper criticizes Kant's argumentative strategy (...) for dealing with our duties in regard to animals, but defends both his theory and most of his conclusions on these topics. /// [Onora O'Neill] Kant's ethics, like others, has unavoidable anthropocentric starting points: only humans, or other 'rational natures', can hold obligations. Seemingly this should not make speciesist conclusions unavoidable: might not rational natures have obligations to the non-rational? However, Kant's argument for the unconditional value of rational natures cannot readily be extended to show that all non-human animals have unconditional value, or rights. Nevertheless Kant's speciesism is not thoroughgoing. He does not view non-rational animals as mere items for use. He allows for indirect duties 'with regard to' them which afford welfare but not rights, and can allow for indirect duties 'with regard to' abstract and dispersed aspects of nature, such as biodiversity, species and habitats. Critical social theory has long been marked by a deep, creative, and productive relationship with psychoanalysis. Whereas Freud and Fromm were important cornerstones for the early Frankfurt School, recent thinkers have drawn on the object-relations school of psychoanalysis. We argue that developing a human ethics application is an effective method for refining the intent and design of research studies. Our study aimed to investigate the delivery of end-of-life and palliative care nursing to residents of an aged care unit in a Multi-purpose Service/centre in rural Victoria. We used the ethics application process as a strategy to focus the study, and to refine the data collection and analysis techniques. It is our contention that the process of completing the application (...) and gaining ethics approval is laborious; however, the intellectualising that occurs provides researchers with an opportunity to reflect upon and refine their studies, thus ensuring the ultimate success and timely completion of research investigations. We demonstrate that Statistical significance (Chow 1996) includes straw man arguments against (1) effect size, (2) meta-analysis, and (3) Bayesianism. We agree with the author that in experimental designs, H0 “is the effect of chance influences on the data-collection procedure . . . it says nothing about the substantive hypothesis or its logical complement” (Chow 1996, p. 41).

Planctomycetes, Verrucomicrobia and Chlamydia are prokaryotic phyla, sometimes grouped together as the PVC superphylum of eubacteria. Some PVC species possess interesting attributes, in particular, internal membranes that superficially resemble eukaryotic endomembranes. Some biologists now claim that PVC bacteria are nucleus‐bearing prokaryotes and are considered evolutionary intermediates in the transition from prokaryote to eukaryote. PVC prokaryotes do not possess a nucleus and are not intermediates in the prokaryote‐to‐eukaryote transition. Here we summarise the evidence that shows why all of the PVC traits (...) that are currently cited as evidence for aspiring eukaryoticity are either analogous (the result of convergent evolution), not homologous, to eukaryotic traits; or else they are the result of horizontal gene transfers. Background: Genomic analysis may reveal both primary and secondary findings with direct relevance to the health of probands’ biological relatives. Researchers question their obligations to return findings not only to participants but also to family members. Given the social value of privacy protection, should researchers offer a proband’s results to family members, including after the proband’s death? Methods: Preferences were elicited using interviews and a survey. Respondents included probands from two pancreatic cancer research resources, plus biological and nonbiological family members. (...) Hypothetical scenarios based on actual research findings from the two cancer research resources were presented; participants were asked return of results preferences and justifications. Interview transcripts were coded and analyzed; survey data were analyzed descriptively. Results: Fifty-one individuals (17 probands, 21 biological relatives, 13 spouses/partners) were interviewed. Subsequently, a mailed survey was returned by 464 probands, 1,040 biological family members, and 399 spouses/partners. This analysis highlights the interviews, augmented by survey findings. Probands and family members attribute great predictive power and lifesaving potential to genomic information. A majority hold that a proband’s genomic results relevant to family members’ health ought to be offered. While informants endorse each individual’s choice whether to learn results, most express a strong moral responsibility to know and to share, particularly with the younger generation. Most have few concerns about sharing genetic information within the family; rather, their concerns focus on the health consequences of not sharing. Conclusions: Although additional studies in diverse populations are needed, policies governing return of genomic results should consider how families understand genomic data, how they value confidentiality within the family, and whether they endorse an ethics of sharing. A focus on respect for individual privacy—without attention to how the broad social and cultural context shapes preferences within families—cannot be the sole foundation of policy. (shrink)

O presente artigo busca aproximar Adorno de Nietzsche, não como a exaltar ressentimentos e picuinhas, mas como a dialogar aspectos da crítica de ambos a uma cultura igualitária formadora de uma humanidade decaída e violenta, além de dócil e pouco crítica. Como leitor de Nietzsche, Adorno acertou ao indicar os processos de nivelamento social promovidas pelas sociedades econômicas contemporâneas. Assim como sua racionalização instrumental que culminou na barbárie(1939-1945). Exporemos uma crítica que busque diminuir os esteriótipos dos autores aproximando mais, o (...) social, de Nietzsche, e o sujeito individual, de Adorno. No fim, tentaremos demonstrar como o conceito de solidariedade em Adorno não resolve melhor a questão ética, que a avaliação como valor para a construção de valores, sendo a proposição imoralista de Nietzsche, muito mais um recurso provocativo, que uma assertiva de caráter fundamental. O presente artigo pretende fazer uma defesa da matemática, em especial, da matemática pura. Partindo de problemas colocados por Kant no que concerne às condições de um pensamento puro a priori, seguindo por indagações promovidas por Leibniz no sentido da construção de uma linguagem artificial capaz de acessar de forma mais segura o mundo, e atormentados pela desconexão estrutural entre a linguagem humana natural e o mundo, elencada pelo debate da Filosofia da Linguagem promovida pela Tradição Analítica, se quis realizar (...) uma investigação no sentido de procurar um conhecimento que fosse essencialmente a priori. Apesar do projeto logicista de Frege, ainda não foi possível uma linguagem totalmente artificial que expressasse o mundo sem suas ambiguidades. Entretanto, pistas indicam que a matemática pura, que tem como substrato a lógica, é uma linguagem formal poderosamente capaz de construir axiomas. (shrink)

This is an excellent resource for scholars of Continental philosophy, philosophy of religion, and American pragmatism.

The history of human subjects research and controversial procedures in relation to it has helped form the field of bioethics. Ethically questionable elements may be identified during research design, research implementation, management at the study site, or actions by a study’s investigator or other staff. Post-approval monitoring (PAM) may prevent violations from occurring or enable their identification at an early stage. In U.S.-initiated human subjects research taking place in resource-constrained countries with limited development of research regulatory structures, arranging a site (...) visit from a U.S. research ethics committee (REC) becomes difficult, thus creating a potential barrier to regulatory oversight by the parent REC. However, this barrier may be overcome through the use of digital technologies, since much of the world has at least remote access to the Internet. Empirical research is needed to pilot test the use of these technologies for research oversight to ensure the protection of human subjects taking part in research worldwide. (shrink)

O objetivo deste artigo é analisar a ampliação do conceito de cidadania em sua aplicação aos animais não-humanos e a relação com a ideia de sociedade decente e civilizada. Para isso, parte-se das discussões sobre os direitos dos animais na obra Zoopolis: a political theory of animal rights, de Sue Donaldson e Will Kymlicka. Ao contrário de teorias que enfatizam basicamente os aspectos negativos dos direitos animais, ou seja, o direito de não sofrer danos, não ser torturado etc., o presente (...) trabalho fundamenta um aspecto mais positivo do direito, priorizando deveres e obrigações em relação aos animais para além da perspectiva ética. Essa questão leva ao desenvolvimento de uma perspectiva política do conceito de cidadania aplicado aos animais partindo do princípio de que os espaços geográficos e públicos são compartilhados e, assim, as inter-relações entre humanos e animais são inevitáveis. Nesse sentido, o presente artigo analisa esse conceito de cidadania animal e o reflete juntamente com os conceitos de humilhação e sociedade decente e civilizada de Avichai Margalit. Por fim, busca-se fundamentar uma perspectiva homo-zoopolitica da sociedade que inclua os animais nos princípios políticos. (shrink)

FINANCIAMENTO DE PESQUISA: PNPD/CAPES A relação entre imaginação, moralidade, política e literatura: uma análise a partir de Adam Smith e Martha Nussbaum Resumo: Este artigo analisa relação da imaginação com a moralidade e a política através da literatura. Parte-se da reflexão sobre o papel da imaginação na sociabilidade e na simpatia moral, segundo Adam Smith. Para o autor, a capacidade de compreender e sentir o que ocorre com o outro exige um exercício imaginativo. Smith considera que a simpatia moral está (...) inseparável da imaginação. Essa questão é ampliada a partir do conceito de imaginação literária ou narrativa desenvolvido por Martha Nussbaum. Para a autora, a capacidade da imaginação pode ser cultivada através da literatura, pois ela possibilita a experiência de vivenciar emoções e compreender situações alheias. Isso promove e amplia uma imaginação moral capaz de proporcionar um entendimento mais amplo das relações humanas. Assim, este artigo sustenta que as humanidades e, em especial, a leitura literária, propicia uma espécie de experiência moral e uma reflexão ética e política. Isso confere à literatura um valor educacional, pois ela é capaz de promover as qualidades de uma cidadania condizente com a sociedade democrática pluralista e cosmopolita. A proposta aqui desenvolvida oferece elementos para se pensar a ética, a política e a educação na sociedade atual, valorizando e resgatando as humanidades e a cultura literária. The relation between imagination, morality, politics and literature: an analysis from Adam Smith and Martha Nussbaum Abstract: This article analyzes the relation between imagination, morality and politics through literature. We start with a reflection on the role of imagination in sociability and moral sympathy, as understood by Adam Smith. For the author, the ability to understand and feel what happens to another requires an imaginative exercise. Smith considers that moral sympathy is inseparable from the imagination. This question is amplified from the concept of literary imagination or narrative developed by Martha Nussbaum. For the author, the capacity for imagination can be cultivated through literature, as it allows the experience of emotion and understand other people´s situations. This promotes and broadens a moral imagination, capable of providing a broader understanding of human relationships. Thus, this article maintains that the humanities and, especially, literary reading, provides a kind of moral experience and an ethical-political reflection. This gives literature an educational value, as it is capable of promote the qualities of a citizenship consistent with the pluralist and cosmopolitan democratic society. The proposal developed here offers elements for thinking about ethics, politics and education in today's society, valuing and rescuing the humanities and literary culture. Para el autor, la capacidad de imaginación se puede cultivar a través de la literatura, ya que permite a las personas experimentar emociones y comprender las situaciones de otras personas. Así, este artículo sostiene que las humanidades, y especialmente la lectura literaria, proporcionan una especie de experiencia moral y una reflexión ético-política. Esto le da a la literatura un valor educativo, ya que es capaz de promover las cualidades de una ciudadanía consistente con la sociedad democrática pluralista y cosmopolita.
